Substantially Limits

504 regulations do not contain a definition.

Interpreted as “significantly restricted as to the condition, manner, duration” under which an individual can perform a particular MLA as compared to the average person in the general population.

Major Life Activity• Amendments’ non-exhaustive list:

“caring for oneself, performing manual tasks, seeing, hearing, eating, sleeping, walking, standing, lifting, bending, speaking, breathing, learning, reading, concentrating, thinking, communicating, and working.”

Mitigating Measures

• Student with ADHD, diabetes, asthma, and a hearing impairment functions well in the classroom with Ritalin, insulin, an inhaler, and hearing aid.

• Would the student be substantially limited in a major life activity without his medications or the use of his hearing aid?

Plan

• FAPE ≠ reasonable accommodations.

• Most fully integrate the student into the life of the school and enable access to the benefit of all programs, activities, and services.
