    LAW ENFORCEMENT CODE OF ETHICS - 2

    LAW ENFORCEMENT CODE OF ETHICSAs a law enforcement officer, my fundamental duty is to serve the community; to safeguardlives and property; to protect the innocent against deception, the weak against oppression orintimidation and the peaceful against violence or disorder; and to respect the constitutional rightsof all to liberty, equality and justice.

    I will keep my private life unsullied as an example to all and will behave in a manner that doesnot bring discredit to me or to my agency. I will maintain courageous calm in the face of danger,scorn or ridicule; develop self-restraint; and be constantly mindful of the welfare of others. Honestin thought and deed both in my personal and official life, I will be exemplary in obeying the lawand the regulations of my department. Whatever I see or hear of a confidential nature or that isconfided to me in my official capacity will be kept ever secret unless revelation is necessary inthe performance of my duty.

    I will never act officiously or permit personal feelings, prejudices, political beliefs, aspirations,animosities or friendships to influence my decisions. With no compromise for crime and withrelentless prosecution of criminals, I will enforce the law courteously and appropriately withoutfear or favor, malice or ill will, never employing unnecessary force or violence and never acceptinggratuities.

    I recognize the badge of my office as a symbol of public faith, and I accept it as a public trust to beheld so long as I am true to the ethics of police service. I will never engage in acts of corruptionor bribery, nor will I condone such acts by other police officers. I will cooperate with all legallyauthorized agencies and their representatives in the pursuit of justice.

    I know that I alone am responsible for my own standard of professional performance and will takeevery reasonable opportunity to enhance and improve my level of knowledge and competence.

    I will constantly strive to achieve these objectives and ideals, dedicating myself before God to mychosen profession . . . law enforcement.

    Law Enforcement Authority100.1 PURPOSE AND SCOPELaw enforcement officers are granted the authority to perform their function based on establishedlegal authority. This Office does not tolerate abuse of law enforcement authority.

    100.2 PEACE OFFICER POWERSSworn members of this Office shall be considered peace officers pursuant to Penal Code § 830.1.The authority of any such peace officer extends to any place in the State of California, as follows:

    (a) As to any public offense committed or which there is probable cause to believe hasbeen committed within the political subdivision which employs the peace officer; or

    (b) Where the peace officer has the prior consent of the chief of police, or personauthorized by him or her to give consent, if the place is within a city or of the sheriff, orperson authorized by him or her to give such consent, if the place is within a county; or

    (c) As to any public offense committed or which there is probable cause to believe hasbeen committed in the peace officer's presence, and with respect to which there isimmediate danger to person or property, or of the escape of the perpetrator of theoffense.

    100.2.1 DELIVERY TO NEAREST MAGISTRATEWhen a deputy makes an arrest pursuant to a warrant with bail set, and the warrant was issued ina county other than where the person was arrested, the deputy shall inform the person in writingof the right to be taken before a magistrate in the county where the arrest occurred (Penal Code§ 821; Penal Code § 822).

    100.2.2 TIME OF MISDEMEANOR ARRESTSDeputies shall not arrest a person for a misdemeanor between the hours of 10:00 p.m. of any dayand 6:00 a.m. of the next day unless (Penal Code § 840):

    (a) The arrest is made without a warrant pursuant to Penal Code § 836 which includes:

    1. A misdemeanor committed in the presence of the deputy.

    2. Misdemeanor domestic violence offenses (See the Domestic Violence Policy).

    (b) The arrest is made in a public place.

    (c) The arrest is made with the person in custody pursuant to another lawful arrest.

    (d) The arrest is made pursuant to a warrant which, for good cause shown, directs that itmay be served at any time of the day or night.

    100.2.3 OREGON AUTHORITYSworn members of this [department/office] who enter the state of Oregon in order to provideor attempt to provide law enforcement assistance have Oregon peace officer authority within

    50 miles from the California-Oregon border (ORS 133.405). Such authority shall only applywhen deputies are acting:

    (a) In response to a request for law enforcement assistance initiated by an Oregon sheriff,constable, marshal, municipal police officer or member of the Oregon State Police.

    (b) In response to a reasonable belief that emergency law enforcement assistance isnecessary to preserve life, and circumstances make it impractical for Oregon lawenforcement officials to formally request assistance.

    (c) For the purpose of assisting Oregon law enforcement officials with emergencyassistance in response to criminal activity, traffic accidents, emergency incidentsor other similar public safety situations, regardless of whether an Oregon lawenforcement official is present at the scene of the incident.

    San Luis Obispo County Sheriff's Office deputies have no authority to enforce Oregon traffic ormotor vehicle laws.

    Whenever practicable, deputies should seek permission from a [department/office] supervisorbefore entering Oregon to provide law enforcement services. As soon as practicable, deputies exercising law enforcement authority in Oregon shall submit any appropriate written reportsconcerning the incident to the Oregon agency having primary jurisdiction over the area in whichthe incident occurred.

    100.3 CONSTITUTIONAL REQUIREMENTSAll employees shall observe and comply with every person’s clearly established rights under theUnited States and California Constitutions.

    Chief Executive Officer102.1 PURPOSE AND SCOPEThe California Commission on Peace Officer Standards and Training (POST) has mandated thatall sworn officers and dispatchers employed within the State of California shall receive certificationby POST within prescribed time periods.

    102.1.1 CHIEF EXECUTIVE OFFICER REQUIREMENTSAny chief executive officer of this Office appointed after January 1, 1999, shall, as a condition ofcontinued employment, complete the course of training prescribed by POST and obtain the BasicCertificate by POST within two years of appointment.

