    Sandy Weathers the Storm, Adapts to Changing Times By Brenda RuggieroCEG CORRESPONDENT

    Nestled in the small rural town ofRoseboro, N.C., Arnold Sandy beganSandys Hauling & Backhoe Service in1994. With just a backhoe and dump truck,he was grading and building lagoons forfarms in and around the community.

    Two years later in 1996, Hurricane Berthaand Hurricane Fran swept through NorthCarolina, causing major damage that includ-ed washing out the lagoons. This causedproblems to surrounding areas, and shortlyafter the storm damage, state officials madethe decision that they would no longer allowlagoons to be constructed. Although lagoonconstruction was a large part of Sandysbusiness, he was able to adapt, and was soonled to installing water, sewer and irrigationlines. Later, he discovered the demand forthe new method of installingutilities by horizontal direc-tional drill, which led him topurchasing a drill rig.

    Over the years, Sandyswife Caroline Sandy hashelped him with the busi-ness. Sandys son, BenSandy, joined the companyin 2005 straight out of highschool. Ben has learned theskills of the utility businessand plays a key role in theconstruction.

    One of the more notewor-thy projects the company hascompleted was a 5,120 ft.(1,560.5 m) drill under theNew River in Jacksonville,N.C., for the Marine CorpsBase at Camp Lejeune, sup-plying a raw water line.

    Today, the company isbacked by more than 30pieces of equipmentinstalling utilities for manymunicipalities across thestate, and has worked for theNorth Carolina Departmentof Transportation within a100-mi. radius.

    Currently, more than halfof the companys fleet isCaterpillar.

    We are very pleased with the serviceCaterpillar has provided us, Sandy said.They have been wonderful. Bill Poteat ofGregory Poole Equipment Company andstaff has been very supportive of us in any-thing weve needed. We are pushing all ofour equipment to Caterpillar. Our latest pur-chase was the D5K, which is one of the mosttop of the line grading dozers that Ive everseen, and it is ready for anything.

    For the horizontal directional drilling proj-ects, the company uses Ditch Witch drill rigssuch as the JT3020, JT60 and JT100, and anAmerican Augers cleaning system for thedrilling fluids.

    Travis Wilkey of Ditch Witch of Raleighand staff have provided us with excellentservice from purchasing to servicing,Sandy said. They are top notch people.Ditch Witch has done a lot of work to get

    where they need to be in the market. The company has a maintenance program

    that follows routine maintenance of equip-ment every 250 hours.

    As far as the future of Sandys Hauling &Backhoe Service, Sandy said that they haveput a lot of hard work into the business, andhe plans to keep going.

    Weve been very fortunate that in theshort time weve been in business, we havecontinued to grow even through the badtimes, he said. Weve got some greatemployees who have worked hard and beenvery good to our company. Were pretty con-

    tent at what we do, and want to remain goodat what we do. My son, Ben has been verysuccessful and takes a big part in what goeson here he now has the knowledge andskill for the water, sewer, storm drain, andgrading. Ben has been a big part to us inmoving forward, and thats what were mov-ing forward for is to build it for him tohave something later, too. We look forwardto the companys bright futures ahead.

    State Demolished 40 Homes for Now-Abandoned ProjectBy Bethany RodgersORLANDO SENTINEL

    ALTAMONTE SPRINGS, Fla. (AP) Thefirst home Brunilda Galarza ever owned, shesurrendered to the government to be razedand submerged beneath a 10-acre drainagepond.

    Like dozens of other residents in theneighborhood just outside AltamonteSprings, she and her husband packed up andcleared out of their community, thenwatched as cranes moved in behind them totear down their homes.

    The driveway where her son practiced hisbasketball layups, the patio where they hungstreamers for his bug-themed 3rd birthdayparty it all disappeared to make way for aretention pond that the Florida Departmentof Transportation said was needed for a crit-ical highway expansion.

    But its been six years since the Galarzasmoved out, and the land is still as dry as theyleft it.

    Project plans changed. The 41-lot neigh-borhood which FDOT deemed neces-sary for public use and was purchased,emptied of residents and demolished for$12.9 million will serve no lasting publicpurpose.

    The land, just east of Interstate 4 and southof state Road 436, will probably go up forsale in a few years and end up in the handsof a private developer. The result of all themoving and expense might be to erase oneneighborhood and replace it with another.

