2.1 On Monday 10-01-2007, at approximately 3:14PM, Texas RangerLieutenant Shawn PALMER interviewed Erica Leigh MANLEY, WfF,DOB/ 06-02-1985. MANLEY .stated the following:
A. MANLEY is employed as a dispatcher for the San AngeloPolice Department. Approximately one (I) month prior to theinterview, MANLEY was on duty and received a call from afemale subject (Jane DOE (PseudonYm). The female subjectstated she had been assaulted at the Oasis. The femalesubject identified the suspect as Chief Tim VASQUEZ. MANLEYnotified San Angelo Police Department Sergeant Fred DIETZabout the call. MANLEY also notified her (MANLEY)supervisor Georganna KENNEDY.
B. One (1) or two (2) days later, San Angelo PoliceDepartment Sergeant Victor VASQUEZ notified MANLEY thatChief VASQUEZ wanted to speak to MANLEY. MANLEY andSergeant VASQUEZ met with Chief VASQUEZ and Assistant ChiefRobert MARTINEZ. Chief VASQUEZ wanted to tell MANLEY his(VASQUEZ) side of the story and Chief VASQUEZ wanted to makesure the particulars of the call did not get out. ChiefVASQUEZ told MANLEY he (VASQUEZ) would fire anyone's ass

that was caught talking about the call. Chief VASQUEZ toldMANLEY the allegation was due to the upcoming election.Chief VASQUEZ stated Detective Jeff DAVIS was runningagainst the Chief and the woman who made the allegation wasan informant for Detective DAVIS. The Chief felt that wasthe reason the call was made. Chief VASQUEZ asked MANLEYabout why MANLEY had asked the female complainant if she hadalready spoken to someone. After MANLEY explained why.MANLEY had asked that, the Chief said that detectives hadquestioned the female complainant. The Chief said thatafter the detectives questioned the female complainant sheno longer wanted to go forward and she wanted to drop allcharges. The Chief said the detectives who questioned thefemale believed she had spoken to someone beforehand.
MANLEY provided Ranger Shawn PALMER with a typewrittenstatement hereafter identified as Exhibit #2.1.
2.2 On Tuesday, 10-02-2007, at approximately 9 :OOAM, RangerShawn PALMER interviewed Sergeant Fred DIETZ. DIETZ hadpreviously contacted Ranger Shawn PALMER by telephone inreference to a typed document Chief VASQUEZ had givenSergeant DIETZ. DIETZ stated that on Friday, 09-29-2007,DIETZ found a seven (7) page typed narrative, which appearedto have been prepared by Chief VASQUEZ. DIETZ noticed therewere two (2) copies of the first page of the narrative. One(1) of these copies of the first page had handwritten noteson it. DIETZ recalled being provided with the printednarrative after a meeting in which Chief VASQUEZ told DIETZand other officers that a report would be written about theincident. Ranger Shawn PALMER asked DIETZ the followingquestions and DIETZ provided the following answers:
Question: Did Chief VASQUEZ tell you to treat theallegation by DOE (PseudonYm) like any other Class C on anofficer and not do anything differently?
Answer: There was some discussion about handling theallegation like a normal Class C but in the end that is nothow the Chief wanted it handled.
Question: After DOE (PseudonYm) asked you to wait to writea report until after she spoke to her attorney, did ChiefVASQUEZ tell yOU" that you could get started on your report

