    SANBERNARDINO CI1lYCHARTERPREAMBLE.

    We, the clllzens of San Bernardino, do h e r e b y establish this Charter to promoteeconomic,environmental, and cultural p r o s p e r i t y t h r o u g h o u t oucommunity; to enable oucitygovernment to meet the needs of the p e o p l e effectively and efficiently; to p r o v i d e foraccountability and ethics in public service; and to ensueeq ua l i t y of opportunity for everyresident.

    ARTICLE I. INCORPORATIONAND SUCCESSION.Sec. 100. NameandBoundaries.

    The municipal c o r p o r a t i o n nowexis t ing and known as the City of San Bernardino shallremain and continue as amunic ipa l c o r p o r a t i o n under its same name. The boundaries of the C i t yshall be the boundaries as established at the time this Charter is a d o p t e d , oas the boundariesmay be c h a n g e d thereafter in the manneauthorized b y law. (Amap of the ex is t ing boundaries isincluded in the a p p e n d i x . )Sec. 101. Succession to rights,property,and liabilities.

    The City shall remain vested with all r igh ts and p r i v i l e g e s of every knd and naturevested in the City at the time this Charter is a d o p t e d . The City shall continue to own,possess,and control all property of everykind and nature owned,p o s s e s s e d , ocontrolled by the City atthe time this Charter is a d o p t e d . The a d o p t i o n of this Charter shall not a b r o g a t e , limt,ootherwise affect any exis t ing debt,obligation,contract, lawsuit,oother liability onbehalfofoaga i ns t the City.

    ARTICLE II.POWERS OF CITY.Sec. 200. Generally.

    The City shall have all powers and r igh ts pos s ib l e for a charter city to have under theconstitution and laws of the State of California as fully and c o m p l e t e l y as t h o u g h t h e y weespecifically enumerated in this Charter, subject only to the limitations contained in this Charter.The City shall have the power to make and enforce all laws and r egu l a t i ons r e g a r d i n g municipalaffairs,subjec t only to such restrictions and limitations that may be p r o v i d e d in this Charter othe Constitution of the State of California. The City shall have the power and may act pursuantto any p r o c e d u r e established by state law, unless a different p r o c e d u r e is established b y thisCharter o by ordinance of the City. The powers and r igh ts of the City shall be construedliberally and in favor of the City,and the enumeration of any p a r t i c u l a r power o right in this

    The City may exercise any of its powers o perform any of its functions, and mayp a r t i c i p a t e in the financing thereof, ointly o in cooperation, b y contract ootherwise,with anyoneomoecities,counties,states, o r e i g n countriesocivil divisions o ag enc ies thereof,o theUnited States orany of its agencies .

    ARTICLE III.LEGISLATIVE BRANCH.Sec. 300. Common Council.

    There is h e r e b y created the Common Council to exercise the powers provided for theCommon Council in this Charter. The Comrnon Council shall be c o m p r i s e d of seven ( 7) electedoffices, the members of which shall be elected from wards by the voters in the ward, in thernanneprovided in this Charter.Sec. 301. Creation of Wards.

    The City shall be divided by ordinance into seven ( 7) wards,d e s i g n a t e d as First Ward,Second Ward, Third Ward, Fourth Ward,Fifth Ward, Sixth Ward, and Seventh Ward. Theboundaries of the wards shall be reviewed at least every ten (10) years upon completion of thefederal decennial censusormoef r eq uen t l y as may be determined necessary. B o u n d a r y changesshall not be made moethan oncein any two (2) year p e r i o d nowithin n ine ty ( 90) d a y s of anyg e n e r a l municipal election.     Except as otherwise p r o v i d e d in this Charter, all powers of the City are vested in theCommon Council. All legislative power of the Common Council shall be exercised b yordinance o resolution,subject to the a p p r o v a l of the Mayor as set forth in this Charter. Allother powers of the Common Council may be exercised b y order o resolution, where notinconsistent with this Charter oordinances of the City,and subject to the a p p r o v a l of the Mayoras set forth in this Charter. U p o n the affirmative vote of at least five ( 5) members of theCommon Council, he Common Council may make formal i nves t iga t i ons into the affairs of theCity,o the conduct ofany city d e p a r t m e n t , office,agency,board,orcommission b y compellingthe attendance and t es t imony ofcity e m p l o y e e s , officers,oother persons,o b y compe l l ing theproduction of documents o evidence. U p o n the affirmative vote of at least five ( 5 ) members ofthe Common Council, he Common Council may issue sub poenas in the nameof the City,whichshall be attested to by the City Clerk. Disobedience of a s ubpoena issued b y the CommonCouncil shall constitute a rnisdemeanor and shall be p u n i s h e d in the same manneas violationsof this Charter aep u n i s h e d .Sec. 305. Ordinances, resolutions,and orders.

    No order,except to a d j o u r n for lack of quorum o c o m p e l the attendance of a quorum,and noordinance,o resolution,shall be valid unless it receives the affirmative vote of at leastfour (4) mernbers of the Common Council.

    A. Procedures. E x c e p t as exp ress ly p r o v i d e d in this Charter, the r equ i r em ents forthe introduction, consideration, a d o p t i o n , and effective date of ordinances, including allp u b l i ca t i o n and notice requirements,shall be go ve r ne d b y state law.

