The decision was made public yesterday when the Little Brown Jug Society announced that the connections of the sport's top 3-year-old pacer had informed them their horse would pass the $550,000 race. Led by Myron Bell, the Captaintreacherous team has been very careful about how it has raced its horse this year, and the Jug, a race on a half-mile track that involves heats, never seemed to be a good fit for this cautious group. Bell said it wasn't so much the heats or the track circumference, but the scheduling of the Jug that led to their decision. "We would have loved to race him there but it's all about scheduling," said Bell, who manages the Captaintreacherous stable. "We want him to have a good meet at the Red Mile, and he will hopefully race twice there. We didn't win the Breeders Crown last year and want to win it this year. That's on our agenda, to go back to Pocono and win the Breeders Crown, and maybe the TVG Pace at the Meadowlands. We have to race him as 4-year-old because of the new rules. The only reason we are not going to the Jug is that we can't make every dance. "I am not here to chastize the Jug. The Jug has been a big part of my life and we love the Jug . I don't want to take anything away from it. Just because we're not racing in it this year With Captaintreacherous doesn't mean we won't race in it in other years. The Captain has to race as a 4-year-old and we've made every dance this year so far but the Adios. We can't make them all." The Captaintreacehrous team will be represented by his stablemate, Wake Up Peter, in the Jug. Little Brown officials weren't shy yesterday about hiding their disappointment. "The officials, staff, volunteers of the Little Brown Jug have been preparing to put on a great week of racing and we are going to fulfill that promise," noted Tom Wright the Director of Racing and the President of the Little Brown Jug Society in a statement. "Almost all of the greatest three-year-old pacers have won or competed in the Little Brown Jug...Good Time, Albatross, Bret Hanover, Niatross, Nihilator, Rock N Roll Heaven. We will be very proud to put the name of another champion on the Little Brown Jug." Wright added, "While we are disappointed in their decision, we are more disappointed for the fans. In a sport that could use positive press, we had a tremendous opportunity to showcase a great horse in front of 40,000 plus fans." The next definite start for Captaintreacherous will come in the 9-28 Bluegrass at the Red Mile and he is likely to come back a week later in Lexington in the Tattersalls. Bell said Captaintreacherous could race next weekend but declined to specify, saying only that he may have a race "on a mile track." If not, Bell added, he will have a qualifier. Captaintreacherous' sire, Somebeachsomewhere, also passed the Jug. Captaintreacherous has raced just eight times this year and will have missed the Adios and the Jug, something that would have been unheard of 20 years ago. But the top standardbreds are being managed more carefully than ever these days, and the decision to sit out the Jug is just another example of that. "That shows you how great a horse he was. I can't do that tothe Captain. There is a lot of money at stake ane he's astallion. I don't want to do anything to diminish his value.When you have a horse of this magnitude you have to becareful how many starts you give them. They are becominglike thoroughbreds. Thoroughbreds race four five times ayear and no one gives them flack about that." Should Captaintreacherous win the Breeders Crown hewill be invited to the TVG Pace at the Meadowlands, wherehe would face older horses. Bell said that race is apossibility. "It's there and we know about it," he said. "First he has toearn it by winning the Breeders Crown, which won't beeasy."

parked co-favorite A Rocknroll Dance around the first turn,forcing driver Kayne Kauffman to take a tuck as the openingpanel went in :25 seconds.Pet Rock and A Rocknroll Dance led the way to the half in:52.4 and then Our Lucky Chip launched a futile attackagainst the leader. The three-quarters was 1:20.1 and Pet Rock rolled into thestretch on top. A Rocknroll Dance came out for the drivebut was unable to catch the leader. Sweet Lou finished third. The winner is trained by Scioto training champ VirgilMorgan, Jr. and owned by Frank Bellino. Buckeye State racing fans delighted in seeing the eightfinals of Ohio Sires Stakes competition, each race contestedfor a $150,000 purse. The star of the night in the Ohio Sires Stake wasContessa Leigh, winner of the 3-year-old filly trot in whatamounted to little more than a training mile. The headstrongfilly marched to the front immediately after the start andintimidated her pursuers. When it appeared that some drivers might think ofmounting a challenge, driver Chip Noble loosened the lineson Contessa Leigh and she was gone. The others wereracing for minor spoils as she eased to the wire in 1:57.1.