Answer: No. I (DIETZ) think Chief VASQUEZ told me (DIETZ)to have all my information available in case I needed to doa report the following morning, but he did not tell me(DIETZ) that I could start a report.
2.3 DIETZ provided Ranger Shawn PALMER with a typewrittenstatement (Exhibit #2.2) and the typed narrative whichVASQUEZ had given DIETZ (Exhibit #2.3).
2.4 On 10-02-2007, at approximately 10:00AM, Ranger Shawn PALMERcontacted Assistant United States Attorney Jeff HAAG. HAAGstated he (HAAG) had been contacted by Chief VASQUEZ inreference to the allegation made by Jane DOE (PseudonYm).Chief VASQUEZ told HAAG about a request for records filed bythe Combined Law Enforcement Association of Texas(C.L.E.A.T.). HAAG reviewed the C.L.E.A.T. request. HAAGdetermined the information requested by C.L.E.A.T. did notappear to identify DOE (Pseudonym) as an informant. HAAGspoke with a representative of the San Angelo City LegalDepartment. HAAG requested that reports related to thepending Federal Court cases not be released. Later, ChiefVASQUEZ contacted HAAG. HAAG told Chief VASQUEZ thatfulfilling the request from C.L.E.A.T. would be alright.
2.5 On 10-02-2007, at approximately 1:25PM, Ranger Shawn PALMERinterviewed San Angelo Police Department Assistant ChiefKevin HaLLWAY, W/M, DOB/ 05-21-1957. HOLLWAY stated thefollowing:
A. Around August HaLLWAY was at work and noticed thereappeared to be individuals inside Chief VASQUEZ' office withthe door closed. HOLLWAY noticed Assistant Chief RobertMARTINEZ and Sergeant Matt BALDWIN were among those comingor going from the Chief's office. HOLLWAY asked MARTINEZwhat was going on and MARTINEZ told HOLLWAY a woman had madean allegation against the Chief. HOLLWAY asked MARTINEZwhat type of allegation and MARTINEZ told HOLLWAY theallegation was that the Chief had grabbed the woman's butt.Around the next day or the day after that HOLLWAY sat in ona discussion in the Chief's office with the Chief,Lieutenant Tracy FINCHER and Sergeant David HOWARD. and the fact the complainant was an informant. There wasdiscussion about a press release and about protecting thecomplainant's identification. There was discussion aboutthe use of a Pseudonym form. HOLLWAY was initially told thefemale complainant had decided she did not want a reportcompleted in reference to the incident.
B. HOLLWAY was also present during a discussion in whichChief VASQUEZ discussed that information about the allegedincident had been provided to the media and there was mediaattention. Chief VASQUEZ stated he (Chief) wanted a reportwritten about the incident. Chief VASQUEZ ordered allofficers who were involved to write reports or reportsupplements. There was discussion about Chief VASQUEZ doinga report of some type. There was also discussion aboutcompleting a false report to a peace officer report. In oneof the discussions Lieutenant FINCHER and Sergeant HOWARDdiscussed not releasing information about the complainantwho was an informant. There was discussion about notthinking the fact the complainant was an informant should bein the report. The Chief discussed something about beingable to tell his side of the story.
2.6 Ranger Shawn PALMER noticed HOLLWAY appeared evasive.Ranger Shawn PALMER began a question and answer typeinterview with HOLLWAY. The questions asked by Ranger ShawnPALMER and the answers given by HOLLWAY included thefollowing:
Question: Did you think that the fact the femalecomplainant was an informant should have been in a report?
Answer: No.
Question: Did anyone, while you were present, tell ChiefVASQUEZ this information should not be in a report?
Answer: Yes.
Question: Did Chief VASQUEZ ever discuss, in your presence,the idea of putting the information about the complainantbeing an informant in a press release?

