Pursuant to Article 49 paragraph 3 of the Law on Utility Activities (OGM 55/16) and Article 12 paragraph 2 item 1 of the Statute of the Energy Regulatory Agency (OGM 36/17), the Board of the Agency at its session held on 19 October 2018 adopted the RULES ON THE BENCHMARKING OF BUSINESS OPERATIONS AND PERFORMANCE INDICATORS OF THE PROVIDERS OF REGULATED UTILITY SERVICES I. BASIC PROVISIONS Subject Article 1 (1) These Rules shall set out in details the performance indicators of providers of regulated utility services (hereinafter referred to as Provider), the data delivery methodology, the data and indicator processing and evaluation methodology and other matters of significance for performance indicator setting and comparing (benchmarking). (2) Regulated utilities shall be public water supply and urban waste water management. Definitions Article 2 (1) The terms used in these Rules shall mean as follows: 1) indicator is a value obtained from a mathematical relation between two or more performance data of the Provider; 2) index is a value obtained from a mathematical relation between several key performance indicators of the Provider; 3) individual index is an efficiency indicator of the Provider's performance on the level of the individual regulated utility service they provide, as well as on the level of all regulated utility services provided by the Provider; 4) local index is an efficiency indicator of the sector of regulated utility services on the level of a local self-government unit; 5) national index is an efficiency indicator of the sector of regulated utility services on the level of Montenegro; 6) weighting factor is a coefficient that defines the relevance of a key indicator in calculating separate indexes used for calculation of the Provider’s performance individual indexes and local indexes; 7) regulatory scale is a range of values used for evaluation of key indicators; 8) primary treatment is the treatment of urban waste waters by a physical and/or chemical process involving settlement of suspended solids or other processes in which the five-day biochemical oxygen demand (hereinafter referred to as BOD5) of incoming waste water is reduced by at least 20% before discharge, and the total suspended solids of the incoming waste water are reduced by at least 50 %; 9) secondary treatment is the treatment of urban waste waters by a process generally involving biological treatment with a secondary settlement or other process pursuant to the law; 10) tertiary treatment is the treatment of waste water by a process where phosphorus is additionally removed by 80% and/or nitrogen by 70-80%; 11) 1 PE (population equivalent) is organic biodegradable load having a five-day biochemical oxygen demand of 60 grams of oxygen per day. (2) Other terms used in these Rules shall have the meaning attributed to them in the Law on Utility Activities.

RULES ON THE BENCHMARKING OF BUSINESS OPERATIONS AND PERFORMANCE

INDICATORS OF THE PROVIDERS OF REGULATED UTILITY SERVICES

I. BASIC PROVISIONS

Subject

Article 1

(1) These Rules shall set out in details the performance indicators of providers of regulated

utility services (hereinafter referred to as Provider), the data delivery methodology, the data and

indicator processing and evaluation methodology and other matters of significance for performance

indicator setting and comparing (benchmarking).

(2) Regulated utilities shall be public water supply and urban waste water management.

Definitions

Article 2

(1) The terms used in these Rules shall mean as follows: 1) indicator is a value obtained from a mathematical relation between two or more

performance data of the Provider; 2) index is a value obtained from a mathematical relation between several key performance

indicators of the Provider; 3) individual index is an efficiency indicator of the Provider's performance on the level of the

individual regulated utility service they provide, as well as on the level of all regulated utility services provided by the Provider;

4) local index is an efficiency indicator of the sector of regulated utility services on the level of a local self-government unit;

5) national index is an efficiency indicator of the sector of regulated utility services on the level of Montenegro;

6) weighting factor is a coefficient that defines the relevance of a key indicator in calculating separate indexes used for calculation of the Provider’s performance individual indexes and local indexes;

7) regulatory scale is a range of values used for evaluation of key indicators; 8) primary treatment is the treatment of urban waste waters by a physical and/or chemical

process involving settlement of suspended solids or other processes in which the five-day biochemical oxygen demand (hereinafter referred to as BOD5) of incoming waste water is reduced by at least 20% before discharge, and the total suspended solids of the incoming waste water are reduced by at least 50 %;

9) secondary treatment is the treatment of urban waste waters by a process generally involving biological treatment with a secondary settlement or other process pursuant to the law;

10) tertiary treatment is the treatment of waste water by a process where phosphorus is additionally removed by 80% and/or nitrogen by 70-80%;

11) 1 PE (population equivalent) is organic biodegradable load having a five-day biochemical oxygen demand of 60 grams of oxygen per day.

(2) Other terms used in these Rules shall have the meaning attributed to them in the Law on Utility Activities.

