1 INTRODUCTION

Dudek evaluated and recorded information about native oak trees over 4 inches in diameter at breast height (D.B.H) and non-native trees over 8 inches in diameter and prepared this Tree Management and Preservation Plan (TMPP) for the proposed Oak Creek; Escondido project. Primary topics of this TMPP include evaluations of project-related impacts and recommendations for tree protection, relocation, removal, and mitigation. The project site is located in southwestern Escondido, just outside the current Escondido city limits and 300 feet west of Interstate 15.

This TMPP provides a summary of Dudek’s site and tree evaluation within the proposed development and at two limited off-site infrastructure improvement areas. There are six (6) native tree species, including Arizona ash (Fraxinus velutina), coast live oak (Quercus agrifolia), Engelmann oak (Quercus engelmanii), black willow (Salix goodingii), arroyo willow (Salix lasiolepis), and Mexican elderberry (Sambucus mexicana). Of the six native species found on site, coast live oak is the most prominent species. Non-native trees found on site include Deodar cedar (Cedrus deodara), red gum (Eucalyptus camaldulensis), shamel ash (Fraxinus uhdei), olive (Olea europa), Afghan pine (Pinus elderica), canary island date palm (Phoenix canariensis), California pepper (Schinus molle), Brazilian pepper (Schinus terebinthifolius), Chinese elm (Ulmus parvifolia), and Mexican fan palm (Washingtonia robusta).

Dudek’s International Society of Arboriculture (ISA) certified arborists performed various functions associated with surveying, inventorying and evaluating the condition of trees on the property and on two off-site areas, as described in the following sections. The purpose of this TMPP is to present the physical characteristics, mapped locations, impact and preservation totals, and appropriate mitigation for impacts to native oaks and other protected trees on the site. The tree quantities and related project impacts have been analyzed and are reported in the following sections.

In summary, the Oak Creek, Escondido property exhibits scattered individual oak trees and more concentrated stands along or within the property’s drainage network. Natural oak seedling establishment is considered fair to good throughout much of the site, especially along the site’s drainages and under existing oak tree canopy. There are 1,036 trees on the project site and 34 trees directly adjacent the off-site study areas. The 34 off-site trees are associated with improvements to existing drainage outfalls required by the City. These areas are discussed separately in the following sections. There are 421 oak trees on the property (410 coast live oak and 11 Englemann oak) and another 615 mature trees scattered throughout the site. Of these, 330 trees (31.9% of the trees on the Oak Creek; Escondido property) are expected to be impacted by the proposed project, and 23 trees are expected to be impacted by the off-site infrastructure improvements. The total number of trees expected to be impacted for the proposed Oak Creek Project and associated off-site infrastructure improvements is 353 trees.

Impacted trees are subject to replacement by mitigation planting. Of the impacted oak trees or other mature trees a total of six trees are considered “candidates” for relocation. However, tree relocation is not a requirement of the City or of this TMPP.

1.1 Site Description

The Oak Creek; Escondido project is located just outside the current Escondido city limits in an area that can be described as southwestern Escondido. The site is generally located several hundred feet west of Interstate 15, one mile north of Lake Hodges, and approximately 1.5 miles south/southeast of Valley Parkway. More specifically, the project site is bounded on the north by Hamilton Lane, on the east by Miller Avenue, on the west by Felicita Road, and to the south by a small existing neighborhood at the intersection of Miller Avenue and Felicita Road (Figure 1). The project is located in Sections 33 and 34 of Township 12 South, Range 2 West on the U.S. Geographical Survey (USGS), 7.5 minute Escondido quadrangle map. Assessor’s Parcel Numbers (APN) 238-110-25 and 35, 238-370-01, 04-08, and 238-380-01 comprise the project site.

The project site is currently undeveloped, disturbed, and dominated by agricultural activities. One occupied residence is located in the middle of the site. Most of the site is currently used for row crop production, while significant firewood cutting and storage occurs in the western portion of the property. Additionally, a small retail ornamental plant nursery is located in the northwestern portion of the property. Existing on-site tree-dominated vegetation is primarily limited to two north-south trending drainages, which converge in the central-western portion of the site and drain southward along the site’s western edge. Trees are also located along the project site’s perimeter, adjacent to existing roadways. Oak riparian, eucalyptus, and olive trees are the primary tree overstory on site. Appendix A provides photographs of the project site, including its landscape features.

The Oak Creek; Escondido project site consists of flat to gently sloping terrain that trends from the north to the south and from east to west. A forked drainage runs approximately north to south near the western edge of the project site and a gently sloping hill along the eastern portion of the project site. The steepest sloping terrain on site is minimal and is associated with this drainage system. Banks on both sides of these drainages range from several feet to 1-foot-tall, and exhibit incising from past water flows. The two main forks of the drainage system join near the southern portion of the site (near the 0.5-acre pond) before exiting under Felicita Road and draining through Felicita Park. Elevations on site range from roughly 625 feet above mean seal level (AMSL) in the northeast corner of the property to just over 570 feet AMSL in the southwestern portion of the project. The on-site drainage supports the majority of trees a mixture of native and non-native trees. The majority of the site is heavily disturbed by ongoing agricultural operations including both a nursery and row crops, and trees are nearly absent from these areas.

