Executive Summary

Three channels within the Lake James southern basin located in Pleasant Township, Steuben County, Indiana, were evaluated for dredging. Sediments and organic matter have accumulated in channels associated with Bledsoe’s Beach, Potawatomi Acres, and Glen Eden since these areas were last dredged. Residents and lake patrons report that the accumulation of sediment and organic matter has resulted in boats hitting bottom during periods of low water.

Lake James Association (LJA) applied for an Indiana Department of Natural Resources (IDNR) Lake and River Enhancement (LARE) grant to fund development of a plan to remove accumulated sediment and organic material from critical areas in Lake James. Bledsoe’s Beach, Potawatomi Acres, and Glen Eden were identified as critical and in the most need of dredging activities. LJA received funding and subsequently hired Davey Resource Group, a division of The Davey Tree Expert Company, to develop a Sediment Removal Plan.

Davey Resource Group assessed the depth of accumulated sediment in the channels on August 22, 2013, and determined that 16,600 cubic yards of material must be dredged from the three project areas to consistently provide sufficient water depths to obviate boats from becoming grounded. Sediment was analyzed for arsenic, barium, cadmium, lead, mercury, selenium, and silver concentrations to determine suitability for land application. Elevated levels were not observed.

Mechanical dredging was identified as the most suitable method to remove accumulated sediment from all project areas. Sediment disposal is proposed within a field owned by Whisper Bay Condos. No primary impacts to regulated water resources will result from the proposed plans.

This project will require a Stormwater Pollution Prevention Plan, a Lake Preservation Act permit from IDNR, and a land use agreement for the sediment disposal area in order for dredging to proceed.

Included with this report are example bid documents and a land use agreement that LJA can tailor as deemed necessary.

This project will take about two years to complete in entirety. Timing can be affected by limits associated with the fish spawning season, seed germination (for the sediment disposal area), weather, the rate at which dredged sediment in the sediment disposal area dries, and decommissioning of the sediment disposal area.

This project will be complex to conduct. Davey Resource Group recommends LJA consider hiring a consultant to provide project management and oversight.

A special committee of LJA called the Lake and Environment Committee sets goals and leads efforts to improve the lake water quality and aquatic habitat. To achieve goals ratified by LJA, the special committee partners with government agencies, businesses, and academia to conduct studies and complete projects to manage lake weeds and invasive species, reduce lake sedimentation, and sustain safe watercraft navigability on Lake James. Project Purpose

LJA has identified bays and channels on Lake James where water depths are normally very shallow, which causes watercraft to become mired, stuck, and sometimes damaged when navigating the areas. The problem is exacerbated during drought conditions. LJA will seek to obtain funds from the Indiana Department of Natural Resources (IDNR) Lake and River Enhancement (LARE) program to hire a contractor for removal of sediment in these areas.

LARE program requirements stipulate that a sediment removal plan (SRP) be developed in accordance to the LARE program scope of services for sediment removal plans. This SRP plan was developed in accordance with the scope of work dated October 2013 prior to seeking dredging funds.

Project Location

Lake James is located in Pleasant Township, Steuben County, Indiana (Figure 1). The nearest city is Angola. Lake James is generally accessible via Interstate 69, taking Exit 350 for North County Road (CR) 200 West, thence north (Figure 2). The Lake James legal lake level is 964.96 feet above sea level. The areas targeted for sediment removal are commonly known as Bledsoe’s Beach, Potawatomi Acres, and Glen Eden. These locations area indicated in Figure 2. National Wetland Inventory (NWI) mapped wetland locations and other features surrounding Lake James are represented in a 7.5-minute topographic map from the United States Geological Survey (Figure 3).

Coordinates for dredging sites and disposal sites are in Table 1. The sites are located in Hydrologic Unit Code (HUC) 040500010803. Representative photographs of the sites are included in Appendix A.

Public Involvement

According to William Hartsuff, project sponsor contact, Lake James Association members readily voice concerns about sediment accumulation around the lake when problems become evident. The potential problems mostly include issues of lake access and watercraft damage. Concerns were largely conveyed by informal conversations with board members and during official board meetings. Concerns pertaining to the connection between Lake James and Jimmerson Lake have also been raised in the past.

Information about the sediment removal plan development was presented and solicitation for input was made at LJA’s annual breakfast meeting held at the Lake James Christian Assembly activity hall on Saturday, July 13, 2014, by Caleb Asbury of Davey Resource Group.

Sediment Characterization

Sediment Mapping and Depth Determination

Sediment and water depth measurements were performed on August 22, 2013 to approximate amounts of sediment to be dredged from target areas in Lake James. A hollow polyvinyl chloride (PVC) pipe, with an inside diameter measuring 1.5 inches, was lowered to the top layer of sediment to record water depth. The pipe was then pushed through the depositional layers of sediment to the original channel depth to record sediment depth. The PVC pipe was capped to allow transport of deposited sediment to the surface, much like holding one’s finger on top of a straw and lifting up. The collection method and depth measurements were repeated several times at regularly spaced intervals throughout each target area. Each sediment sample was placed in a large container and mixed to create one composite sample per target area.

Sediment depth measurement locations were mapped using a GeoXH™ Trimble® GeoExplorer® 6000 series Dual-frequency Global Navigation Satellite System or GNSS (GPS, GLONASS, SBAS [WAAS]) receiver and antenna with Everest™ multipath rejection technology and Floodlight technology with 220 channels, running professional TerraSync™ software capable of decimeter (10–75cm) accuracy after differential correction.

