Welcome to the Benchmark OptionsHome Insurance Policy and thank you forarranging your insurance with us. YourHome Insurance is underwritten by RSAInsurance Ireland Ltd.

Please check your Statement of Fact ProposalForm to ensure that the details contained onit are accurate as this document forms thebasis of the insurance contract. Youracceptance of this policy indicates youragreement that the details contained on theproposal form are accurate.

If the schedule details do not agree with thedetails completed on your Statement ofFact Proposal Form, or if the details on theproposal form are incorrect, then pleasereturn them immediately with a note of thechanges that should be made.

Please also read this Policy carefully toensure that it provides the cover yourequire. Your policy schedule sets out whichsections of cover you have purchased andyour sums insured. Please examine thispolicy, your schedule and any endorsementpages to make sure that they give youprotection according to your present needs.Our policy comes with three levels of coverdescribed as Basic, Standard and Deluxe.Your schedule will indicate which coveroption you have selected.

DUTY OF DISCLOSUREYou should advise immediately if the use ofyour home changes, such as it becoming letout to tenants, used as a holiday home,becoming unoccupied or being used for anybusiness purpose. You should also adviseimmediately if the nature of your homechanges in a way that might affect ourattitude to the cover provided – forexample during the building of an extension.If you are in any doubt as to whether achange is material, please notify it.

The reinstatement value of your Buildingsshown in the Schedule will be adjusted ateach renewal to reflect increased rebuildingcosts. You should satisfy Yourself that thisvalue is adequate to cover the fullrebuilding cost of the entire Buildings,including the cost of professional fees andsite clearance. If the sums insured areinadequate, it may affect the settlement ofany claims you may submit under the policy.We may at any time, on the advice of asurveyor or loss adjustor, amend the sumsinsured so that they represent the truevalues at risk.

This Policy, which includes and shall be readas one document with the Schedule,Endorsements, Proposal Form andStatement of Facts Declaration, evidences acontract of insurance between you andRSA Insurance Ireland Ltd.

Provided you have paid or agreed to paythe premium RSA Insurance Ireland Ltd. will,subject to the terms, conditions, limitationsand exclusions of this Policy provide theinsurance as described in the followingpages for those sections of the policy youhave chosen.

INSURERAll monies which become or may becomedue under this Policy will in accordancewith Section 93 of the Insurance Act 1936be payable and paid in the Republic ofIreland in Euros unless we specifically sayotherwise.Premiums are subject to Government Levyand/or contribution where applicable.

Stamp Duty has been or will be paid inaccordance with Section 5 of the StampDuties Consolidation Act 1999 (asamended).

CONTRACT LAWThe parties to a contract of insurancecovering a risk situated in the Republic ofIreland are permitted to choose the lawapplicable to the contract.This insurancecontract will be governed by Irish Law.

Communications between you and usabout this Policy will be in English.

The insurer that you have entered into acontract with is RSA Insurance IrelandLimited.

Where Benchmark Underwriting Ltd. issuesLegal Expenses cover in association withthis Home Insurance, a separate wordingwill be issued. Any such cover provided willapply only for as long as this HomeInsurance remains in force. Details of theinsurer with which the contract will beconcluded will be clearly stated on thePolicy Schedule.

DEFINITIONSAny word or expression, which is given a specific meaning in this Policy, will have the samemeaning wherever it appears.

The Insured/You: The person(s) named on the Schedule as the Insured.

We/Us/The Company: RSA Insurance Ireland Ltd.

Buildings The Buildings is made up of two parts namely:

(a) the Private House (which includes garages with direct access fromthe Private House) including fixtures and fittings therein andthereon, occupied for residential purposes only, built with brick,stone or concrete and roofed substantially with slates, tiles, or otherincombustible materials and,

(b) domestic outbuildings, detached garages, swimming pools, tenniscourts, including fixtures and fittings therein and thereon, fuelstorage tanks and their contents, terraces patios, driveways,footpaths, walls, gates and fences, lawns, hedges, trees, shrubsand plants

all situate as stated in the Schedule on a site not exceeding two acres in area.

Contents Household goods, including tenants' fixtures and fittings, and personaleffects belonging to you (or for which you are legally responsible) orbelonging to members of your household and domestic employeespermanently residing with You, all in the private house and domesticoutbuildings.

Overall limit for contents of locked domestic outbuildings (other thanContents of secured garages built of standard construction) is €3,000 inany one period of insurance.

