PURPOSE:

The applicant is requesting a site specific text amendment to the Zoning Bylaw’s C4l: Local Commercial zone to

permit a Major Liquor Primary Establishment use on the subject property. In addition, an amendment to the Official

Community Plan is proposed to support the continued use of commercially zoned properties across the City. The

intent of these applications is to facilitate an increase to Shooters Sports Bar’s maximum occupant load, from 125

to 175 people.

RECOMMENDATIONS:

1. THAT Council RECEIVE Application No. CP100084 to amend City of Prince George Official Community

Plan Bylaw No. 8383, 2011 by:

a) REMOVING Section 8.3.55 Neighbourhood Corridor Policy and ADDING Section 8.3.10 a. Future

Land Use General Policy, attached as Appendix “A” to Bylaw No. 8503.

2. THAT Council GIVE FIRST READING to the City of Prince George Official Community Plan Bylaw No. 8383,

2011, Amendment Bylaw No. 8503, 2013;

3. THAT Council CONSIDER the City of Prince George Official Community Plan Bylaw No. 8383, 2011

Amendment Bylaw No. 8503, 2013 in conjunction with the City of Prince George 2012-2016 Provisional

Financial Plan and confirm there are no issues;

4. THAT Council CONSIDER the City of Prince George Official Community Plan Bylaw No. 8383, 2011

Amendment Bylaw No. 8503, 2013 in conjunction with the Regional District of Fraser Fort-George Solid

Waste Management Plan and confirm there are no issues;

5. THAT Council CONSIDER the City of Prince George Official Community Plan Bylaw No. 8383, 2011

Amendment Bylaw No. 8503, 2013 in conjunction with the City of Prince George Strategic Framework

and confirm there are no issues;

6. THAT Council GIVE SECOND READING to the City of Prince George Official Community Plan Bylaw No.

7. THAT Council APPROVE the public consultation process to fulfill the requirements of Section 879 of the

Local Government Act as outlined in the attached Official Community Plan Amendment Consultation

Checklist, which includes one Citywide Newspaper advertisement requesting written comment.

8. THAT Council RECEIVE Application No. RZ100415 to amend City of Prince George Zoning Bylaw 7850,

2007 by:

a) Adding to Section 11.4.2, “Liquor Primary Establishment, Major only on Strata Lot 1, District Lot

2508, Cariboo District, Plan PGS353”, as shown on Appendix “A” to Bylaw No. 8464; and,

9. THAT should these applications be supported, Final Reading be withheld until the following requirements

have been met to the satisfaction of the Director of Planning and Development:

a. Registration of a Section 219 Covenant on legal title of the subject property that limits a Liquor

Primary Establishment, Major to a maximum occupant load of 175; and,

b. Security in the form of a certified cheque or letter of credit in the amount of 120% of the quote

to complete the landscaping works, as shown on Exhibit “A”.

Liquor Licence Amendment Application No. LL100110

The Liquor Licensing and Control Board (LCLB) is the authority for liquor licensing and must approve all

amendments to liquor licences. The applicant has applied with the LCLB to increase the maximum occupant load of

Shooter Sports Pub from 125 to 175 people. The LCLB requires a resolution passed by Council to support the

proposed amendment to the Liquor Licence. Historically, the LCLB has not issued or amended liquor licences

contrary to the support of Council. The Public Hearing for the Liquor Licence Amendment Application seeking Council

Resolution, and the proposed OCP and Zoning Bylaw amendments considered in this report, would be held at the

same Council meeting.

POLICY / REGULATORY ANALYSIS:

The intent of this application is to facilitate an increase to the maximum occupant load of Shooters Sports Pub from

125 to 175 people. This application does not facilitate any changes to the maximum occupant load of 20 people on

the outdoor patio, nor does it facilitate any changes to the existing hours of service: 10:00 a.m. to 2:00 a.m.,

Monday to Thursday, and 11:00 a.m. to 2:00 a.m., Friday to Sunday.

The current occupant load of 125 people includes all patrons, staff, and entertainers. For example, if 30 staff and

entertainers are working and 20 patrons are on the patio, the maximum number of patrons inside is 75. The

rationale for the proposed occupant load increase to 175 people is based on the sum of 125 inside patrons with 20

patio patrons and 30 staff and entertainers. The increased occupant load recognizes two characteristics of Shooters

Sports Bar. First, there is often high staffing levels that include servers, security personnel, and live music

ensembles. Second, there is varied demand for the patio seating, from day to evening and from summer to winter.

Increasing the maximum occupant load to 175 people allows for greater flexibility in serving patrons when additional

staff or entertainers are working, or when the patio is busy.

Official Community Plan (OCP) Bylaw No. 8383, 2011

The subject property is designated as Light Industrial on Schedule B-6: Future Land Use of the Official Community

Plan. However, the OCP has policy direction to support the continued use of properties zoned for commercial use.

