We must lay a proper foundation for the structure.

We need to know enough about what our ancestors did wrong in order that we will not repeat their mistakes.

GRABLE, was fired on May 25, 1953 at the Nevada Test Site. A 280mm artillery gun fired the 15 kiloton nuclear shell.

This was the only time a nuclear artillery shell was ever fired.

The definition of “Contract” (noun) and a thorough analysis of the process and effects of contracting.

The Articles of Incorporation Instrument for your Corporation Sole instrument is a solemn contract.

Agreement, Understanding, Covenant, PactObligation, Compact, TreatyWhen you see any of those words in a statute,

you know that the legislature has just offered you a contract

MUST YOU ACCEPT THEIR OFFER?

Social Security Number

Most people believe that the SSN is required by law and that there is no way that one may function in society without the SSN.

When we prove our point with the most difficult example, the rest is all down hill!

United States ConstitutionArticle 1, Section 10, clause 1

No State shall ... pass any Bill of Attainder, ex post facto Law, or Law impairing the Obligation

of Contracts, or grant any Title of Nobility.

Law of Contracts

Page 5: SS Power Point- Bernie

When a law cannot impair a contract, which one is more powerful?

If contract law is so important, why doesn’t the Bible talk about it?We will investigate a wide variety of contracts. Sufficient to give a basis for dealing with many hidden forms of government control.

Jesus, said, “But let your ‘Yes’ be ‘Yes’ and your ‘No’, ‘No.’ For whatever is more than these is from the evil one.” - Matthew 5:37James, one brother of Jesus, wrote, “Let your ‘Yes’ be ‘Yes’ and your ‘No’ be ‘No’.” - James 5:12Any offer that can be accepted or rejected is an offer of a contract. Our obligation is to keep our word, even with a tax collector!Do you agree or disagree? (This is a contract offer!)

The Bible on Contracts

Page 7: SS Power Point- Bernie

An enforceable agreement. It depends for its validity on six conditions:

1. Mutual assent - offer and acceptance2. Legal consideration3. Legal capacity for contracting4. Absence of fraud or duress5. Not in violation of common [God’s] law6. Must be realistic and attainable

There are additional points for consideration.

Contract

U.C.C. 1-203

Every contract or duty within this Act

imposes an obligation of good faith in its

performance or enforcement.

Obligation of Good Faith

Page 9: SS Power Point- Bernie

Unilateral Alteration

Once a contract is signed, any material, adverse unilateral alteration of the contract may result in cancellation of the contract.

Page 10: SS Power Point- Bernie

Courts enforce Contracts

You cannot depend upon the Private, Contract Courts to protect what you think are your rights, as long as you have signed contracts that supersede those “rights.”

Does this make sense?

Page 11: SS Power Point- Bernie

Presumption of Signature

The courts are enforcing the SS-5 contract as if it were legal, because of the presumption that

“Any sane person understands and concurs with the content of any instrument bearing his voluntary signature.”

Page 12: SS Power Point- Bernie

1 – Mutual Assent

Requires a meeting of the minds

There can be no meeting of the minds unless the matter has been discussed, therefore, full disclosure of all terms and conditions is an absolute requirement for this condition.

This is why contracts are called “agreements”

Page 13: SS Power Point- Bernie

1 – Mutual Assent Continued

The Social Security Contract is about 1200 pages long. I don’t know of any bureaucrat that has read it and understands it. When the bureaucrat does not understand the contract, there can be no meeting of the minds.

Further, the full contract was not offered for perusal before signing the SS-5. There is a court case that says words to the effect that in a contract, “parties cannot agree to agree” upon terms that are not disclosed or discussed. This would be a form of collusion.

Are there grounds, here, for rescinding the social security contract?

Page 14: SS Power Point- Bernie

2 – Legal Consideration

Twenty one SILVER OR GOLD dollars

This gives Seventh Amendment protection

Use FeRNs or Plastic for:Consumables like food, paper, ink, gasoline, or propane

Use lawful money for:durable goods like sporting equipment, autos, land, computers, printers, or tools

Page 15: SS Power Point- Bernie

3- Legal Capacity

Capacity – Legal qualification, competency, power or fitnessOther, related topics and words include:Competency, physical disability, legal disability, mental capacity, person under disabilityA ‘person’ cannot sign a binding contract until they reach the age of majority, 21 by common law or law for common man. Under statutory construction 18 years.

How did Jim Carrey win his case in “Liar, Liar”?Are there grounds for rescission?

Page 16: SS Power Point- Bernie

4 – Absence of fraud

Unconscionable contract. One which no sensible man not under delusion, duress, or in distress would make, and such as no honest and fair man would accept. Franklin Fire Ins. Co. v Noll, 115 Ind. App. 289, 58 N.E.2d 947,949,950 A contract the terms of which are excessively unreasonable, overreaching and one-sided.Do you think that you are paying taxes for police

protection?

Are there grounds for rescission?

Page 17: SS Power Point- Bernie

4 – Absence of fraud Continued

Adhesion contract. Standardized contract form offered to consumers of goods and services on essentially “take it or leave it” basis without affording consumers realistic opportunity to bargain and under such conditions that consumer cannot obtain desired product or services except acquiescing in form contract. Distinctive feature of adhesion contract is that weaker party has no realistic choice as to its terms. Wheeler v. St. Joseph Hospital, Cal.App., 63 Cal.App.3d 345 Standard Oil of Calif. B. Perkins, C.A.Or., 347 F.2d 379, 383. Not every such contract is unconscionable. Lechmere Tire and Sales Co. v. Burwick, 360 Mass. 713, 720, 721 277 N.E.2d 503 (emphasis added)

Are there grounds for rescission?

Page 18: SS Power Point- Bernie

5 – Does not Violate the Common Law

Can’t contract toMurder, steal, damage property, trespass, sell into slavery

Taxes are used forCIA Assassinations“redistribution of 55”Eminent domain“no knock” warrantsJail for not paying tax

Are there grounds for rescission?

Page 19: SS Power Point- Bernie

6 – Must Be Realistic

Legal MaximImpossibillium nulla obligatio est. There is no obligation to do impossible

things. Was the originator of this Maxim thinking of

the national debt?Through “unilateral alteration of contract,”Congress has increased the national debt

until payoff is not realistic or attainable, thus vacating the contract

Are there grounds for rescission?

Page 20: SS Power Point- Bernie

Vacating the Contract

In those six conditions, we have at least eight SOLID, sound, legal grounds for vacating the Social Security contract.

The remedy is in “rescission of contract” and “release of appointment”

Page 21: SS Power Point- Bernie

In Closing

We need to know how they went about getting us to enslave ourselves, so we don’t fall for those tricks again.

WE must understand enough about the nature of the contracts that we will understand how to peacefully rescind them and not reinstate them.
