Highlights

2016 Quarter 1 Quarterly Environmental Enforcement Summary

The Quarterly Environmental Enforcement Summary for the 1st Quarter of 2016 contains 4 orders, 44 administrative sanctions, 279 tickets and 25 court convictions. The total 2016 Q1 penalty amount (includes tickets and court convictions) is $3,532,210. Notable highlights in this quarter:

Teck Metals Ltd. was ordered to pay $3,401,500 in court fines and creative sentencing payments. The company was convicted under the Environmental Management Act and the federal Fisheries Act for unauthorized zinc and caustic solution discharges. The court ordered Teck Metals Ltd. to pay $3,000,000 to the federal Environmental Damages Fund, $390,000 to the B.C. Habitat Conservation Trust Foundation and $11,500 in fines and victim surcharges to the B.C. Provincial Court. This court case was a joint submission by both Federal Crown and Provincial Crown and involved a series of non-compliant incidents at the facility. Some of the non-compliant incidents were investigated by Environment Canada and some were investigated by the B.C. Conservation Officer Service.

Copper Mountain Mine was issued a Pollution Abatement Order under the Environmental Management Act after a mudslide resulted in the unauthorized discharge of rock and soil (overburden) material. This material originated from a waste rock storage area at the Copper Mountain Mine site and entered Wolfe Creek, a fish bearing stream. The company was ordered to clean up and restore the site, take management actions to prevent any further discharge into the creek, and submit a final report when the work is completed. Thirty tickets were issued under the new Off-Road Vehicle Act. The ORV Act replaces the 40-year-old Motor Vehicle (All Terrain) Act with a modern management structure that better aligns with all current regulatory regimes. It provides specific rules governing British Columbia’s growing off-road sector to ensure these vehicles are driven in a safe and environmentally responsible manner. In addition, it will help enforcement officers track stolen off-road vehicles. The registration system opened in November 2014, and one year later, registration became mandatory. Registration costs a one-time fee of $48. A ticket for using an unregistered off-road vehicle on Crown land is $230.

A Pollution Abatement Order was issued after a mudslide in January 2016 resulted in the unauthorized discharge of overburden material. The overburden material originated from the waste rock storage area at the Copper Mountain Mine site and entered a fish bearing stream named Wolfe Creek. This order requires the company to clean up and restore the site, take management actions to prevent any further discharge of overburden into the creek, and submit a final report when the work is completed.

A Water Act Order was amended to extend the deadline for completing required work in Langley. The original order was issued in response to a Bertrand Creek being infilled without lawful authority.

A Water Sustainability Act Order was issued in Surrey in response to a stream being modified without lawful authority. This order requires the preparation and implementation of a sediment and erosion control plan.

A Water Sustainability Act Order was issued in Langley in response to a stream, which is a tributary ofthe Salmon River, being infilled without lawful authority. This order authorizes the stream restoration.