Money is included up to a maximum of €500.

Any one High Value Item is covered for not more than 5% of the ContentsSum Insured or €7,500 (whichever is the higher) and the total of theseitems is covered for not more than 33% of the Contents sum insuredunless details have been advised to us and are listed on the Schedule.

Your Contents Sum Insured includes an amount of €3,000 in any onePeriod of Insurance in respect of Home office equipment i.e. personalcomputers, printers, facsimile, telephone answering machines and the like.

Excluding:1. Property otherwise insured.2. Motor vehicles, (other than mechanically propelled lawnmowers), water craft (other than

canoes, rubber dinghies, sail boards, surf boards), caravans, trailers and aircraft or parts, keysor accessories of, on or in any of them.

3. Animals and livestock.4. Deeds, bonds, securities for money, manuscripts, certificates, bills of exchange, promissory

notes and documents of every kind unless specifically mentioned.

Domestic Employee Any employee of the Insured carrying on solely private domestic dutiesin connection with the Buildings (including repair, maintenance ordecoration but excluding work involving structural alterations, roofrepairs, demolition, construction or farming). Independent contractorsand/or consultants and/or their employees are also excluded.

Endorsement Any alteration to this Policy wording.

Fungi Any type or form of fungus, including but not limited to, all forms ofmould or mildew and any mycotoxins, spores, scents, vapours, gas orsubstance including any by-products produced or released by fungi.

Policy Excess The amount, shown on the Schedule, of any loss you must pay yourself,unless otherwise indicated within the Policy or Schedule.

High Value Items Any item, set or collection of jewellery, watches, precious metals,paintings, pictures, other works of art, furs, stamps, coins, and other suchitems, sets and collections, cameras, video, audio or home computerequipment.

Household You and others permanently residing with you in the Private Houseother than Paying Guests.

Paying Guests Guests paying for short term accommodation and/or tenants,co-tenants, lodgers, residing with you.

Money Banknotes, coins, cheques, bank drafts, postal or money orders, stamps(not forming part of a collection), savings stamps and Certificates,premium bonds, gift tokens, travel tickets.

Period of Insurance The period shown on your Schedule and any subsequent period forwhich we accept a renewal premium.

Personal Effects Articles normally worn or carried on the person.

Reduced Excess Some sections of the Policy are not subject to the Policy Excess.Whereindicated on the Schedule a Reduced Excess applies instead. For thosesections the Reduced Excess, indicated on the Schedule, is the amountof the claim that you must pay yourself. If it is not clearly stated that thereduced excess applies, then the policy excess applies to a loss.

Unfurnished Not adequately furnished or equipped for normal living purposes. In thecase of a newly constructed or renovated house, it will be deemedUnfurnished if either the water or electricity service has not beenconnected.

Unoccupied Not stayed in overnight by a member of your Household or any otherperson authorised by you.

WHATYOUR POLICY COVERSLoss, destruction and/or damage caused by:

1) Fire, Explosion, Lightning, EarthquakeandThunderbolt

2) Smoke

Meaning direct damage from smokeincluding the sudden and unusualoperation of any domestic heater ordomestic cooking appliance locatedwithin the Buildings.

3) Storm or Flood

4) Freezing, Escape or overflow of waterfrom within any plumbing or Heatingsystem, fixed water apparatus or fixeddomestic appliance.

Trace and AccessWe will pay up to a maximum of €750to remove or replace any part of theBuildings necessary to repair any fixeddomestic water, gas or heatinginstallation from which water hasescaped.

EXCLUDING LOSS OR DAMAGE

• by smoke from fireplaces,• by smog or from agricultural or industrial

operations.

• to fences and gates, lawns, hedges, trees,shrubs and plants, except as a directresult of damage to the Private Houseby Storm or Flood,

• by frost,• to roofs constructed with torch-on felt

exceeding 10 years of age.

• while the Private House is Unfurnished,• where the Private House has been

Unoccupied for more than 35consecutive days immediately prior tothe loss or damage,

• to any plumbing or heating system, fixedwater apparatus or fixed domesticappliance from which the water escapes,

• to any fixed water or heating installationdue to wear and tear, rust or gradualdeterioration

• resulting from escape or overflow waterfrom gutters,

• caused by the gradual ingress of waterfrom shower units and baths,

• should you retain any experts orcontractors other than those carrying outemergency works without our expressconsent. The engagement of these expertsor contractors will at all times be subjectto our approval, and we reserve the rightto select experts from our own panel.

