Standards of Student Conduct Division of Student Development updated July 30, 2020 1 Statement of Purpose The mission of the University of Richmond is to educate in an academically challenging, intellectually vibrant, and collaborative community dedicated to the holistic development of students and the production of scholarly and creative work. A Richmond education prepares students for lives of purpose, thoughtful inquiry, and responsible leadership in a diverse world. To that end, the University has established the following Standards of Student Conduct in order to foster an environment that is most conducive to meeting the University’s mission. The Standards of Student Conduct are in place to promote a safe, secure, and inclusive campus community and an appropriate environment for living and learning. These Standards describe conduct that is prohibited at the University and sets forth procedures by which student conduct matters will be handled at the University. Student conduct matters shall be handled in a prompt, fair, and impartial manner. The Standards shall govern the conduct of students and their guests on the campus of the University of Richmond, at University-sponsored activities and functions and as otherwise provided herein. All students of the University are expected to conduct themselves, both within the University and elsewhere, in such a manner as to be a credit to them and to the University of Richmond. As responsible citizens and members of the University community, students are expected to comply with local, state, and federal laws, and with all published University policies and regulations. In order to fulfill its functions as an educational institution and to protect all members of the University community, the University of Richmond has the right to maintain order within the University and to exclude persons who disrupt the educational process. Matriculation and/or continued enrollment at the University of Richmond is a privilege, not a right. Any revocation of such a privilege would be an intention to protect or support the standards of the University community. All students are expected to familiarize themselves with the details of these standards, issued annually or more frequently by the University. The Vice President for Student Development is the person designated by the University President to be responsible for the administration of the Standards of Student Conduct. The Standards of Student Conduct, University policies, and related conduct procedures are not contracts and do not confer contractual rights upon any individual. The University has the right to amend or modify the Standards of Student Conduct, University policies, and related conduct procedures from time to time, without prior notice. Additionally, the Standards of Student Conduct, University policies, and related conduct procedures are not intended to replicate or supersede state, federal, criminal, or civil laws or procedures. University policies differ from the criminal and civil justice system and a finding of responsibility for a violation of the Standards of Student Conduct or a University policy shall not be construed as a finding that any criminal or civil statute has been violated.

StatementofPurposeThemissionoftheUniversityofRichmondistoeducateinanacademicallychallenging,intellectuallyvibrant,andcollaborativecommunitydedicatedtotheholisticdevelopmentofstudentsandtheproductionofscholarlyandcreativework.ARichmondeducationpreparesstudentsforlivesofpurpose,thoughtfulinquiry,andresponsibleleadershipinadiverseworld.Tothatend,theUniversityhasestablishedthefollowingStandardsofStudentConductinordertofosteranenvironmentthatismostconducivetomeetingtheUniversity’smission.TheStandardsofStudentConductareinplacetopromoteasafe,secure,andinclusivecampuscommunityandanappropriateenvironmentforlivingandlearning.TheseStandardsdescribeconductthatisprohibitedattheUniversityandsetsforthproceduresbywhichstudentconductmatterswillbehandledattheUniversity.Studentconductmattersshallbehandledinaprompt,fair,andimpartialmanner.TheStandardsshallgoverntheconductofstudentsandtheirguestsonthecampusoftheUniversityofRichmond,atUniversity-sponsoredactivitiesandfunctionsandasotherwiseprovidedherein.AllstudentsoftheUniversityareexpectedtoconductthemselves,bothwithintheUniversityandelsewhere,insuchamannerastobeacredittothemandtotheUniversityofRichmond.AsresponsiblecitizensandmembersoftheUniversitycommunity,studentsareexpectedtocomplywithlocal,state,andfederallaws,andwithallpublishedUniversitypoliciesandregulations.InordertofulfillitsfunctionsasaneducationalinstitutionandtoprotectallmembersoftheUniversitycommunity,theUniversityofRichmondhastherighttomaintainorderwithintheUniversityandtoexcludepersonswhodisrupttheeducationalprocess.Matriculationand/orcontinuedenrollmentattheUniversityofRichmondisaprivilege,notaright.AnyrevocationofsuchaprivilegewouldbeanintentiontoprotectorsupportthestandardsoftheUniversitycommunity.Allstudentsareexpectedtofamiliarizethemselveswiththedetailsofthesestandards,issuedannuallyormorefrequentlybytheUniversity.TheVicePresidentforStudentDevelopmentisthepersondesignatedbytheUniversityPresidenttoberesponsiblefortheadministrationoftheStandardsofStudentConduct.TheStandardsofStudentConduct,Universitypolicies,andrelatedconductproceduresarenotcontractsanddonotconfercontractualrightsuponanyindividual.TheUniversityhastherighttoamendormodifytheStandardsofStudentConduct,Universitypolicies,andrelatedconductproceduresfromtimetotime,withoutpriornotice.Additionally,theStandardsofStudentConduct,Universitypolicies,andrelatedconductproceduresarenotintendedtoreplicateorsupersedestate,federal,criminal,orcivillawsorprocedures.UniversitypoliciesdifferfromthecriminalandciviljusticesystemandafindingofresponsibilityforaviolationoftheStandardsofStudentConductoraUniversitypolicyshallnotbeconstruedasafindingthatanycriminalorcivilstatutehasbeenviolated.

ArticleI:DefinitionsA. Administrator/StaffMember.Theterms“staffmember”and“administrator”meananypersonemployed

bytheUniversitytoconductadministrative,professional,ortradeassignments.

B. AppellateAdministrator.Theterm“AppellateAdministrator”meansanypersonauthorizedbytheVicePresidentforStudentDevelopmenttoconsideranappealfromaStudentConductBoard.

C. Campus.Theterm“campus”includesanybuildingorpropertyownedorcontrolledbytheUniversitywithinthesamereasonablycontiguousgeographicareaoftheUniversityandusedbytheUniversityindirectsupportof,orinamannerrelatedto,itseducationalpurposes,includingresidencehallsandapartmentsandanybuildingorpropertywithinorreasonablycontiguoustothecampusthatisownedbytheUniversity,isfrequentlyusedbystudents,andsupportsUniversitypurposes.

D. Chair.Theterm“Chair”meansthechairpersonoftheapplicableStudentConductBoard.

E. College.Theterm“College”meanseither“RichmondCollege”or“WesthamptonCollege.”

F. Complainant.Theterm“Complainant”meansthestudentorotherindividualwhoisallegedtobethevictimorsubjectofconductthatformsthebasisforadisciplinarycharge.

G. ConductOfficer.Theterm“ConductOfficer”meansanypersonorpersonsauthorizedonanon-goingoracase-by-casebasisbytheVicePresidentforStudentDevelopmentto:(i)chargeastudentwithaviolationoftheStandardsofStudentConduct;(ii)conductpreliminaryhearings;and(iii)imposesanctionsuponanystudent(s)whoaccept(s)responsibilityforaviolationoftheStandardsofStudentConduct.ConductOfficersoftherankofDeanareempoweredtoimposeasanctionofsuspension,toissueNoContactOrders,andtoimposeInterimSuspensions.

H. Copy.Theterm“copy”includesallmethodsofduplicationtoinclude,butnotlimitedto,useofacamera,recordingdevice,mobilephoneand/ormobilephoneapplication(s),scannerandcopymachine,

I. FacultyMember.Theterm“facultymember”meansanypersonhiredbytheUniversitytoconductclassroomorteachingactivitiesorwhoisotherwiseconsideredbytheUniversitytobeamemberofthefaculty.

J. HearingOfficerforSpecificMattersInvolvingtheUniversity’sPolicyProhibitingSexualMisconduct.Theterm“HearingOfficer”meansanypersonorpersonsauthorizedonanon-goingora case-by-casebasisbytheVicePresidentforStudentDevelopmenttoconductthehearingprocessonbehalfoftheUniversityHearingBoard. TheHearingOfficerisconsideredanon-votingmemberoftheUniversity HearingBoard.TheHearingOfficershallnotbeanemployeeoftheUniversity.

L. May.Theterm“may”isusedinthepermissivesense.

M. MemberoftheUniversityCommunity.Theterm“memberoftheUniversitycommunity”includesanypersonwhoisastudent,facultymember,staffmember,administrator,Universityofficial,oranyotherpersonemployedbytheUniversityoractingasaUniversityvolunteer.TheVicePresidentforStudentDevelopmentortheirdesigneeshalldetermineaperson’sstatusinaparticularsituation.

N. Off-CampusBuildingsorProperty.Theterm“off-campusbuildingsorproperty”meansanybuildingorpropertyownedorcontrolledbyastudentorganizationofficiallyrecognizedbytheUniversityandanybuildingorpropertyownedorcontrolledbytheUniversity,usedindirectsupportof,orinrelationto,theUniversity’seducationalpurposes,andfrequentlyusedbystudents.

O. Off-CampusEducationProgramsandActivities.Theterm“off-campusprogramsandactivities”meanseducational,extra-curricular,orathleticactivitiesinvolvingorganizationsorprogramsoractivitiesrecognizedorsponsoredbytheUniversity,suchasUniversity-sponsoredtrips,athleticteamtravel,eventsfororganizationsthatoccuroffcampus(e.g.,adebateteamtriptoanotherschoolortoaweekendcompetition).

P. Organization.Theterm“organization”or“organizations”meansanynumberofpersonswhohavecompliedwiththeformalrequirementsforUniversityrecognitionandregistration.

Q. PresidingOfficer.Theterm“PresidingOfficer”meanstheAdvisoroftheStudentConductCouncilortheHearingOfficeroftheUniversityHearingBoard.

R. PublicProperty.Theterm“publicproperty”meansstreets,sidewalks,orparkingfacilitieswithinthecampusorimmediatelyadjacenttoandaccessiblefromcampus.

S. Respondent.Theterm“Respondent”meansanystudentchargedwithviolatingtheStandardsofStudentConductoraUniversitypolicy.

T. School.Theterm“School”meanstheSchoolofArts&Sciences,theRobinsSchoolofBusiness,theJepsonSchoolofLeadershipStudies,theUniversityofRichmondSchoolofLaw,ortheSchoolofProfessionalandContinuingStudies.