    The state agency did compensate formerresidents, paying out more than $11.4 mil-lion to buy their homes and about $1.1 mil-lion to relocate them. Still, moving on hasntbeen easy for some people, displaced fromhomes where they had lived for decades,planted gardens and raised children.

    The intention of 40 families beinguprooted was because they said there wasgoing to be a retention pond, and this was thebest location. And now six or seven yearslater, wheres the retention pond? Galarzaasked from her former driveway apron, theonly remaining trace of 127 Dolores Drive.

    An FDOT spokesman said the agency didneed the land based on its initial plan forstoring runoff from the I-4 expansion.However, several years later, the agencychanged course after deciding there was abetter, cheaper solution for dealing withstormwater, spokesman Steve Olson said.

    The agency only recently became con-vinced that the alternative stormwater planwas viable, he added.

    In hindsight, if we knew then what weknow now, and had the comfort level that the

    latest version offers, we could have avoidedbuying the property, and been even furtherahead, Olson wrote in an email.

    Situations such as the one near AltamonteSprings are one side effect of a change inhow FDOT approaches many road projects,said a Jacksonville-based attorney experi-enced in eminent domain cases.

    Recent shifts in how road projectsare sequenced have escalated therisk that the government will unnec-essarily take homes and other pri-vate properties, attorney AndrewBrigham said. Once rigidly orderedin phases, transportation projectshave become more fluid, anddesigns are often still in flux as con-struction gets under way.

    As a result, transportation offi-cials are taking land before theyknow how theyll use it or whethertheyll need it at all, Brigham said.

    In some cases, the government isjumping before they really look, hesaid. With greater discretion put inthe hands of government decisionmakers, you have greater chance ofabuse of property rights.

    FDOT slated the neighborhoodfor a future stormwater pond as partof its I-4 expansion project, whichwill intensify the flow of runoff fromthe highway.

    The retention pond disappearedfrom the project plans after the stateagency changed gears to partnerwith the city of Altamonte Springs and oth-ers on an innovative system for treatingrunoff. Instead of collecting all the dirtywater into a pond, theyd treat and reuse it toirrigate lawns. The plan, called A-FIRST,has been hailed as a forward-thinking runoffsolution that will conserve water, preventpollution and save money.

    But for Ray Collins, a former GenevieveDrive resident, its tough to be thrilled aboutthe plan after seeing homes ripped apart tomake way for a stormwater pond that willnever be.

    They should have thought this wholething out better than they did, Collins, whonow lives in Longwood, said.

    In the past, the design work for new roads,bridges or stormwater ponds was almostcompleted before FDOT officials gatheredland and began construction, Brigham said.But more recently, transportation officialshave been favoring a design-build process,which allows planning and land acquisitionto happen at the same time, he said.

    The idea is to take the property and thendo the design afterwards, he said.

    This system comes with a number of ben-

    efits it can save money by making it eas-ier to adjust a project in progress, forinstance but also changes the playingfield for eminent domain cases, the attorneyargued.

    Brigham said while he wasnt involvedwith the demolition of Galarzas neighbor-hood, he is fighting on behalf of a nearby

    shopping center that likely will be affectedby the I-4 expansion.

    Olson acknowledged that FDOT hasrelied more heavily on the fluid design-buildapproach in recent years, which he said cansave money.

    Another recent example of this approachinvolved a Jacksonville church that FDOTwanted to buy for a drainage pond project.

    When Glorious Bethlehem Temple andthe state agency couldnt agree on fair com-pensation, FDOT simply changed its plansfor the pond and left the church strandedinside a neighborhood that had already beendemolished, according to the Florida Times-Union.

    Brigham, who is representing the churchin its suit against FDOT, said the agencysability to overhaul its project designs late inthe process put his clients at a bargaining dis-advantage.

    An FDOT spokesman declined to com-ment on the case, since it is in litigation.

    Another bitter pill for former residents ofGalarzas community is that FDOT officialssnubbed A-FIRST, the water reuse planhatched by Altamonte Springs officials,

    years before demolishing the neighborhood. It was only after the homes were leveled

    that the transportation agency switched itsplan for dealing with stormwater.

    Florida Sen. David Simmons ofAltamonte Springs said he doesnt faultFDOT for its initial, cautious approach.

    I think that any time that theres a newand innovative idea that is presented,theres often resistance to change,Simmons said. I dont criticizeFDOT at all for having started doingthings the way theyve always donethem. I applaud FDOT for having theinitiative to do something different-ly.

