! Requires the director of the division and most regulatoryboards and commissions within the division (regulators) tostrive to reduce certification, registration, and licensurebarriers for applicants; and

! Gives regulators rule-making authority to establish anoccupational credential portability program in the leastburdensome way necessary to protect the public.

Be it enacted by the General Assembly of the State of Colorado:1

SECTION 1. Legislative declaration. (1) The general assembly2

hereby:3

(a) Finds that:4

(I) Occupational credential requirements affect one in five5

Coloradans;6

(II) Colorado is experiencing tremendous economic growth and7

a tight labor market; and8

(III) Many new residents are skilled professionals who have been9

trained and licensed in another state;10

(b) Determines that meaningful employment positively affects all11

Coloradans and the state economy; and12

(c) Declares that:13

(I) Regulators should seek to reduce barriers to entry in the14

workforce;15

(II) Skilled professionals should be granted a Colorado16

occupational credential for substantially equivalent experience in another17

state unless the regulator can demonstrate a specific reason to withhold18

the credential; and19

(III) Credentials should be provided in the least burdensome20

manner possible in order to get professionals to work as soon as possible.21

SECTION 2. In Colorado Revised Statutes, 12-20-102, add22

(10.5) as follows:1

12-20-102. Definitions. As used in this title 12, unless the context2

otherwise requires:3

(10.5) "OCCUPATIONAL CREDENTIAL PORTABILITY PROGRAM"4

MEANS THE PROGRAM ESTABLISHED PURSUANT TO SECTION 12-20-202 (3)5

AND RULES ADOPTED BY A REGULATOR PURSUANT TO THAT SECTION.6

SECTION 3. In Colorado Revised Statutes, 12-20-202, amend7

(3) as follows:8

12-20-202. Licenses, certifications, and registrations - renewal9

- reinstatement - fees - occupational credential portability program10

- definitions - exceptions for military personnel - rules - consideration11

of criminal convictions - executive director authority.12

(3) Occupational credential portability program. (a) THERE IS13

HEREBY CREATED IN THE DIVISION THE OCCUPATIONAL CREDENTIAL14

PORTABILITY PROGRAM BY WHICH A REGULATOR MAY APPROVE AN15

APPLICATION FOR LICENSURE, CERTIFICATION, REGISTRATION, OR16

ENROLLMENT BY ENDORSEMENT, RECIPROCITY, OR TRANSFER. EACH17

REGULATOR SHALL STRIVE TO REDUCE BARRIERS FOR APPLICANTS UNDER18

THE OCCUPATIONAL CREDENTIAL PORTABILITY PROGRAM, INCLUDING19

THROUGH RECIPROCITY AGREEMENTS, COMPACTS, OR OTHER MEANS TO20

EXPEDITE LICENSURE, CERTIFICATION, REGISTRATION, OR ENROLLMENT21

AND SHALL ADOPT RULES TO IMPLEMENT THE PROGRAM IN THE LEAST22

BURDENSOME WAY NECESSARY TO PROTECT THE PUBLIC. UNLESS THERE23

ARE SPECIFIC REASONS TO WITHHOLD A LICENSE, CERTIFICATION,24

REGISTRATION, OR ENROLLMENT, A REGULATOR SHALL ISSUE A LICENSE,25

CERTIFICATION, REGISTRATION, OR ENROLLMENT, AS APPLICABLE, TO AN26

APPLICANT WHO MEETS THE REQUIREMENTS OF THIS SUBSECTION (3) AND27

RULES ADOPTED BY THE REGULATOR PURSUANT TO THIS SUBSECTION (3).1

(b) (I) EXCEPT AS SPECIFIED IN SUBSECTION (3)(c) OF THIS2

SECTION, A PERSON DULY LICENSED, CERTIFIED, REGISTERED, OR3

ENROLLED IN GOOD STANDING IN ANOTHER STATE OR UNITED STATES4

TERRITORY TO PRACTICE A PARTICULAR PROFESSION OR OCCUPATION IS,5

UPON APPLICATION TO THE DIVISION FOR LICENSURE, CERTIFICATION,6

REGISTRATION, OR ENROLLMENT IN THAT PROFESSION OR OCCUPATION IN7

THIS STATE, ENTITLED TO THE ISSUANCE OF THE APPLICABLE LICENSE,8

CERTIFICATION, REGISTRATION, OR ENROLLMENT UPON:9

(A) SUBMISSION OF SATISFACTORY PROOF TO THE REGULATOR,10

UNDER PENALTY OF PERJURY, OF THE APPLICANT'S SUBSTANTIALLY11

EQUIVALENT EXPERIENCE OR CREDENTIALS AND THAT THE APPLICANT HAS12

NOT COMMITTED AN ACT THAT WOULD BE GROUNDS FOR DISCIPLINARY13

ACTION UNDER THE LAW GOVERNING THE APPLICABLE PROFESSION OR14

OCCUPATION; AND15

(B) PAYMENT OF APPLICABLE FEES ESTABLISHED PURSUANT TO16

SECTION 12-20-105.17

(II) FOR THE PURPOSES OF THIS SUBSECTION (3)(b), "IN GOOD18

STANDING" MEANS THAT A LICENSE, CERTIFICATION, REGISTRATION, OR19

ENROLLMENT HAS NOT BEEN REVOKED OR SUSPENDED AND AGAINST20

WHICH THERE ARE NO OUTSTANDING DISCIPLINARY OR ADVERSE ACTIONS.21

(c) AN APPLICANT IS NOT ENTITLED TO LICENSURE, CERTIFICATION,22

REGISTRATION, OR ENROLLMENT PURSUANT TO THIS SUBSECTION (3) IF THE23

REGULATOR DEMONSTRATES BY A PREPONDERANCE OF EVIDENCE, AFTER24

NOTICE AND OPPORTUNITY FOR A HEARING, THAT THE APPLICANT:25

(I) LACKS THE REQUISITE SUBSTANTIALLY EQUIVALENT26

EXPERIENCE OR CREDENTIALS TO PRACTICE THE APPLICABLE OCCUPATION27

OR PROFESSION; OR1

(II) HAS COMMITTED AN ACT THAT WOULD BE GROUNDS FOR2

DISCIPLINARY ACTION UNDER THE LAW GOVERNING THE APPLICABLE3

PROFESSION OR OCCUPATION.4

(d) A REGULATOR MAY SPECIFY BY RULE WHAT CONSTITUTES5

SUBSTANTIALLY EQUIVALENT EXPERIENCE OR CREDENTIALS AND, unless6

otherwise prohibited by this title 12, SHALL ALLOW an applicant for7

certification, registration, or licensure by endorsement may TO8

demonstrate competency in a specific occupation or profession as9

determined by the regulator in lieu of a requirement that the applicant has10

worked or practiced in that occupation or profession for a period of time11

prior to the application for endorsement.12

(e) THIS SUBSECTION (3) DOES NOT APPLY TO THE FOLLOWING13

PROFESSIONS OR OCCUPATIONS:14

(I) COMBATIVE SPORTS, REGULATED PURSUANT TO ARTICLE 11015

