Introduction

The Board of Directors of Equitas Academy Public Schools (“EQUITAS ACADEMY”) recognizes that EQUITAS ACADEMY is responsible for complying with applicable state and federal laws and regulations governing educational programs.

This document contains rules and instructions about the filing, investigation and resolution of a Uniform Complaint Procedures (“UCP”) complaint regarding an alleged violation by a local educational agency of federal or state laws or regulations governing educational programs, including allegations of unlawful discrimination, harassment, intimidation, bullying, and noncompliance with laws relating to pupil fees, and noncompliance with the requirements governing the Local Control Funding Formula or Sections 47606.5 and 47607.3 of the Education Code, as applicable.

This document presents information about how EQUITAS ACADEMY processes UCP complaints concerning particular programs or activities in which we receive state or federal funding. A complaint is a written and signed statement by a complainant alleging a violation of federal or state laws or regulations. A complainant is any individual, including a person's duly authorized representative or an interested third party, public agency, or organization who files a written complaint alleging violation of federal or state laws or regulations, including allegations of unlawful discrimination, harassment, intimidation, bullying, and noncompliance with laws relating to pupil fees. If the complainant is unable to put the complaint in writing, due to a disability or illiteracy, EQUITAS ACADEMY shall assist the complainant in the filing of the complaint.

Scope

This complaint procedure is adopted to provide a uniform system of complaint processing for the following types of complaints:

(1) Complaints of unlawful discrimination, harassment, intimidation or bullying against any protected group, including actual or perceived discrimination, on the basis of age, ancestry, color, disability, ethnic group identification, gender expression, gender identity, gender, nationality, national origin, race or ethnicity, religion, sex, or sexual orientation, or on the basis of a person’s association with a person or group with one or more of these actual or perceived characteristics in any EQUITAS ACADEMY program or activity; and

(2) Complaints of violations of state or federal law and regulations governing the following programs including but not limited to: Child Nutrition Programs and Special Education Programs.

(3) A complaint may also be filed alleging that a pupil enrolled in a public school was required to pay a pupil fee for participation in an educational activity as those terms are defined below.

a. “Educational activity” means an activity offered by a school, school district, charter school or county office of education that constitutes an integral fundamental part of elementary and secondary education, including, but not limited to, curricular and extracurricular activities.

b. “Pupil fee” means a fee, deposit or other charge imposed on pupils, or a pupil’s parents or guardians, in violation of Section 49011 of the Education Code and Section 5 of Article IX of the California Constitution, which require educational activities to be provided free of charge to all pupils without regard to their families’ ability or willingness to pay fees or request special waivers, as provided for in Hartzell v. Connell (1984) 35 Cal.3d 899. A pupil fee includes, but is not limited to, all of the following:

i. A fee charged to a pupil as a condition for registering for school or classes, or as a condition for participation in a class or an extracurricular activity, regardless of whether the class or activity is elective or compulsory, or is for credit.

ii. A security deposit, or other payment, that a pupil is required to make to obtain a lock, locker, book, class apparatus, musical instrument, uniform or other materials or equipment.

iii. A purchase that a pupil is required to make to obtain materials, supplies, equipment or uniforms associated with an educational activity.

c. A pupil fees complaint may be filed anonymously if the complaint provides evidence or information leading to evidence to support an allegation of noncompliance with laws relating to pupil fees.

d. If EQUITAS ACADEMY finds merit in a pupil fees complaint, EQUITAS ACADEMY shall provide a remedy to all affected pupils, parents, and guardians that, where applicable, includes reasonable efforts by EQUITAS ACADEMY to ensure full reimbursement to all affected pupils, parents, and guardians, subject to procedures established through regulations adopted by the state board.

e. Nothing in this section shall be interpreted to prohibit solicitation of voluntary donations of funds or property, voluntary participation in fundraising activities, or school districts, school, and other entities from providing pupils prizes or other recognition for voluntarily participating in fundraising activities.

(4) Complaints of noncompliance with the requirements governing the Local Control Funding Formula or Sections 47606.5 and 47607.3 of the Education Code, as applicable.

Not all complaints fall within the scope of the UCP. For any complaints regarding subjects not described above, please refer to EQUITAS ACADEMY’s other complaint policies, which can be found at http://www.equitasacademy.org .