Policy 8.3.55, currently under the Neighbourhood Corridor Section, states that “The City shall permit continued

commercial use of properties whose current zoning as of the adoption of this Bylaw is commercial.” The

Department recommends that Policy 8.3.55 be moved from the Neighbourhood Corridor Section to the Future Land

Use General Section to support businesses with preexisting commercial zoning across the City, versus just in

Neighbourhood Corridors. In the case of this application, the zoning of the subject property is C4l: Local Commercial

and Shooters Sports Pub has operated at this location since 2008.

The proposed OCP amendment facilitates the continued commercial use of Shooters Sports Bar. With higher staffing

levels and live music, the establishment is challenged to serve more than 100 patrons at one time. Increasing the

total occupant load from 125 to 175 people would allow for a more flexible variation in staffing and entertainment,

without limiting patron numbers. Shooters Sports Bar is still intended to operate as a neighbourhood pub, providing

an alternative to the much larger night clubs downtown. Therefore, the proposed increase in occupant load remains

consistent with Policy 8.3.18 to maintain downtown as the primary entertainment centre of the city.

Zoning Bylaw No. 7850, 2007

The subject property is zoned as C4l: Local Commercial in the Zoning Bylaw. The purpose of the C4l zone is to

provide for local commercial areas, including Minor Liquor Primary Establishments as defined below:

a place or premises, licenced under the Liquor Control and Licensing Act, where liquor is served for

consumption on site, with a maximum indoor occupant load of 125 persons, and may include accessory

adult-oriented entertainment only in C1l, spectator entertainment, patron participation entertainment, minor

arcade and liquor off-sales.

To permit an indoor occupant load of 175 people, the applicant is requesting to amend the C4l zone to allow for a

Major Liquor Primary Establishment. The difference between major and minor liquor establishments is that the

former does not restrict the maximum indoor occupant load.

An increase to the maximum occupant load to 175 people would not require additional parking on the subject

property. The total of 64 on-site parking stalls meets the collective zoning requirements for the two commercial

buildings on-site: Shooters Sports Pub with attached vacant commercial space and Domino’s Pizza. Landscaping is

proposed along the Ospika Boulevard frontage to screen the parking area and to beautify the site (See Exhibit “A”).

Prior to Final Reading of these applications, the applicant has agreed to provide security in the form of a certified

cheque or letter of credit in the amount of 120% of the quote to complete the landscaping works (see Exhibit “A”).

The Department supports the OCP and Zoning Bylaw amendment applications to facilitate an occupant load

increase from 125 to 175 people at Shooters Sports Pub with a maximum of 20 people on the patio at one time.

The proposed occupant load allows a more flexible variation in the numbers of staff, entertainment, and patron

seating. To ensure that an occupant load higher than 175 people is not pursued, the applicant has agreed to

register a restrictive covenant on the subject property that limits a place where liquor is served to a maximum

occupant load of 175 people.

OTHER CONSIDERATIONS:

Land Use Impacts

Council adopted the City of Prince George Liquor Licence Policy in 2004 to help guide the review of liquor licence

applications. The Liquor Licence Policy suggests a maximum occupant load of 125 people for liquor primary licences

outside of the Central Business District. Council may increase or decrease the suggested occupant loads on a case

specific basis in consideration of community impact criteria. The criteria include location, traffic, noise, and the

anticipated community impacts if the application were approved.

Shooters Sports Bar is located between 18th and 22nd Avenue along Ospika Boulevard. The property is surrounded

by light industrial and utility uses to the north, south, and east, and a major civic destination in the CN Centre and

Exhibition Grounds to the west. Being at such a significant distance from nearby residential neighbourhoods, the

Department believes the community impact of the proposed occupant load is minimal, particularly noise and

nuisance impacts. Further, the Department recognizes that the location of Shooters Sports Pub offers an attractive

and accessible form of entertainment for users and patrons of the CN Centre and Exhibition Grounds, while still

maintaining the character of a neighbourhood pub.

With respect to traffic and parking, the applicant undertook a traffic study to ensure there is adequate parking

provided on-site (see Exhibit “B”). The parking study was conducted from 7 p.m. to 1 a.m. during a Friday evening,

two Saturday evenings, two weekday nights, and one evening when a major concert was held at CN Centre. Data

was collected on the number of parked vehicles, and the destination of people parking on the subject property and

along Ospika Boulevard. The study found that “at the absolute peak time, on the busiest evening, a maximum 45 of

64 parking spaces was utilized. The combined parking lot always had available parking spaces, and there was

never any requirement for patrons to park on Ospika Boulevard” (see page 4; Exhibit “B”). The study further states

that Shooters Sports Pub supports the City’s existing parking ban along this section of Ospika Boulevard.

Referrals

Bylaw Services has no concerns with the proposed occupant load increase given the lack of noise or operational

complaints for Shooters Sports Bar, and the significant distance of the establishment from residential

neighbourhoods.