OF THIS TITLE 12;16

(II) FANTASY CONTESTS, REGULATED PURSUANT TO ARTICLE 12517

OF THIS TITLE 12;18

(III) MORTUARIES AND CREMATORIES, REGULATED PURSUANT TO19

ARTICLE 135 OF THIS TITLE 12;20

(IV) NONTRANSPLANT TISSUE BANKS, REGULATED PURSUANT TO21

ARTICLE 140 OF THIS TITLE 12;22

(V) OUTFITTERS AND GUIDES, REGULATED PURSUANT TO ARTICLE23

145 OF THIS TITLE 12;24

(VI) PASSENGER TRAMWAYS, REGULATED PURSUANT TO ARTICLE25

150 OF THIS TITLE 12;26

(VII) PLUMBERS, REGULATED PURSUANT TO ARTICLE 155 OF THIS27

(VIII) DIRECT-ENTRY MIDWIVES, REGULATED PURSUANT TO2

ARTICLE 225 OF THIS TITLE 12; OR3

(IX) SURGICAL ASSISTANTS AND SURGICAL TECHNOLOGISTS,4

REGULATED PURSUANT TO ARTICLE 310 OF THIS TITLE 12.5

SECTION 4. In Colorado Revised Statutes, amend 12-100-1116

as follows:7

12-100-111. Issuance of certificate by reciprocity. (1) The8

board in its discretion, may waive the examination of persons qualified9

under this subsection (1) and may issue a certificate of certified public10

accountant to AN APPLICANT WHO SATISFIES THE REQUIREMENTS OF THE11

OCCUPATIONAL CREDENTIAL PORTABILITY PROGRAM.12

(a) Any person who is the holder of a certificate of certified public13

accountant issued after examination under the laws of another state and14

who possesses the qualifications prescribed in section 12-100-107 for an15

applicant applying for a certificate as of the time of the issuance of the16

certificate by the other state or possesses substantially equivalent17

qualifications;18

(b) A person who has passed an examination under the laws of19

another state and who possesses the qualifications prescribed in section20

12-100-107 at the time the person applies for a certificate in this state or21

possesses substantially equivalent qualifications; or22

(c) Any person who is the holder of a certificate, license, or23

degree in a foreign country that constitutes a recognized qualification for24

the practice of public accounting in the country, is comparable to that of25

a certified public accountant in this state, and is in full force and effect.26

SECTION 5. In Colorado Revised Statutes, 12-100-106, repeal27

12-100-106. Fees. (3) Any person making application for a2

certificate of certified public accountant under section 12-100-111 shall3

pay a fee authorized to be established pursuant to section 12-20-105 in4

addition to the fee required in subsection (1) of this section.5

SECTION 6. In Colorado Revised Statutes, 12-100-107, repeal6

(1)(a) as follows:7

12-100-107. Certificate of certified public accountant -8

issuance - renewal - reinstatement - rules. (1) The board shall grant a9

certificate of certified public accountant to any applicant who:10

(a) Meets the requirements of section 12-100-111;11

SECTION 7. In Colorado Revised Statutes, amend 12-105-11512

as follows:13

12-105-115. Licensure by endorsement. (1) The director shall14

issue a license by endorsement to engage in the practice of barbering,15

cosmetology, hairstyling, manicuring, or esthetician services in this state16

to an individual who possesses an active license in good standing to17

practice in that profession in another state or territory of the United States18

or in a foreign country if the applicant presents proof that is satisfactory19

to the director, that the applicant WHO SATISFIES THE REQUIREMENTS OF20

THE OCCUPATIONAL CREDENTIAL PORTABILITY PROGRAM.21

(a) Possesses a valid license from another state or jurisdiction that22

is substantially equivalent to the requirements in Colorado for licensure23

and meets all other requirements for licensure pursuant to this article 105.24

The director may specify by rule what shall constitute substantially25

equivalent licensure and qualifications.26

(b) Has paid the prescribed licensure fees.27

SECTION 8. In Colorado Revised Statutes, amend 12-115-1131

as follows:2

12-115-113. License by endorsement or reciprocity. (1) The3

board shall issue an electrical license by endorsement in this state to any4

person who is licensed to practice in another jurisdiction if the person5

presents proof satisfactory to the board that, at the time of application for6

a Colorado license by endorsement, the person possesses credentials and7

qualifications that are substantially equivalent to requirements in8

Colorado for licensure AN APPLICANT WHO SATISFIES THE REQUIREMENTS9

OF THE OCCUPATIONAL CREDENTIAL PORTABILITY PROGRAM.10

(2) The board shall issue an electrical license by reciprocity where11

a reciprocal agreement for an equivalent license exists, pursuant to12

section 12-115-107 (2)(i), between the board and the electrical board, or13

its equivalent, of the state or states where the applicant is licensed. The14

board shall strive to reduce barriers for Colorado licensees to be licensed15

by endorsement or through reciprocity in other states.16

(3) The board may specify by rule what shall constitute17

substantially equivalent credentials and qualifications.18

SECTION 9. In Colorado Revised Statutes, 12-120-211, amend19

(1) as follows:20

12-120-211. Qualifications for engineer-interns. (1) (a) An21

applicant may qualify for enrollment as an engineer-intern by22

endorsement if the applicant is enrolled in good standing in another23

jurisdiction requiring qualifications substantially equivalent to those24

currently required of applicants under this part 2 or if, at the time of initial25