Answer: Yes.
HOLLWAY provided Ranger Shawn PALMER with a typewrittenstatement hereafter identifi~d as Exhibit #2.4. ,HOLLWAYalso provided Ranger Shawn PALMER with a printed copy of ane-mail (Exhibit #2.5) in reference 'to Department policyrelated to the recording of other employees.
2.7 On wednesday, 10-03-2007, at approximately 10:52AM, RangerShawn PALMER interviewed San Angelo Police DepartmentSergeant David HOWARD, WIM, DOBI 03-21-1965. Present duringthe interview was attorney Bob GORSKY. HOWARD providedRanger Shawn PALMER with three (3) pages of typewrittennotes related to the events that followed the reportedincident involving San Angelo Police Department Chief TimVASQUEZ and Jane DOE (Pseudonym). Said typewritten notesare hereafter identified as Exhibit #2.6. HOWARD alsoprovided Ranger Shawn PALMER with one (1) printed e-mailfrom Jeff HAAG (Exhibit #2.7), one (1) photocopy of a CLE-13A (Exhibit #2.8) and one (1) printed e-mail from Chief TimVASQUEZ (Exhibit #2.9). HOWARD stated that approximatelyone and a half (1 1/2) years ago HOWARD assisted with anarcotics investigation in which Jane DOE (Pseudonym) was asuspect. HOWARD reviewed a telephone call from the TomGreen County Jail during which DOE (Pseudonym) statedsomething about going to hang out with her cop friends atthe Oasis. Ranger Shawn PALMER also conducted a questionand answer interview of HOWARD. The questions asked byRanger Shawn PALMER and the answers given by HOWARD includedthe following:
Question: During the meeting on 08-28-2007 in the Chief'soffice, did the Chief ever express a concern for the safetyof the fe~ale C.l. (DOE)?
Answer: Not to me.
Question: Did Chief VASQUEZ say why he wanted to include inthe report the information about the female being a C.T. orinformant?

Question: When you and FINCHER met with the female C.I. wasthe use of a Pseudonym discussed with her as a possibilityfor the report?
Answer: No.
Question: During the meeting with the female C.I. on 08-20-2007, was the female C.I. under the impression that the factthat she was an informant would be in the report?
Answer: We explained that the fact she was an informantwould probably come out. I don't think we told her it wouldbe in the report. FINCHER told her that the Chief wouldburn her. She asked us about why it (alleged incident) wassuch a big deal.
HOWARD provided Ranger Shawn PALMER with a typewrittenstatement hereafter identified as Exhibit #2.10.
2.8 On 10-03-2007, at approximately 2:13PM, Ranger Shawn PALMERinterviewed San Angelo Police Department Lieutenant TracyFINCHER, W/M, DOB/ 06-26-1970. Attorney Bob GORSKY waspresent during the interview. FINCHER provided Ranger ShawnPALMER with four (4) pages of typewritten notes (Exhibit#2.11), two (2) pages of a typewritten narrative forFINCHER'S report (Exhibit #2.12), one (1) page of atypewritten narrative for Sergeant HOWARD'S report (Exhibit#2.13) and three (3) pages of Treo telephone messageinformation (Exhibit #2.14). In addition to the informationprovided in the typewritten notes Range~ Shawn PALMERconducted a question and answer interview with FINCHER. The

Question: Did you ask Chief VASQUEZ to hold off on having areport written prior to going to speak with the C.l.?
Answer: Yes I did.
Question: Why?
Answer: When I first met with the Chief he told me that thefemale C.l. had admitted to being a friend of Jeff DAVIS.The Chief said he was going to hold a press conference tosay the female C.l. (complainant) was an associate of one ofhis (Chief) opponents. I was concerned about her safety andpending cases.
Question: Did the Chief say he was going to release theinformation about the complainant being a C.l.?
Answer: Yes he did.
Question: Did the Chief state to you that he had anyconcern for the complainant's safety due to the release ofthat information?
Answer: No.
Question: Did the Chief ever say anything about "burning"the complainant?
Answer: Yes but I can't remember when or where it was said.
Question: Did Chief VASQUEZ discuss including the informantinformation in a press release?
Answer: I know he talked about including the information Ina press conference the first time I met with him but I amnot sure about the meeting on 08-28-2007.
Question: During the meeting on 08-28-2007, did ChiefVASQUEZ tell you to make a special effort to protect theidentity of the female C.l.?