6) Stealing (or Attempted Stealing)

7) Impact by Aircraft, Aerial Devices orArticles dropped from them, RailVehicles, Road Vehicles or Animals

8) Falling Trees and Branches and/orExternal Television/Radio Aerials,Masts and Satellite Dishes

9) Riot, Civil Commotion, Strikers,Locked-out Workers or PersonsTaking Part in Labour Disturbances

EXCLUDING LOSS OR DAMAGE

• while the Private House is Unfurnished,• where the Private House has been

Unoccupied for more than 35consecutive days immediately prior tothe loss or damage,

• to any plumbing or heating system, fixedwater apparatus or fixed domesticappliance from which the oil escapes,

• to any fixed water or heating installationdue to wear and tear, rust or gradualdeterioration

• should you retain any experts orcontractors other than those carryingout emergency works without ourexpress consent. The engagement ofthese experts or contractors will at alltimes be subject to our approval, and wereserve the right to select experts fromour own panel.

• while the Private House is Unfurnished,• where the Private House has been

Unoccupied for more than 35consecutive days immediately prior tothe loss or damage,

• when any part of the Private House islent, let, sub-let or accommodating payingguests unless involving entry or exit byforcible or violent means.

• to Buildings caused by animals owned byYou or a member of your Household.

• caused by felling of trees or lopping ofbranches,

• to hedges and fences,• arising from the cost of removing fallen

trees unless they have otherwise resultedin a valid claim under the Policy.

• to boundary walls, hedges, tennis courts,gates, fences, terraces, patios, drive-ways,footpaths, swimming pools, lawns, trees,shrubs and plants.

EXCLUDING LOSS OR DAMAGE

Other than by Malicious Fire and Explosion:

• by any person lawfully on the premises orany person invited onto the premises by Youor a member of your Household,

• while the Private House is Unfurnished,• where the Private House has been

Unoccupied for more than 35 consecutivedays immediately prior to the loss ordamage,

• to boundary walls, hedges, tennis courts,gates, fences, terraces, patios, drive-ways,footpaths, swimming pools, lawns, trees,shrubs and plants.

• resulting from demolition, structuralalteration or structural repair,

• resulting from faulty workmanship, defectivedesign, the use of defective materials,settlement of newly made up ground andcoastal, lake or river erosion,

• to boundary walls, gates, fences, terraces,patios, driveways, footpaths, swimming poolsand tennis courts unless the Private House isdamaged at the same time by this cause,

• resulting from the bedding down of anystructure,

• to solid floor slabs or loss or damageresulting from the movement thereof unlessthe foundations beneath the external walls ofthe Private House are damaged by the samecause and at the same time,

• resulting from tunnelling work,• should you retain any experts or contractors

other than those carrying out emergencyworks without our express consent. Theengagement of these experts or contractorswill at all times be subject to our approval,and we reserve the right to select expertsfrom our own panel,

12) Accidental Damage (but only ifindicated as covered on the Schedule)

EXCLUDING LOSS OR DAMAGE

• to the Buildings other than to thePrivate House,

• to any part of the Private House whichis lent, let, sub-let, or accommodatingpaying guests,

• by settlement and shrinkage,• caused by animals owned or in the care

custody or control of You or membersof your Household,

• caused by scratching, abrading ordenting,

• caused by faulty workmanship, defectivedesign, the use of defective materials orloss or damage resulting from them,

• to pottery, porcelain, terracotta, glass orother brittle articles, while being handledor actively used,

• to photographic, television, radio orother receiving, recording orreproducing equipment as a result of thefitting, repairing, adjusting, or dismantlingof any part of such apparatus, or tolamps, tubes, or electronic componentsin such apparatus,

• to records, audio, video or computerdiscs, tapes or cassettes,

• as a result of tree root action,• which comes within the terms of any

exclusion or limitation set out in thisPolicy including,but not limited to, Paragraphs (1) to (11)of this section.

Alternative AccommodationWe will pay for:(a) reasonable additional expenses

necessarily incurred by You, with ourconsent, for alternative comparableaccommodation for You and membersof your Household,

(b) loss of rent due to You,(c) up to two years Ground Rent if You

are liable,(d) rent which continues to be payable

by You,

as a result of the Buildings being rendereduninhabitable following damage by aninsured cause. The expense is limited to theperiod necessary for reinstatement and thetotal amount payable is limited to 15% ofthe Buildings Sum Insured.

