In the alternative you could consider referring the AFR to someonewho you believe will have some facts and go on the record but that is a risk as it may create a story where there is none and is animposition on the person. Some matters have been raised in the press about why Justice Bernard Murphy left Slater and Gordon some 17 years ago. Through a spokesperson he said: I became unhappy at the firm, and resigned from the partnership to take up a senior position at another legal firm, where I worked for the next 15 ½ years. My resignation was not in any way motivated by any suggestion of wrongdoing on my part in relation to Slater and Gordon’s representation of the Australian Workers Union or Mr Bruce Wilson. No allegation of wrongdoing was put to me at that time or has been since. I was not involved in any investigation at Slater and Gordon in relation to my conduct in respect of the AWU or Mr Wilson. If any allegation of wrongdoing was to be raised it would be completely unfounded. I do not propose to make any further statement.

FEDERAL Court judge BernardMurphy, who was one of JuliaGillard's allies when they workedat Slater & Gordon in the 1990s,has been revealed as one of the keyplayers in a split in the partnershipthat preceded their departurefrom the firm.

Former Slater & Gordon part-ner Peter Gordon yesterdayrevealed that when the judge wasstill at the firm, he andJulia Gillardhad been involved in matters thatdamaged relations with otherpartners.

The firm's partners "were lessthan thrilled with how relationswith Bernard Murphy and JuliaGillard had deteriorated", MrGordon said in a statement.

Mr Murphy and Ms Gillardboth left the firm after al995 inter-nal inquiry into work that hadbeen carried out for Ms Gillard'sformer boyfriend Bruce Wilson,an Australian Workers Unionleader accused of corruption.

Justice Murphy yesterdaydenied any wrongdoing and saidhis departure from the firm hadnot been triggered by the investi-gation into the work for MrWilson and the AWU.

An earlier draft statement byMr Gordon, which was supplied toThe Australian, indicates MsGillard reported to Mr Murphyand was one of his allies in thefirm's internal politics. "She was.within Mr Murphy's 'camp' ofclose associates and friends at thefirm at the time," Mr Gordon'sdraft statement says. "Mr Murphyand Ms Gillard acted for the Vic-torian state branch of the AWUfrom 1991-92 until 1995 and alsofor two of its officials, Mr BruceWilson and Mr Ralph Blewitt."

Mr Gordon said yesterdaythere had been "minor inac-curacies" in the draft statementbut he stood by its key messages,

particularly that he believed MsGillard was not involved in anywrongdoing.

When Justice Murphy wasappointed to the Federal Courtbench last year, the federal oppo-sition had questioned his appoint-ment and pointed to his closerelationship with Ms Gillard.

Ms Gillard is believed to havebeen in favour of his appointment,which came after a selectionprocess in which more than 200applicants were considered by acommittee of judges, retiredjudges and government officials.

That committee had put for-ward a list of candidates andJustice Murphy's appointmentwas then approved by cabinet.

The judge responded to MrGordon yesterday with a state-ment of his own denying anywrongdoing and asserting that hewas "not involved in any investi-gation at Slater & Gordon in rela-tion to my conduct in respect ofthe AWU or Mr Wilson".

Mr Gordon's statement indi-cates that the tensions over thework for Mr Wilson and the AWUcame in the immediate aftermathof another incident known as theHarris-Smith case. This case hadplaced relations between Mr Mur-phy's industrial department andthe rest of the partnership undergreat strain, Mr Gordon said.

That case, which did not in-volve Ms Gillard, concerned adefamation action between thefirm and former politician IanSmith. Justice Murphy said his de-parture from the firm had not been

triggered by the 1995 investigationinto the work for Mr Wilson andthe AWU.

According to a transcript of herexit interview, Ms Gillard toldSlater & Gordon in 1995 that shealone had handled the work re-lated to the AWU and Mr Wilson,and did not seek advice from any-one else at the firm. When he wasat Slater 8z Gordon, Justice Mur-phy had recruited Ms Gillard.

In 2010, Ms Gillard named MrMurphy when asked whether shehad a mentor. "He taught me howto organise competing workloads,how to deal with clients, how tocreate the right expectationsabout what's going to happen nextto them in a legal case," she toldVictoria's Young Lawyers Journal.

