His Majesty King Maha Vajiralongkorn Bodindradebayavarangkun is graciously pleased toproclaimthat:Whereasit isexpedienttorevisethelawonforeigners’workingandthelawonthebringingofforeignersforworkingwithemployersinthecountry;
WhereasthisRoyalOrdinancecontainscertainprovisionsrelatingtotherestrictionofrightsandlibertiesofthepeople,inrespectofwhichsection26inconjunctionwithsection28,section33,section34,section38andsection40oftheConstitutionoftheKingdomofThailandsopermitsbyvirtueoftheprovisionsoflaw;
Whereas this Royal Ordinance is, in essence, concerned with foreigners’ workingmanagement to achieveorderliness andefficiencyby layingdown rules governing thebringingofforeignersforworkingwithemployersinthecountryaswellastheworkingofforeignersandsettinguptheForeigners’WorkingManagementPolicyCommissionempoweredtolaydownpoliciesonandexercise supervision of foreigners’workingmanagement and, in this regard, this RoyalOrdinancecontainscertainprovisionswhichhavetheeffectofrestrictingaperson’srightsandlibertiestooroflife and thebody, a person’s liberty of dwelling, a person’s liberty towrite, print andpublicise, aperson right to property and a person’s liberty to engage in an occupation, in a manner thatrestrictionsonrightsand libertiesaremadetotheextentnecessaryforthepurposeof foreigners’working management to achieve orderliness and efficiency; Be it, therefore, by virtue of theprovisionsof section172of theConstitutionof theKingdomof Thailand, enactedby theKing, asfollows.
Section 1. This law is called the “Royal Ordinance Concerning the Management ofEmploymentofForeignWorkers,B.E.2560(2017)”.
Section2. ThisRoyalOrdinance shall come into forceon theday following thedateof itspublicationintheGovernmentGazette.
Section3.Thefollowingshallberepealed:
(1)theForeigners’WorkingAct,B.E.2551(2008);
(2)theRoyalOrdinanceconcerningtheBringingofForeignersforWorkingwithEmployersintheCountry,B.E.2559(2016).
Section4.ThisRoyalOrdinanceshallnotapplytotheperformanceofdutiesintheKingdombyforeignersonlyinthecapacityasthefollowing:
(1)membersofadiplomaticmission;
(2)membersofaconsularmission;
(3) representatives of a Member State to, and personnel of, the United Nations andspecialisedagencies;
(4) private servants travelling from a foreign country to be in the ordinary service to thepersonsunder(1),(2)or(3);
(5) persons performing duties or missions under an agreement concluded by theGovernmentofThailandwithaforeignGovernmentoraninternationalorganisation;
(6)asapersonwhoentersoccasionallytoorganizeorattendmeetings,providescomments,
lectures, or provide demonstrations in meetings, trainings, observe activities or seminars, or
performing arts, cultures or compete in sports, or other activities prescribed by the Cabinet. The
Cabinetwillspecifytheperiodandconditionsasseeappropriate;
(7)asapersonwho enterstoengageinbusinessorinvestmentorhashighknowledge,
capabilityorskills,whichwillbenefitthecountry’sdevelopment,asprescribedbytheCabinet
(6)personsperformingdutiesormissionsforeducational,cultural,artistic,sportiveorotherpurposesasprescribedintheMinisterialRegulation;
(7)personsgrantedentryuponpermissionbytheCounciloftheforperformingaparticulardutyormission,withorwithoutcondition.
(8)asarepresentativeoftheforeignworkerjuristicpersonwhoisgrantedanoperationof
businesslicenseinaccordancewiththeForeignBusinesslegislation
Section5. InthisRoyalOrdinance:
“Bringingforeignworkerstowork”meansanyoperationthatbringsforeignworkerstothe
Kingdomtowork.
“Work”meansengaging inanoccupationwhetherwithorwithoutanemployer,butdoes
not includeanoperationof businessof apersonwho is granteda license in accordancewith the
ForeignBusinesslegislation.
“foreigner”meansanaturalpersonwhoisnotofThainationality;
“employer”meansanemployerunderthelawonlabourprotectionandshallalsoincludea
natural person or a juristic person intending to bring a foreigner forworking in the countrywith
himselforitself;“employee”meansapersonwhoworksforanemployerinreturnforwages;
“License to bring in foreignworkers”means the license to operate a business to bring in
foreignworkerstoworkwiththeemployersintheKingdom.
“Licensee whoispermittedtobringinforeignworkers”meansanoperationofbusiness,
thatbringinforeignworkerstoworkwiththeemployersintheKingdom,whoisgrantedalicenseto
bringinforeignworkers.
“workpermit”meansaworkpermitofaforeigner;“persongrantedpermissionforworking”
meansaforeignergrantedpermissionforworking;
“office” means an office of the person granted permission for bringing foreigners for
working;“fee”meansmoneyorotherbenefitsgiveninreturnforthebringingofforeigners
forworking;“expenses”meansexpensesincurredinthebringingofforeignersforworking;
“Fund”meanstheForeigners’WorkingManagementFund;
“Fund Committee”means the Committee of the Foreigners’WorkingManagement Fund;
“Commission”meanstheForeigners’WorkingManagementPolicyCommission;
“competent official” means a person appointed by the Minister for performing activities
underthisRoyalOrdinance;
“Registrars”meanstheDirector-GeneralandcompetentofficialsappointedbytheMinister
withtherecommendationoftheDirector-Generalforissuingworkpermitsandperforming
otheractivitiesunderthisRoyalOrdinance;
“Director-General” means the Director-General of the Department of Employment;
“Minister” means the Minister having charge and control of the execution of this Royal
Ordinance.
