The government intends toimplement all the four la-bour codes from April 1.These four codes will sub-sume all existing 29 Centrallabour laws.The four codes are — Indus-

trial Relations Code, Code onOccupational Safety,Health&Working Conditions Code(OSH), Social Security Codeand Code on Wages. Thoughthe fourth Code was enactedand rules finalised last year,however since all are inter-connected, so it hasbeenpro-posed to implement all thefour together.“We hope to finalise rules

for remaining three codesduring last quarter of FY2020-21,” Labour SecretaryApurva Chandra told report-ershere. There are somerulesto be framed by the Centrewhile some are to be formu-lated by States.“We have written to all the

States to finalise rules ontheir part,” he said.

45 days for feedbackThe Centre will publish draftrules on its part duringsecond half of next month.Then 45 days will be given tostakeholders to give theirfeedback. Based on the feed-back and if required largestakeholder consultation,rules will be framed accord-ingly. There are indicationsthat some rules could be no-tified earlier and some laterdependuponhow States pro-actively work for finalisationof rules on their part.These codes have already

been enacted after passed byParliament and accented bythe President earlier thismonth.

The government hopesthat these new laws will facil-itate ease of doing businessand boost investment. Thesewill establish transparent,answerable and simplemechanism reducing to oneregistration, one licence andone return for all codes, La-bour Ministry had said afterpassage of there codes in Par-liament.

Safeworking environmentThe OSH Code (operationalsafety and health) envisagessafe working environmentfor workers especially wo-men. An effective dispute res-olution mechanism is beingensured through IndustrialRelations Code providing fortime-bound dispute resolu-tion system in every institu-tion. The Social Security Codeprovides a framework to in-clude organised and unor-ganised sector workers un-der the ambit ofcomprehensive social secur-ity. It also containsprovisions

relating to EPFO, ESIC, build-ing construction workers,maternity benefits, gratuityand social security fund forunorganised sector workers.For the first time in the

OSH Code, annual healthcheck-up has been providedfor workers above a certainage. It also provides for thepayment of at least 50 percent of the penalty imposedon an employer for injury ordeath at the work place, tothe aggrieved worker, in ad-dition to other benefits. Withall these provisions, an efforthas been made to give work-ers a safe working environ-ment. A provision has beenmade that women can workin any type of institution atnight as per their choice.

Fixed term conditionsThe government claims thatfixed term employees’ ser-vice conditions, salary, leaveand social security will alsobe the same as a regular em-ployee. In addition, fixedterm employee has also beengiven the right to pro-rataGratuity.As far as raising the

threshold in retrenchment,closure or lay-off in the IRCode from 100 workers to300, it says labour is on theconcurrent list, and the con-cerned State governmentshave the right to change thelaws. He informed that asmany as 16 States, using thisright, have already increasedthis limit.

TheUnionCabinetonWednes-day approved the modifica-tion of the ADNOCModel to al-low export of crude oil storedin India’s Strategic PetroleumReserves.These modifications are to

the existing commercialisa-tion model under which theAbu Dhabi National Oil Com-pany (ADNOC), UAE’s nationaloil company, had stored crudeoil in one cavern of MangaloreStrategic Petroleum Reserve(SPR) managed by the IndianStrategic Petroleum ReserveLimited (ISPRL).

“The modifications includeincrease in commercial quant-ity for ADNOC, allowing re-ex-port to third countries as wellas permitting coastal move-ment of crude from/to SPRthrough foreign flag vessels.ADNOCstoredtheentirecrudeoil at its own cost,” an officialsaid.Commenting on the de-

cision,UnionMinister PrakashJavadekarsaidtheCabinetalsogave post facto approval forthe ₹3,874-crore expenditureincurred in filling up the Stra-tegic Petroleum Reserves with1.60 crore barrels of crude oil.He said that there has been a

benefit of ₹5,000 crore to thecountry because of thispurchase.The gain is because the

crude oil was purchasedwhenprices had plummeted toaround $21 a barrel. “Sinceprices have recovered fromthose levels, there is a gain forthe country,” the official said.ADNOC had in February

2018 signedapact tofill half ofthe 1.5 million tonne strategicoil storage at Mangaluru. Thefinal shipment of the initialdelivery of ADNOC crude to bestored in ISPRL’s undergroundfacility at Mangaluru had ar-rived inNovember 2018.Under the agreement, AD-