The off-site areas occur to the west of Felita Road and to the north of Hamilton Road, respectively. Existing drainage through culverts flows under these roads and the City has requested improvement of the flow capacity, which will require the placement of rip-rap at the daylight of each culvert. The trees in the immediate vicinity of this proposed work would be preserved in place but may be subject to encroachments during the rip-rap placement and some may require removal for access to the site. These areas are typical of drainages with wetter conditions, various tree types, and steep banks.

1.2 Project Description

The Oak Creek; Escondido project proposes to construct 65 single-family residential units on a 41.4-acre project site. The existing site consists of mostly undeveloped, flat terrain surrounded by urbanized portions of the City of Escondido. In addition to the 66 individual single-family residential lots, the project will include lots dedicated to private streets, biological open space, and fuel modification zones. An improved walkway is also proposed along the project’s western boundary, parallel to Felicita Road (Figure 2).

1.2.1 Off-Site Infrastructure Improvements

The Oak Creek; Escondido project includes off-site infrastructure improvements along Felicita Road and Hamilton Lane. Off-site infrastructure improvements consist of upgrades to the existing storm drainage components both on and off-site. The additional off-site improvements will occur within and adjacent to two of the existing drainage features that currently run beneath Felicita road and Hamilton Lane.

2 METHODS

Dudek’s International Society of Arboriculture (ISA) Certified Arborist conducted an inventory and evaluation of the site’s tree resources on April 29 and 30, 2013 and on July 10, 2014. Data collection efforts for the site’s tree resources included documenting individual tree locations, conducting individual tree evaluations, mapping willow stand locations, and quantifying tree totals within individual willow stands. The Oak Creek; Escondido tree survey area included the project site and areas immediately off site where trees may be subject to construction-related impacts. Trees included in the inventory and assessment meet the City of Escondido’s definition of a “mature tree,” which includes oak species with a minimum trunk diameter of 4 inches and other tree species with a minimum trunk diameter of 8 inches. The method for each approach is discussed in Sections 2.1 and 2.2 below.

2.1 Individual Trees

Dudek mapped and collected tree attribute information for all trees in the tree survey area (including off-site areas) meeting the City of Escondido’s definition of a “mature tree.” The location of each individual mature tree was mapped using a Trimble Pathfinder Pro XH Global Positioning System (GPS) receiver. The Pathfinder has a horizontal accuracy of 1-meter (1-sigma) using differential code positioning techniques. Since tree canopies can sometimes cause loss of satellite lock by blocking the line-of-sight to satellites, an electronic compass and reflectorless electronic distance measuring (EDM) device was also used in mapping tree locations. The EDM/compass combination operates in concert with the Pathfinder system to position offsets, and offset information is automatically attached to the GPS position data string. Mature trees were tagged in the field with an aluminum tree tag bearing a unique identification number. The tags were placed on the trunk of each inventoried tree and tag numbers correspond with the individual tree data presented in Appendix B.

Concurrent with tree mapping efforts, Dudek arborists collected tree attribute data including species, quantity of individual trunks, individual trunk diameters, overall height, canopy extent, and general health and structural conditions. Diameter measurements were collected using the standard protocol outlined by the Council of Tree and Landscape Appraisers in the Guide for Plant Appraisal, published by the International Society of Arboriculture1. Trunk diameter measurements were taken at 4.5 feet (54 inches) above the ground along the trunk axis, with a few common exceptions. In cases where a tree’s trunk is located on a slope, the 4.5-foot distance was approximated as the average of the shortest and longest sides of the trunk (i.e., the uphill side and downhill side of a tree’s trunk, respectively) and the measurement was made at the circumference of the trunk at this point. Tree height measurements were ocular estimates made

by experienced field arborists. Tree canopy diameters were typically estimated by “pacing-off” the measurement based on the investigator’s knowledge of his stride length or by visually estimating the canopy width. The tree crown diameter measurements were made along an imaginary line intersecting the tree trunk that best approximated the average canopy diameter.

Pursuant to the Guide for Plant Appraisal (ISA 2000), tree health and structure were evaluated with respect to five distinct tree components: roots, trunk(s), scaffold branches, small branches, and foliage. Each component of the tree was assessed with regard to health factors such as insect, fungal or pathogen damage, fire damage, mechanical damage, presence of decay, presence of wilted or dead leaves, and wound closure. Components were graded as good, fair, poor, and dead with ‘good’ representing no apparent problems, and ‘dead’ representing a dying and/or dead tree. This method of tree condition rating is comprehensive and results in ratings that are useful for determining the status of trees based on common standards. Trees in natural settings have important habitat value, as evidenced by numerous cavity nesters and insects that thrive on and within oak trees, even when they are considered in poor structural or health condition. However, this assessment focuses on tree condition with regards to health and structure for purposes of analyzing potential project impacts and where necessary, providing recommendations for mitigating potential tree hazards, such as trees with weak limb attachments, cavities and rot, or excessive lean.

Upon completion of field data collection and mapping, raw GPS data was post-processed using GPS Pathfinder Office (v 3.10) and individual tree location data was compiled and updated in a geographic information system (GIS). The digital tree locations were linked to individual tree identification numbers and associated tree attribute data. This data set was then evaluated using ArcGIS (v. 10.1) software to determine the position of individual trees related to the proposed project development areas. Data resulting from this analysis was utilized to evaluate the individual tree impact totals presented in this report.

