3. GENERAL

To monitor the compliance with Company instructions as evidence of respect of the regulations in force, the Company has issued a “WORKING AND RESTING HOURS RECORD BOOK” to be used for Italian Flag vessels only.

In order to provide an additional instrument to the Company vessel commands, Crew Policy Manager and Manning Managers aimed at checking the proper implementation of “ ILO CONV, STCW, OPA 90” and to enable early detection of any possible non-conformance situations, the “Watchkeeper” software has been installed on all Company ships . The evidence of respect of regulations will be provided for non Italian Flag ships only, by using the print out the dedicated pages of the software program .

4. ACTION

4.1 Working and Resting Hours Record Book (Registro dell’orario di lavoro - D.Lgs. 108/2005 for Italian Flag vessel)

This is a register containing a fixed numbered original sheets and equal number of copies. Each sheet is to be monthly filled for each individual crewmember, by the delegated officers. This book records the hours of rest or the hours of work on board for every crew member, Master included. This book is requested by Italian Flag authorities only.

4.1.1 Recording and filing of the Record Book

The vessel and Master’s names must be inserted in the front page, together with the starting and completion date of the book. In the first page of the book the number of pages the register is composed of must be indicated together with the port of registry of the vessel. The record book must be submitted to the Italian Maritime Authority or to an Italian Consulate if abroad; they have to check the conformity of the register, to endorse and to date it and to certify the total amount of pages of the record book (D.Lgs. 108/2005). Every register sheet must indicate the vessel name, Flag, IMO no., month and year of reference, seafarer’s name, rank, if he’s a watch keeper or not. The delegated officer must tick the hour of work or rest (the hours of rest should be preferably indicated) and then the total hours of rest in the 24 hours. Additional comments, if any, can be written (i.e. reason why rules cannot be followed etc.). In the last two columns the total hours of rest or work in any 24 hours and in any 7 days must be indicated, in order to ensure compliance with the rules (ILO Convention and Italian D.Lgs 271 as amended by D.Lgs. 108/2005). Depending if resting or working hours are indicated it must be deleted from title the unnecessary word. The last two columns must be filled by or under responsibility of Master. When filling the record book duly attention must be paid to the 24 hours and 7 days preceding any given time within any given day. The working regime requested by Italian Flag is the same set up for ISF Watckeeper software according with Company instructions, then the latter can be used as a support for a cross check of correctness of inserted data. On the bottom of the form the following must be indicated: the laws governing the limitations (D. Lgs. 271 as amended by D.Lgs. 108/2005) on working hours or minimum rest periods and the name of person (block capitals) authorized by Master to sign the forms. The form must be signed by the delegated officer and by the pertinent seafarer. The original form is to be given to the seafarer, the yellow copy is to be retained on board.

4.1.2 Who and when has to fill the sheets of the Record Book

The crew members who are to be delegated by Master the task of filling the forms and take care of the Record Book (one for the deck and one for the engine) are the Chief Mate for the Deck Dept. and the 2nd A/E for the Engine Dept. The forms must be filled every day for every crew members and the book must be ready at any time for inspections by Flag authorities and /of company members as necessary.

4.1.3 Corrections of sheets of the Record Book

No corrections or abrasions are permitted on the record book pages unless those are applied in such a way that the previous text is still readable (i.e. applying an horizontal bar on the word/s to be corrected and above or below inserting the correct word/s). No numbered sheets can be removed from the book except the copy to be handed over to the seafarer at the end of the month. If a wrongly filled sheet must be cancelled, the same must be marked by a full size cross and retained on the register.

4.1.4 Signature of the sheets of the Record Book

At the end of each month the sheets must be signed by the delegated officer and by the seafarers who will receive a copy of it.

4.1.5 Retention of the Record Book

The Record Book must be kept in the ship’s archive after its completion for 3 years under the responsibility of the delegated officer who will keep an inventory of the same as well. .

4.2 “Watchkeeper” software (applicable to all vessels).

The relevant manual for the software “Watchkeeper - version 3” contains all the instructions relevant to the software use (how to input data, warning, recording and printing of reports) and also the International regulations reference which the software manages (STCW, ILO, OPA 90). The manual is provided on board by the Crew Policy Manager which has also the responsibility to provide updated version upon availability. The manual is subject to the care of the Chief Officer and 2nd

4.2.1 Data input

Assistant Engineer. A “Watchkeeper - Getting started User Guide” is below inserted.

The delegated officer has to input the initial data for each seafarer (name, rank, regime applied, etc); then each month the standard scheduled working hours for each seafarer (watchkeepers and daily workers) should be input. The actual hours of work carried out with comments, if any, will have to be input on a daily basis.

4.2.2 Regime to use

The regime to be chosen is the “ILO WORK” plus the associated OPA 90 clause when in US waters. A quick guide to check if correct regime is used is below inserted. The company provides a poster named “Rest and Working Hours Organization” to be shown in day rooms showing Company and International Rules. Poster “Table of Shipboard Working Arrangements” are to be available in the most attended areas, according to Company instructions and must be duly filled by designated officer in accordance with Company and International rules.

4.2.3 System warning

The system warns the operator when the data input are not in compliance with the current active regime.

4.2.4 Non conformances handling

Please refer to “ISF Watchkeeper” specific instructions in case of non conformances and inform Crew Policy Manager accordingly.

4.2.5 Random check of “Watchkeeper” software data by Crew Policy Manager

The Crew Policy Manager will perform random checks on a monthly basis, requesting a printed copy of “record of hours of rest“ printout as issued by the software on board in order to check that data are regularly and properly input and that the same are in compliance with regulations.

4.2.6 Recording (Non Italian Flag vessels only)

At the end of each month the dedicated Officers will print a copy of “record of hours of rest” by the software, signing the print out together with the signature of concerned seafarer.

button to enter the program in ADMIN mode
