StatementofPurposeThemissionoftheUniversityofRichmondistoeducateinanacademicallychallenging,intellectuallyvibrant,andcollaborativecommunitydedicatedtotheholisticdevelopmentofstudentsandtheproductionofscholarlyandcreativework.ARichmondeducationpreparesstudentsforlivesofpurpose,thoughtfulinquiry,andresponsibleleadershipinadiverseworld.Tothatend,theUniversityhasestablishedthefollowingStandardsofStudentConductinordertofosteranenvironmentthatismostconducivetomeetingtheUniversity’smission.TheStandardsofStudentConductareinplacetopromoteasafe,secure,andinclusivecampuscommunityandanappropriateenvironmentforlivingandlearning.TheseStandardsdescribeconductthatisprohibitedattheUniversityandsetsforthproceduresbywhichstudentconductmatterswillbehandledattheUniversity.Studentconductmattersshallbehandledinaprompt,fair,andimpartialmanner.TheStandardsshallgoverntheconductofstudentsandtheirguestsonthecampusoftheUniversityofRichmond,atUniversity-sponsoredactivitiesandfunctionsandasotherwiseprovidedherein.AllstudentsoftheUniversityareexpectedtoconductthemselves,bothwithintheUniversityandelsewhere,insuchamannerastobeacredittothemandtotheUniversityofRichmond.AsresponsiblecitizensandmembersoftheUniversitycommunity,studentsareexpectedtocomplywithlocal,state,andfederallaws,andwithallpublishedUniversitypoliciesandregulations.InordertofulfillitsfunctionsasaneducationalinstitutionandtoprotectallmembersoftheUniversitycommunity,theUniversityofRichmondhastherighttomaintainorderwithintheUniversityandtoexcludepersonswhodisrupttheeducationalprocess.Matriculationand/orcontinuedenrollmentattheUniversityofRichmondisaprivilege,notaright.AnyrevocationofsuchaprivilegewouldbeanintentiontoprotectorsupportthestandardsoftheUniversitycommunity.Allstudentsareexpectedtofamiliarizethemselveswiththedetailsofthesestandards,issuedannuallyormorefrequentlybytheUniversity.TheVicePresidentforStudentDevelopmentisthepersondesignatedbytheUniversityPresidenttoberesponsiblefortheadministrationoftheStandardsofStudentConduct.TheStandardsofStudentConduct,Universitypolicies,andrelatedconductproceduresarenotcontractsanddonotconfercontractualrightsuponanyindividual.TheUniversityhastherighttoamendormodifytheStandardsofStudentConduct,Universitypolicies,andrelatedconductproceduresfromtimetotime,withoutpriornotice.Additionally,theStandardsofStudentConduct,Universitypolicies,andrelatedconductproceduresarenotintendedtoreplicateorsupersedestate,federal,criminal,orcivillawsorprocedures.UniversitypoliciesdifferfromthecriminalandciviljusticesystemandafindingofresponsibilityforaviolationoftheStandardsofStudentConductoraUniversitypolicyshallnotbeconstruedasafindingthatanycriminalorcivilstatutehasbeenviolated.

B. AppellateAdministrator.Theterm“AppellateAdministrator”meansanypersonauthorizedbytheVicePresidentforStudentDevelopmenttoconsideranappealfromaStudentConductBoard.
C. Campus.Theterm“campus”includesanybuildingorpropertyownedorcontrolledbytheUniversitywithinthesamereasonablycontiguousgeographicareaoftheUniversityandusedbytheUniversityindirectsupportof,orinamannerrelatedto,itseducationalpurposes,includingresidencehallsandapartmentsandanybuildingorpropertywithinorreasonablycontiguoustothecampusthatisownedbytheUniversity,isfrequentlyusedbystudents,andsupportsUniversitypurposes.
D. Chair.Theterm“Chair”meansthechairpersonoftheapplicableStudentConductBoard.
E. College.Theterm“College”meanseither“RichmondCollege”or“WesthamptonCollege.”
F. Complainant.Theterm“Complainant”meansthestudentorotherindividualwhoisallegedtobethevictimorsubjectofconductthatformsthebasisforadisciplinarycharge.
G. ConductOfficer.Theterm“ConductOfficer”meansanypersonorpersonsauthorizedonanon-goingoracase-by-casebasisbytheVicePresidentforStudentDevelopmentto:(i)chargeastudentwithaviolationoftheStandardsofStudentConduct;(ii)conductpreliminaryhearings;and(iii)imposesanctionsuponanystudent(s)whoaccept(s)responsibilityforaviolationoftheStandardsofStudentConduct.ConductOfficersoftherankofDeanareempoweredtoimposeasanctionofsuspension,toissueNoContactOrders,andtoimposeInterimSuspensions.

N. Off-CampusBuildingsorProperty.Theterm“off-campusbuildingsorproperty”meansanybuildingorpropertyownedorcontrolledbyastudentorganizationofficiallyrecognizedbytheUniversityandanybuildingorpropertyownedorcontrolledbytheUniversity,usedindirectsupportof,orinrelationto,theUniversity’seducationalpurposes,andfrequentlyusedbystudents.

