1.ParticipationintheCompetition1.1Registration

Overseasteamsmayparticipate intheCompetitionbymakinganapplicationtotheOrganisersviae-mailtodmh.glc@gmail.comorbypostatthefollowingaddress:

The organisers shall invite ONLY those Indian Universities/Colleges (refer toAnnexureI),whichhadqualifiedtotheQuarterFinalRoundsinthe18thD.M.HarishMemorial Government Law College International Moot Court Competition toparticipateinthecompetition.

1.3ParticipationintheMemorialRound

1.3.1IndianUniversitieswhosenamesarenotincludedinAnnexure1canparticipatein the Memorial Round. Ten (10) additional Indian Universities/Colleges shall beselected from these to participate in the competition based on the Memorialsubmitted by them on or before 11:59 p.m. [Indian Standard Time] on 12thNovember,2017.MorethanelevenIndianUniversities/Collegesmaybeselectedatthesolediscretionoftheorganisers.TheMemorialssubmittedmustbeinaccordancewithclause5.1.1.3.2 The IndianUniversities/Colleges applying through theMemorial RoundmustsubmittheirRegistrationformby5thOctober,20171.3.3 IndianUniversities/Colleges selected in accordancewithClause1.3.1 shall benotified on12th December, 2017 if they have been selected to participate in theCompetition.1.3.4Teamsselectedinthismannershallhavetheopportunitytoimproveupontheirsubmitted Memorials and submit a final soft copy for adjudication along with theotherteamsonorbefore2ndJanuary,2017(11:59p.m.IST)andafinalhardcopyon6thJanuary,2017(12:00p.m.IST)inaccordancewithRule5.


1.4RegistrationFee

1.4.1AnominalregistrationfeeofINR5000shallbechargedtoalltheInvitedIndianUniversities/Colleges and Indian Universities/Colleges that have been selectedthroughtheMemorialRound.AregistrationfeeofUSD150willbechargedtoalltheOverseasUniversities.Noregistration fee shallbe charged to IndianUniversities/Colleges thathaveappliedbuthavenotbeenselectedinaccordancewithclause1.3.1.4.2 For the purpose of clause 1.4.1 Overseas Universities will include allUniversities/Colleges/SchoolsthatarenotsituatedinIndia.1.4.3 The Registration fee charged in accordance with clause 1.4.1 for IndianUniversities/CollegesmustbesubmittedbyaDemandDraft/Bankers’Draftdrawninfavourof“D.M.HarishFoundation”payableat“Mumbai,India”.1.4.4TheRegistrationfeechargedforOverseasUniversities/Colleges,inaccordancewithclause1.4.1,mustbesubmittedbyWireTransfer.Thedetailsaregivenbelow:

2.General2.1Eligibility

Students enrolled in a full-time or part-time law programme at the time of thecompetitionareeligibletocompeteintheCompetition.EachCollege/LawSchoolorUniversitymayenteroneteamONLY.

2.2TeamComposition

2.2.1.Eachteamshallcompriseaminimumoftwo(2)membersconsistingoftwo(2)speakersandamaximumof three (3)membersconsistingof two(2)speakersandone(1)researcher.2.2.2.Certificationshallnotbeawardedtoafourthmember.


2.3OfficialLanguageTheofficiallanguageoftheCompetitionisEnglish.AllCompetitionRoundsincludingthewrittensubmissions(memorials)willbeinEnglish.

2.4Accommodation

2.4.1 Accommodation will be provided to all participants on the days of thecompetitionONLYi.e.:9th,10thand11thofFebruary,2018.2.4.2Teams,whichintendtoarriveearlier,arerequestedtoinformtheorganisersinadvancesothatrequisitearrangementsmaybemadeforthesame.Extrachargeswillhavetobeincurredbytheteamforadditionaldaysofstay.2.4.3Accommodationshallnotbeprovidedtoafourthmember.2.4.4NoaccommodationwillbeprovidedtoteamsfromCollegesinMumbai.

2.5Registration

2.5.1ThedulycompletedRegistrationformwithallteamdetailsmustbesubmittedonlineorsenttotheGovernmentLawCollegeonorbefore20thNovember,2017forteamsparticipatinginaccordancewithclause1.1and1.2andby5thOctober,2017forteamsparticipatinginaccordancewithclause1.3.Nochangeinthenamesoftheparticipants shallbepermittedafter the receiptof theRegistrationForm,exceptatthesolediscretionoftheOrganisers.2.5.2.Allteamsshallbegivena‘‘TeamCode’’bytheOrganisersonvalidationoftheirRegistrationFormandDemandDraft/Bankers’Draft/WireTransfer.2.5.3.Theteamsshallusetheirdesignated“TeamCode”forallcorrespondencewiththeOrganizers.2.5.4. The same team code must be used by the teams during the submission ofMemorialsandduringalltheRoundsoftheCompetition.