“Section5/1 The provisions in this Royal Ordinance shall be pursuant to the criteria,
proceduresandconditionsprescribedintheMinisterialRegulation,orasprescribedbytheMinister
or the Director-General. SuchMinisterial Regulation or prescription shall not include unnecessary
proceduresorcreateimmoderateburdentothepeopleandshallspecifyeachprocedureoperation
periodcarriedoutbytheofficials.
InthecasethatthisRoyalOrdinancespecifiesthatanyonewhohastheobligationtonotify
the Director-General, Registrar or Competent Official, the Director-General shall prescribe the
procedures required and informs the notifier to operate conveniently and timely in writing or
electronics,orothermeansinwhichthepeoplemayoperatewithoutcausingimmoderateburden.
TheperiodtakenfortheDirector-General,RegistrarorCompetentOfficialtoreplytothenotification
shallbespecified.”
Section6.TheMinisterofLabourshallhavechargeandcontroloftheexecutionofthisRoyal
Ordinance and shall have the powers to appoint competent officials and issue Ministerial
Regulations prescribing fees not exceeding the rates annexed hereto, exempting fees and
prescribing other matters or issue Notifications, in the execution of this Royal Ordinance. Such
Ministerial Regulations and Notifications shall come into force upon their publication in the
GovernmentGazette.
Chapter1
GeneralProvisions
Section7 The Minister, with approval from the Committee may issue an
announcement concerning the types ofwork prohibited for foreignworkers,which could be fully
prohibitedorprohibitedunderconditions,asthecasemaybe.
Theannouncementconcerningtheprovisionsinparagraphoneshallbeinregardtothe
nationalsecurity,occupationopportunityofThaisanddemandforforeignworkersasnecessaryfor
thedevelopmentofthecountry,aswellastheagreementsThailandisinpartywith,orhasbinding
obligationsshallbeinthewayofreciprocity.
Section8 The foreignworker is prohibited toengage inworkwithoutobtaininga
workpermitorengageinworkotherthantheirrightswhichisinviolationthisRoyalOrdinance.
Section9 Nooneshallacceptaforeignworkerwithoutobtainingaworkpermitto
engage inworkoracceptsa foreignworker toengage inworkorengage inworkother thantheir
rightswhichisinviolationthisRoyalOrdinance.
Section10 Repealed.
Section11 To ensure the occupation and profession opportunity of Thais, the
DepartmentofEmploymentshallannounceforThainationality job-seekersandregisterapplicants
anddisseminateaccessibleupdatedinformationdaily.
Anyonewishestoemployaforeignworker, toengage inthetypeofworkwhereThai
nationaljob-seekershavebeenregisteredwiththeDepartmentofEmployment,toworkwithinthe
sametypeandarea,iftherearefiveworkersorabove,thenumberofforeignworkersthatcanbe
employedshallnotexceedtwentypercent,unlessaspecialfeeispaid.
ThefeerateinparagraphtwoshallbeinpursuanttotheMinisterialRegulation,which
maybeprescribedas a fee for specific numbersof foreignworkers thatmaydiffer fromwhich is
specifiedinparagraphtwo.
Thenumberof foreignworkers tobe counted inparagraph two shall not include the
foreignworkerswhoarepermittedtoworkinaccordancetoSection63/1.
Anyone who fails to comply with the provisions in paragraph two, shall be liable to
surchargeattherateofone-timeofthefeetobepaid.
The types of work the provisions of this Section will be enforced upon shall be
prescribedintheRoyalDecree.
Section12Repealed.
Section13 AnyonewhoemploysaforeignworkershallnotifytheRegistrarregarding
thenameandnationalityof the foreignworkerandthe typeofworkwithin fifteendays fromthe
employmentdate,andshallnotify theRegistrarwithin fifteendays fromthedatethat the foreign
workernolongerwork andthereasonshallalsobeincluded.
The provisions in paragraph one shall not be enforced on the types foreign workers
announcedbytheDirector-General.
Section14 In special cases regarding the benefits of the national security or
economicsorwardoffpubliccalamity,theMinisterundertheapprovaloftheCabinetmaypermit
foreignworkerstoworkintheKingdomwithanycondition,ortheexceptionnottofollowthisRoyal
Ordinanceinanycase.
Section15Repealed.
Section16.Allcasesresultingfromdisputesbetweenthepersongrantedpermissionfor
bringing foreigners for working and the foreigner, the person granted permission for bringing
foreignersforworkingandtheemployerortheemployerandtheforeignerinconnectionwithrights
or duties under this Royal Ordinance or in connection with labour relation shall fall within the
jurisdictionoftheLabourCourt.
