Hua Hin Jazz Festival10 – 12 June @ Phonkingphet Public Park, Prachuap Khiri KhanThe annual festival draws top bands from Southeast Asia and elsewhere. About Chef Francesco GrecoFrancesco was born in Cagliari (Italy) in 1970. After his mother and grandmother, he represents the third generation of chefs in his family.

Three diplomas in culinary disciplines, a sommelier certifi cate and over 24 years of fi eld experience around the world complete his 360º view of the hospitality business.

He’s now living in Thailand, with his Thai wife and children and after seven years in Bangkok, as Executive Chef for both the Kasemkij Group and Amari Group, he has recently been appointed as the Executive Chef at Cape Sienna Hotel and Villas in Kamala, Phuket.

His refi ned yet simple style, made of the sharp fl avours of the Mediterranean traditions, united with use of the freshest local and imported products, is well represented in the scrumptious menu at Plum Fine Dining Restaurant and the tapas served at Vanilla Sky Bar.

Snow Fish

4 fi llets of around 150 gm•

Bread fl our•

25 ml extra virgin olive oil•

40 ml dry white wine•

Salt and pepper to your liking•

250 gm Italian buff alo mozzarella•

Skin and pat dry the fi llets, drench them in fl our. Heat the oil in a non sticky pan, place the fi llets and fry them gently until medium done. Add salt and pepper to your taste, pour the wine and cover. Complete the cooking at slow fi re, adding a little water if needed. Keep the remaining sauce warm. Place the fi llets in a baking tray. Place one thick slice of Mozzarella on top and bake at 180º C until the cheese gets well soft.

Zucchini

300 gm Fresh zucchini•

25 ml Extra virgin olive oil•

4 Gloves of garlic, peeled•

Salt and pepper to your liking•

Heat the oil and garlic in a fry pan. Fry the garlic until golden brown, and then remove it. Put the zucchini, sliced to 2 mm thickness, add salt and pepper to your taste and fry until well done.

Tomato fondue

4 heirloom tomatoes, well ripened, medium size•

20 gm extra virgin olive oil•

30 gm Italian basil leaves•

Salt and pepper to your liking•

With a small sharp knife, remove the stem from the tomatoes and mark the skin at the top with an “X”. Plunge the tomatoes in boiling water for about 30 seconds. The skin is now very easy to remove, under running water.

Dice the peeled tomatoes to 4 mm cubes. In a non sticky fry pan, heat the oil. Pour the tomatoes in and stir until smooth and creamy. Add salt and pepper to your taste and the basil leaves fi nely chopped.

Serving

On each large main course plate, place ¼ of the zucchini, well drained from the oil, in the middle. Place on top one snow fi sh fi llet, topped with a little of the white wine sauce. Complete the plate with ¼ of tomato fondue. Decorate with fresh Italian basil leaves and serve. A glass of fresh Soave white wine would be a perfect match.

People Profi le

Where are you from originally?Melbourne, Australian born, six generations. I have a small family, my brother, Rob lives in Mackay, my son, John, works with the Grand Hyatt in Melbourne, my 85-year-old father, Noel lives in Phuket and my husband Tom who is here in Phuket too.

What was your work background before you came to Phuket?I worked in advertising in television, radio and the print media, mainly linked to the hospitality and travel industries. I was associate publisher of Travel Week at the time it became Australia’s No 1. Travel Industry newspaper. It was owned by Peter Isaacson, one of Australia’s media icons. Because of the opportunities he gave me to travel, which few women were given in those days, I'm living in Asia today. He was my mentor. He turned 90 last year and I attended his party.

Did you travel much before you fi nally came to Phuket?For many years I travelled, mainly around the South Pacifi c and Asia, selling advertising for Travel Week Australia. Then I met my second husband, Tom Ultmann who was a hotel GM in Australia. He wanted to work in Asia and I said I'd go anywhere, but with two stipulations: fi rstly, that there was an airport and, secondly, that I was not shot at.

So when did you arrive on Phuket?Tom opened a hotel Koh Samui in 1992, and I continued working for Travel Week Australia. Then we worked in Malaysia, Philippines and came to Phuket in 1998 for three months. We established Phuket as a base, Tom returned to Manila in 2000 to do a second contract and I worked in Bangkok launching The BigChilli magazine, but we kept a house in Phuket.