2.2 Tree Stands

In addition to mapping individual trees, Dudek conducted a tree tally count within three large willow stands where single stem and multi-stem trees were too dense for individual tagging. The individual tree locations as shown in Appendix C, D, and E are approximate and were not individually mapped due to the density and condition of the tree stands. These three contiguous stands of willow trees are located within the drainages in the central portion of the site and were delineated on 100-scale aerial photo based field maps. Willow stands consisted entirely of arroyo willow (Salix lasiolepis) and quantities documented reflect those trees that meet the City’s definition of a mature tree. Following field data collection, the willow stand boundaries were digitized in a GIS.

2.3 Scope of Work Limitations

No root crown excavations or investigations, aerial evaluations, or internal probing was performed during the tree assessments. Therefore, the presence or absence of internal decay or other hidden inferiorities in individual trees could not be confirmed. It is recommended that any large tree proposed for preservation in an area that receives human use be thoroughly inspected for internal, or subterranean, decay by a qualified ISA Certified Arborist before finalizing preservation plans.

3 OBSERVATIONS

There are 1,036 trees located within the Oak Creek; Escondido tree survey area and include 12 different tree species that meet the City’s criteria for a “mature tree.” As Table 1 indicates, most of the inventoried trees are native to California, including coast live oak, Engelmann oak, Mexican elderberry, arroyo willow, and Gooding’s black willow. The coast live oak and Engelmann oak trees are considered the highest value trees on this site. Table 1 provides a summary of the 12 species mapped and evaluated within the tree survey area. The Tree Location Exhibit in Appendix C presents the location of the individual trees and willow stands mapped and assessed for the Oak Creek; Escondido project.

Overall, the trees exhibit growth and structural conditions that are typical of their locations as both landscape and natural trees. The trees include various trunk and branch maladies as well as varying health and structural conditions. As presented in the Tree Information Matrix in Appendix B, most of the individually mapped trees, a total of 67.3% (475 trees), exhibit good health condition, 29.0% (205 trees) are in fair health condition, 3.5% (25 trees) in poor health, and 0.1% (1 tree) in very poor health. Dead trees were not evaluated during the tree inventory. Structurally, 5.9% (42 trees) of the individually mapped trees are considered to exhibit good structure, 78.6 % (555 trees) exhibit fair structure, 14.2% (100 trees) exhibit poor structure, and 1.3% (9 trees) exhibit very poor structure. Good condition trees exhibit acceptable vigor, healthy foliage, adequate structure, and lack of any major maladies. Fair condition trees are typical, with few maladies, but declining vigor. Poor condition trees exhibit declining vigor, unhealthy foliage, poor branch structure or excessive lean. In general, trees within the mapped willow stands are exhibit fair health and structural conditions.

Trees within the tree survey area vary in size and stature according to species and available growing space. Coast live oak and Engelmann oak trees are primarily single-stemmed with trunk diameters (DBH) ranging from 4–47 inches. Multi-stemmed oak trees with 2–6 stems have diameters up to 72 inches. Single and multi-stemmed red gum, Goodding’s black willow, arroyo willow, and many of the other ornamental landscape tree species have diameters between 8–51 inches. Tree heights vary from 3–85 feet. The immature Mexican fan palms found on site comprise the smallest trees while the taller (40 ft. +) trees are represented primarily by red gum, Goodding’s black willow, arroyo willow, and mature Mexican fan palm trees. Tree canopy extents range from 3 feet to nearly 45 feet. Over 50% of the trees on site exhibit canopy spreads that are greater than 20 feet across at their widest points.

3.1 Off-Site Survey Area Tree Observations

There are 34 trees located within the proposed off-site improvement survey areas. The off-site survey area includes 7 different tree species that meet the City’s criteria for a mature tree. As Table 1.1 indicates, most of the inventoried trees are coast live oak and eucalyptus trees. The coast live oak trees are considered the highest value trees and occur primarily in the Felicita Road adjacent location. Table 1.1 provides a summary of the seven species mapped and evaluated off site and adjacent to the proposed project footprint. In general, the off-site trees are in good to fair health and exhibit minimal sign of decline, with the exception of a few individual trees. Individual tree information is included within Appendix B. The Tree Location Exhibit in Appendix C presents the location of the individual trees assessed off-site for the Oak Creek; Escondido project. None of the off-site trees were physically tagged with a tree number since they were not on the project site, but are provided a unique identification number and digital location.

4 TREE PRESERVATION

4.1 Regulatory Definitions and Requirements

The following section summarizes the relevant policies regulating tree impact and removal associated with the Oak Creek; Escondido project:

4.1.1 City of Escondido

While the Oak Creek; Escondido project is currently outside of the Escondido city limits, proposed annexation into the City of Escondido warrants evaluating tree impacts and mitigation requirements consistent with the City’s current guidelines and ordinances. Tree protection, removal, and replacement standards are included in the City of Escondido’s General Plan and in Chapter 33 (Zoning), Article 55 (Grading and Erosion Control) of the City’s Municipal Code (Ordinance 2001-21). The Escondido General Plan recognizes oak trees and other mature trees, as defined below, as significant aesthetic and ecological resources deserving protection within the boundaries of the City. Section 33-1052 and 33-1068 of the City’s Municipal Code sets forth rules and standards related to mature tree removal, protection, and replacement.

Section 33-1502 (Definitions)

1. A mature tree is any self-supporting woody perennial plant, native or ornamental, with a single well-defined stem or multiple stems supporting a crown of branches.

a. The single stem, or one of multiple stems of any oak tree (Quercus species), shall have a diameter four inches or greater when measured at four and one-half feet (DBH) above the tree’s natural grade.

b. All other mature trees shall have a DBH of 8 inches, or greater, for a single stem or one of the multiple stems.