    It was Simmons who arranged the2013 sit-down meeting between thestate transportation secretary andAltamonte Springs city manager thatfinally breathed life into A-FIRST.

    City Manager Frank Martz said hefirst pitched the idea to FDOT offi-cials in 2005 or 2006, but theywerent initially comfortable step-ping out on a proposal unfamiliar tothem.

    Olson, the FDOT spokesman, saidtransportation officials did a costcomparison of continuing with thestormwater pond or transitioning toA-FIRST and found the secondoption was cheaper.

    Not all of the displaced inhabitantsof Genevieve Drive and DoloresDrive are unhappy with how things

    turned out. A number of them say FDOTtreated them well and offered them a fairprice for their homes.

    I left with a smile on my face, saidhomeowner Miles Charlesworth, who relo-cated to Dickinson, Texas.

    Meanwhile, the former site of his subdivi-sion stands screened by green fencing. Forthe next five years or so, during the Interstate4 project, the roughly 12 acres will work asa storage yard for trucks and other construc-tion equipment.

    Then, the former subdivision will go upfor sale, possibly to a developer.

    Land broker William Sullivan, divisionpresident of Potomac Land Co. in WinterPark, said the property would probably beworth about $300,000 per acre on the openmarket and suitable for apartments becauseof its proximity to shopping, transportationand entertainment.

    At that rate, FDOT would recoup about$3.5 million from the property, or less than athird of what the agency paid for it.

    Dakota Southeast Products Snake Oil That WorksSnake oil that works thats how

    Michael Stokes, president of Tim-Prep Inc.of Jacksonville, Fla., owner of Bobcat ofJacksonville and the originator of DakotaSoutheast, describes the Dakota Shine prod-ucts that fix faded paint. His new companywill distribute throughout the southeast.

    Stokes has been around the constructionindustry for 30 years. He founded Tim-Prepin 1985 as a site preparation company for thetimber industry.

    In the 1980s, our main focus was build-ing and maintaining logging roads and siteprep for reforestation which we still dotoday. From there we started performing allphases of civil construction for developers ofresidential, commercial and industrial in theearly 1990s. In 2009, we had the opportuni-ty to start a new Bobcat dealership, Bobcatof Jacksonville. With that, we have growninto several new lines including Doosan,Wacker Neuson and Dynapac [Atlas Copco]compacting equipment.

    Six years ago we bought a large JohnDeere tractor to pull pans for our construc-tion business, said Stokes. The hood wasreally faded and I remembered seeing an adfor Dakota Shine, we tried it, and it turnedout great. We had about five or six gallonsleft and it just sat on a shelf in our shopthroughout the down times. We didnt spendany money we didnt have to.

    About six months ago we bought fourmore ag tractors to pull pans and they werereally faded. Before we sent them to the jobwe decided why not try that product we triedsix years ago and see if it was still good.Some of the product was so old we went tothe Dakota Shine Web site to see how to useit and we started to apply it. Before we gottoo much in to the application we called thefactory to make sure we were doing it right.

    After about a 45 minute conversation withLynn Odland of Dakota Shine, we devel-oped a relationship. He explained how to usethe product, we used it, and were sold on it.We were so sold on it we started thinkingabout doing more with it. I started out think-ing we would use it in our Bobcat dealershipbut the more Lynn and I talked about it wetoyed with the idea of us becoming a distrib-utor. There is a need to have it readily avail-able in the southeast instead of having towait three or four days to get it out of theDakotas. So we set up Dakota Southeast tohandle distribution in ten southeasternstates.

    The quick access of the product will makeDakota Shine a value added product to the

    dealers and customers that have faded equip-ment in the SE.

    Stokes knew that with all of his other busi-ness interests he would not have time to runDakota Southeast himself so he went look-ing for someone take over and run the oper-ation.

    I have known Craig Morris for a numberof years since he was my sales rep for anequipment dealership and we have remainedfriends. I called Craig because I thought thiswas the perfect guy for selling DakotaShine, said Stokes.

    Morris has been around constructionequipment a long time.

    I started in 1983 on the wash rack forLinder Machinery, said Morris, andworked through the various departments andfinally got a sales territory in Jacksonville. Ispent over 26 years with them. Knowingequipment as well as I do I am excited aboutthe Dakota Shine product. I know what itdoes for equipment in the rental business andknow the value of sending equipment outthat looks good. It also brings a lot of valueto machines that are going to be sold andthere is real value to a contractor who eitherbuys a piece of used equipment or has anolder piece and wants it to look better on hisjob site.

