Hire Basis Hire shall be on a casual basis and there is no guarantee as to the amount of work for the hire plant and equipment. Hire shall be on an hourly basis and shall include all costs in running a machine with a competent operator. Minimum four (4) hours hire will apply when plant is started on site. If the number of plant and equipment offered for hire is extensive the hire company may submit rates on separate lists so long as reference is made to such list on the quotation form, see Appendix B, this Appendix must be completed, regardless of the number of plant being offered. Transport costs including float or travelling time shall be stated on the Quotation Form. Payment for hire will not be made for any idle period due to breakdown or for reasons within the contractor’s control. Plant and equipment may be stood down from hire by Council at any time due to such reasons as weather, construction program etc. Stand down rates will not apply. Plant and equipment should be available to Council within a reasonable notification time frame (normally less than two (2) weeks). Failure to comply will result in plant stand down or removal from Council’s Plant Hire List. Fuel, oil, ground engaging tools, overtime rates, penalty rates, allowances etc. for operators shall be allowed for in quoted rates. 2. Contractor WHS Management System Requirement It is expected that all Contractors comply with the Work Health and Safety Act 2011 and have a Work Health and Safety management system, as required by NSW WHS Act and Regulations. In addition, Contractors are to comply with National Heavy Vehicle Law (NHVL) and Chain of Responsibility requirements under this law. 3. Roads and Maritime Service All plant supplied for hire for on-road use shall be registered and shall be fitted with the necessary safety equipment; lights, indicators, seatbelts, guards and whatever is necessary to comply with the New South Wales Roads and Maritime Service requirements for travelling by day and by night. Copies of current vehicle registration certificates shall be provided for Council’s records prior to hiring of plant. Driver or plant operators must have the relevant licence for the plant item hired. Copies of licences shall be provided for Council’s records prior to hiring of plant. 4. WorkCover Authority Requirements Where applicable all plant and equipment shall be fitted or altered as required to comply with requirements of the New South Wales WorkCover Authority. Drivers or plant operators must have the relevant WorkCover Plant Operators Certificate or ticket of competency for the plant or equipment hired. Copies of WorkCover Certificates must be provided for Council’s records prior to hiring of plant. 5. Assessment Criteria The criteria used for assessing and selection of plant and for hire shall be: Compliance with WHS Regulations. Quoted hire rate. Capacity and attachments if applicable. Condition and age.

• Plant &/ or operator performance/competencies • Proximity and availability. • Service and support. • Local Preference. • Lowest rate(s) need not be accepted or used.

6. Payment Payment for hire will be made monthly and within two (2) weeks of obtaining an approved invoice.

7. Insurance Requirements All plant hire Contractors wishing to work for Council require the following insurance coverage’s:

7.1 Public Liability Insurance All contractors who undertake work for Council are to be covered by a Public Liability Insurance Policy for an indemnity of not less than $ 20,000,000. This policy should include a “Principals Indemnity Clause” which will cover all principals (users of the Contractor). Third Party Property Damage Insurance is insufficient. The Contractor shall provide documentary proof of coverage (actual policy and “Certificate of Currency”) with a copy being retained for Council’s records. 7.2 Workers’ Compensation Insurance Any persons employing staff are required by law to cover these workers with Workers’ Compensation Insurance. This requirement includes Contractors who employ staff to drive or operate hired trucks, plant, etc. The Contractor shall provide documentary proof of coverage (actual policy and “Certificate of Currency”) with a copy being retained for Council’s records. 7.3 Personal Accident / Illness Insurance Contractors who are self employed sole traders or owner/ operators are to be covered by Personal Accident/ Illness Insurance, also known as Income Loss Protection. The Contractor shall provide documentary proof of coverage (actual policy and “Certificate of Currency”) with a copy being retained for Council’s records. In addition to documentary proof, Appendix A must be completed by the provider and returned with Council for processing purposes.

8. Daily Equipment Hire Order Contractors are required to provide ‘Daily Equipment Hire Order’ similar or same as the example provided in Appendix C. Hours of work are to be agreed and signed each day with Lockhart Shire Council’s site Supervisor. A copy to be provided to site Supervisor once signed and a copy to be attached to Contractor invoice when submitted each month. Agreed hours are required for each day for payment to be approved.