2.6DressCode

ThedresscodefortheroundsofthecompetitionshallbeasprescribedbytheRulesof theCourt of Jurisdiction. Thedress code for all the functions at the competitionshallbewesternformalsforgentlemenandwesternorIndianformalsforladies.


3.RequestsforInterpretationoftheCaseStudyandRules3.1Allrequestsforinterpretationofthecasestudyandrulesofthecompetitionmustbedirected to the “General Secretary, Moot Court Association”. Such requests forinterpretationmustbesentviae-mail [email protected] thee-mailmustread“RequestforInterpretation”.3.2Thedeadlineforrequestsfor interpretationofthecasestudy(clarifications)fortheteamsparticipatinginthememorialroundwillbe20thOctober,2017.3.3Thedeadlineforrequestsfor interpretationofthecasestudy(clarifications)fortheIndian/InternationalteamslistedinAnnexure1,willbe19thNovember,2017.

4.CompetitionRoundsThe competition shall be held over a period of three days and will comprise two (2)PreliminaryRounds,(1)Quarter-FinalRound,one(1)Semi-FinalRoundandone(1)FinalRoundofArguments.4.1PreliminaryRounds

4.1.1Therewillbe two(2)PreliminaryRoundsandeach teamshallargue forboththesides(ApplicantsandRespondent).4.1.2A teamshallbecreditedwithawin in thePreliminaryRounds if theirRoundTotal(asdefinedinClause8.2)isgreaterthantheopposingteam.4.1.3. In caseofa tie in thePreliminaryRound, the teamwith thehigherMemorialScorewilladvancetotheOcto-FinalRound.4.1.4Thetopeight(8)teamsinthePreliminaryRoundsshalladvancetotheQuarter-FinalRound.

4.2Quarter-FinalRoundThetopEight(8)teamsinthePreliminaryRoundsshallqualifytotheQuarter-FinalRound(Roundof8).Thefollowingshallbethesystemfordeterminingtheteamsthatadvance to the Quarter-Final Round, and for the preparation of the Quarter-FinalSeedingChart:


4.2.1 Teams that have a 2:0 win loss ratio in the Preliminary Rounds shalldirectly advance to the Quarter-Final Round. Such teams shall be seededaccordingtotheirPreliminaryRoundTotalasdefinedinclause8.3.4.2.2 Teams that have 1:1 win loss ratio shall advance based on theirPreliminary Round Total. They shall be seeded after the teams qualifyingthroughwitha2:0win loss ratio in thePreliminaryRounds, inorderof theirRoundTotal.4.2.3 The team seeded first in theQuarter-Final Seeding Chartwill be pairedwiththeteamseededeighthintheSeedingChart(Seed1vs.Seed8),theteamseeded second in the Seeding Chart will be paired opposite the team seededseventhintheSeedingChart(Seed2vs.Seed7)andalltheotherteamswillbepairedinthesamemanner.4.2.4TheQuarter-FinalRoundshallconsistofOne(1)MootingSessionandwillbea“Knock-out”RoundwherethewinnerofeachQuarter-FinalRoundpairingwilladvancetotheSemi-FinalRound.

4.2.5 A teamwill be credited with a win in the Quarter-Final Round if theirRoundTotal(asdefinedinClause8.3)isgreaterthantheopposingteam.4.2.6 In case of a tie in the Quarter-Final Round pairing, the team with thehigherMemorialScorewilladvancetotheSemi-FinalRound.4.2.7 In case a tie persists even after the application of Clause4.2.6 the teamwith a higher score in the Preliminary Roundwill advance to the Semi-FinalRound.

4.4Semi-FinalRound4.4.1TheSemi-FinalRoundwillconsistofOne(1)MootingSessionandwillalsobea“Knock-out”RoundwherethewinnerofeachSemi-FinalRoundpairingwilladvancetotheFinalRound.4.4.2AteamwillbecreditedwithawinintheSemi-FinalroundiftheirRoundTotal(asdefinedinClause8.3)isgreaterthantheopposingteam.4.4.3 In case of a tie in the Semi-Final Round pairing, the team with the HigherMemorialRoundscorewilladvancetotheFinalRound.


4.4.4Incaseatiepersistsevenaftertheapplicationofclause4.4.3theteamwithahigheraveragescoreoftheQuarter-FinalRoundandPreliminaryRound(allpreviousrounds)willadvancetotheFinalRound.