In May last year, after JusticeMurphy's appointment to the Fed-eral Court was made public, theopposition described him as "anold associate of the Prime Minis-ter's from a well-known firm ofLabor Party solicitors".

In June last year, when JusticeMurphy addressed a ceremonywelcoming him to the FederalCourt, he named Ms Gillard andMr Gordon as two of the "fineyoung solicitors" from whom hehad learned a lot.

Julia,you first joined Slater & Gordonwhen?JG: I think it was the 12th of Octo-ber 1987; it was certainly October1987.PG: And at that time Slater &Gordon was not acting for theAustralian Workers' Union?(Two pages redacted)PG: You became involved in a per-sonal relationship with Bruce?JG: Yes, I did.PG: Was it about then orJG: It was late 1981 (sic), 1991.PG: Right. And, when Bruce cameto Victoria, did he come alone orwere there other Western Austra-lian people who came with him?JG: No, he came alone. Yes, at thatstage I think he came alone. Hewas subsequently joined by an or-ganiser from Western Australiacalled, his proper name (was) Vas-silis Telikostoglou. He is known aseither Bill Telikostoglou or simplyBill the Greek.PG: Right. There is another fellowcalled Ralph Blewitt. Has he at allmaterial times been Western Aus-tralian based?JG: Yes, he has. Bruce was actingsecretary of the Victorian branchof the AWU so his substantive pos-ition was as secretary of the West-ern Australian branch. At somepoint, and I must admit I don't re-call when, but some point past thetransition to Victoria, he becamepermanently appointed as Victo-rian secretary of the AWU. Underthe AWU's rules it's not possible tohold two elected positions, soRalph became the Western Aus-tralian secretary of the AWU so, atBruce's behest if you like, he filled. . . (Half a page redacted.) It's, it's

common practice, indeed everyunion has what it refers to as a re-election fund, slush fund, what-ever, which is the funds that theleadership team, into which theleadership team puts money sothat they can finance their nextelection campaign. It is not properto use union resources for electioncampaigns so you need to financethem yourself. Some of them, youknow, they can cost $10,000,$20,000 they're not cheap. Sothe usual mechanism people use toamass that amount of money isthat they require the officials whoran on their ticket to enter payrolldeduction schemes where moneyeach week or fortnight goes fromtheir pay into a bank accountwhich is used for re-election pur-poses from time to time. They alsohave different fundraisers, dinnersand raffles and so on to amass thenecessary amount of money tomount their re-election campaign.(Several lines redacted.) Thethinking behind the forming of in-corporated associations is that ithad been our experience that ifyou did it in a less formal way, youjust had someone, say Fred Bloggs,say, oh look, I'll just open a bankaccount and everybody can putthe money into there, the problemdeveloped that when the leader-ship team fractured, as relativelycommonly happens, you got into avery difficult dispute about whowas the owner of the monies in thebank account, so it was better tohave an incorporated association,a legal entity, into which peoplecould participate as members, thatwas the holder of the account.(Two and a half pages redacted)PG: Yes. And to the extent thatwork was done on that file in rela-tion to that, it was done by you?JG: That's right.PG: And did you get advice fromanyone else in the firm in relationto any of those matters?JG: No, I didn't.(Two pages redacted.)PG: When did you first hear of aninterest in acquiring a property for

Wilson to live in?JG: I think (was) either very late1992 or early 1993 Bruce talked tome about it. The flat he had inCarlton he let go over the Christ-mas period between 92 and 93when he returned to Western Aus-tralia. I can't remember if beforeletting the flat go he said some-thing to me about it or whether itwasn't until he returned the fol-lowing year that he said some-thing about it. But my understand-ing was what was said to me at thatstage was that Ralph had an inter-est in investing in a property, thathe had some excess money andthat was what he was going to do,make a property investment, andthat Bruce had talked to him aboutmaking that investment in Victo-ria rather than Western Australiabecause it would suit everybody'spurposes Ralph would have theinvestment that he wanted, andthe negative gearing consequentupon that that he wanted, andBruce would have somewhere tolive that he wanted to live ratherthan in the ordinary landlord/ten-ant situation. Ralph would havethe benefit of knowing that he hada tenant that, you know, wasn't go-ing to do anything disastrous tothe property, so it suited every-body's purpose.PG: That all made sense to you?JG: It, it made sense. I didn't haveany particular reason to question itin great detail, or at all. It made, itmade sense to me in the sense thatRalph, I'd heard Ralph talk in thepast about owning a flat or someflats. I, he's a, Ralph's a boastfulperson if you had to think of an ad-jective to describe him; he was veryfull of stories about what he's doneand how good he is, and in thecourse of these stories about whathow good he is and what he's done,he had sort of held forth aboutwhat he had and how he had such anice house, how his wife was in-volved in a hairdressing businessor owned a hairdressing business,how he'd owned these flats, etcet-era. He moved from Victoria to