Debris Removal CostsWe will pay for the cost of debris removal,demolition and/or shoring up costsnecessarily incurred with our consentfollowing loss or damage to the Buildings byan insured cause.

Architects/Surveyors FeesArchitects/Surveyors and Legal Feesnecessarily and reasonably incurred, withour consent in the reinstatement of theBuildings following loss or damage to theBuildings by an insured cause but excludingfees incurred by You in the preparation of aclaim.

Reinstatement of Sum Insured after LossThe Sums Insured will not be reduced bythe amount of any loss.

Public Authorities Requirements CostsWe will pay the cost of complying with anyGovernment, Local Authority, Building orother Regulation to the extent that theseapply to parts of the Buildings damaged byan insured cause (but not where notice hasbeen served on You prior to theoccurrence of the loss or damage or if anypart of the Buildings is a protectedstructure and we have not been informed).

Purchaser’s InterestIf you have contracted to sell the Buildings,the contracting purchaser will have, at yourrequest, the benefit of this Section up tothe date of completion of the sale. Thisextension only applies if the Buildings is nototherwise insured and shall not prejudiceyour or our rights.

Service Pipes and CablesWe will indemnify You for accidentaldamage to service pipes and cables forwhich You are legally responsible. The totalamount payable is limited to 5% of theBuildings Sum Insured.

SECTION 1: BUILDINGS - BASIC COVERLIABILITYTO OTHERSAS OWNER OFTHE BUILDINGS

WHATYOUR POLICY COVERS

We will indemnify You against all sumswhich You shall become legally liable to payas owner of the Buildings for accidentshappening in or about the buildings whichresult in

(i) death, bodily injury or illness to anyperson other than- members of your Household- employees of You or of members of

your Household- paying guests

(ii) accidental damage to property otherthan property belonging to or underthe control of- You- members of your Household- employees of You or of members of

your Household- paying guests

The amount payable in respect of any oneevent or series of events under this policy(including any other section of the policy)constituting one occurrence will not exceed€3,000,000 inclusive of all legal fees andother expenses.

In the event of your death We will, inrespect of liability incurred by You, indemnifyyour personal representatives in the termsof and subject to the limitations set out,provided that such personal representativeswill, as though they were the Insured,observe, fulfil and be subject to the terms,exceptions and conditions of the Policyinsofar as they can apply.

EXCLUDING LIABILITY IN RESPECT OF:

• the ownership or use of any land orbuilding other than the Buildingsspecified in the Schedule,

• the occupation of any land or building• the exercise of any profession, trade or

business• any wilful or malicious act,• arising from work of a construction or

reconstruction nature or structuralalterations or demolition,

• the transmission of any communicabledisease

• any contract which imposed on youliability which you would not otherwisehave been under

SECTION 1a: BUILDINGS - STANDARD COVER

WHATYOUR POLICY COVERSBreakage of Glass and Sanitary FittingsAccidental breakage of:(i) fixed glass in doors, windows, skylights,

fanlights and verandas,(ii) fixed wash-hand basins, fixed baths,

cisterns, fixed sanitary fittings and fixedshower units, glass in fixed furniture,fixed hobs and fixed mirrors.

EXCLUDING LOSS OR DAMAGE• while the Private House is

unfurnished or where the PrivateHouse has been unoccupied formore than 35 consecutive daysimmediately prior to the loss ordamage.

• to swimming pools.

Door Locks ReplacementWe will pay the cost of replacing externaldoor locks and keys of your Buildings,specified in the Schedule, where the keys ofsuch locks have been stolen following abreak-in at the Private House or followingan assault on You or a member of yourHousehold. The maximum amount payablewill be €500.

Satellite Dishes, Television/Radio Aerialsand MastsWe will indemnify you for loss or damage toexternal Satellite Dishes, Television/RadioAerials and Masts not exceeding 30 feet inheight but subject to a maximum amount of€1,000 any one loss.

Adaptation of Home following disabilityWe will pay the cost of adapting thebuildings for wheelchair access in the eventthat a member of the household suffersdisablement as a result of an accidentoccurring during the period of insurance,which requires them to use a wheelchairfor mobility which will in all probabilitycontinue for the remainder of theirnatural life.

The maximum amount payable is €10,000.

