1. Brett Higman, PHD, Ground Truth Trekking- Tsunami Presentation. He discussed the new updated tsunami

inundation study, the last one was from 2005. The updated study was really good, but the map they used did not

represent an accurate topography of the town. The work analysis looked at many scenarios, and the one shown on the

map was the worst-case scenario. That scenario would have to be a big earthquake, moving a lot of water, very near

Seldovia. The worst-case scenario probably would not be seen for many generations, well into the future. He

presented a different Seldovia map where he plotted the tsunami contour lines to corresponded with the existing

elevations and explained that before the updated tsunami inundation map was published, a better data set had been

released. The first contour line he plotted was about 30 feet above sea level. If they took the good work done with a

better map, the blue line would be the new line. He recommended that the city not operate any differently as far as

evacuating. The only place he could see looking at the map for details was for planning a new building that would be

in place for a very long time. He discussed that a tsunami was a wave in the ocean that was typically very long. It

may only be a few meters high in the inlet but as it comes in to land it will get higher. The inundation area was not

literally the wave height but how far the wave would travel. He listed several very unlikely tsunami scenarios and

stated that the model assessed the more likely model of landslides in the bay or in the inlet. There was a lot of data

that would show right away if a tsunami was not going to happen, including depth of water and depth of the event.

The last tsunami warning was issued for the possibility of landslides that extend out past Anchorage and into the

gulf. He stated that he did not know why the warning wasn’t cancelled right away and was very disappointed that it

was not. Most likely a 1964 earthquake would not be seen in their time. The 1964 earthquake covered a large area

from Cordova to Kodiak. There was an area in the mouth of Cook Inlet that didn’t move much during the 1964

earthquake that hopefully didn’t store much energy, but it was possible that it was storing energy for later. 8.0

earthquakes right on the sea floor could generate a tsunami. He discussed the faults that could generate a tsunami in

Seldovia, and the one nearest to Seldovia had no evidence of movement in 10,000 years and most likely would move

or change in the near future. He discussed that he did share his concerns about the topography with the study’s

authors during the draft version and noted his concern that there was a large difference from the 2005 study to the

recent study.

LAUREL HILTS, resident- Asked for an explanation of what a 90-foot wave inundation meant.

CM CAMERON- Asked for an explanation of why a tsunami warning was issued for the November 30th earthquake.

ANDREW MATTOX, SVFD Fire Chief- Asked for insight on the most likely case for a tsunami in Seldovia.

2. Harmony Payton, SOCC Coordinator- Lollipop Park Equipment Presentation. She presented a packet with

playground equipment replacement options. She had looked at grants with the Rasmuson Foundation, but found that

her position working for the borough could not compete with what the city does, so the city would have to apply for

the grant. The Rasmuson Foundation sent her a catalog with playground equipment in it, and she tried to keep

options in the current 0-6 demographic and included pieces that allowed more children to play at once. Local

organizations and parents have notified the city when equipment was broken. It had been ten years since the previous

grant, the city would qualify for a new grant.

CAMPBELL- Asked where the numbers presented came from.

LAUREL HILTS, resident- Inquired if there was a city maintenance plan or rotation to check park equipment from

time to time and discussed that it would be super logical to find a way for community members and businesses to

participate and help raise funds.

CM CAMERON- Discussed that maintenance removed broken equipment as needed and when notified.

ROJAS- Discussed that when Damara received a grant from the Rasmuson for kitchen the Sea Otter Community

Center kitchen it was done under the umbrella of the city.

CAMPBELL- Spoke in support of putting the Lollipop Park equipment discussion on the agenda, and discussed that

he would like to see it with budget season coming. It can take a couple of months to order equipment.

H. Public Presentation for Items not on Agenda: (public has 3 min each)

LAUREL HILTS, resident- Presented events happening in the community, including that Brett would be sharing his

tsunami presentation at Healthy Chatter that week and would probably have more time for Q&A. Healthy Chatter

had a permanent change from Fridays to Thursdays and offered good cooking from Mark Haverkate and Jonah

Custer. The Seldovia Summer Solstice festival will be having its 20th anniversary this summer and had two headline

acts already chosen, as well as a couple midlevel performers from Alaska. There were five slots from around the

state still open, and she stated she had a feeling that they would fill in a month. She asked for the city council to

consider a proclamation to celebrate their 20-year anniversary and Susan Mumma for her efforts to bring the festival

to Seldovia. She stated that they were also pretty sure that this was the 75th year of Seldovia Bible Chapel as well.