Western Australia. He's a Victo-rian person originally. Did you evermake enquiries as to the source ofthose funds from his point of view?JG: No, I just, from the discussions Ihad an understanding that he wasgoing to put a deposit on and thathe was interested in then having anegative-gearing arrangement forthe rest so that he would get a taxbreak, so he was, I mean like oneordinarily does, he was going tohave a deposit and a mortgage.PG: You assumed he had themoney.JG: Oh, I assumed he had themoney for the deposit, andPG: andJG: and to meet the mortgage re-payments when they fell due.PG: and, umJG: I didn't have any specific know-ledge of how much deposit he wasintending to put on but just that hehad the money to complete thetransactionPG: Or how much funds he had?JG: Or how much funds he had butjust that he had the money to com-plete the transaction.PG: It's fair to say that your viewwas that if anything like all this fel-low said is to be believed he's got ahairdressing business, he's got flatsand he's a man of means who canfund a $200,000 purchase if he

wants toJG: Yes.PG: Is that?JG: Yeah, I hadn't .PG: If you thought about it .JG: To the extent that I thoughtabout it, I hadn't made careful en-quiry about his financial circum-stances, he's a middle aged man,he's on his second marriage. Fromwhat he says it's apparent his firstmarriage ended in circumstanceswhere he didn't have much by wayof ongoing relationship with thechildren and I understood that tobe in the maintenance sense aswell as the access sense. He hadworked here for the TimberWorkers Union. He'd sort of chug-ged that in, cashed that up andusually union officials are worth afair bit when they leave one unionand go to another. He'd gone toWestern Australia. His wife wor-ked. So, you know, they weren't Mrand Mrs Onassis but they wererelatively well positioned.(Two pages redacted)PG: Yeah, I see. Sorry. Julia, youown property in Victoria?JG: Yes, I do.PG: And whereabouts is that?JG: 36 St Phillip Street, Abbotsford.PG: And when did you acquirethat?JG: In May 1991and it settled in theJuly 1991.PG: 1991, yeah. How did you fundthat?JG: I funded that; Slater 8z Gordonextended to me a loan of $40,000,which I used for the deposit, andthe rest of it I borrowed throughthe same branch of the Common-wealth Bank as Slater & Gordonbanks at the William Streetbranch.PG: By way of mortgage.JG: Yes, by way of mortgage.PG: And you still have that mort-gage?JG: I still have that mortgage.PG: And it's being paid off.JG: And it's being paid off.PG: Have any renovations been ta-ken place to that property?JG: Yep. I've, I moved there in July1991. When I first moved there Ishared it with two other people. It'sa two-bedroom place. I shared itwith a couple. And when I firstpurchased it, interest rates were