CHAPTERII
FOREIGNERS’WORKINGMANAGEMENTPOLICYCOMMISSION

Section17.Thereshallbeacommissioncalledthe“Foreigners’WorkingManagement
PolicyCommission”, consistingof theMinisterof Labour asChairperson, Permanent Secretary for
Labour as Vice Chairperson, Permanent Secretary for Defence, Permanent Secretary for Finance,
PermanentSecretary forForeignAffairs,PermanentSecretary forSocialDevelopmentandHuman
Security,PermanentSecretary forAgricultureandCo-operatives,PermanentSecretary for Interior,
PermanentSecretaryforPublicHealth,PermanentSecretaryfor Industry,SecretaryGeneralofthe
National Economic and Social Development Board, Secretary-General of the National Security
Council,Directorof theNational IntelligenceAgency,Commander-in-Chiefof theRoyalThaiArmy,
Commander-in-Chief of the Royal Thai Navy, Commissioner-General of the Royal Thai Police,
Director-General of the Department of Labor Protection and Welfare, Secretary General of the
InternalSecurityOperationsCommand,PresidentoftheThaiChamberofCommerceandPresident
of the Federationof Thai Industries as exofficiomembers, notmore than two representativesof
employees’organisationsappointedbytheMinisteruponnominationbytheDirector-Generaland
qualified persons appointed by the Minister from those possessing knowledge or experience in
labour,industry,lawandhumanrights,providedthatonepersonshallbeappointedfromeachfield,
asmembers.
TheDirector-GeneralshallbeamemberandsecretaryandtheDirectoroftheOfficeof
Foreign Workers Administration, Department of Employment, shall be a member and assistant
secretary.
Section18.Amemberrepresentinganemployees’organisationandaqualifiedmember
mustpossessthequalificationsandmustnotbeundertheprohibitionsasfollows:
(1)beingofThainationality;
(2)notbeingabankruptorhavingbeenadishonestbankrupt;
(3)notbeinganincompetentpersonoraquasi-incompetentperson;
(4)nothavingbeensentencedbya final judgmenttoatermof imprisonment,except
foranoffencecommittedthroughnegligenceorapettyoffence;
(5)notbeingaholderof apolitical position, amemberof a local assemblyor a local
administrator,anexecutivememberoraholderofanypositionresponsiblefortheadministrationof
apoliticalparty,anadvisertoapoliticalpartyoranofficialofapoliticalparty;
(6)nothavingbeensentencedororderedbytheCourttotheeffectthatpropertyshall
vestintheStatebyreasonofunusualwealthinessoranunusualincreaseofproperty.
Section19.Amemberrepresentinganemployees’organisationandaqualifiedmember
shall holdoffice for a termof three years.Whilemembers representingemployees’organisations
and qualified members vacate office for any reason and the appointment of new members
representing employees’ organisations and new qualified members has not yet been made, the
Commission shall consist of the total existing members. A member representing an employees’
organisationandaqualifiedmember,whovacatesofficeupontheexpirationoftheterm,maybere-
appointedbutmaynotserveformorethantwoconsecutiveterms.
Section 20. In addition to the vacation of office upon the expiration of the term, a
memberrepresentinganemployees’organisationandaqualifiedmembervacateofficeupon:
(1)death;
(2)resignation;
(3)beingremovedby theMinisteronthegroundofneglectofduties,misbehavioror
lackofcompetence;
(4)beingdisqualifiedorbeingunderanyprohibitionundersection18.
Section 21. The Commission has the powers and duties in connection with the
formulationofpoliciesandtheoversightofforeigners’workingmanagementasfollows:
(1) to formulatepolicies and strategies on foreigners’workingmanagementby laying
downmeasures and directions to be pursued in solving problems concerning foreigners’ working
andlayingdowndirectionsandgoalsforforeigners’workingmanagement;
(2) to consider and recommend reviews, revision and development of rules for the
management and resolution of problems concerning foreigners’ working to ensure that they are
appropriatetoattendingsituations;
(3)toreportannualoperationstotheCouncilofMinistersanddisseminatethesameto
thepublic;
(4)toperformanyotheractivitiesasprovidedbylawtobethepowersanddutiesofthe
CommissionorasentrustedbytheCouncilofMinisters.
The policies prepared under (1) shall be submitted to the Council of Ministers for
considerationandapprovaland,upontheirapprovalbytheCouncilofMinisters,allStateagencies
shallpursueandsuperviseoperationsintheimplementationofsuchpolicies.
Section22.TheCommissionhasthepowertoappointasub-committeeforconsidering
orperforminganyparticularactasentrustedbytheCommission.
CHAPTERIII
BRINGINGFOREIGNERSFORWORKINGWITHEMPLOYERSINTHECOUNTRY

Section23.TheprovisionsofthisChaptershallnotapplyto:
(1) procurement of employment under the law on procurement of employment and
protectionofjobseekers;
(2)procurementofemploymentunderthelawonmaritimelabour.
Section24.Repealed
Section25.Nopersonshalladvertisethebringingofforeignersforworkingwithemployers
in the country unless such person is the person granted permission for bringing foreigners for
working
PARTII
OPERATIONOFBUSINESSINVOLVINGTHEBRINGINGOFFOREIGNERSFORWORKINGWITH
EMPLOYERSINTHECOUNTRY

Section 26. No person shall operate the business involving the bringing of foreigners for
workingwithemployersinthecountryunlesspermissionisgrantedbytheDirectorGeneral.
