1.

These Regulations may be cited as the Coal Min-ing Safety Commission Regulations.

INTERPRETATION DFINITIONS

In these Regulations,

Act means Part II of the Canada Labour Code; (Loi)

Commission means the Coal Mining Safety Commis-sion established by subsection 137.1(1) of the Act.(Commission)

SELECTION OF MEMBERS SLECTION DES COMMISSAIRES

(1)

Two months prior to the expiration of the termof office of a member of the Commission representativeof employers of employees in coal mines, those employ-ers may submit to the Minister for consideration thename and qualifications of a person the employers rec-ommend be appointed as a member of the Commissionto represent the employers.

Deux mois avant lexpiration du mandat duncommissaire les reprsentant, les employeurs dem-ploys travaillant dans les mines de charbon peuventsoumettre lexamen du ministre les nom et titres decomptence de la personne dont ils recommandent la no-mination comme commissaire les reprsentant au sein dela Commission.

Two months prior to the expiration of the term ofoffice of a member of the Commission representative ofnon-supervisory employees employed in coal mines, thetrade union representing those employees may, in con-sultation with any non-supervisory employees who arenot represented by a trade union, submit to the Ministerfor consideration the name and qualifications of a personthe trade union recommends be appointed as a memberof the Commission to represent the non-supervisory em-ployees.SOR/99-355, s. 1.

any other reason, the trade union representing those em-ployees may, in consultation with any non-supervisoryemployees who are not represented by a trade union,submit to the Minister for consideration the name andqualifications of one person the trade union recommendsbe appointed to replace the member of the Commission.SOR/99-355, s. 1.

Where names and qualifications are not submittedto the Minister in accordance with section 3 or 4, the

Minister shall consult with the employers, the non-super-visory employees or the trade union, as the case may be,before appointing a person as a member of the Commis-sion.

Lorsque les nom et titres de comptence viss auxarticles 3 ou 4 ne lui sont pas soumis, le ministre

consulte, avant de procder la nomination dune per-sonne titre de commissaire de la Commission, les em-ployeurs, les employs occupant des fonctions autres quecelles de surveillance ou le syndicat, selon le cas.

TERM OF OFFICE DURE DU MANDAT

The term of office of the members of the Commis-sion shall be three years.SOR/99-355, s. 2.

A person may be reappointed as a member of theCommission for more than one term.7.