enrollment in the other jurisdiction, the applicant met the requirements for26

enrollment then in existence under Colorado law SATISFIES THE27

(b) Upon completion of the application and approval by the board,3

the applicant shall be enrolled as an engineer-intern if the applicant is4

otherwise qualified pursuant to section 12-120-210.5

SECTION 10. In Colorado Revised Statutes, 12-120-213, amend6

(1) as follows:7

12-120-213. Qualifications for professional engineer.8

(1) (a) An applicant may qualify for licensing as a professional engineer9

by endorsement if the applicant is licensed in good standing in another10

jurisdiction requiring qualifications substantially equivalent to those11

currently required of applicants under this part 2 or if, at the time of initial12

licensure in the other jurisdiction, the applicant met the requirements for13

licensure then in existence under Colorado law SATISFIES THE14

REQUIREMENTS OF THE OCCUPATIONAL CREDENTIAL PORTABILITY15

PROGRAM.16

(b) Upon completion of the application and approval by the board,17

the applicant shall be licensed as a professional engineer if the applicant18

is otherwise qualified pursuant to section 12-120-212.19

SECTION 11. In Colorado Revised Statutes, 12-120-215, amend20

(1)(a)(III) and (1)(b)(III) as follows:21

12-120-215. Fees - disposition. (1) Pursuant to section22

12-20-105, the board shall charge and collect fees for the following:23

(a) With respect to professional engineers:24

(III) Application for licensure by endorsement PURSUANT TO THE25

OCCUPATIONAL CREDENTIAL PORTABILITY PROGRAM;26

(b) With respect to engineer-interns:27

(III) Application for enrollment by endorsement PURSUANT TO THE1

OCCUPATIONAL CREDENTIAL PORTABILITY PROGRAM.2

SECTION 12. In Colorado Revised Statutes, 12-120-311, amend3

(1) as follows:4

12-120-311. Qualifications for land surveyor-interns.5

(1) (a) An applicant may qualify for enrollment as a land surveyor-intern6

by endorsement if the applicant is enrolled in good standing in another7

jurisdiction requiring qualifications substantially equivalent to those8

currently required of applicants under this part 3 or if, at the time of initial9

