HARMONIZATION with the EU ACQUIS
Ministry of economy of RS transposed the EUROPEAN PARLIAMENT AND COUNCIL DIRECTIVE 95/16/EC of 29 June 1995 on the approximation of the laws of the Member States relating to lifts, which establishes legal requirements for the design, installation and placing on the market of new lifts and safety components. It also sets out the conformity assessment procedures to be followed by lift installers to ensure conformity with these requirements.

CURRENT LEGAL FRAMEWORK in RS
Serbia has aligned its legislation with EU DIRECTIVE 95/16/EC
by adopting the Rulebook on safety of lifts (Official Gazette of Republic of Serbia No. 101/10); the Rulebook was published on December 29th 2010, and came into force on January 6th 2011, except for provisions of Articles 27. and 28. of this Rulebook regarding special and additional special requirements for the inspection of existing lifts, which came into force on January 1st 2014.

NEW SERBIAN RULEBOOK – SHORT DESCRIPTION OF THE CONTENT
Serbian Rulebook on safety of lifts lays down essential health and safety requirements relating to design and construction of lifts and safety components in lifts, and other requirements and conditions to be met with respect to their design, construction, installation and placing on the market; the content of the declaration of conformity; conformity assessment procedures; conformity mark and conformity marking; safeguard clause and requirements to be met by the conformity assessment bodies which shall be designated for the assessment of conformity and the inspection of lifts.

PLACING ON THE MARKET
In accordance with the Rulebook, lifts and safety components
may be placed on the market of Republic of Serbia only if they are:
not liable to endanger the health or safety of persons or, where appropriate, the safety of property;
properly installed and maintained;
used for their intended purpose.
Note: Specific regulations may lay down other requirements for protection of people when lifts are put into service or during their use, provided that provisions of said regulations do not contravene the provisions of this Rulebook.

Regular (annual) inspection of lift
The lift owner shall provide regular inspections for lifts.
Regular inspection of lifts shall be performed at least once a year.
Regular inspections shall be performed by a CAB designated for the inspection of lifts.
Regular inspection of lifts shall include all activities necessary to check that existing lifts comply with special requirements for the inspection of existing lifts, or in case of reconstruction, with additional special requirements for the inspection of existing lifts, and that lifts put into service after this Rulebook has come into effect satisfy the essential health and safety requirements of the Rulebook.

Extraordinary (additional) inspection of lift
The extraordinary inspection of lifts shall be performed in the following cases:
1) basic changes to the lift; or
2) the lift is put into service after an accident; or
3) upon request by the surveillance authorities.
Extraordinary inspection of lifts shall be performed by a CAB designated for lift inspection.
The extraordinary inspection of lifts must be performed by the same designated body which issued the negative Inspection Report.

Article 27. lays down special requirements for the inspection of existing lifts: 1) car door is installed at the entrance of car of lifts for transportation of persons, and
car of lifts for transportation of persons and goods, or, in the case when a car door is not possible to be installed due to dimensions or rated load, a presence detection system (for example light curtain) is installed;
2) the lift car is fitted with the indicator or other car position gauge; 3) interlocking devices for landing door meet the essential safety requirements listed
in Annex I of this Rulebook; 4) car suspension cables (ropes, chains, strips etc.), on which the car and
counterweight are suspended are regularly inspected and replaced where necessary;
5) stop controls of lift machinery provides high degree of precision in the stopping levels of the car at stop stations;
6) lining of breaks on the drive mechanism do not contain asbestos; 7) overspeed governors are regularly inspected and replaced where necessary; 8) accesses to machine controls are safe and easy approachable; 9) control openings on the station doors are made of such material and have such dimensions to prevent injury.

Article 28. lays down additional special requirements for the reconstructed lifts In case of lift reconstruction, during regular and additional inspection of lifts, in addition to requirements specified in Article 27 of the Rulebook, the designated body for the
inspection of lifts, shall check the following: 1) whether automatic car doors are fitted with human or animal presence detectors if
automatic landing door has been installed; 2) whether the lift car is provided with emergency lighting and alarm system that
operate in the event of power supply failure; 3) whether the lift car must be fitted with control devices, and at the entrance landing
door, call devices which may be used by disabled persons in accordance with special regulations;
4) whether lifts, whose speed is greater than 0,63 m/s, are fitted with a parachute system;
5) whether the lift is fitted with a device to prevent uncontrolled ascending movements of the car in case of the lift without reduction gear drive, or in the case of the lift with reduction gear drive, such lift is fitted with a device preventing uncontrolled ascending movements when replacing the support frame of the car or grip device.

SERBIAN CONFORMITY MARK
From the day this Rulebook enters into force untill the ratified international Agreement on Conformity Assessment and Acceptance of industrial products with the EU (ACAA) enters into force, conformity marking of lifts and safety components to which this Rulebook applies, shall be performed by affixing the Serbian conformity mark in accordance with this Rulebook and relevant legislation.
If the ACAA shall not be concluded, conformity marking by affixing the Serbian conformity mark shall be performed till the day of accession of the Republic of Serbia to the European Union.
From the day when the ratified international Agreement on Conformity Assessment and Acceptance of industrial products with the EU for lifts and safety components to which this Rulebook applies, conformity marking shall be performed by affixing CE marking in accordance with this Rulebook and relevant legislation.
If this Agreement shall not be concluded, conformity marking by affixing the CE marking shall be performed as from the day of accession of the Republic of Serbia to the European Union.

PRESUMPTION OF CONFORMITY
A lift or a safety component shall be presumed to comply with the essential health and safety requirements laid down in Annex 1 of the Rulebook, if it is designed and constructed in accordance with Serbian standards relating to lifts which transposed the corresponding harmonised standards and covered one or more essential health and safety requirements, the list of which is being made and published in accordance with the law governing technical requirements for products and conformity assessment and the legislation adopted based thereon.
Latest list of Serbian standards relating to lifts transposing corresponding harmonised standards (published in the Official Journal of the European Union on November 8th 2013.) was published in Official Gazette of Republic of Serbia No. 59/14.

CONFORMITY ASSESSMENT BODIES for LIFTS and SAFETY COMPONENTS IN RS
There are 7 accredited CABs in Serbia at the moment, out of which
3 are certification bodies and 6 are inspection bodies for lifts.
There are 6 designated CABs for lifts in Serbia at this moment,
mainly for final inspection, unit verification and type-examination of lifts (and regular and extraordinary inspections of lifts).
There are no designated CABs for safety components in Serbia at this moment.
These designated CABs can be used by manufacturers/installers of lifts when placing lifts/safety components on the market of RS.

ACTIVITIES PLANNED in RS FOR THE UPCOMING PERIOD
Activity: - Transposition of Lifts Directive 2014/33/EU by the end of 2016 (according to the NPAA).
- Organization of seminars and round tables for the industry and all stakeholders, including surveillance authorities to promote the Rulebook, especially for the owners of lifts regarding their obligation of ensuring the regular inspection of existing lifts, by the end of 2014.
Measures planned:
-Increasing activities on cooperation with responsible authorities for market surveillance and surveillance of lifts in use.
- Improving and strengthening the capacities of authorities for market surveillance and surveillance of lifts in use.
-Continuous monitoring of European legislation in this area.