quite high and my salary was lowerthan it is now, and I didn't really doanything of substance to the prop-erty for 12, 18 months, somethinglike that. I then started to get vari-ous bits of work done, go relativelyslowly and as I could afford to getthem done bit by bit. I remembercommenting to Geoff at one pointthat I renovated so slowly otherpeople would call it maintenancebecause not much was happening.Then substantial renovations gotdone on the property last year,which included the kitchen beingentirely redone and the bathroomand laundry being entirely redoneand internal plastering and paint-ing being done, and yes, so I got allthat work done in September, Oc-tober, Novemberish last year.PG: OK. Did you contract all ofthose works to the one subcon-tractor or builder or did you man-age them yourself?JG: No, I. I. I suppose I should do itpiece by piece. I originally gotglasswork and paving work done:that was because the way in whichthe glasswork and the paving weredone at that time was causingwater to go into the foundations. Icontracted with a glassworker/woodworker person called AtholJames, who I found in the localnewspaper, and contracted with apaving place that I got from thelocal newspaper after getting, I gotthree quotes and then picked thelowest one of them, so that gotdone first. I then, I then got thefloors done and I got A Lhol back todo that, so the front of the house,the old part was the original balticpine floorboards. The back partwas chipboard and I wanted to getthe floorboards matched with oldbaltic pine so I could get it all sand-ed down and polished. I'm sure thisdetail is really exciting you. AndAthol came and did that, got oldpine and matched it all up and youknow all of that sort of stuff, whichwas a substantial job. And then Igot some bloke in I think that herecommended to do the sanding,so that was what happened next.Then what happened after thatwas I got the kitchen done. I pur-chased Ikea cupboards and stuff,

purchased the actual appliancesfrom a Radio Rentals place in Clif-ton Hill, and purchased a granitebench top from a local place nearme called the Marble Centre,that's also in Abbotsford, and thenI had installers who were recom-mended by Ikea put it all in. Hisname was Taugney the SwedishBuilder, and he took a substantialamount of time to do all of thatthough I was the envy of Leonie Irecall at that stage for having aSwedish builder. That left me withthe kitchen functional but the, thekitchen had like cork in it, all ofthat had basically been ripped toshreds when they had taken theold cupboards out and put the newcupboards in so it needed tiling, itneeded tiling on the splashbacks,you know around the sink andaround the stove, it needed plas-tering work, kitchen ceiling, thatsort of thing, and I had had a long-held plan to fix the bathroom andlaundry. Both were a sort of 70srenovation which amongst otherthings was red and yellow in col-our and I therefore wanted to get itreplaced. I went away to, for a holi-day, in late August early Septem-ber last year and I had been talkingfor a long time about getting thisbathroom and laundry work done.And, Bruce whilst I was away de-cided that I should just get it doneso he commenced with a group offriends demolishing the bath-room. By the time I came back thebathroom had been demolished soI had no option but to get the restof the renovations done and aseries of tradespeople who JimCollins predominantly organised,Jim Collins being an organiser atthe AWU, who he recommendedthrough his local football club, aseries of tradespeople came in anddid the renovation which predo-minantly consisted of the bath-room, completing the kitchen, til-ing on the kitchen floor, plasteringwork, replacement of ceilings andthe like.PG: To the extent that in respect ofthe bathroom it was required topurchase product tiles or grout or

whatever, how was that paid?JG: I went and picked tiles both forthe bathroom and the kitchenfrom various tile shops and paidfor them.PG: Right.JG: When they were delivered.PG: Yep. In terms of the tradesmenwho did the work in those areas,who were they?JG: I don't, I don't recall theirnames. I have some of their re-ceipts at home. There was a tiler,an electrician, a plasterer who hadwith him a general roustabout per-son and a plumber and they allknew each other and had workedtogether before, but it wasn't likeone of them was the builder whowas organising everybody else. Sothey came in and did it and I paideach of them. I've had occasionover the course of the weekend tolook through my personal recordsin relation to this matter and I dohave a series of receipts from vari-ous of them about bits of the workthat was done.PG: Right, and I take it the inquiryover the weekend may have ex-tended to this work as well, the At-hol James work, the glasswork, thepaving, the floors and the sanding.JG: Yes, I've got, I recall, I recallparticularly dealing with Atholbecause he came back more thanonce and sort of lived at my placefor a substantial period of timewhilst he did the floors, I don'tspecifically recall whether I've gota receipt from him, I think I do. I'veceltainly got his number and stuffin my address book from havingused him.PG: OK. Julia, it would be helpfulto us if we could have copies ofthose.JG: Yes.PG: Do you have a problem withsupplying them to us?JG: No, no problem at all.PG: Good. So that, is it fair to say asa general summary of that workthat all of the work was paid forby you?JG: I believe all of the work waspaid for by me. I was getting re-ceipts, I was paying it. I at that