U. Shall.Theterm“shall”isusedinthemandatorysense.

V. Student.Theterm“student”includesallpersonstakingcoursesattheUniversity,eitherfull-timeorpart-time,pursuingundergraduate,graduate,orprofessionalstudies.Personswhowithdrawduringaninvestigationorwithapendingconductchargeorproceeding,orwhoarenotofficiallyenrolledforaparticulartermbutwhohaveacontinuingrelationshipwiththeUniversityareconsidered“students”forpurposesoftheseStandardsofStudentConduct.

W. StudentConductAdministrator.Theterm“StudentConductAdministrator”meansanypersonauthorizedbytheVicePresidentforStudentDevelopmenttofollowtheStandardsofStudentConductindeterminingtheappropriateConductOfficer,PresidingOfficer,orConductBoardauthorizedtoheareachmatter.

X. StudentConductBoard.Theterm“StudentConductBoard”or“Board”meansagroupauthorizedbytheVicePresidentforStudentDevelopmenttodeterminewhetherastudent,students,orastudentorganizationhasviolatedtheStandardsofStudentConductandtodeterminesanctionsthatmaybeimposedwhenaviolationhasbeencommitted.ThistermincludestheStudentConductCouncilandtheUniversityHearingBoard.

Y. StudentConductCouncil.Theterm“UniversityofRichmondStudentConductCouncil”or“StudentConductCouncil”meansaspecificStudentConductBoardcomprisedofstudentsspeciallyselectedandtrainedbytheUniversity.

Z. University.Theterm“University”means“UniversityofRichmond”.

AA. UniversityHearingBoardorUHB.Theterm“UniversityHearingBoard”or“UHB”meansaspecificStudentConductBoardcomprisedofUniversitystaffmembersspeciallyselectedandtrainedbytheUniversity.

BB. UniversityOfficial.Theterm“Universityofficial”includesanyindividualemployedbytheUniversity,performingassignedadministrativeorprofessionalduties.AUniversityofficialmayincludestudentstaffsuchasResidentAdvisorsandEmergencyMedicalTechnicians.

CC. UniversityPolicy.Theterm“Universitypolicy”meansanypolicy,rule,orregulationoftheUniversity.

DD. UniversityPremises.ForpurposesoftheseStandardsofStudentConduct,theterm“Universitypremises”includes:(1)anybuildingorpropertythatispartoftheUniversity’scampus;(2)anybuildingorpropertythatisnotlocatedonoradjacentorcontiguoustothecampus,butisownedorcontrolledbyaUniversityrecognizedorganizationorthatisusedindirectsupportoforinrelationtotheUniversity’seducationalpurposesandisfrequentlyusedbystudents;(3)publicpropertywithinthecampusorimmediatelyadjacenttoandaccessiblefromcampus(suchaspublicroads,sidewalks,parkinglots);or(4)otherareasthatarewithinthepatroljurisdictionoftheUniversityPoliceDepartment.

ArticleII:StandardsofStudentConductAuthorityA. TheVicePresidentforStudentDevelopmentortheirdesigneeshalldeveloppoliciesforthe

administrationofthestudentconductsystemandproceduralrulesfortheconductoftheStudentConductBoardHearingsthatarenotinconsistentwiththeprovisionsoftheStandardsofStudentConduct.

B. SubjecttotheappealrightssetforthintheseStandards,decisionsmadebyaStudentConductBoardand/orConductOfficershallbefinal.

ArticleIII:JurisdictionandProhibitedConduct

A. JurisdictionoftheStandardsofStudentConduct

TheStandardsofStudentConductshallapplytoconductthatoccursonthecampusoftheUniversity,onorinoff-campusbuildingsorpropertyoftheUniversity,andatUniversitysponsoredactivities,includingoff-campuseducationprogramsandactivities,oronpublicproperty,asdefinedinArticleI.

TheStandardsofStudentConductalsoapplytoUniversitystudentsstudyingabroadthroughaUniversityapprovedstudyabroadprogram.TheStandardsofStudentConductapplytoconductbyaUniversitystudentororganizationsoccurringatotherlocationsorinconnectionwithotheractivitiesiftheVicePresidentforStudentDevelopmentortheirdesigneedeterminesthatsuchconductmayadverselyaffectanymemberoftheUniversitycommunity,theUniversityitself,oritseducationalprograms.

FormattersinvolvingsexualharassmentunderTitleIXcoveredbytheUniversity’sPolicyPreventingSexualMisconduct,jurisdictionislimitedtoconductthathasoccurredwithintheUniversity'seducationprogramoractivitywhichincludeslocations,events,orcircumstancesoverwhichtheUniversityexercisedsubstantialcontroloverboththerespondentandthecontextinwhichthesexualharassmentoccursandalsoincludesanybuildingownedorcontrolledbyastudentorganizationthatisofficiallyrecognizedbytheUniversity.TitleIXactionsinvolveconductthathasoccurredwithintheUnitedStatesonly.Eachstudentshallberesponsiblefortheirconductfromtheirfirstdayoncampusthroughtheactualawardingofadegree(eventhoughtheconductmayoccurbeforeclassesbeginorafterclassesend)aswellasduringtheacademicyearandduringperiodsbetweentermsofactualenrollment.StudentswhohaveacceptedadmittancetotheUniversitybuthavenotyetenrolledareexpectedtocomportthemselvesaccordingtotheStandards.TheStandardsofStudentConductshallapplytoastudent’sconductevenifthestudentwithdrawsfromtheUniversitywhileadisciplinarymatterispending.

B. ProhibitedConduct.ThefollowingconductisprohibitedbytheUniversity.

1. Violence.Anyactofviolence,force,coercion,threat,orintimidationthatincludes,butisnotlimitedto:a. Physicalabuseoforassaultuponanyperson;b. Conductthatthreatens,intimidates,orendangersthehealthorsafetyofanyperson;c. Physicaldetainmentofanypersonagainsttheirwill;ord. Possession,storage,useof,orattemptorthreattouseanykindofammunition,explosives,

firearms,orweapon.

2. Property.a. TheftorpossessionofUniversitypropertyorthepropertyofothers.b. Vandalismordamageto,defacement,ordestructionofUniversitypropertyorthepropertyof

others.c. Alteration,fabrication,misuse,ordestructionofUniversitydocumentsincludingrecords,

identificationcards,orparkingstickers/permits.

3. Disruption.a. Obstruction,disruption,orattemptsatobstructionofdisruptionofteaching,research,

administration,disciplinaryprocedures,orotherUniversityorUniversity-authorizedactivities,functions,events,oroperations.

b. BlockingtheentranceorexitofanyUniversityfacilityorbuilding,oranycorridororroomtherein.

c. BlockingorimpedingnormalpedestrianorvehiculartrafficonoradjacenttoUniversityproperty.

d. Disorderlyconduct.e. Disturbingtheresidencehall/community.

4. Trespass.Unauthorizedentryinto,presencein,seizure,oroccupationofanyUniversityfacilityorareathatislocked,closedtostudentactivities,orotherwiserestrictedastoitsusewhereone’spresenceisunauthorized.

5. IllegalActivity.ConductthattheUniversitydeterminesmayviolatelocal,state,orfederallaws,including,butnotlimitedto:a. Possessionand/oruseofillegaldrugs,narcotics,pharmaceuticals,and/ordrugparaphernalia;b. Distributionorsaleofillegaldrugs,narcotics,pharmaceuticals,and/ordrugparaphernalia;c. ViolationofAlcoholandBeverageControl(ABC)Laws;d. Drivingundertheinfluenceand/orwhileintoxicated;e. Possessionand/oruseoffalseidentification;orf. Convictionofanyfelonyorconvictionofamisdemeanorinvolving,fraud,theft,lyingormoral

turpitude.i. Astudentmay,atthediscretionoftheConductOfficerorStudentConductBoardChair,be

foundresponsibleofProhibitedConductIII(B)(5)(f)solelyupontheintroductionintoevidenceataStudentConductBoardhearingofacertifiedcopyofanorderofconvictionorotherdocumentsatisfactorilyevidencingconvictionofafelonyorofamisdemeanor.

6. OtherRegulationsandPolicies.a. Actsofharassmentand/ordiscrimination,orviolationoftheUniversity’sPolicyonPreventing

andRespondingtoDiscriminationandHarassmentAgainstStudents.b. ViolationoftheUniversity’sPolicyProhibitingSexualMisconduct.

i. SexualHarassmentii. SexualAssaultiii. Stalkingiv. DatingViolencev. DomesticViolencevi. SexualExploitation

c. ViolationoftheUniversity’sHazingPolicy.d. ViolationoftheUniversity’sRetaliationPolicy.e. ViolationofrulesandregulationsincludingthosepertainingtotheUniversity’sAlcohol,Tobacco

&OtherDrugPolicy.StudentschargedthroughthestudentconductsystemforalcoholviolationsandfoundresponsiblewillbeissuedsanctionsasoutlinedintheUniversity’sAlcohol,Tobacco&OtherDrugPolicy.i. Consumptionofalcoholunderthelegaldrinkingage.ii. Possessionofalcoholunderthelegaldrinkingage.iii. Possessionofanopencontainerofalcoholinapublicspace.iv. Hostinganillegal/unregisteredeventwithalcohol.v. HostingaregisteredeventwithalcoholthatviolatedtheUniversity’salcoholregulations.vi. Havinganunderageguestwhopossessedand/orconsumedalcoholwhileinattendanceat

yourevent.vii. Consumptionofanalcoholicbeverageinpublic.viii. Publicintoxication.ix. ViolationofthealcoholpolicyatTheCellar.x. Purchase,possession,orconsumptionoftobaccoproducts,nicotinevaporproducts,and/or

alternativenicotineproductsundertheageof21.xi. Contributionofalcoholtoapersonundertheageof21.

f. ViolationofUniversitypoliciesorCollegerulesorregulationsincluding,butnotlimitedto,thosegoverningUniversityhousing.

g. FailuretocomplywithdirectionsofaUniversityofficialactingintheauthorizedperformanceofduty.

i. LyingorintentionallymisleadingUniversityofficialsperformingtheirassignedduties.Lyingincludesknowingmisrepresentationsormaterialomissions.

j. ViolationoftheUniversity’sInformationServicespolicies.k. ViolationoftheUniversity’sGamblingPolicy.l. ProvidinginformationaboutamemberoftheUniversityCommunitytoorganizationsor

individualsthatarenotaffiliatedwiththeUniversitywithoutthemember’spermission.m. Violationofa“NoContactOrder”issuedbyaUniversityofficial.n. Incitingotherstocommitprohibitedactsofthekindshereinprohibited.