    102.1.2 SHERIFF CANDIDATE REQUIREMENTSPrior to filing for the office of Sheriff, any candidate shall at minimum meet the requirements ofGovernment Code § 24004.3.

    Oath of Office104.1 PURPOSE AND SCOPEDeputies of the Sheriff's Office are sworn to uphold the federal and state constitutions and toenforce federal, state and local laws.

    104.1.1 OATH OF OFFICEUpon employment, all sworn employees shall be required to affirm the oath of office expressingcommitment and intent to respect constitutional rights in discharging the duties of a lawenforcement officer (Cal. Const. Art. 20, § 3; Government Code § 3102). The oath shall be asfollows:

    I, [employee name], do solemnly swear (or affirm) that I will support and defend the Constitutionof the United States and the Constitution of the State of California against all enemies, foreignand domestic; that I will bear true faith and allegiance to the Constitution of the United Statesand the Constitution of the State of California; that I take this obligation freely, without any mentalreservation or purpose of evasion; and that I will well and faithfully discharge the duties uponwhich I am about to enter.

    Policy Manual106.1 PURPOSE AND SCOPEThe manual of the San Luis Obispo County Sheriff's Office is hereby established and shall bereferred to as "The Policy Manual." The Policy Manual is a statement of the current policies,procedures, rules, and guidelines of the Sheriff's Office. All employees are to conform to theprovisions of this manual. All prior and existing manuals, orders, and regulations which are inconflict with this manual are revoked, except to the extent that portions of existing manuals, orders,and other regulations which have not been included herein shall remain in effect where they donot conflict with the provisions of this manual.

    Except where otherwise expressly stated, the provisions of this manual shall be considered asguidelines. It is recognized, however, that police work is not always predictable and circumstancesmay arise which warrant departure from these guidelines. It is the intent of this manual to be viewedfrom an objective standard, taking into consideration the sound discretion entrusted to membersof the Sheriff's Office under the circumstances reasonably available at the time of any incident.

    106.2 POLICYExcept where otherwise expressly stated, the provisions of this manual shall be consideredas guidelines. It is recognized that the work of law enforcement is not always predictable andcircumstances may arise which warrant departure from these guidelines. It is the intent of thismanual to be viewed from an objective standard, taking into consideration the sound discretionentrusted to members of this department under the circumstances reasonably available at thetime of any incident.

    106.2.1 DISCLAIMERThe provisions contained in the Policy Manual are not intended to create an employment contractnor any employment rights or entitlements. The policies contained within this manual are for theinternal use of the San Luis Obispo County Sheriff's Office and shall not be construed to createa higher standard or duty of care for civil or criminal liability against the County, its officials ormembers. Violations of any provision of any policy contained within this manual shall only formthe basis for department administrative action, training or discipline. The San Luis Obispo CountySheriff's Office reserves the right to revise any policy content, in whole or in part.

    106.2.2 EXECUTIVE STAFF

    Staff shall consist of the following:

    • Sheriff

    • Undersheriff

    • The Chief Deputies from the field operations and investigative services bureaus

    • The Correctional Captain from the custody bureau

    The staff shall review all recommendations regarding proposed changes to the manual at staffmeetings.

    106.3 AUTHORITYThe Sheriff shall be considered the ultimate authority for the content and adoption of the provisionsof this manual and shall ensure compliance with all applicable federal, state and local laws. TheSheriff or the authorized designee is authorized to issue Departmental Directives, which shallmodify those provisions of the manual to which they pertain. Departmental Directives shall remainin effect until such time as they may be permanently incorporated into the manual.

    106.3.1 DISTRIBUTION OF MANUAL

    Hard Copies of the Policy Manual shall be distributed to the following:

    • Watch Commander's Office

    • Custody Sergeant's Office

    • Custodian of Records

    A computerized version of the Policy Manual will be made available on the Department network/Intranet for access by all employees. The computerized version will be limited to viewingand printing of specific sections. No changes shall be made to the electronic version withoutauthorization from Sheriff

    106.4 DEFINITIONSThe following words and terms shall have these assigned meanings throughout the Policy Manual,unless it is apparent from the content that they have a different meaning:

    Adult - Any person 18 years of age or older.

    Auxiliary Member - A member of an organization approved by the Sheriff who volunteers servicesto benefit the Sheriff's Office and the community.

    CCR - California Code of Regulations (Example: 15 CCR 1151).

    CHP- The California Highway Patrol.

    CFR - Code of Federal Regulations.

    County - The County of San Luis Obispo.

    Correctional Deputy- A member of the Sheriff's Office who is classified as a "Safety Member,"who has peace officer powers under PC 830.1(c)

    Non-sworn - Employees and volunteers who are not sworn peace officers.

    Department/SLOSO - The San Luis Obispo County Sheriff's Office.

    Deputy Sheriff - Those employees, regardless of rank, who are sworn employees under PenalCode section 830.1/830.1(c) of the San Luis Obispo County Sheriff's Office, unless specificallyidentified as exclusive to Correctional Deputy.

    Dispatcher - Those employees assigned to the Sheriff's Office dispatch/communication center.

    DMV - The Department of Motor Vehicles.

    Emergency Order - A temporary order developed to deal with a contingency, and effective andenforceable for the length of the contingency only. This order does not require changes to theManual or Operational Directives

    Employee/personnel - Any person employed by the Sheriff's Office.