Trimble® GPS Pathfinder® Office software was used for postprocessing the GNSS field collected data incorporating Trimble® DeltaPhase™ differential correction technology using GPS data collected from an appropriate base station. The corrected GPS latitude-longitude positions were exported into a compatible coordinate system as an AutoCAD® drawing interchange file (DXF). The vegetation and water resources maps included in this report were prepared using AutoCAD Map® 2012 software. Sediment depth measurements and volume estimate maps for each site are included in Appendix B.

Sediment Origin

Bledsoe’s Beach (Photograph 1) is an island adjacent to a public access ramp for Lake James. A no-wake zone surrounds the area; however, wave energy from boat traffic is still eroding the island. The island is made largely of marl which is a mix of clay and invertebrate shells. The lake shoreline surrounding the channel is composed of loamy sands (Web Soil Survey 2014). A mixture of the two sediment types has deposited into the channel near the island and public access site. The resulting mixture is very compacted.

Glen Eden is a series of channels that allow access to Lake James for many residents. The surrounding upland is densely forested. Organic deposition from decomposing leaves as well as aquatic vegetation constitute the majority of fill material in this section of the lake. Suspended sediment from lake water and shoreline erosion also result in soil deposition in the channel.

Potawatomi Acres is a small channel shared by many households. The channel forms a man-made island on which multiple houses are located. Boat traffic contributes a large part to shoreline erosion. The original channel was dug extremely steep resulting in an accelerated shoreline erosion process. The channel shoreline is composed of loamy sand (Web Soil Survey 2014). Organic deposition from decomposing leaves and aquatic vegetation also contribute to fill material found in Potawatomi Acres. Organic material and loamy sand were observed within the channel bottom. Table 2 summarizes sediment sources for each location.

Chemical Composition

Composite sediment samples were collected at each of the proposed sediment dredging sites. The composite samples were placed on ice and transported to Sherry Laboratories for analysis. The samples were screened for Resource Conservation and Recovery Act (RCRA) metals and other non-RCRA metals. Laboratory results and chain-of-custody forms are provided in Appendix C. A summary of results is in Table 3. The U.S. Environmental Protection Agency (USEPA) and the Indiana Department of Environmental Management (IDEM) has set limits on the concentrations of metals that can be applied to land. The levels observed fall well below the IDEM maximum concentrations for land application. No further testing is recommended or required (D. Nusbaum, personal communication, November 18, 2013).

Samples were also analyzed for ammonia-nitrogen and phosphorus. These nutrients when elevated can accelerate lake eutrophication. The results presented in Table 4 are not a concern (D. Nusbaum, personal communication, November 18, 2013).

Volume Determination

Water and sediment depth measurements were taken in the areas evaluated for dredging. Current channel depth and original channel depth measurements were recorded. The legal lake level for Lake James is 964.96—the lake was at normal pool levels during sampling. The difference between the two measurements results in the depth of dredge material for each measurement site. Each measurement site was mapped using GPS. Davey Resource Group calculated an overestimate for dredged sediment within the channels using field measurements and by assuming a rectangular channel shape. Final channel shapes will be convex rather than having straight sides. Assuming the channel’s sides move straight down instead of gently sloping inward will provide dredging contractors enough information to prepare for excavation activities as well as ensure enough space is properly prepared to receive dredge materials. Maps depicting sediment removal areas, sediment depths, and cubic yard estimates of sediments proposed to be dredged are located in Appendix B. A maximum total of 16,600 cubic yards of sediment is proposed to be dredged.

Davey Resource Group recommends dredging Potawatomi Acres to the original channel depth. Davey Resource Group also recommends dredging Glen Eden to a final depth of 5 feet. Dredging to this depth will save cost and adhere to permitting requirements from IDNR Division of Fish and Wildlife (Nate Thomas, personal communication, February 25, 2015). The original channel depth varies throughout the channels (Appendix B). Dredging to the depths described will help deter undesirable plant growth within the channels. Desirable species, such as arrowhead (Sagittaria latifolia) and spatterdock (Nuphar lutea), currently grow in two small channels between islands in Glen Eden. Davey Resource Group has not included these areas in volume determination and recommends leaving these areas undisturbed. Precautions should be taken by dredging contractors to ensure these areas are not disturbed by dredging activities. Two volume determinations were made for Bledsoe’s Beach. Davey Resource Group recommends dredging to a minimum depth of 5 feet. The need for near term future dredging is low because source sediment appears to be coming from a nearby eroding island. Dredging the entire project area to 5 feet will result in removal of 6,100 cubic yards of sediment (Appendix B, Bledsoe’s Beach Option 1). The most critical areas for dredging include the entrance and exit channels surrounding the island and boat ramp (Appendix B, Bledsoe’s Beach Option 2). These areas experience the most traffic and are also the shallowest. The option to only dredge the most critical areas at Bledsoe’s Beach may be discussed between LJA and the IDNR LARE program when applying for sediment removal funding (D. Nusbaum, personal communication, October 18, 2014). Choosing Option 2 would reduce the amount of sediment to be removed to 2,700 cubic yards and lower project costs—assuming a final depth of 5 feet throughout the area.