Damage to HeadstonesWe will pay the cost of repairing and/orreplacing headstones on the graves of yourparent, spouse or child following damage asa result of fire, lightning, storm, flood,malicious damage and/or stealing. Themaximum amount payable is €1,000.

Alternative AccommodationWe will pay for :(a) reasonable additional expenses

Compensation for death of Insuredand/or SpouseWe will pay €2,500 in the event of you oryour spouse's death by accident, as aresult of:(1) fire, explosion, lightning or assault by

thieves at the Buildings,(2) travelling as a passenger by train, bus,

licensed taxi or hackney,(3) assault in the street,where death occurs within three calendarmonths of such accident.

Contents in the openWe will indemnify You, up to an amount of€750, for loss or damage by an insuredcause, other than Accidental Damage(irrespective of whether cover is indicatedin the Schedule), to Contents in the openwithin the boundaries of your buildings.

Fraudulent Use of Credit/Debit/Charge/Cheque or Cash CardsWe will indemnify You up to a maximum of€1,000 in any Period of Insurance, inrespect of all claims resulting from the lossof a credit/debit/charge/cheque and/or cashcard belonging to You, or your spouse andsubsequent fraudulent use by anyunauthorised person.

Freezer and Refrigerator ContentsWe will indemnify You up to a maximum of€500 by payment or, at our option, byreplacement for loss or damage to food inyour deep freeze & refrigerator caused byany of the following events(1) Rise or fall in the temperature(2) Contamination by refrigeration fumes

resulting from;(i) accidental damage to the appliance,(ii) failure of the appliance due to its

own defect.

• to bicycles in the open.

Section Definitions

Identity TheftThe theft of your personal identification,Personal Public Service (PPS) number, orother method of identifying you which hasor could reasonably result in the wrongfuluse of such information, including but notlimited to, theft occurring on or arising outof your use of the internet. All financial lossresulting from the same, continuous, relatedor repeated acts shall be treated as arisingout of a single Identity Theft Event. IdentityTheft shall not include the theft or wrongfuluse of your business name or any othermethod of identifying any of your businessactivities.

Identity Theft EventOne occurrence of Identity Theft or aseries of related occurrences.

This section provides You with insurancecover if You become the victim of IdentityTheft during the period of insurance,subject to the terms, conditions andlimitations shown below.We will pay up to€10,000 for each Occurrence of IdentityTheft, including €2,500 in respect of lostwages (maximum payment any one week€420). An Excess of €50 applies to eachIdentity Theft Event.

THE COVER (what is insured)

(1) Costs for Solicitors' fees for signingstatutory declarations or similardocuments for financial institutions orsimilar credit grantors or creditagencies that have required thataffidavits be notarised.

(2) Costs for registered mail to Gardaí,credit reference agencies, financialinstitutions or similar credit grantors.

(3) Lost wages as a result of time taken offfrom work to meet with, or talk topolice, credit reference agencies and/orlegal counsel or to complete statutorydeclarations. If you are a self employedprofessional, actual lost wages includesremuneration for vacation days,discretionary days, floating holidays andpaid personal days. Computation oflost wages for self employedprofessionals must be supported byand will be based on prior year taxreturns. Coverage is limited to wageslost within 12 months after yourdiscovery of an Identity Theft Event.

• Loss arising out of business activity ofany insured person. Lost wagesremuneration excludes businessinterruption or future earnings of aself- employed professional.

(4) Loan application fees for re-applyingfor a loan or loans when the originalapplication is rejected solely becausethe lender received incorrect creditinformation.

(5) Reasonable legal fees incurred, subjectto our prior consent, for :(a) defence of lawsuits brought against

the insured person by merchants oftheir collection agencies;

(b)the removal of any criminal or civiljudgements wrongly enteredagainst you;

(c) challenging the accuracy orcompleteness of any information ina consumer credit report.

(6) Charges incurred for travel, longdistance telephone calls to retailmerchants, Police, financial institutionsor similar credit grantors or creditreference agencies to report ordiscuss an actual Identity Theft.

CONDITIONSAPPLICABLETOIDENTITYTHEFT COVERIf you discover you are a victim of anOccurrence of Identity Theft, contact Usimmediately and We will help you withadvice on what you need to do.

If you make a claim for lost wages, We willask you to submit proof from youremployer that you took unpaid days off. Youmust also provide proof that it wasnecessary to take time away from work.

You must also;(a) send copies of any demand, notices,

summonses, complaints, or legal papersreceived in connection with a coveredloss;

(b) take all reasonable and prudent actionto prevent further damage to youridentity;

(c) You must make the claim no later than6 (six) months from expiration date ofthis Policy.