5.Memorials5.1FormatSpecifications

AllteamsmustsubmitMemorials/WrittenSubmissionsforbothsides(Applicants&Respondent)andtheMemorialsmustfulfilallthefollowingspecifications:5.1.1Memorialsmustcontainthefollowing:

i. TableofContentsii. IndexofAuthoritiesiii. StatementofJurisdictioniv. StatementofFactsv. QuestionsPresentedvi. SummaryofArgumentsvii. BodyofArgumentsviii. Conclusion/Prayer.

5.1.2 The Memorial shall not be more than forty (40) pages, including Body ofArguments,whichshallnotbemorethantwenty(25)pages.

5.1.3TheMemorialshallbeformattedaccordingtothefollowingspecifications:

i. TypedonstandardA4sizepageii. Fonttype:TimesNewRomaniii. Fontsizeforbodytext:12;thetextofthewrittensubmissionmust

haveoneandahalfspacingiv. Font size for footnotes: 10; text of footnotesmaybe single-spaced

howevertwoseparatefootnotesmustbedoublespacedv. Margin:1inchmarginoneachsideoftheA4sizepagevi. Quotationsofsourcesoutsideofthememorialoffiftywordsormore

in any part of thememorial shall be block quoted andmust be initalics.

5.1.4ThefootnotesmustfollowtheBluebookformatofcitation.

5.1.5.TheMemorialmustbeeithersoftboundorspiralbound.Ifnot,thenitcanleadtodeductionofmarks.5.1.6.TheCoverPageoftheMemorialmusthavethefollowingcolourscheme:

5.1.7 The Memorial must not contain any Annexure/Photographs/Sketches/Exhibits/Affidavitsetc.

5.1.8Memorialsthatdonotcomplywiththeabove-mentionedspecificationswillbesubjectedtopenalties.

5.2DeadlineforsubmissionofMemorials

5.2.1Thedeadlineforsubmissionofthesoftcopiesforallteamswillbe2ndJanuary,2017 by 11:59 p.m. (IST). The teams must send a “pdf” file extension, [email protected]:

Memorialforteamcode“mentionteamcode’’Thecontentofthee-mailattachmentshouldnotdifferfromthecontentofthehardcopiessubmittedtotheOrganizers.

5.2.2 The deadline for submission of the hard copies of memorials for all IndianUniversitieswillbe6thJanuary,2017by12p.m.(IST).TheteamsmustsendEight(8)copiesoftheirMemorialforeachsideonorbeforetothefollowingaddress:

5.2.3.Thedeadline forsubmissionofhardcopiesof thememorials forallOverseasTeamswillbe8th January2017by12p.m.(IST). TheteamsmustsendEight(8)copiesoftheirMemorialforeachsidetotheaddressmentionedaboveinClause5.2.2.

5.2.4All teamsarerequiredtocarrywiththemSix(6) copiesof thememorials foreachside,whichhave tobe submitted to theorganisersat the timeof registration.ThecontentoftheseadditionalmemorialsshouldnotdifferfromthecontentofthehardcopiessubmittedtotheOrganisersinaccordancewithclause5.2.1.Failure to comply with the above rule will subject the team to immediatedisqualification.Thecontentinthehardcopyofthememorialshouldnotdifferfromthesoftcopiessubmitted.


5.2.5Participantsareadvised tocarryextracopiesof theirMemorial for theirownuse.

5.3.DeadlineforsubmissionofMemorialsfortheMemorialRound5.3.1 The deadline for submission of soft copies of the Memorials for all IndianUniversitiesapplyingthroughtheMemorialRoundwillbe12thNovember,2017by6:00pm I.S.T.The teamsmust submit two (2) copies for each side to the addressmentioned in clause 5.2.2. The teams must also send an e-mail of the Memorials,whichmustbeofa“pdf”fileextension,[email protected]:

MemorialRound:Memorialforteam“mentionteamcode’’5.3.2 The deadline for submission of hard copies of the Memorials for all IndianUniversitiesapplyingthroughtheMemorialRoundwillbe16thNovember,2017by12:00pmI.S.T.TheteamsmustsubmitEight(8)copiesforeachsidetotheaddressmentionedinclause5.2.2.5.3.3TheIndianTeamsqualifyingthroughtheMemorialRoundwillbedulynotifiedon12thDecember,2017.