enrollment in the other jurisdiction, the applicant met the requirements for10

enrollment then in existence under Colorado law SATISFIES THE11

REQUIREMENTS OF THE OCCUPATIONAL CREDENTIAL PORTABILITY12

PROGRAM.13

(b) Upon completion of the application and approval by the board,14

the applicant shall be enrolled as a land surveyor-intern if the applicant15

is otherwise qualified pursuant to section 12-120-310.16

SECTION 13. In Colorado Revised Statutes, 12-120-313, amend17

(1) as follows:18

12-120-313. Qualifications for professional land surveyor -19

repeal. (1) (a) An applicant may qualify for licensing as a professional20

land surveyor by endorsement and examination if the applicant passes the21

required examination or examinations pertaining to Colorado law IF THE22

APPLICANT SATISFIES THE REQUIREMENTS OF THE OCCUPATIONAL23

CREDENTIAL PORTABILITY PROGRAM.24

(b) In order to be admitted to the examination pursuant to25

subsection (1)(a) of this section, the applicant shall be licensed in good26

standing in another jurisdiction requiring qualifications substantially27

equivalent to those currently required of applicants under this part 3 or,1

at the time of initial licensure in the other jurisdiction, have met the2

requirements for licensure then in existence under Colorado law.3

(c) Upon passing the examination, the applicant shall be licensed4

as a professional land surveyor if the applicant is otherwise qualified5

pursuant to section 12-120-312.6

SECTION 14. In Colorado Revised Statutes, 12-120-315, amend7

(1)(a)(III) and (1)(b)(III) as follows:8

12-120-315. Fees - disposition. (1) Pursuant to section9

12-20-105, the board shall charge and collect fees for the following:10

(a) With respect to professional land surveyors:11

(III) Application for licensure by endorsement and examination12

PURSUANT TO THE OCCUPATIONAL CREDENTIAL PORTABILITY PROGRAM;13

(b) With respect to land surveyor-interns:14

(III) Application for enrollment as a land surveyor-intern by15

endorsement PURSUANT TO THE OCCUPATIONAL CREDENTIAL PORTABILITY16

PROGRAM.17

SECTION 15. In Colorado Revised Statutes, 12-120-413, amend18

(3) as follows:19

12-120-413. Qualifications for architect licensure. (3) An20

applicant for MAY OBTAIN licensure by endorsement must hold a license21

in good standing in a jurisdiction requiring qualifications substantially22

equivalent to those currently required for licensure by examination as23

provided in section 12-120-409 (1) and subsections (1) and (2) of this24

section and shall submit an application as prescribed by the board. The25

board shall provide procedures for an applicant to apply directly to the26

OCCUPATIONAL CREDENTIAL PORTABILITY PROGRAM. The board may also1

provide an alternative application procedure so that an applicant may, at2

his or her THE APPLICANT'S option, instead apply to a national3

clearinghouse designated by the board. The national clearinghouse shall4

then forward the application to the board.5

SECTION 16. In Colorado Revised Statutes, 12-130-109, amend6

(1)(c)(II); and repeal (4) as follows:7

12-130-109. Licensure - application - qualifications - rules.8

(1) Application. (c) Applicants may seek licensure in one of the9

following manners:10

(II) Licensure by endorsement as described in subsection (4) of11

this section PURSUANT TO THE OCCUPATIONAL CREDENTIAL PORTABILITY12

PROGRAM; or13

(4) Licensure by endorsement. (a) An applicant for licensure by14

endorsement shall file an application as prescribed by the board and shall15

hold a current valid license or registration in a jurisdiction requiring16

qualifications substantially equivalent to those required for licensure by17

subsections (2) and (3) of this section.18

(b) The board shall provide procedures for an applicant to apply19

directly to the board for a license by endorsement. A certified record from20

the Council of Landscape Architectural Registration Boards, or its21

successor organization, shall qualify a candidate to submit an application22

to the board for licensure by endorsement.23

(c) The board may develop or adopt a supplementary examination24

to measure the minimum competence of applicants for licensure by25

endorsement. The supplementary examination shall be administered at the26

discretion of the board when an applicant for licensure by endorsement27

has otherwise failed to sufficiently demonstrate minimum competence.1

SECTION 17. In Colorado Revised Statutes, amend 12-200-1072

as follows:3

12-200-107. Licensure by endorsement. (1) The director shall4

issue a license by endorsement to engage in the practice of acupuncture5

in this state to any applicant who has a license in good standing as an6

acupuncturist under the laws of another jurisdiction if the applicant7

presents satisfactory proof to the director that, at the time of application8

for a license by endorsement, the applicant possesses substantially9

equivalent credentials and qualifications to those required for licensure10

pursuant to this article 200 SATISFIES THE REQUIREMENTS OF THE11

OCCUPATIONAL CREDENTIAL PORTABILITY PROGRAM.12

(2) The director shall specify by rule what shall constitute13

"substantially equivalent credentials and qualifications" for the purposes14

of this section.15

(3) For the purposes of this section, "in good standing" means a16

license that has not been revoked or suspended, or against which there are17

no disciplinary or adverse actions.18

SECTION 18. In Colorado Revised Statutes, 12-205-108, amend19

(3) as follows:20

12-205-108. Requirements for license - license by endorsement21

- application - denial. (3) (a) To be licensed by endorsement, an22

applicant must file an application and pay a fee as prescribed by the23

director and must hold a current, valid license or registration in a24

jurisdiction that requires qualifications substantially equivalent to those25

required for licensure by subsection (1) of this section SATISFY THE26

REQUIREMENTS OF THE OCCUPATIONAL CREDENTIAL PORTABILITY27

(b) To be licensed by endorsement, an applicant must submit, with2

the application, verification that the applicant has actively practiced for3

a period of time determined by rules of the director or has otherwise4

maintained continued competency as determined by the director.5

(c) Upon receipt of all documents required by subsections (3)(a)6

and (3)(b) of this section, the director shall review the application and7

make a determination of the applicant's qualifications to be licensed by8

endorsement.9

(d) The director may deny licensure if the applicant has committed10

an act that would be grounds for disciplinary action under section11

12-205-111.12

SECTION 19. In Colorado Revised Statutes, amend 12-210-10713

as follows:14

12-210-107. Licensure by endorsement. (1) The director shall15

issue a license by endorsement to engage in the practice of audiology in16

this state to an individual who possesses an active license in good17

standing to practice audiology in another state or territory of the United18

States or in a foreign country if the applicant WHO SATISFIES THE19

REQUIREMENTS OF THE OCCUPATIONAL CREDENTIAL PORTABILITY20

PROGRAM.21

(a) Presents satisfactory proof to the director that the individual22

possesses a valid license from another state or jurisdiction that requires23

qualifications substantially equivalent to the qualifications for licensure24

in this state and meets all other requirements for licensure pursuant to this25

article 210; and26

(b) Pays the license fee established under section 12-20-105.27

(2) The director may specify by rule what constitutes substantially1

equivalent qualifications for the purposes of this section.2

SECTION 20. In Colorado Revised Statutes, amend 12-215-1093

as follows:4

12-215-109. Licensure by endorsement. (1) Upon application5

for a license to practice chiropractic in this state, accompanied by the6

required fee, the board shall issue a license to any person who furnishes,7

upon the form and in the manner the board prescribes, evidence8

satisfactory to the board that:9

(a) The applicant is licensed to practice chiropractic in another10

state, a territory of the United States, the District of Columbia, the11

commonwealth of Puerto Rico, or a province of Canada; and12

(b) At the time of application under this section, the applicant13

possesses credentials and qualifications that are, in the judgment of the14

board, equivalent to this state's requirements for licensure by15

examination; and16

(c) (I) The applicant has been engaged in the full-time practice of17

chiropractic, or has taught general clinical chiropractic subjects at an18

accredited school of chiropractic, as set forth in section 12-215-106 (1),19

in one of the jurisdictions referred to in subsection (1)(a) of this section20

for at least three of the five years immediately preceding the date of the21

receipt of the application; or22

(II) The applicant has demonstrated competency as a chiropractor23

as determined by the board; and24

(d) The applicant has not been convicted of a crime that would be25

grounds for the refusal, suspension, or revocation of a license to practice26

chiropractic in this state if committed in this state; and27

(e) The applicant's license to practice chiropractic is in good1

standing AN APPLICANT MAY OBTAIN LICENSURE BY ENDORSEMENT IF THE2

APPLICANT SATISFIES THE REQUIREMENTS OF THE OCCUPATIONAL3

CREDENTIAL PORTABILITY PROGRAM.4

SECTION 21. In Colorado Revised Statutes, amend 12-220-1185

as follows:6

12-220-118. Dentist - licensure by endorsement. (1) The board7

shall provide for licensure upon application of any person licensed in8

good standing to practice dentistry in another state or territory of the9

United States who provides the credentials and meets the qualifications10

set forth in this section in the manner prescribed by the board ISSUE A11

LICENSE BY ENDORSEMENT TO AN APPLICANT WHO SATISFIES THE12

REQUIREMENTS OF THE OCCUPATIONAL CREDENTIAL PORTABILITY13

PROGRAM.14

(2) The board shall issue a license to an applicant licensed as a15

dentist in another state or territory of the United States if the applicant has16