Off-CampusEducationProgramsandActivities.Theterm“off-campusprogramsandactivities”meanseducational,extra-curricular,orathleticactivitiesinvolvingorganizationsorprogramsoractivitiesrecognizedorsponsoredbytheUniversity,suchasUniversity-sponsoredtrips,athleticteamtravel,eventsfororganizationsthatoccuroffcampus(e.g.,adebateteamtriptoanotherschoolortoaweekendcompetition).
P. Organization.Theterm“organization”or“organizations”meansanynumberofpersonswhohavecompliedwiththeformalrequirementsforUniversityrecognitionandregistration.
Q. PresidingOfficer.Theterm“PresidingOfficer”meanstheAdvisoroftheStudentConductCouncilortheHearingOfficeroftheUniversityHearingBoard.
R. PublicProperty.Theterm“publicproperty”meansstreets,sidewalks,orparkingfacilitieswithinthecampusorimmediatelyadjacenttoandaccessiblefromcampus.
S. Respondent.Theterm“Respondent”meansanystudentchargedwithviolatingtheStandardsofStudentConductoraUniversitypolicy.
T. School.Theterm“School”meanstheSchoolofArts&Sciences,theRobinsSchoolofBusiness,theJepsonSchoolofLeadershipStudies,theUniversityofRichmondSchoolofLaw,ortheSchoolofProfessionalandContinuingStudies.
U. Shall.Theterm“shall”isusedinthemandatorysense.
V. Student.Theterm“student”includesallpersonstakingcoursesattheUniversity,eitherfull-timeorpart-time,pursuingundergraduate,graduate,orprofessionalstudies.Personswhowithdrawduringaninvestigationorwithapendingconductchargeorproceeding,orwhoarenotofficiallyenrolledforaparticulartermbutwhohaveacontinuingrelationshipwiththeUniversityareconsidered“students”forpurposesoftheseStandardsofStudentConduct.
W. StudentConductAdministrator.Theterm“StudentConductAdministrator”meansanypersonauthorizedbytheVicePresidentforStudentDevelopmenttofollowtheStandardsofStudentConductindeterminingtheappropriateConductOfficer,PresidingOfficer,orConductBoardauthorizedtoheareachmatter.
X. StudentConductBoard.Theterm“StudentConductBoard”or“Board”meansagroupauthorizedbytheVicePresidentforStudentDevelopmenttodeterminewhetherastudent,students,orastudentorganizationhasviolatedtheStandardsofStudentConductandtodeterminesanctionsthatmaybeimposedwhenaviolationhasbeencommitted.ThistermincludestheStudentConductCouncilandtheUniversityHearingBoard.
Y. StudentConductCouncil.Theterm“UniversityofRichmondStudentConductCouncil”or“StudentConductCouncil”meansaspecificStudentConductBoardcomprisedofstudentsspeciallyselectedandtrainedbytheUniversity.
Z. University.Theterm“University”means“UniversityofRichmond”.
AA. UniversityHearingBoardorUHB.Theterm“UniversityHearingBoard”or“UHB”meansaspecificStudentConductBoardcomprisedofUniversitystaffmembersspeciallyselectedandtrainedbytheUniversity.
BB. UniversityOfficial.Theterm“Universityofficial”includesanyindividualemployedbytheUniversity,performingassignedadministrativeorprofessionalduties.AUniversityofficialmayincludestudentstaffsuchasResidentAdvisorsandEmergencyMedicalTechnicians.
CC. UniversityPolicy.Theterm“Universitypolicy”meansanypolicy,rule,orregulationoftheUniversity.
DD. UniversityPremises.ForpurposesoftheseStandardsofStudentConduct,theterm“Universitypremises”includes:(1)anybuildingorpropertythatispartoftheUniversity’scampus;(2)anybuildingorpropertythatisnotlocatedonoradjacentorcontiguoustothecampus,butisownedorcontrolledbyaUniversityrecognizedorganizationorthatisusedindirectsupportoforinrelationtotheUniversity’seducationalpurposesandisfrequentlyusedbystudents;(3)publicpropertywithinthecampusorimmediatelyadjacenttoandaccessiblefromcampus(suchaspublicroads,sidewalks,parkinglots);or(4)otherareasthatarewithinthepatroljurisdictionoftheUniversityPoliceDepartment.

ArticleIII:JurisdictionandProhibitedConduct
A. JurisdictionoftheStandardsofStudentConduct
TheStandardsofStudentConductshallapplytoconductthatoccursonthecampusoftheUniversity,onorinoff-campusbuildingsorpropertyoftheUniversity,andatUniversitysponsoredactivities,includingoff-campuseducationprogramsandactivities,oronpublicproperty,asdefinedinArticleI.
TheStandardsofStudentConductalsoapplytoUniversitystudentsstudyingabroadthroughaUniversityapprovedstudyabroadprogram.TheStandardsofStudentConductapplytoconductbyaUniversitystudentororganizationsoccurringatotherlocationsorinconnectionwithotheractivitiesiftheVicePresidentforStudentDevelopmentortheirdesigneedeterminesthatsuchconductmayadverselyaffectanymemberoftheUniversitycommunity,theUniversityitself,oritseducationalprograms.
FormattersinvolvingsexualharassmentunderTitleIXcoveredbytheUniversity’sPolicyPreventingSexualMisconduct,jurisdictionislimitedtoconductthathasoccurredwithintheUniversity'seducationprogramoractivitywhichincludeslocations,events,orcircumstancesoverwhichtheUniversityexercisedsubstantialcontroloverboththerespondentandthecontextinwhichthesexualharassmentoccursandalsoincludesanybuildingownedorcontrolledbyastudentorganizationthatisofficiallyrecognizedbytheUniversity.TitleIXactionsinvolveconductthathasoccurredwithintheUnitedStatesonly.Eachstudentshallberesponsiblefortheirconductfromtheirfirstdayoncampusthroughtheactualawardingofadegree(eventhoughtheconductmayoccurbeforeclassesbeginorafterclassesend)aswellasduringtheacademicyearandduringperiodsbetweentermsofactualenrollment.StudentswhohaveacceptedadmittancetotheUniversitybuthavenotyetenrolledareexpectedtocomportthemselvesaccordingtotheStandards.TheStandardsofStudentConductshallapplytoastudent’sconductevenifthestudentwithdrawsfromtheUniversitywhileadisciplinarymatterispending.
B. ProhibitedConduct.ThefollowingconductisprohibitedbytheUniversity.
1. Violence.Anyactofviolence,force,coercion,threat,orintimidationthatincludes,butisnotlimitedto:a. Physicalabuseoforassaultuponanyperson;b. Conductthatthreatens,intimidates,orendangersthehealthorsafetyofanyperson;c. Physicaldetainmentofanypersonagainsttheirwill;ord. Possession,storage,useof,orattemptorthreattouseanykindofammunition,explosives,
firearms,orweapon.
2. Property.a. TheftorpossessionofUniversitypropertyorthepropertyofothers.b. Vandalismordamageto,defacement,ordestructionofUniversitypropertyorthepropertyof
others.c. Alteration,fabrication,misuse,ordestructionofUniversitydocumentsincludingrecords,
identificationcards,orparkingstickers/permits.
3. Disruption.a. Obstruction,disruption,orattemptsatobstructionofdisruptionofteaching,research,
administration,disciplinaryprocedures,orotherUniversityorUniversity-authorizedactivities,functions,events,oroperations.
b. BlockingtheentranceorexitofanyUniversityfacilityorbuilding,oranycorridororroomtherein.
c. BlockingorimpedingnormalpedestrianorvehiculartrafficonoradjacenttoUniversityproperty.
d. Disorderlyconduct.e. Disturbingtheresidencehall/community.