Fire Services commented that the increase in occupant load requires the review and approval of the building’s fire

alarm system, building exits, occupant load sign, table layout, and update to the Fire Safety Plan, to comply with the

BC Building and Fire Codes.

The RCMP expressed concern that an increase in occupancy would increase on-street parking along Ospika

Boulevard. The concern is specific to the drivers and passengers that exit Shooters Sports Pub at closing time and

cross onto the street to access their vehicles. In response to this concern, the applicant undertook a traffic study

described above to demonstrate there is sufficient parking provided on the subject property (see Exhibit “B”).

Consultation

When an OCP amendment is proposed, the City of Prince George is required to consult the public in accordance with

Section 879 of the Local Government Act. Should Council pass 1st and 2nd Reading of Bylaw No. 8503, the public

consultation process would include one citywide newspaper advertisement requesting written comment prior to the

Public Hearing, and 3rd Reading (see attached Official Community Plan Amendment Consultation Checklist).

The Public Hearing is advertised by two consecutive citywide newspaper advertisements, and through a delivered

notice to adjacent land owners within 30 metres of the subject property.

ALTERNATIVES:

1. Approve the application

2. Approve the application as amended

3. Reject or refuse the application

4. Defer or otherwise deal with the application

The Department recommends that Council approve the proposed applications, and that Final Reading be withheld

until the following has been met:

Registration of a Section 219 Covenant on legal title of the subject property that limits a Liquor Primary

Establishment, Major to a maximum occupant load of 175; and,

Security in the form of a certified cheque or letter of credit in the amount of 120% of the quote to complete

the landscaping works, as shown on Exhibit “A”.

SUMMARY AND CONCLUSION:

The applicant is requesting a site specific text amendment to the Zoning Bylaw’s C4l: Local Commercial zone to

permit a Major Liquor Primary Establishment use on the subject property. The applicant has agreed to register a

Restrictive Covenant to the title of the subject property that limits the maximum occupant load of the Liquor Primary

Establishment to 175 people. In addition, an amendment to the Official Community Plan is proposed to support the

continued use of commercially zoned properties across the City.

The Department supports the Official Community Plan and Zoning Bylaw amendment applications based on the

policy and regulatory analysis outlined in this report.

City Response Letter Dated October 4t\ 2012

The City of Prince George response to the Rezoning Application was provided in their letter of October 4th, 2012. The City indicated the "there is a frequent demand for on-street parking along Ospika Boulevard". In reviewing this concern with the City of Prince George it was suggested that there was not a parking issue on Ospika Boulevard. It was further noted that the parking concern may be more of a perception than reality. It was also noted that any parking on Ospika Boulevard was most likely caused by customers of Domino's Pizza and by patrons of the CN Centre. Accordingly, a Parking/ Destination survey was designed and implemented to determine:

a) Is there a frequent demand for on-street parking along Ospika Boulevard?

b) Which patrons from which establishments are parking in Ospika Boulevard?

c) Is there available on-site parking at all times at Shooters Bar and Grill?

d) What is the impact of Domino's on the parking situation, including the impact of pizza delivery personnel, pizza pickup parking and pizza employee parking?

Fully two thirds of the parking activity within the combined Shooters / Domino's parking lot is

attributable to the staff, patrons and delivery vehicles associated with Domino's Pizza.

The combined Shooters/Domino's parking lot was never at capacity. On the very busiest evenings,

the parking lot, on average, was only 59% full. At the absolute peak time, on the busiest evening, a

maximum 45 of the 64 parking spaces was utilized. The combined parking lot always had available

parking spaces, and there was never any requirement for patrons to park on Ospika Boulevard.

Conclusions and Recommendations

1. There is not an on-street parking problem on Ospika Boulevard.

2. On-street parking on the east curb of Ospika Boulevard is prohibited in the immediate

vicinity of Shooters and Domino's.

3. The existing "No Parking" sign age is old and faded, and it is not clear that parking on Ospika

Boulevard is prohibited in the vicinity of Shooters and Domino's .

4. At all times during the parking survey the combined Shooters/Domino's parking lot was

never full. There were always available onsite parking spaces, and there is no requirement

for parking on Ospika Boulevard.

5. The Domino's patrons, staff and pizza delivery vehicles utilize the combined parking lot

much more frequently than the patrons and staff of Shooters. Domino's staff, patrons and

delivery vehicles used the combined parking facilities twice as much as the Shooters staff

and patrons. The precise parking utilization was 62% utilization by Domino's and 38%

utilization by Shooters. However, it should be noted that the duration of parking by

Shooters customers was significantly longer. In summary, the impact of the Domino's

franchise parking activity has a significant impact upon the functionality of the combined

parking lot.

6. Shooters would support a complete parking ban on the east side of Ospika Boulevard

between the Ministry of Forests building and 18t h Avenue.

7. Shooters would be amenable to the paving of the existing staff parking area on the adjacent

property.