submitted credentials and qualifications for licensure that include:17

(a) Proof of graduation from an accredited dental school;18

(b) Proof the applicant is currently licensed in another state or19

United States territory;20

(c) Proof the applicant has been in practice or teaching dentistry,21

which involves personally providing care to patients for not less than22

three hundred hours annually in an accredited dental school for a23

minimum of five years out of the seven years immediately preceding the24

date of the receipt of the application, or evidence that the applicant has25

demonstrated competency as a dentist as determined by the board;26

(d) Proof the applicant has not been subject to final or pending27

disciplinary action by any state in which the applicant is or has been1

previously licensed; except that, if the applicant has been subject to2

disciplinary action, the board may review the disciplinary action to3

determine whether the underlying conduct warrants refusal to issue a4

license;5

(e) Proof the applicant has passed an entry level examination6

acceptable to the board; and7

(f) Proof the applicant has met any more stringent criteria8

established by the board.9

SECTION 22. In Colorado Revised Statutes, amend 12-220-12610

as follows:11

12-220-126. Dental hygienist - licensure by endorsement.12

(1) The board shall provide for licensure upon application of any person13

licensed in good standing to practice dental hygiene in another state or14

territory of the United States who has met the requirements of section15

12-220-124 and provides the credentials and meets the qualifications set16

forth in this section in the manner prescribed by the board ISSUE A17

LICENSE BY ENDORSEMENT TO AN APPLICANT WHO SATISFIES THE18

REQUIREMENTS OF THE OCCUPATIONAL CREDENTIAL PORTABILITY19

PROGRAM.20

(2) The board shall issue a license to an applicant duly licensed as21

a dental hygienist in another state or territory of the United States who has22

submitted credentials and qualifications for licensure in Colorado that23

include:24

(a) Verification of licensure from any other jurisdiction where the25

applicant has held a dental hygiene or other health care license;26

(b) Evidence of the applicant's successful completion of the27

national board dental examination administered by the Joint Commission1

on National Dental Examinations;2

(c) (I) Verification that the applicant has been engaged either in3

clinical practice or in teaching dental hygiene or dentistry in an accredited4

program for at least one year during the three years immediately5

preceding the date of the receipt of the application; or6

(II) Evidence that the applicant has demonstrated competency as7

a dental hygienist as determined by the board;8

(d) A report of any pending or final disciplinary actions against9

any health care license held by the applicant at any time; and10

(e) A report of any pending or final malpractice actions against the11

applicant.12

SECTION 23. In Colorado Revised Statutes, amend 12-230-20313

as follows:14

12-230-203. Licensure by endorsement. (1) The director shall15

issue a license by endorsement to practice as a hearing aid provider in this16

state to an individual who possesses an active license in good standing to17

practice in that profession in another state or territory of the United States18

or in a foreign country if the applicant WHO SATISFIES THE REQUIREMENTS19

OF THE OCCUPATIONAL CREDENTIAL PORTABILITY PROGRAM.20

(a) Presents proof satisfactory to the director that the individual21

possesses a valid license from another state or jurisdiction that requires22

qualifications substantially equivalent to the qualifications for licensure23

in this state and meets all other requirements for licensure pursuant to this24

article 230; and25

(b) Pays the licensure fee established under section 12-20-105.26

(2) The director may specify by rule what constitutes substantially27

equivalent qualifications for the purposes of this section.1

SECTION 24. In Colorado Revised Statutes, 12-235-108, amend2

(4) as follows:3

12-235-108. License - denial of license application. (4) The4

director shall issue a license BY ENDORSEMENT to an applicant who5

otherwise meets the qualifications set forth in this article 235 and who6

submits satisfactory proof and certifies under penalty of perjury that the7

applicant currently possesses an unrestricted license or registration, in8

good standing, to practice massage therapy under the laws of another state9

or territory of the United States or a foreign country if: SATISFIES THE10

REQUIREMENTS OF THE OCCUPATIONAL CREDENTIAL PORTABILITY11

PROGRAM.12

(a) The director determines that the qualifications for massage13

therapy licensure or registration in the other state, territory, or foreign14

country are substantially equivalent to those required by this section;15

(b) The applicant submits proof of experience and competency on16

a form determined by the director;17

(c) The applicant submits to a criminal history record check18

pursuant to subsection (2) of this section; and19

(d) The director reviews any disciplinary actions taken against the20

applicant.21

SECTION 25. In Colorado Revised Statutes, 12-240-110, amend22

(1) introductory portion and (1)(d) as follows:23

12-240-110. Qualifications for licensure. (1) Subject to the24

other conditions and provisions of this article 240, THE BOARD SHALL25

GRANT a license to practice medicine shall be granted by the board to an26

applicant only upon the basis of:27

(d) (I) Endorsement, if the applicant for licensure by endorsement1

SATISFIES THE REQUIREMENTS OF THE OCCUPATIONAL CREDENTIAL2

PORTABILITY PROGRAM.3

(A) Files an application and pays a fee as prescribed by the board;4

(B) Holds a current, valid license in a jurisdiction that requires5

qualifications substantially equivalent to the qualifications for licensure6

in this state as specified in this section;7

(C) Submits written verification that he or she has actively8

practiced medicine in another jurisdiction for at least five of the9

immediately preceding seven years or has otherwise maintained continued10

competency as determined by the board; and11

(D) Submits proof satisfactory to the board that he or she has not12

been and is not subject to final or pending disciplinary or other action by13

any state or jurisdiction in which the applicant is or has been previously14

licensed; except that, if the applicant is or has been subject to action, the15

board may review the action to determine whether the underlying conduct16

warrants refusal of a license pursuant to section 12-240-120.17

(II) Upon receipt of all documents required by this subsection18

(1)(d), the board shall review the application and make a determination19

of the applicant's qualification to be licensed by endorsement.20

SECTION 26. In Colorado Revised Statutes, amend 12-245-20721

as follows:22

12-245-207. Licensure by endorsement. A board may issue a23

license by endorsement to engage in the practice of psychology, social24

work, marriage and family therapy, professional counseling, or addiction25

counseling to an applicant who has a license, registration, or certification26

in good standing as a psychologist, social worker, marriage and family27

therapist, licensed professional counselor, or addiction counselor under1

the laws of another jurisdiction if the applicant presents proof satisfactory2

to the board that, at the time of application for a Colorado license by3

endorsement, the applicant possesses credentials and qualifications that4

are substantially equivalent to the requirements of section 12-245-304,5

12-245-404, 12-245-504, 12-245-604, or 12-245-804, whichever is6