Excavation Method Options

Overview of Excavation Method Options Considered

Two common methods of dredging materials from lakes and ponds include excavation and hydraulic dredging (Crooke et al. 1993). Excavation involves the use of an excavator (Photograph 2) or dragline. Excavation is limited to the reach distance of the excavator used, which is typically an issue associated with excavators operated from shore. Some excavators are mounted on barges, which increases accessibility to dredge areas. Shallow water depth can limit the use of barge-mounted excavators. Material can be dumped along shorelines or deposited in leak-proof dump trucks standing within reach to receive dredge material, which is then hauled to an off-site disposal area. Sediment may be loaded directly into leak-proof dump trucks from a dredging barge (Photograph 3) using a “one-step” method. When excavators are operated on barges, a dump bin can be attached to the barge to carry the dredge material to shore where it can be offloaded.

Excavation can take place at normal water level elevations or the water level can be partially drawn down. This is referred to as “wet excavation”, which is typically permissible when migration of a sediment plume is either not likely or not a concern. Dry excavation involves draining a lake as much as possible. This helps increase the speed of the dredging activity, reduces the migration of sediment plumes, and reduces the volume of water that is hoisted from the lake in excavator buckets.

Water in dredge material hoisted to shoreline dump areas draining back to a lake or other regulated waters may be an issue, as the water may be turbid and carry sediment and nutrients with it as it drains away from the dump area.

Hydraulic dredges are common machines that float like a barge under their own power (Photograph 3).

They are transported on flatbed semi-trailers, and are placed in a lake using a crane or launched into a lake in a fashion similar to a boat. A typical hydraulic dredge is equipped with a cutter head powered by a hydraulic system. The cutter head chews up sediment combining it with lake water to produce slurry comprised of approximately 70–90% water depending on sediment type. An onboard pump sucks the slurry from the area around the cutter head into a pipe and discharges it to another area of the waterbody or to a more remote location on land.

Hydraulic dredges generate enormous amounts of slurry that must be dewatered if land disposal of sediment is planned.

Sediment dewatering basins are engineered structures designed to contain slurry for a sufficient duration to allow solids to settle out via gravity (Photograph 4). Water is allowed to flow from the dewatering basin through a pipe located at a high elevation. Polymers and coagulants can be added to the slurry to increase the rate of solids settling.

Geotubes, also known as geo-textiles or “bags” by contractors in the industry, are often utilized when a sediment dewatering basin is not possible. Geotubes are made-to-order to any required length. Larger geotubes are often 200 feet long with a circumference of 75 feet. Geotubes act as a filtering bag collecting hydraulically dredged slurry in an upland location. Excess water will filter through the bag once enough pressure exists. The filtered water is collected and brought back to the original waterbody leaving the sediment behind inside the bag. Even with polymers, an additive used to increase to capacity of each geotube, the bags may only utilize 80% of their 1,000 cubic yard volume for sediment storage. The larger bags described above will hold approximately 800 cubic yards of dredged sediments when polymers are added. Sediment may take between 6 to 12 months to dry within the bag depending on site conditions and when dredging occurs. The dried sediment can be easily excavated and moved to any location once dry.

Material dredged from Indiana lakes is typically rich in nutrients, which makes it a great soil amendment. Because the dredge material is high in nutrients, the potential negative impact of runoff water flowing back to lakes, streams, wetlands, and other water resources must be considered.

Preferred Excavation Method

Hydraulic dredge units are mobile, allowing operators to move throughout the lake to all dredging sites with greater ease than other methods. This method is often cheaper than other alternatives as well; however, only Potawatomi Acres (22% of dredge volume) may be hydraulically dredged because of its close proximity to a potential sediment dewatering basin. Potawatomi Acres is within 1,500 feet of a potential dewatering basin. Hydraulically dredging Bledsoe’s Beach and Glen Eden would require pumping material across long distances—over a mile in the case of Glen Eden. Pumping dredge material this distance is not feasible.

Shoreline excavation requires the use of adjacent land to perform dredging activities—a feature not available in most areas around Lake James. Sufficient space is not available for an excavator to move along the shoreline to reach all target areas at Glen Eden, Potawatomi Acres, or the exit channel south of the island at Bledsoe’s Beach. Shoreline excavation could be used at all other areas of Bledsoe’s Beach.

Bledsoe’s Beach and Glen Eden will require mechanical barge-mounted excavators to dredge due to the lack of space for a dewatering basin and shoreline excavation equipment. Therefore, mechanical dredging by barge is recommended for all three project areas. Dredged materials will be taken from the lake and placed directly into a truck. The truck may then move the dredged materials away to an upland disposal location.

Sediment Dewatering and Disposal

A site has been selected where sediment may be permanently disposed. Mechanical dredging using a “one-step” method allows contractors to move dredged materials more concentrated than other dredging methods. A one-step method decreases permitting requirements as well as the cost for dewatering basin construction and decommissioning because the basins size requirements are minimal compared to hydraulic dredging. The water dredged with the material is very low allowing the site to be decommissioned more quickly than a standard dewatering basin. Erosion control required for mechanical dredging is minimal when compared to hydraulic dredging. Best management practices such as silt fencing can be used to keep sediment on site and not transported into the surrounding drainage system.

Primary Disposal Site – Whisper Bay Condos Property Site Description and Ownership

The best location for construction of a sediment dewatering basin and sediment disposal is on property owned by Whisper Bay Condos located on Lane 325 Lake James. The site is located south of this road and the Whisper Bay Condos (Appendix D). This site is proposed to dewater sediment mechanically excavated from Bledsoe’s Beach, Potawatomi Acres, and Glen Eden (Photograph 5). The site may also hold hydraulically dredged material from Potawatomi Acres if the IDNR LARE program, LJA, and dredging contractors agree that it is a better option for Lake James in terms of logistics and costs associated with all Lake James dredging projects.

