We couldn’t have done it without YOU! The people of Michigan will have direct access to physical therapy January 1, 2015! Why now? Why this time? In a phrase: Politics, Timing and Context. This sums it up and MPTA has been crucial throughout the process. Politics: We have all learned the process for a bill to become a law. At the MPTA Spring meeting we had a throw-back moment viewing Schoolhouse Rock’s “I’m just a Bill.” But first, we needed a primary bill sponsor. Sen. John Moolenaar stepped up to the plate, sponsoring SB 690. How did we find him? Evie Sweeney, MPTA’s lobbyist, did a masterful job vetting potential sponsors. Political process can include multiple “workgroups” with multiple stakeholders to draft the bill and testimony by MPTA before committee. There were challenges to the bill, stakeholders stepping forward to state they opposed the bill or wanted amendments. A big win occurred when the MPTA, Michigan State Medical Society and Michigan Orthopedic Society united in support of SB 690. Timing: Sometimes the timing is just right. MPTA Members... We couldn’t have done it without YOU! The people of Michigan will have direct access to physical therapy January 1, 2015! Why now? Why this time? In a phrase: Politics, Timing and Context. This sums it up and MPTA has been crucial throughout the process.

Politics: We have all learned the process for a bill to become a law. At the MPTA Spring meeting we had a throw-back moment viewing Schoolhouse Rock’s “I’m just a Bill.” But first, we needed a primary bill sponsor. Sen. John Moolenaar stepped up to the plate, sponsoring SB 690. How did we find him? Evie Sweeney, MPTA’s lobbyist, did a masterful job vetting potential sponsors. Political process can include multiple “workgroups” with multiple stakeholders to draft the bill and testimony by MPTA before committee. Senate Bill 690 introduced by Senator John Moolenaar (Midland) was signed into law by Governor Rick Snyder on July 1, 2014, becoming Public Act 260. Direct Consumer Access becomes

effective January 1, 2015. The passage of this legislation and the 4 tie-barred insurance bills are the culmination of decades of work. I cannot possibly mention all of those who have put in a tremendous amount of work and effort to make this a reality. I would like to express gratitude to State Representative Margaret O’Brien (Portage) for her tireless advocacy, the lobbying firm of Muchmore Harrington Smalley & Associates (Evelyn Zois Sweeney in particular), the Michigan State Medical Society as well as the Michigan Orthopaedic Society for their collaboration, and most importantly the general membership of the MPTA for their grassroots activities. The final outcome of Public Acts 260-264 is as follows:

• allows direct access to physical therapy for 10 visits or 21 days, whichever first occurs, without a physician prescription/referral;

• physical therapy received through direct access beyond that limit would require a physician prescription/referral;

• an individual accessing physical therapy for promoting fitness and/or injury prevention is not subject to any limits;

• Insurers are not required to reimburse for physical therapy services obtained through direct access.

The passage of this legislation will help the people of Michigan access the care they need directly from the provider who can best meet their needs. MPTA will continue to work to educate consumers, insurers and other health care professionals of the benefits of Direct Consumer Access. Continue to look to MPTA for updates and plan to attend the MPTA conference October 24-25 in Kalamazoo, where we will have a panel discussion on Direct Consumer Access.

While we celebrate the success of Direct Consumer Access, we are mindful of ongoing reforms on the federal level. APTA published a response to the Centers of Medicare & Medicaid Services proposed rules for Inpatient Rehab and Skilled Nursing Facilities. Please visit APTA.org for details. Additionally, APTA continues to work for the membership in the areas of Functional Limitations Reporting and Physician Quality Reporting System, among others. Please download APTA’s Advocacy app to your smart phone for important access and updates. Physical Therapist professionals continue to be leaders in quality, cost-effective care, and your ongoing support of the association is appreciated! ■

It is my pleasure to serve on the MPTA Board of Directors as Director #2 - Professional Development and Membership during this exciting time of change including the passage of Direct Consumer Access to Physical Therapy and progress towards developing new professional standards for the profession in Michigan.

MANDATORY CONTINUING COMPETENCE - PUBLIC ACT 55-2009The Board of Physical Therapy passed new PT Administrative Rules and they are currently posted on-line http://www7.dleg.state.mi.us/orr/Files/ORR/1124_2012-116LR_orr-draft.pdf. Please reference the bolded text under Part 5. Continuing Professional Development. The list of activities looks to be very comprehensive and the state PT Licensing board should be commended for their work on this important document.

There will be a public hearing on the new Rules, but no date has been set. The public hearing is part of the legislative oversight process that occurs via the Joint Committee on Administrative Rules (JCAR). Final approval of the new rules should take about a year, so no implementation date for mandatory continued competence for re-licensure of PTs and PTAs has been established.

