    Complaints of a barking dog at 3:15

    a.m. Friday, Nov. 22, resulted in the

    shooting death of Lexie, a pit bull mix,

    after police spent more than five hours

    attempting to corral the dog, accord-

    ing to police reports and witness state-

    ments.

    Officers were dispatched to the area

    of Yale and Princeton where they ob-

    served the pit bull mix running loose

    and chase after a subject on a bicycle,but it did not bite the subject.

    Officers attempted to corral the dog,

    but were unsuccessful.

    At 4:43 a.m., officers observed the

    dog on a porch in the 27000 block of

    Princeton. The report states the dog

    began growling and barking as they

    exited the vehicle.

    Another unsuccessful attempt was

    made to corral the dog. Officers con-

    tacted the homeowner and asked if

    she belonged to him. He said no, add-

    ing he didnt know to whom she be-

    longed.

    According to the report, another call

    came into dispatch at 7:20 a.m. about

    the dog was in the area of Princeton

    and Walton. The caller said the dog

    started barking and showing her

    teeth at her as she was exiting her ve-

    hicle.

    At this time, the report states offi-cers again asked the resident if the

    dog belonged to him, which he again

    denied, adding the dog may have be-

    longed to his daughter but was un-

    sure.

    According to the report and two wit-

    ness statements, the dog charged one

    Farmhouse Museum.

    The event gives children

    the chance to visit with

    Santa and Mrs. Claus, play

    in a petting zoo and have

    hot chocolate and a holi-

    day treat in the museums

    kitchen.

    This is the third year

    weve come to this, said

    Cathy Rutledge, who

    made the trip despite the

    winter storm. Its some-

    thing my kids look for-

    ward to. A little snow

    wasnt going to stop us. Its

    Christmas time, the snow

    is cool.

    Optimist Club member

    Debbie DePape said the

    organization expected be-

    tween 250 and 300 chil-

    dren this year, down from

    more than 500 in 2012.

    With the weather being

    like it is, she said during

    the event. Were not ex-

    pecting the same turnout,

    but we are still thinking

    between 250 and 300

    kids.

    Inside the museum, dec-

    orated for the holidays re-

    flecting the era of the

    house, children, such as

    Ava Ruby, visited Santa

    with her Christmas list in

    hand.

    wouldnt forget anything,

    she said to Santa.

    there were few prob-

    lems.

    While not objecting,

    Smith said the actual in-spections took longer

    than expected due to in-

    spectors being ques-

    tioned by residents in

    the target area.

    Each inspection was

    estimated to take 10 to

    15 minutes, but resident

    questions lengthened

    some to up to 45 min-

    utes.

    cost, he said.

    Councilman JohnCaron questioned the

    rationale of a large

    chunk of money being

    spent on re-inspection

    and not targeting other

    areas.

    Smith reiterated the

    idea is to target one area

    and then others in prox-

    imity of the initial area

    and perhaps two others

    to encircle and snare the

    vermin.

    and most importantly a

    residents complaint.

    I guess I have violated

    this ordinance and itdoesnt make much sense

    because no one knows

    theres any business go-

    ing on, the financial ad-

    used his phone and home

    computer for business.

    as an anti-permission

    slip.

    Dogs also became an

    issue, prompting a pro-

    posed change requiring

    inspectors to knock on

    the door if a dog is pres-

    ent in the yard.

    I dont think we

    should be entering; their

    behavior is not predict-

    able, Mayor Kip Walby

    said of dogs, adding hes

    also concerned about thedog running out of the

    yard.

    Rusie also suggested

    the letter indicate Code

    V, an arm of Landscape

    Services, which holds

    the contract with the city,

    is actually conducting

    the inspec t ions.

    Residents, she said, need

    to know how to identify

    these workers.

    While both council and

    residents have ex-

    pressed great concern

    about inspectors looking

    for violations unrelated

    to rats, Smith said that is

    not happening.

    I am very pleased to

    say we looked at 210

    backyards and what we

    cited them for is what we

    cited them for, he said.

    Were not looking to get

    in the backyard to see if

    you are growing some-

    thing you arent sup-

    posed to be growing.

    However, he did say if

    the garage door is open,

    inspectors can look in-

    side for evidence of rats

    but they cannot enter the

    building.

    Smith said because

    bait boxes and their con-

    tents are heavily regulat-ed by state law, residents

    should not be concerned

    about inspectors placing

    them to increase compa-

    ny profits.

    While the inspectors

    make the decision

    where bait boxes are

    placed, their placement

    is not approved by the

    city, but city is monitor-

    ing them, Smith said,

    adding hed be con-

    cerned if the results of

    the pilot program were

    more skewed.

    Given the amount of

    traffic in that area, it

    matched up with com-

    plaints made previous to

    the programs imple-

    mentation, he said.

    The revisions are ex-

    pected to go before

    council for approval pri-

    or to the next phase be-

    ing implemented this

    spring.

    Are bait boxes contributing to the citys rat population?