    Immediately - Without delay

    Juvenile- Any person under the age of 18 years.

    Lead Worker - An employee who, by assignment, is directly responsible for the successfulcompletion of a task. Responsible for training and evaluation of trainee's performance within adefined training program

    Managers - Undersheriff, Chief Deputies, Correctional Captain, Commanders, CorrectionalLieutenants and other FSLA - exempt employees

    Manual - The San Luis Obispo County Sheriff's Office Policy Manual.

    May - Indicates a permissive, discretionary or conditional action.

    Member - Any person employed or appointed by the San Luis Obispo County Sheriff's Office,including full-time sworn deputies, reserve deputies, non-sworn employees and volunteers.

    On Duty - A member's status during the period when he/she is actually engaged in theperformance of his/her assigned duties.

    Order - A written or verbal instruction issued by a superior.

    POST - The California Commission on Peace Officer Standards and Training.

    Professional Staff - All members of the Sheriff's Office not classified as "Safety Member"

    Rank - The title of the classification held by a deputy.

    Reserve Deputy - A member of the Sheriff's Office who volunteers services or is compensatedhourly and has peace officer powers (Penal Code Section 830.6)

    Safety Member - A person covered under San Luis Obispo County's Safety Retirement

    Shall or will - Indicates a mandatory action.

    Should - Indicates a generally required or expected action, absent a rational basis for failing toconform.

    Special Order - A temporary order to deal with a contingency for which a policy or OperationalDirective does not exist.

    Subordinate - A person who is responsible to, and receives direction from, a Sheriff's Officeemployee of higher rank

    Supervisor - An employee responsible for training and evaluating performance of subordinates,successful completion of assigned tasks, and accomplishment of day-to-day operations within adivision

    Watch Commander - A Sergeant or Commander who, by assignment, is responsible forsupervision of Sheriff's personnel and other resources during their shift

    USC - United States Code.

    106.5 ISSUING THE POLICY MANUALAn electronic version of the Policy Manual will be made available to all members on the departmentnetwork for viewing and printing. No changes shall be made to the manual without authorizationfrom the Sheriff or the authorized designee.

    Each member shall acknowledge that he/she has been provided access to, and has had theopportunity to review the Policy Manual and Departmental Directives. Members shall seekclarification as needed from an appropriate supervisor for any provisions that they do not fullyunderstand.

    106.6 PERIODIC REVIEW OF THE POLICY MANUALThe Sheriff will ensure that the Policy Manual is periodically reviewed and updated as necessary.

    106.7 REVISIONS TO POLICIESAll revisions to the Policy Manual will be provided to each member on or before the date the policybecomes effective. Each member will be required to acknowledge that he/she has reviewed therevisions and shall seek clarification from an appropriate supervisor as needed.

    Members are responsible for keeping abreast of all Policy Manual revisions.

    Each Bureau Chief will ensure that members under his/her command are aware of any PolicyManual revision.

    All department members suggesting revision of the contents of the Policy Manual shall forwardtheir written suggestions to their Bureau Chiefs, who will consider the recommendations andforward them to the command staff as appropriate.

    Organizational Structure and Responsibility200.1 PURPOSE AND SCOPEThe organizational structure of the Sheriff's Office is designed to create an efficient means toaccomplish our mission and goals and to provide for the best possible service to the public.

    200.2 BUREAUSThe Sheriff is responsible for administering and managing the San Luis Obispo County Sheriff'sOffice. There are three Bureaus in the Sheriff's Office as follows:

    • Investigative Services Bureau

    • Field Operations Bureau

    • Custody Bureau

    200.2.1 INVESTIGATIVE SERVICES BUREAUThe Investigative Services Bureau commanded by a Chief Deputy whose primary responsibilityis to provide general management direction and control for the Investigative Services Bureau.The Investigative Services Bureau consists of the Detective Division, Coroner's Unit, SpecialOperations Section (SOU/GTF), Civil Enforcement Division/Court Security, Property Office, andAdministrative Services.

    200.2.2 FIELD OPERATIONS BUREAUThe Field Operations Bureau commanded by a Chief Deputy whose primary responsibility isto provide general management direction and control for that bureau. The Operations Bureauconsists of Patrol Divisions, Patrol Headquarters and Auxiliary units such as Search and Rescue,Posse, Aero Squadron, Dive Team, and Sheriff's Auxiliary Volunteer Patrol (SAVP).

    200.2.3 CUSTODY BUREAUThe Custody Bureau is commanded by a Correctional Captain whose primary responsibility is toprovide general management direction and control for the Custody Bureau. The Custody Bureauconsists of the Jail, Honor Farm, and Court Transportation.

    200.3 COMMAND PROTOCOL

    200.3.1 SUCCESSION OF COMMAND

    The Sheriff exercises command over all personnel in the Sheriff's Office. During planned absencesthe Sheriff will designate the Undersheriff to serve as the acting Sheriff. Except when designatedas above, the order of command authority in the absence or unavailability of the Sheriff is asfollows:

    200.3.2 UNITY OF COMMANDThe principles of unity of command ensure efficient supervision and control within the Sheriff'sOffice. Generally, each employee shall be accountable to one supervisor at any

    time for a given assignment or responsibility. Except where specifically delegated authority mayexist by policy or special assignment (e.g., K-9, SED,SOU), any supervisor may

    temporarily direct any subordinate if an operational necessity exists.