The responsibilities of Equitas Academy Public Schools

EQUITAS ACADEMY has the primary responsibility to insure compliance with applicable state and federal laws and regulations. EQUITAS ACADEMY shall investigate complaints alleging failure to comply with applicable state and federal laws and regulations and/or alleging discrimination, harassment, intimidation, bullying and charging pupil fees for participation in an educational activity and seek to resolve those complaints in accordance with these UCP procedures.

EQUITAS ACADEMY acknowledges and respects every individual’s rights to privacy. Unlawful discrimination, harassment, intimidation or bullying complaints shall be investigated in a manner that protects to the greatest extent reasonably possible the confidentiality of the parties and the integrity of the process. EQUITAS ACADEMY cannot guarantee anonymity of the complainant. This includes keeping the identity of the complainant confidential. However, EQUITAS ACADEMY will attempt to do so as appropriate. EQUITAS ACADEMY may find it necessary to disclose information regarding the complaint/complainant to the extent necessary to carry out the investigation or proceedings, as determined by the CEO or designee on a case-by-case basis.

EQUITAS ACADEMY prohibits any form of retaliation against any complainant in the complaint process, including but not limited to a complainant’s filing of a complaint or the reporting of instances of unlawful discrimination, harassment, intimidation or bullying. Such participation shall not in any way affect the status, grades or work assignments of the complainant.

Compliance Officer

The Board of Directors designates the following compliance officer(s) to receive and investigate complaints and to ensure EQUITAS ACADEMY’s compliance with law:

The Chief Executive Officer (“CEO”) or designee shall ensure that employees designated to investigate complaints are knowledgeable about the laws and programs for which they are responsible. Designated employees may have access to legal counsel as determined by the CEO or designee.

The CEO may designate the School Director of the charter school where the complaint originated to serve as the designee regarding complaints of noncompliance with laws relating to pupil fees.

Should a complaint be filed against the CEO, the compliance officer for that case shall be the President of the EQUITAS ACADEMY Board of Directors.

Notifications

The CEO or designee shall annually provide written notification of the Charter School’s uniform complaint procedures to employees, students, parents and/or guardians, advisory committees, private school officials and other interested parties (e.g., Adult Education).

The Annual Notice shall also advise the recipient of any civil law remedies that may be available under state or federal discrimination, harassment, intimidation, and bullying laws, if applicable, and of the appeal pursuant to Education Code section 262.3.

The annual notice shall be in English, and when necessary, in the primary language, pursuant to section 48985 of the Education Code if fifteen (15) percent or more of the pupils enrolled in any one of the charter schools speak a single primary language other than English.

A copy of this UCP complaint policies and procedures document shall be available free of charge.

The annual notice shall include the following:

(a) A statement that EQUITAS ACADEMY is primarily responsible for compliance with federal and state laws and regulations.

(b) A statement that a pupil enrolled in a public school shall not be required to pay a pupil fee for participation in an educational activity.

(c) A statement identifying the responsible staff member, position, or unit designated to receive complaints.

(d) A statement that the complainant has a right to appeal EQUITAS ACADEMY's decision to the CDE by filing a written appeal within 15 days of receiving EQUITAS ACADEMY’s Decision.

(e) A statement advising the complainant of any civil law remedies that may be available under state or federal discrimination, harassment, intimidation or bullying laws, if applicable, and of the appeal pursuant to Education Code § 262.3.

(f) A statement that copies of the local educational agency complaint procedures shall be available free of charge.

Filing a complaint with Equitas Academy Public Schools

Procedures

The following procedures shall be used to address all complaints, which allege that EQUITAS ACADEMY has violated federal or state laws or regulations governing educational programs. Compliance officers shall maintain a record of each complaint and subsequent related actions.

All parties involved in allegations shall be notified when a complaint is filed, when a complaint meeting or hearing is scheduled, and when a decision or ruling is made.

Step 1: Filing of Complaint

Any individual, public agency, or organization may file a written complaint of alleged noncompliance by EQUITAS ACADEMY.

A complaint alleging unlawful discrimination, harassment, intimidation or bullying shall be initiated no later than six (6) months from the date when the

alleged unlawful discrimination, harassment, intimidation or bullying occurred, or six (6) months from the date when the complainant first obtained knowledge of the facts of the alleged unlawful discrimination, harassment, intimidation or bullying. A complaint may be filed by a person who alleges that he/she personally suffered unlawful discrimination, harassment, intimidation or bullying or by a person who believes that an individual or any specific class of individuals has been subjected to unlawful discrimination, harassment, intimidation or bullying.