2. A protected tree is any oak (Quercus species) that has a ten inch or greater DBH, or any other tree species or individual specimen listed on the historic register, or determined to substantially contribute to the historic character of a property or structure listed on the local historic register, pursuant to Article 40 of the Escondido Zoning Code.

Section 33-1068 (Vegetation Clearing and Protection)

The purpose of this section is to establish regulations and standards for the preservation, protection, and selected removal of mature and protected trees. A vegetation removal permit is required prior to clearing, pruning, or destroying vegetation, and prior to any encroachments by

construction activities that disturb the root system within the dripline2 of mature trees. Issuance of a vegetation removal permit requires the submittal of a tree survey and possible a tree replacement and/or protection plan.

Section 33-1069 (Vegetation Protection and Replacement)

Pursuant to this section, every feasible effort and measure to avoid damage to existing trees to remain on site shall be taken by the owner and developer during clearing, grading, and construction activity. If mature trees cannot be preserved on site, they shall be replaced at a minimum ratio of one to one (1:1). Protected oak trees shall be replaced at a minimum ratio of two to one (2:1). However, the number, size, and species of replacement trees can be determined on a case-by-case basis by the Director of Planning and Building.

4.1.2 Migratory Bird Treaty Act

The Migratory Bird Treaty Act (MBTA 1918) requires tree removal and potentially disturbing construction activities to occur during certain time periods to avoid harassment of nesting birds. According to this Act, no construction or other disturbing activities can occur within 500 feet of an active bird nest during the period beginning in January and ending in June each year. Biological surveys should be conducted to provide clearance for project initiation.

4.2 Impacts

Tree impacts were determined through the use of geographic information system (GIS) technology to determine the locations of trees relative to the project impact areas (limits of grading). Impacts were further determined based on Dudek’s experience with native and non-native trees and their typical reactions to disturbances such as soil compaction, excavation, remedial grading. The impact analysis results presented herein were utilized for developing appropriate mitigation measures for the project.

Impacts to trees can be classified as either direct or indirect. Direct impacts to trees related to site improvements are typically the result of physical injuries or changes caused by machinery involved with the development process. Direct impacts include tree removal, root damage, soil excavation and compaction, grade changes, loss of canopy, and trunk wounds, amongst others. Indirect impacts to trees are the result of changes to the site that may cause tree decline, even when the tree is not directly injured. Indirect impacts include alterations to stream flow rates, diversion of ground water flow, introduction of exotic plant species, and alterations to

disturbance regimes. Wider-scale alterations to the area near trees as well as specific changes that occur around the trees are important considerations.

In general, there is a great deal of variation in tolerance to construction impacts among tree species, ages, and conditions. It is important to know how a certain tree based on its species, age, and condition would respond to different types of disturbance. The trees in the proposed project area are of varying ages and conditions. Mature specimens are typically more sensitive to root disturbance and grade changes. In general, healthy trees will respond better to changes in their growing environment. Trees of poor health or stressed conditions may not be vigorous enough to cope with direct or indirect impacts from construction activities.

Impacts totals presented herein are based on conceptual disturbance limits, fuel modification zones, and development plans as of the date of this TMPP. As such, the actual number of trees that are subject to direct and indirect impacts may change as the detailed site planning process proceeds.

4.2.1 On-Site Project Direct Tree Impacts

For the purposes of this report, direct impacts are those associated with tree removal or encroachment within the tree protected zone (canopy drip line plus 5 feet or 15 feet from trunk, whichever is greater). Tree removal is expected to be required when the trunk is located inside or within 2 feet of the proposed limits of grading. Encroachment is expected when soil and roots are disturbed within the tree protected zone. Table 2 summarizes the total number of trees (inclusive of those associated with walkway improvements along Felicita Road), by species, which are expected to be subject to direct construction-related impacts. The locations of impacted trees, by impact type, are presented in the map in Appendix D. Measures to minimize the extent of impact to preserved trees are provided in Appendix E.

4.2.1.1 On-Site Tree Impact Summary

Based on proposed project development plans, it is estimated that 238 (22.9%) mature trees will require removal, 92 (8.9%) will experience encroachment into the tree protected zone, 92 (8.9%) will be indirectly impacted, and 706 (68.1%) will be preserved in place with no direct impacts. Of the 238 trees identified for removal, 68 meet the criteria for classification as a protected tree, as defined by the City. Of the 92 encroached upon trees, 26 meet size criteria to be classified protected trees. In comparison, the proposed Alternative #4 project development plan removes an estimated 220 (21.2%) mature trees, encroaches into the tree protection zone of 94 trees (9.1%), indirectly impacts 95 trees (9.2%) and preserves 722 trees (68.7%). Of the 220 trees identified for removal in the proposed Alternative # 4 project plan, 63 meet the criteria for classification as a protected tree, as defined by the City and of the 94 encroached upon trees, 27 meet size criteria to be classified protected trees. In total, the proposed Alternative #4 preserves an additional 16 trees.

Table 3 presents only the number of trees expected to be directly impacted by walkway improvements along Felicita Road.

4.2.2 Indirect Tree Impacts

Indirect impacts to trees are the result of changes to the site that may cause tree decline, even when the tree is not directly injured. Site-wide changes affecting trees include: diverting runoff and storm water, creating retention and detention ponds, relocating streams or making improvements to streams, lowering or raising water tables, altering the capacity for soil moisture recharge, removing vegetation, or damming underground water flow (Matheny and Clark 1998). For the purposes of this report, indirect tree impacts are expected for trees within 25 feet of the project’s limits of grading and not subject to removal or encroachment. Trees located in fuel modification zones are also typically considered indirectly impacted; however, no trees are located in proposed fuel modification zones that are not otherwise impacted (removal or encroachment).