    200.3.3 ORDERSMembers shall respond to and make a good faith and reasonable effort to comply with the lawfulorder of superior officers and other proper authority.

    200.3.4 CHAIN OF COMMANDCommunication within the Sheriff's Office shall follow the chain of command. Each echelon shallforward communications via the chain of command to the addressee, with recommendations ifappropriate. In the absence of a staff position, the communication

    Organizational Staffing201.1 PURPOSE AND SCOPEThis section lists Sheriff's Office job positions and a brief description of the position responsibilities.This does not reflect the Sheriff's Office chain of command

    201.1.1 SHERIFF

    (a) The Sheriff is Chief Executive Officer of the Sheriff's Office. He will establish policy,organizational structure, and discharge duties imposed on him by law and in theinterest of public safety.

    (b) Administers Sheriff's Office activity through managers who serve in an advisorycapacity for matters of general Sheriff's Office policy and procedure. These managersdirect and control specific functions of the Office in a manner approved by the Sheriff.

    201.1.2 UNDERSHERIFFSubordinate only to the Sheriff; assumes command of the Office in the absence of the Sheriff,manages, directs and administers the activities of the Sheriff's Office at the executive level; anddirectly supervises Chief Deputies.

    201.1.3 CHIEF DEPUTY/CORRECTIONAL CAPTAINUnder direction of the Sheriff and Undersheriff, a Chief Deputy plans, organizes, controls anddirects the activities of a bureau or function of the Sheriff's Office at the executive managementlevel or command; coordinates and directs communications, resources, and personnel in supportof law enforcement activities; supervises and evaluates the performance of assigned personnel;and does other related work as required. Under direction of the Sheriff and Undersheriff theCorrectional Captain plans, organizes, controls and directs the activities of the Custody Bureauat the executive management level or command; supervises and evaluates the performance ofassigned custody personnel and does other work as required.

    201.1.4 COMMANDERUnder direction, plans, organizes and directs the operations and activities of an assigned division,station or shift of the Sheriff's Office; supervises and evaluates the performance of assignedpersonnel.

    201.1.5 SERGEANTA supervisor responsible for developing subordinate compliance with Office policies and rules;conducting inspections as necessary to ensure that compliance.

    201.1.6 SENIOR DEPUTYAssigned to all areas of investigation, identification, field training, and other specialty assignments;will serve as a lead worker when teamed with Deputy Sheriffs.

    201.1.9 CORRECTIONAL SERGEANTA supervisor responsible for developing subordinate compliance with Office policies and rules;conducting inspections as necessary to ensure compliance.

    201.1.10 SENIOR CORRECTIONAL DEPUTYWill serve as a lead worker when teamed with Correctional Deputy; may act as a supervisor in theabsence of a Correctional Sergeant. Responsible for on the job training of Correctional Deputy.

    201.1.11 CORRECTIONAL DEPUTYUnder general supervision, receive, process, transport, monitor, and care for County Jail prisoners(PC 830.1 (c))

    201.1.12 ACCOUNT CLERKUnder general supervision; performs routine and repetitive clerical accounting functions involvingbalancing and reconciling; and does other related work as required.

    201.1.13 ACCOUNTANT I/II/IIIPerforms accounting and budgetary work involved in establishing, analyzing, auditing, reconcilingand maintaining financial records in support of designated programs; provides support in thepreparation, analysis and monitoring of annual budget and accounts

    201.1.14 ACCOUNTING TECHNICIANUnder direction, independently performs complex and responsible paraprofessional accountingwork; is assigned the overall technical responsibility for the financial operation of a majoraccounting system or entity.

    201.1.19 CAL-ID PROGRAM COORDINATORUnder direction of the Field Operations Bureau Chief, organizes and directs the activities of theCalifornia Identification system; develops and implements training programs for County criminaljustice agencies; operates automated technical identification systems.

    201.1.20 COOK I/II/IIIPrepares and cooks food; cleans work area, dishes and equipment; serves food, maintains recordsof diets, and supervises minimum security inmates in the performance of food preparation andserving operations.

    201.1.21 CORRECTIONAL TECHNICIANUnder general supervision, performs a variety of clerical and technical duties in support ofCorrectional Deputies.

    201.1.22 CRIME PREVENTION SPECIALISTUnder direction of the Patrol Headquarter Division Commander, coordinates and delivers crimeprevention programs; assists in public relations and community service activities for the Sheriff'sOffice.

    201.1.23 DEPARTMENTAL AUTOMATION SPECIALISTUnder direction, assists in the implementation and utilization of automated systems andequipment. Provides personal computer (PC) training.

    201.1.24 DEPARTMENT PERSONNEL TECHNICIAN-CONFIDENTIALActs as confidential assistant to Administration. Provides administrative support, assists in thepersonnel functions for all employees, and contributes to administration of employer-employeerelations.

    201.1.32 SENIOR CORRECTIONAL TECHNICIANProvide lead support for Correctional Technicians, performs a variety of clerical and technicalduties in support of Correctional Officers.

    201.1.33 SENIOR DISPATCHERPerforms the duties of a Dispatcher and, as directed, serves as a trainer/lead worker in theCommunications Center.

    201.1.34 SENIOR SOFTWARE ENGINEERUnder general direction, conducts comprehensive systems analysis studies; coordinates andadministers information technology software/hardware products and solutions to customerdepartments; develops and conducts training for software and hardware usage; recommends,oversees, develops and implements database policies and procedures and ensure data integrity;may act in a lead capacity over lower level staff; may handle coordination of projects betweendepartments; oversees projects and provides training and work direction to subordinate personnel;performs project management; may act as a team leader; provides input to performanceevaluations prepared by the supervisor.