CM CAMERON- Presented Resolution 19-14. They had a preliminary engineering report for VSW to take on the

wastewater engineering and feasibility study, VSW was not sure they would receive funding this year, but they

did. The funding was for a $28,000 for the report.

1. Discussion- Seldovia Source Water Protection Plan- DRAFT

a. Presentation by Staff or Council

CM CAMERON- Introduced Kevin Schoneman from ARWA with the Seldovia Source Water Protection Plan

final draft. She stated that she was very happy to have this document for the City of Seldovia. The plan will raise

awareness and help protect the watershed. The committee will be meeting tomorrow at 1:00pm in the multi-

purpose room with the team members listed. The team included a variety of members, including, SVT, Andrew,

herself, Tyler, and Charles. They will go through the plan and find ways to implement and educate. She asked for

the city council to consider a resolution to accept the plan at the next meeting after reading it over.

KEVIN SCHONEMAN, ARWA- Discussed that after a lot of hours of work he was happy to present a Source

Water Protection Plan for Seldovia. It was also presented to the State of Alaska, who endorsed the plan and stated

that it meets all the requirements for source water protection. The state also requested to use the plan as a template

for the State of Alaska. It was a living plan and may constantly be rearranging and moving around, but this would

most likely remain the template. There was some discussion in body of plan about recent climate change trends,

but not a lot of time of time was spent on climate change.

communities leading the front and that’s exciting.

CM CAMERON- Presented the city manager’s report as written and included that she had been working in a short

window to complete the DEC registration renewals. Charles completed his class in Homer. Heidi and herself had been

holding down the fort for the last couple weeks. They were working on budget prep and gearing up to get the most out of

the hour and a half workshops. She will present a report at the next workshop report with all bells and whistles and

spreadsheets that the council likes. The City Council has discussed before the board of fisheries having their annual

meeting in Kenai. There was a board of fisheries meeting last week in Anchorage where a vote got added to agenda and

was passed to host the next year’s meeting in Anchorage instead of Kenai. Kenai had been preparing to host the meeting

and there were a lot of economic benefits to hosting the meeting. She included a letter from a Kenai Peninsula Delegation

and a news article from the Peninsula Clarion in the laydown. She asked the city council to consider a resolution

supporting the location to be in the Kenai Peninsula and discussed that the need for all levels of government to respect the

meeting process and the Open Meetings Act. She discussed that she was still working on the emergency operation plan

and had finished the risk assessment with AMLJIA. HEA was on board with having meeting, but ACS was still dodging

her. ACS did tell her that their engineers were working on replacing the backup batteries in the next couple of weeks so

that they would last at least 8 hours during a power outage and they were still working on a better plan. She conveyed to

ACS that not having telephones for emergency services was inexcusable. The city does have radios and they do extend to

Homer. There was an update to the website, Heidi worked on it for hours. The website is how the city updates

information. She discussed that she was able to strike a deal with the borough, for street signs, for a really good deal, by

placing the city’s sign order with the borough. Willie Dunn helped facilitate the deal by helping her get in touch with their

roads guy. The Borough does their own lettering and that’s what the city was going to do. She discussed that her earlier

purchase of four stop signs and was $400 and the shipping was $300. The maintenance crew is rotating the stop signs,

ones that lost their metallic could be retired or moved to a less used area. The clinic cleanup was getting done. Layla has

put in a lot of hours and had filtered through most of the debris. There will be a spring sale, with the details coming up.

Items will be put online and in the community for sale. She suggested that if people saw Layla that they thank her. She

discussed that a new hire was not on her the report, but their beloved cook Sue had hung up her apron and a new cook

Mark Haverkate was hired. The Source Water Protection Plan Committee meeting would be tomorrow at 1pm.

CAMPBELL- Discussed as previous board of fisheries member, that the first meeting of the year discussed where the

meeting would be placed the following year, and it was a big deal as it involved hundreds of people. The Upper Cook

Inlet meeting was the most contentious as it impacted the most different types of fishing and types of fisheries. He spoke

in support of having the city draft a resolution.

