0. EXECUTIVE SUIMLVARY

Duc Trong 220kV substation and its connection lines include these components: + Duc Trong 22011 lOkV substation has the capacity of 2xl251MVA with . + Construction and installation of connecting line: the 220kV connection line (two routes) with the 1,100m length and the 1 lOKV connection line (two routes) with the 6,000m length. In the project area, there are many ethnic minorities such as the Churu and K'Ho mainly living at Chi Rong A hamlet, Phu Hoi commune, the Tho and the Chinese scattering in Ward 2, 12, Lien Nghia township. Implementing the project components, there will be impacted on local people bec.ause land acquisition required for tower foundations and tree chopping in ROW. However, the project does not cause permanently affected houses; therefore, involuntary resettlement is not required.

0.2 SOCIO-ECONOMIC STATUS OF ETHNIC MINORITY IN THE PROJECT AREA

Ethnic minorities in the project area are Chu Ru, Tho, K'Ho, and Chinese people who are living intermix with Kinh people in Duc Trong district, Lam Dong province. Chu Ru EM is one of the communities whose language stems from the Malayo - Polynesian. The population of Chu Ru EM is quite small; they mainly live in Lam Dong, Ninh Thuan and Binh Thuan province. Tho language belongs to the Viet - Muong system. These people mainly live at the west of Nghe An. Its population is about 5 1,000 people. K'Ho people are over 92,190, and language's one belongs to Mon -- Kho Me system (Nam - A family). These people mainly lived long - standing at Tay Nguyen, then migrated to Lam Dong. Some specific production tools are yoas (chop down a tree), plough, rake and Kor (level the field). . . The percentage of Chinese people in Vietnam is 1.13% Vietnamese population and is ranked in the fourth position. In Lam Dong province, Chinese people are over 12,000. Most of Chinese people in Lam Dong are those who migrate from Quang Ninh in 1955 - 1975. Those people are a part of Chinese people who did farming in Quang Ninh and later set up their house in Lam Dong.

0.3 LEGAL FRAMEWORK

This plan is developed based on policy OP 4.10 of the World Bank on indigenous people (previous as OD 4.20) and policies for EM of GOV. A policy framework and guidelines for EMDP has been prepared for TD2 project to ensure that ethnic minorities are well informed, consulted and mobilized to participate in the sub-projects to be supported by the TD2 project.

0.4 PROJECT IMPACT ON ETHNIC lMINORITY

The project will affect Chu Ru EM people and K' Ho EM people in Chi Rong hamlet, Phu Hoi commune, Chinese EM people in Lien Nghia town, and Tho

EM people in Lien Nghia township, Duc Trong district, Lam Dong province. There are 13 Chu Ru EM households (64 people), 14 Chinese EM h.ouseholds (68 people), and 18 Tho ELM households (88 people) affected.

0.5 PEOPLE'S PARTICIPATION

During the project preparation (along with RP preparation), Management Board and consulting companies have held many community meetings at the commune level in the project area with the participation of DPs and representatives of Commune People's Committees, authorities and non- governmental organisations (Women's union, youth organisation, farmers' union, fatherland front, veterans7 organisation, etc.) In these meetings, project related issues i.e. investment financial resources, project objectives, project components, compensation policy, allowances, etc. are explained by consulting institutions.

0.6 INSTITUTIONAL ARRANGEMENT

To implement this EMDP smoothly, PMB will: - Assigning adequate number of staff for ElMDP implementation. - Contracting with skillful experts for EMDP implementation. - Setting up offices at the site for advantageous implementation.

- Periodically monitoring the EMDP implementation. - Transparency in implementation through information campaign. - Ensuring that EM leaders (elders and those who prestigious on publicity) are

represented in local EMDP committees.

0.7 DEVELOPMENT ACTIVITIES

The plans are not only for EM DPs who are directly affected by land acquisition but also for the EMS who are living in the project affected areas. As mentions in RP, this ElMDP is developed based on the results of consultation with and participation of EM and their local authorities. Special resettlement provisions for ethnic minorities to ensure consideration of impacted ethnic people's views on various issues and to represent their legal rights.

0.8 IMPLEMENT ARRANGEMENT

The EMDP implementation program will be carried out in parallel with the RP implementation program. The details of implementation arrangement are described in Chapter 8 of the RP report of this project.

0.9 MONITORING AND EVALUATION

The implementation of RPElMDP shall be constantly supervised and monitored by PMB in co-ordination with local People's Committees.

Iluc Trong 220kV Substation and connection line -- p-p.--

An independent monitoring agency will bc entrusted with extcrnal rnonitoring tasks of RP and ElMDP implementation. The selection of this agency will be submitted to the approval of PMB and WB. The selected independent external monitoring agency shall be contracted by the PMB right after RPIEMDP approval and shall begin supervision and rnonitoring activities from the beginning of the implementation phase.

0.10 COST AND FINANCING PLAN

Total cost of project is (including contingency - 20%) 22.800.000.

1. INTRODUCTION

1.1 The project

Duc Trong 220kV substation project is proposed to be built to strengthen capacity 1 lOkV supplying power for Lam Dong province in the next project stage, especially the north of the province (zone 1) including: Dalat city and Duc Trong, Don Duong, Lac Duong, Lam Ha and Dam Rong districts. The duty of Duc Trong 220kV substation is to receive power 220kV from Da Nhim hydroelectric power plant and 5001200kV Di Linh station through the line 220kV Da Nhim - Di Linh - Bao Loc transmission line and provide 1 lOkV power to the additional charge of the north of Lam Dong Province.

