FamilyLawyerThis week I was in court again with a business

person who hates the legal system. The judges are rotten. The barristers are all stupid, and whilst I am a nice person they would do it all better. Which begs the question, why bother to instruct me at all, why not just handle their own divorce and financial settlement?

This made me ponder the value of a specialist family lawyer. Of course it costs money, and of course the more you disagree with your other half the higher the cost will be. It also costs quite a bit to go to the dentist, but would you fancy filling your own teeth? What I can offer is knowledge, amassed over a twenty year period. Clients are often in a state of confusion, panic and distress when they first come to see me. I can help them form a clearer picture very quickly. Whilst every case is different there are regular financial themes that occur. I know the relevant case law and what the likely outcome would be if the matter were to be heard by a judge. I know how to pitch an offer to try to reach a settlement that is workable. I like to think that I can offer creative financial solutions. All of this is what a client needs quickly so that they can move on with their life.

The legal process can be daunting. If a client is running a business that will probably have to be valued. Equally, if it is a new or, clearly not very profitable business then I would try to make sure that precious money was not spent on a valuation. Pensions may need to be

valued and advice given as to Pension Sharing. The correct level of maintenance needs to be agreed. In the long term it may be possible to pay a lump sum in lieu of maintenance, a clean financial break. Presenting a client’s case in the best way is crucial.

A divorce client is often going through one of the worst periods of their life. They can be very stressed. A lot of Emmersons Solicitors business clients are used to being in control of everything. They can therefore become very angry and frustrated if they are on the receiving end of divorce proceedings. However, appearing in court without a family law solicitor could be a disaster. They may be too emotional and quite often too aggressive to a judge. One client recently said that everyone in the court room was too polite to the judge. Luckily for him I had advised him not to speak! Thankfully he fol-lowed my advice and only addressed the judge after an order had been made in his favour. He doesn’t know how lucky he is.

So why instruct a solicitor?

Knowledge of the law, the procedure, the likely outcome. An ability to negotiate on your be-half, to be your voice, to protect you from your angry self, and to guide you through the legal process. Or you could borrow my pliers and take your own teeth out!

sprint rather than a marathon. To be fair, there will some of you out there who are well on the way to actually achieving the goals you set yourself as Big Ben chimed in the New Year and Auld Lang Syne was in full in voice. Please take the deserved plaudits. You are doing well.

For the majority who have already fallen at the first hurdle and failed miserably the best resolu-tion is probably to make no resolutions at all next time round. This means the self-inflicted pres-sure is lifted and we have more time and space to do what we want, when we want and if we want.

Now then, where did I put those running shoes?

Yes, it is that time of year when we prob-ably all made a long list of New Year resolu-tions and already most of them have been broken. Don’t worry, you are not alone, very few of us who actually make such commitments actually see them through.

No doubt you talked about getting into shape, getting down to the gym or the lo-cal swimming pool, or maybe deciding to cut down on the old alcohol intake, less chocolate or even giving up smoking.

Or what about taking up a new hobby, chang-ing job or even being a little bit more or-ganised. The list is almost endless. But with the festivities just out the way there is lit-tle chance you have stuck to any of them.

Well, maybe the road to resolution was paved with good intention in those early days as you put the goodies back in the cupboard, gave the pub a miss and sneaked off for the odd couple of lengths at the leisure centre. Even the bicy-cle was probably dusted down and pumped up for a solitary outing. But has all this continued?

For the vast majority the answer will be a resounding negative as willpower has suc-cumbed to temptation and you have already slipped back into the old habits. Well, at least you made a token gesture and actually made some resolutions for 2013 and made a start.

But a start is about as far as most of us get. The finish line is never crossed as those new proposed lifestyle changes prove to be a quick

Why Advertise with RUYS ? I havebeen advertising with this magazine for over three years now. Like all businesses we have struggled due to the recession. This year I had to be ruthless and cut out a lot of our advertising. As a business we monitor all new customers to find out how they heard about us.

We have advertised online, in glossy magazines, newspapers and with Yellow Pages. We realized that none of the newspapers or glossy magazines were working for us. However, we obtain business every week from our advertising in RUYS.
