If the court had ruled agents as employees, firms would have to back-pay their agents.
Agents would work set hours and not have as much time to dedicate to their clients.
On June 3, 2015 the court ruled to keep the real estate industry’s structure intact. Real estate agents are seen as independent
contractors by Boston law.
In 2011, six agents sued their Boston brokerage firms asking for salaried
compensation.
Boston’s supreme judicial court had to rule between two laws: agents being salaried employees, or agents staying as independent
contractors.
In the real estate insdustry, agents are indepdendent contractors who make their paycheck off the commission
of home sales.