Theapplicationforpermissionandthegrantingofpermissionunderparagraphoneshallbe
inaccordancewiththerules,proceduresandconditionsprescribedintheMinisterialRegulation.
Apermitforbringingforeignersforworkingshallbeinaccordancewiththeformprescribed
intheNotificationoftheDirector-General.
Section 27. A person applying for permission for bringing foreigners for working with
employers inthecountrymustbea limitedcompanyorapublic limitedcompanyandpossessthe
qualificationsandmustnotbeunderanyprohibitionsasfollows:
(1)havingsuchpaid-upregisteredcapitalasprescribed in theNotificationof theDirector-
General,providedthatitshallnotbelessthanonemillionBaht;
(2)havingthecapitalbelongingtoshareholdersofThainationalityintheamountofnotless
thanthree-fourthsofthetotalcapitalandhavingshareholdersofThainationalityinthenumberof
notlessthanthree-fourthsofthetotalnumberofshareholders,exceptinthecasewherethereisa
treatytowhichorunderwhichThailandisapartyorisboundbytheobligationthereinasconcluded
betweentheGovernmentofThailandandaforeignGovernment, inwhichcasetheprovisionsand
conditionsofsuchtreatyorobligationshallgovern;
(3)havinganofficesituatedinaproper,openanddefinitelocation,providedthatitisnota
prohibitedplaceasprescribedintheNotificationoftheDirector-General;
(4)notbeingapersongrantedpermission forbringing foreigners forworking,notbeinga
personwhosepermitforbringingforeignersforworkingissuspendedornothavinghadapermitfor
bringingforeignersforworkingrevokedunderthisRoyalOrdinance;
(5)notbeingapermitgrantee,notbeingapersonwhosepermitissuspendedornothaving
hadapermitrevoked,underthelawonprocurementofemploymentandprotectionofjobseekers;
(6)notbeinganemploymentpermitgrantee,notbeingapersonwhoseemploymentpermit
issuspendedornothavinghadanemploymentpermitrevoked,underthelawonmaritimelabour;
(7)havingamanagerwhoisadirectorauthorisedtorepresentthejuristicpersonandwho
hasqualificationsandisundernoprohibitionsasfollows:
(a)beingofThainationality;
(b)beingofnotlowerthantwentyyearsofage;
(c)notbeingadirector,partnerormanagerofa juristicpersonthat is thepersongranted
permissionforbringingforeignersforworkingoratthetimewhensuchjuristicpersonhashadthe
permitforbringingforeignersforworkingrevokedunderthisRoyalOrdinanceRoyalOrdinance;
(d)notbeingadirector,partnerormanagerofajuristicpersonthatisthepermitgranteeor
atthetimewhensuchjuristicpersonhashadthepermitrevokedunderthelawonprocurementof
employmentandprotectionofjobseekers;
(e) not being a director, partner or manager of a juristic person that is the grantee of a
permitforprocurementofemploymentoratthetimewhensuchjuristicpersonhashadthepermit
forprocurementofemploymentrevokedunderthelawonmaritimelabour;
(f)notbeinganincompetentpersonoraquasi-incompetentperson;
(g)notbeingapersonwhohasorhadmisconductormoralimpropriety;
(h)nothavingbeensentencedbyafinaljudgmenttoatermofimprisonmentinrespectof
anoffencewhich,underthelaw,requiresadishonestactasanelementthereoforinrespectofan
offenceunderthisRoyalOrdinance,thelawonprocurementofemploymentandprotectionofjob
seekers,thelawonmaritimelabourorthelawonanti-humantrafficking.
Section 28. The applicantmust, before being grantedpermission by theDirectorGeneral,
placewith the Director-General the security as prescribed in theMinisterial Regulation, provided
thatitmustnotbelessthanfivemillionBaht,assecurityforlosswhichmayarisefromthebringing
offoreignersforworkingwithemployersinthecountryunderthisRoyalOrdinance.
In the case where the security placed by the person granted permission for bringing
foreignersforworkingunderparagraphonediminishesonaccountofitsbeingexpendedunderthis
Royal Ordinance, the Director-General shall order, in writing, the person granted permission for
bringing foreigners for working to place additional security until the specified amount is fully
achievedwithinthirtydaysasfromthedateofreceiptoftheorder.
The undertaking, retention, deduction, change of the guarantee, demand for additional
guarantee,additionalguaranteeplacementandreturnofguaranteeshallbepursuanttothecriteria,
proceduresandconditionsaccordingtotheMinisterialRegulation.
Section29Repealed.
Section30.ThelicensetobringinforeignworkersaccordingtoSection26shallbevalidfor
fiveyearsfromthedateof issuance,butthe licenseewho ispermittedtobring inforeignworkers
shallpayyearlyfeeasprescribedbytheMinisterialRegulation.
TheCompetentOfficialshallbeobligatedtoinspectthecomplianceofthisRoyalOrdinance
atleastonceayear.
Thelicenseewhoispermittedtobringinforeignworkerswhodesiresto renewthelicensetobringinforeignworkersshallapplythirtydaysbeforetheexpirydate. Whentheapplicationis
submitted,theoperationsmaycontinueuntiltheDirector-Generalordernottoextendthelicense.