    The value I see in Dakota Shine forequipment that is being taken to an auction isthat it does not hide the faults of themachine, said Stokes. As a buyer of usedequipment I would much rather buy a pieceof equipment that has been shot with DakotaShine than had what we call a Mary Carteroverhaul which is a repainting. The hoseswill not be black anymore but yellow. Youknow that the machine has been repaintedand you wonder what all is hidden under thatpaint.     Ed Malzahn, Ditch Witch Founder,Industry Icon, Passes Away at 94The Ditch Witch family announced the passing of the

    companys founder and industry icon Ed Malzahn on Dec.11. He was 94. Gus Edwin George Malzahn (Ed), of Perry, Okla., was the

    son of Charles and Bertha (Wolff) Malzahn. He was born onJuly 3, 1921, in Perry, Okla.Mr. Malzahn graduated from Perry High School in 1939

    where he was an Eagle Scout, played football, played in theband and participated in several theatrical plays. He wasknown to pull out his cornet and play Dear Old Perry Highif you asked. After high school he completed a degree inmechanical engineering at Oklahoma A&M College(Oklahoma State University) where he met the love of hislife, Mary Corneil. Mr. Malzahn was very enterprising. As a young boy, he

    always had a project to engage his interests. He cast silverdollars for his friends at age 13, resulting in a visit from theFBI. He built a remote control spotlight at age 17 that caughtthe attention of the Air Force when he was caught spot-lighting aircraftagain resulting in a visit from the FBI. Hewas always tinkering with something.Even in his later years he always had a project, with the

    latest being the conversion of a Perry landmark, the MasonicLodge, into a multi-unit residence. But, no matter what proj-ect he was working on he always had time to roam the hallsof Ditch Witch as bull of the woods to find treats for hissweet tooth, blow bubbles at a birthday party, or make a spe-cial delivery of roses from his garden.Mr. Malzahn changed the way the worlds utility infra-

    structure is installed and maintained when he launched thefirst service line trencher, the Ditch Witch model DWP in1949 from a small machine shop in Oklahoma. That smallshop grew to become Ditch Witch, a Charles MachineWorks company, which today employs more than 1,500workers, and has more than 175 dealerships and branchesserving 195 countries. The company has produced and soldmore than half of the worlds trenching machines. Ed was the inspirational leader of the Ditch Witch and

    the Charles Machine Works family for over 65 years, saidRick Johnson, chief executive officer of Charles MachineWorks. He possessed a sharp mind, strong rural work ethicand generous spirit all of which he used to better thosearound him. Recognition of Mr. Malzahns accomplishments as an

    industry leader and innovator included his induction into theOklahoma Inventors Hall of Fame, American RentalAssociation Hall of Fame, Construction Equipment Hall ofFame and North American Society for TrenchlessTechnology Hall of Fame. He also was named Inventor ofthe Year by the Oklahoma Bar Association: Patent,Trademark and Copyright Section.The needs of the community and its residents were always

    a priority to Mr. Malzahn, who held deep Oklahoma roots.His efforts as a civic leader and philanthropist included vol-unteer service and financial contributions to numerousorganizations and boards at the local, state and national level. As a family man, Mr. Malzahns family life extended to

    his work life. Charles Machine Works has remained a fami-ly business since its creation, even after global success. Mr.

    Malzahns granddaughter Tiffany Sewell-Howard, who rep-resents the fifth-generation of the Malzahn family, nowserves as the executive chair of Charles Machine Works. Mr. Malzahn is survived by three children, Don Malzahn,

    and his wife, Phyllis; Pam Sewell, and her husband, David;and Meleasa Malzahn. He has nine grandchildren, TiffanySewell-Howard, and her husband, Dan; Jason Sewell, andhis wife, Katie; Cody Sewell, and his wife, April; ZahnWilkerson, and his wife, Kelly; Courtney Darrah, and herhusband, Will; Sarah Malzahn; Matthew Wilkerson, and hiswife, Briana; Whitney Wilkerson; and, Perry Malzahn, andher husband, Jason Brammer. He also has thirteen great-grandchildren. He was preceded in death by his parents, Charles and

    Bertha Malzahn, his wife, Mary, and one sister, VirginiaLamb. In lieu of flowers, donations may be made to the Perry