Gender sensitivity

Article 3

The terms used in these Rules for physical persons in masculine gender shall imply the same

terms in feminine gender.

Indicator benchmarking levels

Article 4

(1) The Energy Regulatory Agency (hereinafter referred to as Agency) shall carry out the benchmarking of Providers' performance indicators for the services of:

1) public water supply; 2) urban waste water collection and discharge, and 3) urban waste water treatment. (2) In accordance with these Rules, the Agency shall evaluate and compare performance

indicators of each Provider individually for the purpose of reviewing the efficiency of their

performance, the sustainability and quality of services that a Provider provides through regulated

utility services, as well as other indicators that are to reflect the sustainability and quality of services

on the local and national levels.

Benchmarking objectives

Article 5

These Rules are aimed to facilitate:

1) creating of a database required for calculating, evaluating and comparing of Providers' performance indicators as well as reviewing of sustainability and quality of services referred to in Article 4 paragraph 1 of these Rules, and

2) identification of operational segments that require improvement of Providers' performance or the conditions under which the Providers operate.

II. DATA DELIVERY METHOD

Data delivery method

Article 6

(1) Providers shall collect the performance data listed in Schedule 1 that makes an integrated part of these Rules (hereinafter referred to as: data) on monthly basis.

(2) Providers shall deliver to the Agency the data referred to in paragraph 1 of this Article quarterly, but not later than 15 days before the expiry of the previous quarter.

(3) Where the data from the Provider's financial report for the previous year differs from the data provided to the Agency for that year, the Provider shall inform the Agency thereof and submit updated financial data not later than 30 April of the current year for the previous year.

(4) In addition to the data referred to in paragraph 1 of this Article, the Provider shall submit other data and documents on request by the Agency.

(5) Providers shall submit to the Agency the data in hard copy signed by the Provider's authorised person,

(6) and in electronic form. (7) Where the Agency identifies errors or ambiguities in the delivered data, it shall demand the

Provider to correct, supplement or clarify the data.

Assessment of data reliability

Article 7

(1) Providers shall deliver the Agency the data reliability assessment on the occasion of delivering the data inclusive of the fourth quarter.

(2) Data reliability shall be assessed in the way that:

1) reliable data scores 1; 2) unreliable data scores 2.

(3) Providers shall assess data reliability based on the documents available. (4) Providers shall provide the documents used for the assessment of the data reliability, unless

such documents have been provided in the procedure of filing a request to the Agency to issue consent on the proposed tariffs for carrying out regulated utility activities.

Benchmarking coordinator

Article 8

Providers shall submit to the Agency the data (first name, last name, email address, contact

telephone and the like) on the person designated to be submitted the data and documents on the

Provider's performance (Benchmarking Coordinator).

Annual report on the performance indicators benchmarking

Article 9

(1) Annual reports on Providers' performance indicator benchmarking (hereinafter referred to as Annual Report) shall be drawn up by the Agency no later than 31 October of the current for the previous year.

(2) Annual Reports shall include but not be limited to the data on the benchmarking of Providers' key performance indicators (hereinafter referred to as Key Indicators) and Providers' performance indexes calculated based on them, local indexes and the national index.

(3) The Agency shall publish the Annual Reports on its website.

III. DATA AND INDICATOR PROCESSING AND EVALUATION METHODOLOGY

Key Indicators

Article 10

(1) Key Indicators shall be set for each service referred to in Article 4 paragraph 1 of these Rules individually.

(2) Key Indicators for public water supply services shall be: 1) water delivery continuity; 2) degree of water quality compliance with special regulations; 3) degree of coverage of the people served with water supply through connections to the public

water supply system; 4) degree of non-revenue water; 5) degree of coverage of consumers by special metering devices (water meters); 6) number of breakdowns per km of water supply network. (3) Key indicators for the service of urban waste water collection and discharge shall be: 1) degree of coverage of the people served by the service of urban waste water collection and

discharge through connections to the public sewerage system; 2) degree of urban waste water subjected to secondary or tertiary treatment; 3) degree of inspected sewerage network; 4) number of blockages per km of sewerage network. (4) Key indicators for the service of urban waste water treatment shall be: 1) degree of compliance of the quality of treated urban waste water discharged from the urban

waste water treatment plant (hereinafter referred to as effluent); 2) degree of secondary treatment of urban waste waters; 3) degree of coverage by the service of urban waste water treatment. (5) Key indicators relating to all the services referred to in paragraphs 2, 3 and 4 of this Article

shall be: 1) degree of collection; 2) total number of staff per 1000 of consumers; 3) degree of coverage of operating expenses by operating revenues (excluding depreciation);

4) number of complaints per 1000 consumers. (6) The value of key indicators shall be obtained from the mathematical relation between two or

more performance data of the Provider, and they shall be used for calculation of the Provider's performance indexes, the local and national indexes.