Duc Trong 220kV substation and its connection lines include these components:

+ Duc Trong 22011 10kV substation has the capacity of 2xl25h4VA. The first stage will set up 1 x 125MVA. Duc Trong 220kV substation is scl~eduled to build at Chi Rong A hamlet, Phu Hoi commune, Duc Trong district, Lam Dong province.

+ Construction and installation of connecting line

- The 220kV connection line (two routes) with the 1,100m length starts from tower of the substation's gate to T115 - TI 16 tower of the Da Nhim - Di Linh 220kV existing transmission line and goes across the area of Phu Hoi commune.

- The 1 lOKV connection line (two routes) with the 6,000m length starts from tower of the Duc Trong substation's gate to No.3 tower of the Da Nhim - Duc Trongl 1 OkV existing transmission line and goes across Lien Nghia township and a part of Phu Hoi commune.

In the project area, there are many ethnic minorities such as the C:huru and K'Ho mainly living at Chi Rong A hamlet, Phu Hoi commune, the Tho and the Chinese scattering in Ward 2, 12, Lien Nghia township. Implementing the project components, there will be impacted on local people because land acquisition required for tower foundations and tree chopping in ROW. However, the project does not cause permanently affected houses; .therefore, involuntary resettlement is not required.

1.2 Ethnic Minority Development Plan

As mentioned above, implementing the project components, local people will be affected because land acquisition is required for the tower foundations, substation, road into the substation and tree chopping in ROW. Although there is special try in design, proposed construction measures and construction schedule to reduce adverse impacts on the local communities, particularly the ethnic minority, some adverse impact on land acquisition would be unavoidable. These adverse impacts to individuals are not significant: most of land is temporarily affected, while some agricultural land of ethnic minority households could be permanently revoked for tower foundations and substation.

The EMDP is developed to ensure that the project subcomponents would not cause any traditional culturally specific impact on the affected EM13 and the nature of impacts does not result in community-wide socio-economic effects. The EMDP also ensures that the development process foster full respect for dignity, human rights and cultural uniqueness of the EMS and the,y will not suffer adverse effects during the development process and that they will receive culturally compatible social and economic benefits.

The plans are not only for DPs who are directly affected by land acquisition but also for the EMS who are living in the affected project areas. As mentions in RP, this EMDP is developed based on the results of consultatior~ with and participation of affected EMPs and their local authorities.

1.2.1 Policy framework for ethnic minority

The TD2 project has prepared an Policy Framework and guidelinesjbr EMDP. The guidelines seek to ensure that ethnic minorities are well informed, consulted and mobilized to participate in the sub-projects to be supported by Transmission and Distribution I1 Project. Their participation can protect them from any potential adverse impacts of sub-projects to be financed blyr the TD2 Project. This ElMDP is prepared based on this guidelines.

(Pls. see Appendix 2 for Policy Framework and guidelines for EMDP - TD2 project).

1.2.2 Ethnic minorities in Vietnam

In Vietnam, the indigenous people, particularly the ethnic minority people are commonly among the poorest groups and have limited benefits from social development. They are vulnerable to the appearance of possible physical impacts by their land occupation for the infrastructure project or social impacts due to the changes of favorable place living acquaintance.

The WB's policies are to identify the possible impacts, analyze the customs, cultures and behaviors to find out the best appropriate plan to act and help those affected people. In the process it is necessary to study the policy and legal framework to integrate in the implementation schedule. Org, ranization

needs to build to precede the plan, monitor and supervise in order to contribute to the improvement of indigenous people life conditions.

For this subproject, considering the institutional arrangements by EVN (all institutions which will be involved in RP preparation and implementation will be responsible for preparing and implementing Ethnic Minority Development Plan). Therefore, a lot of information on consultation and participation of EM in EMDP, institutional arrangements, complaint and grievances and monitoring are described the RP report of this project. The resettlement and compensation policy for EMDPs is the same for other RP. In the EMDP, only the special policies and programs are figured out based on the consultation and feedback from EM and local authorities in the project affected areas.

The plan mainly aims at providing information on ethnic group in the project areas and having development plan in compliance with WB's policy OP 4.10 (previous as OD 4.20), ensuring the following:

(a) Respect characteristics of customs, habits and cultural tradition o f . the ethnic group;

(b) Avoid negative impacts on ethnic group during development progress; and

(c) Ethnic group will be entitled to socio-economic interests suitable to their cultural tradition.

2. SOCIO-ECONOMIC STATUS OF ETHNIC lMINOKITY IN THE PROJECT AREA 2.1 Ethnic minority in the project area

Ethnic minorities in the project area are Chu Ru, Tho, K'Ho, anti Chinese people who are living intermix with Kinh people in Duc Trong district, Lam Dong province.

Chu Ru Ethnic Minority

Chu Ru EM is one of the communities whose language stems from the Malayo - Polynesian. The population of Chu Ru EM is quite small; they mainly live in Lam Dong, Ninh Thuan and Binh Thuan province.

In Lam Dong province, Chu Ru EM has about 13,000 people who are living in Tutra commune (Don Duong district), Phu Hoi and Loan communes (Duc Trong district) and some parts of hamlets of Di Linh district.

Like other EM in Lam Dong province, Chu Ru EM does not have their own script. Nowadays, many Chu Ru people, especially the teenagers, can speak and write Vietnamese very well.