    Supervision203.1 COMMAND STRUCTURELines of control which permit the delegation of authority, placing of responsibility, supervision ofoperations, and coordination of effort are established by the Sheriff's Office Organizational Chart.

    203.2 RESPONSIBILITY FOR SUPERVISIONEach supervisor shall, by act, manner, and attitude, promote understanding of Sheriff's Officepolicies, rules, and procedures; shall convey intent and spirit of Orders and Directives tosubordinates; strive to create and maintain high morale

    203.3 ACCOUNTABILITYSupervisors shall take reasonable steps to determine that each employee under their supervisionperforms duties completely and promptly; accountable for proper execution of every order,whether by personal presence, rules, instructions given, or delegation of authority.

    203.3.1 EXERCISE OF AUTHORITYAn employee shall exercise the authority of their position, with firmness and impartiality, in thebest interest of the Sheriff's Office.     203.3.2 TRAININGSupervisors shall develop an employee's effectiveness, skills and knowledge through training,exemplifying the ideals and objectives of the Office by personal conduct

    203.3.9 AUTHORITYAuthority delegated or granted to supervisors is not confined to their respective divisions. However organizational authority should follow the chain of commandwithin respected bureaus and divisions. The Sheriff's watch commander has authority over allemployees in the absence of a sheriff's manager. Sworn peace officers (Penal Code 830.1) mayonly be supervised by supervisors who also are sworn peace officers under Penal Code section830.1.

    203.3.10 DELEGATION OF AUTHORITYEach supervisor may delegate work to subordinates for maximum efficiency. This delegation doesnot relieve a supervisor of responsibility for proper accomplishment of the work and performanceof subordinates.

    203.3.11 PERFORMANCE INSPECTIONSSupervisors shall conduct frequent but random inspections of subordinates and their workproduct to ensure compliance with law, this Manual, applicable Operational Directives, and Officeprocedures. Supervisors detecting noncompliance will take immediate corrective steps to include,as appropriate, initiation of disciplinary action. Additionally, supervisors observing noncomplianceby employees subordinate to others will take immediate corrective steps to include writtennotification to the employee's supervisor.

    Emergency Management Plan - 30

    Emergency Management Plan206.1 PURPOSE AND SCOPEThe County has prepared an Emergency Management Plan for use by all employees in the eventof a major disaster or other emergency event. The plan provides for a strategic response by allemployees and assigns specific responsibilities in the event that the plan is activated (GovernmentCode § 8610).

    206.2 ACTIVATING THE EMERGENCY PLANThe Emergency Management Plan can be activated on the order of the official designated bylocal ordinance.

    206.2.1 RECALL OF PERSONNELIn the event that the Emergency Management Plan is activated, all employees of the San LuisObispo County Sheriff's Office are subject to immediate recall. Employees may also be subject torecall during extraordinary circumstances as deemed necessary by the Sheriff or the authorizeddesignee.

    Failure to promptly respond to an order to report for duty may result in discipline.

    206.3 LOCATION OF THE PLANThe Emergency Management Plan is available in the Watch Commander's office. All supervisorsshould familiarize themselves with the Emergency Management Plan. The Headquarter'sCommander should ensure that department personnel are familiar with the roles police personnelwill play when the plan is implemented.

    206.4 UPDATING OF MANUALSThe Sheriff or designee shall review the Emergency Management Plan Manual at least once everytwo years to ensure that the manual conforms to any revisions made by the National IncidentManagement System (NIMS) and the Standardized Emergency Management System (SEMS)and should appropriately address any needed revisions.

    Training Policy208.1 PURPOSE AND SCOPEIt is the policy of the Sheriff's Office to administer a training program that will provide for theprofessional growth and continued development of its personnel. By doing so, the Sheriff's Officewill ensure its personnel possess the knowledge and skills necessary to provide a professionallevel of service that meets the needs of the community.

    208.2 PHILOSOPHYThe Sheriff's Office seeks to provide ongoing training and encourages all personnel to participatein advanced training and formal education on a continual basis. Training is provided within theconfines of funding, requirements of a given assignment, staffing levels, and legal mandates.Whenever possible, the Sheriff's Office will use courses certified by the California Commissionon Peace Officer Standards and Training (POST) and the California Standards and Training forCorrections.

    208.3 OBJECTIVESThe objectives of the Training Program are to:

    (a) Enhance the level of law enforcement service to the public

    (b) Increase the technical expertise and overall effectiveness of our personnel

    (c) Provide for continued professional development of Sheriff's Office personnel

    208.3.1 TRAINING REQUESTAll requests for training shall be submitted on the "Sheriff's Office Training Request" form.

    (a) All training requests will conform to the following guidelines:

    1. Requests will be submitted to the Training Unit a minimum of 10 business daysprior to the starting date of the requested course.

    2. The request section is to be filled out completely by one of the followingpersonnel:

    (a) Individual to attend training.

    (b) Individual's supervisor.

    (c) Training Manager.

    3. The request section is to be signed by requestor and forwarded to employee'ssupervisor with a copy of the course flyer attached.

    (b) Supervisor will recommend approval or denial, sign and date the Supervisor'sRecommendation section, then forward to division commander.

    (c) Division commander will recommend approval or denial, sign and date the divisioncommander's recommendation section, then forward to Training Unit.