TheCabinetCommitteeonEco-nomic Affairs (CCEA) on Wed-nesdayapprovedthedemergerof Nagarnar Steel Plant fromstate-owned mineral producerNMDC. The Cabinet also ap-proved the strategic disinvest-ment of the demerged com-pany by selling the entireGovernment stake to a stra-tegicbuyer.This is the second time that

the Cabinet has given anod forthe strategic sale of the NMDCIron & Steel Plant (NISP)Nagarnar, Bastar district, Ch-hattisgarh. With the latest ap-proval, the CCEA has amendedits earlierdecision takenonOc-tober 27, 2016, to disinvest NSPas aunit of NMDC.Speaking to journalists after

Minister Prakash Javadekarsaid: “The Nagarnar Steel Plantis 90per cent complete. It is ex-pected to be commissioned byMarch 2021. The next step willbe to carve it out of NMDC Ltdby April 2021. The strategic dis-investment will be completedby September 2021.”Responding to a Business-

Line query, Javadekar said: “Thetotal expenditure in setting upthe Nagarnar Steel Plant was₹23,140 crore. It is a profitableventure, so thiswill be themin-imum floor price for strategicsale. The interests of minoritystakeholders will also beprotected.”In August this year, the

NMDC Board had given an in-principle approval to the pro-posal to demergeNMDC Iron&Steel Plant, Nagarnar. This waspart of long-standing consider-ations for unlocking its valueby either roping in a strategicpartner or potentially listing itseparatelybydemerging.The project has faced signi-

ficant delays, and the cost over-run is already said to havetouched50per cent.Anofficialstatementsaidthe

Nagarnar Steel Plant (NSP) willbeathreemilliontonneperan-num (mta) integrated steelplant. NMDC has invested₹17,186 crore in the project, outof which ₹16,662 crore is fromNMDC’s own funds and ₹524crore has been raised from thebondmarket.

Post-mergerplanThe statement also said thatafterthedemerger,NSPshallbea separate company and themanagements of NMDC andNSP shall be accountable fortheir respectiveoperationsandfinancial performance. Share-holders of NMDC will also beshareholders of the demergedcompany (NSP) in the propor-tionof their shareholding.“The demerger will also be

tax-neutral from the point ofviewof capital gains,” the state-ment added.

The Cabinet on Wednesday ap-proved the implementation of aproject called StrengtheningTeaching-Learning and Resultsfor States (STARS) for improvingqualityof education insixStates.Thetotalprojectcostispeggedat₹5,718 crore with the financialsupport of World Bank amount-ing to $500 million (approxim-ately ₹3,700 crore), the officialstatement said.The STARS project would be

implemented as a newCentrallySponsored Scheme under De-partment of School Educationand Literacy, Ministry of Educa-tion and will involve the settingup and support to the NationalAssessment Centre, PARAKH asan independent and autonom-ous institution under the De-partment of School Educationand Literacy, an official state-ment added. “The project coversHimachal Pradesh, Rajasthan,Maharashtra, Madhya Pradesh,Kerala and Odisha. The identi-

fied States will be supported tovarious interventions for im-provingthequalityof education.Besides this project, it is also en-visaged to implement a similarADB funded project in Gujarat,Tamil Nadu, Uttarakhand,JharkhandandAssam,” it added.

SpecialpackageTheCabinet also approved a spe-cialpackageworth₹520crore intheUTsof J&KandLadakhforfiveyears till FY 2023-24. This is beingdone to ensure funding ofDeendayal Antyodaya Yojana -National Rural Livelihoods Mis-sion (DAY-NRLM) in the UTs ofJammu and Kashmir & Ladakh“on a demand driven basiswithout linking allocation withpoverty ratio during this exten-dedperiod”.Meanwhile, an MoU between

IndiaandAustralia forcollabora-tion in capacity building, re-search and development andmaking an impact for sustain-able groundwatermanagementalsogot theCabinet’snod.

TheSupremeCourtonWednesdayques-tioned the government’s need to wait awholemonth, tillNovember 15, tonotifythe implementation of a scheme forwaiving the compound interest (in-terest on interest) accumulated duringmoratorium against loans up to ₹2crore.

Thewaiver scheme ismeant to “hand-hold small and vulnerable borrowers”whose fortunes have dipped during thelockdown.

“Their Diwali is in your hands,” thecourt told thegovernment.

Schemefor8categoriesThe waiver scheme has been proposedfor eight different categories, includingMSME, education, housing, consumerdurables, credit card, auto, personalandconsumption loans.

The RBI had termed theCentre’s resolve as an “addi-tional relief” for pandemic-induced financial distressamongborrowers.

But the court soundedsceptical onWednesday.

“Having taken the decision towaive their compound interest forthe moratorium period, our only ques-tion to you is why do you require amonth (till November 15) to bring thisscheme into effect?Whydoyoudelay is-suing the circular?” Justice AshokBhushan asked Solicitor-General TusharMehta, appearing for theCentre and theRBI.