4. Trespass.Unauthorizedentryinto,presencein,seizure,oroccupationofanyUniversityfacilityorareathatislocked,closedtostudentactivities,orotherwiserestrictedastoitsusewhereone’spresenceisunauthorized.
5. IllegalActivity.ConductthattheUniversitydeterminesmayviolatelocal,state,orfederallaws,including,butnotlimitedto:a. Possessionand/oruseofillegaldrugs,narcotics,pharmaceuticals,and/ordrugparaphernalia;b. Distributionorsaleofillegaldrugs,narcotics,pharmaceuticals,and/ordrugparaphernalia;c. ViolationofAlcoholandBeverageControl(ABC)Laws;d. Drivingundertheinfluenceand/orwhileintoxicated;e. Possessionand/oruseoffalseidentification;orf. Convictionofanyfelonyorconvictionofamisdemeanorinvolving,fraud,theft,lyingormoral
turpitude.i. Astudentmay,atthediscretionoftheConductOfficerorStudentConductBoardChair,be
foundresponsibleofProhibitedConductIII(B)(5)(f)solelyupontheintroductionintoevidenceataStudentConductBoardhearingofacertifiedcopyofanorderofconvictionorotherdocumentsatisfactorilyevidencingconvictionofafelonyorofamisdemeanor.
6. OtherRegulationsandPolicies.a. Actsofharassmentand/ordiscrimination,orviolationoftheUniversity’sPolicyonPreventing
andRespondingtoDiscriminationandHarassmentAgainstStudents.b. ViolationoftheUniversity’sPolicyProhibitingSexualMisconduct.

Hostinganillegal/unregisteredeventwithalcohol.v. HostingaregisteredeventwithalcoholthatviolatedtheUniversity’salcoholregulations.vi. Havinganunderageguestwhopossessedand/orconsumedalcoholwhileinattendanceat
yourevent.vii. Consumptionofanalcoholicbeverageinpublic.viii. Publicintoxication.ix. ViolationofthealcoholpolicyatTheCellar.x. Purchase,possession,orconsumptionoftobaccoproducts,nicotinevaporproducts,and/or

f. ViolationofUniversitypoliciesorCollegerulesorregulationsincluding,butnotlimitedto,thosegoverningUniversityhousing.
g. FailuretocomplywithdirectionsofaUniversityofficialactingintheauthorizedperformanceofduty.
h. FailuretopresentproperidentificationuponrequestbyaUniversityofficial.

individualsthatarenotaffiliatedwiththeUniversitywithoutthemember’spermission.m. Violationofa“NoContactOrder”issuedbyaUniversityofficial.n. Incitingotherstocommitprohibitedactsofthekindshereinprohibited.
7. UseofRecordedMaterial.ManyclasseswillberecordedusingZoomandfacultymaypreparevideorecordingsoflecturesorteachingsegmentsusingothersoftware.Recordingsofanytypewillbemadeavailableonlytostudentsregisteredforthecourseandshouldbeusedonlyforpersonalstudybystudentsenrolledinthecourse.a. Studentsshallnotdisclose,share,trade,orselltheserecordingswith/toanyotherperson,
organization,business,orinstitution.b. Studentsshallnotpost/storetheserecordingsinalocationaccessiblebyanyoneotherthanthe
student,includingbutnotlimitedtosocialmediaaccounts.c. Studentsmustcomplywithanyinstructionsordirectionsfromtheirfacultyregardingtheuseof
suchrecordings.d. Studentsarerequiredtodestroyanyrecordingsthatweremadewhentheyarenolongerneeded
forthestudent’sacademicwork.
C. ViolationofLawandUniversityDiscipline.
1. UniversitydisciplinaryproceedingsmaybeinstitutedagainstastudentchargedwithconductthatpotentiallyviolatesboththecriminallawandtheStandardsofStudentConductorUniversitypolicy(thatis,ifbothpossibleviolationsresultfromthesamefactualsituation)withoutregardtothependencyofcivilorcriminallitigationincourtorcriminalarrestorprosecution.AtthediscretionoftheVicePresidentforStudentDevelopment,andconsistentwithotherUniversitypolicies,proceedingsundertheStandardsofStudentConductmaybecarriedoutpriorto,simultaneouslywith,orfollowingcivilorcriminalproceedingsoffcampus.
DeterminationsmadeorsanctionsimposedundertheStandardsofStudentConductshallnotbesubjecttochangebecausecriminalorcivilchargesarisingoutofthesamefactsgivingrisetoviolationofUniversityrulesweredismissed,reduced,orresolvedinfavoroforagainstthecriminalorcivillawdefendant.
2. Whenastudentischargedbyfederal,state,orlocalauthoritieswithaviolationofthelaw,theUniversitywillnotrequestoragreetospecialconsiderationforthatindividualbecauseoftheirstatusasastudent.IftheallegedoffenseisalsobeingprocessedundertheStandardsofStudentConduct,theUniversitymayadviseoff-campusauthoritiesoftheexistenceoftheStandardsofStudentConductandofhowsuchmattersaretypicallyhandledwithintheUniversitycommunity.Subjecttoapplicablelaws,theUniversitywillattempttocooperatewithlawenforcementandotheragenciesintheenforcementofcriminallawsoncampusandintheconditionsimposedbycriminalcourtsfortherehabilitationofstudentviolators(providedthattheconditionsdonotconflictwithcampusrulesorsanctions).