ContentsProvided that, at the time of a loss, thecontents sum insured is adequate to replaceall of the contents as new, any admitted claim(excluding claims for items listed at (iii)below) will be settled on a new for old basis,as follows:(i) Total loss or destruction will be settled

We will indemnify You against all sumswhich You become legally liable to pay fordamages in respect of;(1) Death, bodily injury or illness to any

Section 3: All Risks CoverProvided the loss or damage is covered byyour policy we will settle your claim asfollows subject to the sum insured:- Where damage can be economically

repaired, including for clothing, we willeither authorise or arrange for repair

- Where a damaged or lost item can bereplaced with an item of similar qualitywe will either authorise or arrange forreplacement.

- Where we are unable to either repairor replace the item we will make a cashpayment equal to an agreedreplacement value

- Where we have offered either repair orreplacement but you prefer a cashsettlement, we will pay you an amountequal to the cost to us had the itembeen repaired or replaced.

We may make a deduction for wear, tearand depreciation for clothing.

Section 4: Caravan/Mobile Home CoverOur maximum liability for any admittedclaim will not exceed the market value ofthe property at the time of its loss ordamage, or the Sum Insured specified in theSchedule (whichever is the lesser).

A proportionate adjustment will be madein the settlement of your claim if the SumInsured at the time of the loss or damage isless than the cost of replacing all of theproperty, which is the subject of this cover.

Observance of ConditionsThe observance by You of the terms,conditions and endorsements of this Policyas far as they relate to anything to be doneor complied with by You will be a conditionprecedent to any liability of the Company.

MisdescriptionThis Policy will be voidable in the event ofmisrepresentation, misdescription or non-disclosure of any material facts i.e. thosecircumstances which may influence Us inour acceptance or assessment of thisinsurance. If You are in any doubt as towhether a fact is material or not pleasedisclose it. This condition applies atinception of Your Policy and at renewaleach year.

Maintenance and SecurityYou must keep the Buildings in good repairand take all reasonable precautions toensure the safety of property insured andto prevent accidents.

Change in Risk or CircumstanceYou must tell Us in writing IMMEDIATELYof any change, which may affect thisinsurance or increase the risk of loss,damage or injury. Such changes include, butare not limited to(a) if the occupancy of the house changes

(i.e. becomes let out, used as a holidayhome or becomes unoccupied),

(b) if a business is carried on from theBuildings,

(c) if the property is being structurallyaltered,

(d) if an extension is being built,(e) if non standard materials are used in

the construction of a new extension.

Failure to advise Us of such a change couldinvalidate the cover provided or couldresult in a claim being rejected or reduced.If You are in any doubt as to whether achange is material or not please notify Us.

Cancelling this PolicyYou may cancel the Policy at any time bywritten notice. If there has been no claimduring the current Period of Insurance Wewill return premium for the unexpiredPeriod of Insurance.

We may also cancel the Policy at any timeby sending notice by registered letter toYou at your last known address. This noticeis effective from midnight on the seventhday immediately following the date of theregistered letter. We will return aproportionate part of the premium.

Where you have agreed under a separateagreement to pay the premium byinstalments and you fail to make a paymenton the date on which it becomes due, thefull amount of premium remainingoutstanding will become immediatelypayable. If the outstanding amount is notreceived in full we may cancel the policy bysending notice by registered letter to you atyour last known address. This notice iseffective from midnight on the seventh dayimmediately following the date of theregistered letter.

Mortgagee ClauseThe interest of a Mortgagee in thisinsurance shall not be prejudiced by any actor neglect of the Mortgagor (or Occupierof the Buildings) whereby the risk of loss ordamage is increased without the authorityor knowledge of the Mortgagee, provided

Inflation ProtectionBuildings: The sum insured may be adjustedmonthly in accordance with the HouseRebuilding Cost Index prepared by theDepartment of the Environment. Followingloss or damage by any cause listed underSection 1 - Buildings, the Buildings suminsured will be Index Linked for theduration the Buildings are being reinstated,at the same rate that applied at thecommencement of Your Policy or lastrenewal, provided You take all reasonablesteps to ensure that the reinstatement iscarried out without undue delay.

No additional premium will be charged forthese adjustments between the anniversarydates of Your Policy, but the renewalpremium will be calculated on the revisedsum insured as appropriate.

