Attachment B includes thestaff report and pertinent excerpt of the minutes of the April 3 2012 CityCouncil meeting.

    t the City Council meeting of March 4, 2014, Council Member Hillyardrequested that the City Council reconsider the decision to illuminate themedian string lights on a year-round basis. Staff has brought this statusreport to the City Council for discussion and possible action.This is a discussion item, and as such, the Council can take any one ofseveral courses of action. City staff have already expressed an intentionto review the existing Holiday Lighting Policy with the PlanningCommission and either a new subcommittee of the Commission orthrough the Sign Subcommittee. It is staff s goal to have a revised policyconsidered by the Planning Commission and forwarded to the CityCouncil prior to the commencement of this year's holiday season. TheCouncil may want to await that process before providing direct ion on theexisting practice of illuminating the Ocean Avenue median year-round.The Council could also direct an interim change to this practice. Finally,the Council could take no action, in which case the City would continueto ill uminate the City median on a year-round basis in compliance withthe vote at the April 3 2012 City Council meeting.Staff work to process any proposed changes to the lighting policy wouldbe a part of the Community Planning and Building Department'soperations and budget, which is supported by the General Fund.

    The City of Carmel-by-the-Sea allows the placement of l ights ont rees in the public right-of-way and n or on commercial proper ty on a temporary basis during the holiday season. The hol i day s e s o n ~ i s defined as the period beginning with the th i rdWednesday in November and continuing unt i l the second Wednesdayin January.This Policy applies to the public r ights-of-way and pr iva te prope r t i e s in the cc and sc zones and to commercial enterpr i ses inthe res ident i a l di s t r i c t .The following guidel ines sha l l be followed:

    1. As of the second Wednesday in January, a l l holiday l igh t ing must be removed from businesses and from City-ownedt rees .

    2. All l ights and extension cords used outdoors sha l l beuexter ior type UL l i s ted .3. Lighting sha l l be secured, not loose or dangling, andwell' out of the publ ic s way. Elec tr ica l cords sha l lbe ins ta l l ed a t a minimum of eight (8) fee t above thepublic r igh t -of- way.4. Lights are not permitted on t rees which have a t runkdiameter of less than three (3) inches 1 measured fourand one-half (4 1/2) fee t above the ground.5. Lights must be hung in a manner tha t wil l not damage at ree or other public proper ty. Nothing tha t wil l causeholes in t rees - - such as nai ls , pushpins, or staples- - may be used.6. Lights sha l l be removed i f , in the opinion of the For

    RECOMMENDED MOTIONConsider and provide direction on having the Ocean Avenue median lights remainilluminated on a year-round basis.BACKGROUNDAt the November 2, 2010 meeting, City Council unanimously approved having the holidaymedian lighting start at the beginning of Thanksgiving week and last until the start ofDaylightSaving Time in March. Since that time, the City has received many favorable comments aboutthe ambiance these lights bring to the community and appreciation that the median is lit well forthe AT&T tournament and Presidents' Day weekend.There is now interest from the public in extending the median lighting period even further, tomake it year-round. t has been noted that City special events such as the car events, the CarmelAuthors and Idea Festival, and the Carmel Art and Film Festival, all of which are held in thepresent off' season for the lights, would benefit from having the median lit as it would be anextra attraction for visitors and event attendees.FISCAL IMPACTIf the lighting period for the Ocean Avenue median were extended the additional sevenmonths, the PG&E bill would be approximately 490 more per year.SUMMARYProvide direction on the year-round lighting of the Ocean Avenue median.
