Documents in form of DD shall be in separate envelope with cover marking “Cost of documents”.

a. The original instruments in respect of cost of documents, EMD and relevant technical bid documents etc. must be delivered to the Chief Engineer, CI&D Wing JKSPDC, Khullar Market, Sec-3, Ext. Trikuta Nagar, Jammu on or before 13-09-2013 up to 1400 Hrs. If the office happens to be closed on the date of receipt as specified, the EMD documents fee will be received on the next working day at the same time and venue.

b. Financial Bids of technically responsive bidders will opened on 16-09-2013 at 1200 hours in the Office of the Chief Engineer, CI&D Wing JKSPDC, Khullar Market, Sec-3, Ext. Trikuta Nagar, Jammu.

6. The bid for the work shall remain open for acceptance for a period of 120 days from the date of opening of bids if any bidder/tenderer withdraws his bid/tender before the said period or makes any modifications in the terms & conditions of the bid, the said earnest money shall stand forfeited.

7. No Engineer of Gazetted Rank or other Gazetted Officer employed in Engineering or Administrative Duties in an Engineering Department of the State Government is allowed to work as Contractor for a period of two years after his retirement from government services without permission of the Government. This contract is liable to be cancelled if either the Contractor or any of his employees is found at any time to be such a person who had not obtained the permission of the government as aforesaid before submission of the tender or engagement in the contractor’s service.

8. Other details can be seen in the bidding documents. 9. The work shall have to be completed in stipulated period as envisaged in the

NIT. Any delay beyond the stipulated period shall lead to a penalty of Rs.2000/= (Rupees two thousand only) per day till actual completion date.

10. Instructions to Bidders regarding E-tendering Process: a. The interested bidder can download the NIT/Bidding Document from the

website www.jktender.gov.in b. To participate in bidding process, the bidders have to get (DSC) “Digital

Signature Certificate” as per Information Technology Act-2000, to participate in online bidding. This certificate will be required for Digitally Signing the Bid. Bidders can get above mentioned Digital Certificate from any approved vendor. The bidders, who already possess valid (DSC) Digital Signature Certificate, need not to procure new Digital Signature Certificate.

c. The bidders have to submit their bids online in electronic format with Digital Signature. The bids cannot be uploaded without Digital Signature. No proposal will be accepted in physical form.

d. Bids will be opened online as per the time schedule mentioned in Para 2(C) & 5(b).

e. Before submission of online bids, bidders must ensure that scanned copy of all the necessary documents have been attached with bid.

f. The department will not be responsible for delay in online submission of bids whatsoever reasons may be.

g. All the required information for bid must be filled and submitted online.

h. Bidders should get ready with the scanned copies of the cost of documents & EMD as specified in the tender documents. The original instruments in respect of cost of documents, EMD and relevant documents be submitted to the tender inviting authority by registered-post/courier as per time schedule specified.

Details of Instructions to the Tenderers 1. All conditions laid down in PWD Form 25 (Double) and special conditions

mentioned herein along with instructions shall apply and govern the contract. These will finally form part of agreement for the work and bind the tenderers.

2. I. In case of work under tender, tenderers must quote item rate only, in the Rate List/BOQ. II. Any item required to be executed (during execution as per necessity at site of work) and not covered by SSR 2008, shall be got executed and paid as per

lowest market rate (LMR) prevailing in the vicinity after same is certified by Engineer In charge. III. Any item required to be executed (during execution as per necessity at site of work) which are covered by SSR 2008, shall be got executed and paid as per the analysis of rates and as per the market appreciation.

3. The quantities of various items of the work given in the tender document are subject to increase or decrease up to 25%. The above specified variation in quantities of items of work to be executed cannot and shall not form basis of dispute regarding the rates to be paid for or giving rise to any claim for compensation on any account. Such variations shall also form part of contract and not invalidate the contract.

