1. Call to Order by Presiding Officer
A. Roll call of Board members and establishment of a quorum to conduct meeting.
The meeting was called to order at 1:10 pm. Roll Call: Ms. Bennett; Present, Ms. Tibbitts; Present,

2. Civility Statement
In accordance with the Open Meeting Law, the Board has a civility policy that prohibits any type of
disorderly conduct that disrupts the Board from carrying out its business. Those violating this policy will be asked
to modify their behavior and act civilly. If the disorderly conduct continues, the person may be removed from the
meeting room. (Adopted 11/8/2012)

6. Regulatory Matters
N. Discussion, Consideration, Possible Action by the Board of Investigations and Complaints.
(The Board may go into executive session on any of the following items under A.R.S. § 38-
431.03(A)(2) for discussion of any information made confidential by law.)
(1) Dr. Dayna Monterrey, Case No. 14-016 - Investigative Interview.
Dr. Monterrey was present. She stated she disagreed with the term severe elevations. She
stated that the complainant did not contact her regarding the lab results, but chose to file the complaint directly. Dr.
Sadilek stated he was concerned about the patient's TSH level. After running a patient report on the State of
Arizona Prescription Monitoring Program, and speaking directly with compounding pharmacist, Dr. Monterrey
discovered the patient was seeing multiple physicians and picking up multiple prescriptions. Dr. Monterrey
ultimately dismissed the patient from care. Dr. Terlisner stated she did not find the dosing in this case to be harmful
and that the patient may have been double dosing. Dr. Marchese made a motion to dismiss the case. Seconded by
Dr. Terlisner. Motion Carried.

Dr. Anderson was not present. Dr. Marchese pointed out that the DEA certificate is Federal
and not state specific. Ms. Bennet stated Respondent does not practice in the State of Arizona. Dr. Sadilek made a
motion to dismiss. Seconded by Dr. Terlisner. Motion Carried.

(3) Dr. Don Selvey, Case No. 15-001 - Formal Interview
Dr. Selvey was present along with Council, Ms. Carol Romero. The complaint originated
from Health Choice Quality Management Department, after a patient death review. Dr. Selvey stated he was not the
physician who had initiated the therapy, but he did continued to renew the medications after she established care
with him. Dr. Selvey stated he no longer treats patients for pain management.
Dr. Danielle Holloway requested to make a statement to the Board. She was not part of the case, however wanted to
make a statement to the Board regarding pain management prescribing.
Dr. Sadilek made a motion to issue a Letter of Reprimand for polypharmacy prescription protocols, and noted that
the patient charts did not show tapering, or any type of request for the patients to try other options for pain relief,
such as acupuncture or physical therapy.
Dr. Eldridge made a motion to restrict his DEA license for 1 year.

Dr. Sadilek made a motion to go into Executive Session for Legal advice. Seconded by Mr. Logan. Motion Carried,
7 Ayes.
The Board returned to regular session at 4:00 pm.
Dr. Marchese made a motion to issue a non-disciplinary Letter of Concern for Dr. Selvey's use of polypharmacy in
the treatment of 6 patients in 2014- early 2015. Seconded by Dr. Terlisner. Motion Carried

(4) Dr. Ramon Esquerdo, Case No. 15-016 - Investigative Interview.
Dr. Esquerdo was present along with Council, Mr. David Williams. Ms. Anthony discussed
the allegations were based on an Arizona Pharmacy Board Prescription Monitoring Program audit which had been
run by the Board. The audit showed several prescriptions had been written by Dr. Esquerdo that, pursuant to an
inforce consent agreement with the Board, was not within his scope to write. After verification of the prescriptions
with the pharmacies, it appeared to be pharmacy error, and the prescriptions had in fact been written by another
physician in the office. Dr. Sadilek made a motion to dismiss the case. Seconded by Dr. Terlisner. Motion Carried.

(5) Dr. Ramon Esquerdo, Case No. 14-017- Formal Interview.
The patient was not the complainant in this case. The complaint was received by Cigna
Medical Group after review of a claim for payment of services for a blood patch. Respondent stated that the patient
did have a reaction after he performed prolotherapy injection, he suspected a spinal nick and performed all
appropriate procedures, including dialing 911, after the patient complained of symptoms. The patient signed a
consent to treat form prior to the procedure, risks /benefits of the procedure were discussed. Respondent followed
up with the patient many times after the in- office incident and after the blood patch procedure. Dr. Sadilek made a
motion to dismiss the case. Seconded by Dr. Eldridge. Motion Carried.

(6) Dr. Briana Cain, Case No. 15-009 -Investigative Interview.
Dr. Cain was present and answered questions by the Board. Dr. Cain stated she was the
Medical Director of the National Laser Institute at the time the complainant was treated for the brown spot on her
face, however did not see the patient prior to the incident, and was not the one who performed the procedure. Dr.
Cain stated she was the physician who saw the patient when she presented 10 days post treatment. During the days
prior to presenting to Dr. Cain, the patient admitted to using an ointment on the area which had been veterinarian
prescribed to her dog. She also admitted to using an outdated over the counter medication on the area. She further

reported presenting to a dermatologist, who had injected the area with Kenalog. Upon review of the records, it was
discovered the patient had not signed the consent to treat form.
The complainant was present. After discussion, the Board stated concerns regarding the lack of follow up on the
part of Dr. Cain. Although Dr. Cain had evaluated and treated the patient for a burn, she should have been more
diligent and followed up with another in person encounter, Instead, Dr. Cain relied on a photo she received via
email from the patient as the follow up.
Dr. Marchese made a motion to issue a Letter of Concern for the following based on the fact that Dr. Cain was the
Medical Director at the time. Concern 1. Failure to ensure the risks and benefits of the procedure were not only
verbalized to the patient, but that the patient signed a consent to treat form for the procedure to be done on the face.
Concern 2. Failure to supervise the esthetician, to ensure the risks and benefits had been explained to the patient
and that the consent to treat form was signed for the treatment of the face. Concern 3. Failure to follow up with the
patient in person, after her initial evaluation and treatment recommendation. Seconded by Dr. Terlisner. Motion

Dr. Kim was present. She stated she was not the person who performed the Botox injections,
that it was a Physicians Assistant who performed the procedure. She, and the PA were working under an allopathic
medical director at the medspa. A few days after the treatment, the patient presented to the medspa upset at the
results of her treatment and wanted a refund. A partial refund was offered by another member of the staff, however
the patient refused the offer and refused to have after photos. Dr. Sadilek made a motion to dismiss. Seconded by
Dr. Terlisner. Motion Carried.

(8) Dr. Melenie Dunn, Case No. 15-010 - Investigative Interview.
Dr. Dunn was present. She stated that at the medical marijuana clinical records are scanned,
which include the queried report from the pharmacy board. She stated that the clinic was using another physicians
DEA registration to pull the pharmacy board queries until she was able to obtain her own log in. Dr. Sadilek made
a motion to issue a letter of concern. Seconded by Dr. Eldridge. Dr. Marchese asked Dr. Dunn is she felt she had
enough education in certifying medical marijuana and her roll as a Naturopathic Physician. Dr. Dunn stated at that
time, she did not, and she was more educated now. Dr. Marchese pointed out an upcoming medical marijuana
conference being presented by the AzNMA. Dr. Sadilek pointed out that the University of Arizona offers CME on
Medical Marijuana. Both encouraged Dr. Dunn to participate in these opportunities for further education.