Lieutenant FINCHER provided Ranger Shawn PALMER with atypewritten statement hereafter identified as Exhibit #2.15.
2.9 On Thursday, 10-04-2007, Ranger Shawn PALMER contactedAssistant Chief Robert MARTINEZ by telephone. MARTINEZ hadleft a voicemail message requesting Ranger Shawn PALMERcontact him. MARTINEZ stated he (MARTINEZ) wanted to besure Ranger Shawn PALMER was aware of the threat informationdirected towards Jane DOE (Pseudonym) which was listed in aprinted e-mail (Exhibit #1.7) previously provided byMARTINEZ. Ranger Shawn PALMER informed MARTINEZ that he(PALMER) had already followed up on the threat information.Ranger Shawn PALMER then asked MARTINEZ what had been doneby MARTINEZ or any other administrative personnel to followup on the threat information. MARTINEZ stated nothing hadbeen done by him or other administrative personnel.MARTINEZ then stated he (MARTINEZ) had reviewed theinformation provided in his typewritten statement. MARTINEZwas concerned about questions Ranger Shawn PALMER had aboutChief VASQUEZ releasing information about Jane DOE(Pseudonym) being an informant. MARTINEZ stated he(MARTINEZ) had recalled that on 08-20-2007, Chief VASQUEZwas upset and made outbursts related to Jane DOE (Pseudonym)and the allegation. MARTINEZ stated Chief VASQUEZ hadstated something about Jane DOE (Pseudonym) not meaninganything or she was not important. MARTINEZ agreed to meetwith Ranger Shawn PALMER at a later date to provide a followup statement to clarify this information. Ranger ShawnPALMER utilized a digital audio recorder to audio record theconversation with MARTINEZ. Said digital audio recording ishereafter identified as Exhibit #2.16.
2.10 On Friday, 10-05-2007, at approximately 3:00PM, Ranger ShawnPALMER traveled to the San Angelo Police DepartmentCommunications Center to oversee the recovery of computerdata from COIpputer equipment recovered from Chief TimVASQUEZ. Ranger Shawn PALMER had previously spoken to SanAngelo Assistant City Attorney Teresa SPECIAL. SPECIAL hadobtained written consent from VASQUEZ, which authorizedRanger Shawn PALMER to participate in the recovery of thedata. SPECIAL had indicated Chief VASQUEZ would bepresent. Information Technology Department for the City of SanAngelo. EADES informed Ranger Shawn PALMER that VASQUEZwould not be present (or the recovery of the data. EADESrecovered VASQUEZ' e-mail information from the server.Ranger Shawn PALMER scrolled through the folder containingthe e-mails to attempt to identify any dates or subjectinformation related to Jane DOE (Pseudonym)". Ranger ShawnPALMER did not open or highlight any e-mails to read thecontents. Ranger Shawn PALMER did note that there wereseveral e-mails which had subject information which appearedto be related to some type of campaign and also the musicband which VASQUEZ plays in. Wayne GILLEY arrived andrecovered the hard drive from the desktop computer CPUrecovered from VASQUEZ' office. GILLEY informed RangerShawn PALMER that on 10-03-2007, someone had successfullylogged into VASQUEZ' e-mail account from a computer assignedto VASQUEZ' secretary Sherrie ZESCH. GILLEY and TeresaSPECIAL recovered ZESCH'S computer from the San AngeloPolice Department.

On Sunday, 10-07-2007, at approximately 3:15PM, Ranger ShawnPALMER contacted Sherrie ZESCH by telephone. ZESCH statedshe had not logged into Chief VASQUEZ' e-mail on 10-03-2007. ZESCH stated she has never logged into Chief VASQUEZ'e-mail from her computer. ZESCH stated that when VASQUEZhas requested that she review his (VASQUEZ) e-mail ZESCHuses the computer in VASQUEZ' office. ZESCH believed thaton 10-03-2007, she' (ZESCH) left work at approximately 2:00PMand did not return until approximately 4:30PM. ZESCH statedduring that time her computer remained logged on.
This investigation will continue.