applicable. Each board shall promulgate rules setting forth the manner in7

which the board will review credentials and qualifications of an applicant8

SATISFIES THE REQUIREMENTS OF THE OCCUPATIONAL CREDENTIAL9

PORTABILITY PROGRAM.10

SECTION 27. In Colorado Revised Statutes, 12-250-107, amend11

(3) as follows:12

12-250-107. Registration required - qualifications -13

examination - registration by endorsement - rules. (3) The director14

may issue a registration by endorsement to engage in the practice of15

naturopathic medicine to an applicant who has a license, certification, or16

registration in good standing as a naturopathic doctor under the laws of17

another jurisdiction if the applicant presents satisfactory proof to the18

director that, at the time of application for a Colorado registration by19

endorsement, the applicant possesses credentials and qualifications that20

are substantially equivalent to the requirements of this section. The21

director may adopt rules concerning the necessary applicant credentials22

and qualifications SATISFIES THE REQUIREMENTS OF THE OCCUPATIONAL23

CREDENTIAL PORTABILITY PROGRAM.24

SECTION 28. In Colorado Revised Statutes, 12-255-110, amend25

(2) as follows:26

12-255-110. Requirements for professional nurse licensure.27

practice of professional nursing in this state to a nurse who is licensed to2

practice professional nursing in another state or a territory of the United3

States or in a foreign country if the applicant presents proof satisfactory4

to the board that, at the time of application for a Colorado license by5

endorsement, the applicant possesses credentials and qualifications that6

are substantially equivalent to requirements in Colorado for licensure by7

examination. The board may specify by rule what shall constitute8

substantially equivalent credentials and qualifications SATISFIES THE9

REQUIREMENTS OF THE OCCUPATIONAL CREDENTIAL PORTABILITY10

PROGRAM.11

SECTION 29. In Colorado Revised Statutes, 12-255-111, amend12

(3)(c) as follows:13

12-255-111. Requirements for advanced practice nurse14

registration - legislative declaration - advanced practice registry -15

rules. (3) (c) A professional nurse may be included in the advanced16

practice registry by endorsement if the professional nurse meets one of17

the following qualifying standards: THE REQUIREMENTS OF THE18

OCCUPATIONAL CREDENTIAL PORTABILITY PROGRAM.19

(I) The professional nurse is recognized as an advanced practice20

nurse in another state or jurisdiction and has practiced as an advanced21

practice nurse for at least two of the last five years immediately preceding22

the date of application for inclusion in the advanced practice registry; or23

(II) The professional nurse holds national certification as provided24

in subsection (3)(b) of this section and possesses an appropriate graduate25

degree as determined by the board.26

SECTION 30. In Colorado Revised Statutes, 12-255-114, amend27

12-255-114. Requirements for practical nurse licensure.2

(2) The board may issue a license by endorsement to engage in the3

practice of practical nursing in this state to any applicant who has been4

duly licensed or registered as a practical nurse or who is entitled to5

perform similar services under laws of another state or a territory of the6

United States or a foreign country if the applicant presents proof7

satisfactory to the board that, at the time of application for a Colorado8

license by endorsement, the applicant possesses credentials and9

qualifications that are substantially equivalent to requirements in10

Colorado for licensure by examination. The board may specify by rule11

what shall constitute substantially equivalent credentials and12

qualifications SATISFIES THE REQUIREMENTS OF THE OCCUPATIONAL13

CREDENTIAL PORTABILITY PROGRAM.14

SECTION 31. In Colorado Revised Statutes, 12-255-117, amend15

(1) as follows:16

12-255-117. Temporary licenses and permits. (1) The board17

may issue a temporary license to practice for a period of four months to18

an applicant for licensure by endorsement pending compliance with the19

requirements for licensure. To obtain a temporary license, the applicant20

for licensure by endorsement shall show evidence of current licensure in21

another state or country or in a territory of the United States PURSUANT TO22

THE OCCUPATIONAL CREDENTIAL PORTABILITY PROGRAM.23

SECTION 32. In Colorado Revised Statutes, amend 12-260-10724

as follows:25

12-260-107. Certification by endorsement. (1) Every AN26

applicant for MAY OBTAIN certification by endorsement shall pay the27

required application fee, shall submit the information required by the1

board in the manner and form specified by the board, and shall submit2

written evidence that the applicant: IF THE APPLICANT SATISFIES THE3

REQUIREMENTS OF THE OCCUPATIONAL CREDENTIAL PORTABILITY4

PROGRAM.5

(a) Is certified to practice as a nurse aide by another state or6

territory of the United States with requirements that are essentially similar7

to the requirements for certification set out in this article 260 and that the8

certification is in good standing;9

(b) Has not committed any act or omission that would be grounds10

for discipline or denial of certification under this article 260;11

(c) Has successfully completed an education program approved12

by the board or a nurse aide training program that meets the standards for13

the programs specified in this article 260 and those standards set by the14

board; and15

(d) Has no record of abuse, negligence, or misappropriation of16

resident's property or any disciplinary action taken or pending in any other17

state or territory against the certification.18

SECTION 33. In Colorado Revised Statutes, amend 12-265-11219

as follows:20

12-265-112. Licensure by endorsement. (1) (a) The board shall21

issue a license to any person duly licensed to practice nursing home22

administration in another state or territory of the United States who: BY23

ENDORSEMENT TO AN APPLICANT WHO SATISFIES THE REQUIREMENTS OF24

THE OCCUPATIONAL CREDENTIAL PORTABILITY PROGRAM.25

(I) Provides written documentation verifying that the applicant has26

passed a national examination administered by a nationally recognized27

testing entity for nursing home administrators and has passed an1

examination in another state; and2

(II) Successfully completes the Colorado state examination3

provided in section 12-265-111.4

(b) For purposes of this section, "state or territory" includes the5

District of Columbia and the commonwealth of Puerto Rico.6

(2) An applicant for licensure under this section shall submit to7

the board, in a manner prescribed by the board, all of the following:8

(a) Evidence that the applicant holds a current, active license to9

practice nursing home administration issued by a state or territory of the10

United States other than Colorado. The evidence shall include a license11

history from the state or territory that issued the license, indicating12

whether any disciplinary or other adverse actions are currently pending13

or have ever been taken in connection with that license and the final14

disposition of these actions, if any. If an applicant is or has been licensed15

in more than one state or territory other than Colorado, the applicant shall16

submit a license history or similar record as described in this subsection17

(2)(a) from each such state or territory.18

(b) A license history or similar record, as described in subsection19

(2)(a) of this section, relating to any license or registration that the20

applicant holds or has held in any other health care occupation in any21

state or territory other than Colorado. For purposes of this section, "health22

