SECTION 2 SPECIAL TERMS AND CONDITIONS

2.1 PURPOSE

This Request to Qualify (RTQ) will establish a Prequalified Pool of Vendors (Pool) that will be used to solicit Harris Radio Components, Battery Packs, and Services for Miami-Dade County (County). It is the intent of this RTQ to identify and make available to the County, a Pool of pre-qualified Vendors capable of providing Harris parts, components, battery packs, and repair and calibration services. The Pool will assist authorized County departments in the acquisition of timely, reliable, and high quality products and services to support the County’s radio communication environment. Placement in the Pool is not a contract between the County and the Vendor, but an acknowledgement that the Vendor meets the qualifications as outlined throughout this RTQ. Vendor Submittals are accepted throughout the term of the RTQ for placement in such Pool. The County seeks to prequalify Vendors in the following three Groups:

• Group 1 – Harris Radio Parts and Components • Group 2 - Harris Battery Packs • Group 3 – Harris Calibration, Repair and Technical Support Services

2.2 DEFINITIONS

Invitation to Quote (ITQ) – Shall refer to the solicitation of quotes from the Pool for specific goods and/or services; and awarded based on lowest price, or other quantifiable criteria. Prequalified Pool of Vendors (Pool) – Shall refer to business entities/individuals determined by the County’s Internal Services Department, Strategic Procurement Division, as meeting the minimum standards of business competence, financial ability, and/or product quality for placement in the Pool, and which may submit quote or proposal, at the time of need. Vendor – Shall refer to a business entity/individual responding to this RTQ. Submittal - Shall refer to all information, attachments and forms submitted in response to this RTQ. Work Order Proposal Request (WOPR) – Shall refer to the solicitation of offers from the Prequalified Pool of Vendors for specific goods and/or services; and evaluated and awarded based on best value.

2.3 TERM

The Pool shall be established on the first calendar day of the month succeeding approval by the Board of County Commissioners, or designee, unless otherwise stipulated in the Blanket Purchase Order issued by the Internal Services Department, Strategic Procurement Division. The Pool shall expire on the last day of the last month of the five-year term.

2.4 SUBMITTAL REQUIREMENTS

Vendor shall meet the following criteria to be considered for placement in the Pool and for participation in future solicitations: 2.4.1 Group 1: Harris Radio Parts and Components

A. Vendors shall provide contact information for primary (required) and secondary (optional) staff who will be responsible for providing a response to the County’s ITQ or WOPR process. These services shall typically be required Monday through Friday within the business hours of 8:00 AM and 5 P.M Eastern Time.

B. Vendors shall provide three (3) Public Safety (i.e. Fire, Police, Law Enforcement, Military, etc.) references to demonstrate it is regularly engaged in the sale of Harris Radio Parts and Components. Each reference provided must be for sales that were completed within the last three (3) years. No more than one of these references can be from Miami-Dade County.

C. Vendors shall complete the Harris Radio Parts and Components table in Section 4.2.2 of the Submittal to demonstrate the Harris Radio Parts and Components they are able to provide to the County.

2.4.2 Group 2 – Harris Battery Packs

A. Vendor shall provide contact information for primary (required) and secondary (optional) staff who will be responsible for providing a response to the County’s ITQ or WOPR process. These services shall typically be required Monday through Friday within the business hours of 8:00 AM and 5 P.M Eastern Time.

B. Vendors shall provide three (3) Public Safety (i.e. Fire, Police, Law Enforcement, Military, etc.) references to demonstrate it is regularly engaged in the sale of Harris Battery Packs. Each reference provided must be for sales that were completed within the last three (3) years. No more than one of these references can be from Miami-Dade County.

C. Vendors shall complete the Harris Battery Packs table in Section 4.3.2 of the Submittal, confirming that the Vendor can provide batteries from Harris or an approved equivalent that meets or exceeds the Original Equipment Manufacturers specifications. The County shall be the sole judge of approving any proposed equivalent, based on the best interests of the County, and its decision in this regard shall be final.

2.4.3 Group 3 – Harris Calibration, Repair and Technical Support Services

A. Vendor shall provide contact information for primary (required) and secondary (optional) staff who will be responsible for providing a response to the County’s ITQ or WOPR process. These services shall typically be required Monday through Friday within the business hours of 8:00 AM and 5 P.M Eastern Time.

B. Vendors shall be authorized to perform repair and calibration services. This authorization shall be provided in the form of a letter from the OEM. If the Vendor is the OEM, a letter on company letterhead stating so will suffice.

Vendor shall provide all of the specified information, documents and attachments listed above with their Submittal as proof of compliance with the requirements of this RTQ. However, the County may, at its sole discretion and in its best interest, allow Vendors to compete, supplement, or supply the required documents throughout the term of the RTQ. It shall be the sole right of the County to determine the number of Vendors which will be included in the Pool. During the term of the RTQ, the County reserves the right to add or delete Vendors as it deems necessary, and in its best interest.