    (d) Training manager will complete the Training Unit section as follows:

    (a) Enter the title and date of the most recent training completed by the requestingemployee, and the date when Advanced Officer Training (A.O.T.) must becompleted.

    (b) Enter related costs for the course being requested (i.e., tuition, lodging, meals,travel), whether budgeted for, if funds are available, the total estimated cost, ifspace is available, the POST or STC certification number (if applicable), and thenumber of hours in the course.

    (c) Training manager will sign and date this section, then forward the request to theappropriate bureau chief.

    (e) Bureau Chief will recommend approval or denial, sign and date the bureau chief'srecommendation section, then forward to Undersheriff.

    (f) Undersheriff will approve or deny request, sign and date in the undersheriff section,and return request to Training Unit.

    (g) If request is approved, Training Unit will schedule training. If denied, Training Unit willnotify requestor.

    208.4 TRAINING PLANA training plan will be developed and maintained by the Training Manager. It is the responsibilityof the Training Manager to maintain, review, and update the training plan on an annual basis. Theplan will address the following areas:

    State Mandated Training

    Critical Issues Training

    208.5 TRAINING NEEDS ASSESSMENTThe Training Unit will conduct an annual training-needs assessment of the Office. The needsassessment will be reviewed by executive staff. Upon approval by the executive staff, the needsassessment will form the basis for the training plan for the fiscal year.

    208.6 TRAINING COMMITTEEThe Training Manager shall establish a Training Committee, which will serve to assist withidentifying training needs for the Office.

    The Training Committee shall be comprised of at least three members, with the senior rankingmember of the committee acting as the chairperson. Members should be selected based on theirabilities at post-incident evaluation and at assessing related training needs.

    The Training Committee should review certain incidents to determine whether training would likelyimprove future outcomes or reduce or prevent the recurrence of the undesirable issues related tothe incident. Specific incidents the Training Committee should review include, but are not limited to:

    (a) Any incident involving the death or serious injury of an employee.

    (b) Incidents involving a high risk of death, serious injury or civil liability.

    (c) Incidents identified by a supervisor as appropriate to review to identify possible trainingneeds.

    The Training Committee should convene on a regular basis as determined by the Support ServicesChief Deputy to review the identified incidents. The committee shall determine by consensuswhether a training need exists and then submit written recommendations of its findings to theTraining Manager. The recommendation should not identify specific facts of any incidents, suchas identities of employees involved or the date, time and location of the incident, but should focuson the type of training being recommended.

    The Training Manager will consider the recommendations of the committee and determine whattraining should be addressed, taking into consideration the mission of the Office and availableresources.

    208.7 TRAINING PROCEDURES

    (a) All employees assigned to attend training shall attend as scheduled unless previouslyexcused by their immediate supervisor. Excused absences from mandatory trainingshould be limited to the following:

    1. Court appearances

    2. Pre-approved vacation

    3. Sick leave

    4. Physical limitations preventing the employee's participation.

    5. Emergency situations

    (b) When an employee is unable to attend mandatory training, that employee shall:

    1. Notify his/her supervisor as soon as possible but no later than one hour priorto the start of training.

    2. Document his/her absence in a memorandum to his/her supervisor.

    3. Make arrangements through his/her supervisor and the Training Manager toattend the required training on an alternate date.

    208.8 DAILY TRAINING BULLETINSThe Lexipol Daily Training Bulletins (DTBs) is a web-accessed system that provides training onthe San Luis Obispo County Sheriff's Office Policy Manual and other important topics. Generally,one training bulletin is available for each day of the month. However, the number of DTBs maybe adjusted by the Training Manager.

    Personnel assigned to participate in DTBs should only use the password and login name assignedto them by the Training Manager. Personnel should not share their password with others andshould frequently change their password to protect the security of the system. After each session,employees should log off the system to prevent unauthorized access. The content of the DTBs iscopyrighted material and shall not be shared with others outside of the Office.

    Employees who are assigned to participate in the DTB program should complete each DTB at thebeginning of their shift or as otherwise directed by their supervisor. Employees should not allowuncompleted DTBs to build up over time. Personnel may be required to complete DTBs missedduring extended absences (e.g., vacation, medical leave) upon returning to duty. Although theDTB system can be accessed from any Internet active computer, employees shall only take DTBsas part of their on-duty assignment unless directed otherwise by a supervisor.

    Supervisors will be responsible for monitoring the progress of personnel under their command toensure compliance with this policy.

    Electronic Mail212.1 PURPOSE AND SCOPEThe purpose of this policy is to establish guidelines for the proper use and application ofthe Sheriff's Office electronic mail (email) system by employees of this Office. E-mail is acommunication tool available to employees to enhance efficiency in the performance of job dutiesand is to be used in accordance with generally accepted business practices and current law(e.g., California Public Records Act). Messages transmitted over the e-mail system must only bethose that involve official business activities or contain information essential to employees for theaccomplishment of business-related tasks and/or communication directly related to the business,administration, or practices of the Sheriff's Office.

    212.2 E-MAIL RIGHT OF PRIVACYAll e-mail messages, including any attachments, that are transmitted over Sheriff's Office networksare considered Office records and therefore are Office property. The Sheriff's Office reserves theright to access, audit or disclose, for any lawful reason, any message including any attachmentthat is transmitted over its e-mail system or that is stored on any Sheriff's Office system.