7. UseofRecordedMaterial.ManyclasseswillberecordedusingZoomandfacultymaypreparevideorecordingsoflecturesorteachingsegmentsusingothersoftware.Recordingsofanytypewillbemadeavailableonlytostudentsregisteredforthecourseandshouldbeusedonlyforpersonalstudybystudentsenrolledinthecourse.a. Studentsshallnotdisclose,share,trade,orselltheserecordingswith/toanyotherperson,

organization,business,orinstitution.b. Studentsshallnotpost/storetheserecordingsinalocationaccessiblebyanyoneotherthanthe

student,includingbutnotlimitedtosocialmediaaccounts.c. Studentsmustcomplywithanyinstructionsordirectionsfromtheirfacultyregardingtheuseof

suchrecordings.d. Studentsarerequiredtodestroyanyrecordingsthatweremadewhentheyarenolongerneeded

forthestudent’sacademicwork.

C. ViolationofLawandUniversityDiscipline.

1. UniversitydisciplinaryproceedingsmaybeinstitutedagainstastudentchargedwithconductthatpotentiallyviolatesboththecriminallawandtheStandardsofStudentConductorUniversitypolicy(thatis,ifbothpossibleviolationsresultfromthesamefactualsituation)withoutregardtothependencyofcivilorcriminallitigationincourtorcriminalarrestorprosecution.AtthediscretionoftheVicePresidentforStudentDevelopment,andconsistentwithotherUniversitypolicies,proceedingsundertheStandardsofStudentConductmaybecarriedoutpriorto,simultaneouslywith,orfollowingcivilorcriminalproceedingsoffcampus.

DeterminationsmadeorsanctionsimposedundertheStandardsofStudentConductshallnotbesubjecttochangebecausecriminalorcivilchargesarisingoutofthesamefactsgivingrisetoviolationofUniversityrulesweredismissed,reduced,orresolvedinfavoroforagainstthecriminalorcivillawdefendant.

2. Whenastudentischargedbyfederal,state,orlocalauthoritieswithaviolationofthelaw,theUniversitywillnotrequestoragreetospecialconsiderationforthatindividualbecauseoftheirstatusasastudent.IftheallegedoffenseisalsobeingprocessedundertheStandardsofStudentConduct,theUniversitymayadviseoff-campusauthoritiesoftheexistenceoftheStandardsofStudentConductandofhowsuchmattersaretypicallyhandledwithintheUniversitycommunity.Subjecttoapplicablelaws,theUniversitywillattempttocooperatewithlawenforcementandotheragenciesintheenforcementofcriminallawsoncampusandintheconditionsimposedbycriminalcourtsfortherehabilitationofstudentviolators(providedthattheconditionsdonotconflictwithcampusrulesorsanctions).

ArticleIV:Reporting,Charge,PreliminaryHearing,andInterimSuspension[PleaseseeAppendixAforspecificreportingandemergencyremovalproceduresformattersinvolvingtheUniversity’sPolicyProhibitingSexualMisconduct.]

A. Reporting.

AnymemberoftheUniversitycommunitywithknowledgeofanactbyastudentthatmayconstituteaviolationoftheStandardsofStudentConduct,includingaviolationofUniversitypolicy,mayfileacomplaintinwritingtotheappropriatedeanoftheCollegeorSchool.

Complaintsshouldbesubmittedassoonaspossiblefollowingtheeventthatprecipitatedthecomplaint,preferablywithinseven(7)days.However,nocomplaintwillbedismissedsolelyonthebasisofthetimeitwasfiled.

B. PreliminaryInvestigationandCharge.

1. Uponreceiptofacomplaint,theStudentConductAdministratorshalldeterminewhethertherehasbeenanypreliminaryinvestigationorinquiryintothefactsunderlyingthecomplaint(forexample,bytheUniversityofRichmondPoliceDepartment).a. Iftherehasbeenapreliminaryinquiryorinvestigation,theStudentConductAdministratorshall

reviewthefindingsofthatinquiryorinvestigationtodeterminewhetherapreliminarychargeundertheStandardsofStudentConductiswarranted.TheStudentConductAdministrator,attheirsolediscretion,mayconductafollow-upinvestigationinordertogainsufficientinformationtodeterminewhetherapreliminarychargeiswarranted.

b. Intheprocessofassessingwhetherapreliminarychargeiswarranted,theStudentConductAdministrator,attheirsolediscretion,mayseektheadviceandcounselofindividualsnotinvolvedinthepotentialhearingprocess.TheseindividualsincludebutarenotlimitedtoUniversityPolice,UniversityCounsel,andotheradministrators.

2. TheStudentConductAdministratorshallassignthecomplainttotheappropriateConductOfficer.TheStudentConductAdministratorshallsharethepreliminarychargesandthefindingsofanyinquiriesorinvestigationsconductedtothatpointwiththeConductOfficer.

a. AcomplaintthatmayrequiretheimpositionofaNoContactOrderand/orInterimSuspension,resultinsuspensionoftheRespondentasapossiblesanction,orwouldresultinareferraltotheUniversityHearingBoardshallbeassignedtoaDean.

b. Acomplaintthatinvolvesstudentslivinginoff-campusresidencesshallbereferredtoaConductOfficerwiththerankofDean.

c. TheConductOfficer,attheirsolediscretion,mayconductfollow-uporadditionalinvestigationinordertogainsufficientinformationtodetermineifthespecificpreliminarychargesareappropriateorifadditionalchargesarewarranted.

i. Intheprocessofdeterminingappropriateandspecificcharges,theConductOfficer,attheirsolediscretion,mayseektheadviceandcounselofindividualsnotinvolvedinthepotentialhearingprocess.TheseindividualsincludebutarenotlimitedtoUniversityPolice,UniversityCounsel,andotheradministrators.

d. ThefinaldecisiononwhetheraformalchargeundertheStandardsofStudentConductiswarrantedrestswiththeConductOfficer.TheConductOfficer,attheirdiscretion,mayseekadviceandcounselinthedeterminationofformalcharges.

i. ConductOfficerswiththerankofAreaCoordinatorshallconsultwithaDeanoftherespondent’sCollege.

ii. ConductOfficerswiththerankofDeanshallconsultwiththerespondent’sCollegeDean.

iii. AcomplaintshallbereassignedfromaConductOfficerwiththerankofAreaCoordinatortoaConductOfficerwiththerankofDeanif,intheprocessofdeterminingappropriateand

specificcharges,thecomplaintmayrequire:(a)theimpositionofaNoContactOrder,(b)anInterimSuspension,(c)thesuspensionoftheRespondentasapossiblesanction,and/or(d)thedecisionoftheRespondentasoutlinedinArticleIV(C)(2)wouldresultinareferraltotheUniversityHearingBoard.

e. IndeterminingwhethertoformallychargeastudentwithaviolationoftheStandardsofStudentConduct,theConductOfficerwillconsiderwhethertheresultsoftheinvestigationprovidesufficientfactsandevidenceuponwhichareasonabledecision-makercouldfind,byapreponderanceoftheevidence,thattheRespondentviolatedtheStandardsofStudentConduct.However,thedecisiontoinitiateaconductorotherdisciplinaryproceedingisnotafinaldeterminationofresponsibilityandwillnotbeusedasevidenceinanysubsequenthearingorproceeding.

C. PreliminaryHearing.

1. TheConductOfficershallnotifytheRespondentofthecharge(s)anddateofthepreliminaryhearinginwritingandrequesttheattendanceoftheRespondentatthathearing.Duringthepreliminaryhearing,theConductOfficershall:

a. ProvidetheRespondentwithacopyofArticleVoftheStandardsofStudentConductasappropriate;

b. ReviewthecomplaintfiledagainsttheRespondent;

c. Explainthecharge(s)andanyassociatedpolicyorpolicies;and

d. Reviewtheoptionsavailableforresolutionofthecharge(s),includingpossiblesanction(s).

2. TheRespondentisaskediftheyacceptresponsibilityfortheallegedviolation(s)charged.

a. TheRespondentmayacceptresponsibilityfortheallegedviolation(s)charged.

i. IftheRespondentacceptsresponsibilityfortheviolation(s)andacceptsthesanction(s)assignedbytheConductOfficer,theRespondentwaivestheirrighttoahearingandanappeal.

ii. IftheRespondentacceptsresponsibility,butdoesnotacceptthesanction(s)assignedbytheConductOfficer,thematterwillbereferredtotheappropriateStudentConductBoardforahearingtodetermineappropriatesanctions.

a. Inlimitedcircumstances,thematterwillbereferredtothePresidingOfficeroftheappropriateStudentConductBoardforanadministrativehearingtodeterminetheappropriatesanction.

b. TheRespondentmaydenyresponsibilityfortheallegedviolation(s)charged.IftheRespondentdeniesresponsibility,thematterwillbereferredtotheappropriateStudentConductBoardforahearingandadeterminationofresponsibilityandsanctions,ifany.

c. TheConductOfficermayconcludethatthereisinsufficientevidencetowarrantacharge,orthatastudentwasnotpresentorinvolvedintheallegedviolation.

i. Iftheconclusionisthatthereisinsufficientevidencetowarrantacharge,theRespondentwillbefoundNotResponsibleforthecharge.

ii. IftheconclusionisthattheRespondentwasnotpresentorinvolvedintheallegedviolation,theRespondentwillbefoundNotResponsible/ChargesUnfoundedforthecharge.