The site is approximately 4 acres (1.6 hectares) of which approximately 2 acres (0.8 hectare) could conservatively be used to hold dredged material. The field is sloped upward on its southern edge which will allow for easy basin construction because the area is currently a “bowl” shape (H. Davis, personal communication October 6, 2014). A decommissioned sewer structure is located in the middle of the site. The structure has not been in service since May 2006 (Steuben Regional Lake Waste District, personal communication October 15, 2014). Frank Baade, the President of the Board of Directors for Whisper Bay Condos, has given permission for contractors to do whatever they feel is necessary to remove, work around, or bury these structures.

The site is comprised exclusively Kosciusko gravelly sandy loam (KsC) soils having 6 to 12 percent slopes. These soils are non-hydric. Hydric soils are located to the west across County Road 225 West. Hydric soils in this area include Houghton muck (undrained) and histosols (ponded) (Web Soil Survey 2014). This area is depicted on National Wetland Inventory (NWI) maps as a mixture of emergent and forested wetlands (USFWS 2014). Construction of a sediment dewatering basin where proposed will not impact wetland areas. Contractors shall take necessary steps to ensure the wetlands will not be impacted in any way from dredging activities.

Land Use Agreement and Availability Whisper Bay Condos has verbally committed to using their property for sediment dewatering and disposal. Frank Baade, the current Lake James Association President, is also the President of the Board of Directors for Whisper Bay Condos. His contract information may be found below:

Sediment Dewatering Basin Plan Approximately 2 acres (0.8 hectare) of the Whisper Bay Condos site can hold dredged material in the form of an upland sediment disposal (spoils) pile or sediment dewatering basin. The effective disposal area lies below the surrounding landscape in a natural bowl-shape. Approximately 1 acre-foot is needed to dispose of 16,000 cubic yards of mechanically dredged sediments. Extrapolating this estimate, a total of 16,600 cubic yards of mechanically dredged sediment will increase 2 acres of land by approximately 1.1 feet. Whisper Bay Condos would like the dredged material to flatten the existing site grade. The goals of LJA to dredge sediment and Whisper Bay Condos to receive sediment are well in line with one another. Sediment disposal should be discussed with Frank Baade, President of the Board of Directors for Whispering Bay Condos, and the current LJA President prior to sediment disposal. Whisper Bay Condos may want more sediment allocated in specific areas of the sediment disposal area. Davey Resource Group recommends the use of mechanical dredging in all proposed project areas. While Potawatomi Acres may be dredged hydraulically, Bledsoe’s Beach and Glen Eden must be dredged mechanically. The primary basin cannot be used for disposal of both hydraulic and mechanical dredged sediment simultaneously—the process of dewatering could last anywhere from 6 to 24 months if hydraulic dredging is used. Using both hydraulic and mechanical dredging will result in increased costs for equipment mobilization.

Secondary Disposal Site – Jim Neuenschwander’s Property Site Description and Ownership

Jim Neuenschwander owns multiple parcels surrounding Lake James. He recently accepted dredged sediment from the Lake James Laguna Park dredging project after the sediment was dewatered.

Mr. Neuenschwander is not interested in having a sediment dewatering basin on his property, but dry sediment may be placed within an agricultural field located west of the intersection between County Road 200 West (North Bay View Road) and County Road 275 West Lake James (Appendix D). This site can be utilized for disposal of sediment mechanically excavated from Bledsoe’s Beach, Potawatomi Acres, and Glen Eden if the primary site south of Whisper Bay Condos will not work.

Sediment Dewatering Basin Plan Mechanical dredging allows managers to haul concentrated amounts of dredged materials. Large quantities of water will not be accompanying the material to the disposal site. Any excess water will quickly percolate through the soil. Large-scale basin construction is not required nor permitted by the landowner at the secondary disposal site (owned by Jim Neuenschwander). Sediments may be spread across the 70-acre parcel by the landowner. If the materials are spread over a few acres, the resulting final grade elevation of the field will not increase significantly.

Permits

The dredging project requires a Lakes Preservation Act permit from IDNR, Division of Water (DOW) in accordance with 312 IAC 11 for disturbance to the lake bed beneath the legal lake level. Application materials and instructions are available on the IDNR website at the following address: http://www.in.gov/dnr/water/4945.htm. The permit application and public notice forms are in Appendix F. LJA may elect to complete the application or hire a contractor to complete the process. Information contained in this SRP can be used to complete the permit application.

Indiana Administrative Code 327 15-5, commonly referred to as “Rule 5”, requires a Storm Water Pollution Prevention Plan (SWPPP) be prepared for projects that result in land disturbance equal to or greater than 1 acre. The SWPPP should be prepared according to IDEM specifications and submitted to the Steuben County Soil and Water Conservation District (SWCD) for review. Details about the program are located on the IDEM website at the following address: http://www.in.gov/idem/4902.htm. Because the sediment disposal area will disturb more than 1 acre of land, a SWPPP must be prepared. LJA may elect to have the contractor who is hired to dredge and move the sediment also complete and submit the SWPPP, or a company independent of the dredging contractor may be retained to develop the SWPPP. Approximately 30 days should be allotted to receive approval of the SWPPP after it is submitted to the SWCD for review. The SWPPP will also require a public notice. The SWCD approval notice and proof of public notice must then be submitted to IDEM. Work may commence 48 hours after these materials are submitted to IDEM.