Contents,All Risks and Caravan/MobileHome: The sums insured may be adjustedmonthly in accordance with the DurableHousehold Goods Section of theConsumer Price Index.

No additional premium will be charged forthese adjustments between the anniversarydates of Your Policy, but the renewalpremium will be calculated on the revisedsums insured as appropriate.

These adjustments may not be sufficient forYour needs and therefore You should notrely on this alone to ensure Your sumsinsured are adequate.You shouldperiodically review Your own sums insured.

Other InsurancesIf at the time of any incident, which resultsin a claim under this Policy, there is anyother insurance covering the same liability,loss or damage, We will pay only ourratable share.

No Claims DiscountYour Benchmark Options policy may besubject to a No Claims Discount. If this isthe case it will be indicated on theschedule.

In the event of a claim you must- tell us immediately of any loss, damage

or accident and give details of how theloss, damage or accident occurred.

- forward these to us, together with acompleted claim form, within 30 days offirst notifying us of the incident.

- send us any writ, summons, notice ofprosecution or other legal documentYou receive, unanswered, on receipt.

- advise the Gardaí or Police about anyincident of stealing, attempted stealingor vandalism, or loss, destruction,damage or injury by maliciousperson(s).

You must NOT- proceed with repairs (other than

emergency repairs necessary to limitdamage) or investigative work withoutour prior approval.

- negotiate, admit or repudiate any claimwithout our written consent , or allowany other person insured under thisPolicy, or anyone else acting on yourbehalf to do so.

We are entitled to- take over and conduct in your name, or

in the name of any other personindemnified by this Policy, the defence orsettlement of any legal action.

- take proceedings at our own expenseand for our own benefit, but in yourname, or in the name of any otherperson indemnified by this Policy, torecover any payment We have madeunder this Policy.

- receive all necessary assistance from Youor any other person indemnified by thisPolicy.

- enter any building where loss or damagehas occurred and deal with any salvage ina reasonable manner. However, noproperty may be abandoned to Us.

Emergency HomeAssist HelplineWe also provide an emergency 24 HourAssist emergency helpline which can provideyou with a connection to an approvednetwork of repairers (plumbers, electricians,glaziers, locksmiths, roofers etc.) to helpalleviate the effects of a loss as quickly aspossible. The cost of this service must be borne byyou. However, if the cost is covered by thispolicy then we will reimburse you as part ofthe claim settlement.

In addition to any otherrights or remedies which we may have underthis policy or otherwise- We will not pay the claim- We will not pay any other claim which

has been or may be made under thispolicy

- We may at our option declare the policyvoid

- We will be entitled to recover from youthe amount of any claim already paidunder the policy

- We may inform the appropriate lawenforcement agency of the circumstances.

GENERAL EXCLUSIONSWar andTerrorism ExclusionNotwithstanding any provision to thecontrary within this Policy or anyendorsement thereto it is agreed that thispolicy excludes loss damage cost orexpense of whatsoever nature directly orindirectly caused by resulting from or inconnection with any of the followingregardless of any other cause or eventcontributing concurrently or in any othersequence to the loss(1) war invasion acts of foreign enemies

hostilities or warlike operations(whether war be declared or not) civilwar rebellion revolution insurrectioncivil commotion assuming theproportions of or amounting to anuprising military or usurped power or

(2) any Act of Terrorism.

For the purpose of this endorsement anAct of Terrorism means an act including butnot limited to the use of force or violenceand/or the threat thereof of any person orgroup of persons whether acting alone oron behalf of or in connection with anyorganization or government committed forpolitical religious ideological or similarpurposes including the intention toinfluence any government and/or to put thepublic in fear.

This endorsement also excludes lossdamage cost or expense of whatsoevernature directly or indirectly caused byresulting from or in connection with anyaction taken in controlling preventingsuppressing or in any way relating to (1)and/or (2) above.

If the Company alleges that by reason ofthis exclusion any loss damage cost orexpense is not covered by this Policy theburden of proving the contrary shall beupon the Insured.

In the event any portion of thisendorsement is found to be invalid orunenforceable the remainder shall remain infull force and effect.

Biological or Chemical ContaminationExclusionIt is agreed that regardless of anycontributory causes this Policy does notcover any loss damage cost or expensedirectly or indirectly arising out of Biologicalor chemical contamination due to any Act ofTerrorism.

