The said order was stayed by learned single judge Hon'ble High court, Calcutta vide order dt. 26.09.2011 in AST.No. 678/2011. The Hon'ble Division Bench vide order dated 17.05.2012 vacated the stay granted by learned single judge Trial court. The Honb'le Supreme Court vide order dated 6th June, 2012 ordered that the position as on 26.09.2011 will continue to apply for a month. Further, the Honourable Supreme Court vide order dated 06-07-2012, ordered that the Competent Authority shall hear M/s. Heritage Insurance Brokers regarding their renewal application dated 31-12-2008 and pass fresh order. IRDA order dated 22.09.2011 is withdrawn and does not survive. If the said order is adverse to the petitioner, it shall remain deferred for a period of one week from the date of communication of such order to the petitioners to enable them to take appropriate legal recourse. Pursuant to the above order of Honble Supreme Court, an opportunity of personal hearing was given to M/s. Heritage Insurance Brokers on 03.08.2012. After taking into consideration of facts and submissions made it is decided by the Authority to refuse to grant renewal of license to act as a composite Broker M/s. Heritage Insurance Brokers Pvt. Ltd. vide order dated 05.10.2012. Aggrieved by the Authoritys order 5.10.12, M/s. Heritage Insurance Brokers challenged the IRDAs order, in the Honble High Court of Kolkata praying for interim relief. The Honble Single Judge vide order dated 17.10.12 refused petitioners prayer for interim relief. M/s Heritage appealed to Honble Division Bench. The gist of the Order of the Honble Division Bench dated 19.10.12 is as under:

When it has been found prima facie that irretrievable loss and injury is likely to occur and further will affect third party right, certainly interim protection should be given with some regulatory measure. We accordingly pass order restoring the position as on the date of filing of present writ petition with regard to business of the appellant.

We make it clear, in the process the appellants receive fresh business, then the premium and/or consideration so to be received must be deposited in a nationalized bank and if any insurer is to be paid off their maturity value of the insurance policy the same may be done. However, list of such payee must be prepared and amount paid to such payees should be enlisted and copy thereof shall be supplied to the learned Advocate-on-record for the for the respondants. The interim order will continue till four weeks after Christmas vacation or until further order, whichever is earlier. This order is passed without prejudice to the rights and contentions of the parties. "The broker has filed a writ petition No.23500/2012 challenging the Authority's order before the Hon'ble High Court, Calcutta. The Hon'ble single Judge has not granted stay on the Authority's order. Subsequently M/s. Heritage appealed to the Hon'ble Division Bench. The Hon'ble Division Bench has stayed the Authority's order dated 5.10.2012. Pursuant to the Hon'ble Division Bench order the Authority has filed SLP before the Hon'ble Supreme Court. The gist of the order dated 4.01.2013 of the Hon'ble Supreme Court is as under: "The inpunged order dated 19.10.2012 passed by the Division Bench is set aside. We request the learned single Judge to hear and decide W.P. No.23500(W) of 2012 - Heritage Insurance Brokers Pvt. Ltd and another Vs Insurance Regulatory and Development Authority and others as expeditiously as may be possible and positiviely on or before 15th Feb 2013. The parties shall appear before the learned single judge in the above matter on 10.01.2013. We direct the parties to co-operate with learned single Judge in disposal of the above Writ Petition and not to seek any adjournment on the dates that may be fixed". The said order of the Authority is subject to the outcome of the writ petition filed before the Hon'ble High Court. In accordance with the above orders of Honble Supreme Court, the Honble Single Bench of Calcutta High Court heard and decided the WP.No.23500 (W) of 2012. The Honble Single Bench of Calcutta vide Judgment dated 14.02.13, dismissed the said Writ Petition of M/s Heritage Insurance Brokers for the reasons recorded in the Judgment, and upheld Chairmans order dated 5.10.2012 refusing the application of renewal of M/s Heritage Insurance Brokers Pvt.
