“A building permit affirms that the struc-ture is being built in accord with health andsafety standards as set by the uniform build-ing code,” Laredo told The Pine Cone. “Thefact that a structure is safe and sound doesnot mean that the city will authorize everyconceivable use to take place within thatstructure.”
The lawsuit lists Canterbury Woods resi-dents Carol Hart, Phyllis Burkey, MadeleineLittlefield and William and Alice Englanderas coplaintiffs.
The tenants say they will be “adverselyaffected” if the city forces the retirementcommunity to stop using the homes.
The separate units, the tenants contend, allow them more freedom than living inCanterbury Woods’ main facility.
Burkey, who lives in the 19th Street
duplex, “chose to live at this location by rea-son of her longtime hobby of active garden-ing and the desire to have a garden to whichshe could devote her frequent efforts, a pos-sibility which does not exist at CanterburyWoods,” the suit says.
Littlefield, also a duplex resident, “con-tinues to give regular piano lessons to musicstudents and would not be able to do so atCanterbury Woods without causing prob-lems for other residents ...” the lawsuit says.
Laredo, a city planner and the hearingofficer, David Spradling, are also listed asdefendants in the lawsuit.
In his February ruling, Spradling saidCanterbury Woods would be subject to a$3,000-per-day fine if it didn’t stop using thehouses.
In September 2007, several neighborsnear the disputed Canterbury Woods’ homescomplained the units would be detrimental tothe “residential environment” of the area, according to the lawsuit.