ArticleIV:Reporting,Charge,PreliminaryHearing,andInterimSuspension[PleaseseeAppendixAforspecificreportingandemergencyremovalproceduresformattersinvolvingtheUniversity’sPolicyProhibitingSexualMisconduct.]
A. Reporting.
AnymemberoftheUniversitycommunitywithknowledgeofanactbyastudentthatmayconstituteaviolationoftheStandardsofStudentConduct,includingaviolationofUniversitypolicy,mayfileacomplaintinwritingtotheappropriatedeanoftheCollegeorSchool.
Complaintsshouldbesubmittedassoonaspossiblefollowingtheeventthatprecipitatedthecomplaint,preferablywithinseven(7)days.However,nocomplaintwillbedismissedsolelyonthebasisofthetimeitwasfiled.
B. PreliminaryInvestigationandCharge.
1. Uponreceiptofacomplaint,theStudentConductAdministratorshalldeterminewhethertherehasbeenanypreliminaryinvestigationorinquiryintothefactsunderlyingthecomplaint(forexample,bytheUniversityofRichmondPoliceDepartment).a. Iftherehasbeenapreliminaryinquiryorinvestigation,theStudentConductAdministratorshall
reviewthefindingsofthatinquiryorinvestigationtodeterminewhetherapreliminarychargeundertheStandardsofStudentConductiswarranted.TheStudentConductAdministrator,attheirsolediscretion,mayconductafollow-upinvestigationinordertogainsufficientinformationtodeterminewhetherapreliminarychargeiswarranted.
b. Intheprocessofassessingwhetherapreliminarychargeiswarranted,theStudentConductAdministrator,attheirsolediscretion,mayseektheadviceandcounselofindividualsnotinvolvedinthepotentialhearingprocess.TheseindividualsincludebutarenotlimitedtoUniversityPolice,UniversityCounsel,andotheradministrators.
2. TheStudentConductAdministratorshallassignthecomplainttotheappropriateConductOfficer.TheStudentConductAdministratorshallsharethepreliminarychargesandthefindingsofanyinquiriesorinvestigationsconductedtothatpointwiththeConductOfficer.
a. AcomplaintthatmayrequiretheimpositionofaNoContactOrderand/orInterimSuspension,resultinsuspensionoftheRespondentasapossiblesanction,orwouldresultinareferraltotheUniversityHearingBoardshallbeassignedtoaDean.
b. Acomplaintthatinvolvesstudentslivinginoff-campusresidencesshallbereferredtoaConductOfficerwiththerankofDean.
c. TheConductOfficer,attheirsolediscretion,mayconductfollow-uporadditionalinvestigationinordertogainsufficientinformationtodetermineifthespecificpreliminarychargesareappropriateorifadditionalchargesarewarranted.
i. Intheprocessofdeterminingappropriateandspecificcharges,theConductOfficer,attheirsolediscretion,mayseektheadviceandcounselofindividualsnotinvolvedinthepotentialhearingprocess.TheseindividualsincludebutarenotlimitedtoUniversityPolice,UniversityCounsel,andotheradministrators.
d. ThefinaldecisiononwhetheraformalchargeundertheStandardsofStudentConductiswarrantedrestswiththeConductOfficer.TheConductOfficer,attheirdiscretion,mayseekadviceandcounselinthedeterminationofformalcharges.
i. ConductOfficerswiththerankofAreaCoordinatorshallconsultwithaDeanoftherespondent’sCollege.
ii. ConductOfficerswiththerankofDeanshallconsultwiththerespondent’sCollegeDean.
iii. AcomplaintshallbereassignedfromaConductOfficerwiththerankofAreaCoordinatortoaConductOfficerwiththerankofDeanif,intheprocessofdeterminingappropriateand

e. IndeterminingwhethertoformallychargeastudentwithaviolationoftheStandardsofStudentConduct,theConductOfficerwillconsiderwhethertheresultsoftheinvestigationprovidesufficientfactsandevidenceuponwhichareasonabledecision-makercouldfind,byapreponderanceoftheevidence,thattheRespondentviolatedtheStandardsofStudentConduct.However,thedecisiontoinitiateaconductorotherdisciplinaryproceedingisnotafinaldeterminationofresponsibilityandwillnotbeusedasevidenceinanysubsequenthearingorproceeding.
C. PreliminaryHearing.
1. TheConductOfficershallnotifytheRespondentofthecharge(s)anddateofthepreliminaryhearinginwritingandrequesttheattendanceoftheRespondentatthathearing.Duringthepreliminaryhearing,theConductOfficershall:
a. ProvidetheRespondentwithacopyofArticleVoftheStandardsofStudentConductasappropriate;
b. ReviewthecomplaintfiledagainsttheRespondent;
c. Explainthecharge(s)andanyassociatedpolicyorpolicies;and
d. Reviewtheoptionsavailableforresolutionofthecharge(s),includingpossiblesanction(s).
2. TheRespondentisaskediftheyacceptresponsibilityfortheallegedviolation(s)charged.
a. TheRespondentmayacceptresponsibilityfortheallegedviolation(s)charged.
i. IftheRespondentacceptsresponsibilityfortheviolation(s)andacceptsthesanction(s)assignedbytheConductOfficer,theRespondentwaivestheirrighttoahearingandanappeal.
ii. IftheRespondentacceptsresponsibility,butdoesnotacceptthesanction(s)assignedbytheConductOfficer,thematterwillbereferredtotheappropriateStudentConductBoardforahearingtodetermineappropriatesanctions.
a. Inlimitedcircumstances,thematterwillbereferredtothePresidingOfficeroftheappropriateStudentConductBoardforanadministrativehearingtodeterminetheappropriatesanction.
b. TheRespondentmaydenyresponsibilityfortheallegedviolation(s)charged.IftheRespondentdeniesresponsibility,thematterwillbereferredtotheappropriateStudentConductBoardforahearingandadeterminationofresponsibilityandsanctions,ifany.
c. TheConductOfficermayconcludethatthereisinsufficientevidencetowarrantacharge,orthatastudentwasnotpresentorinvolvedintheallegedviolation.
i. Iftheconclusionisthatthereisinsufficientevidencetowarrantacharge,theRespondentwillbefoundNotResponsibleforthecharge.
ii. IftheconclusionisthattheRespondentwasnotpresentorinvolvedintheallegedviolation,theRespondentwillbefoundNotResponsible/ChargesUnfoundedforthecharge.