Chu Ru people have begun their rice cultivation for many years. Cultivation is the main production activities. Besides wet rice cultivation, Chu R.u people plant corn, sweet potato and vegetables in their own land.

Land is owned by the whole village and each member has the right to hunt and fish in the area of hislher village; however, tenure land belongs to each family.

Yet, all the selling and buying activities must have the agreement of the village's leader.

Chu Ru families follow the matriarchy, which is proved by the role of wives and uncles (mother's younger brothers) in families. The right of inheritance belongs to the daughter in families. A great family often includes three or four generations who live in a long house on stilts. Uncles have the right to make important decisions such as inheritance division, marriage, and land exchange.

In the Chu Ru matriarchal society, only marriage between people i,n different families is accepted. Couples will live in the bridegroom's house and children will follow their mothers' surnames. After marriage, couples will cultivate on the land which their parents give to them.

In the project area, there are 13 Chu Ru households (64 people) living in Chi Rong hamlet, Phu Hoi commune, Duc Trong district.

Tlzo Ethnic Minority

Tho people have other names such as: Keo, Mon.. . Tho language belongs to the Viet - Muong system. These people mainly live at the west of Nghe An. Its population is about 5 1,000 people.

Tho people mainly till fields, plant rice and flax. Besides, these people have experiences in hunting and fishing. In the past, job of Tho people was also the weave fabric, but because of the cultivation condition and exchanges with Kinh people, weave fabric was faded.

In villages, that Tho people help each other and have the close rela-tionship is the long-standing lifestyle. According to the old customs, all land, mountains and forests, rivers and mountains are public property; each person has the right to control when helshe is cultivating, to exploit when heishe is a member of the village.

Tho people are used to live on houses on stilts, but their houses on stilts do not have specific characteristics. Nowadays, Tho people's houses in many places have been changed into the Kinh-style house.

It is difficult to realize the character of ethnic people. Their costumes are the same as the Kinh costumes in the countryside in previous centuries; in some areas, women wear the Thai skirts. In Tho area, it is familiar for women to wear white square cloth; and mourning hed- band is white long cloth.

In the project area, the connecting line 1 lOkV has the impact on 18 Tho households (88 people) living in Lien Nghia township, Duc Trong district.

K'lio Ethnic Minority

K'Ho people are over 92,190, and language's one belongs to Mon - Kho Me system (South - Asia family). These people mainly had been lived at Tay Nguyen for very long time before migrated to Lam Dong. Some: specific production tools are yoas (chop down tree), ploughs, rakes and Kors (level the field) etc . . .

Except for some households cultivate wet rice, most till the fields with nomadic existence in cycle. They live in long house stilts with cottage roofs cottage wall inclining outside and having a stair in front. Most ol' activities including eat and drink, relax, and entertain are around a ilame.

Traditional clothes of K' Ho women are long indigo blue skirt winded. They wear a thin blanket in cold days. K' Ho girls practice weave when they were young. In order to use these products as betrothal gifts to bridegroorn's family when they are adult.

"Bo~" is a rural commune inclined matriarchy clan commune. "Kuang bon" heads bon. A volunteer union orgnization of many bons was taken shape in densely populated areas, and the head of union is "iM' drong". K' Ho still exist 2 family types: large family and small family. However, the large families are gradually dissolving and the small families are gradually disseminated, especially populous and rich areas. K' Ho organization is matriarchy, the women are active in marriage. After wedding ceremony, the husbands live in his wife house, their children take mother surename, . . . The youith marries fairy soon (men from 18 to 20 years of age; women from 16 to 1'7 years of age), so that is one of primary reasons make birth rate faily high (on an average, the per woman birth is about 5 to 6 children).

K' Ho people believe that everything are decided by Supernatural Being. In their ideas, one side is Yang (God) supporting them and other side is Cha (devils) who make many bad things to them. So in all of cases (growing rices, wedding ceremony, ...), they always make ceremonial to implore. They believe that the Gods like eat and drink so much, but depending on importance of ceremony, they sacrifice raw buffaloes, pigs, or chickens together with alcohol.

Among rituals of K' Ho people, the one which concerned tilling the fields are the most important.

Chinese Etlzn ic Minority

The percentage of Chinese people in Vietnam is 1.13% Vietnamese population and is ranked in the fourth position. In Lam Dong province, Chinese people are over 12,000. Most of Chinese people in Lam Dong are those who migrate from Quang Ninh in 1955 - 1975. Those people are a part of Chinese people who did farming in Quang Ninh and later set up their house in Lam Dong.

Outstanding characteristics of Chinese people are to unite closely, help each other in ethnic community, local areas and families. They do their best to preserve and maintain their own cultural character and tradition.

Houses of Chinese people often have two categories: tree-compartment houses, two-lean-to houses and two-wing houses.

Chinese society has the severe class gap and follows the strict patriarchy. Working people has the high spirit of close unity which has been ;preserved quite completely.

Together with the: previous opinions of living beings and specific characters in every locality, group of people, they are affected by the opinions of Taoism, Buddhism, and Confucianism.. . Ethnic minority people live alternatively; although they have different languages, their lifestyles are similar.

In the project area, 14 Chinese households (68 people) living in Lien Nghia township, Duc Trong district are affected.

~Most houses are of cat.4 and cat.tempora~y orlcs with woodcn vvall, tile or corrugated steel sheet.