The application for renewal of license to bring in foreign workers and the granting
permissionshallbepursuanttothecriteria,proceduresandconditionsprescribedintheMinisterial
Regulation.TheDirector-Generalshallcompletetheconsiderationwithinfifteendaysfromthedate
ofreceivingtheapplication.
Thelicenseewhoispermittedtobringinforeignworkersshallpaytheyearlyfeewithinsixty
daysfromthestartingdayofthelicensetobringinforeignworkerssecondyearandtheconsecutive
years. The payment may be made through electronics means. After the yearly payment, a
notificationshallbemadetotheRegistrar,andacopyofyearlyfeereceiptshallalsobesubmitted.
If the licenseewho ispermitted tobring in foreignworkersdonotpay the feewithin the
periodspecifiedinparagraphfive,theDirector-Generalmay suspendthelicensetobringinforeignworkersinaccordancetoSection86.
Section31.Inthecasewhereapermitforbringingforeignersforworkingislost,destroyed
or substantiallydamaged, thepersongrantedpermission forbringing foreigners forworkingmust
submit an application for receiving a substitute for the permit for bringing foreigners forworking
withinfifteendaysasfromthedateoftheknowledgeofsuchloss,destructionordamage.
The application for a substitute for a permit for bringing foreigners for working and the
issuanceofasubstituteforapermitforbringingforeignersforworkingshallbeinaccordancewith
therules,proceduresandconditionsprescribedintheNotificationoftheDirector-General.
Section32.Thepersongrantedpermissionforbringingforeignersforworkingmustdisplay
the permit for bringing foreigners for working at an open and conspicuous place at the office
indicatedinthepermitforbringingforeignersforworking.
Section33 Thelicenseewhoispermittedtobringinforeignworkersthatdesirestomove
officeortoestablishatemporaryofficethatisnotspecifiedinthelicense tobringinforeignworkersshallnotifytheRegistraratleastfifteendaysinadvanced.
Section34 The licensee who is permitted to bring in foreign workers that desires to
change themanagerauthorized toactonbehalfof the juristicpersonshallnotify theRegistrarat
leastfifteendaysinadvanced.
Section35 The licenseewho is permitted to bring in foreignworkers shall notify the
Registrarofthenumberandnames listsoftheemployeeswhoperformdutiesrelatingtobringing
foreignworkerstowork, underthecriteria,proceduresandconditionsprescribedbytheDirector-General.
Themanagersauthorizedtoactonbehalfofthejuristicpersonandtheemployeeswho
performdutiesrelatingtobringingforeignworkerstoworkofthelicenseewhoispermittedtobring
inforeignworkersshallobtainidentificationcardsandacopyofthelicense tobringinforeignworkers,andshallalwaysbeabletopresenttheexistenceofsuchidentificationcardsandlicense tobringinforeignworkerstotheCompetentOfficials.
TheidentificationcardshallbeintheformprescribedbytheDirector-General.
Section36Repealed.
Section37Repealed.
Section 38. The security which the person granted permission for bringing foreigners for
workinghasplacedundersection28shallnotbesubjectedtolegalexecutionaslongastheperson
grantedpermissionforbringingforeignersforworkingdoesnotceasetheoperationofthebusiness
of bringing foreigners for working with employers in the country or remains liable to make
compensationunderthisRoyalOrdinanceafterhavingceasedtheoperationofsuchbusiness.
UndertheexecutionofSection55,inthecasethatthelicenseewhoispermittedtobringin
foreignworkersdissolutethebusinessofbringingforeignworkerstoworkandhasnoresponsibility
tocompensateunderthisRoyalOrdinance,thelicenseewhoispermittedtobringinforeignworkers
shallapplytotheDirector-Generalforthereturnoftheguarantee. WhentheDirector-Generalchecks and finds that the licensee who is permitted to bring in foreign workers does not have
responsibilitytocompensateunderthisRoyalOrdinance,thelicenseewhoispermittedtobring in
foreignworkersshallbenotifiedinwritingtoreceivethereturnoftheguarantee.
Thepersongrantedpermissionforbringingforeignersforworkingshalltakeareturnofthe
securitywithin fiveyearsas fromthedateofreceiptof thewrittennotificationfromtheDirector-
General.Inthecasewherethepersongrantedpermissionforbringingforeignersforworkingfailsto
takeareturnofthesecuritywithinthespecifiedtime,suchsecurityshallvestintheState.

Section41 The licensee who is permitted to bring in foreign workers may bring in
foreign workers when a contract in bringing foreign workers and the foreign workers’ potential
employersare inplace,which include thename list,nationalityand the foreignworker’spassport
number.Suchemployersshallnotbeinformofworkerssubcontractorwagessubcontractbusiness
operatorandispermittedtobringinforeignworkerstoworkonlyinaccordancewithsuchnumber
andnamelist.
Thecontractinbringingforeignworkersinparagraphoneshallcontainatleastinpursuant
tothedetailprescribedbytheDirector-General.