3. Withintwenty-four(24)hoursafterthepreliminaryhearing,theRespondentmustadvisetheConductOfficerinwritingoftheirchoiceoftheavailableproceduraloptions.
a. IftheRespondentdoesnotadvisetheConductOfficerinwritingoftheirchoicewithintwenty-fourhours,theRespondentwillbefoundresponsibleandwillbesubjecttothesanction(s)assignedbytheConductOfficerinaccordancewiththeStandardsofStudentConduct.TherespondentwillbenotifiedinwritingofthedeterminationoftheConductOfficerandanypossiblesanctions.
b. TheConductOfficerattheirdiscretioncanextendthisdeadlineuptoseventy-two(72)hours,withgoodcause.
i. IftheRespondentdoesnotadvisetheConductOfficerinwritingoftheirchoicewithinseventy-twohours,theRespondentwillbefoundresponsibleandwillbesubjecttothesanction(s)assignedbytheConductOfficerinaccordancewiththeStandardsofStudentConduct.TherespondentwillbenotifiedinwritingofthedeterminationoftheConductOfficerandanypossiblesanctions.
4. ReferraltoStudentConductBoard.
a. IfthematterisreferredtoaStudentConductBoard,theConductOfficerwillprepareastatementfortheStudentConductBoardlistingthespecificchargesagainsttheRespondent,summarizingthefactssupportingeachcharge,settingforththerecommendedsanction(s)andsummarizingtherationaleforsanction(s),ifapplicable.
D. InterimSuspensionandClassRemoval.1. IncertaincircumstancesaUniversityorhousing“interim”suspensionmaybeimposed.Interim
suspensionsshallbeimposedbyaConductOfficerwiththerankofDean,theVicePresidentofStudentDevelopmentintheirroleasChairoftheThreatAssessmentTeam,orbytheTitleIXCoordinator,ontheirownaccordorafterconsultationwithotherUniversityofficials.
2. Aninterimsuspensionmaybeimposedwhenthereisareasonablebasistoconcludethat:(a)thecontinuedpresenceoftheRespondentoncampusorinaresidencehallmaycreatearisktothehealthorsafetyofoneormorestudentsorofothermembersoftheUniversitycommunity;or(b)theRespondentposesanongoingthreatofdisruptionof,orinterferencewith,thenormaloperationsoftheUniversity.
3. Duringtheperiodofinterimsuspension,theRespondentmustleavecampusimmediatelyandshallnotparticipateinacademic,extracurricular,orotheractivitiesoftheUniversityexceptasmaybeauthorizedbythepartywhoimposedtheinterimsuspension.TheRespondentisnotpermittedonthecampuswithoutthepriorwrittenconsentfromthepartywhoimposedtheinterimsuspension.
Suchinterimsuspension,ifimposed,shallbeinadditiontoanyotherinterimremedialmeasures,suchasNoContactOrders,putintoplacebyUniversityofficials,includingtheTitleIXCoordinator.Theinterimsuspensiondoesnotreplacetheregularhearingandappealprocess,whichshallproceedonthenormalschedule.Unlessprovidedwithexplicit,writtenpermissionforanexceptioninadvance,asabove,theRespondentsubjecttoaninterimsuspensionwillbepermittedtoreturntocampussolelyforpurposesofparticipatinginahearingbeforetheappropriateStudentConductBoard.
4. ARespondentmaybedeniedattendanceinaspecificclassifthereisareasonablebasistoconcludethattheRespondentmayposeanongoingthreattothehealthandsafetyofanypersonintheclass.ArrangementswillbemadefortheRespondenttoeitherattendanothersectionoftheclassortomakeanarrangementwiththeinstructorofrecordtocompletethecourseinanothermanner.

ArticleVI:StudentConductBoardProcedures[PleaseseeAppendixAforspecificconductboardproceduresformattersinvolvingtheUniversity’sPolicyProhibitingSexualMisconduct.]A. ProceduresApplicabletoallStudentConductBoardHearings.Thefollowingprocedureswillapplytoall
StudentConductBoardhearings.SpecificrulesandguidelinesfortheUniversityofRichmondStudentConductCouncilareoutlinedintheStatutesoftheCouncil.
1. InsituationswheremorethanonestudentisaccusedofviolatingArticleIIIoftheStandardsofStudentConduct,thePresidingOfficer,attheirdiscretion,maypermittheStudentConductBoardHearingsconcerningeachstudenttobeconductedeitherseparatelyorjointly.
2. StudentConductHearingsshallbeclosedtothepublic.AdmissionofanypersonnotdirectlyconnectedtothehearingshallbeatthesolediscretionofthePresidingOfficer.
3. Formalrulesofprocess,procedure,and/ortechnicalrulesofevidence,suchasareappliedincriminalorcivilcourt,arenotusedinStudentConductBoardproceedings.
4. Thereshallbeasingleverbatimrecord,typicallyanaudiorecording,ofallStudentConductBoardhearingsexceptfordeliberationsoftheStudentConductBoard,whichshallnotberecorded.TherecordshallbethepropertyoftheUniversity.
a. Ifitappearsvitaltothedispositionofthecase,thePresidingOfficerortheVicePresidentforStudentDevelopment,attheirsolediscretion,mayorderthattheproceedingsbetranscribedinadditiontotherecording.

TheStudentConductBoard’sdeterminationshallbemadebasedonapreponderanceoftheevidencestandard,meaningthatinordertofindtheRespondentresponsible,theStudentConductBoardmustfindthatthegreaterweightoftheevidencepresentedatthehearingsupportsafindingofresponsibilityfortheviolations(s)ofArticleIII(B)withwhichtheRespondentwascharged.Apreponderanceorthegreaterweightoftheevidenceisamatterofquality,notquantity.
B. ProceduresSpecifictotheUniversityHearingBoard.TheUniversityHearingBoardischargedwiththedispositionofchargesasoutlinedinArticleIV(C)(2)(a)(ii)andArticleIV(C)(2)(b)oftheStandardsofStudentConduct.TheVicePresidentforStudentDevelopmentshallassignaHearingOfficertoberesponsiblefortheadministrationoftheUniversityHearingBoard.
1. CompositionoftheUniversityHearingBoard.TheUniversityHearingBoardshallconsistofthree(3)votingmemberschosenfromtheUniversityHearingBoardPool.
a. TheUniversityHearingBoardPoolshallconsistofaminimumoften(10)staff/administratorsappointedannuallybytheVicePresidentforStudentDevelopmentandwhohavereceivedannualtrainingonissuesrelatedtosexualmisconduct,TitleIX,theimpactoftraumaonvictims,theinvestigativeanddisciplinaryprocess,andthehearingprocess.