5.4Anonymity

Identity of the team or the names of the participantsmust not be revealed in theMemorial inanymannerwhatsoeverandall teamsmust send theMemorialwithacovering letter specifying the name and contact details of the TeamMembers andtheirdesignatedTeamCode.TeamsdisclosingtheiridentitythroughtheMemorialsinanyformwillbesubjecttodisqualification.The name of the institution should not appear on any compendium or submissionthatneedstobesubmittedtothebench.Inthiscase,theteamwillnotbeallowedtosubmitthecompendium.

5.5ExternalAssistance

5.5.1Allresearch,writingandeditingmustbesolelytheproductofTeammembers.No Team shall be allowed to view or otherwise become privy to anyMemorial/WrittenSubmissionother than the respectiveApplicant andRespondentMemorialofthescheduledopposingTeamsinthecourseoftheCompetition.5.5.2 Team members are permitted to discuss with their coach (if any) and withothers affiliated with their College/Law School/University general principles of


international law ONLY. Persons other than the official team members are notpermittedtoresearchontheCase-StudyoftheCompetition.5.5.3 The coach/faculty members/others affiliated with the College/LawSchool/Universitymayprovide general guidanceon the overall organizationof thebrief, but cannot assist with the actual writing and are not permitted to edit theWrittenSubmission/Memorialsorcorrectthecitationformat.5.5.4 Academic guidance beyond that permitted by the Official Rules of theCompetitionwillleadtotheimmediatedisqualificationoftheteam.5.6 The above memorials shall be evaluated in accordance with clause 6.3 of therules.5.7AfterthecompletionoftheCompetition, theOrganisersreservetherighttousetheMemorialssubmittedtothem,astheymaydeemappropriate.

6.MarkingCriteriafortheMemorials6.1TheMemorialswillbejudgedbyaspecialpaneloffourJudges.6.2EveryMemorialwillbemarkedonatotalofHundred(100)marksbyeachofthefour

judges.Two judgeswillevaluate theapplicantsand theother twowillevaluate therespondentmemorials.Theaverage(1/4ththetotal)ofthemarksofall fourjudges,outofamaximumoffourhundred(400)markswillbetakenasthefinalscore.

6.3ThefollowingwillbetheMarkingCriteriaandtheMarksAllocatedtoeachcategory:

7.OralSubmissions7.1Asspecifiedhereinaboveat2.2.1,eachteamshallcompriseoftwospeakerswhoshall

dividetheoralsubmissionsbetweenthemselves.7.2 During the course of the Oral Submissions no speaker shall either reveal his/ her

identityortheidentityoftheirUniversity/Collegebyanymeanswhatsoever.7.3TimeDistribution

7.3.1 Each team will have a maximum of 30 minutes to present their OralSubmissions.Thiswillincludethetimethateachteammaywanttoreservefortheirrejoinder/sur-rejoinderwhichwillbeattheirsolerisk.Teamsmustnotethattheywillnotbegrantedarejoinder/sur-rejoinderasamatterofrightandwilllieatthesolediscretionofthejudges.7.3.2 At the commencement of every session of Oral Submissions each team shallnotify theCourtOfficeras to thedivisionof timebetween the2speakers includingthetimereservedfortheirrejoinder/sur-rejoinder.Amaximumof5minutescanbereservedfortherejoinder/sur-rejoinder.(Rejoinder:Rebuttal)7.3.3 No single speaker will be permitted to address the Court for more than 20minutes. This includes the time the speaker addresses the Court during therejoinder/sur-rejoinder.7.3.4Teamsshallnotsplit the timereserved forarejoinder/sur-rejoinderbetweenthemselves and only one speakerwill be permitted to address the Court during arejoinder/sur-rejoinder.7.3.5Five(5)minutesbefore thecompletionof theallocated time foreachspeakerthere will be a warning bell, and at the completion of the allocated time for eachspeakertherewillbeafinalbell.7.3.6 If any speaker continues to speak after the completion of his/her time, theadditionaltime,whichhe/shespeaksfor,willbedeductedfromthetimeallocatedtohis/herco-speaker,orfromthetimeallocatedfortherejoinderandsur-rejoinder,asthecasemaybe.7.3.7 The final decision as to the time structure and the right to rejoinder/sur-rejoinderwillbethatoftheJudges.


