INTRODUCTION On February of 2015, the Department of Buildings adopted the amendments to Title 1 of the Rules of

the City of New York, regarding course requirements for construction trades.

On October 16, 2017, New York City Local Law (196 of 2017) (“LL196” or “Local Law”) went into effect requiring many construction workers to complete site safety training courses and to carry site safety identification cards as proof of completion of the training. The following guideline was developed to assist Site Safety Training Course Providers seeking to implement an identification card program. On December of 2019, New York City Local Law (219 of 2019) went into effect to amend the

administrative code of the city of New York and the New York City Building Code, setting forth

requirements for site safety training providers and site safety training requirements for individuals.

PART 1: SITE SAFETY IDENTIFICATION CARDS

TRAINING REQUIREMENTS1

Delivery persons, flag persons, design professionals (professional engineers/registered

architects), Department-licensees and Department-registrants (excluding safety professionals)

are not required to be trained.

Individuals who fall into of these categories but serve as a Site Safety Manager, Site Safety

Coordinator, Concrete Safety Manager, Construction Superintendent or competent person,

they are required to receive training. While licensees themselves do not need to be trained,

employees working under their direct and continuing supervision do need to be trained.

The Local Law established four categories of identification cards: Temporary Site Safety Training Card, Limited Site Safety Training Card, Site Safety Card and Site Safety Training Supervisor Card.

Temporary Site Safety Training Card Effective December 1, 2019, new entrants to the construction or demolition workforce may begin working with a Temporary Site Safety Training Card, which is a non-renewable card that expires after six months and is issued to a person who has completed an OSHA 10-hour class. Limited Site Safety Training Card Effective December 1, 2019, construction workers will be required to have taken an OSHA 10-hour class with 20-hour additional training or an OSHA 30-hour class or a 100-hour training program approved by DOB. Limited Site Safety Training Cards will expire April 30, 2019 but no later than August 31, 2020. Site Safety Card Effective September 1, 2020, construction workers will be required to have taken a required OSHA 10-hour class with 30-hours of additional training or an OSHA 30-hour class with 10 additional hours (total 40 hours) training. Site Safety Training Cards expire after five (5) years and are renewable upon an applicant showing that they have, in the one-year period preceding submission of a renewal application, completed eight (8) training hours specified by DOB.

Site Safety Training Supervisor Card Effective December 1, 2019, Supervisor Site Safety Training Cards will be issued to those who successfully completed an OSHA 30-hour class and 32-hours of additional training. Supervisor Site Safety Training Cards expire after five (5) years and are renewable upon an applicant showing that they have, in the one-year period preceding submission of a renewal application, completed sixteen (16) training hours specified by DOB.

SITE SAFETY TRAINING CARD REQUIREMENTS

As of December 1, 2018, DOB approved course providers are authorized to issue Site Safety

Training Cards to individuals who complete the DOB required courses.3

SST Cards to Be Issued Upon Course Completion

Until further notice, an SST course provider must, upon a student’s completion of the SST

course4, issue a temporary SST card, limited SST card, SST card, or Supervisor SST card in

accordance with the guidelines contained herein. The course provider may charge a fee for

issuing a card. However, the course provider must disclose whether the cost is part of the

training or if it is a separate fee. In addition, SST course provider must disclose the cost to

replace a lost, stolen or damaged SST card.

Course Credits

The course provider must accept documentation, including identification cards or

certificates of completion, from a Department-approved SST course equivalent, as set out on

the Department’s website, and must apply such course hours to satisfy the SST training

requirements. Course providers may not limit issuing cards to only those individuals who have

taken courses with them. Course providers must issue an SST ID Card to any individual who

presents proper qualifications. Failure to issue an identification card to a qualified individual

may result in suspension and/or termination of a Course provider’s status as an approved DOB

course provider.

SITE SAFETY TRAINING ID CARD DESIGN & REQUIRED ELEMENTS

The New York City Building Code, BC 3302.1, requires course providers to issue SST

cards to individuals who demonstrate that they have obtained the necessary SST credits. The

law requires that a photograph be taken of the applicant and “such additional information as

the department may allow by rule”. The elements described in Figure 1 below are required.

NYC Rule 1 RCNY § 105-03, states:

(i) SST cards to be issued upon course completion. The Department may require SST course completion cards to be issued by a third party. Until such time as a third party process is instituted, an SST provider must, upon completion of the SST course, issue a temporary SST card, limited SST card, SST card, or SST supervisor card, in accordance with subdivision (h), this subdivision and section 3302.1 of the Building Code.

(1) Such card must be wallet-sized and must conform to the guidelines posted on the Department’s website. (2) Any SST card issued prior to the effective date of this rule must conform to the guidelines posted on the Department’s website. The course provider who issued such SST card must replace non-conforming cards by April 1, 2020 with cards that comply.