3. Withintwenty-four(24)hoursafterthepreliminaryhearing,theRespondentmustadvisetheConductOfficerinwritingoftheirchoiceoftheavailableproceduraloptions.

a. IftheRespondentdoesnotadvisetheConductOfficerinwritingoftheirchoicewithintwenty-fourhours,theRespondentwillbefoundresponsibleandwillbesubjecttothesanction(s)assignedbytheConductOfficerinaccordancewiththeStandardsofStudentConduct.TherespondentwillbenotifiedinwritingofthedeterminationoftheConductOfficerandanypossiblesanctions.

b. TheConductOfficerattheirdiscretioncanextendthisdeadlineuptoseventy-two(72)hours,withgoodcause.

i. IftheRespondentdoesnotadvisetheConductOfficerinwritingoftheirchoicewithinseventy-twohours,theRespondentwillbefoundresponsibleandwillbesubjecttothesanction(s)assignedbytheConductOfficerinaccordancewiththeStandardsofStudentConduct.TherespondentwillbenotifiedinwritingofthedeterminationoftheConductOfficerandanypossiblesanctions.

4. ReferraltoStudentConductBoard.

a. IfthematterisreferredtoaStudentConductBoard,theConductOfficerwillprepareastatementfortheStudentConductBoardlistingthespecificchargesagainsttheRespondent,summarizingthefactssupportingeachcharge,settingforththerecommendedsanction(s)andsummarizingtherationaleforsanction(s),ifapplicable.

D. InterimSuspensionandClassRemoval.1. IncertaincircumstancesaUniversityorhousing“interim”suspensionmaybeimposed.Interim

suspensionsshallbeimposedbyaConductOfficerwiththerankofDean,theVicePresidentofStudentDevelopmentintheirroleasChairoftheThreatAssessmentTeam,orbytheTitleIXCoordinator,ontheirownaccordorafterconsultationwithotherUniversityofficials.

2. Aninterimsuspensionmaybeimposedwhenthereisareasonablebasistoconcludethat:(a)thecontinuedpresenceoftheRespondentoncampusorinaresidencehallmaycreatearisktothehealthorsafetyofoneormorestudentsorofothermembersoftheUniversitycommunity;or(b)theRespondentposesanongoingthreatofdisruptionof,orinterferencewith,thenormaloperationsoftheUniversity.

3. Duringtheperiodofinterimsuspension,theRespondentmustleavecampusimmediatelyandshallnotparticipateinacademic,extracurricular,orotheractivitiesoftheUniversityexceptasmaybeauthorizedbythepartywhoimposedtheinterimsuspension.TheRespondentisnotpermittedonthecampuswithoutthepriorwrittenconsentfromthepartywhoimposedtheinterimsuspension.

Suchinterimsuspension,ifimposed,shallbeinadditiontoanyotherinterimremedialmeasures,suchasNoContactOrders,putintoplacebyUniversityofficials,includingtheTitleIXCoordinator.Theinterimsuspensiondoesnotreplacetheregularhearingandappealprocess,whichshallproceedonthenormalschedule.Unlessprovidedwithexplicit,writtenpermissionforanexceptioninadvance,asabove,theRespondentsubjecttoaninterimsuspensionwillbepermittedtoreturntocampussolelyforpurposesofparticipatinginahearingbeforetheappropriateStudentConductBoard.

4. ARespondentmaybedeniedattendanceinaspecificclassifthereisareasonablebasistoconcludethattheRespondentmayposeanongoingthreattothehealthandsafetyofanypersonintheclass.ArrangementswillbemadefortheRespondenttoeitherattendanothersectionoftheclassortomakeanarrangementwiththeinstructorofrecordtocompletethecourseinanothermanner.

responsibilitiesthroughouttheconductprocess:

1. Hearing.TheRespondenthastherighttoahearing,conductedinaccordancewiththeStandardsofStudentConductandtheproceduresoftheappropriateStudentConductBoard.

a. TheRespondenthastherighttoaconductprocessoutcomebasedonreliableevidencepresentedduringtheconductprocess,includingreasonableinferencesdrawnfromsuchevidence,andreasonabledeterminationsbythefactfinderastothecredibilityofwitnesstestimony.

2. RulesandProcedures.TheRespondenthastherighttoacopyoftherulesandproceduresoftheUniversity’sconductprocess.

3. Advisors.TheRespondenthastherighttotheservicesofanadvisoroftheirchoice.TheadvisormustbeamemberoftheUniversitycommunityandmaynotbeanattorney.

a. Advisorsarenotpermittedatthepreliminaryhearing.

b. TheRespondentisresponsibleforpresentingtheirowninformation,andtherefore,advisorsarenotpermittedtoparticipateinanyhearingbeforeaStudentConductBoard,including,butnotlimitedtomakingoralargumentsorstatements,questioningwitnesses,orraisingobjectionsduringahearing.AnadvisormayrequestabriefrecessoftheproceedingstoprovideadvicetotheRespondent.

c. TheRespondentshouldselectasanadvisorapersonwhosescheduleallowsattendanceatthescheduleddateandtimefortheStudentConductBoardhearing,asdelayswillnotnormallybeallowedduetotheschedulingconflictsofanadvisor.

17. NoticeofOutcome.TheRespondenthastherighttowrittennoticeoftheoutcomeandsanctions(ifapplicable)oftheStudentConductBoardhearingby5:00PMonthesecondbusinessdayfollowingtheconclusionofthehearing.ThePresidingOfficeroftheboardattheirdiscretioncanextendthistimeline.

ArticleVI:StudentConductBoardProcedures[PleaseseeAppendixAforspecificconductboardproceduresformattersinvolvingtheUniversity’sPolicyProhibitingSexualMisconduct.]A. ProceduresApplicabletoallStudentConductBoardHearings.Thefollowingprocedureswillapplytoall

StudentConductBoardhearings.SpecificrulesandguidelinesfortheUniversityofRichmondStudentConductCouncilareoutlinedintheStatutesoftheCouncil.

1. InsituationswheremorethanonestudentisaccusedofviolatingArticleIIIoftheStandardsofStudentConduct,thePresidingOfficer,attheirdiscretion,maypermittheStudentConductBoardHearingsconcerningeachstudenttobeconductedeitherseparatelyorjointly.

2. StudentConductHearingsshallbeclosedtothepublic.AdmissionofanypersonnotdirectlyconnectedtothehearingshallbeatthesolediscretionofthePresidingOfficer.

3. Formalrulesofprocess,procedure,and/ortechnicalrulesofevidence,suchasareappliedincriminalorcivilcourt,arenotusedinStudentConductBoardproceedings.

4. Thereshallbeasingleverbatimrecord,typicallyanaudiorecording,ofallStudentConductBoardhearingsexceptfordeliberationsoftheStudentConductBoard,whichshallnotberecorded.TherecordshallbethepropertyoftheUniversity.

a. Ifitappearsvitaltothedispositionofthecase,thePresidingOfficerortheVicePresidentforStudentDevelopment,attheirsolediscretion,mayorderthattheproceedingsbetranscribedinadditiontotherecording.

b. TheRespondentandtheComplainant(ifapplicable)mayrequesttheopportunitytoreviewtherecordingofthehearing,butwillnotbeprovidedwithacopyoftherecordingandmaynotcopytherecordinginanymanner.

5. ThePresidingOfficer,attheirsolediscretion,shalldeterminetheadmissibilityofevidence,witnesstestimony,andwitnessstatementsandshallonlyadmitevidence,testimony,orwitnessstatementsthatisrelevantorreasonablyrelatedtotheissuesbeforetheStudentConductBoard.

6. AllproceduralquestionsaresubjecttothefinaldecisionofthePresidingOfficeroftheStudentConductBoard.

7. AftertheportionoftheStudentConductBoardhearingconcludesinwhichallevidence,witnesstestimony,andwitnessstatementshavebeenreceived,theStudentConductBoardshalldeliberateinprivatetodeterminewhethertheRespondentisresponsiblefortheviolationorviolationsofArticleIII(B)oftheStandardsofStudentConductforwhichtheRespondentwascharged.

8. TheStudentConductBoard’sdeterminationshallbemadebasedonapreponderanceoftheevidencestandard,meaningthatinordertofindtheRespondentresponsible,theStudentConductBoardmustfindthatthegreaterweightoftheevidencepresentedatthehearingsupportsafindingofresponsibilityfortheviolations(s)ofArticleIII(B)withwhichtheRespondentwascharged.Apreponderanceorthegreaterweightoftheevidenceisamatterofquality,notquantity.

B. ProceduresSpecifictotheUniversityHearingBoard.TheUniversityHearingBoardischargedwiththedispositionofchargesasoutlinedinArticleIV(C)(2)(a)(ii)andArticleIV(C)(2)(b)oftheStandardsofStudentConduct.TheVicePresidentforStudentDevelopmentshallassignaHearingOfficertoberesponsiblefortheadministrationoftheUniversityHearingBoard.

1. CompositionoftheUniversityHearingBoard.TheUniversityHearingBoardshallconsistofthree(3)votingmemberschosenfromtheUniversityHearingBoardPool.

a. TheUniversityHearingBoardPoolshallconsistofaminimumoften(10)staff/administratorsappointedannuallybytheVicePresidentforStudentDevelopmentandwhohavereceivedannualtrainingonissuesrelatedtosexualmisconduct,TitleIX,theimpactoftraumaonvictims,theinvestigativeanddisciplinaryprocess,andthehearingprocess.

b. AnymemberoftheUniversityHearingBoardPoolselectedtoserveonaUniversityHearingBoardmustdisqualifythemselvesforanybiasorconflictofinterest.