There are no regulated waters above the legal lake level around Lake James that will be impacted by this project as proposed. Impacts to wetlands and other regulated waters require permits from the U.S. Army Corps of Engineers (USACE), IDEM, and/or the IDNR. LJA needs to communicate to all contractors that permits to impact wetlands and streams in the course of this project have not been obtained, and that all such areas must be completely avoided. Further, sediment-laden water must be adequately filtered prior to flowing into a regulated waterbody. An adequate SWPPP will prevent unintended water pollution. The recommended one-step mechanical dredging involves no return water back into Lake James or any other body of water; thus, USACE and IDEM will not require permitting for dredging activities. If return water is brought back to Lake James or any other federal and/or state regulated waterbody it may be regulated by USACE and IDEM if turbidity measurements are high. IDEM would like additional collaboration with dredging contractors to ensure dredged materials will not be placed in wetlands or any other water resource (H. Parsons, personal communication October 17, 2014). Underground culverts could be used during hydraulic dredging of Potawatomi Acres to bring sediment to and from a dewatering basin. The Steuben County Highway Department does not have a specific permit for culvert use; however, they would require a general utility permit for work within utility rights-of-way (Appendix G). Coordination between Jennifer Starkey with the Steuben County Highway Department and any contractor(s) awarded the project should occur before the use of underground culverts.

Table 5 summarizes the permit requirements for both mechanical and hydraulic dredging methods. More permits are required for hydraulic dredging from different federal, state, and county regulatory authorities.

It is Davey Resource Group’s professional judgment that this project should not cause impacts to protected or endangered species or significant habitat used by wildlife. Therefore, coordination with the U.S. Fish and Wildlife Service is not required. The IDNR, Division of Fish and Wildlife may provide input on the Lake Preservation Act permit in the course of review by IDNR. Davey Resource Group recommends early coordination with Nate Thomas, IDNR Division of Fish and Wildlife Lakes Permitting biologist, regarding dredging activities. This is especially true for any dredging activity below 6 feet within a man-made channel or within naturally shallow areas of Lake James. The entrances to the Potawatomi Acre channels are an example of a naturally shallow area. Dredging the channel entrances could possibly be permitted due to sediment type and origin (Nate Thomas, personal communication February 25, 2015). The sediment disposal area is not proposed to be located within a regulated floodway; therefore, a Flood Control Act permit from the IDNR, Division of Water is not required.

Construction Schedule and Sequence of Work

The deadline to submit grant applications to the IDNR LARE program is January 31 each year. Awards are typically announced in March. IDNR typically does not allow dredging projects to occur during the fish spawning season, which is April 1 to June 30. If LJA receives a LARE grant, LJA will need to finalize contract agreements with contractors immediately thereafter to afford contractors sufficient time to plan for the project and mobilize equipment to the project site. It is advisable for LJA to apply for and obtain a Lake Preservation Act permit from IDNR, Division of Water as soon as possible, because it may take several months to receive the permit. Permit application data may be entered online to save up to 4 weeks in the permitting process: http://www.in.gov/dnr/water/4998.htm. Provided LJA applies for permits by April 2015, it is realistic to expect the dredging project can commence in October or November 2015. A detailed timeline for the project is located in Table 6.

If hydraulic dredging is used at Potawatomi Acres, the sediment dewatering basin can be constructed 48 hours after the required SWPPP Notice of Intent is submitted to IDEM. The same would apply for the placement of mechanically dredged sediment. It should take 2 weeks to a month to construct a basin. Between 6 and 24 months may be required for dredge slurry to dry sufficiently enough to allow the site to be graded and restored. LJA should be prepared to monitor the site and ensure the contractor restores the site as agreed upon by LJA and Whisper Bay Condos or Jim Neuenschwander. Once dredge material is dry, it may be used as a soil amendment. This SRP does not include instructions for such use.

Project Management and Oversight

LJA may retain an independent consultant to manage and oversee this project, so as to ensure the procedures and specifications outlined in the SRP are followed and completed correctly. The consultant should be on site to regularly inspect erosion and sediment control measures; oversee construction, operation, and maintenance of the sediment dewatering basin; and restoration of the area after the basin is decommissioned as well as observe the sediment removal process.

Cost Estimates

The sediment removal plan involves multiple components, which include project management and oversight, permit acquisition and SWPPP development, and restoring the sediment disposal area once the project is complete and sediments are dry. Added components for hydraulic dredging at Potawatomi Acres include construction, decommission, grading and seeding the sediment dewatering basin, and increased permitting requirements. Davey Resource Group recommends obtaining cost estimates for each component separately, as one or more contractors may be involved in one or more components. A summary of estimated costs is included in Table 7.

Davey Resource Group solicited rough cost estimates from contractors to dredge all three areas as specified in the SRP as well as manage the specified primary sediment disposal area. Estimates varied significantly. The costs to construct sediment dewatering basins and other dredging activities are unique to each sediment removal project. Therefore, solicited cost estimates were averaged to derive an estimated cost to dredge Bledsoe’s Beach, Potawatomi Acres, and Glen Eden as well as management of a sediment disposal area south of Whisper Bay Condos property.