Almost ELM DPs are farmers. Their cultivation is mainly ricc planting mixed with small scale live-stock breeding. So, DPs' income is mainly from cultivation and livestock raising (86.45%), only 13.55% ol- DPs have income from small scale industry, small business and others.

2.2.1 Education:

+ Developing classes and schools: All ELMS' schools are public, and ELM students do not to attend night class.

+ Compulsory education: Duc Trong district has succeeded in c~ompulsory education in primary school with the right age at 14/14 communes, towns and in secondary school at 13/14 communes.

+ EM students' support: 18,430 primary and secondary students have borrowed textbooks (a set of textbooks/student)(l2,661 primary students and 5,779 secondary students) to support their study.

2.2.2. Health care:

Districts and townships have 1 general hospital each and all c;ommunes covered by the project have 1 healthcare station each.

The commune's health care services usually taking care of minor illness or maternity deliveries. The district hospital can take care of more serious illness or minor operations.

However, such health services are suffering from poor facilities or lack of equipment.

As regard more serious cases, the patients will be transferred to the provincial hospitals.

2.2.3. Culture:

Cultural, festival, sporting activities also develop.

Leaders of communes have used many poverty alleviation methods to reduce poverty fast by many projects such as borrowing capital and changing the structures of crop plants and domestic animals.

2.3 Land use actuality of the ethnic minority in the project area

From 22 July to 30 July 2007, PECC3 had had a survey for land acquisition of EMMH and result follows:

2.3.2 Tho EM

In the project area, 'Tho EM people scatter in Lien Nghia township, Duc Trong district and live on farming production. Land for crops occupies a large proportion of Tho EM land use system in the project area; land for crops occupies 50%, land for rice occupies 10.29%, garden land occupies 24.5 1% of the whole land.

Cultivated land is affected:

- Residential land

- Crops land 6,120 m2

- Rice land

- Garden land

The total culturing affected land : 12,240 m2

Like other EM in the project area, cultivation is the main job of Tho EM. Cultivation has applied many mechanization methods. Water for irrigation is 30-40m underground water

2.3.4 Chinese EM

Chinese EM people who live in Lien Nghia town have the same habits and customs with Kinh people. Those who are affected by Duc 'rrong 220kV substation project live on farming production. Because of high topography, water for irrigation is underground water.

Cultivated land is affected:

- Residential land

- Crops land

- Rice land

- Garden land 450 m2

The total cultivated land affected : 9,849 m2

In the project area, EM use cultivated land for crops and irrigate by underground water.

3. LEGAL FRAMEWORK

This plan is developed based on policy OP 4.10 of the World Bank on indigenous people (previous as OD 4.20) and policies for ELM of'GOV.

A policy framework and guidelines for EMDP has been prepared for TD2 project to ensure that ethnic minorities are well informed, consulted and mobilized to participate in the sub-projects to be supported by the TD2 project.

3.1 The OP 4.10 on indigenous people of the World Bank

According to OP 4.10: "The Bank's broad objective towards indigenous people, as for all the people in its member countries, is to ensure that the development process fosters full respect for their dignity, human rights, and cultural unique. Particularly, the objective at the center of this directive is to ensure that indigenous people do not suffer adverse effects during the development process, particularly from Bank-financed projects, and that they receive culturally compatible social and economic benefits.", and

"The Bank's policy is that the strategy for addressing the issues pertaining to indigenous people must be based on the informed participation of the indigenous people themselves. Thus, identifying local preferences through direct consultation, incorporation of indigenous knowledge into project approaches, and appropriate early use of experienced specialists are core activities for any project that affects indigenous people and their rights to natural and economic resources."

3.2 Vietnam Law

In Vietnam, the Government has always devoted much altention to ethnicities in Vietnam. In 1955, right after liberation froin France. Vietnam issued one of the first legal documents on ethnicities, Decree 299-SL, dated April 29, 1955. Article 6 ofthis Decree declared:

"Ethnicities are free in the development of their langzlage and jetters, are free in preservation or improvement of usages and ctlstoms, are free in religion choice and are assisted by the Government (of Vietnam) in all side political, economic, czilttiral and social development. "

Since then, many policies for development for ethnicities in Vietnam have been issued.

The equality of every ethnic person living in Vietnam has been clearly stated at the highest legal level - in the constitution of 1992. Its article 5 declares that:

The Socialist Republic of Vietnam is an united nation with many nationalities. The State implements an equality and united policy and supports spiritually all nationalities and prohibits race di~crimi~vation and separation. Each nationality has the right to use its own language and ways of living to preserve their characteristics and to improive its own good traditional and cultural customs. The State carries out a policy to develop thoroughly and gradually improve the quality of life of ethnic minorities in Vietnam physically and spiritually.

Recently, The GOV has established programs such as 327, 135 and the like for sake of speeding up the tempo of development for ethnic groups in mountain areas. Many social policies have been issued to benefit these groups. Therefore, ethnic minorities in Vietnam have enjoyed better legal and political status than in the past. They have received many benefits as a result of government policies. They have received preferential treatment in college admission processes. Cooking oil, kerosene, and iodized salt have been provided to them at heavily subsidized rates. The government, foreign donor agencies, and many NGOs have been organized numerous development and special assistance programs that are target to ethnic minorities. Very large sums of money have been invested with the intention of helping the upland in general and ethnic minorities in particular to "catch up" with lowland areas.