Professional membership is key to remaining informed about professional development standards and taking advantage of Direct Consumer Access to PT opportunities as our profession evolves in the state of Michigan. Now that Direct Consumer Access is on the horizon, it has opened up several areas of focus for the MPTA reimbursement committee. We will be meeting with Blue Cross Blue Shield of Michigan on August 27 and will follow with other insurers to work through issues to ensure reimbursement for treatment rendered under direct access. Insurance companies are putting more emphasis on measuring outcomes. Medicare is trying to standardize measurement tools in post-acute settings; Priority Health has been using web outcomes to compare providers in their network and have promised bonus payments for highest rated providers; and BCBSM is considering similar initiatives. United Healthcare has announced that, starting August 1, they will be requiring Functional Limitation Reporting for their Medicare Advantage clients. Please ensure that your documentation and billing systems are prepared for this.Stay tuned to both MPTA and APTA where the latest information is presented to keep your businesses viable through this period of unprecedented change. While the MPTA has been busy working on getting Direct Access legislation passed, APTA has continued their diligent work on federal issues. Here is a snap shot of regulatory and congressional updates:

• Of concern are provisions in the inpatient rehabilitation facility (IRF) proposed rule, which would require physical therapists to report group therapy and individual therapy separately on sections of the IRF-PAI. APTA is opposing the implementation of this reporting requirement and suggesting that CMS conducts a research project to learn about these treatments in the IRF setting. There are also proposals for future quality measures in the IRF setting. CMS will continue to consider all comments submitted until August 1, 2014

• APTA thanks CMS for its work to create an alternative therapy payment method, wants the inclusion of a standardized assessment tool, and a universal therapy payment model across all post acute care settings.

• APTA is also making recommendations regarding the 2-midnight admission criteria, short stays, and

observation status. They are requesting that therapy services provided stay exempted from the outpatient therapy requirements of FLR and therapy cap. They are in the process of making recommendations to improve long term care hospital reporting.

• Final rules for the Physician Fee Schedule and Home Health Prospective Payment System will be released in November. Proposed rules with can be found at www.apta.org and type in fee schedule proposed cy 2015

• APTA did Pilot Testing for the new CPT codes during the NEXT conference to see if there was consistency among therapists in the selection of the CPT codes for similar case studies. More pilot tests and the results will follow.

• APTA continues to encourage members to download the APTA Action App. Currently, only 2800 APTA members have done so. We really want to bring this number up since this will be an easy way for those who do not have a lot of time to help with our legislative efforts.

CHIEF DELEGATE REPORTAPTA HOUSE OF DELEGATESBy Cam Williams DPT, PT, MS

The 2014 House of Delegates meeting in Charlotte, NC was a productive and successful meeting. Year round governance strategies are helping to make the House meeting even more productive as many motions are more extensively vetted, edited and otherwise perfected prior to the meeting. We also welcomed the new APTA CEO, J. Michael Bowers, to his first House of Delegates. As well, the APTA showed its deep appreciation for outgoing officers of the APTA that provide focus for our profession.

There were several motions passed this year. The following is a summary of motions of significance:

RC 22-14 RESCIND PHYSICAL THERAPIST RESPONSIBILITY AND ACCOUNTABILITY FOR DELIVERY OF CAREPhysical Therapist Responsibility and Accountability for the Delivery of Care (HOD P06-12-06-08), is rescinded.By rescinding this policy, the APTA has reverted to its previous position that “… Physical Therapist Assistants are the only individuals who provide selected physical therapy interventions under the direction and at least general supervision of the physical therapist.”

RC 7-14 ENTRY POINT INTO HEALTH CAREAmends current position to state, “Physical therapists are entry point providers into the health care system.”

RC 8-14 TELEHEALTHCreates an APTA position that telehealth is an appropriate model of service delivery for the profession of physical therapy when provided in a manner consistent with other existing APTA documents.

RC 9-14 PURSUIT OF REGULATORY DEGREEAPTA shall begin to pursue a uniform change in the regulatory designation of physical therapists in all states to “DPT” by the year 2025.

RC 11-14 MEMBERSHIP VALUE FOR THE PHYSICAL THERAPIST ASSISTANTAPTA will create a plan for increasing the value of APTA membership for the physical therapist assistant (PTA) and present the plan to the 2015 House of Delegates by December 2014.

RC 16-14 TOOLS TO NEGOTIATE PRODUCTIVITY AND PERFORMANCE STANDARDSAPTA will identify and develop resources that equip PTs and PTAs to negotiate successfully in establishing an agreed upon conceptual framework of productivity and performance to ensure the provision of quality physical therapy care with a report to the 2015 House of Delegates.

HEALTH PROFESSIONAL RECOVERY PROGRAMBy: Susan Ann Talley, PT, DPT, C/NDT, PhD(c) Physical Therapy Representative, HPRC

Health care professionals are not immune to substance use and/or mental health disorders by virtue of their training or experience. These conditions can lead to impaired practice and the loss of health or life for the health care professional. Research shows that many otherwise highly qualified health care professionals may develop these problems due to stress, long hours, a genetic disposition, and/or a tendency to self-medicate.

The State of Michigan’s Health Professional Recovery Program (HPRP) was established by legislation in 1994. It is administered by the Michigan Department of Licensing and Regulatory Affairs. The Health Professional Recovery Committee (HPRC), comprised of members of

each licensed health profession, oversees the program.

The HPRP is designed to support the recovery of health professionals in order to protect the safety of the public and to assist participants to return to practice, if appropriate. This program is confidential – this means that if a licensee is referred to the program, has a qualifying diagnosis, and complies with all of the program requirements, the person’s name will not be disclosed to state regulatory authorities or to the public.

Michigan health care professionals supported by the HPRP include those applying for, or who are actively licensed, registered or certified in any of the following licensing boards:
