(Greenfield Avenue curb and sidewalk improvements - special assessment) BE IT ORDAINED BY THE COMMON COUNCIL OF THE CITY OF SUMMIT, IN THE COUNTY OF UNION, NEW JERSEY (not less than two thirds of all the members thereof aftirmativety con- curring), AS FOLLOWS: Section 1, The improvement described in Section 3 of this bond ordinance is hereby authorized as a local improvement to be made or acquired by The City of Summit, New Jersey. For the said improvement or purpose stated in said Section 3, there is hereby appropriated the sum of $53,000, said sum being inclusive of all appropriations heretofore made therefor and including the sum of 33,000 as the down payment for said improvement or purpose required by law and now available therefor by virtue of provision in a previously adopted budget or budgets of the City for down payment or for capital improvement purposes. Section 2. For the financing of said improvement or purpose and to meet tile part of said $53,000 appropriation not provided for by application hereun- der of said down payment, negotiable bonds of the City are hereby author- ized to be issued in the principal amount of $50,000 pursuant to the Local Bond Law of New Jersey. In anticipation of the issuance of said bonds and to temporarily finance said improvement or purpose, negotiable notes of (lie City in a principal amount not exceeding $50,000 are hereby authorized to be issued pursuant to and within the limitations prescribed by said Local Bond Law. Section 3. (a) The improvement hereby authorized and purpose for Jhe linancing of which said obligations are to be issued is the improvement of a f iortion of Greenfield Avenue in and by he City, by the construction or recon- struction therein of granite block curbs and concrete sidewalks adjacent to those lands designated on the official tax map of the City as Lots 1 and 50 to 81 in Block 401, including all storm water drainage facilities, structures, appurtenances, equipment, site work, work and materials necessary therefor or incidental thereto, all as shown on and In accordance with the plans and specifications therefor on file or to be filed in trie office of the City Engineer and hereby approved (b) The estimated maximum amount of bonds or notes to be issued for said purpose is $50,000. (c) The estimated cost of said pur- pose is $53,000, the excess thereof over the said estimated maximum amount of bonds or notes to be issued therefor being the amount of the said $3,000 down payment for said pur- pose. Section 4. The following additional matters are hereby determined, declared, recited and stated: (a) The said purpose described in Section 3 of this bond ordinance is not a current expense and is a property or improvement which the City may law- fully acquire or make as a local improvement. (b) The period of usefulness of said purpose within the limitations of said Local Bond Law, according to the rea- sonable life thereof computed from the date of the said bonds authorized by this bond ordinance, is ten (10) years (c) The supplemental debt statement required by said Local Bond Law has been duly made and filed in the office of the Cily Clerk and a complete exe- cuted duplicate thereof has been filed in (.he office of the Director of the Divi- sion of Local Government Services in the Department of Community Affairs of the State of New Jersey, and such statement shows that the gross debt of the City as defined in said Local Bond Law is increased by the authorization of the bonds and notes provided for in this bond ordinance by $50,000, and the said obligations authorized by this bond ordinance wiil be within all debt limitations prescribed by said Local Bond Law. (d) An aggregate amount not exceeding $7,000 for interest on said obligations, costs of issuing said obli- gations and other items of expense listed in and permitted under section 40/V2-20 of said Local Bond Law may be included as part of the cost of said improvement and is inciuded in the foregoing estimate thereof. (e) Nothing will be contributed by the City at large to payment of the cost of said improvement or purpose, and the estimated maximum amount of the special assessments to be levied on property specially benefited by said improvement is $53,000, and the num- ber of annual installments in which all such special assessments may be paid is ten (10). i 5 is ten ( ) . Section 5, The cost of said local improvement shall be paid by special assessments which shall be levied in accordance with law on property spe- cially benefited thereby, as nearly as may be in proportion to and not in excess of the peculiar benefit, advan- tage or increase in value which the respective lots and parcels of real estate shall be deemed to receive by reason of said local improvement. The owner of any land upon which any such assessment shall have been made may pay such assessment in the number of equal annual installments hereinaboye determined, all as may be provided in accordance with law and with legal interest on the unpaid bal- ance of the assessment. Section 6. All bond anticipation notes issued hereunder shall mature at such times as may be determined by the Chief Financial Officer, provided that no note shall mature later than one year from its date. The notes shall bear interest at such rate or rates and be in such form as may be determined by the Chief Financial Offi- cer. The Chief Financial Officer shall determine all matters in connection with the notes issued pursuant to this bond ordinance, and the Chief Finan- cial Officer's signature upon the notes shall be conclusive evidence as to all such determinations. All notes issued hereunder may be renewed from time to time subject to the provisions of N.J.S.A. §40A:2-8. The Chief Finan- cial Officer is hereby authorized to sell part or all of the notes from time to time at public or private sale and to deliver them to the purchasers thereof upon receipt of payment of the pur- chase price plus accrued interest from their dates to the dates of delivery thereof. The Chief Financial Officer is directed to report in writing to the gov- erning body of the City at the meeting next succeeding the date when any sale or delivery of the notes pursuant to this bond ordinance is made. Such report must include the principal amount, interest rate and maturities of the notes sold, the price obtained and the name of the purchaser Section 7. The full faith and credit of the City are hereby pledged to the punctual payment of the principal of and interest on the said obligations authorized by this bond ordinance Said obligations shall be direct, unlim- ited obligations of the City, and the City shall be obligated to levy ad val- orem taxes upon all the taxable prop- erty within the City for the payment of said obligations and interest thereon without limitation of rate or amount. Section 8. The capital budget or temporary capital budget of the City is hereby amended to conform with the provisions of this ordinance to the extent of any inconsistency herewith and the resolutions promulgated by the Local Finance Board showing all detail of the amended capital budget or temporary capital budget and capi- tal program as approved by the Direc- tor, Division of Local Government Ser- vices, are on file with the City Clerk and are available for public inspection. Section 9. This bond ordinance shall lake effect twenty (20) days after the first publication thereof after final (adoption, as provided by said Local Bond Law. BE IT ORDAINED BY THE COMMONCOUNCIL OF THE CITY OF SUMMIT,IN THE COUNTY OF UNION, NEWJERSEY (not less than two thirds of allthe members thereof aftirmativety con-curring), AS FOLLOWS:

Section 1, The improvementdescribed in Section 3 of this bondordinance is hereby authorized as alocal improvement to be made oracquired by The City of Summit, NewJersey. For the said improvement orpurpose stated in said Section 3, thereis hereby appropriated the sum of$53,000, said sum being inclusive ofall appropriations heretofore madetherefor and including the sum of33,000 as the down payment for saidimprovement or purpose required bylaw and now available therefor byvirtue of provision in a previouslyadopted budget or budgets of the Cityfor down payment or for capitalimprovement purposes.

Section 2. For the financing of saidimprovement or purpose and to meettile part of said $53,000 appropriationnot provided for by application hereun-der of said down payment, negotiablebonds of the City are hereby author-ized to be issued in the principalamount of $50,000 pursuant to theLocal Bond Law of New Jersey. Inanticipation of the issuance of saidbonds and to temporarily finance saidimprovement or purpose, negotiablenotes of (lie City in a principal amountnot exceeding $50,000 are herebyauthorized to be issued pursuant toand within the limitations prescribedby said Local Bond Law.

Section 3. (a) The improvementhereby authorized and purpose for Jhelinancing of which said obligations areto be issued is the improvement of a

fiortion of Greenfield Avenue in and byhe City, by the construction or recon-

struction therein of granite block curbsand concrete sidewalks adjacent tothose lands designated on the officialtax map of the City as Lots 1 and 50 to81 in Block 401, including all stormwater drainage facilities, structures,appurtenances, equipment, site work,work and materials necessary thereforor incidental thereto, all as shown onand In accordance with the plans andspecifications therefor on file or to befiled in trie office of the City Engineerand hereby approved

(b) The estimated maximum amountof bonds or notes to be issued for saidpurpose is $50,000.

(c) The estimated cost of said pur-pose is $53,000, the excess thereofover the said estimated maximumamount of bonds or notes to be issuedtherefor being the amount of the said$3,000 down payment for said pur-pose.

Section 4. The following additionalmatters are hereby determined,declared, recited and stated:

(a) The said purpose described inSection 3 of this bond ordinance is nota current expense and is a property orimprovement which the City may law-fully acquire or make as a localimprovement.

(b) The period of usefulness of saidpurpose within the limitations of saidLocal Bond Law, according to the rea-sonable life thereof computed from thedate of the said bonds authorized bythis bond ordinance, is ten (10) years

(c) The supplemental debt statementrequired by said Local Bond Law hasbeen duly made and filed in the officeof the Cily Clerk and a complete exe-cuted duplicate thereof has been filedin (.he office of the Director of the Divi-sion of Local Government Services inthe Department of Community Affairsof the State of New Jersey, and suchstatement shows that the gross debt ofthe City as defined in said Local BondLaw is increased by the authorizationof the bonds and notes provided for inthis bond ordinance by $50,000, andthe said obligations authorized by thisbond ordinance wiil be within all debtlimitations prescribed by said LocalBond Law.

(d) An aggregate amount notexceeding $7,000 for interest on saidobligations, costs of issuing said obli-gations and other items of expenselisted in and permitted under section40/V2-20 of said Local Bond Law maybe included as part of the cost of saidimprovement and is inciuded in theforegoing estimate thereof.

(e) Nothing will be contributed bythe City at large to payment of the costof said improvement or purpose, andthe estimated maximum amount of thespecial assessments to be levied onproperty specially benefited by saidimprovement is $53,000, and the num-ber of annual installments in which allsuch special assessments may be paidis ten (10).

Section 5, The cost of said local

improvement shall be paid by specialassessments which shall be levied inaccordance with law on property spe-cially benefited thereby, as nearly asmay be in proportion to and not inexcess of the peculiar benefit, advan-tage or increase in value which therespective lots and parcels of realestate shall be deemed to receive byreason of said local improvement. Theowner of any land upon which anysuch assessment shall have beenmade may pay such assessment in thenumber of equal annual installmentshereinaboye determined, all as may beprovided in accordance with law andwith legal interest on the unpaid bal-ance of the assessment.

Section 6. All bond anticipationnotes issued hereunder shall matureat such times as may be determined bythe Chief Financial Officer, providedthat no note shall mature later thanone year from its date. The notesshall bear interest at such rate orrates and be in such form as may bedetermined by the Chief Financial Offi-cer. The Chief Financial Officer shalldetermine all matters in connectionwith the notes issued pursuant to thisbond ordinance, and the Chief Finan-cial Officer's signature upon the notesshall be conclusive evidence as to allsuch determinations. All notes issuedhereunder may be renewed from timeto time subject to the provisions ofN.J.S.A. §40A:2-8. The Chief Finan-cial Officer is hereby authorized to sellpart or all of the notes from time totime at public or private sale and todeliver them to the purchasers thereofupon receipt of payment of the pur-chase price plus accrued interest fromtheir dates to the dates of deliverythereof. The Chief Financial Officer isdirected to report in writing to the gov-erning body of the City at the meetingnext succeeding the date when anysale or delivery of the notes pursuantto this bond ordinance is made. Suchreport must include the principalamount, interest rate and maturities ofthe notes sold, the price obtained andthe name of the purchaser

Section 7. The full faith and credit ofthe City are hereby pledged to thepunctual payment of the principal ofand interest on the said obligationsauthorized by this bond ordinanceSaid obligations shall be direct, unlim-ited obligations of the City, and theCity shall be obligated to levy ad val-orem taxes upon all the taxable prop-erty within the City for the payment ofsaid obligations and interest thereonwithout limitation of rate or amount.

Section 8. The capital budget ortemporary capital budget of the City ishereby amended to conform with theprovisions of this ordinance to theextent of any inconsistency herewithand the resolutions promulgated bythe Local Finance Board showing alldetail of the amended capital budgetor temporary capital budget and capi-tal program as approved by the Direc-tor, Division of Local Government Ser-vices, are on file with the City Clerkand are available for public inspection.

Section 9. This bond ordinance shalllake effect twenty (20) days after thefirst publication thereof after final(adoption, as provided by said LocalBond Law.