Justice MR Shah, also on the Bench,asked Mehta to consider the plight ofthecommonman. “Inhismind, thegov-ernment has already helped him (withthewaiverof compoundinterest)...Nowhe wants concrete results. When you

have already taken a decision, why doyouneedonemonthjust to issueacircu-lar?” Justice Shahasked.

In his turn, the Solicitor-Generalreplied that the schemewas itself proofof the government’s concern for thecommonman.

“We have already considered theplight of the commonman. That is whywe have brought this scheme... Wewould not gain anything by delaying it.Therearecomplexities involved.Novem-ber 15 is the outer limit,” Mehtaexplained.

Tothis, JusticeShahsaidthecourtwel-comed the step taken by the govern-mentto“takecare”of thecommonman.

“We welcome it, but you need to im-plement it soon,” Justice Shahsaid.

Mehta replied that certain “modalit-ies”need tobeworkedout.

“Modalities will take a month? Ifyou had issued a circular to thebanks, theywouldhave takensteps... Till now you havenot. You have only told thecourt,” Justice Bhushanobserved.Mehta said the govern-

menthasdetailedtheschemeonanaffidavit in court. Itwould

notgobackon itsword.Senior advocate Harish Salve, for the

Indian Banks Association, assured theBench, also comprising Justice R.Subhash Reddy, that the scheme wouldbe “workedoutanddone”.

Senior advocateRajeevDutta, for peti-tioner Gajendra Sharma, sought “oneline from the Bench to assure the com-monman”.

But the Bench refrained frompassingany formal order. Instead, the courtscheduled a hearing for November 2.The Bench said it would evaluate thesteps takenby thegovernment then.

The Finance Ministry expects the for-eign investment restrictions — intro-duced in April this year (press note 3)against investments from China andother countries with which Indiashares a land border — to have only“temporary impact” on start-up fund-ing in thecountry, a topofficial said.

The increased interest amongprivate equity investors from othercountries (like US and those in EU)willhave a “substitution” effect and fill thespace, Chief Economic Advisor Krish-namurthy Subramanian said on Wed-nesday. He was speaking at a FICCI or-ganised virtual session on ‘Investmentopportunities in stressed assets inIndia’.

Asked as to what is the impact of in-direct investments from HongKong into India and will this besubject togovernmentapprovalunder new regime of press note3, Subramanian replied to thisspecific question at a broader

level: “Yes, investments coming fromacross the border from country withwhichwe have tensions right now ..ac-tually those need to be scrutinised.That includes not only thedirect ones even indirectonesaswell”.

He said there will besome impact on start-upfunding in short run butwithin some time thatspace will get filled.“Private equity playersfrom other countries arekeen to participate in theIndian start-upecosystem.This impactwill be temporaryandsub-stitutionwillhappen,”headded.

It may be recalled that the govern-ment had in April this year amendedthe foreign direct investment policy tocurb opportunistic takeovers/acquisi-

tions of Indian companies due to thepandemic. The change in FDI policy ex-panded the list of countries whose in-vestors are no longer eligible to invest

in India under the auto-matic route. Also, an in-vestment in India — thatwould otherwise fall un-der automatic route—now falls under the gov-ernment route if it the in-vestingentityhasa “bene-ficial owner” who is fromsuchborderingcountry.

Wholesale price-based inflation (WPI)rose to a seven-month high of 1.32 percent in September 2020, higher than0.33 per cent in samemonth last year.The bump up in WPI comes on theback of costlier food prices. In August2020, the WPI had touched 0.16 percent.The latestWPI print is significant as

it is forthesecondstraightmonththatit is showingpositive readingafterbe-ing in negative territory for four con-secutive months April (-)1.57 per cent;May (-)3.37 per cent; June (-)1.81 percent; and July (-)0.58per cent.Food articles inflation during

September 2020 stood at 8.17 per centas against 3.84per cent inAugust, offi-cial DP data showed. Vegetable prices

inflationwas as high as 36.54 per centand potato prices saw 107.63 per centonayear-on-yearbasis.Manufacturedproducts inflationin

September stood at 1.61 per cent from1.27per cent inAugust 2020.Policymakers are now guided by

themovements in retail inflation andnot by the wholesale price index-based inflation.Commenting on the latest WPI

print,MadanSabnavis, Chief Econom-ist, CARE Ratings, said that inflationfor manufactured goods has startedincreasinginthe last fourmonthsandthis is apositive sign. “It is good for in-dustry which is looking for a changein fortunes which have been down-beat in the past signifying loss of pur-chasingpower. This ishenceapositivesign,”he said.