Whenbringingtheforeignworkerstowork,thelicenseewhoispermittedtobringinforeign
workers shall submit a copy of the contract of the potential foreign workers’ employers to the
Registrarandinnecessarycases,mayrequesttheRegistrartocertifythecopyandtheexistenceof
theemployersand theworkof theemployers. In suchcases,whentheRegistrarchecksand finds
accuracy, a certificationdocument shall be issued.Upon receiving the foreignworkers’ name lists
and passport numbers, the licenseewho is permitted to bring in foreignworkers shall notify the
RegistraroftheinformationinparagraphoneandtheRegistrarshallnotifytheImmigrationBureau
orrelevantagencies.
Uponnotifying theRegistrar inparagraph three, the licenseewho ispermitted tobring in
foreignworkersmayapplyfortheworkpermitsonbehalfoftheforeignworkersinaccordancewith
thenotificationinparagraphthree.
Section42 InbringingforeignworkerstoworkwiththeemployersintheKingdom,the
licenseewhoispermittedtobringinforeignworkersortheemployeewhoperformsdutiesrelating
tobringingforeignworkerstowork areprohibitedtodemandfororreceivemoneyoranyother
propertyfromtheemployerortheforeignworkerotherthanservicefeeorcostfromtheemployer
accordingtothelistandrateprescribedbytheDirector-General.
Section43 When the licensee who is permitted to bring in foreign workers has
delivered the foreignworker to theemployer,anotification shallbemade to theRegistrarwithin
fifteendaysfromthedatethattheforeignworkerisdeliveredtotheemployerinaccordancetothe
listprescribedbytheDirector-General.
Section44.Thepersongrantedpermissionforbringingforeignersforworkingmustusethe
name,wordsrepresentingthenameoranyotherword, intheoperationofbusiness, identifiedas
“CompanyBringingForeigners forWorking in theCountry”andmayalsouseotheraccompanying
foreignexpressionsorlettersbearingtheidenticalconnotation.
Section45.Anypersonotherthanthepersongrantedpermissionforbringingforeignersfor
workingshallnotuseanyname,word representing thenameoranyotherword, in thecourseof
business, identified as “Company Bringing Foreigners forWorking in the Country” or use foreign
wordsorlettersbearingthesimilarconnotation.
PARTIII
EMPLOYERSBRINGINGFOREIGNERSFORWORKINGWITHTHEMINTHECOUNTRY

Section46 Any employer, who do not operate businesses concerning workers
subcontractorwagessubcontract,wishestobringinforeignworkersfromoverseastoworkinthe
Kingdom under an agreement or Memorandum of Understanding made by the Thai and foreign
governmentshallinformtheRegistrarregardingthenumberofcountriestheforeignworkersreside
in,thetypeofworktheforeignworkertobeengagedinandotherdetail inaccordancetothe list
prescribedbytheDirector-General.InthecasethatfeeshavetobemadeinaccordancetoSection
11,theemployershallproceedfurtherafterfeepaymenthasbeenconducted.
In the case that there is no fee to be paid or fee payment has been conducted in
accordancetoparagraphone,theemployershallproceedtoacquirethenameandpassportnumber
oftheforeignworkerwhoisenteringtowork,andnotifytheRegistrarandtheRegistrarshallnotify
the ImmigrationBureauor relevant agencies. In this regard, theDirector-Generalmay specify the
employerwhobrings in foreignworkers to engage in the types ofwork that require a guarantee
placementtoensurethecomplianceunderthisRoyalOrdinance.Theundertaking, rate, retention,
deductionorchangeof theguarantee, thedemand foradditionalguarantee,additionalguarantee
placement and return of guarantee shall be pursuant to the criteria, procedures and conditions
accordingtotheMinisterialRegulation.
Beforeaforeignworkerengagesinworkwiththeemployer,theemployershallconduct
anemploymentcontractinwriting,includingatleastthelistprescribedbytheDirector-General,and
placetheemploymentcontractattheemployer’sworkplacefortheRegistrarorCompetentOfficials
to check, and a copy of the employment contract shall be given to the employee. If the foreign
workernolongerworksduetoanyreason,theemployershallnotifytheRegistrationwithinfifteen
daysfromthedatethattheforeignworkernolongerworksandthereasonshallalsobeincluded.
TheprovisionsinthisSectionshallnotbeenforcedontheemployers,whoarenotworkerssubcontractorwagessubcontractbusinessoperators,thatwishtobringinforeignworkersfromthecountries thatThailandhavenotmadeanagreementorMemorandumofUnderstandingwith theforeigncountryinaccordancetoparagraphone.
Section 47. In the case where the security placed by the employer under section 46diminishesonaccountofitsbeingexpendedunderthisRoyalOrdinanceandtheemployerremainsboundbytheresponsibilitiesunderthisRoyalOrdinance,theDirector-Generalshallorder,inwriting,theemployer toplaceadditional securityuntil the specifiedamount is fullyachievedwithin thirtydaysasfromthedateofreceiptoftheorder.
Any employerwho fails to place additional securitywithin the time under paragraph onemust be liable to payment of additional money at the rate of two percent per month until theadditionalsecurityisplacedinthefullamount.