stage borrowed an additional$20,000 from the bank to pay forthe renovations. I had occasion toask Geoff if I could be pre-paid,which he did. I don't recall theamount. But that was recoupedout of my pay for the first sixmonths of this year. And betweenthat pre-payment and the borrow-ing of the 20,000 from the bank Ipaid for that work.PG: Right.JG: I should say that, when I say the20,000 from the bank: that was thebathroom, the work that was or-ganised subsequent to the demo-lition of the bathroom. AtholJames, the tiler, sorry Athol James,the paver. Taugney the Swedishbuilder I had paid over time aswork was done.PG: OK. Julia, the file that you gaveus last Monday, that you gave Paullast Monday, could you justdescribe to us the circumstances inwhich you came across it, I thinkit's exactly right in front of you,isn't it?JG: Yes, that's right.PG: How, what are the circum-stances in which we only got thatlast week? Can you talk aboutthat?JG: When Geoff and Nick camedown and saw me about the con-veyancing file, I must admit myrecollection about the incorpor-ation file was that I hadn't openeda file on system and that I had hadsome papers and at some point Ihad given the papers to (name re-dacted). I don't recall whether Isaid that to you but I rememberhaving, I remember saying toGeoff I don't think I opened it onsystem to which Geoff then said,well, that will be easy enough tocheck. In the surrounding kaos(sic) I must admit I didn't do any-thing to check whether or not Iopened it on system. I subse-quently but relatively quicklythereafter went on a period ofleave and whilst I was focused onthe issues surrounding this Iwasn't particularly focused about

I said when to Leeshawhen I went on leave was one ofthe things I was doing when I waspacking up did she remember thisfile at all and she said she did andwhen I came back from leave shesaid that it was, that it had been inthe cabinet, that she'd found it, didI want it.PG: Why wasn't it opened on thesystem?JG: I don't think there's any greatscientific explanation for that, Ididn't have an intention to chargeon it, and from time to time I'vedone bits of work on files that Ihaven't opened up where I've justdone relatively small jobs forunions that I wasn't intending tocharge for. Ordinarily they wouldbe kept on the union's file. Wehave a file for each union where weput little bits of free work or tele-phone attendances of advice wegive, or they're kept on my per-sonal file JEG general. This, thiswas a more substantial job thanthat and really ought to have beenopened on system, but I think,well, I don't have a specific recol-lection of thinking to myselfshould I open it on system orshouldn't I open it on system, butapparently I didn't.P6: Response redacted.PG: We're concluding the inter-view going to ask you. I have, I have heard arumour to the effect that someoneattended at the offices of the AWUsince the time that Bruce has leftpresenting an account whichwhen the union enquired into itwas an account for work on myproperty and that they refused topay it. spoke to Andrew Watson about itand said that David Feeney, who isan official of the Transport Work-ers' Union, or an industrial officerof the Transport Workers' Union,had raised it with Andrew with thespecific intent of Andrew raising itwith me and David was happy forme to talk to him about it. I havespoken to David Feeney. I spoke tohim on Friday afternoon. What Ibelieve to have happened is this.This year I had additional workdone on my place to try and dosomething about the outside, theoutside is still not painted the rightcolour, and needed, needed furth-er work done on it. Bill the Greekrecommended to me a friend of hiscalled Con, the last name I believeto (be) Spin, Spiridis or Spiritis or aword to that effect. Con organisedfor me, or Con came and did thefollowing things. There are, therewere two of the original Victorianwindows on either side of thehouse that were not functionalandthe wood was rotting. I wantedthem replaced by new windows.Contrary to the directions I gavehim about that he replaced themwith aluminium sliding windowswhich I was particularly unhappyabout. The veranda was slate and itwas coming up and the postswhich held up the veranda in partwere rotting so I contracted withhim to replace the posts and to tilethe veranda. He did tile the veran-dah after a fashion, but the job isuncompleted. He did put in postsbut he put in, ah, what's the word,decorative posts chiselled out withpatterns, rather than plain posts.Given it's a Victorian weather-board house I was pretty unhappyabout that as well. And he mor-tared the fence and put pickets in itwhich was required to completethe fence. Now I believe thatthat must be the source of the ru-mour about, that must be the fac-tual construct behind what has be-come the rumour about, about theassociation or Bruce or the unionor whoever paying for work on myhouse and I don't obviously givenI've been fairly surprised by eventsto date in relation to this matter, Ican't categorically rule out thatsomething at my house didn't getpaid for by the association orsomething at my house didn't getpaid for by the union or whatever. Ijust, I don't feel confident saying Ican categorically rule it out, but Ican't see how it's happened be-cause that really is the only bit ofwork that I would identify that Ihadn't paid for. THE labour movement inVictoria prides itself on itsintellectual credentials and theferocity of its legendary battles.