Other potential indirect impacts may include firewood harvesting, vandalism, and deliberate or accidental wildfire ignition in oak-willow woodland drainage areas. These potential indirect impacts can be minimized by implementing woodland management and protection measures, including educational material provided to homeowners and long-term management of oak-willow dominated habitat on the site. Table 4 presents the number of trees expected to be indirectly impacted by the proposed project.

4.2.3 Off-Site Impacts

Table 5 summarizes the total number of trees, by species, which may be subject to direct construction-related impacts due to the proposed off-site infrastructure improvements. The locations of impacted trees, by impact type, for the proposed off-site infrastructure improvements, are presented in the map in Appendix D. Measures to minimize the extent of impact to preserved trees are provided in Appendix F.

4.2.4 Off-Site Tree Impact Summary

Based on available project information for off-site improvements, it is estimated that nine mature trees will potentially require removal and 14 will experience potential encroachment into the tree protected zone. Of the 23 trees identified for removal, 3 meet the criteria for classification as a protected tree, as defined by the City. Of the 14 encroached upon trees, 3 meet size criteria to be classified protected trees. The 23 potentially impacted trees consists of 6 red gum eucalyptus, 2 silver-dollar gum eucalyptus, 2 sugar gum eucalyptus, 1 shamel ash, 9 coast live oaks, 1 willow and 2 Mexican fan palms. Off-site impacts are expected to be minimized through the measures outlined in this TMPP.

4.2.5 Total Project Tree Impacts

For comparison, Table 6 summarizes the total number of trees, by species, which are expected to be subject to direct construction-related impacts. Based on the proposed project and off-site infrastructure improvements, it is estimated that 247 trees would require removal and an additional 106 trees would be preserved in place with protections, but encroached upon. The locations of impacted trees, by impact type, for the proposed off-site infrastructure improvements, are presented in the map in Appendix D. Measures to minimize the extent of impacts to preserved trees are provided in Appendix F.

4.2.5.1 Tree Impact Summary – All Trees (Proposed Project and Off-site Trees)

In total, it is estimated that 247 (23.1%) mature trees will require removal, 106 (9.9%) will experience encroachment into the tree protected zone, 92 (8.6 %) will be indirectly impacted, and 717 (67%) will be preserved in place with no direct impacts. Of the 247 trees identified for removal, 71 meet the criteria for classification as a protected tree, as defined by the City. Of the 106 encroached upon trees, 29 meet size criteria to be classified protected trees. The removal of 247trees (including 143 coast live oaks and 5 Engelmann oaks) and encroachment on an additional 106 trees (including 52 coast live oaks and 1 Engelmann oaks) is considered a significant impact, but is mitigated to a less than significant level through the measures outlined in this TMPP. This TMPP utilizes a conservative, overly aggressive approach to defining tree impacts from grading. The actual number of tree impacts will be finalized at time of grading and it may be possible to reduce the total number of trees impacted and the related mitigation tree planting requirements through minor grading adjustments in the field.

5 MITIGATION

Section 33-1069 of the City of Escondido’s Municipal Code identifies tree replacement standards for projects affecting mature and/or protected trees. Minimum mitigation planting requirements for removal and encroachment on 253 mature trees (1:1 replacement ratio) and 100 protected trees (2:1 replacement ratio) is 453 trees. However, Dudek’s oak tree and woodland management experience indicates that mitigation tree planting should be conducted with an ecological approach, rather than only planting container tree stock in the post-construction landscape. This ecological approach is the framework for the mitigation program outlined in this TMPP, which is consistent and dovetails with the site’s biological habitat restoration plan and which also satisfies the intent of City requirements and is consistent with state oak woodland mitigation regulations (California Public Resource Code 21083.4) concerning tree preservation, replacement, and monitoring.

The proposed Oak Creek; Escondido tree mitigation program focuses on preservation (the project will preserve over 68.1% of the trees on site) and restoration and enhancement of preserved oak trees/stands through sustainable tree plantings, as well as native tree planting in the transition area between open space and developed areas throughout the proposed project site.

5.1 Proposed Mitigation Program

The proposed mitigation program has been designed to provide mitigation for direct impacts to 253 mature trees and 100 protected trees associated with the Oak Creek; Escondido project and off-site infrastructure improvements, and does not directly address mitigation associated with the proposed Alternative # 4 plan. However, should Alternative #4 be selected, the proposed mitigation plan would be refined to meet the reduced potential impacts of Alternative #4. The goal of the proposed mitigation program is to offset tree impacts through a sustainable, customized plan that is suitable for the site’s unique opportunities for oak tree preservation, enhancement, and establishment. Dudek recommends that the tree mitigation program focus on the inclusion of native and ornamental trees (larger container sizes – 15- gallon, deep tree pots and d-40s 24-inch box, etc.) within project landscape areas. Tree species recommended for individual mitigation include coast live oaks, western sycamores (Platanus racemosa), London plane (Platanus acerfolia), holly oak (Quercus ilex), western redbud (Cercis occidentalis) and strawberry trees (Arbutus unedo). Furthermore, it is recommended that 1,500 to 2,000 additional tree plantings occur within the site’s potential tree receiver sites (within the preserved riparian areas as identified in the Conceptual Habitat Restoration Plan). It is recommended that the additional tree plantings within these areas include acorns, seedlings, cuttings, and up to 1-gallon container sized native trees in an effort to enhance and restore oak and willow dominated habitats outside the development footprints, primarily in the site’s drainages. These strategies will be described in more detail in the project’s Conceptual Habitat Restoration Plan (CHRP).