Section 48. In the case where an employer requests for a return of the security, theemployermusthaveno liability tomakecompensationunder thisRoyalOrdinance. In this regard,upon an employer’s request for a return of the security, the Director-General shall conduct anexaminationtohissatisfactionthattheemployerhasnoliabilitytomakecompensationunderthisRoyalOrdinanceandnotify,inwriting,theemployertotakeareturnofthesecurity.
InthecasewheretheemployerfailstotakeareturnofthesecuritywithinfiveyearsasfromthedateofreceiptofthenotificationfromtheDirector-General,suchsecurityshallvestintheState.
Section49 The employer is prohibited to demand for or receivemoney or any other
propertyfromtheforeignworkersincomingtoworkwiththemselvesintheKingdom,exceptfrom
the costs which are of the foreign worker’s responsibility, in which the employer has paid for in
advanced,suchaspassports,healthcheck,workpermitorotherrelevantcostsasprescribedbythe
Director-General, inwhichtheemployermaydeduct fromthewages,over time,holidaywagesor
overtimeholidaywages.Theemployermayonlydeducttheforeignworker’swagesinaccordance
totheactualcostpaidbutshallnotexceedtenpercentoftheforeignworker’smonthlywages.
In the case that no agreement has been made concerning the employer’s advanced
payment for the employee’s travelling costs, and the employer hasmade advancedpayment, the
employermaydeducttheforeignworker’swagesinaccordancetoparagraphone.
PARTIV
DUTIESANDRESPONSIBILITIES

Section50 Whenthe licenseewho ispermittedtobring inforeignworkersdelivers
the foreign workers to the employers in accordance to Section 43, in case of the following
circumstances, theemployershallnotify the licenseewho ispermittedtobring in foreignworkers
andtheRegistrarwithinsevendaysfromthedateoftheincident,asthecasemaybe:
(1) theemployerrefusestoaccepttheforeignworkerforemployment,
(2) theforeignworkerdoesnotconsenttoworkwiththeemployer
(3) theforeignworkerquitswithanyreason.
In the cases of (1) or (3), that are not of the foreign worker’s fault, and the foreign
workerwishes toworkwith another employer, the licenseewho is permitted to bring in foreign
workersmayarrangefortheforeignworkertoworkwithanotheremployerwithinthirtydaysfrom
thedatetheemployerrefusestoaccepttheforeignworkerforemployment,howevertheperiodof
workwiththenewemployershallnotexceedtheperiodofthecontracttobringinforeignworkers
towork.
Inthecaseof(2),thataretheemployer’sfault,theprovisionsinSection51andSection
52shallapplymutatismutandis.
When the licensee who is permitted to bring in foreign workers perform under
paragraph twoorparagraph three, the result shallbenotified to theRegistrar inaccordancewith
theformprescribedbytheDirector-General.
Inthecaseof(1)or(2)wheresuchforeignworkerdoesnotworkforthenewemployer
withinthespecificperiod,itshallbeconsideredthatthepermissiontostayintheKingdomofsuch
foreignworker isterminatedinpursuanttothe immigration law.The licenseewhoispermittedto
bringinforeignworkersshallsendtheforeignworkerbacktothecountryoforiginwithinsevendays
fromdayofthedeadlinetoworkwiththenewemployerisoverdueandshallsubmitevidencethat
such foreign worker has left the Kingdom to the Registrar within seven days from the date of
sendingtheforeignworkerback.Ifsuchoperationcannotbemanaged,anotificationshallbemade
to the Registrar within three days from day of the deadline to work with the new employer is
overdue. The Registrar shall notify the Competent Official under the immigration law or police
officertorepatriatesuchforeignworkerfromtheKingdomimmediately.Insuchcases,thelicensee
who is permitted to bring in foreign workers shall be responsible for the operation costs of the
Competent Official under the immigration law or police officer, but not exceeding the rate
prescribedbytheDirector-General.
Inthecasethatthelicenseewhoispermittedtobringinforeignworkersfailthesubmit
the leaving theKingdomevidencewithin the specifiedperiod inparagraph five, an administrative
fineshallbemadetotheRegistrarintherateofonethousandBahtperdayperoneforeignworker
untilvalidoperationiscarriedout,butnotexceedingtwentythousandBahtperoneforeignworker.
Section51 Theforeignworker,whoworkswiththeemployerunderSection43and
Section46,thatquitsbeforethecompletionoftheemploymentcontract isnotpermittedtowork
withanotheremployer,exceptbeabletoprovetotheRegistrarthereasontoquitresultfromthe
faultoftheemployerorhaspaidforthedamagecoststothecurrentemployer. Insuchcases,the
Registrar shall issueanewworkpermitorendorse theworkpermit showing the rights to change
employer.
Thedamagecostsunderparagraphone includesall thecosts inbringing such foreign
worker to work, which shall be calculated by the ratio of the time such foreign worker has
completedwork.
Theprovisionsinparagraphoneshallnotbeenforcedontheforeignworkersthatare
granted renewed employment contract and quit the work during the renewed employment
contract.
Section52 The foreign worker who changes the employer under Section 51 shall
startworkingwiththenewemployerwithinthirtydays fromthedateofemploymenttermination
withthepreviousemployer. Inthecasethatsuchforeignworkerengagesinthetypeofworkthat
theemployerisobligatedtoplaceaguaranteeunderSection46,thenewemployershallplacethe
guaranteetotheDirector-GeneralunderSection46withinfifteendaysfromthedateofemploying
suchforeignworker.