2.5 INDEMNIFICATION / INSURANCE

The following clauses from Section 1, General Terms and Conditions shall not apply. They are replaced in their entirety with Section 2.5.1:

• Section 1.21, INDEMNIFICATION • Section 1.22, INSURANCE REQUIREMENTS

2.5.1 Groups 1, 2 and 3 Insurance is not required in order to be prequalified under this RTQ. Insurance requirements will be detailed in the subsequent ITQ or WOPR.

2.6 SPOT MARKET QUOTES Vendors in the Pool will be invited to participate in future spot market competition, as needed. The spot market competition will be in the form of an ITQ or WOPR that will include the specific goods and/or services required, and may include provisions, as applicable, such as: • Small Business Enterprise (SBE) Measures • Warranty Requirements • Liquidated Damages • Living Wage

For federally funded projects/programs, additional provisions may apply in accordance with the funding source. The following provisions from Section 1, General Terms and Conditions shall be exempted from such solicitations, as indicated in the ITQ or WOPR. • Local Preferences • User Access Program (UAP) Fee • SBE Measures • Local Certified Veteran Business Enterprise Preference • First Source Hiring Referral Program • SBE Prompt Payment Terms • Office of Inspector General Fee

SECTION 3 SCOPE OF WORK/TECHNICAL SPECIFICATIONS

3.1 SCOPE OF WORK/TECHNICAL SPECIFICATIONS

This RTQ includes the following three (3) groups: 3.1.1 Group 1 – Harris Radio Parts and Components

Section 4.2.2 of the Submittal includes a list of Harris Parts and Components that the County may procure during the term of this RTQ. The County reserves the right to accept substitutions for obsolete items in the form of factory reconditioned parts and components, provided standard warranty provisions apply.

3.1.2 Group 2 – Harris Battery Packs

Vendor may furnish radio battery products in accordance with requested County requirements provided they meet or exceed the specifications and performance characteristics established by Harris as the Original Equipment Manufacturer (OEM) for two-way radios. All Battery packs provided must be manufactured in accordance with the latest ISO 9000 series industry standards or an equivalent and recognized industry compliance standard. Environmental and Operating Specification: Battery Packs shall meet or exceed MIL-STD-810 and 810F testing standards based on current requirements for procedures covering the items as listed below: 1. Low Pressure 2. High Temperature 3. Low Temperature 4. Temperature Shock 5. Solar Radiation 6. Blowing Rain 7. Humidity 8. Salt Fog 9. Blowing Dust 10. Immersion – 1 meter for 4 hours with 49 degree F (27C) temperature differential 11. Vibration (Minimum Integrity) 12. Vibration (Basic Transportation) 13. Shock (Functional/Basic) 14. Shock (Transit Drop) 15. IP-67 Test - Dust-tight and Water Immersion 16. U.S. Forest Service – Vibration (10-60Hz) 5G’s 17. TIA/EIA-603-A – Shock – 1 meter drop Nominal Operating Temperatures: NiCd - -22 to +140 degrees F (-30 to +60 degrees C) NiMH - +14 to +122 degrees F (-10 to +50 degrees C)

Expected Battery Life with M-A/COM Model P7100 (at 5% Tx, 5% Rx, 90% standby): NiCD – 8 hours (1600 mAH) NiMH – 11 hours (2400 mAH) Battery Packs must also meet standards set by the Federal Communications Commission (FCC) for Specific Absorption Rate (SAR) qualifications to protect Public Safety users. The FCC requires that any device attached to a portable radio and worn within 8 inches of the body must be tested to make sure that the device (in this case the battery) doesn’t interfere with the radio and RF propagation and cause “hot spots” on the human body. 18. FM Intrinsically Safe (IS) Certification for Portable Radio/Battery Pack combination.

3.1.3 Group 3 – Harris Calibration, Repair and Technical Support Services

Calibration, Repair, and Technical Support Services may be required on Harris two-way Land Mobile Radio equipment used by the County, including public safety divisions of the County (i.e. police, fire rescue, and other public safety radio operations. An example of equipment that will need to be serviced and/or calibrated includes: two-way radios, repeaters, simulcast equipment, integrated multi-site controllers, radio network switches, interoperability combiners and other related components.

SUBMITTAL FORM

Instructions to Vendors: Please review and complete the information below to be considered for inclusion in the Pool.

4.1 VENDOR CONTACT INFORMATION (ALL GROUPS):

Per Section 2.4, Vendors shall provide contact information for a Primary staff member within their company who will be responsible for providing a response to ITQ’s or WOPR’s issued by the County to include: name of contact, email address, and phone number.