care occupation" includes without limitation the practices of medicine,23

dentistry, psychiatry, psychology, nursing, physical therapy, gerontology,24

chiropractic, podiatry, midwifery, optometry, pharmacy, and any other25

practice in which individuals are treated for medical or psychological26

problems or conditions, as well as the rendition of any service supportive27

to or ancillary to those practices.1

(c) (I) Verification that the applicant has been engaged in the2

practice of nursing home administration, has taught in a health care3

administration program, or has served as a member of a nursing home4

survey or accreditation team for one year immediately preceding the date5

of the receipt of the application, or has been engaged in one of the6

services described in this subsection (2)(c)(I) for three of the five years7

immediately preceding the date of the receipt of the application; or8

(II) Evidence that the applicant has demonstrated competency as9

a nursing home administrator as determined by the board.10

SECTION 34. In Colorado Revised Statutes, 12-270-107, amend11

(5) as follows:12

12-270-107. Licensure of occupational therapists - application13

- qualifications. (5) Licensure by endorsement. (a) An applicant for14

MAY OBTAIN licensure by endorsement must file an application and pay15

a fee as prescribed by the director and must hold a current, valid license16

or registration in a jurisdiction that requires qualifications substantially17

equivalent to those required by subsection (1) of this section for licensure18

IF THE APPLICANT SATISFIES THE REQUIREMENTS OF THE OCCUPATIONAL19

CREDENTIAL PORTABILITY PROGRAM.20

(b) An applicant for licensure by endorsement must submit with21

the application verification that the applicant has actively practiced for a22

period of time determined by rules of the director or otherwise maintained23

competency as determined by the director.24

(c) Upon receipt of all documents required by subsections (5)(a)25

and (5)(b) of this section, the director shall review the application and26

make a determination of the applicant's qualification to be licensed by27

(d) The director may deny the application for licensure by2

endorsement if the applicant has committed an act that would be grounds3

for disciplinary action under section 12-270-114.4

SECTION 35. In Colorado Revised Statutes, 12-270-108, amend5

(5) as follows:6

12-270-108. Occupational therapy assistants - licensure -7

application - qualifications. (5) Licensure by endorsement. (a) An8

applicant for MAY OBTAIN licensure by endorsement must file an9

application and pay a fee as prescribed by the director and must hold a10

current, valid license or registration in a jurisdiction that requires11

qualifications substantially equivalent to those required for licensure by12

subsection (1) of this section IF THE APPLICANT SATISFIES THE13

REQUIREMENTS OF THE OCCUPATIONAL CREDENTIAL PORTABILITY14

PROGRAM.15

(b) An applicant for licensure by endorsement must submit with16

the application verification that the applicant has actively practiced as an17

occupational therapy assistant for a period of time determined by rules of18

the director or otherwise maintained competency as an occupational19

therapy assistant as determined by the director.20

(c) Upon receipt of all documents required by subsections (5)(a)21

and (5)(b) of this section, the director shall review the application and22

make a determination of the applicant's qualification to be licensed by23

endorsement as an occupational therapy assistant.24

(d) The director may deny the license if the applicant has25

SECTION 36. In Colorado Revised Statutes, 12-275-110, amend1

(2) as follows:2

12-275-110. Application for license - licensure by3

endorsement. (2) (a) The board may issue a license by endorsement to4

engage in the practice of optometry to an applicant who SATISFIES THE5

REQUIREMENTS OF THE OCCUPATIONAL CREDENTIAL PORTABILITY6

PROGRAM.7

(I) (A) Is currently licensed and is in practice and good standing8

in another state or territory of the United States or in a foreign country if9

the applicant presents proof satisfactory to the board at the time of10

application for a Colorado license by endorsement;11

(B) Pays a fee as prescribed by the board; and12

(II) (A) Possesses credentials and qualifications that are13

substantially equivalent to requirements for licensure by examination; or14

(B) Has demonstrated competency as an optometrist as15

determined by the board.16

(b) The board shall specify by rule what shall constitute17

substantially equivalent credentials and qualifications or competency.18

SECTION 37. In Colorado Revised Statutes, 12-280-114, amend19

(8) as follows:20

12-280-114. Licensure, certification, or registration -21

applicability - applications - licensure and certification requirements22

- rules. (8) A person licensed by examination and in good standing in23

another state may apply for a license transfer The board shall designate24

a clearinghouse for license transfer applicants, and a person applying for25

a license transfer shall apply through the clearinghouse designated by the26

board PURSUANT TO THE OCCUPATIONAL CREDENTIAL PORTABILITY27

SECTION 38. In Colorado Revised Statutes, amend 12-285-1122

as follows:3

12-285-112. Licensure by endorsement. (1) An applicant for4

MAY OBTAIN licensure by endorsement shall: IF THE APPLICANT SATISFIES5

THE REQUIREMENTS OF THE OCCUPATIONAL CREDENTIAL PORTABILITY6

PROGRAM.7

(a) Possess a valid license in good standing from another state or8

territory of the United States;9

(b) Submit an application in the form and manner designated by10

the director; and11

(c) Pay a fee in an amount determined by the director.12

(2) Upon receipt of all documents required by subsection (1) of13

this section, the director shall review the application and determine if the14

applicant is qualified to be licensed by endorsement.15

(3) The board shall issue a license if the applicant fulfills the16

requirements of subsection (1) of this section and meets any one of the17

following qualifying standards:18

(a) The applicant graduated from an accredited program within the19

past two years and passed an examination substantially equivalent to that20

specified in section 12-285-110 (1)(b);21

(b) The applicant has practiced as a licensed physical therapist for22

at least two of the five years immediately preceding the date of the23

application;24

(c) The applicant has:25

(I) Not practiced as a licensed physical therapist at least two of the26

last five years immediately preceding the date of the receipt of the27

(II) Passed an examination in another jurisdiction that is2

substantially equivalent to the examination specified in section3

12-285-110 (1)(b); and4

(III) Demonstrated competency through successful completion of5

an internship or demonstrated competency as a physical therapist by6

fulfilling the requirements established by rules of the board.7

(4) The board may deny a license if the applicant has committed8

an act that would be grounds for disciplinary action under section9

12-285-120.10

SECTION 39. In Colorado Revised Statutes, amend 12-285-20611

as follows:12

12-285-206. Certification by endorsement. (1) An applicant for13

MAY OBTAIN certification by endorsement shall: IF THE APPLICANT14

SATISFIES THE REQUIREMENTS OF THE OCCUPATIONAL CREDENTIAL15

PORTABILITY PROGRAM.16

(a) Possess a valid license, certification, or registration in good17

standing from another state or territory of the United States;18

(b) Submit an application in the form and manner designated by19

the director; and20

(c) Pay a fee in an amount determined by the director.21