For the purpose of this endorsement an Actof Terrorism means an act including but notlimited to the use of force or violence and/orthe threat thereof of any person or group ofpersons whether acting alone or on behalf ofor in connection with any organisation orgovernment committed for political religiousideological or similar purposes including theintention to influence any government and/orto put the public or any section of the publicin fear.

For the purpose of this endorsementcontamination means the contaminationpoisoning or prevention and/or limitation ofthe use of objects due to the effects ofchemical and/or biological substances.

If the Company alleges that by reason of thisexclusion any loss damage cost or expense isnot covered by this Policy the burden ofproving the contrary shall be upon theInsured.

Cyber RiskThis Policy does not apply to liability, loss,damage, cost or expense of whatsoevernature directly or indirectly caused by,resulting from or in connection with

(1) the loss of, alteration of or damage to or(2) a reduction in the functionality, availability

or operation of a computer system,hardware, programme, software, data,information repository, microchip,integrated circuit or similar device incomputer equipment or non-computerequipment that results from the maliciousor negligent transfer (electronic orotherwise) of a computer programme

Consequential LossConsequential loss or damage of any kindexcept as set out in this Policy.

FeesFees incurred by You in the preparation ofany claim.

FungiAny loss, damage or liability directly orindirectly caused by the presence, growth,

proliferation, spread or any activity of fungi,wet or dry rot or bacteria. Whenever fungi,wet or dry rot or bacteria occur, they andany resulting loss are always excluded underthis policy, howsoever caused. In addition,there is no cover to test for, monitor, cleanup, remove, remediate, contain, tread, de-toxify, neutralize, or in any way respond to oraccess the effects of fungi, wet or dry rot,or bacteria.

Sets and Matching ItemsAny undamaged item which forms part of aset, pair, suite or any other article of auniform nature even when replacementscannot be matched. We will only be liable forthe value of the particular item, part or partsthat have been lost or damaged inproportion to the total value of the set, pairor suite.

Wear, Tear and as undernoted- Wear, tear, rust or corrosion.- Gradual deterioration or any gradually

operating cause.- The cost of maintenance.- Mildew, rising damp, dry/wet rot, moth,

vermin, atmospheric or climaticconditions.

- Damage caused by any process ofcleaning, dyeing, repairing or restoring anyarticle.

- Mechanical, electrical or electronic defects,breakdown or malfunction.

Business, Trade or Professional PurposesThis Policy does not provide cover for anyproperty held in connection with anybusiness, trade or professional purpose otherthan Home Office equipment as referred towithin the Definition of Contents.

What Does Benchmark do withYourPersonal DataInformation you provide will be used byBenchmark for the purposes of processingyour application and administering yourinsurance policy. Fraud Prevention, Detection & ClaimsHistoryBenchmark distributes, administers andmanages a range of insurance products onbehalf of RSA Insurance Ireland Ltd.Thefollowing information outlines how RSA dealwith the issues of Fraud Prevention,Detection and Claims History.

In order to prevent and detect fraud and thenon-disclosure of relevant information RSAmay at any time:- Share information about you with

companies within the RSA InsuranceGroup, other organisations outside theRSA Insurance Group including whereapplicable private investigators and publicbodies including An Garda Síochána;

- Check and / or file your details with fraudprevention agencies and databases, and ifyou give us false or inaccurateinformation and we suspect fraud, we willrecord this.

RSA may also search these agencies anddatabases to:- Help make decisions about the provision

and administration of insurance, creditand related services for you;

- Trace debtors or beneficiaries, recoverdebt, prevent fraud and manage yourinsurance policies with RSA;

- Check your identity to prevent moneylaundering, unless you furnish us withother satisfactory proof of identity;

- Undertake credit searches and additionalfraud searches.

Insurance Link DatabaseInformation about claims (whether by ourcustomers or third parties) made underpolicies that we provide is collected by uswhen a claim is made and is placed on aninsurance industry database of claimsknown as Insurance Link.This informationmay be shared with other insurancecompanies, self insurers or statutoryauthorities.

Insurance companies share claims data:(a) to ensure that more than one claim

cannot be made for the same personalinjury or property damage

(b) to check that claims informationmatches what was provided wheninsurance cover was taken out

(c) when required, to act as a basis forinvestigating claims when our recordedinformation is incorrect or when wesuspect that insurance fraud is beingattempted.

The purpose of Insurance Link is to help usidentify incorrect information andfraudulent claims and, therefore, to protectcustomers.