It was her eighth win in nine races this year andcompleted her sweep of four preliminary legs and the final.She is trained by trotting master Marty Wollam, whoco-owns her with G&B Racing. Diplomats Mistress was second and TT’s Megapixel wasthird. Rompaway Galaxy also completed his sweep of OhioSires Stakes action for 2-year-old trotting males for driverMike Micallef, trainer Krista Williams, and RompawayFarms of Michigan. Your So Vain, withScott Zeron, pulledoff a major upset inthe first elim, rallyingfrom last to blow pastthe pacesettingHambletonian winnerand 2-5 favouriteRoyalty for Life nearthe wire to score byone and one-quarterlengths in 1:52.4. Smilin Eli was third,

another length back. Master of Law, also driven by Zeron, challenged thepacesetter Corky around the far turn and then prevailed ina stiff drive, holding off a late bid from Punxsutawney forthe neck win in 1:53.4. Wheeling N Dealin was third, oneand three-quarter lengths behind, while Corky faded tofourth. The best three-year-old trotters in North America were ondisplay in the elims, with the top five finishers qualifying fornext Saturday’s $686,000 CTC final, which has been wonrecently by such stars as Market Share, Muscle Hill,Donato Hanover and Deweycheatumnhowe, allHambletonian winners to boot. The elim winners also earned their connections the rightto choose a post position before the balance of the fieldwas drawn. Your So Vain, trained by Brad Maxwell for PG Van CampStables of Port Perry, Ontario, was winning his third start inseven outings this year and entered off a dominatingperformance in last week’s Simcoe Stakes. “He’s always had the ability, but there’s always been anissue,” said co-owner Paul Van Camp. “I think Brad’s gotthe issues fixed. Your So Vain paid $11.40, $3.60 and $2.10, combiningwith Royalty for Life ($2.20, $2.10) for a $25.20 (1-5)exactor. A 1-5-3 (Smilin Eli, $2.10) triactor was worth$60.20. Master of Law, the 3-5 choice trained by Frank Antonaccifor U.S. interests, was winning his sixth consecutive start,after making a break in his debut. The son of anotherHambo-CTC winner, Deweycheatumnhowe, out of PossessThe Magic, came into his elim off an impressive eightlength score in a Kentucky Sires Stake on September 1 atLexington. Corky had taken over after the first quarter and led to thehalf in 56.2, but Master of Law came calling turning forhome and opened a length after three-quarters in 1:25.3,before repulsing the late rail bid from Punxsutawney. “When you’re sitting there at 2-5, everyone wants tofollow you,” explained Zeron. “I was fine with coming firstup. I just didn’t want to have to put him up front againtonight. “I know how talented he is, so does Frank, even at thebeginning of the year. But he just wanted to take his time

He impressed and he did again tonight. He’s very tough to handle but it’s (best quality) his absoluteendurance. He can go all day and I like him chasing horses. He likes to mow them down.” Master of Law paid $3.30, $2.50 and $2.20, combiningwith Punxsutawney ($7.20, $4.50) for a $22.30 (5-6)exactor. A 5-6-7 (Wheeling N Dealin, $4.10) triactorreturned $99.50. Report: Barbara Galbraith Facing Animal Cruelty

Charges

Barbara Galbraith, the wife of famed horseman ClintGalbraith, has been charged with three counts of failure toprovide sustenance to an animal, the Rochester Democratand Chronicle reported in yesterday’s editions. The chargesare misdemeanors and each count carries a maximumsentence of nine year in jail and a $1,000 fine.

According to thepaper,investigatorsexecuted searchwarrants onThursday andseized five horsesthat Galbraith hadmoved from herfarm recently. “When wearrived at herproperty on Aug.28, we found watertroughs that werecompletely dry,

and they didn’t have access to other water,” AdrienneMcHargue, director of communications and outreach atLollypop Farm, the Humane Society of Greater Rochester,told the paper.