2. Pre-HearingProcedures.
a. TheHearingOfficershallnotifytheRespondentinaccordancewiththeStandardsofStudentConduct.
b. TheRespondentshallbeaffordedtheopportunitytomeet(inpersonorbytelephoneorvideoconference)withtheHearingOfficerpriortothehearing.ThepurposeofthismeetingistoadvisetheRespondentofthehearingproceduresandtheirrightsinconnectionwiththehearing.
c. TheHearingOfficershallcreatesix(6)copiesofanevidencepacketcontainingallsubmittedinformationtobeconsideredduringthehearing.Thepacketsaredistributedasfollows:
i. One(1)copyfortheHearingOfficer’susewhichwillbeaddedtotheofficialcasefile;
ii. Three(3)copiesdistributedtotheUniversityHearingBoardMembersatthePre-HearingMeeting;
iii. One(1)copygiventotheRespondentinaccordancewiththetimeframessetforthintheseStandardsofStudentConduct;and
iv. One(1)copyismadeavailableforwitnessreferenceduringthehearing.
d. TheHearingOfficerortheirdesigneeshallconveneaPre-HearingMeetingofthemembersoftheUniversityHearingBoardtoreviewthecharge(s),gooverthecontentsoftheevidencepacket,andtoansweranyproceduralquestions.Thismeetingshallbeheldatleasttwenty-four(24)hourspriortothehearing.
3. GeneralProceduralRulesoftheUniversityHearingBoard.
a. TheHearingOfficershallpresideoverandconductthehearingandisspecificallyempoweredto:
i. Appointarecordingsecretaryorotherstaffasneeded;
ii. Controltheadmissionofpersonstothehearing.TheHearingOfficermayorderanypersoninattendancethatdoesnotconductthemselvesinanorderlyandrespectfulmannertoleave.Obstructive,contemptuous,disruptive,ornoisyconductinthepresenceofthehearingboardbyanyperson,includingtheRespondent,awitness,oranadvisor,mayresultinthatpersonbeingremovedfromthehearingand,ifastudent,chargedwithaviolationofprohibitedconductasoutlinedinArticleIII(B)oftheStandardsofStudentConduct;
iii. ControltheconductoftheUniversityHearingBoardmembersandoftheRespondenttoprotectwitnessesfromimproperquestions,insultingtreatment,andunnecessaryinquiryintotheirprivateaffairs;and
iv. Excludewitnessesfromthehearingroomexceptwhentheyaretestifying.
b. AllmembersoftheUniversityHearingBoardmustbepresentthroughoutthehearing.
i. IfamemberoftheUniversityHearingBoardmustleavethebeforethehearingiscompletewithgoodcause,theHearingOfficermayattheirsolediscretionrecessthehearingandreconvenethehearingwithintwenty-four(24)hours.
ii. Ifavotingmemberdisqualifiesthemselvesorforgoodcausemustwithdrawfromthehearing,theHearingOfficershallselectareplacementfromtheUniversityHearingBoardPool.TheHearingOfficershall,afterconsultationwiththeRespondent,inopensession,providethereplacementwithasummaryofallpriorproceedings.

4. OrderoftheHearing.
a. TheHearingOfficerwillaskthemembersoftheUniversityHearingBoard,theRespondentandtheRespondent’sadvisortointroducethemselves.
b. TheHearingOfficershallreadthecharge(s)totheRespondent,andtheRespondentshallstatewhethertheyacceptresponsibilityforeachcharge.
i. Intheabsenceofaresponse,theRespondentshallbedeemednottohaveacceptedresponsibilityforthecharge(s).
ii. IftheRespondentdoesnotacceptresponsibilityforthecharge(s),evidence,witnesstestimony,and/orwitnessstatementsshallbepresentedthatwillsupportorrefutethecharge.

b. ThemembersofUniversityHearingBoardshallnotmakeanyfindingoffactthatisnot
supportedbytheevidencepresentedatthehearing.
c. IftwoormoreUniversityHearingBoardmembersfindtheRespondentresponsibleforacharge,thestudentis“responsible”forthatcharge.
d. IftheRespondentisfoundresponsible,therecommendedsanctionshallbechosengenerallyfromthoselistedinArticleVIIIoftheStandardsofStudentConduct.Inevaluationofthesanction(s),theUniversityHearingBoardshallconsultwithanysanctioningguidelinesimplementedbytheUniversityand,incasesinvolvingaviolationoftheUniversity’sPolicyProhibitingSexualMisconduct,pastprecedentinsimilarcases.

5. HousingEviction.SerioushousingmattersorrepeatedviolationsofUniversitypolicymayresultinremovalfromUniversityhousing.
6. Suspension.Aforced,temporaryleavefromtheUniversity.Thetimeperiodofasuspensionistypicallyasemesterorafullacademicyear,butcanbesetforanyduration.AsuspensionshallonlybeimposedbyaConductOfficerwitharankofDeanorbyaStudentConductBoard.
7. Separation.ImmediateandpermanentseparationfromtheUniversity.AstudentwhoisseparatedfromtheUniversityisnoteligibleforreadmission,andistypicallybarredfromUniversityevents,activities,andproperty.SeparationshallonlybeimposedbyaConductOfficerwitharankofDeanorbytheUniversityHearingBoard.

1. CommunityService.AnassignmenttoperformataskorservicefortheUniversityoraUniversitysponsoredorganization.
2. Fine/Restitution.Reimbursementfordamageto,destructionof,ormisappropriationofproperty,toincludebutnotlimitedtopersonalandmedicalreimbursement.
3. NoContactOrder.Anordertohavenocontactinanyformwithanidentifiedstudentorstudents.NoContactOrdersarebilateraltoprotectallpartiesinvolved,andareissuedbyeithertheTitleIXofficeorbytheCollegeDeans’Offices.
4. Notificationofparents/guardiansbytheCollegeDeanortheirdesigneeifdeemedappropriate.
5. a. An“active”conductfileissubjecttodisclosuretoanyUniversitydepartmentwithaneducationalneedtoknoworoutsideagencywithwrittenpermissionfromthestudent.
i. SanctionssubjecttodisclosureincludeConductProbation,Suspension,andSeparation.
ii. DisciplinaryWarningisgenerallynotsubjecttodisclosure.
b. Intheeventthatastudentison“conductprobation”atthetimeoftheirgraduation,thestudent’sconductfilewillremain“active”foroneyearfollowingthestudent’sgraduation.
c. Conductrecordsmayremain“active”indefinitelyatthediscretionoftheVicePresidentforStudentDevelopmentortheirdesignee.
d. Whenastudenthascompletedallofthesanctionsassignedtothem,and/orwhentheirperiodofprobationhasended,thestudentshallbeconsideredingoodstanding.

E. TranscriptNotation.
1. SuspensionorPermanentSeparation.Generally,astudent’ssuspensionorpermanentseparationfromtheUniversitywillbenotedonthestudent’sacademictranscript.ExceptforthoseconductviolationsdescribedinArticleVII(E)(2),thetranscriptnotationshallnotspecificallyreferenceaviolationoftheStandardsofStudentConduct.
2. Suspension,SeparationorWithdrawalforCertainViolationsoftheStandardsofStudentConduct.TheUniversityisrequiredbyVirginialawtoincludeaprominentnotationontheacademictranscriptofeachstudentwhohasbeensuspendedfor,permanentlyseparatedfor,orwithdrawswhileunderinvestigationforaviolationoftheStandardsofStudentConductinvolvingsexualviolence,asdefinedintheUniversity’sPolicyProhibitingSexualMisconduct.ThistranscriptnotationwillberemovedifthestudentissubsequentlyfoundnottohavecommittedanoffenseinvolvingsexualviolenceorifthestudentcompletesthetermsoftheirsuspensionandisdeterminedtobeingoodstandingaccordingtoapplicableUniversitypolicy.Consistentwithstatelawandfederalregulations,thenotationwillberemovedfromatranscriptafterthreeyearsforastudentthatwithdrawalswhileunderinvestigationorispermanentlydismissedfromtheUniversity.

C. RightNottoParticipate. TheComplainantshallbeaffordedtheopportunitytomeet(inperson,bytelephoneorvideoconference)withtheHearingOfficerortheirdesigneepriortothehearing.Thepurposeof thismeetingistoadvisetheComplainantofthehearingproceduresandtheirrightsin connectionwiththehearing.TheComplainant’sadvisorispermittedtoattendthismeeting.
4. TheHearingOfficershallreviewallwrittenmaterialspriortosubmissiontotheUniversityHearingBoardtoensurethatthehearingrecorddoesnotcontainirrelevant,unfairlyprejudicial,orinadmissibleinformation,asdeterminedbytheHearingOfficerintheirreasonablediscretion.

the membersoftheUniversityHearingBoardtoreviewthecharge(s),togooverthecontentsofthe hearingrecord,andtoansweranyproceduralquestions. Thismeetingshallbeheldatleast twenty-four(24)hourspriortothehearing.

E. GeneralProceduralRulesoftheUniversityHearingBoard.
1. TheHearingOfficershallpresideoverandconductthehearingandisspecificallyempoweredto:
a. Appointarecordingsecretaryorotherstafftoaudiorecordthehearing.b. Controltheadmissionofpersonstothehearing.TheHearingOfficermayorderany
personinattendancethatdoesnotconductthemselvesinanorderlyandrespectfulmannertoleave.Obstructive,contemptuous,disruptiveornoisyconductinthepresenceofthehearingboardbyanyperson,includingtheRespondent,theComplainant,awitness,oranadvisor, mayresultinthatpersonbeingremovedfromthehearingand,ifastudent,chargedwitha violationofArticleIII(B)(6)(b)oftheStandardsofStudentConduct.Ifaparty’sadvisorisremovedfromahearingpursuanttothissection,thehearingwillberecesseduntilsuchtimethattheUniversitycanprovideanalternateadvisoroftheUniversity’schoiceatnocostorfeetotheparty,inordertoconductcrossexaminationonbehalfofthatparty.

10. TheHearingOfficerwillexcuseallpartiesandwitnessessothatthemembersoftheUniversityHearingBoardmaydeliberateinprivateontheissueofresponsibilityforthechargesatissue.
11. Afterdeliberationsontheissueofresponsibilityarecompleted,theHearingOfficershallmeetseparatelywiththeRespondentandtheComplainanttonotifythemofthedecisionoftheUniversityHearingBoardontheissueofresponsibility.
12. IftheUniversityHearingBoardfindstheRespondentresponsiblefortheallegationsatissue,thehearingwillbereconvenedafternoticetoeachparty. TheComplainantwillthenhaveanopportunitytomakeanimpactstatementtotheUniversityHearingBoardregardingtheissueofsanctionsandtheimpactoftheconductontheComplainant.Followingthatstatement,theRespondentwillhaveanopportunitytomakeanimpactstatementtotheUniversityHearingBoardregardingtheissueofsanctionsandtheimpactoftheconductontheRespondent.
13. TheHearingOfficerwillexcusebothpartiessothatthemembersoftheUniversityHearingBoard maydeliberateinprivateontheissueofsanctions.
14. Afterdeliberationsontheissueofsanctionsarecompleted,theHearingOfficershallmeetwiththeRespondenttonotifytheRespondentofthesanctionsimposedbytheUniversityHearingBoardandtheeffectivedateofsuchsanctions.TheHearingOfficerwillthenmeetwiththeComplainanttonotifythemofthesanctionsimposedupontheRespondentthatrelatedirectlyto theComplainantandtheeffectivedateofsuchsanctions.
15. TheHearingOfficerwillalsoprovideinformationtobothpartiesabouttheremediesthatwillbeprovided(ifany)theComplainantdesignedtorestoreorpreserveequalaccesstotheUniversity’seducationalprogramoractivity.
16. TheHearingOfficerwillalsoprovideinformationrelatedtowrittennotification ofthedecisionandtheprocedureandbasesforappeal.

TheRespondent’sandComplainant’sadvisorshallhavetheopportunitytocrossexamineawitness.Ifawitnessdoesnotsubmittocrossexamination,theUniversityHearingBoardcannotrelyonanystatementofthatwitnessinmakingadeterminationnorcantheHearingBoarddrawanyinferenceaboutthedeterminationofresponsibilitybasedsolelyfromthewitness’sabsence.Theadvisorcannotyell,berateortalkovertheparty/witnesswhenprovidingcross-examination.
7. MembersoftheUniversityHearingBoardshallhaveafinalopportunitytoaskquestionsofthewitnesses.
H. DeliberationoftheUniversityHearingBoard.1. ThemembersoftheUniversityHearingBoardshalldeliberateinprivateandreacha
decisionbasedonlyupontheevidenceintroducedatthehearing.TheHearingOfficerispresentduringthedeliberation,butdoesnothaveavote.
2. ThemembersofUniversityHearingBoardshallnotmakeanyfindingoffactthatisnotsupportedbytheevidencepresentedatthehearing.
3. IftwoormoreUniversityHearingBoardmembersfindtheRespondentresponsiblefortheallegedconduct,thestudentis“responsible”forthatconduct.
4. IftheRespondentisfoundresponsible,therecommendedsanctionshallbechosengenerally fromthoselistedinAppendixA,Section3oftheStandardsofStudentConduct.
Section3:Sanctions
A. ListofPossibleSanctions.RespondentsfoundresponsibleforviolatingthePolicyProhibitingSexualMisconductwillbesanctioned.Sanctionsincludebutarenotlimitedtothefollowing:
1. UniversityHousingProbation.Actionpermittingthestudenttoremaininresidenceonprobationary status.Duringtheperiodofprobation,ifthestudentisfoundresponsibleforadditionalviolations, thestudentmaybeevictedfromUniversityhousing.
2. ConductProbation.ActionpermittingthestudenttoremainattheUniversityonprobationarystatusandsubjecttocertaintermsandconditionsasoutlinedbytheUniversityHearingBoard.Duringtheperiodofprobation,ifthestudentisfoundresponsibleforfurtherviolations,thestudentmaybesubjecttosuspension,dismissal,orseparationfromtheUniversity.Studentsareprohibitedfromstudyingabroadinanysemesterforwhichtheyareonconductprobationforallorpartofthe semester.
3. HousingRelocation.RelocationfromoneUniversityhousingareatoanother.4. HousingEviction.RemovalfromUniversityhousing.5. NoTrespassOrder.Anorderbanningastudentfromspecificbuildings,portionsofthe
campus,or fromtheentirecampusoroff-campusbuildingsorproperty.6. RevocationofPrivilege.Therevocationofaprivilegeincluding,butnotlimitedto,registered
events,usingUniversitydining facilities,havinganautomobileoncampus,and/oraccesstootherUniversityfacilities.
7. Suspension.Aforced,temporaryleavefromtheUniversity.Thetimeperiodofasuspensionistypicallyasemesterorafullacademicyear,butcanbesetforanydurationbytheUniversityHearingBoard.
8. Separation.ImmediateandpermanentseparationfromtheUniversity.Astudentwhoisseparated fromtheUniversityisnoteligibleforreadmission,andistypicallybarredfromUniversityevents,activities,andproperty.
B. MultipleSanctions.Morethanoneofthesanctionslistedabovemaybeimposedforanysingleviolation.

Section4:Appeal
A. RighttoAppeal.TheRespondentandComplainanthavetherighttoappealthedecisionoftheUniversityHearingBoardtotheAppellateAdministrator.
B. TimeforFilingAppeal.AnappealmustbereceivedbythedesignatedAppellateAdministratorinwriting(adocumentasanemailattachmentisacceptable)by5:00PMonthefifthbusinessdayafterdeliveryofthewrittennotificationofthefindingoftheHearingBoard.TheHearingOfficermayextendthetimeframeforsubmittinganappeal,attheirsolediscretion,forgoodcauseuponwrittennoticetotheRespondent,andtheComplainant(whereappropriate)settingforththereasonfortheextension.
C. AccesstoHearingRecord.Thepartyfilingtheappealshallbeprovidedwithreasonableaccesstothehearingrecordinthehearingfromwhichtheappealistaken.
D. TimeforDecidingAppeal.Thedecisiononarequestforanappealshallbemadewithinthirty(30)daysofthereceiptoftheappeal,unlessthereisgoodcauseforareasonableextensionofthistimeperiod.Ifanextensionisdeemedappropriate,theAppellateAdministratorshallprovidewrittennoticetotheRespondent,andComplainant,settingforththereasonfortheextension.
E. BoththeComplainantandtheRespondentwillbeprovidedareasonableandequalopportunitytosubmitawrittenstatementinsupportoforchallengingtheHearingBoardoutcome.
F. AppealReviewBoard1. TheAppellateAdministratorshallconveneaReviewBoardcomprisedoftwomembersof
theUniversityHearingBoardwhowerenotinvolvedintheoriginalhearing.TheAppellateAdministratorshallbealsobeavotingmemberoftheReviewBoard.
2. TheAppellateAdministratorshallnotifytheotherpartyComplainantinwritingthatanappealhasbeenfiled.
3. TheReviewBoarddoesnotholdanewhearing.ThedecisionoftheReviewBoardshallbemadebymajorityvote.
4. IftheReviewBoardfindsgroundstograntanappeal,theReviewBoardshalldeterminearemedyasprescribedinArticleVIII(G)oftheStandardsofStudentConduct.
G. GroundsforAppeal.AnappealshallbegrantedtothepersonfilingiftheAppellateAdministratororReviewBoardsfinds,byclearandconvincingevidence,thatoneormoreofthefollowingoccurred:
1. Proceduralirregularitythataffectedtheoutcomeofthematter;2. Newevidencethatwasnotreasonablyavailableatthetimeofthedeterminationregarding
responsibilitywasmadethatcouldaffecttheoutcomeofthematter;3. TheTitleIXCoordinator,investigator(s),orHearingBoardmember(s)hadaconflictof
interestorbiasfororagainstcomplainantsorrespondentsgenerallyortheindividualRespondentorComplainantaffectedbytheoutcome.
H. NoticeofAppealOutcome.Uponreachingadecisiononarequestforanappeal,theAppellateAdministratorshallprovidewrittennotificationoftheirdecisiontotheRespondentandtheComplainantsimultaneously.Thewrittennotificationoftheappealdecisionshouldinclude:
1. Thegroundsforrequestforappealasoutlinedabove;2. AdescriptionofthepertinentpointstheAppellateAdministratororReviewBoard