The complaint shall be presented to the compliance officer who shall maintain a log of complaints received, providing each with a code number and date stamp.

If a complainant is unable to put a complaint in writing due to conditions such as a disability or illiteracy, EQUITAS ACADEMY staff shall assist him/her in the filing of the complaint.

Step 2: Mediation

Within three (3) days of receiving the complaint, the compliance officer may informally discuss with the complainant the possibility of using mediation. If the complainant agrees to mediation, the compliance officer shall make arrangements for this process.

Before initiating the mediation of an unlawful discrimination, harassment, intimidation or bullying complaint, the compliance officer shall ensure that all parties agree to make the mediator a party to related confidential information.

If the mediation process does not resolve the problem within the parameters of law, the compliance officer shall proceed with his/her investigation of the complaint.

The use of mediation shall not extend EQUITAS ACADEMY’s timelines for investigating and resolving the complaint unless the complainant agrees in writing to such an extension of time.

Step 3: Investigation of Complaint

The compliance officer is encouraged to hold an investigative meeting within five (5) days of receiving the complaint or an unsuccessful attempt to mediate the complaint. This meeting shall provide an opportunity for the complainant and/or his/her representative to repeat the complaint orally.

The complainant and/or his/her representative shall have an opportunity to present the complaint and evidence or information leading to evidence to support the allegations in the complaint.

A complainant’s refusal to provide EQUITAS ACADEMY’s investigator with documents or other evidence related to the allegations in the complaint, or his/her failure or refusal to cooperate in the investigation or his/her engagement in any other obstruction of the investigation, may result in the dismissal of the complaint because of a lack of evidence to support the allegation.

EQUITAS ACADEMY’s refusal to provide the investigator with access to records and/or other information related to the allegation in the complaint, or its failure or refusal to cooperate in the investigation or its engagement in any other obstruction of the investigation, may result in a finding, based on evidence collected, that a violation has occurred and may result in the imposition of a remedy in favor of the complainant.

Step 4: Response

Unless extended by written agreement with the complainant, the compliance officer shall prepare and send to the complainant a written report of EQUITAS ACADEMY’s investigation and decision, as described in Step #5 below, within sixty (60) days of EQUITAS ACADEMY’s receipt of the complaint.

Step 5: Final Written Decision

EQUITAS ACADEMY’s decision shall be in writing and sent to the complainant. EQUITAS ACADEMY’s decision shall be written in English and in the language of the complainant whenever feasible or as required by law.

The decision shall include:

1. The findings of fact based on evidence gathered.

2. The conclusion(s) of law.

3. Disposition of the complaint.

4. Rationale for such disposition.

5. Corrective actions, if any are warranted.

6. Notice of the complainant’s right to appeal EQUITAS ACADEMY’s decision within fifteen (15) days to the CDE and procedures to be followed for initiating such an appeal.

7. For unlawful discrimination, harassment, intimidation or bullying complaints arising under state law, notice that the complainant must wait until sixty

(60) days have elapsed from the filing of an appeal with the CDE before pursuing civil law remedies.

8. For unlawful discrimination, harassment, intimidation or bullying complaints arising under federal law such complaint may be made at any time to the U.S. Department of Education, Office for Civil Rights.

If an employee is disciplined as a result of the complaint, the decision shall simply state that effective action was taken and that the employee was informed of EQUITAS ACADEMY’s expectations. The report shall not give any further information as to the nature of the disciplinary action.

Appeals to the California Department of Education

If dissatisfied with EQUITAS ACADEMY’s decision, the complainant may appeal in writing to the CDE within fifteen (15) days of receiving EQUITAS ACADEMY’s decision. When appealing to the CDE, the complainant must specify the basis for the appeal of the decision and whether the facts are incorrect and/or the law has been misapplied. The appeal shall be accompanied by a copy of the locally filed complaint and a copy of the EQUITAS ACADEMY’s decision.

Upon notification by the CDE that the complainant has appealed EQUITAS ACADEMY’s decision, the CEO or designee shall forward the following documents to:

1. A copy of the original complaint.

2. A copy of the decision.

3. A summary of the nature and extent of the investigation conducted by EQUITAS ACADEMY, if not covered by the decision.

4. A copy of the investigation file, including but not limited to all notes, interviews, and documents submitted by all parties and gathered by the investigator.