When did you join Baan Rim Pa Group (BRP)In 2001, Bruce Stanley, a freelance writer, introduced me to Tom McNamara, the late founder of the group. He needed someone to sort out his advertising. I was initially not interested as I didn't think Tom and I would get on. Eventually I agreed to a maximum of three months. We did have our ups and downs. But the job grew and I stayed. It’s now 10 years.

What changes in the business have you seen in the last 10 years?There’s always a change in the type of tourists, but business doesn't change much. BRP started 21 years ago so it was already an icon when I joined. Our main business comes from tourists, groups and weddings. The other two restaurants in the group are Da Maurizio (started 17 years ago) and Joe's Downstairs (six years ago). They're wonderful restaurants and I'm proud to be a part of them.

Where do you live and why did you choose to live there?We've always lived in the Rawai / Nai Harn area and bought a villa there seven years ago. It’s our favourite part of the island.

What sort of car do you drive?A white Honda CRV. I love it. It's my baby.

What do you like most about living on Phuket?Most things! Weather, food, the lifestyle and the multi-cultural society. I enjoy staying fi t and go to the gym regularly; four years ago I started running and

will run again in Laguna’s ¼ Marathon in June. Not that I'm a good runner – I’m not, I just do it for fun.

What are the most frustrating things about living on Phuket?The traffi c, people complaining in general but specifi cally about immigration. I've never had a problem with them, in fact quite the opposite. If you treat them with respect you get it back.

What do you think the future holds for you?At this stage we're not thinking of moving anywhere, although I can't predict the future.

How would you evaluate success?Being successful in life is more important than work. I've always enjoyed working and am fortunate enough to say I've always had jobs that I liked, so I guess that's successful. I have a wonderful husband, a small but close family, good friends and a really good life on Phuket.

What do you do with your free time?I enjoy walking on Nai Harn Beach in the morning with my husband and our Doberman “Shatzi”, working with my personal trainer, dining out or just staying at home. We lead a pretty casual life.

Are you involved in any local charities, clubs or associations?Phuket Has Been Good to Us Foundation is a passion of mine. Started by my late boss Tom McNamara after the tsunami, it teaches quality English language to more than 700 under privileged Thai children in the Kalim and Kamala Kings schools. The aim is to give these children better opportunities in the future. We also run an after-school and weekend programme called “Coconut Club” for 150 of these children who live permanently at the Kamala school. They enjoy activities such as swimming, surfi ng, arts and crafts, special outings and we also have birthday parties for all these children on a monthly basis. The foundation is totally run by fundraising.

Sukko means "Beyond Happiness". My fi rst feeling when I stepped through the impressive gates of the Sukko spa was, "I’m in paradise". The Sukko staff are dressed beautifully in traditional Thai style and the spa design, infl uenced by the ancient Siamese capital, creates a haven of calm yet regal serenity. I felt I had left all my troubles behind.

Chilled out by the soothing background music, my mind was fi lled with a peaceful wellbeing as I enjoyed the warm traditional welcome (again from Sukko culture) of the ‘Flower Floating Ritual’ – similar to ‘Loy Kratong’, where the idea is to fl oat away past stresses and wish for luck and joy from that moment on.

A variety of 40 spa treatments – prepared by Sukko's certifi ed Thai Herbalist and based on ancient Thai medical theory – is off ered at Sukko, in packages lasting from 2 hours to 4 hours. Each package has a specifi c purpose and can be selected to suit your lifestyle or the way you feel on the day. These herbal recipes and procedures have been handed down through generations and are totally free of petrochemicals, synthetic perfumes or colouring. I was pampered with the ‘All-Soother’ package, a 2 1/2 hour experience that left me feeling relaxed and refreshed. Bobby Duchowny studied aromatherapy – a healing art that promotes massage, when combined with specifi c herb and spice oils, as a method to reduce stress, boost energy and heal certain physical ailments – at the American Aromatherapy Association.

PROTECTING YOUR BRAND IN THAILAND

Many foreign investors doing business in Thailand do not consider, or may not seek or are not advised on the benefi ts of registering a Trademark in Thailand with regards to protecting their brand. This is notwithstanding the ever increasing emphasis in the modern world on the importance and value of brands, and the fact that each day a business should be through its actions be improving its brand value. The publication in which this article appears is also dominated by brands.

Protection for a Trademark is provided under the Trademark Act. In Thailand Trademark law protects all the commonly protected marks, symbols and labels used for a product or a service and in addition covers three dimensional objects, groups of colors and combinations of these images.