Since 1968, the GOV has promulgated resettlement policy -for ethnic groups, reducing migration trends of the ethnic people. One of the most important policies on relation with ethnic groups is the Government Guidance No.5251TTG on 2/11/1993 regarding in detail on implementation guiding of development in high land areas and ethnic areas with the main following points:

4.1.1 Chu Ru EIM

The project will affect Chu Ru EM people in Chi Rong hamlet, Phu Hoi commune, Duc Trong district, Lam Dong province.

There are 06 Chu Ru EM households (28 people) affected, in which:

The area of Tho EM producing land which is affected by the project is 12,240 m2. There are two HHs which are permanently acquired; permanent acquired land is 32 m2, which accounts for 0.26% of the total affected land of Tho EM households.

In general, cultivated land of EM DPs acquired for pole foundations and stations is 22,733 m2, which occupies 37.47% of their cultivated land which they own.

There is no ethnic communal house, cultural site or any sensitive place affected in this project because HHs in the project area have been broadly popularized the information and minimizing methods as in 7.2.

EM people in the project area has the right for continuing their access to and use the customary and traditional land and other natural resources.

(Please see Appendix 3 for preliminary screening of ethnic minorities.)

The project will affect K' Ho EM people in Chi Rong hamlet, Phu Hoi commune, Duc Trong district, Lam Dong province.

There are 07 K' Ho ELM households (28 people) affected, in which:

There are 45 EM households (220 people) with temporarily affected land in ROW and during construction period. The temporarily acquired areas are:

- Garden land : 1,990 m2

- Other land : 8,571 m2

Permanent land acquisition:

There are 14 EIM households (49 people) with permanently acquired land for towerlpole foundations and stations. Total acquired area is 2,2,733 m2. The acquired area is about 7.01% of total area of their land. holdings (average productive land hoiding of EM DPs is around 7,210 rn2). There is one EM DP affected more than 20% of totai agricultural land their holdings.

Since the impact on land accluisition is almost 7.01% of' productive land holding of the EM DPs. The land use system ofthe ELM DPs in the pro-ject area is farming production, mainly planting vegetables.

When the project in progress, land acquisition for pole foundations does not change the land use system.

4.3 Impacts on houses and structures

In the project area, there is no ELM houses/stmctures affected.

During the pro-ject preparation (along with RP preparation), Management Hoard and consulting companies have held many community meetings at the commune level in the project area with the participation olf DPs and representatives of Commune People's Committees, authorities and non- governmental organisations (Women's union, youth organisation, farmers' union, fatherland front, veterans' organisation, etc.) In these meetings, project related issues i.e. investment financial resources, project objectives, project components, compensation policy, allowances, etc. are explained by consulting institutions.

local people on possible impacts caused by thc project, project site selection, alignment of routes etc. so as the proposed selected line route is the least impact option.

In the comn~unity meetings, DPs' queries on RP related issues i.e. entitlements, compensation, etc. are explained by PIMB and DPs' opinions were recorded.

The opinions of EM DPs and local government in the project area:

- The process of building stations and implementing the T/L must have the participation of DPs.

- DPs want to know the project's schedule; so that they car1 clear the ground on their own.

- DPs expect to receive satisfactory compensation for their damaged properties and they also want to be provided the information about the compensation unit prices for their temporarily damaged crops.

- Compensation for the damaged land in ROW is due to TIL limited utility.

- If land is acquired, compensation and relocation (if yes) should be in progress, but land in Lien Nghia township is used up.

Minutes of community meetings must have the signature of representatives of district compensation and relocation, Provincial People's Committee, MB and DPs.

All of the feedbacks of DP are integrated in W and EiMDP of this project.

6. INSTITUTIONAL ARRANGEMENT

The details of institutional arrangement are described in Chapter 2 of the W report of this project.

To implement this EMDP smoothly, PMB will:

- Assigning adequate number of staff for EMDP implementation.

- Contracting with skillful experts for ElMDP implementation.

- Setting up offices at the site for advantageous implementation.

- Periodically monitoring the EMDP implementation.

- Transparency in implementation through information campaign.

- Ensuring that ELM leaders (elders and those who prestigious on publicity) are represented in local EMDP committees.

7. IlEVEI,OPME?r:T ACTIVIrI'IES

The plans are not only for EM DPs who are directly affected by land acquisition but also for the E,Ms who are living in the project affected areas. As mentions in RP, this EMDP is developed based on the results of consultation with and participation of ELM and their local authorities.

Special resettlement provisions for ethnic minorities to ensure consideration of impacted ethnic people's views on various issues and to represent their legal rights.

In indigenous people, the role of the village elders, mostly, and most respect one is really .the heart of their ideology playing .the vital role in public consultation. Hence they were invited to meetings for getting information on the project and R.P and EMDP.

Community meetings including representatives of EIM DPs and village and commune authorities (EM leaders (elders), and representatives of EM DPs) and women's union. PMB and consulting institution made the presentation on the locations of the project, proposed policy and requested participants assess for the adverse impacts, propose for mitigation measures and propose for development programs.

Through consultation with and participation of local authorities and EM in the project affected areas, local authorities and ELM gave the feedback on the potential of adverse impacts by the project as below:

- Potential of electric shock;

- Accident in the construction period;

- Disturbance by the construction and construction workers to villages;

- Implementing street may have impacts on people and trees at. two sides of streets

All of these feedbacks are integrated in this EMDP and environmental mitigation measures (EMP report).

7.1 For ethnic minority in affected area

The following programs are proposed by EIM and local authorities for all EM people who are living in the project affected areas.