5. A report of any action taken to resolve the complaint.

6. A copy of EQUITAS ACADEMY’s complaint procedures.

7. Other relevant information requested by the CDE.

The CDE may directly intervene in the complaint without waiting for action by EQUITAS ACADEMY when one of the conditions listed in Title 5, California Code of Regulations,

Section 4650 exists, including cases in which EQUITAS ACADEMY has not taken action within sixty (60) days of the date the complaint was filed with EQUITAS ACADEMY.

Civil Law Remedies

A complainant may pursue available civil law remedies outside of EQUITAS ACADEMY’s complaint procedures. Complainants may seek assistance from mediation centers or public/private interest attorneys. Civil law remedies that may be imposed by a court include, but are not limited to, injunctions and restraining orders. For unlawful discrimination, harassment, intimidation or bullying complaints arising under state law, however, a complainant must wait until sixty (60) days have elapsed from the filing of an appeal with the CDE before pursuing civil law remedies. The moratorium does not apply to injunctive relief and is applicable only if EQUITAS ACADEMY has appropriately, and in a timely manner, apprised the complainant of his/her right to file a complaint in accordance with 5 CCR 4622.

1. Quejas de discriminación ilegal, acoso, intimidación en contra de cualquier grupo protegido, incluyendo discriminación actual o discriminación percibida, a base de edad, genealogía, color, incapacidad, identificación de grupo étnico, expresión de género, identificación de género, género, nacionalidad, origen nacional, raza o grupo étnico, religión, sexo, o orientación sexual, a base de la asociación de una persona o grupo con unas de las características actuales o percibidas en cualquier programa o actividad de EQUITAS ACADEMY; y

2. Quejas de violación estatales y federales, y regulaciones que gobiernan los siguientes programas incluyen pero no se restringe a: Programas de nutrición para niños y programas de educación especial.

3. Una queja también se puede registrar alegando que un alumno esté matriculado en una escuela pública y se requiera pagar por el alumno por alguna participación en una actividad educacional; los términos se definen abajo.

a. “Actividad educativa” significa que alguna actividad se ofrece por parte de la escuela, distrito de la escuela, escuela autónoma o oficina del condado de educación que constituta una parte esencial y fundamental de la educación elementaría y secundaria, incluyendo, pero no limitada a, actividades curriculares y extracurriculares.

b. “Pago de alumno” significa un pago, depósito, o algún otro cobro que se le impone a los alumnos, o padres o tutor de alumnos, en violación de la sección 49011 del código de educación y sección 5 del artículo IX de la constitución de California, que requiere actividades educacionales que se les provee sin costo a todos los alumnos sin considerar la habilidad y disposición de la familia para hacer pagos o solicitar una dispensa especial, tal como se provee en Hartzell v. iii. Una compra que se le requiere al alumno para obtener materiales, suministros, equipamiento o uniformes asociados con la actividad educativa.

c. Una queja de cargo de alumno se puede registrar anónimamente si la queja provee evidencia o información que lleve mas evidencia para soportar el alegato de incumplimiento con las leyes relacionadas con los cargos de alumnos.

d. Si EQUITAS ACADEMY encuentra mérito en la queja del cargo de alumno, EQUITAS ACADEMY proveerá un remedio a todos los alumnos afectados,

padres, y tutores, y en donde sea aplicable, incluye esfuerzos razonables por EQUITAS ACADEMY para asegurar reembolso a todos los alumnos, padres, tutores afectados, sujetos a un procedimiento establecido por regulaciones adoptadas por la junta estatal.

e. Ninguna parte de esta sesión será interpretada para prohibir la solicitación de donaciones voluntarias de fondos o propiedad, participación voluntaria en la colecta de fondos para actividades, o el distrito de la escuela, la escuela, y otras identidades para proveerles premios a los alumnos o algún otro reconocimiento por haber participado voluntariamente en las actividades de la colecta de fondos.

Las responsabilidades de Equitas Academy Public SchoolsEQUITAS ACADEMY tiene la responsabilidad de asegurar que cumpla con los requisitos estatales y federales, y las regulaciones. EQUITAS ACADEMY reconoce y respeta el derecho a la privacidad de cada individuo. Quejas de discriminación ilegal, acoso, intimidación será investigado de una manera que protege al alcance total y razonablemente la confidencialidad de los grupos y la integridad del proceso. EQUITAS ACADEMY no garantiza anonimato del demandante. Esto incluye manteniendo la confidencialidad del demandante. Aun así, EQUITAS ACADEMY intentará de hacerlo de manera apropiada. Es posible que EQUITAS ACADEMY encuentre necesario de revelar información referente a la queja/demandante hasta el alcance necesario para llevar la investigación o actos, tal como se determine por la Directora Ejecutiva o la persona asignada al caso específico.