It should be noted that in Thailand the categories under the trademark law are diff erent to other jurisdictions, providing protection for 4 categories of Trademarks as follows:

Trademark• is a mark that is used in conjunction with goods to present that such goods are diff erent from other goods;Service Mark• is a mark that is used in conjunction with a service to present that such service is diff erent from other services; Certifi cation Mark• is a mark that the owner of a product or service uses in conjunction with the product or the service to ensure quality of the product or the service; andCollective Mark• is a trademark or service mark used by a company or other associates ventures or members of an association or other organizations of public and private entities.

The procedure of registering Trademark applications is divided into 4 periods as follows;

1. Investigation and examination of the similarity and availability of trademark;

2. Submission of trademark application for the consideration of the registrar;

3. Notifi cation of status and result of the application; and

4. Registration of the trademark.

If you understand this simple process, then you will understand the process your appointed attorneys or advisers will need to undertake to assist you with protecting your brand. It is not suffi cient to ask your advisers to go ahead and register protection, but in addition you should consult with them about the marks you intend to register to ensure they are unique and will not be declined by the Registrar as unsuitable.

1. Investigation of TrademarkIt is recommended that the applicant fi ling for the registration of trademark, conduct an investigation and examination of the similarity and availability of trademark he is applying for the registration. The investigation and examination service must be conducted by the applicant himself at the competent offi ce of the Department of Intellectual Property or online as ‘Copyright Search’ at www.ipthailand.go.th.

2. Submission of trademark applicationThe applicant should provide the following documents:(a) One original registration application form (“Gor. 01”) with the signature of the authorized person and a photo of the trademark. The original application shall be submitted together with 5 copies of it.

(b) If the applicant is a juristic person, a certifi ed affi davit of the juristic person obtained from the authority no longer than six months must be submitted. Note that if the applicant resides outside of Thailand, a notary public procedure is required to certify the documents.

(c) If the applicant is a natural person, a certifi ed copy of identifi cation card is required to be submitted. Note that if the applicant resides outside of Thailand, a notary public procedure is required to certify the documents.

(d) If a proxy and/or agent is appointed to fi le the application, a copy of the

power of attorney (Gor. 19), as well as a copy of the proxy’s and/or agent’s certifi ed copy of identifi cation card must be submitted.

3. Notifi cation of status and result of the applicationAfter the application is submitted, the registrar and the offi cer shall conduct an investigation related to the qualifi cations of trademark applying for the registration. At this stage, if there is any issue or opposition from any third parties, the registrar will send the applicant with an offi cial notice informing details of such issue or opposition and provide the applicant with a time period to appeal and/or submit further documentations.If the application is completed and no opposition is fi led against the application to the registrar, the registrar shall approve the registration of the trademark and issue the certifi cate for the applicant.

4. Registration of the trademarkThe applicant or his proxy must bring together with his presence at the Department of Intellectual Property, the written notice received from the registrar in order to proceed with the registration of trademark.

Understanding the protection under lawA nuance of the law relating to infringement of these marks is that from the date of application the marks are deemed protected under law and you can enforce against third parties for infringement. The ‘catch’ is that the enforcement is only possible post-registration which makes the protection ‘retrospective’ in eff ect. Therefore, if third parties infringe your marks during registration, you can warn such parties off from infringement, but the real enforcement is delayed until the marks are properly registered. There are laws of course which also protect unregistered marks, and the laws relating to ‘passing off ’ can also be relevant.

CONCLUSIONIn the last twenty years, and as of 2011, the matter of brands has become an integral part of everybody’s lives, as the new generations make their commercial choices typically around branded products. Businesspeople creating new business or working in existing businesses should not overlook the importance of legally addressing protection of brands through trademark protection as described above.

Any person or company intending to use the procedures above should seek formal retained advice prior to proceeding.

Dim Sum: Dim Sum. This is a steamed dumpling, fi lled with a choice of every imaginable variety of sweet or savoury fi lling, sometimes accompanied by Chinese herb chicken soup and condiments.

Kanom Jin Phuket: This is a vermicelli-based dish served with a variety of curry sauces. Often eaten as breakfast, it comes with a range of fresh vegetables, boiled eggs, and curried fi sh mousse (Hor Mok).

Oh Tao: (Also known as Hoi Tod Hokgian). This is a fried oyster dish prepared with eggs, fl our, bean sprouts and taro root. It’s a favourite Phuket snack. Look for it at the Oh Tao Wongwian Restaurant, located near the Clock Tower Circle, Phuket Road, or at the Oh Tao Restaurant next to Bang Neaw Municipality School, Phuket Road.