Few battles were morefiercely fought than two whichoccurred concurrently duringthe early to mid-1990s. TheAustralian Workers' Union wasforced into a shotgun marriagewith the FederatedIronworkers' Association as aresult of the HawkeGovernment/ACTU shake-upof the union movement and itwas anything but a smoothamalgamation.

The FIA was a staunchlyanti-communist outfit thatbroke from the Labor Partyduring the split in the 1950s andhad a reputation as a

"cleanskin" union not taintedby some of the infighting andscandals that regularly arose inother organisations, includingthe AWU.

After the amalgamation,some AWU members called fora royal commission into therunning of the Victorianbranch, headed by the allegedlycorrupt Bruce Wilson. Thenfederal workplace ministerLaurie Brereton resisted thesecalls.

These events saw this fightcollide with anotheracrimonious and bitter battlebeing played out in the officesof Victoria's leading industriallaw firm, Slater & Gordon.

Slater & Gordon acted forWilson and the AWU with

rising star Julia Gillardhandling the account.Wrongdoing uncovered by abrigade of young turks in theunion came to the attention ofpartners at the law firm, whichprompted an internal inquiry,headed by one of the company'stop lawyers, Bernard Murphy.

Murphy, who was involved inwhat has been described as anasty brawl with senior partnerPeter Gordon over the lawfirm's future, found nowrongdoing on the part ofGillard, something that hasbeen confirmed by the AWUand other lawyers involved.

A FEDERAL Court judge andformer mentor to Julia Gillarclhas denied being forced toresign from the law firm at thecentre of a 17-year-old allegedunion fraud scandal involvingthe PM's ex-boyfriend.

Justice Bernard Murphy saidhe quit the law firm in late 1995

around the same time MsGillard left because he hadbecome "unhappy" working atSlater & Gordon.

A former equity partner withthe firm, Justice Murphy re-cruited Ms Gillard to thecompany in 1987.

In 1995 both he and MsGillard resigned after aninternal investigation by thefirm into the creation of a slushfund for the former AustralianWorkers Union boss and ex-boyfriend of Ms Gillard,Bruce Wilson. Slater & Gordonhave said Ms Gillard left tocampaign for the senate.

Yesterday Justice Murphydenied any wrongdoing, follow-ing suggestions by another ex-partner that the firm had con-sidered sacking him and MsGillard despite both beingcleared of wrongdoing.

"No allegation of wrongdo-ing was put to me at that timeor has been since," JusticeMurphy said in a statement.

"I was not involved in anyinvestigation at Slater &Gordon in relation to my con-duct in respect of the AWU orMr Wilson.

"If any allegation of wrong-doing was to be raised it wouldbe completely unfounded. I

became unhappy at the firm,and resigned from the partner-ship to take up a senior positionat another legal firm, where Iworked for the next 15 years.

"My resignation was not inany way motivated by anysuggestion of wrongdoing on

my part in relation to Slater &Gordon's representation of theAustralian Workers Union orMr Bruce Wilson."

Ms Gillard has also deniedany wrongdoing over heralleged involvement in settingup the slush fund and hasaccused those responsible forreviving the issue of beingmotivated by malice.

Ms Gillard told caucus, manyof whom are anxious over thepolitical impact, that she wasthe victim of a "vile"onlinecampaign against her.

