There are very few purchasers who buy the home of their dreams and do

All too often when you view a property you see it as it is, not as what it

Make sure the interior of your home is free of clutter. The smell of flowers can
make a room feel more welcoming as can a warm home in Winter and open

Buying a property can be a minefield and the one person, possibly above all
others, you definitely need on your side is your Solicitor. They are highly trained
individuals who know all the pitfalls which can arise when completing the sale
of a property, and they are there to advise and guide you throughout the entire
process.
Most solicitors offer full conveyancing services plus a wide range of other legal
services. When you are buying a property, they will communicate with the sellers
solicitor and ascertain exactly what is included in the agreed price. It is not
unusual for an agreed sale price to change because it did not take into account
fixtures or fittings. These are the items which all too often, the buyer believes were
included in the price and the seller believes were not included. Clarification of
these details by your solicitor will prevent delays and ensure that both parties are
in agreement.
Another very important enquiry which your solicitor will make will be to the local
authority. This is called a search and asks the authority about the things like road
access, drainage, rights of way, boundaries, plans for future development and a
host of other questions.
Your solicitor will draw up draft contracts and send these to the vendors solicitor
for them to study and return as agreed or with further questions. The financial
side of matters is also taken care of by your solicitor, who will receive the loan
from your lender and then distribute the relevant amounts to the various parties
concerned.
As you can see there is a great deal more to buying a house than may at first
be thought and there are also a large number of areas which need the expert
attention of a solicitor. You can do it yourself and there is advice available on how
to do this, however, be warned, one simple and at the time apparently insignificant
item which has been overlooked by you, can end up not only costing you a
fortune, but can turn that dream home into a nightmare.
WHY DO I NEED TO USE A SOLICITOR?

There are three types of survey which will vary in cost dependent upon the level
of detail required. However you will be well advised to ask for the best survey you
can afford. The three different types are detailed below.
The most basic survey is called a Valuation Report. The purpose of this report is
simply to establish whether or not the property is worth the price which has been
agreed between the seller and the vendor. It is an inspection of the property by
sight and will detail obvious faults that can be seen, however, it will not look for
faults or defects which may be hidden behind walls, under floors or above ceilings.
The second type of survey is known as the RICS (Royal Institute of Chartered
Surveyors) Homebuyers Survey & Valuation. This survey is far more detailed than
the Valuation Report and will examine areas such as the roof space and the state
of the timber.
The Buildings Survey & Valuation, formally known as the Structural Survey, is the
best you can get and should always be the first choice of the buyer if possible. This
survey examines every possible facet of the property and will provide the buyer with
a completely detailed and totally comprehensive report on the property, including
all its defects and plus points. It will tell the buyer whether or not they are buying a
potential minefield or whether they are making a sound investment.
True, this type of survey will cost a little more, however, it could save you
thousands of pounds in money and a great deal of grief in the future.

Homeowners are required to provide a Home Information Pack (HIP) when
marketing their homes for sale throughout England and Wales.
The pack must currently include evidence of title, terms of sale and standard
searches. An energy efficiency rating must also be included in the report, giving
consumers the choice to assess the likely running costs of a property before they buy.
The current temporary provision for first day marketing allows a property to
be marketed without a HIP as long as the required documents have been
commissioned and paid for (or arrangements for payment made) and there is an
expectation they will arrive within 28 days. This temporary provision was due to
expire on the 31 December 2008 but will now be extended to 5 April 2009 when
it will then expire. From April the 6th 2009 sellers will need to have the basic HIP
before their home is marketed, which is expected to take 3 to 5 days to compile.
The Property Information Questionnaire will also be introduced into HIPs for all
properties marketed for sale from 6th April 2009. It was developed with industry
and is designed to provide information that is not only important for buyers to
know but is also easy for sellers to provide without professional help.

HOWEVER THE GOVERNMENT MAY MAKE AMENDMENTS IN THE FUTURE.