    That issue was raised by Councilman Tony Tiseo, who has openly dis-

    cussed rat issues in his own yard. He questioned if leaving bait boxes in

    yards is ineffective, as they continue to offer a food source.

    I dont want to have a smorgasbord in my yard, he said.

    Since removing his backyard deck and making foundation repairs to

    rid his yard of the vermin, Tiseo said hes seen about 25. I would think I

    would have saw something dead laying somewhere, he said, adding he

    was told his property is a path for rats to travel to their harborage which

    has yet to be identified.

    Am I attracting rats by baiting my yard? he asked Acting City

    Manager Mike Smith.

    I dont know how rats think, Smith said, adding he will address the

    question with inspectors. To take boxes away, we have no semblance of

    control and that is not good idea.

    Smith said the idea is to encourage rats to eat the poisoned bait and

    die, thus eliminating or at least reducing the rat population.

    Ive been told numerous times its not a good idea to have a bait box

    on your property if you do not have an issue, Councilman Pete Rubino

    said. All youre doing is inviting them to your property.

    But you might be helping with the kill.Ludos called the question valid for areas were bait is present and

    theres no sign of rodents.

    We need to take a look and decide, he said, telling council he will in-

    vestigate.

    its right side and once in

    the face.

    The dog reportedly

    walked back to the side

    walkway of the house

    and growled. Another

    shot was fired, striking

    her in the chest. The dog

    retreated to the bushes

    and the citys animal con-

    trol officer was able to

    lasso her with the dog

    stick, the report said.

    A group of outraged

    residents appeared at the

    Dec. 16 city council meet-

    ing asking the city to in-

    vestigate the case and re-

    view its policy regarding

    aggressive animals.

    not bothering anybody.

    come up with a revision

    for councils review and

    approval.

    Depending on the out-

    come of an ordinance re-

    vision, it may not be as

    easy to grab a bag of ice to

    fill the cooler next sum-

    mer.

    City officials are re-

    searching details of the

    citys ordinance banning

    the storage of outside ma-

    terials which currently in-

    cludes ice chests, fire-

    wood, windshield washer

    fluid, pop machines and

    other saleable items.

    The issue was ad-

    dressed at the Dec. 9

    council study session after

    Veronica Pinto, owner of

    the Lakeside Bait Shop in

    St. Clair Shores, was told

    she had to remove an out-door ice chest from out-

    side her business after 25

    years.

    Now were not able to

    put it outside. We dont

    have the room for it, she

    told city council at its Oct.

    21 meeting.

    City Planner Liz Koto

    said noted violations were

    the result of a sweep she

    ordered of the citys sign

    and outdoor storage and

    display ordinances.

    Her concern, she said, is

    the litter that can accrue

    around storage areas.

    There was an abun-

    dance of ice chests, she

    said, adding she believes

    17 business owners re-

    ceived letters of violation.

    It raised quite a stink,

    she said.

    While council wants

    the ordinance amended

    to allow ice chests, City

    Attorney Robert Ihriecautioned against, saying

    that could open the

    floodgates and weaken

    the citys defense against

    lawsuits from fireworks

    distributors who want to

    set up tents in the city.

    The ordinance banning

    all outdoor sales is its pro-

    tection, he said.

    If we broaden it, we

    expose ourselves to argu-

    ments, he said.

    Council, however, ar-

    gued the actual purchase

    occurs indoors and mem-

    bers agree they want ex-

    emptions.

    To clarify and address

    questions posed by coun-

    cil and Pinto, Koto said

    the sale of plant material,

    dirt and other seasonable

    items is allowed if the

    seller gets permission

    from the citys Zoning

    Board of Appeals.

    Nurseries, she said,

    have special land use per-

    mits and newspaper box-

    es are exempt under the

    First Amendment, specif-

    ically the dissemination

    of information verbiage.

    Weve got to figure out

    a way to let them keep

    them, Councilman Ron

    Frederick said of the ice

    chests. We all understand

    we dont want to take this

    away from them.

    outdoor refrigeration de-

    vices to cover bait sales

    along the Nautical Mile.

    Mayor Kip Wahby sug-

    gested the ordinance

    mimic language allowing

    for outdoor propane stor-

    age.

    At Kotos insistence,

    the ice chests cannot

    have a sign reading any-

    thing other than ice, as

    the box could become ad-

    vertising space, a viola-

    tion of the citys sign ordi-

    nance.

    Ihrie was instructed to

    further investigate and

    report back to council.

    Copper pipe andmemorabiliamissing

    A house in the 20000

    block of Parkside was re-

    portedly burglarized Wed.

    Dec. 12, according to its

    owner. The house, which

    is in the process of foreclo-

    sure, was vacant. But

    when the owner returned

    for more of his posses-

    sions, he discovered a

    basement door was ajar

    and several of his posses-

    sions were missing.

    Among the items report-

    ed stolen were copper pipe

    and sports memorabilia.

    Car stolen

    A female resident living

    in the 27000 block of

    Princeton reported her

    2013 Chevrolet Cruze was

    stolen from her driveway

    at about 8 a.m. Tuesday,

    Dec. 12.