(7) The calculation method for the key indicators referred to in paragraphs 2 to 5 of this Article is given in Schedule 2 that makes an integrated part of these Rules.

Other performance indicators

Article 11

(1) In addition to the key indicators referred to in Article 10 of these Rules, based on the data that the Agency gathers from the Providers, it may calculate and compare Providers' other performance indicators.

(2) The calculation method for other performance indicators is given in Schedule 2 of these Rules.

Evaluation of key performance indicators

Article 12

(1) Key indicators shall be evaluated based on the regulatory scale referred to in Article 13 of these Rules.

(2) After the evaluation completed in accordance with paragraph 1 of this Article, the key indicators shall be evaluated based on the data reliability assessment in accordance with Article 14 of these Rules.

Evaluation based on the regulatory scale

Article 13

(1) Evaluation of key indicators based on the regulatory scale shall be carried out in line with the lower and upper limits of the regulatory scale, which are established in Schedule 3 of these Rules.

(2) The lower limit of the regulatory scale referred to in paragraph 1 of this Article shall be undesirable value of the key indicator.

(3) The upper limit of the regulatory scale referred to in paragraph 1 of this Article shall be the desirable value of the key indicator.

(4) Where higher numerical value of an indicator indicates the Provider's inefficient performance, the lower limit of the regulatory scale has value higher than the upper limit of the regulatory scale.

(5) The key indicator with numerical value below the lower limit that that has value lower than the upper limit of the regulatory scale shall score 0.

(6) The key indicator with numerical value above the lower limit, where the lower limit has the value higher than the upper limit, shall score 0.

(7) Where lower numerical value of an indicator indicates the Provider's efficient performance, the upper limit of the regulatory scale has value lower than the lower limit of the regulatory scale.

(8) The key indicator with numerical value above the upper limit, where upper limit has value higher than the lower limit of the regulatory scale, shall score 100.

(9) The key indicator with numerical value below the upper limit, where the upper limit has value lower than the lower limit of the regulatory scale, shall score 100.

(10) The key indicator with numerical value between the prescribed lower limit of the regulatory scale and the upper limit of the regulatory scale shall score a number between 0 and 100.

Evaluation of key indicators based on data reliability assessment

Article 14

Evaluation of key indicators based on data reliability assessment shall be carried out:

1) by dividing the indicator by 1, if all the data for calculation of that indicator has scored 1 in accordance with Article 7 paragraph 2 item 1 of these Rules;

2) by dividing the indicator by number 2, if at least one datum for calculation of that indicator has scored 2 in accordance with Article 7 paragraph 2 item 2 of these Rules;

3) by dividing the indicator by number 4, if all the data for calculation of that indicator has scored 2 in accordance with Article 7 paragraph 2 item 2 of these Rules.

Individual index of the Provider's performance

Article 15

(1) Individual index shall be calculated individually for each service referred to in Article 4 paragraph 1 of these Rules and jointly for all those services.

(2) Individual index shall be a sum of separate indexes, which are determined for the services referred to in Article 4 paragraph 1 of these Rules, with maximum value 100/100.

(3) The separate indexes referred to in paragraph 2 of this Article shall be calculated based on evaluated key indicators as follows:

1) public water supply separate index shall be obtained by summing the values of evaluated key indicators for the public water supply service multiplied by weighting factors of key indicators, save the indicator of the coverage degree of that service;

2) separate index for urban waste water collection and discharge shall be obtained by summing the values of evaluated key performance indicators for the service of urban waste water collection and discharge multiplied by weighting factors of key indicators, save the indicator of coverage by that service and the indicator of the degree of urban waste waters sent for secondary or tertiary treatment;

3) separate index of urban waste water treatment shall be obtained by summing the values of evaluated key indicators for the service of urban waste water treatment multiplied by weighting factors of key indicators, save the indicator of the degree of secondary treatment of urban waste waters and indicator of coverage by the service of urban waste water treatment;

4) separate index related to all services referred to in Article 4 paragraph 1 of these Rules that the Provider provides shall be obtained by summing the values of evaluated key indicators of such services multiplied by weighting factors of key indicators.

(4) Individual index shall be presented in the form of a fraction of two numbers, with maximum value 400/400, where:

1) denominator is 200, if the Provider provides one service, or 300 or 400 if the Provider provides two or three services referred to in Article 4 paragraph 1 of these Rules,

2) numerator is the sum of the values of separate indexes referred to in paragraph 3 of this Article and may not exceed the denominator referred to in item 1 of this paragraph.