Mee Sue: Phuket’s breakfast noodles with a salty taste and white colour when uncooked are boiled and fl avoured with oriental spices. They can be served with sliced pork or chicken accompanied by boiled rice or rice soup. Kuo Kwan Restaurant, located on Phuket Road near Robinson’s department store, is rightly famous for this simple but tasty dish.

Mee Hok Kian: This is made with large yellow noodles similar to Japanese Soba. Mee Hok Kian can be served with pork-bone soup and/or dried noodles. A delightful variety known as Mee Hok Kian Pak includes fried noodles, soup, egg, fried onions, pork crackling and a choice of pork, fi sh or squid. Recommended Mee Hok Kian restaurants are Mee Ao Gay, located on Poonpol Road, and Mee Sapam at Sapam Village, Thepkasattri Road. Clock Tower Circle, Phuket Road, or at the Oh Tao Restaurant next to Bang Neaw Municipality School, Phuket Road.

Try the Local Food.The island has a unique cuisine and both its entrées and desserts are a combination of local and Chinese cooking styles. View Antique Buildings.A hundred years ago, Phuket City had a prosperous economy based on tin mining, and even back then was an international centre with a large expatriate community of Chinese and Europeans. They built beautiful homes in the style called Sino-Portuguese – terraced townhouses with narrow frontages and accommodations which stretch back from the road. The interiors often include walled gardens and fountains, and are beautifully furnished with antiques and Chinese inspired decorations. Rommanee Road is a fi ne example which has been fully restored. Visit Talang Road, Yaowarat Road and Dibuk Road. Nowadays, these streets in the Chinese quarter have transformed themselves into busy thoroughfares featuring antique shops, speciality restaurants and more.

The Provincial Hall, the Phuket Courthouse and the town branch of the Siam City Bank are further examples of architecture from the past. All well worth a visit.

the valley. The whole area is surrounded by palm trees and lush vegetation and it’s a really relaxing place.

Clients often ask me to explain the diff erent forms of ownership available in Thailand and I try to make it as simple as possible without leaving out the essentials. There are websites that claim to explain this but the information is often outdated, incorrect or impossible to understand. The following is a simple-to-follow brief of the methods of ownership available to foreigners.

1. Foreign Freehold Condominium This is a simple method by which a foreigner can obtain outright freehold ownership of a “condo” in Thailand. It's only available for those properties that properly constitute a condominium under the rules of the Condominium Act. When a building has been designated as falling within the Condominium Act an area amounting to 49% of the total can be made available to foreigners. Once the 49% has been taken the remaining units cannot be sold as foreign freehold; it's either necessary to form a Thai company to purchase a unit or it may be possible to take a lease upon the unit. The 51% cannot be purchased freehold by a foreign individual. Rumours suggest the Thai government will increase the percentages for foreign ownership but certainly nothing is likely to happen until after the elections.

This is not a problem in Bangkok or, to a lesser extent, Pattaya but it can make selling the Thai quota more diffi cult in Phuket. You'll often fi nd developers willing to off er incentives to sell the 51% and this has created a virtual two-tier pricing within the same development which continues through to resales. If the Thai quota is changed it could turn out to be highly advantageous to those buyers who chose to take the Thai quota at the lower price.

The costs of registration or transfer of a foreign freehold condominium are higher than those of a leasehold property and usually amount to about 6%. These costs can vary and are split into sellers and buyers fees, but it's quite common for both parties to simply split the fees.

2. Leasehold or “Protected Leasehold” Historically the length of a single lease in Thailand is no more than 30 years, making it necessary to create a contractual obligation within the leasehold agreement for two further terms of 30 years, making a total of 90 years. A typical leasehold for an apartment or condo (architecturally there is no diff erence) in many parts of the world would be for a similar period. The leasehold structure is also the most common choice when it comes to purchasing a villa within a development. Resort developments use the leasehold structure as most of the common areas fall under the resort management whereas in a condominium building these form part of the Condominium Juristic Entity or CJE and are the condo owners’ collective responsibility. A Protected Leasehold

is simply in addition to owning the lease the buyer also owns a share in the Thai Company that owns the land the building stands on thereby protecting the lease in perpetuity as he would, in eff ect, become his own landlord. Under Thai law foreigners cannot own land however a Thai company can and the ownership can be controlled through preferential shareholding which to all intents and purposes is the same as owning it. The Thai Company, of which the individual leaseholder of the villa or apartment becomes an equal shareholder, is controlled by the leaseholders collectively. Transfer fees and taxes relating to leasehold properties are generally cheaper than those relating to the sale of a foreign freehold condominium.

