(1) The Board of Commissioners, in and for the County of Scott, Minnesota, met in the Courthouse Board Room in the City of Shakopee, Minnesota, and convened at 9:03 a.m., with the following members present: Commissioner Wolf, presiding, Commissioner Wagner, Commissioner Menden, Commissioner Marschall, and Commissioner Ulrich.
(2) Amendments to the AgendaChair Wolf announced that agenda
item 5.19 to authorize an Agreement with Allied Waste Industries, Inc. for waste removal and recycling man-agement was being pulled from the agenda per staff’s request.
(3) On a motion by Commissioner Ulrich, seconded by Commissioner Menden, the Minutes of August 14, 2012 were approved.
(4) Recognition of Interested Citizens:
Thom Boncher, Jordan, reported on the meeting he attended on August 15 where the Minnesota Environmental Quality Board received public com-ments regarding frac sand mining.
(5) Consent Agenda:Commissioner Wolf stated that
agenda item 5.2 requesting approv-al to enter into an agreement with Nieman Roofing Company, Inc. for installation of a new roofing system at the Scott County Association for Leadership and Efficiency (SCALE) Regional Training facility is being pulled from the consent agenda for separate discussion and consider-ation.
On a motion by Commissioner Marschall, seconded by Commissioner Ulrich, the following actions were approved unanimously. All resolutions are available in the office of the County Administrator and are made a part of this record by reference.
A. Adopt Resolution No. 2012-140; Acknowledging Receipt and Acceptance of Gifts to Scott County.
B. Adopt Resolution No. 2012-143; Authorizing Entering Into an Agreement With NiemanRoofing Company, Inc. for Installation of a New Roofing System at the Scott County Association for Leadership and Efficiency Regional Training facility.
C. Approve the renewal of Service Agreements with Alliance Health Care effective December 1, 2012 through November 30, 2014 for support services authorized by case managers for clients based on indi-vidual client needs, specificallyhome and community based services.
D. Approve the renewal of Service Agreements with Cooperating Community Programs effective December 2, 2012 through November 30, 2014 for support services autho-rized by case managers for clients based on individual client needs, specifically home and community based services.
E. Approve the renewal of the Service Agreement with Dungarvinfiscal Services Minnesota, LLC effective December 1, 2012 through November 30, 2014 for support services authorized by case managers for clients based on indi-vidual client needs specifically home and community based services.

N. Approve the request to amend Conditional Use Permit (#1007-C-3) for Sweetland Orchard, Mike and Gretchen Perbix, applicants, in Section 27 of Cedar Lake Township. This action is in accordance with Chapters 2, 16 and 40 of Scott County Zoning Ordinance No. 3 and is based on the criteria listed for approval on the Permit.
O. Approve the request for prelimi-nary plat, final plat and Amendment to the Development Agreement for Minnesota River Valley Industrial Park Plat 2 in Section 11 of Jackson Township. These actions are in accordance with Chapter 60 of Scott County Zoning Ordinance No. 3 and Chapters 4 and 5 of Scott County Subdivision No. 7 and is based on the criteria listed for approval on the Permit.
P. Approve appraisal reports’ esti-mate of just compensation by a market value appraisal for new right–of–way and easements for the reconstruction of County Highway 17 from County Highway 16 to approximately 800’ south of County Highway 78 in the City of Shakopee.

Belle Plaine at St. James on Saturday as it cruised past Pipe-stone 6-1. Posting singles wins for the Tigers were Morrison (6-4, 6-1), Vennie (7-5, 6-2), Savage (3-6, 6-2/10-6 and Leah Schaefer (6-4, 6-1), the latter of whom was making her varsity debut. Winning their doubles matches were Brazil and Hall-gren (6-2, 6-3), Abby Brandt and Gavin (6-0, 5-7/10-7) and Sam Gregory, Grace Olson and Bailey Gavin (scores not avail-able).Next up was Martin County
West, which edged Belle Plaine 4-3. The deciding match was at No. 3 doubles, where Olson and Schaefer lost a hard-fought, two-plus hour contest 5-7, 6-1/8-10. Recording wins for the Tigers were Morrison (6-2, 6-1), Vennie (6-1, 6-1) and Sav-age (6-2, 6-1).In the final match of the day,
Belle Plaine was shutout by No. 2-ranked St. James 7-0. All
the losses came in straight sets, one of the most competitive be-ing Brazil and Brandt at No. 2 doubles (1-6, 4-6).
New Prague 4, Tigers 3In a match that lasted three
hours in what Belle Plaine coach Annette Moylan described as a “terrible” wind, Belle Plaine came up on the short end of a 4-3 score on Monday in New Prague. The Tigers won three of four singles matches but couldn’t find a win in doubles play.Winning their matches for
Belle Plaine were Morrison (6-4, 6-4), Lambrecht (6-1, 7-6) and Vennie (2-6, 6-0, 6-3). Sav-age lost her No. 4 singles match in three sets (6-2, 3-6, 3-6).One of doubles matches also