Mechanical dredging, including the cost of equipment mobilization and sediment transport to the disposal site, is estimated to cost $14 per cubic yard for a total estimated cost to dredge 16,600 cubic yards of $232,400. This cost can be affected significantly by fluctuating fuel costs and the distance contractors need to travel. A small disposal basin costing approximately $5,000 will be required. Silt fence installation at the primary sediment disposal site will cost approximately $4,500. Resurfacing and seeding costs for the sediment disposal site should not exceed $5,000 in the case of mechanical dredging.

Bledsoe’s Beach Option 2 reduces the amount of dredge material by 3,400 cubic yards. At $14 per cubic yard this option would save approximately $47,600 from the total project cost.

Hydraulically dredging Potawatomi Acres, which comprises 22% of the total proposed dredging volume, will result in the increased costs for equipment mobilization. Mobilization fees vary for each contractor and each project; however, $30,000 is an average estimate for mobilization. Sediment can be removed hydraulically and pumped to a sediment dewatering basin for approximately $8 per cubic yard. The basin will cost approximately $12,000 to construct including erosion control. The primary sediment disposal area could be used to hold mechanically dredged sediments from Bledsoe’s Beach and Glen Eden after hydraulically dredged sediment has dewatered. The dewatering process typically lasts 6 to 24 months. Davey Resource Group does not recommend using the primary sediment disposal area for disposing both hydraulic and mechanically dredge material disposal concurrently. The dewatering basin must be decommissioned once sediments have dewatered. The decommissioning process involves regrading and seeding the area for approximately $5,000. Additional permits will also be required from USACE, IDEM, and the Steuben County Highway Department because water must return to Lake James. The additional permitting is estimated to cost an additional $2,000. The total estimated cost to perform hydraulic dredging and fully construct and decommission the sediment dewatering basin is $77,800. By adding an additional 10% contingency for unforeseen changes, LJA should plan on hydraulic dredging of Potawatomi Acres to cost $85,600.

Davey Resource Group does not recommend hydraulic dredging for Potawatomi Acres based on the small site size relative to the rest of the project areas and the additional costs associated with using two dredging methods. Mechanically dredging all sites will cost approximately $232,400. Hydraulically dredging Potawatomi Acres and mechanically dredging Bledsoe’s Beach and Glen Eden will increase the project cost to $288,800, a cost increase of $56,400.

Geotubes could be utilized at Bledsoe’s Beach. A large parking area and grass field exist adjacent to the site where geotubes could be placed. Option 1, approximately 6,100 cubic yards, will require 8 geotubes. Option 2, approximately 2,700 cubic yards, will require 4 geotubes. Each geotube costs approximately $7,500. Mobilization of required equipment will cost approximately $30,000. The average cost to hydraulically dredge in northeast Indiana is $9 per cubic yard. Excavation and movement of sediment to a nearby location will cost approximately $4 per cubic yard once sediment in each bag has dried sufficiently. The total cost for Option 1 is approximately $170,000. The total cost for Option 2 is approximately $96,000. If a sediment disposal basin location is found the cost of dredging could decrease dramatically. The cost of constructing a disposal basin is site specific. A dredging contractor should be consulted if a suitable location is identified for cost approximation. The use of a basin could save as much as $45,000 for Option 1 and $15,000 for Option 2 assuming a basin construction cost of $15,000.

Geotubes were considered for use at Glen Eden; however, sufficient space is not available to allow for bag storage. Approximately 9 geotubes are required to hold dredged materials from Glen Eden.

Geotubes could be utilized for Potawatomi Acres as well for an increased cost of approximately $52,000 compared to sediment basin disposal. Approximately 5 large geotubes would be required and dried sediment from the bags would require transport costs. The total cost to dredge Potawatomi Acres using geotubes is approximately $137,600.

Contractor Selection

Davey Resource Group recommends soliciting bids from multiple contractors to complete the dredging project. This project is comprised of five distinct components, which includes:

Project management and oversight Permit acquisition including SWPPP development and submittal and IDNR Lake

Preservation Act permit application submittal Sediment disposal area preparation, decommissioning, and site restoration Mechanical dredging operations Post-dredging channel bathymetric survey

Bidding forms are provided in Appendix H. A committee should be formed to carefully review all bids, ensuring that proposed work coincides with specifications and the project timeline outlined in the SRP. LJA should reserve the right to reject any or all proposals, or recommend modifications to proposals received. Written formal agreements between LJA and contractors are strongly recommended. Agreements should specify a project work schedule, project milestones, project status communication requirements, and a payment schedule and terms. LJA should request proof of liability insurance from all contractors at the time bids are solicited, and should require certificates of insurance or a bid bond from all hired contractors.