2. Pre-HearingProcedures.

a. TheHearingOfficershallnotifytheRespondentinaccordancewiththeStandardsofStudentConduct.

b. TheRespondentshallbeaffordedtheopportunitytomeet(inpersonorbytelephoneorvideoconference)withtheHearingOfficerpriortothehearing.ThepurposeofthismeetingistoadvisetheRespondentofthehearingproceduresandtheirrightsinconnectionwiththehearing.

c. TheHearingOfficershallcreatesix(6)copiesofanevidencepacketcontainingallsubmittedinformationtobeconsideredduringthehearing.Thepacketsaredistributedasfollows:

i. One(1)copyfortheHearingOfficer’susewhichwillbeaddedtotheofficialcasefile;

ii. Three(3)copiesdistributedtotheUniversityHearingBoardMembersatthePre-HearingMeeting;

iii. One(1)copygiventotheRespondentinaccordancewiththetimeframessetforthintheseStandardsofStudentConduct;and

iv. One(1)copyismadeavailableforwitnessreferenceduringthehearing.

d. TheHearingOfficerortheirdesigneeshallconveneaPre-HearingMeetingofthemembersoftheUniversityHearingBoardtoreviewthecharge(s),gooverthecontentsoftheevidencepacket,andtoansweranyproceduralquestions.Thismeetingshallbeheldatleasttwenty-four(24)hourspriortothehearing.

3. GeneralProceduralRulesoftheUniversityHearingBoard.

a. TheHearingOfficershallpresideoverandconductthehearingandisspecificallyempoweredto:

i. Appointarecordingsecretaryorotherstaffasneeded;

ii. Controltheadmissionofpersonstothehearing.TheHearingOfficermayorderanypersoninattendancethatdoesnotconductthemselvesinanorderlyandrespectfulmannertoleave.Obstructive,contemptuous,disruptive,ornoisyconductinthepresenceofthehearingboardbyanyperson,includingtheRespondent,awitness,oranadvisor,mayresultinthatpersonbeingremovedfromthehearingand,ifastudent,chargedwithaviolationofprohibitedconductasoutlinedinArticleIII(B)oftheStandardsofStudentConduct;

iii. ControltheconductoftheUniversityHearingBoardmembersandoftheRespondenttoprotectwitnessesfromimproperquestions,insultingtreatment,andunnecessaryinquiryintotheirprivateaffairs;and

iv. Excludewitnessesfromthehearingroomexceptwhentheyaretestifying.

b. AllmembersoftheUniversityHearingBoardmustbepresentthroughoutthehearing.

i. IfamemberoftheUniversityHearingBoardmustleavethebeforethehearingiscompletewithgoodcause,theHearingOfficermayattheirsolediscretionrecessthehearingandreconvenethehearingwithintwenty-four(24)hours.

ii. Ifavotingmemberdisqualifiesthemselvesorforgoodcausemustwithdrawfromthehearing,theHearingOfficershallselectareplacementfromtheUniversityHearingBoardPool.TheHearingOfficershall,afterconsultationwiththeRespondent,inopensession,providethereplacementwithasummaryofallpriorproceedings.

c. NopersonshalladdresstheUniversityHearingBoardorsubmitquestionstotheHearingOfficerforanywitness(includingtheRespondentoranadvisor)withoutfirstbeingrecognizedbytheHearingOfficer.

d. Thetakingofphotographsinthehearingroom,thestreamingorbroadcastingfromthehearingroomoftheproceedingsbysocialmedia,telephone,radioortelevision,ortherecordingoftheproceedingsfornon-officialuse,orforlaterreleaseorbroadcasttothegeneralpublic,shallnotbepermitted.

4. OrderoftheHearing.

a. TheHearingOfficerwillaskthemembersoftheUniversityHearingBoard,theRespondentandtheRespondent’sadvisortointroducethemselves.

b. TheHearingOfficershallreadthecharge(s)totheRespondent,andtheRespondentshallstatewhethertheyacceptresponsibilityforeachcharge.

i. Intheabsenceofaresponse,theRespondentshallbedeemednottohaveacceptedresponsibilityforthecharge(s).

ii. IftheRespondentdoesnotacceptresponsibilityforthecharge(s),evidence,witnesstestimony,and/orwitnessstatementsshallbepresentedthatwillsupportorrefutethecharge.

iii. IftheRespondentacceptsresponsibilityforthecharge(s),evidence,testimony,and/orwitnessstatementsshallbepresentedthatwillassisttheUniversityHearingBoardinassigninganappropriatesanction.

c. TheHearingOfficerremindsallpartiesthattheburdenofproofshallbepreponderanceofevidence,meaningthatinordertofindtheRespondentresponsible,theUniversityHearingBoardmustfind,basedonapreponderanceoftheevidencepresentedatthehearing,thattheRespondentisresponsiblefortheviolationcharged.

d. TheRespondentshallbeprovidedanopportunitytomakeanopeningstatement.

e. TheMembersoftheUniversityHearingBoardshalldirecttheHearingOfficertocallwitnessesand/orpresentevidenceandwitnessstatements.

f. TheRespondentshallhavetheopportunitytopresentevidenceandcallwitnesses.

g. MembersoftheUniversityHearingBoardshallhavetheopportunitytoaskquestionsoftheRespondent.

h. TheRespondentshallbegiventheopportunitytomakeaclosingstatementtotheUniversityHearingBoard.

i. TheHearingOfficershallexcuseallpartiesandwitnessessothatthemembersoftheUniversityHearingBoardmaydeliberateinprivate.

j. Afterdeliberationsarecompleted,thehearingwillreconveneandtheHearingOfficerwillreadthedecisionoftheUniversityHearingBoardandanysanctionsifapplicable.

k. TheHearingOfficerwillprovideinformationrelatedtonotificationofthedecisionandappealinformation.

l. TheHearingOfficerwilladjournthehearing.

5. ProcedureforOralTestimony.Thefollowingproceduresshallapplytoalloraltestimonypresentedatthehearing:

a. Witnessesshalltestifyunderoathoraffirmation.

b. ThemembersoftheUniversityHearingBoardshallbegiventheopportunitytoaskquestionsofthewitness.

c. TheHearingOfficerwillaskquestionssubmittedbytheRespondentunderproceduresoutlinedinArticleVIoftheStandardsofStudentConduct.

d. TheMembersoftheUniversityHearingBoardshallhavetheopportunitytoaskquestionsofthewitness.

6. ProcedureforOtherEvidenceandWitnessStatements.Thefollowingproceduresshallapplytoalldocumentaryorotherevidencepresentedatthehearing:

a. EvidencesubmittedbytheConductOfficer,and/orRespondentwillbepermittedatthesolediscretionoftheHearingOfficer.

b. WrittenstatementsofwitnesseswhocannotattendthehearingmustbesubmittedinadvanceasoutlinedintheStandardsofStudentConduct.

c. IftheHearingOfficerpermitsevidenceorwitnessstatements,six(6)copiesshouldbeprovidedfordistributionasoutlinedinArticleVI(B)(2)(c)oftheStandardsofStudentConduct

7. DeliberationoftheUniversityHearingBoard.

a. ThemembersoftheUniversityHearingBoardshalldeliberateinprivateandreachadecisionbasedonlyupontheevidenceintroducedatthehearing.TheHearingOfficerispresentduringthedeliberation,butdoesnothaveavote.

b. ThemembersofUniversityHearingBoardshallnotmakeanyfindingoffactthatisnot

supportedbytheevidencepresentedatthehearing.

c. IftwoormoreUniversityHearingBoardmembersfindtheRespondentresponsibleforacharge,thestudentis“responsible”forthatcharge.

d. IftheRespondentisfoundresponsible,therecommendedsanctionshallbechosengenerallyfromthoselistedinArticleVIIIoftheStandardsofStudentConduct.Inevaluationofthesanction(s),theUniversityHearingBoardshallconsultwithanysanctioningguidelinesimplementedbytheUniversityand,incasesinvolvingaviolationoftheUniversity’sPolicyProhibitingSexualMisconduct,pastprecedentinsimilarcases.

e. TheHearingOfficershallwriteabriefstatementoutliningtherationaleforthedecisionandsanctionaftertheUniversityHearingBoardhasreacheditsdecision.ThemembersoftheUniversityHearingBoardshallsignthestatement,andthestatementwillbeplacedinthecasefile.

StudentConductmayresultinoneormoreofthefollowingdisciplinarysanctions.Additionalsanctions,ifany,arelistedinthehandbooksorofficialannouncementsoftheSchoolorCollegeconcerned.FollowingadeterminationofresponsibilitybyaStudentConductBoardasoutlinedinArticlesVandVI,theboardwillimposesanctionsfromthefollowing:

1. DisciplinaryWarning.Awrittennoticethatacontinuationorrepetitionofprohibitedconductwillbegroundsformoreseriousdisciplinaryaction.

2. UniversityHousingProbation.Actionpermittingthestudenttoremaininresidenceonprobationarystatus.Duringtheperiodofprobation,ifthestudentisfoundresponsibleforadditionalviolations,thestudentmaybeevictedfromUniversityhousing.

3. ConductProbation.ActionpermittingthestudenttoremainattheUniversityonprobationarystatus.Duringtheperiodofprobation,ifthestudentisfoundresponsibleforfurtherviolations,thestudentmaybesubjecttosuspension,dismissal,orseparationfromtheUniversity.Studentsareprohibitedfromstudyingabroadinanysemesterforwhichtheyareonconductprobationforallorpartofthesemester.

4. HousingRelocation.SerioushousingmattersorrepeatedviolationsofUniversitypolicymayresultinrelocationfromoneUniversityhousingareatoanother.

5. HousingEviction.SerioushousingmattersorrepeatedviolationsofUniversitypolicymayresultinremovalfromUniversityhousing.

6. Suspension.Aforced,temporaryleavefromtheUniversity.Thetimeperiodofasuspensionistypicallyasemesterorafullacademicyear,butcanbesetforanyduration.AsuspensionshallonlybeimposedbyaConductOfficerwitharankofDeanorbyaStudentConductBoard.

7. Separation.ImmediateandpermanentseparationfromtheUniversity.AstudentwhoisseparatedfromtheUniversityisnoteligibleforreadmission,andistypicallybarredfromUniversityevents,activities,andproperty.SeparationshallonlybeimposedbyaConductOfficerwitharankofDeanorbytheUniversityHearingBoard.