COLBERG- Spoke in support of drafting a resolution to the board of fisheries.

MORRISON- Spoke in support of drafting a resolution to the board of fisheries. He inquired about the houses being

required to have house numbers and if it was a concern around town.

ROJAS- Spoke in support of drafting a resolution to the board of fisheries.

LAUREL HILTS, resident- Inquired if the city had satellite phones, and asked if the emergency response radios extended

to Homer.

PAULIE CARLUCCIO, Seldovia Planning Commission Member- Discussed that the requirement to post housing

numbers was in the code including the size of the lettering. If houses don’t meet the requirements they can be fined.

The Chief of Police Report was presented as written.

CHIEF CUSHMAN- Discussed what the different codes for inside and outside of city limits were and what the 10

codes on the report meant.

1. The first FY20 Budget Workshop is scheduled for February 11, 2019 at 4:00pm.

CAMPBELL- Clarified that the first workshop was for water and sewer rates.

CITY OF SELDOVIA

ORDINANCE 19-06

AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SELDOVIA, ALASKA,

AMENDING CHAPTER 11.10.040 GENERAL UTILITY RIGHT-OF-WAY USE PERMIT

SECTION 1. CLASSIFICATION: This ordinance is permanent in nature and shall become a part of the

Municipal Code of the City of Seldovia.

SECTION 2: SEVERABILITY: If any provision of this ordinance or any application thereof to any

person or circumstances is held invalid, the remainder of this ordinance and the application to another

person or circumstances shall not be affected thereby.

SECTION 3. AMENDING CHAPTER 11.10.040 GENERAL UTILITY RIGHT-OF-WAY USE

PERMIT, BY REMOVING LANGUAGE IN STRIKEOUT TO READ AS FOLLOWS:

11.10.040 General utility right-of-way use permit. A. A general utility right-of-way use permit shall

give written evidence of a utility's written agreement to comply with terms, conditions and requirements of this

chapter, including, but not limited to:

1. A provision for indemnification by the utility saving the city harmless against any loss or damages

due to the negligence of the utility or its agents and employees while constructing, operating and

maintaining its plant and equipment in, under or over city right-of-way.

B. There is established an annual base fee for a general utility right-of-way permit in the amount listed in

the most current City of Seldovia Fee Schedule. Permit renewal fees are due at the beginning of each calendar

year.

C. A general utility right-of-way permit issued to a utility authorizes the utility to:

1. Conduct normal maintenance and/or repairs of existing utility facilities within a right-of-way.

FEE SCHEDULE TO INCLUDE A DRIVEWAY PERMIT APPLICATION FEE, AN

ENCROACHMENT PERMIT APPLICATION FEE, AN INDIVIDUAL RIGHT-OF-WAY

PROJECT APPLICATION FEE, A GENERAL UTILITY ROW USE PERMIT FEE, AND A

WHEREAS, the City Council of the City of Seldovia passed Ordinance 19-02 adopting chapter 11.10

permits for utility use of right-of-way on November 26, 2018; and

WHEREAS, the City Council of the City of Seldovia passed Ordinance 19-05 adopting chapter 11.05

Right of Way Restrictions and Regulations on December 10, 2018; and

WHEREAS, Ordinance 19-02 states that the general utility row use permit application and the utility

construction project permit application shall include a fee in the amount listed in the most current City

of Seldovia Fee Schedule; and

WHEREAS, Ordinance 19-05 states that the driveway permit application fee, the encroachment permit

application fee, and the individual right-of-way project application fee shall be provided in the current

approved City of Seldovia Fee Schedule.

NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF SELDOVIA:

SECTION 1. A Non-Code Ordinance amending FY 2019 fee schedule to include a driveway permit

application fee, an encroachment permit application fee, an individual right-of-way project application

fee, a general utility right-of- way use permit fee, and a utility construction project permit fee.