(5) by dividing the numerator by the denominator referred to in paragraph 4 of this Article obtained shall be the final individual index of the Provider's performance, which shall be a number that is lower than 1 or ideally equal to 1.

Weighting factors of key indicators

Article 16

(1) Weighting factors of key indicators shall be allocated to each key indicator in the calculation of separate indexes used for calculation of individual indicators of the Provider’s performance and local indexes, and their value shall depend on the significance of such key indicator for the evaluation of the Provider’s performance efficiency and the quality of services provided by the Provider through a regulated utility activity, as well as the maintenance and quality of services in the sector of public water supply and urban waste water management.

(2) The sum of all weighting factors for calculation of individual and local indexes shall be 1. (3) Weighting factors of key indicators are given in Schedule 3 of these Rules.

Local index

Article 17

(1) Local indexes shall be calculated separately for each service referred to in Article 4 paragraph 1 of these Rules provided by the Provider and jointly for all those services.

(2) Local index shall be a sum of separate indexes that are set for the services referred to in paragraph 1 of this Article, with maximum value 100/100, as follows:

1) local separate index for the service of public water supply shall be obtained by summing the values of evaluated key indicators for the service of public water supply multiplied by weighting factors of key indicators for that service;

2) local separate index for the service of urban waste water collection and discharge shall be obtained by summing the values of evaluated key indicators for the service of urban waste water collection and discharge multiplied by weighting factors of key indicators for that service;

3) local separate index for the service of urban waste water treatment shall be obtained by summing the values of evaluated key indicators for the service of urban waste water treatment multiplied by weighting factors of key indicators for that service;

4) local separate index relating to all services referred to in Article 4 paragraph 1 of these Rules shall be obtained by summing the values of evaluated key indicators for such services multiplied by weighting factors of key indicators for those services.

(3) Local index shall be presented in the form of a fraction of two numbers, with maximum value 400/400, where:

1) denominator is 400; 2) numerator is the sum of the values of local separate indexes referred to in paragraph 2 of

this Article and may not be higher than the denominator referred to in item 1 of this paragraph. (4) By dividing the numerator by the denominator referred to in paragraph 3 of this Article,

obtained shall be the final local index which represents a number less than 1 and in ideal scenario it equals to number 1.

National index

Article 18

(1) National index shall be calculated jointly for all the services referred to in Article 4 paragraph 1 of these Rules, in the way that when calculating it local indexes and the share of Providers in the sale of water are taken into account.

(2) The share of Providers in the sale of water referred to in paragraph 1 of this Article shall be set based on the Provider’s share of billed water in the total billed water of all Providers in Montenegro.

(3) The data on the billed water referred to in paragraph 2 of this Article shall be taken for the year to which the Annual Report referred to in Article 9 of these Rules is related.

(4) National index shall be set for the services referred to in Article 4 paragraph 1 of these Rules, with maximum individual value 100/100, i.e.:

1) national index for the service of public water supply; 2) national index for the service of urban waste water collection and discharge; 3) national index for the service of urban waste water treatment; 4) national index relating to all services referred to in items 1 to 3 of this paragraph. (5) The index referred to in paragraph 1 of this Article shall be presented in the form of a

fraction of two numbers, with maximum value 400/400, where: 1) denominator is 400; 2) numerator is the sum of the values of separate indexes referred to in paragraph 4 of this

Article and may not be higher than the denominator referred to in item 1 of this paragraph. (6) By dividing the numerator by the denominator referred to in paragraph 5 of this Article,

obtained shall be the national index which represents a number lower than 1 and in ideal scenario it shall equal to number 1.

Data check

Article 19

Based on the available documents the Agency shall check the data provided in accordance with

these Rules as well as the assessment of their reliability.

Schedules

Article 20

The Schedules 1 to 3 to these Rules shall be published only in electronic edition of the Official

Gazette of Montenegro.

IV. TRANSITIONAL AND FINAL PROVISION

Data delivery and report drawing up

Article 21

(1) The Providers shall deliver to the Agency the data referred to in Article 6 of these Rules for 2015, 2016 and 2017 no later than 1 March 2019.

(2) The Providers shall deliver to the Agency the data referred to in Article 6 of these Rules for 2018 by 30 April 2019.

(3) The Annual Report referred to in Article 9 of these Rules for 2018 shall also include the data referred to in paragraph 1 of this Article.

Entry into force

Article 22

These Rules shall enter into force on the eighth day following their publication in the Official

Gazette of Montenegro.

Secondary water supply network (distribution pipeline) is a pipeline or a group of pipelines connecting the primary network with tertiary network.
