Preamble

Justice, Liberty, Equality and Fraternity.

Article 14

The State shall not deny to any personequality before the law of the equalprotection of the laws within the territory of India.

Reservation for Weaker SectionsArticle 15(4)

Nothing in this article (Article 14) or in clause 2 of Article 29

shall prevent the State from making any special provision for the advancement of any socially and educationally backwardclasses of citizens or for SCs and the STs.

Article 16(4)Nothing in this article shall prevent the State from making anyprovision for the reservation of appointments or posts in favour of any backward class citizens which in the opinion of the Stateis not adequately represented in the Services under the State.

Identification of backward classes i.e., socially andeducationally.

The said class is not adequately represented in theservices under the State

Reservation not to exceed 50% under constitutionalphilosophy, in a particular year.

Definitions of SCs/STs/OBCs

Article 341 &342 provides the Castes, racesor tribes.Through Presidential notification.the lists identifying as SCs/STs are notified inrespect of a State/UT only.

Based on Mandal Commission recommendation lists of OBCs in respect of various States have been notified.

Mandal Commission has prepared these lists on the basis of Socio educational field survey

Census report of 1961Personal Knowledge gained through extensive touring of thecountry and receipt of voluminous public evidenceList of OBCs notified by various State Governments