7.4Submissionofadditionalmaterial7.4.1 All teamswill be expected to carry along any case law(s) and authorities towhichtheyintendtorefer.TeamsmustnotethattheywillnotbepermittedtosubmitanymaterialtothejudgesifsuchmaterialbearsthenameorsealoftheirCollege/University.7.4.2 During the course of oral submissions the participants cannot submit to thecourt any material containing pictorial representation whatsoever. Further theparticipantswillnotbepermittedtomakeanyaudio/visualrepresentationnorwillthey be allowed to use personal computers, laptops and any other technical ormechanicaldeviceduringtheiroralsubmissions.7.4.3 If at any instance a submission ismadewith anymaterial in violation of theabove rules and if any picture, sketches, photos, cartoons, caricatures, audio film,videofilm,projector-slideoracomputergeneratedimageissubmittedorpresentedtocourt,theteamsshallbedisqualifiedfromthecompetitionforthwith.

8.MarkingCriteriafortheArguments:8.1PointsAllocation

8.1.1EachSpeakerwillbemarkedonatotalof100marksbyeachBenchJudge.Thefollowingwill be theMarking Criteria and theMarksAllocated to each Speaker byeachJudgeintheRound:

8.1.2ThedecisionofthejudgesastotheMarksallocatedtoanyteamshallbefinal.

8.1.3Soastoensureuniformityinthemarkingsystemallthejudgeswillbeprovidedwithamarkingguideline.

8.2RoundTotalforthePreliminaryRounds

TheRoundTotalforthePreliminaryRoundswillbeanaggregateofthetotalmarksofeachSpeakerbyeachJudge(asindicatedinclause8.1.1)intheRoundandone-fourth(1/4th)oftheTeam’sMemorialMarks(asindicatedinclauses6.2and6.3).

8.3RoundTotalfortheQuarter-Final/Semi-Final/FinalRounds

The Round Total for the Quarter-Final, Semi-Final and Final Round will be anaggregatetotalofthemarksobtainedbyeachspeakerfromeachjudge(asindicatedintable8.1.1).ATeam’sMemorialMarkswillnotbeapartoftheirRoundTotalintheOcto-Final, Quarter-Final, Semi-Final and Final Rounds. However in case of a tie,MemorialScoreswillbeusedasatie-breaker.

9.Researchers’Test

9.1TheResearchers’TestshallbeconductedonDay1oftheCompetition.9.2Thetestshallbeforadurationofsixty(60)minutesonly.9.3 The test shall consist of both objective and subjective questions based on General

PrinciplesofInternationalLawandthecasestudy(Compromis)9.4Ifateamcomprisesofthree(3)members,thenONLYtheResearcheriseligibletotake

thetest.

10.Awards10.1ARollingTrophyandacashprizeofRs.36,000/- for theBestTeamandaRolling

TrophyandacashprizeofRs.27,000/-forthe2ndBestTeam.10.2Anawardand cashprizeofRs15,000/- for theBestMemorial andan awardand

cashprizeofRs.12,000/-fortheRunner-upMemorial.10.3Anawardand cashprizeofRs. 14,000/- for theBest Speaker, anawardand cash

prizeofRs.10,000/- for the2ndBestSpeakerandanawardandcashprizeofRs.14,000/-fortheBestSpeakerintheFinalRoundofArguments.


TheBestSpeakerandRunnerupSpeakerAwardswillbedeterminedbythehighestaggregatescoreofallroundsthatthecontestanthasargueddividedbythenumberof rounds, whereas the Best Speaker in the Final Round of Arguments will bedetermined on the basis of the Individual speaker scores in the Final Round ofArguments.

10.4AnawardandcashPrizeofRs.12,000/-fortheBestResearcher,andanawardand

cashprizeofRs.10,000/-forthe2ndBestResearcher.10.5Allparticipantswill getCertificatesofParticipationandall thewinnersof awards

specifiedin10.1to10.4willgetCertificatesofMerit.

11.Miscellaneous11.1Scouting

Nomemberofanyteamwillbepermittedtoheartheargumentsinanycourtroominwhichthatteamisnotoneofthecontestingteamswhilstthatteamisstillinthecompetition. The Organisers shall take strict action, including expulsion from thecompetition, against any team found to be scouting through a team member orthroughanyothermeans.

11.2Organisers’Extra-OrdinaryPower

11.2.1 All Participants are expected tomaintain decorum in the Court during thecompetitionandareexpectedtoconductthemselvesinamannerbefittingthelegalprofession. The Organisers reserve the right to take appropriate action for anyunethical,unprofessionalandimmoralconduct.11.2.2TheOrganisersdecisionas regards the interpretationof rulesoranyothermatterrelatedtothecompetitionwillbefinalandbinding.11.2.3Ifthereisanysituationwhichisnotcontemplatedintherules,theOrganisersdecisiononthesameshallbefinalandbinding.11.3.4TheOrganisersreserve theright tovary,alter,modify,orrepealanyof theabove rules without any prior notification, if so required and as theymay deemappropriate.
