Communities to formally challenge Naperville annexation proposal by Erin Hegarty - Naperville Sun

A proposed referendum that would ask voters in Lisle, Warrenville and Woodridge if they want to dissolve their municipalities and be annexed into Naperville will be challenged by residents in the three towns, town officials said Friday.

A press conference will be held Monday by Naperville Mayor Steve Chirico, Warrenville Mayor David Brummel, Woodridge Mayor Gina Cunningham and Lisle Mayor Joseph Broda to address the annexation referendum question, which was filed in DuPage County Circuit Court Tuesday by a person or group that has chosen to remain anonymous. A judge needs to approve it if it is to be on the April 4 election ballot.

"I still haven't heard who's behind this, and I still don't know what the motivation is," Chirico said. "But I believe it will be challenged on the basis of petition signature."

State law requires that anyone wanting to put an annexation referendum question on an election ballot obtain the signatures of at least 10 percent of the number of people who voted in the preceding general municipal election or 250 people – whichever number is smaller. Signatures are only required from the municipality that is proposed to be annexed.

The Lisle petition has 221 signatures, the Warrenville petition has 81 and the Woodridge petition has 51. Some pages of the Lisle petitions appear to be repeated. It's not clear if those numbers meet the minimum signature requirement, or if the petitioner can file more signatures in advance of a court hearing.

Ken Menzel, general counsel for the Illinois State Board of Elections, said seeking a court order rather than submitting petitions to a county clerk is an unusual way of having a referendum question placed on a ballot. A decision will need to be made by Jan. 26 because of printing deadlines and other issues, he said.

While municipalities cannot challenge a referendum, residents of the affected communities can, Chirico said.

Chirico has said he cannot see any benefit to merging the four towns since it would be unlikely to produce any government or service efficiencies.

When larger municipalities annex unincorporated land or sections of smaller municipalities, there are advantages, experts say – as well as disadvantages.

"The benefit is that it normally means better government services and more resources," said Dick Simpson, professor of political science at the University of Illinois at Chicago. "The downside is it often increases property taxes."

According to state statute, if an annexation measure is placed on the ballot and a majority of voters say "yes," the annexation becomes "effective and the jurisdiction of the annexing municipality shall extend over the territory of the annexed municipality." The annexing municipality would assume all debts, liabilities and contractual obligations of the annexed municipality, the law says.

If a majority of voters vote "no" on the proposal, the next time an annexation proposal is submitted, petitions must be signed by at least one-eighth of the number of people who voted in the preceding general municipal election. Additionally, no new question on annexation can be placed on a ballot for 22 months after the first question was posed.

Municipalities can also annex other municipalities through ordinances. The ordinances have to be approved by a majority vote of all aldermen, trustees or commissioners holding office in each municipality that desires annexation. Then the binding referendum question goes to the voters of each municipality, and has to gain approval from a majority of voters in each municipality for it to pass.