CARD DESIGN – FRONT

1) REQUIRED: SST ID Training Card Label: SST Training Course Providers cards are to include a banner across the card that indicates that the card is a New York City Site Safety Training Identification Card.

2) REQUIRED: Photograph of the person to whom it was issued.

show a close-up of full head and shoulders without any other objects or people

be between 29mm and 34mm high from the crown to the chin

c. In addition the photo should show the card applicant:

facing forward and looking straight at the camera

with a neutral expression and mouth closed

without anything covering the face

in clear contrast to the background

without a head covering (unless it’s worn for religious or medical reasons)

with eyes open, visible and free from reflection or glare from glasses

with eyes not covered by sunglasses, tinted glasses, glasses frames or hair

without any ‘red eye’

without any shadows

3) REQUIRED: Height and Eye. The cardholders height and eye color are required to be printed on the card.

4) REQUIRED: Type of SST ID: Course Providers should label the SST ID card based on the type - Temporary, Limited Site Safety, Site Safety, Site Safety Training Supervisor

a. Course Providers should incorporate a banner using distinct colors to distinguish the card by type. DOB recommends that Temporary SST IDs and Limited SST IDs use a red banner with white lettering and that Site Safety SST IDs use a blue banner with white lettering and Site Safety Supervisor IDs use a gold banner with white lettering.

5) REQUIRED: Issued Date & Expiration Date: Course Providers should include both the date of issuance and expiration date of the card. Note: Temporary Cards expire after 6 months and are not renewable. Applicants may not receive another temporary card.

6) REQUIRED: Unique identification card number. Please refer to the “Provider ID & SST ID Card ID Number” section.

7) REQUIRED: The printed full legal name of the cardholder: The cardholder’s name should appear on the card and match other legal documents. This may not reflect a nickname or preferred name.

8) REQUIRED: QR Code: A QR code used to allow the card to be scanned to check the validity of the ID card linking to the Course Provider’s website registry.

9) REQUIRED: Course Provider Logo: the issuing Course Provider’s logo affixed to the card.

10) REQUIRED: Any additional information the Department may require: Temporary Cards are to include the language NON-RENEWABLE displayed on the card. In addition, Course Providers are to label the card with the DOB Course Provider’s ID number. Contact DOB to receive your unique Course Provider ID number.

11) ADDITIONAL REQUIREMENTS: Temporary Cards must be labeled “Non-Renewable”.

CARD REPLACMENT

Any SST card issued prior to the effective date of the rule, April 1, 2020, must be replaced with

the design style in this document. Cards issued without the required elements are considered

non-conforming cards and must be replaced by the issuing Course Provider.5

LOST, STOLEN OR DAMAGED CARDS

Course providers must replace lost, stolen or damaged SST ID Cards. Providers may charge a

fee to replace the card.

Please note, a new SST ID Number should not be issued. Instead, the same ID Number should

be printed on the new card. However, the date the new card was issued should be changed to

reflect the new issue date. The expiration date must remain the same.

PROVIDER ID & SST CARD ID NUMBER

Course Provider ID DOB has assigned course providers a unique ID number. The Course Provider ID number must be printed on SST Cards you issue. Additionally, DOB recommends that Course Provider ID numbers be printed on individual course certificates of completion.

SST Card ID Numbers When issuing SST Cards you should use a unique ten (10) Character Alphanumeric identifier. The first digits of the SST Card ID number should be your Provider ID number followed by your created alphanumeric system (no hyphen). The number should be assigned to a single individual and the individual should have the same number on a replacement or upgraded SST Card issued by any Course Providers. For example: 2B02S6P7N3

PHYSICAL CARD

To ensure uniformity, course providers are to issue ID cards that are standard credit card size of 2.125 x 3.370 inches. These ID cards are to be printed in portrait mode. Finally, course providers should consider printing the ID cards on durable material such as PVC plastic with a laminated layer to prolong its life.

SECURITY FEATURES

Course providers should issue identifications cards containing security features that will deter

counterfeiting, ensure authenticity and help facilitate the detection of a fraudulent card. When

deciding what security features are necessary, Course Providers should consider issuing an

identification card that incorporates one or more of the following types of security features:

Holograms

Because the technology used to create holograms on identification cards is expensive,

cards using this technology are difficult to duplicate using standard printers. The cards

printed with a holographic overlay create the illusion that make parts of the cards

appear and disappear depending on the angle from which it is viewed.

Ultraviolet (UV)/Florescent (F) Printing

Ultraviolet or florescent printing can be used to print hidden text or images directly onto

an identification card. The image or hidden text can only be detected using UV or

florescent light readers.