She warned, in response to aquestion from one MP aboutplans to regulate the media,that Australia was at risk ofgoing down the "US path"where there was intensescrutiny of politicians'personal lives.

former attorney-general RobertMcClelland, to appoint MrMurphy to the Federal Court, aspokesman for the Prime Min-ister said an independent panelhad recommended five poten-tial candidates, including MrMurphy. He was appointed tothe Federal Court benchlast year.

The spokesman said Ms Gil-lard did not comment on Cabi-net matters but added that allappointments made to the Fed-eral Court since the 2010 elec-tion had been made under anew independent assessmentprocess introduced by theLabor government.

When asked if he had feltpressure to appoint MrMurphy, Mr McClellandsaid: "It would not be appropri-ate for me to comment onCabinet processes."

A Federal Court judge appointed bythe Gillard government has beenidentified as the lawyer who super-vised Julia Gillard at Slater &Gordon when the future prime minis-ter dated and did legal work for aunion official who has been accusedof financial impropriety.

Judge Bernard Murphy, a former

senior equity partner at Slater & Gor-don, was named by the firm's formerchairman, Peter Gordon, in a state-ment yesterday.

Mr Gordon said Ms Gillard andMr Murphy left the firm in 1995after falling out with other partnersover the AWU matter and a high-pro-file Victorian case involving a Ken-nett government minister.

Mr Wilson set up a fund which it isalleged was used to obtain money fromemployers and pay for a house inMelbourne. Ms Gillard has expressedregret at her relationship with MrWilson, who has disappeared frompublic life.

Ms Gillard was recruited to work atthe prominent Melbourne law firm,which represents several unions, by thethen Mr Murphy, who mentored herthrough her ascent to partner. It wasthrough him she was reported to havemet Mr Wilson, the AWU Victorianbranch secretary.

Mr Murphy said yesterday hebecame unhappy at Slater & Gordonand resigned from the partnership totake up a senior position at rivalMaurice Blackman, where he workedfor the next 15X years.

"My resignation was not in any waymotivated by any suggestion ofwrongdoing on my part in relation toSlater & Gordon's representation of theAustralian Workers Union or MrBruce Wilson," he said.

Ms Gillard has repeatedly denied

any wrongdoing in the case, andJustice Murphy said no allegation ofwrongdoing was put to him when heleft the firm or since.

"I was not involved in anyinvestigation at Slater & Gordon inrelation to my conduct in respect of theAWU or Mr Wilson," he said.

"If any allegation of wrongdoingwas to be raised it would be completelyu n founded."

Fair Work commissioner IanCambridge, a former nationalsecretary of the AWU, detailed in a1996 affadavit an elaborate set of bankaccounts set up by Mr Wilson, whotogether with another AWU member,Ralph Blewitt, extorted money fromconstruction companies such as Theissand John Holland through the mid-1990s.

Mr Gordon wrote in a documentthis week that the Slater & Gordonpartnership considered sacking MsGillard and Mr Murphy because theyhad not observed proper vigilance inthe AWU case or given timelydisclosure over the matter to theirfellow partners.

Justice Murphy, who represented MsHarris, was criticised by both premierJeff Kennett and Mr Smith, who laterresigned, after writs were leaked tonewspapers.

Mr Gordon said the controversy"placed relations between theindustrial department and the rest ofthe partners under great strain anddamaged relationships".

In his swearing-in speech in June lastyear, Justice Murphy mentioned bothMs Gillard and Mr Gordon in a "finecohort of solicitors" from whom he hadlearnt a lot.

Slater & Gordon head partnerAndrew Grech said yesterday there was"no inconsistency of substance"between Mr Gordon's leaked statementand a statement made by the firm onSunday that Ms Gillard resigned on herown accord, and was not found to havecommitted any wrongdoing.

The Prime Minister did not addressthe allegations directly yesterday buttold Labor MPs she was "perplexed"that the Australian media was movingtowards US-style political coveragewhere "so much time was spent on thepersonal, and not on importantreforms like healthcare and education".

Ms Gillard did not specifically citethe AWU case but said she hadobserved a changed dynamic wheremainstream media were following upreports on fringe internet websites.

Slater & Gordon is also consideringtaking legal action against TheAustralian newspaper for allegedlyinducing former partner Nick Styant-Brown to breach confidentialityobligations.