B. ListofAdditionalSanctionsandRemedies.AStudentConductBoardmayalsoimposeadditionalsanctionsandremediestothedisciplinarysanctionslistedinVII(A).Additionalsanctionsandremediesinclude,butarenotlimitedto,thefollowing:

1. CommunityService.AnassignmenttoperformataskorservicefortheUniversityoraUniversitysponsoredorganization.

2. Fine/Restitution.Reimbursementfordamageto,destructionof,ormisappropriationofproperty,toincludebutnotlimitedtopersonalandmedicalreimbursement.

3. NoContactOrder.Anordertohavenocontactinanyformwithanidentifiedstudentorstudents.NoContactOrdersarebilateraltoprotectallpartiesinvolved,andareissuedbyeithertheTitleIXofficeorbytheCollegeDeans’Offices.

4. Notificationofparents/guardiansbytheCollegeDeanortheirdesigneeifdeemedappropriate.

5. NoTrespassOrder.Anorderbanningastudentfromspecificbuildings,portionsofthecampus,orfromtheentirecampusoroff-campusbuildingsorproperty.NoTrespassOrdersmayberecommendedbyaConductOfficer,aStudentConductBoard,theChairoftheThreatAssessmentTeam,orbytheTitleIXCoordinator.NoTrespassOrdersshallbeimposedandenforcedbytheUniversityofRichmondPoliceDepartment.

RevocationofPrivilege.Including,butnotlimitedto,registeredevents,usingUniversitydiningfacilities,havinganautomobileoncampus,and/oraccesstootherUniversityfacilities.Inseriousmatters,astudentmayhaveadditionalprivilegesrevokedduringand/orwhileUniversitychargesarebeingprocessedthroughtheUniversityconductsystem.

7. SubstanceAbuseEducation.Alcoholorotherdrugpreventionprogramdesignedtoassiststudentswithmakingsafeandhealthierchoicesregardingtheirsubstanceuse.

C. MultipleSanctions.Morethanoneofthesanctionslistedabovemaybeimposedforanysingleviolation.

D. RecordKeeping.ExceptasdescribedinArticleVII(E),below,disciplinarysanctionsshallnotbenotedonthestudent’spermanentacademictranscript,butshallbecomepartofthestudent’sconductrecord.

1. AstudentfoundresponsibleofaviolationofprohibitedconductasoutlinedinArticleIII(B)oftheStandardsofStudentConductwillhavean“active”conductfileuntilgraduation,atwhichtimethefilebecomes“inactive.”

a. An“active”conductfileissubjecttodisclosuretoanyUniversitydepartmentwithaneducationalneedtoknoworoutsideagencywithwrittenpermissionfromthestudent.

i. SanctionssubjecttodisclosureincludeConductProbation,Suspension,andSeparation.

ii. DisciplinaryWarningisgenerallynotsubjecttodisclosure.

b. Intheeventthatastudentison“conductprobation”atthetimeoftheirgraduation,thestudent’sconductfilewillremain“active”foroneyearfollowingthestudent’sgraduation.

c. Conductrecordsmayremain“active”indefinitelyatthediscretionoftheVicePresidentforStudentDevelopmentortheirdesignee.

d. Whenastudenthascompletedallofthesanctionsassignedtothem,and/orwhentheirperiodofprobationhasended,thestudentshallbeconsideredingoodstanding.

2. Astudent’sdisciplinaryrecordmustbemaintainedforaminimumperiodofseven(7)yearsafterthestudent’sgraduation.Afterthatperiod,thestudent’sdisciplinaryrecordwillbedestroyed.ConductrecordsmaybemaintainedindefinitelyatthediscretionoftheVicePresidentforStudentDevelopmentortheirdesignee.

E. TranscriptNotation.

1. SuspensionorPermanentSeparation.Generally,astudent’ssuspensionorpermanentseparationfromtheUniversitywillbenotedonthestudent’sacademictranscript.ExceptforthoseconductviolationsdescribedinArticleVII(E)(2),thetranscriptnotationshallnotspecificallyreferenceaviolationoftheStandardsofStudentConduct.

2. Suspension,SeparationorWithdrawalforCertainViolationsoftheStandardsofStudentConduct.TheUniversityisrequiredbyVirginialawtoincludeaprominentnotationontheacademictranscriptofeachstudentwhohasbeensuspendedfor,permanentlyseparatedfor,orwithdrawswhileunderinvestigationforaviolationoftheStandardsofStudentConductinvolvingsexualviolence,asdefinedintheUniversity’sPolicyProhibitingSexualMisconduct.ThistranscriptnotationwillberemovedifthestudentissubsequentlyfoundnottohavecommittedanoffenseinvolvingsexualviolenceorifthestudentcompletesthetermsoftheirsuspensionandisdeterminedtobeingoodstandingaccordingtoapplicableUniversitypolicy.Consistentwithstatelawandfederalregulations,thenotationwillberemovedfromatranscriptafterthreeyearsforastudentthatwithdrawalswhileunderinvestigationorispermanentlydismissedfromtheUniversity.

totheappropriateAppellateAdministrator.InhearingsthatinvolvedaviolationoftheUniversity’sPolicyProhibitingSexualMisconduct,theComplainantalsohastherighttoappealthedecisionoftheUniversityHearingBoard.

B. TimeforFilingAppeal.AnappealmustbereceivedbythedesignatedAppellateAdministratorinwriting(adocumentasanemailattachmentisacceptable)by5:00PMonthefifthbusinessdayafterdeliveryofthewrittennotificationofthefindingoftheStudentConductBoard.ThePresidingOfficeroftheStudentConductBoardmayextendthetimeframeforsubmittinganappeal,attheirsolediscretion,forgoodcauseuponwrittennoticetotheRespondent,andtheComplainant(whereappropriate)settingforththereasonfortheextension.

C. AccesstoHearingRecord.Thepartyfilingtheappealshallbeprovidedwithreasonableaccesstothe

hearingrecordinthehearingfromwhichtheappealistaken.D. TimeforDecidingAppeal.Thedecisiononarequestforanappealshallbemadewithinthirty(30)daysof

c. TheAppellateAdministratordoesnotholdanewhearing.

d. IftheAppellateAdministratorfindsgroundstograntanappeal,theAppellateAdministratorshalldeterminearemedyasprescribedinArticleIX(F)oftheStandardsofStudentConduct.

2. MattersInvolvingtheUniversity’sPolicyProhibitingSexualMisconduct.

F. GroundsforAppeal.AnappealshallbegrantedtothepersonfilingiftheAppellateAdministratororReviewBoardfinds,byclearandconvincingevidencethatoneormoreofthefollowingoccurred:

1. AwitnessattheStudentConductBoardhearingliedandthetestimonywasbothmaterialandadversetotheappealingparty.

2. NewevidenceofamaterialnatureisavailablethatwasnotavailableatthetimeoftheStudentConductBoardhearing,unlesssuchevidencewasorcouldhavebeenavailablepriortooratthetimeoftheStudentConductBoardhearing.

3. TheStudentConductBoardhearingwasconductedinamannermateriallyinconsistentwiththeStandardsofStudentConductandthewrittenproceduresofsuchStudentConductBoard.

AppendixAProceduresSpecifictoMattersInvolvingtheUniversity’sPolicyProhibitingSexualMisconductTheprocedures,rights,andresponsibilitiessetforthinthisAppendixshallapplytoallgrievanceproceduresinwhichtheRespondentischargedwithaviolationoftheUniversity’sPolicyProhibitingSexualMisconduct.Theseprocedures,rights,andresponsibilitiesshallapplytoallhearingsinwhichatleastonechargeinvolvesanallegedviolationoftheUniversity’sPolicyProhibitingSexualMisconduct.TheUniversityshallrespondtoallegationsofsexualmisconductinapromptandequitablemanner.TheUniversityshallcompletethegrievanceprocessinatimelymannerdesignedtoprovideallpartieswitharesolution.Thetimeframeforcompletionofaspecificmattermayvarydependinguponanumberoffactors,including,butnotlimitedto,thecomplexityofthecaseorinvestigation,theavailabilityofwitnesses,andtheacademiccalendar.Section1: StudentRightsandResponsibilitiesTheRespondentandComplainantshallbeaffordedthefollowingrightsandresponsibilitiesthroughoutthegrievanceprocess:

B. Advisors.TheRespondentandComplainanthavearighttotheservicesofanadvisoroftheirchoice.Theadvisormaybeanattorney.Advisorsmayattendanyrelatedmeetings,proceedings,investigativeinterviewsand/orhearingwiththerespectiveparties.

1. Duringtheoutreachandinvestigativephase,theroleoftheadvisoristoprovidesupport,guidance,andadvicetotherespectiveparties.TheRespondentandComplainantareresponsibleforpresentingtheirowninformation.Theadvisormaynotreachouttotheopposingpartyoropposingpartieswitnessestoaskquestionsorgatherinformationonbehalfoftherespectiveparties.

2. DuringahearingbeforeaUniversityHearingBoard,theadvisor,inadditiontoofferingadviceandguidance,willconductcross-examinationofallpartiesandwitnessesonbehalfoftherespectiveparty.Anadvisormayalsorequestabriefrecessoftheproceedingstoprovideadvicetotherespectiveparty.

C. RightNottoParticipate. TheRespondentandtheComplainanthavetherighttonotparticipateinanymeetings,proceedings,interviewsorhearing.If,however,aRespondentorComplainantchosestobeabsentfromahearingorattendsthehearinganddoesnotsubmittocrossexaminationduringahearingbeforeaUniversityHearingBoard,theUniversityHearingBoardcannotrelyonanystatementsmadebythatpartyinreachingadeterminationregardingresponsibility.TheUniversityHearingBoardcannotdrawaninferenceaboutthedeterminationregardingresponsibilitybasedsolelyontheparty’spresenceatahearingorrefusaltosubmittocrossexamination.

5. TheRespondentandComplainantwillhave10daysafterreceiptoftheabovereferencedevidencetosubmitawrittenresponsewhichtheinvestigatorwillconsiderpriortocompletionoftheinvestigativereport.

6. TheUniversitywillprovidetheRespondent,theComplainantandtheirrespectiveadvisorswithacompleteinvestigativereportthatfairlysummarizesrelevantevidenceatleast10dayspriortoahearingbytheUniversityHearingBoardforreview.NeithertheRespondent,theComplainantnortheirrespectiveadvisorwillhavetherighttoreproducetheinvestigativereportinanymanner.