AGREEMENT FOR THE PURPOSE OF ACCESS FOR CONSTRUCTION AND MAINTENANCE OF

A TEMPORARY SEDIMENT DEWATERING BASIN

This Agreement is made and entered into on this _____ day of _______________, 2013 by and between _________________________ (OWNER) and the Lake James Assocation (LJA), a not-for-profit corporation organized under the laws of the State of Indiana. WITNESSETH: OWNER, in consideration of the rents and covenants contained herein, does hereby enter in this Agreement for the use and maintenance of real property located in _________________ Township, Steuben County, Indiana, Section __, Township __ N/S/E/W, Range __8 N/S/E/W; and, more particularly described on the attached plan sheet, attached as Attachment A (herein after referred to as the Property) and does grant LJA access to said Property for construction and maintenance of a temporary sediment dewatering basin. WHEREAS, LJA is a not-for-profit Indiana Corporation which is dedicated to improving the water quality of Lake James located in Pleasant Township, Steuben County, Indiana; and WHEREAS, LJA wishes to undertake activities including construction and maintenance on the Property as part of its channel dredging project to improve the navigability on Lake James, and the general water quality of the lake; and WHEREAS, OWNER is in Agreement with LJA’s desire to conduct the channel dredging project. NOW, THEREFORE, OWNER, for themselves, their successors and assigns, and their administrators, in consideration of the covenants, undertakings, and Agreements hereinafter set forth, and in consideration of the sum of _____________________ and other valuable consideration, the receipt of which is hereby acknowledged, hereby grants LJA reasonable access to the Property described hereinabove under the following terms and conditions: AGREEMENT PART 1 – ACCESS

1.) REFERENCE. Agreement Part 1 shall refer to the access unto the Property as designated on Attachment A.

2.) TERM. The term shall commence on the day this Agreement is signed by the parties hereto and shall continue until December 31, 2015. It is further agreed that this Agreement, or as modified at that time by the parties, shall be renewable by either party

upon mutual Agreement, or as modified at that time by the parties, shall be renewable by either party upon mutual Agreement 60 days prior to the expiration of said Agreement.

3.) USE AND PURPOSE. a. OWNER grants to LJA, their agents, and assigns the right to do specific acts on

the Property as set out herein, and OWNER retains all rights to the Property, with consideration of those rights granted to LJA.

b. OWNER grants LJA reasonable right to access the Property for the purpose of construction, maintenance, inspections, and reconstruction of a temporary sediment dewatering basin.

c. OWNER grants LJA access, as delineated specifically on Attachment A, for ingress to and egress from the Property as well as reasonable access on, over, and along the said access easements for the purpose of the construction, inspection, maintenance, and repair of the sediment dewatering basin, provided that LJA shall give prior notice of their intentions before entering upon the Property. OWNER, for themselves, their heirs, assigns, and administrators, agree that reasonable access shall be maintained, and in the event of construction or building upon the existing access during the term of this Agreement, LJA shall be so advised of changes and setting out of the alternate access to the Property.

AGREEMENT PART 2 – GENERAL PROVISIONS

1.) MANAGEMENT. a. OWNER agrees that LJA and its agents shall be permitted to enter onto the

Property with such machinery, materials, and equipment and the personnel and works to operate said machinery and equipment to carry out the intended use of the Property by LJA, including, the construction, inspection, maintenance, and repair of the temporary sediment dewatering basin. It is agreed that all improvements shall stay with the land.

b. OWNER agrees that LJA shall have the right to take such tests and borings on the Property as LJA deems necessary to carry out its intended use, and to take photographs of the Property, provided the OWNER is advised of such borings, tests, and photographs, and the necessity of such.

c. OWNER limits the rights granted to LJA as contained herein, and that LJA may enter onto the Property for the intended use as described, and not for any other use by LJA and/or its agents, or the general public.

d. Rights to the Property shall be retained by the OWNER. Further, OWNER agrees that those activities agreed between the parties will not be interfered with, provided that LJA has not deviated from said Agreement of intended use without first securing the permission or Agreement from the OWNER.

e. LJA shall give notice to the OWNER of its intention to enter onto the Property for the purpose of inspection, maintenance, and repair of the temporary sediment dewatering basin, and the eventual decommissioning of the basin. LJA shall not enter the Property without permission from the OWNER, which permission will not be unreasonably withheld.

f. Upon completion of the project, LJA will retain maintenance rights to the temporary sediment dewatering basin area for the period of the Agreement, although the OWNER may manage and control plant and animal life on the property.

2.) TAXES. Taxes shall be borne by the OWNER, or their successors and/or assigns of the said real estate, and any assessments shall be borne by the same.

3.) CONDEMNATION. a. The OWNER agrees that if the Property, or any part thereof, shall be taken or

condemned for public or quasi-public use or purpose by any competent authority, LJA shall have the right to defend against such attempted condemnation of the Property or any part thereof. If, in the opinion of LJA, the Property becomes unmanageable or unsuitable for its intended use and purpose as a result of such condemnation, this Agreement may be terminated by LJA upon 60 days written notice to the OWNER.

4.) LIABILITY/INSURANCE. a. Nothing in this Agreement shall be construed as imposing any additional liability

on the OWNER. LJA and any contractor employed to complete the work shall name the OWNER as additional insured on LJA’s liability policy. Prior to the start of construction and throughout the term of the Agreement thereafter, LJA shall carry a policy of public liability insurance covering all of its activities on the Property. At the request of the OWNER, LJA and the contractor shall provide the OWNER with a certificate or other evidence that such insurance is in effect.

b. LJA shall be responsible for and shall indemnify and hold the OWNER harmless from any and all costs, including the expense of defending any claim of legal action related to any injury or damage to the project area caused by or resulting from LJA activities on the Property.

5.) DAMAGES. a. LJA shall restore all road surfaces owned by the OWNER to their original

condition if said surfaces are damaged by equipment and/or machinery used by LJA and its agents during ingress to and egress from the property.

b. Before final completion of the work on said premises, LJA and its agents shall adequately clean up, replace fences, and replant the construction site to the original condition or satisfaction of the OWNER, whichever is less.

c. This commitment pertains to construction, repair, and maintenance completed by LJA and its agents on the Property.