La mesa de directores asigna al/ a los siguentes oficial/es de cumplimiento y investigarán las quejas para asegurar que EQUITAS ACADEMY cumpla con la ley:

La Directora ejecutiva o persona asignada asegurará que los empleados asignados para investigar las quejas tengan conocimiento sobre la ley y los programas por los cuales son responsable. Empleados asignados tendrán acceso a consejeria legal tal como se determine por la Directora ejecutiva o la persona asignada.

La Directora ejecutiva podrá asignar al/la director/a de la escuela donde él demandante trabaja y será la persona asignada de las quejas de incumplimiento con la ley relacionada a el cobro de alumnos.

Si alguna queja se registra en contra de la directora ejecutiva, el oficial de cumplimiento será el Presidente de la mesa de directores de EQUITAS ACADEMY.

NotificacionesLa Directora ejecutiva o persona asignada proveerá anualmente información por escrito sobre el procedimiento de quejas de la escuela autónoma para los empleados, los estudiantes, los padres o/y los tutores, grupos de consulta, oficiales de escuelas privadas, y otros grupos de interés (Educación para los adultos).

La noticia anual le avisará al recipiente de cualquier remedio de leyes civiles que esté disponible bajo las leyes estatales y federales de la discriminación, acoso, e intimidación, si es aplicable, y de acuerdo con la apelación del código de educación, sección 262.3. La noticia anual será en Inglés, y cuando sea necesario, en el idioma primario, conforme con la sección 48985 del código de educación si quince (15) por ciento o mas de los alumnos matriculados en cualquier de las escuelas autónomas hablan otro idioma fuera del Inglés.

Una copia del documento de las pólizas y procedimientos de UCP estará disponible gratuitamente.

La noticia anual incluirá lo siguiente:a. Una declaración indicando que EQUITAS ACADEMY es responsable

por cumplir con las leyes y regulaciones estatales y federales.b. Una declaración explicando que un alumno matriculado en una

escuela pública no tendrá que pagar por alguna participación en cualquier actividad educacional.

Registrando una queja con Equitas Academy Public Schools

ProcedimientoLos siguientes procedimientos se usaran para dirigirse a todas las quejas, que afirma que EQUITAS ACADEMY haya violado las leyes federales, estatales, o regulaciones gobernando programas educativos. El oficial de cumplimiento mantendrá un récord de cada queja y todas las acciones relacionadas con la queja.

Todas las personas involucradas en las alegaciones serán notificadas cuando se registre alguna queja, cuando tengan una junta sobre la queja o cuando se programe una junta, y cuando se llegue a alguna decisión o resolución.

Paso 1: Registrando una queja

Cualquier individuo, agencia pública, o organización puede registrar una queja por escrito de un presunto incumplimiento de EQUITAS ACADEMY.

Una presunta queja de discriminación ilegal, acoso, e intimidación que será iniciado no más de seis (6) meses después de que la discriminación ilegal, acoso, e intimidación halla ocurrido, o seis (6) meses de cuando el demandante obtuvo información y hechos de la presunta discriminación ilegal, acoso, e intimidación. Una queja se puede registrar por una persona que afirma que él o ella personalmente sufrió discriminación ilegal, acoso, o intimidación, o por una persona que cree que algún individuo o cualquier clase de individuos haya sido afectado por discriminación ilegal, acoso, e intimidación.

El demandante se le presentará al oficial de cumplimiento quien mantendrá un registro de quejas, dándoles a cada uno de los demandantes un número de código y una estampa con la fecha.

Si un demandante es incapaz de registrar una queja por escrito debido a condiciones de incapacidad o anafalbetismo, el personal de EQUITAS ACADEMY asistirá a él o ella en llenar la queja.

Paso 2: Mediación

Dentro de tres (3) días de recibir la queja, el oficial de cumplimiento puede informalmente hablar con el demandante sobre la posibilidad de mediación. Si el demandante está de acuerdo con una mediación, el oficial de cumplimiento hará los arreglos necesarios para el proceso.