E. Hearing.TheRespondentandComplainanthavetherighttoahearingconductedinaccordancewiththeproceduressetforthinAppendixAoftheStandardsofStudentConduct.

F. NoticeofHearing:TheHearingOfficeroftheUniversityHearingBoardortheirdesigneeshallprepareand delivertotheRespondentandComplainantanoticeof hearing.SuchnoticemaybedeliveredtotheRespondentandComplainantinperson,byelectronicmail,byU.S.Mail,orbycampusmail.Thedateofthehearingshallnotbelessthanseven(7)ormorethantwenty(20) businessdaysfromthedateofsuchnotice.Thetimeframeforconductingthehearingmaybe extendedbytheHearingOfficer,forgoodcauseanduponwrittennoticetotheRespondentandComplainantsettingforththereasonfortheextension.Thenoticeofhearingshallinclude:

Thewrittennoticeoutcomewillbeprovidedby5:00PMonthe thirdbusinessdayfollowing theconclusion of the hearing. The Hearing Officer, at their discretion, can extend this timeline uponwrittennoticetothepartiessettingforththereasonfortheextension.Thenotice(s)describedinthissectionshallbesentsimultaneouslytotheRespondentandtheComplainant.

N. Privacy of the Respondent & Complainant. The Respondent and Complainant have the right topreservationofprivacytotheextentreasonablypossibleandallowedbylaw.Thepartieshavetherightnottohaveirrelevantpriorsexualorrelationshiphistory admittedasevidenceinaUniversityHearingBoardhearing.

1. TheUniversitywillnotaccess,consider,discloseorotherwiseuseaparty’srecordsthataremadeormaintainedbyaphysician,psychiatrist,psychologistorotherrecognizedprofessionalorparaprofessionalactingorassistingintheirprofessionalcapacity,andwhicharemadeandmaintainedinconnectionwiththeprovisionoftreatmentoftheparty,withoutvoluntary,writtenconsentfromtherespectiveparty.

2. TheRespondentandComplainanthavetherightnottohavereleasedtothepublicbyUniversityofficialsanypersonallyidentifiableinformationaboutthecomplaint,withouttheirconsent,excepttotheextentsuchdisclosureisrequiredbyapplicablelaw,regulation,orcourtorder.

O. Appeal.TheRespondentandComplainanthavetherighttoappealthedecisionoftheUniversityHearingBoardinaccordancewiththestandardsforappealestablishedinAppendixA,Section4.

Section2:HearingProceduresTheUniversityHearingBoardischargedwiththedispositionofchargesasoutlinedintheStandardsofStudentConduct.TheVicePresidentforStudentDevelopmentshallassignaHearingOfficertoberesponsiblefortheadministrationoftheUniversityHearingBoard.

A. CompositionoftheUniversityHearingBoard. TheUniversityHearingBoardshallconsistofthethree(3)votingmembersandonealternatechosenfromtheUniversityHearingBoardPool.

1. TheUniversityHearingBoardpoolshallconsistofaminimumoften(10)staff/administratorsappointedannuallybytheUniversityPresidentandwhohavereceivedtrainingonthedefinitionofsexualharassmentintheUniversity’sPolicyonProhibitingSexualMisconduct,thescopeoftheUniversity’seducationprogramoractivity,thehearingprocess,impartiality,conflictsofinterestandbias,technologyusedduringahearing,relevanceofquestionsandevidenceandtheinvestigativeanddisciplinary process.

2. AnymemberoftheUniversityHearingBoardpoolselectedtoserveonaUniversityHearingBoardmustdisqualifythemselvesforanybiasorconflictofinterest.

B. Pre-HearingSubmissionDeadlines.1. SubmissionofWitnessLists.TheComplainantandtheRespondentshallprovidetheHearing

Officerortheirdesigneewiththeirrespectivelistsofwitnessesatby5:00p.m.onthefourth(4th)daybeforethehearing.

1. SubmissionofDocumentary,Electronic,andOtherEvidence. TheComplainantandtheRespondentshallsubmitcopiesofalldocumentary,electronic,orotherevidencetotheHearing Officerortheirdesigneeby5:00p.m.onthefourth(4th)daybeforethehearing.

2. AccesstoOtherParty’sPre-HearingSubmissions. Uponreceiptofapre-hearingsubmissionfrom eithertheComplainantortheRespondent,theHearingOfficerortheirdesigneeshallprovidethe otherpartywithaccesstosuchsubmissionassoonasreasonablypossibleandinnoevent,later thantwenty-four(24)hoursfollowingthesubmission.

3. UniversityHearingBoardWitnesses,Documentary,Electronic,andOtherEvidence. 4. ExtensionofSubmissionDeadlines. TheHearingOfficermayextendthetimeframeforsubmitting evidence,andwitnesslists,attheirsolediscretion,and onlyforgoodcause. Iftimelinesareextended,theHearingOfficerortheirdesigneeshallprovide writtennoticetotheRespondentandtheComplainant.

C. Pre-HearingProcedures.1. TheHearingOfficerortheirdesigneeshallnotifytheRespondentandtheComplainantof

the scheduledhearingdateinaccordancewiththisAppendixAoftheStandardsofStudentConduct.

TheRespondentshallbeaffordedtheopportunitytomeet(inperson,bytelephoneorvideoconference)withtheHearingOfficerortheirdesigneepriortothehearing.Thepurposeof thismeetingistoadvisetheRespondentofthehearingproceduresandtheirrightsinconnection withthehearing.TheRespondent’sadvisorispermittedtoattendthismeeting.

1. TheHearingOfficershallpresideoverandconductthehearingandisspecificallyempoweredto:

a. Appointarecordingsecretaryorotherstafftoaudiorecordthehearing.b. Controltheadmissionofpersonstothehearing.TheHearingOfficermayorderany

personinattendancethatdoesnotconductthemselvesinanorderlyandrespectfulmannertoleave.Obstructive,contemptuous,disruptiveornoisyconductinthepresenceofthehearingboardbyanyperson,includingtheRespondent,theComplainant,awitness,oranadvisor, mayresultinthatpersonbeingremovedfromthehearingand,ifastudent,chargedwitha violationofArticleIII(B)(6)(b)oftheStandardsofStudentConduct.Ifaparty’sadvisorisremovedfromahearingpursuanttothissection,thehearingwillberecesseduntilsuchtimethattheUniversitycanprovideanalternateadvisoroftheUniversity’schoiceatnocostorfeetotheparty,inordertoconductcrossexaminationonbehalfofthatparty.

c. ControltheconductoftheUniversityHearingBoardmembersandoftheRespondentandComplainanttoprotectwitnessesfromimproperquestions,insultingtreatment,andunnecessaryinquiryintotheirprivateaffairs;and

d. Excludewitnessesfromthehearingroomexceptwhentheyaretestifying.2. AllmembersoftheUniversityHearingBoardmustbepresentthroughoutthehearing.

a. IfamemberoftheUniversityHearingBoardmustleavebeforethehearingiscompletewithgoodcause,theHearingOfficermayattheirsolediscretionrecessthehearingandreconvenethehearingwithintwenty-four(24)hours.

b. Ifavotingmemberdisqualifiesthemselvesorforgoodcausemustwithdrawfromthe hearing,theHearingOfficershallcalluponthealternatetoserve.TheHearingOfficershall,afterconsultationwiththeRespondentandtheComplainant,inopensession,providethereplacementwithasummaryofallpriorproceedings.

3. NopersonshalladdresstheUniversityHearingBoardorposequestionstoanywitness(includingtheRespondent,theComplainantoranadvisor)withoutfirstbeingrecognizedbytheHearingOfficer.

4. Thetakingofphotographsinthehearingroom,thestreamingorbroadcastingfromthehearing roomoftheproceedingsbysocialmedia,telephone,radioortelevision(withtheexceptionof videoconferencingasoutlinedinAppendixA,Section1(K)oftheStandardsofStudentConduct),orthe recordingoftheproceedingsfornon-officialuse,orforlaterreleaseorbroadcasttothegeneral public,shallnotbepermitted.

F. OrderoftheHearing1. TheHearingOfficerwillaskthemembersoftheUniversityHearingBoard,theRespondent,the

Respondent’sadvisor,theComplainant,andtheComplainant’sadvisortointroducethemselves.

a. TheHearingOfficershallreadtheallegationstotheRespondent,andtheRespondentshallstate whethertheyacceptresponsibilityforeachallegation.

b. Intheabsenceofaresponse,theRespondentshallbedeemednottohaveacceptedresponsibilityfortheallegation(s).

c. IftheRespondentdoesnotacceptresponsibilityfortheallegation(s),evidence,witnesstestimony,admittedbytheHearingOfficershallbepresented thatwillsupportorrefutetheallegation

2. IftheRespondentacceptsresponsibilityfortheallegation(s),evidence,witnesstestimony,admittedbytheHearingOfficershallbepresentedthatwillassist theUniversityHearingBoardinassigninganappropriatesanction.

3. TheHearingOfficerremindsallpartiesthattheburdenofproofshallbepreponderanceofevidence,meaningthatinordertofindtheRespondentresponsible,theUniversityHearingBoardmustfind,basedonapreponderanceoftheevidencepresentedatthehearing,thattheRespondentisresponsiblefortheallegedviolation.

4. TheRespondentandComplainantshalleachbeprovidedanopportunitytomakeanopeningstatement.

5. TheMembersoftheUniversityHearingBoardshalldirecttheHearingOfficertocallwitnessesand/orpresentevidence.

6. TheComplainantshallhavetheopportunitytotestify,presentevidence,andcallwitnesses.TheComplainant’sadvisorshallhavetheopportunitytoconductcrossexaminationofallwitnessesincludingtheRespondent.

7. TheRespondentshallhavetheopportunitytotestify,presentevidence,andcallwitnesses.TheRespondent’sadvisorshallhavetheopportunitytoconductcrossexaminationofallwitnessesincludingtheComplainant.