- Information (on projects, project implementation schedule, project impacts etc.) disclosure/dissemination.

- Compensation for assets lost (according to DP).

- Training for electric safety:

To propagandize the regulation electric safety measures and guidance for giving first aid in case of electric shock. The leaflet will be disseminated to all families in the project areas.

- Training on applying, use and management of loan and assi.st DPs to access loan from BARD (to be organized by the provincial and/or district BARD).

- Special agriculture extension training courses for female-headed households who are farmers (to be organized by the district and/or commune Agricultural Extensions andlor Farmer's Union:; in close cooperation with the district and/or commune Women Unions).

- Construction period: various mitigation measures

7.2 Mitigation measures

Potential of ne~ative impacts:

Permanent land acquisition for building stations ;and pole foundations; temporary land for ROW in construction period; temporary impacts on long-term trees and crops.

Local sanitation and local food/foodstuff prices may go up due to the concentration of many workers in construction period.

Noise and dust are due to transportation and construction activities.

Mitigation measures:

The measures to minimize impacts includes of (i) technical measure; (ii) encouraging ELM in the project affected areas to participate in preparing and implementing EMDP; and (iii) close consultation with local authorities and all relevant institutions.

Information from .the SIA and meetings with the ethnic minority communities will be used in preparing the design, construction schedule and construction measures for the project and the estimated cost of required work. These will include:

a. Recommendations for changing line alignments, locations, construction measures and construction schedule for the project to accommodate needs and preferences of ethnic minority.

Public consultation has already undertaken during the design stage for the line route, locations of support poles with consideration to preferences of the EM community in the project area.

The construction schedule has been considered to avoid crops. Although the requirement for construction is 12 months, it is considered to increase workers working two shifts; therefore, construction can begin right after the end of crop harvest ,and finish before the beginning of the next crop.

However, temporary crop damages will be compensated by market prices.

b. Sensitive areas, cultural and historical monuments must be considered during the design and construction stage: sensitive areas

have been well considered during the preliminary construction stage. FIowever, sensitive areas are far from the project area

c. Develop a program for communication, information and education by the commune for the ethnic minority community in the zone of influence on electric safety, potential health and social problems.

Special training programs for EM communities in affected areas have been envisaged i.e.

Training on agricultural extension program for EM ho~~seholds in the project area.

Training on electric safety to local people and students in the project area.

Training on utilization of small credit from BARD.

d. Land acquisition and compensation: where there is land accluisition in ethnic minorities, the project will ensure that their rights will not be violated and that they will be compensated for the use of any part of their land in a manner that culturally acceptable to them. The compensation will follow the resettlement policy for DPs under the project. Ethnic minority leaders will assist with consultation of affected households and with compensation activities

Compensation for land shall be at replacement cost as defined in RP. However, it is noticeable that all ELM DPs should have land owner certificate of total land owning.

There is always participation of representatives of EM DPs together with ELM development council.

The EM people enjoy similar compensation administrative and grievance redressal structures and monitoring procedures ;as defined in RP.

Results of mitigation measures:

There is no E M DPs required to be relocated due to impacts on their houses/structures.

There is no communal house, cultural areas, and sensitive areas of EM DPs in the project area due to careful consultation and mitigation measures as mentioned above.

7.3. Technical identification of development assistance

Through its regular development program, PPC will provide assistance to the ethnic minorities living in the project areas, such as priority for those living near the affected areas in getting employment i n project construction and maintenance. Priority for accessing to credit:; OF Bank for Agricultural and Rural Development in medium and long terms. Assistance for agricultural development such as land reclamation. If the

The implementation of RPEMDP shall be constantly supervised and monitored by PMB in co-ordination with local People's Committees.

An independent monitoring agency will be entrusted with external monitoring tasks of RP and ElMDP implementation. The selection of this agency will be submitted to the approval of PMB and WB.

The selected independent external monitoring agency shall be contracted by the PMB right after RPfEMDP approval and shall begin supervision and monitoring activities from the beginning of the implementation phase.

The detailed supervision and monitoring are described in Art. 7.7.

for Etltnic Minority Development Plan (entdp) -- 2 Introduction

1. EVN is undertaking a large transmission and distribution with World Bank. financing, the Second Transmission and Distribution project. Under this project, at the 500kV le:vel, about 540 km transmission lines and 1500 MVA of new transformers will be built to enable the evacuation of power from the planned major generation centers at 0 Mon in the South and at Quang Ninh in the north. Substation reinforcements will be made at 500 kV and 220 kV levels to meet increased demand in Ho Chi Minh city. Additional measures will also be taken to strengthen transmission system control, protection and reactive capability so as to improve the quality and stability of the bulk power system. At the 220 kV level, the Project consists of two GIs substation constructed in Southern Vietnam. At the 1 lOkV level, about 50 km of lines and 80 MVA to new transformer capacity will be built to improve network capacity, remove bottlenecks and meet growing demand from smaller load centers in Central Vietnam. Other subcomponents will be prepared later based on the proposed project implementation schedule.

2. In line with the World Bank's Operational Directive on Indigenous People (OD 4.20), this policy framework is developed to guide the preparation and implementation of Ethnic Minority Development Plans (ElMDPs) for sub-project areas where there are ethnic minority households.