Mr Gordon accused Mr Styant-Brown, who has since moved to the US,of leaking the "unchecked, privilegedand confidential first-draftcommunication" to the newspaper.

The federal opposition chose not topursue the allegations against thePrime Minister in question timeyesterday but independent MPAndrew Wilkie backed earlier callsfrom Opposition Leader Tony Abbottfor the Prime Minister to make a briefexplanation to Parliament.

Mr Abbott said yesterday the subjectwas "of legitimate media interest".

"The ball is now in the PrimeMinister's court," he said.

"If the Prime Minister wants tomake a statement, the Coalition willgladly facilitate that. We would give her

every opportunity to do so."Federal government ministers came

out in defence of the Prime Minister.Treasurer Wayne Swan told ABC

Slater & Gordon has confirmedthe firm acted for the AWU at thesame time it represented Mr Wilsonand his associate Ralph Blewitt.

"Ethics are drummed into us untilit's coming out our ears," a formersenior member of the legal profes-sion said. "But there's a good reasonfor it, because contravention of it canbring down firms."

Regulations to define ethical con-duct are onerous, stipulating every

lawyer's first duty is to the court,then to the client, and then to thepartnership or firm where they work

Conflicts of interest that aren'tmanaged correctly could lead to law-yers being struck off the legal roll,ending their practice career. But,legal sources say there is a big differ-ence between legal and commercialconflicts of interest.

"You can do a lot of things, as longas you have complete disclosure, aslong as you tell the partnership whatis going on. Even when you've donesomething wrong," a lawyer said."But of course we don't all do that,all of the time."

JULIA Gillard yesterday wasasked to defend herselfagainst unspecified allega-tions concerning her employ-ment at the Melbourne lawfirm Slater & Gordon almosttwo decades ago.

The background to this iswell known. It's been raisedin various forms in theVictorian and national parlia-ments and has featured innews stories for the past twoyears.

More recently the muckhas evolved into somethingaltogether more toxic andputrid, particularly in a blogwritten by a soft-porn car-toonist, Larry Pickering.

Most journalists are sentlinks to this stuff a few times aday accompanied by de-mands it all be investigated.

It's a bit like a husbandthrowing down a copy of FiftyShades of Grey and asking hiswife to explain her role in theevents it contains.

ggWhat is missing is anyspecific allegation andexact questions Gillardshould answer

The public record tells usGillard was involved with aninfluential and powerfulVictorian union figure, BruceWilson, in the early '90s.

He was state secretary ofthe Australian WorkersUnion and they livedtogether in the inner city.

Against a background of afork in the road for the lawfirm whether to focus onindustrial work or, as eventu-ally happened, go the way ofhigh-profile class actionsGillard's close friend andsenior partner BernardMurphy discovered Wilsonwas defrauding his union.

Two things happened atonce. Slater and Gordonceased any association withWilson and stopped actingfor him and Gillard broke offher relationship and neversaw him or spoke to himagain.

An internal inquiry at thefirm did not uncover anywrong-doing on the part ofany of the partners or law-yers, according to peoplefamiliar with the history.

Now Slater and Gordon'sequity partner at the timesays there was a record ofinterview with Gillard inwhich she said she couldn'tbe certain no fraudulentlyacquired money was used in

renovating the house sheshared with Wilson althoughshe claimed to have paid forall the work and producedreceipts.

The partner, Nick Styant-Browne, says he recalledGillard saying she wasshabbily treated and resignedas a result of the inquiry.

The other version ofevents, known to and be-lieved by people close toGillard, has it that Gillardresigned of her own volitionfollowing the rift that arosefrom the argument about thefirm's direction.

Her mate and ally.Murphy, quit after an acri-monious time with seniorpartner Peter Gordon. Otherindustrial lawyers JoshBornstein and Kate Hawkinsleft at the same time andGillard left soon after, sayingshe wanted to pursue a politi-cal career.

One bit of history that cutsacross the current conspiracytheory is that Gillard hasbeen and remains a closefriend with Murphy, theSlater and Gordon partnerwho uncovered the Wilsonfraud and took immediateaction. What is missing is anyspecific allegation and exactquestions Gillard shouldanswer, as the Prime Ministersaid yesterday.