8. PriortotheinitialdeliberationsbytheUniversityHearingBoard,theComplainantshallhavetheopportunitytomakeaclosingstatementsummarizingtheirevidence. Thisstatementshallnotaddresstheimpactoftheallegedincident,theinvestigation,orthehearing,ontheComplainant.

9. PriortotheinitialdeliberationsbytheUniversityHearingBoard,theRespondentshallbegiventheopportunitytomakeaclosingstatementtotheUniversityHearingBoard. Thisstatementshallnotaddresstheimpactoftheincident,theinvestigationorthehearing,ontheRespondent.

10. TheHearingOfficerwillexcuseallpartiesandwitnessessothatthemembersoftheUniversityHearingBoardmaydeliberateinprivateontheissueofresponsibilityforthechargesatissue.

11. Afterdeliberationsontheissueofresponsibilityarecompleted,theHearingOfficershallmeetseparatelywiththeRespondentandtheComplainanttonotifythemofthedecisionoftheUniversityHearingBoardontheissueofresponsibility.

12. IftheUniversityHearingBoardfindstheRespondentresponsiblefortheallegationsatissue,thehearingwillbereconvenedafternoticetoeachparty. TheComplainantwillthenhaveanopportunitytomakeanimpactstatementtotheUniversityHearingBoardregardingtheissueofsanctionsandtheimpactoftheconductontheComplainant.Followingthatstatement,theRespondentwillhaveanopportunitytomakeanimpactstatementtotheUniversityHearingBoardregardingtheissueofsanctionsandtheimpactoftheconductontheRespondent.

13. TheHearingOfficerwillexcusebothpartiessothatthemembersoftheUniversityHearingBoard maydeliberateinprivateontheissueofsanctions.

14. Afterdeliberationsontheissueofsanctionsarecompleted,theHearingOfficershallmeetwiththeRespondenttonotifytheRespondentofthesanctionsimposedbytheUniversityHearingBoardandtheeffectivedateofsuchsanctions.TheHearingOfficerwillthenmeetwiththeComplainanttonotifythemofthesanctionsimposedupontheRespondentthatrelatedirectlyto theComplainantandtheeffectivedateofsuchsanctions.

15. TheHearingOfficerwillalsoprovideinformationtobothpartiesabouttheremediesthatwillbeprovided(ifany)theComplainantdesignedtorestoreorpreserveequalaccesstotheUniversity’seducationalprogramoractivity.

16. TheHearingOfficerwillalsoprovideinformationrelatedtowrittennotification ofthedecisionandtheprocedureandbasesforappeal.

17. TheHearingOfficerwilladjournthehearing.

G. ProcedureforOralTestimony. Thefollowingproceduresshallapplytoalloraltestimonypresentedatthehearing:

1. TheTitleIXCoordinatorshallnottestifyasawitness.2. TheTitleIXinvestigatormaybecalledtotestifyasawitness.3. Witnessesshalltestifyunderoathoraffirmation.4. ThemembersoftheUniversityHearingBoardshallbegiventheopportunitytoask

questionsof thewitness.

5. TheHearingOfficerwillaskquestionssubmittedbythestudentcallingthewitness(eitherthe ComplainantortheRespondent)underproceduresoutlinedthisAppendixAoftheStandardsof StudentConduct.

6. TheRespondent’sandComplainant’sadvisorshallhavetheopportunitytocrossexamineawitness.Ifawitnessdoesnotsubmittocrossexamination,theUniversityHearingBoardcannotrelyonanystatementofthatwitnessinmakingadeterminationnorcantheHearingBoarddrawanyinferenceaboutthedeterminationofresponsibilitybasedsolelyfromthewitness’sabsence.Theadvisorcannotyell,berateortalkovertheparty/witnesswhenprovidingcross-examination.

7. MembersoftheUniversityHearingBoardshallhaveafinalopportunitytoaskquestionsofthewitnesses.

H. DeliberationoftheUniversityHearingBoard.1. ThemembersoftheUniversityHearingBoardshalldeliberateinprivateandreacha

decisionbasedonlyupontheevidenceintroducedatthehearing.TheHearingOfficerispresentduringthedeliberation,butdoesnothaveavote.

2. ThemembersofUniversityHearingBoardshallnotmakeanyfindingoffactthatisnotsupportedbytheevidencepresentedatthehearing.

3. IftwoormoreUniversityHearingBoardmembersfindtheRespondentresponsiblefortheallegedconduct,thestudentis“responsible”forthatconduct.

4. IftheRespondentisfoundresponsible,therecommendedsanctionshallbechosengenerally fromthoselistedinAppendixA,Section3oftheStandardsofStudentConduct.

Section3:Sanctions

A. ListofPossibleSanctions.RespondentsfoundresponsibleforviolatingthePolicyProhibitingSexualMisconductwillbesanctioned.Sanctionsincludebutarenotlimitedtothefollowing:

1. UniversityHousingProbation.Actionpermittingthestudenttoremaininresidenceonprobationary status.Duringtheperiodofprobation,ifthestudentisfoundresponsibleforadditionalviolations, thestudentmaybeevictedfromUniversityhousing.

2. ConductProbation.ActionpermittingthestudenttoremainattheUniversityonprobationarystatusandsubjecttocertaintermsandconditionsasoutlinedbytheUniversityHearingBoard.Duringtheperiodofprobation,ifthestudentisfoundresponsibleforfurtherviolations,thestudentmaybesubjecttosuspension,dismissal,orseparationfromtheUniversity.Studentsareprohibitedfromstudyingabroadinanysemesterforwhichtheyareonconductprobationforallorpartofthe semester.

3. HousingRelocation.RelocationfromoneUniversityhousingareatoanother.4. HousingEviction.RemovalfromUniversityhousing.5. NoTrespassOrder.Anorderbanningastudentfromspecificbuildings,portionsofthe

campus,or fromtheentirecampusoroff-campusbuildingsorproperty.6. RevocationofPrivilege.Therevocationofaprivilegeincluding,butnotlimitedto,registered

events,usingUniversitydining facilities,havinganautomobileoncampus,and/oraccesstootherUniversityfacilities.

7. Suspension.Aforced,temporaryleavefromtheUniversity.Thetimeperiodofasuspensionistypicallyasemesterorafullacademicyear,butcanbesetforanydurationbytheUniversityHearingBoard.

8. Separation.ImmediateandpermanentseparationfromtheUniversity.Astudentwhoisseparated fromtheUniversityisnoteligibleforreadmission,andistypicallybarredfromUniversityevents,activities,andproperty.

B. MultipleSanctions.Morethanoneofthesanctionslistedabovemaybeimposedforanysingleviolation.

C. RecordKeeping.PleaseseeArticleVIIIoftheStandardsofStudentConduct,(4)(5)forinformationonrecordkeepingandtranscriptnotation.

Section4:Appeal

A. RighttoAppeal.TheRespondentandComplainanthavetherighttoappealthedecisionoftheUniversityHearingBoardtotheAppellateAdministrator.

B. TimeforFilingAppeal.AnappealmustbereceivedbythedesignatedAppellateAdministratorinwriting(adocumentasanemailattachmentisacceptable)by5:00PMonthefifthbusinessdayafterdeliveryofthewrittennotificationofthefindingoftheHearingBoard.TheHearingOfficermayextendthetimeframeforsubmittinganappeal,attheirsolediscretion,forgoodcauseuponwrittennoticetotheRespondent,andtheComplainant(whereappropriate)settingforththereasonfortheextension.

C. AccesstoHearingRecord.Thepartyfilingtheappealshallbeprovidedwithreasonableaccesstothehearingrecordinthehearingfromwhichtheappealistaken.

D. TimeforDecidingAppeal.Thedecisiononarequestforanappealshallbemadewithinthirty(30)daysofthereceiptoftheappeal,unlessthereisgoodcauseforareasonableextensionofthistimeperiod.Ifanextensionisdeemedappropriate,theAppellateAdministratorshallprovidewrittennoticetotheRespondent,andComplainant,settingforththereasonfortheextension.

E. BoththeComplainantandtheRespondentwillbeprovidedareasonableandequalopportunitytosubmitawrittenstatementinsupportoforchallengingtheHearingBoardoutcome.

F. AppealReviewBoard1. TheAppellateAdministratorshallconveneaReviewBoardcomprisedoftwomembersof

theUniversityHearingBoardwhowerenotinvolvedintheoriginalhearing.TheAppellateAdministratorshallbealsobeavotingmemberoftheReviewBoard.

2. TheAppellateAdministratorshallnotifytheotherpartyComplainantinwritingthatanappealhasbeenfiled.

3. TheReviewBoarddoesnotholdanewhearing.ThedecisionoftheReviewBoardshallbemadebymajorityvote.

4. IftheReviewBoardfindsgroundstograntanappeal,theReviewBoardshalldeterminearemedyasprescribedinArticleVIII(G)oftheStandardsofStudentConduct.

G. GroundsforAppeal.AnappealshallbegrantedtothepersonfilingiftheAppellateAdministratororReviewBoardsfinds,byclearandconvincingevidence,thatoneormoreofthefollowingoccurred:

1. Proceduralirregularitythataffectedtheoutcomeofthematter;2. Newevidencethatwasnotreasonablyavailableatthetimeofthedeterminationregarding

responsibilitywasmadethatcouldaffecttheoutcomeofthematter;3. TheTitleIXCoordinator,investigator(s),orHearingBoardmember(s)hadaconflictof

interestorbiasfororagainstcomplainantsorrespondentsgenerallyortheindividualRespondentorComplainantaffectedbytheoutcome.

H. NoticeofAppealOutcome.Uponreachingadecisiononarequestforanappeal,theAppellateAdministratorshallprovidewrittennotificationoftheirdecisiontotheRespondentandtheComplainantsimultaneously.Thewrittennotificationoftheappealdecisionshouldinclude:

1. Thegroundsforrequestforappealasoutlinedabove;2. AdescriptionofthepertinentpointstheAppellateAdministratororReviewBoard

consideredinrenderingadecision;3. ThedecisionoftheAppellateAdministratororReviewBoardontherequestforappeal;and4. Anyremedyorprescribedactionifapplicable.