    The e-mail system is not a confidential system since all communications transmitted on, to orfrom the system are the property of the Sheriff's Office. Therefore, the e-mail system is notappropriate for confidential communications. If a communication must be private, an alternativemethod to communicate the message should be used instead of e-mail. Employees using theSheriff's Office e-mail system shall have no expectation of privacy concerning communicationsutilizing the system.

    Employees should not use personal accounts to exchange e-mail or other information that isrelated to the official business of the Sheriff's Office.

    212.3 PROHIBITED USE OF E-MAILSending derogatory, defamatory, obscene, disrespectful, sexually suggestive and harassing orany other inappropriate messages on the e-mail system is prohibited and may result in discipline.

    E-mail messages addressed to the entire Sheriff's Office are only to be used for official businessrelated items that are of particular interest to all users and must be approved by the Sheriff,Undersheriff or a Bureau Chief. Personal advertisements are not acceptable.

    It is a violation of this policy to transmit a message under another user's name. Users arestrongly encouraged to log off the network when their computer is unattended. This added securitymeasure would minimize the misuse of an individual's e-mail, name and/or password by others.

    212.4 MANAGEMENT OF E-MAILBecause the e-mail system is not designed for long-term retention of messages, e-mail that theemployee desires to save or that becomes part of an official record should be printed and/or

Personnel should use Sheriff's Office letterheadonly for official business and with approval of their supervisor.

    214.3.1 SIGNATURESWhenever a signature is required, it is to be legible or the name printed legibly adjacent to thesignature.

    Staff Meeting Protocol215.1 PURPOSE AND SCOPEThe policy of the Sheriff's Office is to conduct regularly scheduled staff meetings.

    These regularly scheduled meetings within specific working units, supervisors, and managers willassist in the flow of accurate information within the organization.

    215.2 MEETING PROCEDUREMeetings shall be held within the various units to assist in the flow of communications. Theminimum frequency of identified meetings is established by policy and additional meetings maybe conducted as deemed necessary or appropriate.

    (a) Briefings

    1. Conducted on a daily basis and/or prior to the start of a shift or event.

    2. Shall be attended by all affected personnel.

    3. The objective of the meeting is to review current issues, concerns, and plans.

    4. A briefing log is recommended, but minutes are not required.

    5. A formal agenda for daily briefings is not required.

    6. Shall be conducted by a supervisor or senior staff member, whenever possible.

    (b) Station or Unit Meetings

    1. Shall be conducted at least twice per year by the commanding officer.

    2. Shall be attended by all affected available personnel.

    3. Objective is to share information, trends, goals, training concerns, liability issues,and tactics with all persons assigned to a station or work area.

    4. Minutes shall be prepared to document meeting.

    5. A formal agenda is required and distributed one week prior to meeting by thestation or unit commander.

    (c) Division Commanders/Bureau Meetings

    1. Shall be conducted at least once per month by the commanding officer.

    2. Shall be attended by all available assigned management personnel.

    3. Objective is to review and critique activities, set operational goals, increaseconsistency between stations/units, and maintain the flow of communication.

    216.2 MINIMUM STAFFING LEVELSMinimum staffing levels should result in the scheduling of a supervisor on duty in the field wheneverpossible. Watch Commanders will ensure that the field supervisor is informed of any criticalincidents throughout the county including but not limited to any incidents that require notificationof executive staff per section 358.2 of this policy manual.

    License to Carry a Firearm218.1 PURPOSE AND SCOPEThe Sheriff is given the statutory discretion to issue a license to carry a firearm to residents withinthe County of San Luis Obispo (Penal Code § 26150; Penal Code 26155). This policy will providea written process for the application and issuance of such licenses. Pursuant to Penal Code §26160, this policy shall be made accessible to the public.

    218.1.1 APPLICATION OF POLICYNothing in this policy shall preclude the Chief or other head of a municipal police departmentfrom entering into an agreement with the Sheriff of the county or preclude the Sheriff of thecounty from entering into an agreement with the Chief of any municipal police department toprocess all applications and license renewals for the carrying of concealed weapons (Penal Code§ 26150; Penal Code § 26155).

    218.2 POLICYThe San Luis Obispo County Sheriff's Office will fairly and impartially consider all applications tocarry firearms in accordance with applicable law and this policy.

    218.3 QUALIFIED APPLICANTSIn order to qualify for a license to carry a firearm, the applicant must meet certain requirements,including:

    (a) Be a resident of the County of San Luis Obispo (Penal Code § 26150; Penal Code§ 26155).

    (b) Be at least 21 years of age (Penal Code § 29610).

    (c) Fully complete an application that will include substantial personal information. Muchof the information in the application may be subject to public access under the PublicRecords Act.

    (d) Be free from criminal convictions that would disqualify the applicant from carrying afirearm. Fingerprints will be required and a complete criminal background check willbe conducted.

    (e) Be of good moral character (Penal Code § 26150; Penal Code § 26155). The applicantshall provide at least three letters of character reference.

    (f) Show good cause for the issuance of the license (Penal Code § 26150; Penal Code§ 26155).

    (g) Pay all associated application fees. These fees are set by statute and may not berefunded if the application is denied.

    (h) Provide proof of ownership or registration of any firearm to be licensed.

    (i) Be free from any psychological conditions that might make the applicant unsuitablefor carrying a firearm (Penal Code § 26190).

    (j) Complete required training (Penal Code § 26165).

    218.4 APPLICATION PROCESSThe application process for a license to carry a firearm shall consist of two phases. Upon thesuccessful completion of each phase, the applicant will advance to the next phase until the processis completed and the license is either issued or denied.