The paper’s report included the following description ofthe situation at the Galbraith farm: Rodney Farms has aproud history: Two-time Horse of the Year Niatross trainedthere under Galbraith’s husband, harness racing Hall ofFame reinsman and trainer Clint Galbriath. Niatross’ success elevated Clint and the farm to the topof the racing game, and helped the farm expand to morethan 120 racing horses, Barbara said. The racing horsesand brood mares nearly filled the 208-stall main barn and20-stall receiving barn. Each 12-by-12 stall was equippedwith automatic waterers and individual infrared heaters. But the farm has struggled for years, and Clint Galbraith’sserious head injury a few years ago made the alreadyshaky two-person operation untenable. The cost and workload of running a working horse farmand breeding operation has been overwhelming, BarbaraGalbraith said earlier this year. Massive holes in the roof of the once beautiful main barnlet in the snow and wind. Most of the 200 stalls havebroken doors and bent bars; only about 30 are usable.”

Driven by JimMorrill Jr., He’s Watching took control as the field passedthe wire for the first time and would open by six lengthsafter going the three-quarters in 1:25.3. All Bets Off, a 39-1shot by Bettor’s Delight, made a race out of it and Morrillhad to work a bit to hold him off in a three-quarter-lengthwin. Over a track listed as “good” He’s Watching set a trackrecord, winning in 1:54.2. Gold Rocks captured the $96,200 Babic Open in 1:54.4while Ideal Helen annexed the $61,900 Babic Filly in astakes record 1:54.3. Both stakes are for New Jersey-sired two-year-oldpacers. Gold Rocks [$2.20], a son of Rocknroll Hanover, wasable to repel the challenge of Useful Hanover [by WesternIdeal, to win by four and a half lengths in the ninth race. Rocknroll Reality [by Rocknroll Hanover] was third byseven and a quarter.

George Brennan was at the lines of the TonyAlagna-trained Gold Rocks, sent off at odds of 1-9. The coltpaced the mile in a career best 1:54.4. Gold Rocks picked up his second straight win in four triesand lifted his earnings to $59,400 for Eagle Soar Partners,Alan Alber, Joe Sbrocco and Mystical Marker Farms. Ideal Helen overcame a restart to win the Babic Filly, thethird race, by three-quarters of a length over Beautiful Lady[Rocknroll Hanover], whose broken equipment caused therecall. Rosie De Vie [Western Ideal] was third by eight anda half. Ideal Helen, a daughter of Western Ideal, settled into atwo-hole trip until Marcus Miller sent her after BeautifulLady, who cut the fractions. The final time of 1:54.3eclipsed the stakes record of 1:55.1 set by Happy Dreamerin 2007.Ideal Helen now has three wins and two seconds in eighttries. Update on Cat Manzi & Jeff Gregory Both Cat Manzi and Jeff Gregory remain hospitalized withfractures suffered in a racing spill in Friday’s fourth race atFreehold Raceway. Hall of Famer Manzi suffered breaks on both sides of hispelvis. His wife, Ellen, reported Saturday morning that hewas in a lot of pain, needed to sleep and not up to receivingvisitors. Gregory underwent a lengthy surgery on Friday night torepair a broken left elbow. “It was very difficult [surgery],” said Gregory’s wife,Helene. “The surgeon said he had to call in a second doctorto help get all the pieces together. The bone was shattered. But he said they got him wired up and screwed tight so hesounded optimistic.”

On The Metro Non-DQ As someone who watched the race online and had nowagering interest in the result, I thought the decision wascorrect. That being said, I wonder if the judges' decisionwould have been different had one of the adversely affecteddrivers had filed an official objection. Even the trackannouncer specifically remarked several times that this wasa judges' inquiry and that no objection had been made byany of the drivers involved.

Maybe they felt that the infraction was so obvious andegregious that they did not object, assuming the judgeswould correct the situation. Maybe the drivers are all personally so close that theydon't like to "snitch" on one of their own, knowing thatsituations arise all the time during the course of racing andthings even themselves out in the long run. Perhaps if several of the drivers had lodged objectionsthen the judges would have been forced to be moreaccountable.