The CHRP will be a cohesive restoration and monitoring plan that will address site-wide restoration/mitigation efforts and will include a tree planting, canopy cover goal, and monitoring component.

The CHRP shall be approved by the City of Escondido (as well as applicable agencies), prior to the issuance of grading permits. The plan shall specify native oak, willow, sycamore, and cottonwood tree planting details, locations, and long-term maintenance and monitoring for mitigation trees. This plan will be utilized to prepare biddable construction documents for site preparation, tree installation and maintenance. The CHRP shall require that a knowledgeable arborist or biologist be retained to monitor mitigation tree plantings for a period of five years. The CHRP shall also outline reporting protocols and standards for mitigation tree replacement, should it be necessary if canopy cover goals are not being achieved.

5.2 Mitigation Details

As indicated in Table 7, the total number of plantings required to meet the intent of the City of Escondido tree protection and replacement requirements is 453 trees. Therefore, the mitigation program proposes that a minimum of 453 trees (including coast live oak and other suitable native or ornamental species are planted within the development landscape areas (Figure 3) and an additional 1,500 – 2,000 acorns, seedlings, cuttings, and 1-gallon native trees be planted within the existing restoration woodland areas. Table 8 provides recommended replacement species and totals for the 453 individually impacted trees. The 453 landscape trees provide mitigation for the 353 individual tree impacts from the site according to the City replacement ratios, but do not provide mitigation for the loss of habitat. Therefore tree plantings within the preserved riparian corridors on site will include native coast live oak, sycamore, cottonwood and willow trees totaling 1,500 to 2,000 additional trees at proportions similar to existing species proportions. The project’s CHRP will provide the final tree planting total, which is expected to mitigate the loss of native oaks and willows.

5.3 Mitigation Discussion

The total number of mitigation trees proposed for anticipated tree impacts is considered appropriate and sustainable and results in a minimum of 3:1 replacement should 30% of the preserve riparian plantings survive, which is higher than the 1:1 and 2:1 replacement ratios as required by the City of Escondido. However, the acorns, seedlings, cuttings, and 1-gallon planting success ratios cannot be precisely determined at this time, but would not be expected to

exceed roughly 75% under ideal conditions. Conservative estimates of acorn establishment success result in a 30–75% success ratio for a project of this scale. At a 30% success ratio, the acorn/seedling planting totals 600 trees or roughly 3 replacement trees for every impacted oak tree when combined with the 453 landscape plantings. At 60% success of acorns/seedlings, the replacement to impacted ratio is 4.7:1, when combined with the 453 landscape plantings, more than double the City of Escondido’s minimum requirement of 1:1 for mature trees and 2:1 for protected trees.

Concerns over seedling and smaller plant sizes as mitigation for loss of mature or semi-mature native oak and willow trees are alleviated when considering how well small tree plantings perform. Planting seeds and seedlings has long been considered the most simple, economical, and successful way of establishing healthy trees. They do not require long-term, supplemental water (following watering for up to 5 years (2–3 years and no water for last 2 years to insure they are viable) and during drought years, they generally naturalize, outperform larger trees, and produce superior trees. Direct seeding of acorns and seedlings is often discouraged because growers expect poor germination rates and a high loss to rodents. These problems are minimized with careful selection and storage of seed and the use of newly available, low-cost tree shelters to protect the seed and growing seedling in the ground. Proper seed handling methods have been shown in numerous settings to produce germination rates greater than 60th percentile. New technology, such as planting hole preparation, amendments, watering techniques, and protective cages, allows experienced restoration specialists to prepare a planting site to enhance the likelihood of successful germination and survival.

Tree Relocation

As mentioned, relocation of impacted trees was analyzed during our tree assessments, and a total of six trees are considered “candidates.” However, tree relocation is not a requirement of the City or of this TMPP. Rather, as the landscape plan is finalized, if any of the six candidate trees can be relocated, they will be evaluated further. Tree relocation is a stressful process for native oaks and unless they are superior specimens, it is preferable to purchase large, nursery-grown trees.

Alternative #4

Project Alternative #4 reduces the total number of impacted (removal and encroachment) trees by 16 trees with total impacts at 314 (non-inclusive of off-site trees) trees. Should Alternative #4 be selected, the proposed mitigation plan would be refined to meet the reduced potential impacts of Alternative #4. The total number of mitigation trees that would be provided under this alternative is 404 trees (non-inclusive of off-site tree mitigation). The locations of impacted trees, by impact type, for the proposed Alternative #4 project, are presented in the map in Appendix E. Measures to minimize the extent of impact to preserved trees are provided in Appendix F.