Social and Economic informationi

3. Over the last 20 years, Vietnam has made considerable progress in achieving economic growth and in reducing poverty. Almost all Vietnamese have better lives today than they had in 1985. Most of this remarkable economic growth, however, took place in and around major urban centers. And despite all this very real progress, Vietnam remains a very poor country, with limited resources and a growing population. The national poverty rate is about 29 percent (Vietnam Household Living Standard Survey - VHLSS 2002) and the per capita annual GDP is only about US$430.

Status of Ethnic Minorities

4. Ethnic minorities in Vietnam have enjoyed better legal and political status than minority groups have in many other countries in the region, or around the world. They have received many benefits as a result of government policies. They have received preferential treatment in college admission processes. Cooking oil, kerosene, and iodized salt have been provided to them at heavily subsidized rates. The government, foreign donor agencies, and many NGOs have organized numerous development and special assistance ;programs that targeted ethnic minorities. Very large sums of money have been invested with the intention of helping the uplands in general and ethnic minorities in particular to "catch up" with lowland areas. And yet ethnic minorities in Vietnam are still severely disadvantaged.

5. While many-probably most--ethnic minority households have better material standards of living today than they did ten or fifteen years ago, they are still not catching up with the rest of the country economically. Indeed, they are in many ways falling fi~rther behind. The poverty rate among the ethnic minorities fell marginally over the past 10 ycar period, from 86.2% in 1993 to 69.3% in 2002 (VHLSS). As predicted by the World Bank (VDR 2004 - Poverty), ethnic minorities are among the groups that will remain poor for longer. A forward-looking estimate of the poverty rate of Vietnam put it at 21% by 2010. Aro~lnd 37% of those living in poverty by then would be ethnic minority people, more than twice their share of the poor in 1993, and close to three times their share of the Vietnamese population.

6. There are many reasons for the poverty of ethnic minority groups in Vietnam. But lack of attention from the government and the Party is not one of them. Nor have they been ignored by the donor community or by NGOs. The peoples of the northern mountain region are struggling to adapt to severe stresses placed upon them from population pressure, resource depletion, and cultural dislocation resulting from decades of externally imposed change. Development of the region must concentrate on promoting the process of adaptive change, recognizing that it must be accomplished by the people themselves, and that they will inevitably have to devise many different ways of doing it.

Policy Framework

7. The main objective of the ethnic minority policy framework is to ensure that the development process fosters full respect for their dignity, human rights, cultural uniqueness and that ethnic minorities do not suffer adverse impacts during the development process and they will receive culturally-compatible social and economic benefits. The Bank's OD 4.20 on Indigenous Peoples indicates that the strategy for addressing the issues pertaining to indigenous peoples must be based on the informed participation of the indigenous people themselves. Thus, identifying local preferences through direct consultation, incorporation of indigenous knowledge into project approaches, and appropriate early use of experienced specialists are core activities for any project that affects indigenous peoples and their rights to natural and economic resources.

8. The State of Viet Nam has the policy of not discriminating against indigenous peoples as showed by the presence of Ethnic People Committee in the National Assembly. Article 94 in the Constitution states that the Ethnic People Committee has the right to submit proposals, plans or related issues of indigenous peoples to the Assembly, monitor, control the implementation of national policies, development programs on various areas such as, education, health care, etc. Article 5 of the Constitution also indicates that ethnic minority people could use their own languages to reserve its cultural distinctions. In the Government of Viet Nam, directly under the supervision of the Prime Minister is the Committee of Ethnic Minorities Affairs (CEMA which is equivalent to a minist try). Development programs are supervised by CEMA such as the poverty reduction Program 135 according to the degree No, 135/1998/QD-TTg of the Prime minister to promote the construction of small-scale infrastructure in poor ethnic minority villages.

9. According to the Government of Vietnam, ethnic minorities have the following characteristics:

- An intimate understanding and long stay in the territory, land or area of their ancestors closed attachment to the natural resources;

10. This policy framework will be applied to all of the sub-projects of TD2 where applicable.

Guidelines for Ethnic Minority Dcvclopmcnt Plan (EMPD)

11 . The guidelines seek to ensure that ethnic minorities are informed, consulted and mobilized to participate in the sub-projects to be supported by TD2 Project. Their participation can either provide them benefits with more certainty, or protect them from any potential adverse impacts of sub-projects to be financed by the Project. The main features of the EMDP will be a preliminary screening process, then a social impact assessment to determine the degree and nature of impact of each work under the sub-project, and an action plan will be developed if warranted. Consultations with and partici~ation of the minority population, their leaders and local government officials will be an integral part of the overall EMDP. The EMDP's consist of the following sections:

(a) preliminary screening (b) social impact assessment (c) mitigation measures (d) development assistance (e) project monitoring

Detail requirements for screening and social impact assessment are described in the annexes. The Project will provide a series of training to all implementers and local agencies preparing and implementing ElMDPs.

Screening

12. All communes which are candidates for sub-project will be visited (at the time of first consultation with communes) by a teams made up of Project Management Boards of Electricity of Viet Nam (EVN) or of the respective Power Company (PC) or project consultants. Prior to the visit, respective Project Management Boards (PMBs) will send a letters to the communes informing the commune leaders that they will be visited by the respective PMBs or project consultants which would like to discuss sub-project. The letter will request that the communes invited to the meeting have representatives of farmers and women associations, village leaders, and key staff of commune for discussion on the sub- project. If there are ethnic minorities in the commune, their leaders should be invited to the meeting as well. During the visit, the commune leaders and other participants will present their views with regards to the sub-project.