    218.4.1 PHASE ONE (TO BE COMPLETED BY ALL APPLICANTS)

    (a) Any individual applying for a license to carry a firearm shall first fully complete aCalifornia Department of Justice (DOJ) application on line to be electronically signedunder penalty of perjury. Any applicant who provides false information or statementson the application will be removed from further consideration and may be prosecutedfor a criminal offense (Penal Code § 26180).

    1. In the event of any discrepancies in the application or background investigation,the applicant may be required to undergo a polygraph examination or voicestress analyzer at no cost to the applicant.

    2. If an incomplete application package is received, the Sheriff or authorizeddesignee may do any of the following:

    (a) Require the applicant to complete the package before any furtherprocessing.

    (b) Advance the incomplete package to phase two for conditional processingpending completion of all mandatory conditions.

    (c) Issue a denial if the materials submitted at the time demonstrate thatthe applicant would not qualify for a license to carry a firearm even ifthe package was completed (e.g., not a resident, disqualifying criminalconviction, absence of good cause).

    (b) An initial payment for the required California DOJ application fee, along with anonrefundable 20 percent of the application fee to cover the cost of processing theapplication (Penal Code § 26190) is required when submitting the application.

    (a) Full payment of the remainder of the application fee will be required uponissuance of a license.

    (b) Payment of related fees may be waived if the applicant is a duly appointedreserve peace officer as defined in Penal Code § 830.6 (a) or (b) (Penal Code§ 26170).

    (c) The applicant shall be required to submit to fingerprinting and a complete criminalbackground check by the California DOJ. No person determined to fall within aprohibited class described in Penal Code § 29800, Penal Code § 29900, Welfare andInstitutions Code § 8100 or Welfare and Institutions Code § 8103 will be issued a

    license to carry a firearm. A license shall not be issued if the California DOJ determinesthat the applicant is prohibited by state or federal law from possessing, receiving,owning or purchasing a firearm (Penal Code § 26195).

    (d) The applicant shall submit at least three signed letters of character reference fromindividuals other than relatives.

    (e) The applicant shall submit proof of ownership or registration of each firearm to belicensed.

    Once the Sheriff or authorized designee has reviewed the completed application package andrelevant background information, the application will either be advanced to phase two or denied.

    In the event that an application is denied at the conclusion of, or during, phase one, the applicantshall be notified in writing within 90 days of the initial application or within 30 days after receiptof the applicant's criminal background check from the California DOJ, whichever is later. If thelicense is denied, the notice shall state which requirement was not satisfied (Penal Code § 26205).

    218.4.2 PHASE TWOThis phase is to be completed only by those applicants successfully completing phase one.

    (a) Upon successful completion of phase one, the applicant shall be scheduled for apersonal interview with the Sheriff or authorized designee. During this stage, therewill be further discussion of the applicant's statement of good cause and any potentialrestrictions or conditions that might be placed on the license.

    1. The determination of good cause should consider the totality of circumstancesin each individual case.

    2. Any denial for lack of good cause should be rational, articulable and not arbitraryin nature.

    3. The Department will provide written notice to the applicant as to thedetermination of good cause (Penal Code § 26202

    (b) The applicant shall complete a course of training approved by the agency, whichcomplies with Penal Code § 26165. The applicant will not be required to complete andpay for any training courses prior to any determination of good cause (Penal Code §26165; Penal Code § 26202).

    (c) The applicant shall submit any firearm to be considered for a license to the Sheriff orhis designee to confirm the identifying information of each weapon at no cost to theapplicant. The Sheriff reserves the right to deny a license for any firearm that has beenaltered from the manufacturer's specifications or that is unsafe (Penal Code § 31910).

    (d) The applicant shall successfully complete a firearms safety and proficiencyexamination with the firearm to be licensed, to be administered by adepartment approved firearms safety and proficiency instructor, including completion

    of all releases and other forms. The cost of any outside inspection/examination shallbe the responsibility of the applicant.

    Once the Sheriff or authorized designee has verified the successful completion of phase two, thelicense to carry a firearm will either be granted or denied.

    Whether an application is approved or denied at the conclusion of or during phase two, theapplicant shall be notified in writing within 90 days of the initial application or within 30 days afterreceipt of the applicant's criminal background check from the California DOJ, whichever is later.If the license is denied, the notice shall state which requirement was not satisfied (Penal Code§ 26205).

    218.5 LIMITED BUSINESS LICENSE TO CARRY A CONCEALED FIREARMThe authority to issue a limited business license to carry a concealed firearm to a non-residentapplicant is granted only to the Sheriff of the county in which the applicant works. A chief of amunicipal police department may not issue limited licenses (Penal Code § 26150). Therefore,such applicants may be referred to the Sheriff for processing .

    An individual who is not a resident of the county but who otherwise successfully completes allportions of phases one and two above, may apply for and be issued a limited license subject toapproval by the Sheriff and subject to the following:

    (a) The applicant physically spends a substantial period of working hours in the applicant'sprincipal place of employment or business within the County of San Luis Obispo (PenalCode § 26150).

    (b) Such a license will be valid for a period not to exceed 90 days from the date of issuance(Penal Code § 26220).

    (c) The applicant shall provide a copy of the license to the licensing authority of the cityor county in which the applicant resides (Penal Code § 26220).

    (d) Any application for renewal or reissuance of such a license may be granted only uponconcurrence of the original issuing authority and the licensing authority of the city orcounty in which the applicant resides (Penal Code § 26220)