    B Approval by Mayor. E x c e p t as exp ress ly p r o v i d e d in this Charter,noordinance,resolution,oorder shall take effect without the a p p r o v a l of the Mayor. For orders, he a p p r o v a lof the Mayor is p resum ed unless at the m e e t i n g at which the order is p a s s e d , the Mayorannounces d i s a p p r o v a l and the reasons therefor. All ordinances and resolutions must besubmitted in final form to the Mayor for approval. The Mayor's

    D. Approval and override in Community Development Commission. When,pursuant to state law, the Mayor and Common Council have d e s i g n a t e d themselves as theCommunity D e v e l o p m e n t Comrnission of the City, he Mayor shall have the power of a p p r o v a lof all orders and resolutions of the Commission, in the samemanne as the Mayor has in theCity,subjec t to the power of the Commission to override any d i s a p p r o v a l , in the same manneasthe CommonCouncil has in the City.

    E. Dateof adoption.     ARTICLEVII.VACANCIES.Sec. 800. Vacancies and forfeitureofoffice.

    An elected office shall become vacant upon the occurenceof any of the following: anevent that causesa vacancy of public office as provided in the Government Code of the State ofCalifornia, removal of the incumbent from the office in any manne authorized b y law, orforfeiture of the office. An elected officer shall forfeit the office ifthe elected officer lacks atany time du r ing the term of office the eligibility r eq u i r emen ts for the office established by thisCharter orby law,o the elected officer accepts o retains another elected office o e m p l o y m e n tas prohibited b y this Charter o b y law. The existence of a vacancy shall be declared byresolution of the Common Council sta t ing the reasons for the vacancy,and the vacancy shall befilled in the mannep r o v i d e d in this Charter.Sec. 801.     Sec. 1701. Duties andprocedures.The S a l a r y Committee shall study and hold public meet i ngs onthe issue of the totalc o m p e n s a t i o n for each elected official of the City. Not later than n ine ty ( 90) d a y s before the

    end of the fiscal year, the S a l a r y Committee shall make a recommendation to the CommonCouncil concerning the total c o m p e n s a t i o n , includ ing sa la ry and benefits, for each electedofficial of the City. The Common Council shall a d o p t od i s a p p r o v e the recommendation of theS a l a r y Committee prior to the end of the fiscal year. The Common Council shall have nopowertoalter,amend,ootherwise change the recommendation of the S a l a r y Committee.Sec. 1702.     After the commencement ofeach fiscal year, he Mayor,with the consent of the CommonCouncil,shall e m p l o y a qualified certified public accountant,who has nop e r s o n a l interest,directo indirect, n the fiscal affairs of the City o any of its e m p l o y e e s oofficers. The accountantshall perform anannual audit of Ihe books,financial records,and related documents of the Cityinaccordance with g e n e r a l l y ac c ep ted aud i t ing standards for public agenc i es , and shall have freeaccess to the books,records, inventories,and reports of all officers and e m p l o y e e s who receive,handle,odisburse publ ic funds,and such other officers,e m p l o y e e s , d e p a r t m e n t s , oag enc ies asthe Common Council may direct.     ARTICLEXX.TRANSITION.Sec. 2100. Adoption dateand operative date.

    As used in this Charter, the term Adoption Date rneansthe date upon which thisCharter is filed in accordance with state law,and the term Operative Date meansthe date ofJuly 1,2001,except as otherwise p r o v i d e d in this Charter.Sec. 2101. Officers,employees,boards,and commissions.

    E x c e p t as p r o v i d e d in this section, all officers, e m p l o y e e s , and persons serv ing onanyboard o commission of the City onthe Adoption Date shall continue to perform the duties oftheir r espec t i ve offices,employments,and a p p o i n t m e n t s without interruption and under the sameterms and conditions until p r o v i s i o n s have been made otherwise in accordance with this Charterountil the election,employment,oa p p o i n t m e n t of their successo.

    A. City Attorney and City Treasurer. Upon the Adoption Date, the personsserving in the elected offices of the City Attorney and the City Treasurer asestablished b y the p r e v i o u s charter,shall serve,respectively,as the a p p o i n t e d CityAttorney and the a p p o i n t e d City Treasurer as established under this Charter,untila person is a p p o i n t e d to such office in accordance with this Charter,o the officeis vacated,othe O p e r a t i v e Date,whichever is earlier.

    B. Park and Recreation Commssion.     ARTICLE XXII. MSCELLANEOUS.

    Sec. 2200. Oath ofoffice.Every officer of the City, a p p o i n t e d o elected, before en te r i ng upon the duties of theoffice,shall take the oath ofoffice as provided for in the constitution of this state,and shall file

    the same with the City Clerk.Sec. 2201. Official bonds.

    Officers and e m p lo ye e s sub je ct to group o individual bonds to insure the fathfulp e r f o r m a n c e ofofficial duties shall be determined b y ordinance of the City. The ordinance shallfix the amount of such bonds,and shall p r o v i d e for the payment of the premium of such bondsby the City.Sec. 2202. Conflicts of interest and ethics.

    Regulations g o v e r n i n g conflicts of interest and ethics a p p l i c a b l e to officers, e m p l o y e e s ,members of boards and commissions, and candidates for elected office of the City may beestablished b y ordinance of the City. Prohibition against holdingotherofficeorcity positions.Except where authorized by law, no elected officer of the City shall hold any otherelected public office during the term for which the person waselected to office. No electedofficershall hold any other municipal office ohold any officeoemployment, he c o m p e n s a t i o nofwhich is p a i d with funds of the City,while serv ing as anelected officer of the City. Exceptfor the incumbent in anelected office onthe Adoption Date that is abolished o otherwiseremoved from this Charter,noformer elected officer of the City shall hold any c o m p e n s a t e dofficeo e m p l o y m e n t with the City,except anelected office,until at least one(I)ear after theexpiration of the term for which the person waselected. Nothing in this section shall beconstrued to prohibit the a p p o i n t m e n t of any current o former elected officer of the City torepresent the City on the govern ing board of any regional, state, federal, o otheri n t e r