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SELDOVIA, ALASKA

ENCOURAGING THE STATE OF ALASKA BOARD OF FISHERIES TO RESCIND

THEIR JANUARY 18, 2019 DECISION TO MOVE THE UPPER COOK INLET 2020

FINFISH MEETING TO ANCHORAGE DUE TO THE LACK OF ADEQUATE PUBLIC

NOTICE AND PROCESS

WHEREAS, in March of 2018 the State of Alaska Board of Fisheries (BOF) considered and

passed Board Policy 2018-289-FB by a vote of 4-2 at their Statewide Dungeness Crab, Shrimp,

and Miscellaneous Shellfish meeting, establishing a rotating schedule of the Upper Cook Inlet

Finfish (UCI) meeting between the communities of Kenai / Soldotna, Palmer / Wasilla, and

Anchorage beginning with Kenai / Soldotna in 2020, Palmer / Wasilla in 2023, and Anchorage in

2026; and

WHEREAS, prior to considering Board Policy 2018-289-FB, the public was adequately noticed

35 days prior to the vote through the Boards Supplemental Notice of Regulatory Actions to Be

Taken on February 2, 2018; and,

WHEREAS, during the BOF Arctic / Yukon / Kuskokwim Finfish meeting held from January

15 – 19, 2019 in Anchorage the BOF voted 4-3 to move the UCI 2020 meeting to Anchorage;

and,

WHEREAS, adequate public notice was not provided prior to the vote, the action was

inconsistent with past BOF practices, and it did not meet the requirements of the Open Meetings

Act; and,

WHEREAS, this action has the potential to erode the public trust in the BOF process; and,

WHEREAS, City of Seldovia is located on the southern portion of the Kenai Peninsula and

waters of Cook Inlet; and

WHEREAS, many local residents are impacted by Upper Cook Inlet Finfish fisheries either

directly or indirectly; and

WHEREAS, conducting the Alaska Board of Fisheries Upper Cook Inlet Finfish meeting

exclusively in Anchorage hinders local attendance, participation and knowledge due to the

expenses and time required to travel such distances; and

WHEREAS, all users of public resources are entitled to reasonable access to public meetings

and processes concerning matters affecting their economy, livelihood and lifestyle; and

WHEREAS, holding the 2020 Alaska Board of Fisheries Upper Cook Inlet Finfish meeting on

the Kenai Peninsula would improve that access for locals; and

WHEREAS, all Alaskans deserve consistency, openness, legal compliance, and transparency

when engaging with their government during any deliberative decision-making process.

NOW THEREFORE BE IT RESOLVED THAT: The City Council of the City of Seldovia

encourages the State of Alaska Board of Fisheries to rescind their January 18, 2019 decision to

move the Upper Cook Inlet 2020 Finfish meeting to Anchorage due to the lack of adequate

public notice and process and that a copy of this Resolution be forwarded to Governor Mike

Dunleavy, Board of Fisheries Chair, Reed Morisky, Board of Fisheries Members, and the Board

of Fisheries Executive Director, Glenn Haight.

RESOLUTION 19-16

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SELDOVIA, ALASKA

ADOPTING THE CITY OF SELDOVIA SOURCE WATER PROTECTION PLAN AND

AUTHORIZING THE CITY MANAGER TO FORWARD THE DOCUMENTS TO THE

STATE OF ALASKA AND OTHER ORGANIZATIONS AS APPROPRIATE

WHEREAS the Environmental Protection Agency (EPA) sets standards for drinking water

quality under the Safe Drinking Water Act (SDWA); and

WHEREAS the State of Alaska developed a plan describing a single program known as

Drinking Water Protection Program (DWPP) that meets all of the SDWA requirements and was

approved by the EPA in April, 2000; and

WHEREAS the DWPP promotes the development of voluntary Drinking Water Plans for all

Community Water Systems; and

WHEREAS the Council of the City of Seldovia recognizes the importance of developing a

Seldovia Drinking Water Source Protection Plan (SDWSPP); and

WHEREAS the City of Seldovia and the Seldovia Drinking Water Source Protection Plan

Committee (SDWSPP) worked with and was assisted by the Alaska Rural Water Association

(ARWA) to create such a plan; and

WHEREAS: drinking water systems that have completed a Source Water Protection Plan will

have information on watershed characteristics, a detailed contaminant source inventory, and an

implementation plan that determines the best response to ensure the continued quality of the

water supply.

NOW, THEREFORE, BE IT RESOLVED THAT: the City Council of the City of

Seldovia, Alaska; adopts the City of Seldovia Drinking Water Source Protection Plan

(SDWSPP) and authorizes the City Manager to forward the documents to the State of Alaska

and other organizations as appropriate.