6 CONCLUSIONS

The Oak Creek; Escondido trees and groves are characterized by scattered individual oak trees and more concentrated stands along or within the property’s drainage network. The site includes fair to good recruitment of seedlings and saplings below tree canopy cover. The project site, inclusive of the off-site infrastructure improvement areas, includes 1,070 total trees represented by 14 species, 6 of which are native to the State of California. A vast majority of the trees on site are concentrated in the sites’ two primary drainages. In total, there are 421 oak trees and 615 other mature trees on the property and an additional 18 oak trees and 16 ornamental trees off-site, of which 353 (201 oaks) are expected to be impacted by the proposed project, with up to 106 of them potentially preservable in place. Alternatively, the proposed Alternative #4 project impacts up to 220 (non-inclusive of potential off-site impacts) trees and encroaches on an estimated 94 trees (non-inclusive of potential off-site impacts), A few of the impacted oaks may be suitable for relocation within the project’s landscape areas.

The remaining 68.1% of the trees on site are in areas that will be avoided by the project. As such, these areas are preserved and will be enhanced and restored through native tree planting and protection measures designed to increase establishment, consistent with oak habitat mitigation goals outlined in the City of Escondido’s Tree Regulations and Standards chapters 33-1052 and 33-1068.

Mitigation planting will include replacement of the impacted oak trees with a minimum of 453 landscape area tree plantings that will be at least 15-gallon size as well as a minimum of 1,500 to 2,000 tree plantings in the preserved woodlands/riparian areas with seed, seedlings, 1-gallon and cuttings. The larger tree plantings will be incorporated into the site’s Landscape plan. The smaller sized plantings are appropriate for the habitat areas that they will be planted in as a component of the restoration program. A Conceptual Habitat Restoration Plan will be prepared for all site restoration activities and will guide the tree planting in these areas. This proposed mitigation program is a sustainable and site-customized oak restoration program. This mitigation program includes planting seedling and small sapling oak, willow, cottonwood, and sycamore trees in the preserved riparian areas, and various sized trees in the landscaped portion of the proposed development.

The final number of mitigation trees is expected to be between 1,050 and 1,650, depending on germination and establishment rates. The anticipated result is a significant increase in the number of trees over existing conditions and provision for the next generation of oaks and riparian willow, cottonwood and sycamore trees. The proposed mitigation program provides many benefits including focusing restoration on degraded riparian woodlands, providing protection measures for developing seedlings and saplings, including planting in the transition areas of the development to soften the edge between wildland and developed areas, and integrating the oak

mitigation with mitigation for other plant communities, as possible. The landscape component will incorporate native oaks as a significant component.

6.1 Arborist’s Statement

This report provides conclusions and recommendations based on an examination of the trees and surrounding site by ISA Certified Arborists. Arborists are tree specialists who use their education, knowledge, training, and experience to examine trees, recommend measures to enhance the beauty and health of trees, and attempt to reduce the risk of living near trees.

No root crown excavations or investigations, or internal probing was performed during the tree assessments. Therefore, the presence or absence of internal decay or other hidden inferiorities in individual trees could not be confirmed. It is recommended that any large tree proposed for preservation in an area that receives human use be thoroughly inspected for internal, or subterranean decay by a qualified arborist before finalizing preservation plans and appropriate mitigations should be enacted to reduce potential risk.

Arborists cannot detect every condition that could possibly lead to the failure of a tree. Trees are living organisms that fail in ways not fully understood. Conditions are often hidden within trees and below ground. Arborists cannot guarantee that a tree will be healthy or safe under all circumstances, or for a specified period of time. There are no guarantees that a tree’s condition will not change over a short or long period due to weather, cultural or environmental conditions. Trees can be managed but not controlled.

The following sections are included as general guidelines for tree protection from construction impacts. The measures presented should be monitored by arborists and enforced by contractors and developers for maximum benefit to the trees.

Tree Protection Measures Prior to Construction Prior to any grading activity, preserved trees that fall within 500 feet of construction activity shall be protected by fencing and signage. All contractors shall be made aware of the tree protection measures. Fencing: A 4-foot high, orange-webbing, polypropylene barricade fence with tree protection signs shall be erected around all trees (or tree groups) to be preserved. The protective fence should be installed ten feet beyond the dripline of the tree. This will delineate the tree protection area and prevent unwanted activity in and around the trees in order to reduce soil compaction in the root zones of the trees and other damage from heavy equipment. The fence webbing shall be secured to 6-foot, heavy gauge t-bar line posts, pounded in the ground a minimum of 18-inches and spaced 8-feet on-center. Fence webbing will be attached to t-bar posts with minimum 14-gage wire fastened to the top, middle and bottom of each post. Tree protection signs should be attached to every fourth post. The contractor shall maintain the fence to keep it upright, taut, and aligned at all times. Fencing shall be removed only after all construction activities are complete. Pre-Construction Meeting: A pre-construction meeting shall be held between all contractors (including grading, tree removal/pruning, builders, etc.) and the arborist. The arborist will instruct the contractors on tree protection practices and answer any questions. All equipment operators and spotters, assistants, or those directing operators from the ground, shall provide written acknowledgement of their receiving tree protection training. This training shall include information on the location and marking of protected trees, the necessity of preventing damage, and the discussion of work practices that will accomplish such.