Antes de comenzar la mediación de la discriminación ilegal, el acoso, y la intimidación el oficial de cumplimiento asegurará que todos los grupos estén presente en la mediación y mantengan la información privada.

Si el proceso de la mediación no resuelve el problema dentro del parámetro de la ley, el oficial de cumplimiento procederá con la investigación del demandante.

El uso de mediación no se prolongará con la línea de tiempo que tiene EQUITAS ACADEMY para investigar y resolver la queja, a solo que el demandante esté de acuerdo por escrito a una extensión de tiempo.

Paso 3: Investigación de queja

Se le anima al oficial de cumplimiento en tener una junta investigativa dentro de cinco (5) días después de haber recibido la queja o un intento fracasado en mediar la queja. Esta junta proveerá la oportunidad para el demandante y/o su representante en repetir la queja oralmente.

El demandante que niegue en proveerle al investigador de EQUITAS ACADEMY con documentos o alguna otra evidencia relacionada con la alegación en la queja, o falte hacerlo, o negarse en cooperar en la investigación, o con la participación en alguna otra obstrucción de la investigación, puede resultar en conclusión, basado en la evidencia que fue colectada, que alguna violación ocurrió y podrá resultar en la imposición de algún remedio a favor del demandante.

Paso 4: Reacción

A solo que se alargue la investigación por escrito, el oficial de cumplimiento preparará y mandará un reporte por escrito sobre la investigación de EQUITAS

ACADEMY y la decisión, tal como se explica en Paso 5, dentro de sesenta (60) días de haber recibido la queja por EQUITAS ACADEMY.

Paso 5: Decisión final por escrito

La decisión estará por escrito y se le mandará al demandante. La decisión de EQUITAS ACADEMY estará escrita en Inglés y en el idioma nativo apropiado del demandante cuando sea posible o requerido por la ley.

La decisión incluirá lo siguiente:1. Los resultados basados en los hechos de la evidencia que se colectó.2. La conclusión de la ley.3. Disposición de la queja.4. Razonamiento de la disposición5. Acciones correctivas, si es necesario.6. Aviso al demandante de apelar la decisión de EQUITAS ACADEMY dentro

de quince (15) días a CDE y los procedimientos vendrán a continuación después del inicio de la apelación.

7. Por discriminación ilegal, acoso, o intimidación de quejas bajo la ley estatal, note que el demandante tendrá que esperar hasta que haya pasado sesenta (60) días después de haber llenado la apelación con CDE antes de continuar con una solución de ley civil.

8. Quejas de discriminación ilegal, acoso, e intimidación que surgen bajo ley federal se puede hacer a cualquier hora al Departamento de educación de los Estados Unidos, Oficina de derechos civiles.

Si algún empleado llega a ser disciplinado por resultado de alguna queja, la decisión explicará que una acción fue tomada y que los empleados fueron informados de las expectativas de EQUITAS ACADEMY. El reporte no dará más información sobre la acción disciplinaria que tomó lugar.

Apelaciones al Departamento de educación de California

Si uno está insatisfecho con la decisión de EQUITAS ACADEMY, el demandante puede apelar por escrito al CDE dentro de quince (15) días después de recibir la decisión de EQUITAS ACADEMY. Cunado se apela al CDE, el demandante debe de especificar la base de la apelación y si los hechos son incorrectos y/o la ley fue usada de la manera incorrecta. La apelación será acompañada por una copia de la queja registrada y una copia de la decisión de EQUITAS ACADEMY.

Tras la notificación por CDE que el demandante apeló la decisión, la Directora ejecutiva o persona asignada mandará los siguientes documentos al CDE:

Solución de ley civilUn demandante puede seguir con las soluciones de la ley civil fuera de EQUITAS ACADEMY y su procedimiento. Los demandantes pueden pedir asistencia a centros de mediación o con abogados públicos o privados. Soluciones de ley civil que se pueden impedir por el tribunal incluye, pero no es limitado a, una orden y ordenes de restricción. Para discriminación ilegal, acoso, e intimidación de quejas que surgen bajo ley estatal, pero tiene que pasar sesenta (60) días del día que se haya registrado la queja en apelación con CDE antes de seguir con una solución de ley civil. La moratoria no se aplica a ordenes restrictivas y se aplica solamente si EQUITAS ACADEMY dio notificación al demandante de su derecho de registrar una queja de acuerdo con 5 CCR 4622 de una manera apropiada y con tiempo oportuno.