6.) EXPENSES. LJA shall be responsible for all expenses incurred in the construction, repair, inspection, and maintenance of the intended use of the Property by LJA as set out in Part I of this Agreement.

7.) NO LIEN AGREEMENT. In consideration of the rents and covenants herein contained, LJA, for itself and for all contractors, laborers, or persons performing labor upon or furnishing materials or machinery for the intended use of the Property set out herein, agree that:

a. No lien shall attach to the Property or the OWNER’s property, or to any structure or other improvement to be constructed on the Property; and

b. Any recording of the Agreement is intended solely for the purpose of giving proper notice as provided under IC 32-8-3-1 et seq.; and no lien whatsoever is created against the real estate as the result of the execution or recordation of this Agreement.

8.) TRESPASS. The OWNER grants to LJA and its contractor(s) permission to enter onto the Property during the normal working hours of 7:00 a.m. to 7:00 p.m., with proper notice, to carry out its intended use as set out herein. All others shall be considered trespassers on the Property unless the party has permission of the OWNER to be on the Property.

9.) DEFAULT. a. Breach of any covenant herein shall constitute a default under this Agreement. In

the event of a default, the defaulting party shall be entitled to 30 days written notice specifying the nature of the default and giving the defaulting party an opportunity to cure the default. If the default is not corrected within 30 days after written notice is received, the injured party may elect to terminate the Agreement.

b. If the use intended for the Property is not approved by any governmental agency having jurisdiction over the project, LJA and the OWNER shall each have the right to terminate the Agreement by giving written notice to the other party. Within 60 days from the date the notice is received by the OWNER, the Agreement shall be null and void.

10.) NOTICE. Any notice required by this Agreement shall be served upon the other party by mail at the address set forth below or at such other address as the parties may hereinafter designate: ________________________________ ________________________________ ________________________________

11.) AGENTS. Where in this instrument rights are given to LJA or the OWNER, such rights shall also extend to the agents, officers, or employees of the parties.

12.) BINDING EFFECT. This Agreement shall become effective at the time construction on the Property begins and shall be binding upon the OWNER, their heirs,

personal representatives, successors, and assigns, and upon LJA and any successor organizations.

13.) TITLE. The OWNER hereby represents and warrants that they are owners of the Property covered by this Agreement and that they have the right to enter into this Agreement and to bind themselves and their heirs, successors, assigns, and personal representatives.

14.) This Agreement shall be interpreted under the laws of the State of Indiana. 15.) Headings are for reference only and do not affect the provisions of this

Agreement. 16.) Where appropriate, the singular shall include the plural. 17.) This Agreement contains all of the agreements of the parties, all prior

negotiations, understandings, and agreements having been merged into it. Amendments to this Agreement shall not be effective unless made in writing and signed by the parties.

18.) In the event LJA should cease to exist, the Agreement shall be binding up the organization that succeeds the said LJA, provided that the succeeding organization’s membership consists of property owners of real estate on Lake James located in Steuben County, Indiana.

19.) This Agreement or a Memorandum thereof shall be recorded in the Office of the Recorder of Steuben County, Indiana. LJA shall pay the recording fee.

20.) Any person signing this Agreement in a representative capacity for a party affirms under the penalties for perjury that he or she has the actual authority to sign. HOLD HARMLESS AGREEMENT

In consideration of the grant of an easement for utility purpose along county

highway right of ways in Steuben County, Indiana, the undersigned official of said utility on behalf of said utility does hereby agree to hold harmless and defend Steuben County from any and all liability or responsibility for any damages that may occur to any of the equipment, materials or other property of the utility regardless of the cause. PLANS AND SPECIFICATIONS: The plans and specifications to be used in this project are included with the Invitation to Bid. The Owner does not warrant any material estimates provided. Bidders are responsible for visiting the site as necessary to determine material estimates, machinery, and labor needed to complete the project in a timely manner for a fixed bid price.

PRE-BID MEETING: A mandatory pre-bid meeting will be held at the project site at ___:___ a.m. / p.m. on __________________, 2015. Bidders are to meet at the boat ramp at the east end of the channel connecting Jimmerson Lake to Lake James (Bledsoe’s Beach).

If hydraulic dredging is used at Potawatomi Acres, a Section 404 RGP and Individual 401 WQC must be obtained through USACE and IDEM, respectively. If mechanical dredging is used in all locations, permits from USACE and IDEM are not required as long as wetlands as fill material does not travel to a regulated body of water.

Obtain IDNR Lake Preservation Act Permit

A Lake Preservation Act Permit shall be obtained through IDNR Division of Water in accordance with 312 IAC 11 for disturbance to a lake bed beneath the legal lake level.

Task 3

“Rule 5” Stormwater Pollution Prevention Plan (SWPPP)

Develop a Stormwater Pollution Prevention Plan (SWPPP) and submit per 327 IAC 15-5.

Task 4

Steuben County Highway Department Utility Permit

Coordination with Steuben County Highway Department shall occur if underground culverts will be used during hydraulic dredging practices at Potawatomi Acres. A general utility permit is required prior to culvert use.

Task 4

Sediment Disposal Area Construction

Includes all labor, machinery, and expenses associated with delivery and pickup of machinery necessary to construct the sediment dewatering basin if hydraulic dredging is used. Other activities include attending project meetings; utility location coordination; and installation and maintenance of erosion control measures as specified in SWPPP.