Protection and Maintenance During Construction Once construction activities have begun the following measures shall be adhered to: Equipment Operation and Storage: Avoid heavy equipment operation around the trees. Operating heavy machinery around the root zones of trees will increase soil compaction, which decreases soil aeration and subsequently reduces water penetration in the soil. All heavy equipment and vehicles should, at minimum, stay out of the fenced tree protection zone, unless where specifically approved in writing and under the supervision of a Certified Arborist. Storage and Disposal: Do not store or discard any supply or material, including paint, lumber, concrete overflow, etc. within the protection zone. Remove all foreign debris within the protection zone; it is important to leave the duff, mulch, chips, and leaves around the retained trees for water retention and nutrients. Avoid draining or leakage of equipment fluids near retained trees. Fluids such as: gasoline, diesel, oils, hydraulics, brake and transmission fluids, paint, paint thinners, and glycol (anti-freeze) should be disposed of properly. Keep equipment parked at least 50 feet away from retained trees to avoid the possibility of leakage of equipment fluids into the soil. The effect of toxic equipment fluids on the retained trees could lead to decline and death. Grade Changes: Grade changes, including adding fill, are not permitted within the tree protection zone, without special written authorization and under supervision by a Certified Arborist. Lowering

the grade within this area will necessitate cutting main support and feeder roots, jeopardizing the health and structural integrity of the tree(s). Adding soil, even temporarily, on top of the existing grade will compact the soil further, and decrease both water and air availability to the trees’ roots. Moving Construction Materials: Care will be taken when moving equipment or supplies near the trees, especially overhead. Avoid damaging the tree(s) when transporting or moving construction materials and working around the tree (even outside of the fenced tree protection zone). Above ground tree parts that could be damaged (e.g., low limbs, trunks) should be flagged with red ribbon. If contact with the tree crown is unavoidable, prune the conflicting branch(es) using ISA standards. Root Pruning: Except where specifically approved in writing, all trenching shall be outside of the fenced protection zone. Roots primarily extend in a horizontal direction forming a support base to the tree similar to the base of a wineglass. Where trenching is necessary in areas that contain tree roots, prune the roots using a Dosko root pruner or equivalent. All cuts should be clean and sharp, to minimize ripping, tearing, and fracturing of the root system. The trench should be made no deeper than necessary. Irrigation: Trees that have been substantially root pruned (30% or more of their root zone) will require irrigation for the first twelve months. The first irrigation should be within 48 hours of root pruning. They should be deep watered every two to four weeks during the summer and once a month during the winter (adjust accordingly with rainfall). One irrigation cycle should thoroughly soak the root zones of the trees to a depth of 3 feet. The soil should dry out between watering; avoid keeping a consistently wet soil. Designate one person to be responsible for irrigating (deep watering) the trees. Check soil moisture with a soil probe before irrigating. Irrigation is best accomplished by installing a temporary above ground micro-spray system that will distribute water slowly (to avoid runoff) and evenly throughout the fenced protection zone but never soaking the area located within 6- feet of the tree trunk, especially during warmer months. Pruning: Do not prune any of the trees until all construction is completed. This will help protect the tree canopies from damage. All pruning shall be completed under the direction of an ISA Certified Arborist and using ISA guidelines. Only dead wood shall be removed from tree canopies. Washing: During construction in summer and autumn months, wash foliage of trees adjacent to the construction sites with a strong water stream every two weeks in early hours before 10:00 a.m. to control mite and insect populations. Inspection: An ISA Certified Arborist shall inspect the impacted preserved trees on a monthly basis during construction. A report comparing tree health and condition to the original, pre-construction baseline shall be submitted following each inspection. Photographs of representative trees are to be included in the report on a minimum annual basis.

Maintenance After Construction Once construction is complete the fencing may be removed and the following measures performed to sustain and enhance the vigor of the preserved trees. Mulch: Provide a 4-inch mulch layer under the canopy of trees. Mulch should include clean, organic mulch that will provide long-term soil conditioning, soil moisture retention, and soil temperature control. Pruning: The trees will not require regular pruning. Pruning should only be done to maintain clearance and remove broken, dead or diseased branches. Pruning shall only take place following a

recommendation by an ISA Certified Arborist and performed under the supervision of an ISA Certified Arborist. No more than 15% of the canopy shall be removed at any one time. All pruning shall conform to International Society of Arboriculture standards. Watering: The natural trees that are not disturbed should not require regular irrigation, other than the twelve months following substantial root pruning. However, soil probing will be necessary to accurately monitor moisture levels. Especially in years with low winter rainfall, supplemental irrigation for the trees that sustained root pruning and any newly planted trees may be necessary. The trees should be irrigated only during the winter and spring months. Watering Adjacent Plant Material: All plants near the trees shall be compatible with water requirements of said trees. The surrounding plants should be watered infrequently with deep soaks and allowed to dry out in-between, rather than frequent light irrigation. The soil shall not be allowed to become saturated or stay continually wet. Irrigation spray shall not hit the trunk of any tree. A 60-inch dry-zone shall be maintained around all tree trunks. An above ground micro-spray irrigation system is recommended over typical underground pop-up sprays. Washing: Periodic washing of the foliage is recommended during construction but no more than once every two weeks. Washing should include the upper and lower leaf surfaces and the tree bark. This should continue beyond the construction period at a less frequent rate with a high-powered hose only in the early morning hours. Washing will help control dirt/dust buildup that can lead to mite and insect infestations. Spraying: If the trees are maintained in a healthy state, regular spraying for insect or disease control should not be necessary. If a problem does develop, an ISA Certified Arborist should be consulted; the trees may require application of insecticides to prevent the intrusion of bark-boring beetles and other invading pests. All chemical spraying should be performed by a licensed applicator under the direction of a licensed pest control advisor. Inspection: All trees that were impacted during construction within the tree protection zone should be monitored by an ISA Certified Arborist for the first five years after construction completion. The Arborist shall submit an annual report, photograph each tree and compare tree health and condition to the original, pre-construction baseline.