(2) Upon receipt of all documents required by subsection (1) of22

this section, the director shall review the application and make a23

determination of the applicant's qualification to be certified by24

endorsement.25

(3) The board shall issue a certification if the applicant fulfills the26

requirements of subsection (1) of this section and meets any one of the27

(a) The applicant graduated from an accredited program within the2

past two years and passed an examination substantially equivalent to the3

examination specified in section 12-285-205 (1)(b);4

(b) The applicant has practiced as a licensed, certified, or5

registered physical therapist assistant for at least two of the five years6

immediately preceding the date of the application; or7

(c) The applicant has passed an examination in another8

jurisdiction that is substantially equivalent to the examination specified9

in section 12-285-205 (1)(b), and has demonstrated competency through10

successful completion of an internship or demonstrated competency as a11

physical therapist assistant by fulfilling the requirements established by12

rules of the board.13

(4) The board may deny certification if the applicant has14

committed an act that would be grounds for disciplinary action under15

section 12-285-211.16

SECTION 40. In Colorado Revised Statutes, amend 12-290-11217

as follows:18

12-290-112. Licensure by endorsement. (1) The board may19

issue a license by endorsement to engage in the practice of podiatry in this20

state to any applicant who has a license in good standing as a podiatrist21

under the laws of another jurisdiction if the applicant presents proof22

satisfactory to the board that, at the time of application for a Colorado23

license by endorsement, the applicant possesses credentials and24

qualifications that are substantially equivalent to requirements in25

Colorado for licensure by examination, and that in the two years26

immediately preceding the date of the application the applicant has been27

otherwise demonstrate competency as determined by the board. The board2

may specify by rule what shall constitute substantially equivalent3

credentials and qualifications SATISFIES THE REQUIREMENTS OF THE4

OCCUPATIONAL CREDENTIAL PORTABILITY PROGRAM.5

(2) A fee to be set by the board shall be charged for registration6

by endorsement.7

(3) "In good standing", as used in subsection (1) of this section,8

means a license that has not been revoked or suspended or against which9

there are no current disciplinary or adverse actions.10

SECTION 41. In Colorado Revised Statutes, amend 12-295-10811

as follows:12

12-295-108. License by endorsement. The board may issue a13

license without examination to an applicant who is licensed or otherwise14

registered as a psychiatric technician by another state or a territory of the15

United States if the requirements for license or registration in the other16

state or territory are substantially equal to the requirements in this article17

295; but in no event shall an applicant be required to meet qualifications18

higher than those in force in this state at the time of his or her application19

for license in this state. Every applicant under this section shall state20

under oath that he or she has not committed an act that would be grounds21

for disciplinary action under this article 295 and that the applicant has22

completed a four-year high school course of study or the equivalent23

thereof TO AN APPLICANT WHO SATISFIES THE REQUIREMENTS OF THE24

OCCUPATIONAL CREDENTIAL PORTABILITY PROGRAM.25

SECTION 42. In Colorado Revised Statutes, 12-300-107, amend26

(2)(a) as follows:27

issue a license to practice respiratory therapy to an applicant who2

otherwise meets the qualifications set forth in this article 300 and who3

submits satisfactory proof and certifies under penalty of perjury that the4

applicant is either:5

(a) Currently in possession of an unrestricted license in good6

standing to practice respiratory therapy under the laws of another state or7

territory of the United States or foreign country, if the qualifications of8

the applicant are deemed by the director to be substantially equivalent to9

those required by this state, and whether the applicant has ever had a10

disciplinary action taken in regard to the applicant's license to practice11

respiratory therapy in another state ELIGIBLE FOR LICENSURE BY12

ENDORSEMENT PURSUANT TO THE OCCUPATIONAL CREDENTIAL13

PORTABILITY PROGRAM;14

SECTION 43. In Colorado Revised Statutes, 12-305-107, amend15

(4) as follows:16

12-305-107. Certification - application - qualifications -17

provisional certification - renewal - fees - rules. (4) Certification by18

endorsement. (a) An applicant for MAY OBTAIN certification by19

endorsement shall file an application and pay a fee as determined by the20

director and shall hold a current, valid license or certification in a21

jurisdiction that requires qualifications substantially equivalent to those22

required for certification by subsection (1) of this section IF THE23

APPLICANT SATISFIES THE REQUIREMENTS OF THE OCCUPATIONAL24

CREDENTIAL PORTABILITY PROGRAM.25

(b) An applicant for certification by endorsement shall submit26

with the application verification that the applicant has actively practiced27

for a period of time determined by rules of the director or otherwise1

maintained competency as determined by the director. Additionally, If the2

applicant will provide speech-language pathology services to patients, the3

applicant shall submit to the director proof that the applicant has4

purchased and is maintaining or is covered by professional liability5

insurance in an amount determined by the director by rule.6

(c) Upon receipt of all documents required by subsections (4)(a)7

and (4)(b) of this section, the director shall review the application and8

make a determination of the applicant's qualification to be certified by9

endorsement.10

(d) The director may deny the certification by endorsement if the11

applicant has committed an act that would be grounds for disciplinary12

action under section 12-305-112.13

SECTION 44. In Colorado Revised Statutes, amend 12-315-10914

as follows:15

12-315-109. License by endorsement. The board may issue a16

license by endorsement to engage in the practice of veterinary medicine17

in this state to an applicant who has a license in good standing as a18

veterinarian in another jurisdiction if the applicant presents proof19

satisfactory to the board that, at the time of application for a Colorado20

license by endorsement, the applicant possesses credentials and21

qualifications that are substantially equivalent to the Colorado22

requirements for licensure set forth in section 12-315-107. The board may23

specify, by rule, what constitutes substantially equivalent credentials and24

qualifications SATISFIES THE REQUIREMENTS OF THE OCCUPATIONAL25

CREDENTIAL PORTABILITY PROGRAM.26

applicability. (1) This act takes effect at 12:01 a.m. on the day following1

the expiration of the ninety-day period after final adjournment of the2

general assembly (August 5, 2020, if adjournment sine die is on May 6,3

2020); except that, if a referendum petition is filed pursuant to section 14

(3) of article V of the state constitution against this act or an item, section,5

or part of this act within such period, then the act, item, section, or part6

will not take effect unless approved by the people at the general election7

to be held in November 2020 and, in such case, will take effect on the8

date of the official declaration of the vote thereon by the governor.9

(2) This act applies to applications filed on or after the applicable10

effective date of this act.11