4. The Engineer in charge may without invalidating the Contract and without notice to the contractor, require the Contractor to perform extra items or

quantities of work not included in the schedule of quantities and rates make changes in proposals/ specifications within the general scope of Contract or otherwise vary the work. The contractor shall perform changes and variations in the manner and to the extent specified in written orders approved by Engineer in charge/ Chief Engineer. Such items of work shall be paid as per the tendered rate/rates as envisaged in clause 2-II / III above.

5. All taxes in vogue during the contract period shall be deducted at source from the bills of contractor/firm and any increase or decrease shall be affected accordingly in the bill. No variation of any sort shall be paid whatsoever.

6. Royalty on account of stones, sand, bajri etc. utilized on the work shall be paid by the contractor himself at his own cost to the concerned corporation or the concerned lessees as the case be. All other taxes, duties, municipal taxes, toll tax etc. relevant to contract shall be paid by contractor himself and nothing extra shall be paid.

7. All cement works depending on the discretion of Engineer in charge of the works shall be tested in the Government laboratory for compressive strength test (cube testing). The contractor has to make arrangement for such tests and the cost of such tests is to be borne by him. Under specification works shall not be accepted and contractor has to rectify such works at his cost. If contractor fails to rectify such works, the same will be rectified by the department at the risk and cost of contractor.

8. Any loss or damage to work due to natural calamity or any other reason during execution of work shall be borne by the contractor.

9. If after opening of the tenders, if it is found that the rates quoted by the lowest tenderer are less by 25% of the advertised amount, the contractor shall have to provide additional security of 5% of the tendered amount in shape of the F.D.R/C.D.R pledged to Chief Pay & Accounts Officer JKSPDC Jammu till the completion of the work.

10. Key construction material to be used and arranged by the contractor for execution of work shall be as given below; A) Cement: 43 Grade OPC conforming to IS:8112-1989 (Latest Version) of

Ambuja/ACC/Ultratech Brand/make. B) Steel of all sorts: Fe-415 conforming to IS:1786-1985 (Latest Version) of

SAIL, TISCO, Rashtriya Ispat or any other ISI Brand. 11. 10% amount of the running bills due to contractor during execution of

work shall be retained as retention money and shall be released only after satisfactory completion of work and removal of defects if any and after conducting necessary repairs to the satisfaction of Engineer in charge and not earlier than 12 months from the date of satisfactory completion of work. In case of failure on part of contractor to remove defects or conduct repairs within stipulated period, the same shall be got removed or rectified by the department and its cost shall be recovered from retention money.

12. Any typographical error in respect of nomenclature/rates, the same shall be corrected and paid as per S.S.R 2008.

13. The contractor/firm shall have to execute agreement with department within seven days from issuance of allotment order. Failure of contractor to execute the agreement shall not however prevent the contract being enforced against him. No payment shall be made to contractor till the agreement is executed by him with the department.

14. Tenderers should study drawing, specifications and local conditions of work at site. It will be presumed that the tenderers have visited the site of work and tenders are based on full knowledge of working conditions prevailing at site, availability of material, water, electricity, labour, transportation facilities, probable site for labour camp and store godowns and all factors involved in execution of work.

15. The earnest money shall be forfeited without prejudice to the right and remedies available to the corporation in the event of tenderer failing to keep his tender valid and open for acceptance for and during the period of 120 days reckoned from the date of opening of tenders and or to execute a formal instrument of agreement governing the contract.

16. The tenderers are required to state their address fully and correctly in their tenders. All notices, communications and references shall have been deemed as having been delivered within seven days from the date of these notices are sent by India Post or through Courier Services by the department. Receipts issued by India Post/Courier Services shall be deemed as sufficient proof for due dispatch of all such communications.

17. The Engineer-in-charge may from time to time by directions in writing and without in any way invalidating the contract, order the contractor to suspend the work or any part thereof at such time or times and for such reasons as he may consider necessary and contractor shall not after such directions to suspend the work or any part thereof, proceed and be entitled to any claim for compensation on this account. In event of such suspension, the Chief Engineer may under the provisions of the contract extend the time of completion of the work or part thereof, by such