    The woman claimed she

    started the vehicle at about

    7:50 a.m. and at 8 a.m. she

    looked out her front win-

    dow and observed the ve-

    hicle being driven down

    her driveway and heading

    north down Princeton.

    After spending 16 minutes on the phone with City

    Attorney Robert Ihrie, Raymond Socia, owner and

    operator of Pest Pounders in St. Clair Shores, con-

    formed to the citys home -based business ordinance.

    He said I was breaking the law and violating city

    code, Socia told city council of the call at its Dec. 2

    meeting. I got no notice, just the call.

    Socia said he used his house as home base for his

    pest control business. All the actual work is done at

    the clients house or business, he said, adding he had

    to explain to Ihrie how he planned to operate his busi-

    ness.

    Since his conversation with Ihrie, Socia has leased

    office space to conform.

    Socia said he informed Ihrie he has three competi-

    tors within the city that operate as he does and ques-

    tioned the selective enforcement.

    If I have to lease space, the others should have to

    do the same, he said.

    Im a lifelong resident, I love the city. Id like my

    kids to raise their kids here, he said, adding hes

    less than interested in how others conduct their

    home-based businesses.

    Socia said his intent of going before council was to

    alert them of whats happening and for members to

    get involved.

    I dont want to be bullied. I dont want to be run out

    A recent fire on Yalewas deemed acciden-tal, by fire departmentofficials a blaze thatcost the life of the familydog.

    But accidental firescan happen in the blinkof an eye, particularlyduring the cold wintermonths.

    According to St. ClairShores Fire DepartmentC h i e f G e o r g eMorehouse, accidentalfires are more common

    when commercial andspace heaters are beingused in the residence.

    The best thing forcommercial heaters is to

    follow the guidelines ofthe manufacturer,Morehouse said. Youobviously dont wantthem up against, near, orpointed to anythingcombustible.

    Using the proper fuelfor whatever type ofheater you have is obvi-ously very important,he said. But you would

    be surprised how manypeople might use gaso-line in a kerosene heat-er.

    According to theConsumer ProductsSafety Commission,about 25,000 house fires

    are caused by improperuse of space heaters, re-sulting in 6,000 injuriesrequiring medical atten-tion.

    The safety commis-sion has several recom-mendations that fall in

    line with the chiefs tips,including not placingheaters within three feetof furniture or othercombustible materialsand placing heatersaway from areas wherechildren or pets could

    potentially bump intothem and knock themover.

    Its also very impor-tant that people have

    working smoke detec-tors in their home,Morehouse said.

    And perhaps most im-portant, dont ever leavea heater unattended.

    It would be awful, said Sierra Gostkowski. Tothink that your child would wake up on Christmas

    morning and have nothing to open for Christmas.

    That would be heartbreaking.

    This very thought brought dozens of volunteers

    to Assumption Greek Orthodox Church at 6:30

    a.m. last Saturday to wrap hundreds of toys for

    about 100 area families.

    Cops 4 Kids puts on approximately five to seven

    fundraisers throughout the year, St. Clair Shores

    Cops 4 Kids President Kevin Kimm said. And this

    allows us to have a mass shopping event which al-

    lows us to provide for between 80 and 110 families

    and approximately 200 to 250 children.

    On that Saturday morning, these toys, games,

    stuffed animals, clothing and other items were be-

    ing wrapped with care by volunteers ranging from

    councilmembers Candice Rusie and John Caron, to

    then there are the offi-

    cers out there that see

    this firsthand, that see

    this need firsthand. We

    ask these patrol officers

    for feedback. Theyre

    extremely important. A

    lot of people out there

    dont think this happens

    here, but it does. And

    this organization is all

    about helping these St.

    Clair Shores families in

    need.

    Kimm said the organi-

    zations reach goes well

    beyond Christmas.

    Actually, we look to

    help families all year.

    We try to step up and

    help out our St. Clair

    Shores residents as

    much as we can. Thats

    what this is all about.

    From help with a

    fence violating city code

    to paying the monthly

    bills, the program has

    been there to lend a

    hand for 37 years, Kimm

    said.

    But the Christmas toy

    program is the headlin-

    er.

    This is our marquee

    event, it really is, Kimm

    said. We have all these

    gifts in there that need

    to be wrapped so when

    the families come in to

    pick these gifts up they

    know theyre kids aregoing to have a good

    Christmas. And we have

    all of these wonderful

    volunteers making surethat happens, knowing

    that these gifts are going

    to kids and families who

    need it, right here in thiscity. Its really some-

    thing special to see and

    to be a part of.

    Kimm said the organi-

    zation is now helping

    qualifying families for

    three years.

    One of things we

    want to do now is maybe

    taking these same kids

    and come August, help-

    ing them with school

    supplies, he said. We

    want to extend this help

    all year and make sure

    these kids and families

    are helped not just now,but throughout the

    year.

    Kimm also added that

    the organization per-

    sonalized the gift giving

    this year.