3. Thai Company Thai companies are often used when a buyer wishes to obtain the freehold of land, a villa or an apartment. He may choose to use this in conjunction with a lease whereby he leases the land, villa or apartment from the Thai company for additional protection. Setting up a Thai company is a fairly simple and inexpensive process. Taking over an existing Thai company is a straightforward process, however due diligence on the company should be carried out by a lawyer to ensure the company is free from encumbrance – normal practice anywhere in the world.

4. Off shore Companies You may see a BVI (British Virgin Island Company) or some other off shore entity interjected to purchase any of the above. This is not a tax dodge or a means by which the owner can be invisible (though some owners may see an advantage in remaining anonymous) but can be a tax effi cient way to own any of the above. The advantage being that when the owner decides to sell, he only needs to sell the shares within the off shore company as it's the company that owns the asset and not he as an individual. Any subsequent sale can take place off shore in any currency the parties choose. There's a relatively small cost of setting up the off shore company and maintaining it.

And that’s it in brief. I have tried to condense years of understanding and experience into a few paragraphs but I believe the main points are contained herein.

Rabies is a viral disease which aff ects the central nervous system, essentially the brain and spinal cord and is transmitted from infected mammals to humans. Once symptoms appear in humans who have not been vaccinated, the disease is invariably fatal. The good news for my friend, and others, is there have been no human deaths from rabies in Phuket for over 20 years.

All mammals, including humans are susceptible to rabies. In Phuket, cats, dogs and monkeys are the most likely mammal to contract and pass on the disease to humans, and it’s important to understand that humans can only contract rabies through exposure to a rabid animal. Exposure is nearly always through a bite, but rabies can also be transmitted if a rabid animal scratches a person or if its saliva comes into contact with broken skin.

RabiesRecently a friend, whilst riding his bike, was bitten rather severely by a dog here in Phuket. Apart from the trauma of the dog bite, which was bad enough, he was quite concerned about rabies.

To decrease the likelihood of getting rabies, it's best to minimise any exposure to animals that may have the disease – and this certainly includes any wild animal, including stray dogs and cats which are acting abnormally. The Thai authorities are also reducing the risk by vaccinating dogs and cats, and if you have a pet, you should ensure that it has been vaccinated. Keeping exotic or wild animals as pets should be discouraged, as is having your photo taken with wild animals on Bangla Road and at other tourist areas.

If you are bitten, or believe you've been exposed, immediately clean the area with lots of soap and water and see a doctor as soon as possible. It's likely that the doctor will recommend a course of rabies injections, possibly including a vaccine and Rabies Immune Globulin, depending on whether you've been vaccinated before. These injections are not as painful as common myth has led some people to believe, but they are expensive. You'll also need to attend a hospital or clinic on fi ve occasions, as the course requires fi ve injections over a 28 day period.

It's very rare in Phuket for the observation or testing of an animal to rule out the possibility of rabies. In some other countries, authorities may catch the animal and keep it under observation to see if it develops rabies and only then do the bite victims get their rabies shots. Another option is to kill the animal and examine the brain tissue to eliminate or confi rm rabies. Again this is rarely done here in Phuket and you're more likely to just get the rabies shots.

If you get rabies, the early symptoms include irritability, headache, fever and sometimes itching or pain at the site of exposure. The disease eventually progresses to spasms of the throat and the muscles used for breathing, convulsions, delirium, paralysis and eventually death. Remember, by the time any symptoms appear, rabies cannot be successfully treated. Usually the time between exposure and the onset of symptoms is two to ten weeks, although much longer time periods have been reported.

There's also a vaccine that's given to people who are at risk of getting rabies, for example veterinarians and those who work with wild animals. In some countries being vaccinated for rabies before coming to Thailand is recommended by health offi cials, although this is not really necessary, unless you intend to work with wild animals.

It’s good to know that rabies is not a serious disease in Phuket, but the possibilities of contracting the disease still exist. It’s also nice to know that exposure to a rabid animal does not always result in rabies. If preventive treatment is obtained promptly following a rabies exposure, nearly all cases of rabies will be prevented. However, if preventive treatment is not administered and signs of rabies develop, the disease is invariably fatal. Most doctors here in Phuket therefore recommend that all bites from animals where you're unsure if they've been vaccinated should be evaluated by a qualifi ed expert or doctor.