Ghost Images

Ghost images are smaller versions of the cardholder’s photograph that is printed on a

different part of the card and the image appears to be faded in the background.

Micro-Text Printing

Micro-text printing uses technology to embed text on the identification card that can be

read using a magnifying glass or microscope to reveal repeating text that indicates that

the card is authentic. Micro-text printing is created using industrial equipment not

generally available to the general public.

SUSPENSION AND REVOCATION OF APPROVAL

The Department may take corrective action against any course provider for failure to

comply with the required items contained in the guidelines. Course providers are subject to

such corrective actions such as suspension or revocation of a course provider’s authority to

conduct classes and to distribute SST cards. Where there is an imminent threat to public safety,

the Commissioner may immediately suspend a course provider for a period of up to 30 days

subject to a hearing. For more information, please consult the Course Provider Rule, 1 RCNY

§105-03.

PART 2: IDENTITY AND TRAINING VERIFICATION

IDENTITY VERIFICATION

Course providers are required to verify an individual’s identity and mailing address. Before issuing an SST ID Card, course providers should verify the applicant’s identity and mailing address using a point system or document calculator such as the one below based on the NYCID program. The applicant’s documents should total four (4) points in any combination as described below:

1. At least four (4) points of documents with:

At least three (3) points of documents proving identity

At least one (1) point for documents proving address 2. At least one (1) of the documents submitted must have a photo of the applicant.

Course providers should note that the City of New York has adopted a non-retention policy for personal identifying information records. DOB recommends that course providers not retain any of the applicant’s original documentation or make any copies of the documentation. Instead, course providers should document what items were presented by the applicant. Course providers should consider developing an application that contains a checklist of potential documents that an applicant may present as proof of their identity. The list should be generic. For example, a description could be: Government issued identity document totaling 4 points. Expired documents should not be accepted unless explicitly mentioned below. Only original documents and copies certified by the issuing agency should be accepted.

TRAINING VERIFICATION

In addition to verifying an applicant’s identity, the course provider will need to verify the applicant’s prior training. Please note, unlike the personal identifying documents non-retention policy discussed above, course providers should maintain a copy of an applicant’s training certificates, identification cards or other proof of training. If the course provider is not the original OSHA training location, the course provider will need to contact the OSHA training provider and/or course provider where the applicant received their prior training. The course provider will confirm that the applicant received the required training and will count the total credits in the calculation towards the required credits. Course providers will be expected to evaluate the authenticity of an individual’s training. If the training cannot be verified, the course provider must not issue an SST ID. In addition, if a course provider believes that an applicant has presented fraudulent credentials, a course provider should retain a copy of the document(s) and contact the DOB’s Office of Buildings

SPECIAL INSTRUCTIONS FOR OSHA CARDS

OSHA Can OSHA verify a student course completion card or an authorized trainer card? For privacy reasons, OSHA does not provide individual verification of student course completion cards or authorized trainer cards. Verification of Outreach card authenticity is at the discretion of the cardholder. How do I verify a student course completion card? If an individual holding an OSHA Outreach student course completion card wishes to verify the authenticity of their student course completion card, the individual can provide the name and contact information of the authorized trainer who issued the student course completion card. Each authorized OSHA outreach trainer is required to maintain records on their training for a period of five years. How do I verify an authorized trainer card? An individual who completes an OSHA outreach trainer course is provided an OSHA authorized trainer card. This card indicates the expiration date of the trainer's authorization. If the authorized trainer who issued the OSHA Outreach student course completion card wishes to verify the authenticity of their own authorized trainer status, the trainer can provide their OSHA trainer card, which will include the name and phone number of the authorizing training organization. The authorizing training organization can verify the status of the trainer. Please note that in most cases, the authorizing training organization is an OSHA Training Institute Education Center. I believe I have encountered fraudulent activity on training related to the OSHA Outreach Training Program. How do I report this? Write to [email protected] or call the outreach fraud hotline at 847-297-4810 to file complaints about program fraud and abuse. Provide all pertinent information, including the trainer's name, the date of training, the location of the training, the type of training (Construction, General Industry, Maritime, Disaster Site Worker), and whether it was to cover 10 or 30 hours. ONLINE TRAINING

Online training received before October 16, 2017 will be accepted. After the October 16 date, only in-person training and actively proctored online training will be accepted. Actively proctored online training consists of:

online training taken in a classroom with a proctor; or

online training that at a minimum requires the individual receiving the training to:

o Attest that they are the individual that received the training and the training was

received without assistance; and

o Have their participation monitored at random times to ensure the individual

receiving the training is present for the entirety of the training.