13. At this visit, the social scientists (social consultants) will undertake a screening for ethnic minority population with the help of ethnic minority leaders and local authorities. The screening will check for the following:

(a) names of ethnic groups in the commune (b) total number of ethnic minority groups in the commune

14. If the results show that there are ethnic minority households in the zone of influence of the proposed sub-project, a social impact assessment will be planned for those areas.

Social Impact Assessment

15. The social impact assessment (SIA) will be undertaken by the social consultants. The SIA will gather relevant information on the following: demographic data; social, cultural and economic situation; and social, cultural and economic impacts - positive and negative.

16. Information will be gathered from separate group meetings: ethnic minority leaders; ethnic minority men; and ethnic minority women, especially those who live in the zone of influence of the proposed work under sub-project. Discussions wil.1 focus on sub-project impacts, positive and negative; and recommendations for design of sub-project. The social consultants will be responsible for anaIyzing the SIA, and for leading the development of an action plan with the ethnic minority leaders, project engineers and other sta.ff. If the SIA indicates that the potential imuact o f the urouosed strb-proiect will be sinnificantlv adverse or that the ethnic minoritv commtlni& reiects the proiect, the sub-Project will not be implemented in that localitv; no ftrrther action is needed in this case.

17. If the ethnic minority supports the sub-project implementation an EMDP will be developed.

Ethnic Minority Development Plan

18. The action plan wilI consists of a number of activities and will include mitigation measures of potentially negative impacts, modification of sub-project design, and development assistance. Where there is land acquisition in ethnic minority communities, the Project will ensure that their rights will not be violated and that they be compensated for the use of any part of their land in a manner that is culturally acceptable to them. The compensation will follow the Resettlement Policy Framework of the project. An Ethnic Minorities Development Plan will include:

baseline data; land tenure information; local participation; technical identification of development or mitigation activities; institutional arrangement; implementation schedule; monitoring and evaluation; and cost and financing plan.

Project Monitoring

19. Implementation of the EMDPs will be regularly supervised and monitorecl by PMBs of EVN or PCs in coordination with the respective Peoples' Committees and Cclmmittees for Ethnic Vlinorities and Mo~lntainous Areas at grass root level. The findings and

20. The independent agency or agencies which would be ~lsecl by the respective PMBs to . ~~nder take external monitoring and evaluation of the implementation of resettlement action plans for the Project will also be tasked with monitoring the resettlement activities for ethnic minority areas. While, the external monitoring agency will visit a sample of affected households for resettlement in each relevant province on an annual basis, it will also visit a sample of at least 10% of ethnic minority households in the project affected areas.

Schedule

2 1. The EMDP should have an implementation schedule that is coordinated with the sub- project implementation. Logically, social impact assessments and group meetings should be undertaken before sub-project designs are prepared. Compensation for land acquisition should be satisfactorily completed at least one month prior to start of civil work. Mon.itoring should take place at the recommended times during and after civil work.

Budget

22. The EMDP will include information on detailed cost of mitigation measures and other rehabilitation entitlements for ethnic minority in the affected areas. Sources of funding for the various activities and financing plans will be clearly specified in the cost tables.

23. The EMDPs will be prepared and submitted by PMBs to EVN or PCs and then the World Bank at the same time that respective PMBs submit the sub-project fea,sibility study, Resettlement Plan to EVN, PCs and the World Bank for review. If a PMB has many sub- projects with similar implementation schedule, an integrated EMDP report for all sub-projects will also be prepared and furnished to EVN, PCs and the World Bank for review..

Implcmen tation Arrangement

24. PMBs of EVN and PCs will be responsible for the EMDP while the 1oc:al authorities (People's Committees, Committees for Ethnic Minorities and Mountainous Areas, Resettlement Committees, Women Union and Land Departments etc. at different levels) will closely coordinate with PMBs for preparing and implementing EMDP. The project social consultant will be responsible for coordinating, planning and supervising EMDP. Consultants will also be responsible for training respective PMBs, social organizations to undertake the work of consultation, screening, social impact assessment, analyses, implerr~entation and monitoring.

d) Threats to cultural properties and resources, such as archaeological sites and historical monuments, sacred and ceremonial sites, graveyards, medicinal plants, etc., in zone of influence:

EM DPs expressed their satisfaction since such issues have been considered during the preliminary design stage and through thorough community consultation to minimize the negative impacts of the project and practically there is on impacts on such sensitive areas.

e) Other negative impacts:

The EM also expressed their concern about the possible social disturbance due to concentration of construction workers during the construction period.

C. Comments and petitions for the project:

From men:

- Compensation unit prices have to be announced for reference of local people.

- Proclaiming the project in the locality to local people give related information.

- Compensation policy has to obey stipulation of the government..

- Compensating and allowancing in satisfaction for DPs to rehabilitation.

- Compensation unit price for trees and crops is based on age groups trees and crops.

- Compensation unit prices close to market unit prices to mitigate impacts to local inhabitants.

- There are allowances for poor households of the commune.

- Clearing houses and structures in ROW of the line and assisting local people on power safety.

- Assisting cost of house/structure improvement and installing fireproof materials and lightning arrestors.

- Compensating for different value of land in ROW.

- Supporting for households with land in ROW

- Tower foundations of the line do not locate at houses of local people to minimize the losses.

- In the construction phase, the project needs to combine with local government and local people to minimize losses on trees, crops and harvest.

From women:

- Considering the construction period to avoid impact on cultivation and harvest of local inhabitants.