Individuals presenting Certificates of Completions or other documentation as proof of their online training are required to sign a document attesting to having completed the training on their own and according to the law. Below is sample language that may be incorporated:

Sample attestation language for online training: I, (applicant), hereby attest that on (fill in date), I completed an online site safety

training course in accordance to the requirements of the Administrative Code, the Rules of the City of New York, rules, regulations, policies, procedure notices and directives issued by the New York City Department of Buildings. I further attest that I completed the training without assistance.

I, (applicant), do hereby further attest that the information provided on this

application is true, accurate and correct to the best of my knowledge. In addition, I agree to comply with the terms and conditions [COURSE PROVIDER

TEMPORARY SST CARDS

Applicants must provide a written statement indicating that they have never been issued a Temporary,

Limited, SST Card or a Supervisor SST Card.

FEES

Course Providers are permitted to collect a fee to cover the cost of the card issuance.

PART 3: DATA COLLECTION & REPORTING

RECORD-KEEPING AND VERIFICATION OF SST CARDS

Attendance Record The course provider must have in place fraud- resistant procedures for confirming the identity and attendance of individuals taking any course(s), including logs reflecting those in attendance at different times during the course, and be able to produce the logs and any other documentation demonstrating that an attendee attended the course(s).

DATA COLLECTION

The course provider must maintain a record of all the [names of course attendees and the

course they completed] information required on the identification cards and the certificates of

completion for a minimum period of seven (7) years from the date of completion. The course

provider must make these records available to the Department upon request.

DATA REPORTING

Course providers must report the number of Temporary SST, Limited SST, Full SST and Supervisory SST Cards issued.6 Additionally, the Department requires the number of total courses attendance, total personnel trained, and the total courses delivered. The SST Course Provider Submission Template is the format required by the Department for this report. These reports are due on the first (1st) of every month. This report must be emailed to [email protected] in Excel format with all the fields completed. The format below must be used for the subject when sending your email.

PART 4: PRIVACY

Privacy Principles The City of New York has an ongoing responsibility to safeguard the identifying information of its employees, officials, and members of the public that is maintained by City agencies, while also fulfilling its mandate to provide important City services and resources, which often requires the coordination and sharing of personal information across agencies and with other parties. With advances in technology, the increasing volume of electronic transactions involving such information calls for robust privacy protection and data security practices to guard against the unauthorized access, fraud, theft, and other misuse of such information.

The following privacy principles are those that City agencies abide by. The Department recommends that course provider adhere to the same principles. Privacy Principle Description Accountability City agencies should establish and implement agency privacy protection policies and protocols, develop strategies and plans to periodically assess and modify such practices as privacy and security threats emerge and evolve, and guide its covered contractors and subcontractors in such efforts. Public Trust City Agencies and their covered contractors and subcontractors should collect, use, retain, and disclose identifying information in a manner that protects an individual’s privacy interests to the greatest extent reasonable under the circumstances so that all members of the public can seek and safely access needed City services and resources, trusting that the City is appropriately safeguarding their personal information. Responsible Governance and Stewardship In delivering necessary City services and striving to improve outcomes for its residents, City agencies and their covered contractors and subcontractors should appropriately protect the privacy and security of identifying information so that such information is used collected, accessed, stored, and disclosed or otherwise shared only with authorized persons for lawful purposes. Data Quality, Integrity, and Accuracy City agencies should endeavor to maintain identifying information in a manner that protects its quality, integrity, and accuracy. Agencies should take reasonable steps to ensure that inaccurate or outdated identifying information is corrected, updated, or, where appropriate, securely disposed. Security Safeguards

PART 5: SST ID PROGRAM - FREQUENTLY ASKED QUESTIONS

Who will be issuing the Site Safety Identification Cards? Currently, SST Course Providers are authorized to issue SST ID cards. However, DOB or its designee may issue SST ID cards at a future date. What should the SST ID cards look like? DOB recommends that each card have a unique identification card number, a photo of the person to whom it was issued, the printed name and signature of the card holder, date of course completion, expiration date , name and address of provider of issuance and a summary description of the type of training and number of credit hours completed. Are QR Codes allowed on the SST ID card? QR Codes are permitted but the card should display all of the recommended elements. May I issue a digital SST ID card? Course providers may issue digital SST ID cards but they must also issue a hard copy of the SST ID. What are the expiration dates for each type of SST ID card? Generally, SST ID cards expire after 5 years. However, Temporary SST ID cards expire after 6 months and are not renewable. I am unable to verify an applicant’s OSHA training, but the OSHA card looks legitimate. Am I allowed to issue/renew an ID? No. Course Providers should attempt to use their best efforts to evaluate the authenticity of an applicant’s training. Failure to verify an applicant’s qualifications may result in suspension and/or removal from DOB’s list of approved Course Providers. A course provider should issue an SST card but should be prepared to revoke the card should it later learn of a discrepancy in the supporting documentation.