Section53 TheforeignworkerwhohasnorightsinchangingemployerunderSection
51ortheforeignemployerwhohastherightstochangeemployerbutdoesnotstartworkingwith
anotheremployerwithinthespecificperiodunderSection52,theforeignworker’sworkpermitshall
beterminatedfromthedateof theemploymentterminationorexceedsthespecificperiodunder
Section 52, as the case may be. The permission to stay in the Kingdom of such foreign worker
terminatesinpursuanttotheimmigrationlaw.
Thelicenseewhoispermittedtobring inforeignworkersortheemployer,wholatest
placedtheguaranteeunderSection46orSection52,shallberesponsible for thecostsofsending
theforeignworkerbacktothecountryoforiginunderparagraphone,asthecasemaybe.
Section54Repealed.
Section55WhentheforeignworkerhasworkedfortheemployerunderSection43or
Section46untilthetermunderthecontractofbringingforeignworkerstoworkwiththeemployers
intheKingdomortheemploymentcontractiscompleted,thelicenseewhoispermittedtobringin
foreignworkersortheemployer,who latestplacedtheguaranteeunderSection46orSection52,
shall send the foreignworkerback to the countryof origin, except for renewing theemployment
contract or the foreign worker works with the new employer within the specific period under
Section52.
The provisions in paragraph five and paragraph six of Section 50 shall apply when
sendingtheforeignworkerbacktothecountryoforiginunderparagraphone,mutatismutandis.
Inthecasethatthelicenseewhoispermittedtobringinforeignworkers dissolutethebusinessinbringingforeignworkerstoworkwiththeemployersintheKingdom,theRegistrarshall
return the guarantee to the licensee who is permitted to bring in foreign workers when such
licenseeshowsevidenceofsendingtheforeignworkerbacktothecountryoforigin,butshallnotbe
laterthantwoyearsfromthedateofthebusinessdissolution.Whensuchdeadlineisreachedand
the licensee who is permitted to bring in foreign workers fails to show evidence of sending the
foreignworkerbacktothecountryoforigintotheRegistrar,suchguaranteeshallbevestedinthe
AlienRepatriationFundtobeusedinrepatriatingtheforeignworkerfromtheKingdom.Inthecase
thatthelicenseewhoispermittedtobring inforeignworkersshowssomepartoftheevidenceof
sending the foreignworkerbackwithin theperiod specified, theDirector-General shall return the
guaranteeinrelevanttotheratioandguidelineprescribedintheMinisterialRegulation.
Section56 TheforeignworkerwhocomesintoworkunderthisChapterandhasto
be repatriated back to the country of origin under the immigration or other relevant law, the
authority that is repatriating such foreign worker may demand for the cost arises from such
arrangement fromthe licenseewho ispermittedtobring in foreignworkersor theemployerwho
placedtheguarantee.
In the case that the licensee who is permitted to bring in foreign workers or the
employerfailtocompensatethemoneywithintheperiodspecifiedinparagraphone,theDirector-
General shall deduct the amount of money from the guarantee undertaken to return to the
authoritythatrepatriatetheforeignworker.
Section57 Theforeignworkerwhoreceiveddamagescausedbythelicenseewhois
permitted to bring in foreign workers or the employer who does not comply to Section 50 may
surrendertotheDirector-Generalortheappointedofficialtorepatriatetheforeignworkerandthe
Director-General or the appointed official shall arrange for repatriation immediately, and the
provisionsinSection58paragraphtwoshallapplymutatismutandis.
Section58 Inthecasethatthelicenseewhoispermittedtobringinforeignworkers
ortheemployerwholatestplacedtheguaranteeunderSection46orSection52doesnotsendthe
foreign worker back to the country of origin under these provisions, when the Registrar or the
CompetentOfficialfindssuchforeignworker,repatriationshallbearranged.
Regardingtheforeignworker’s repatriationunderparagraphone, theRegistraror the
Competent Official shall initially use the money from the Fund and informs the licensee who is
permittedtobringinforeignworkersortheemployerunderparagraphoneinwritingtopayforthe
expensesoccur inarrangingtheforeignworker’srepatriationandothernecessarycostswithinthe
specific period. If such person does not paywithin the specific period, the Director-General shall
deduct the amount from the guarantee undertaken by the licenseewho is permitted to bring in
foreignworkersortheemployer,asthecasemaybe.
When such deduction under paragraph two is completed, the Director-General shall
informthelicenseewhoispermittedtobringinforeignworkersortheemployerwithoutdelay.
CHAPTERIV
FOREIGNERS’WORKING
______________
Section59 A foreignworkerwho resides in theKingdomor receivespermission to
enter theKingdomtemporarilyunderthe immigration law,butnot for tourismor transitpurpose,
shall be able to engage in the types of work that are not prohibited for foreign workers under
Section7paragraphone,andshallobtainaworkpermit.
UndertheexecutionofSection60,theforeignworkerwhodesirestoapplyforawork
permitunderparagraphoneshallsubmitanapplicationtotheRegistrar,andinthecaseofalready
havinganemployer,thenameoftheemployershallalsobeidentified.
Theapplication forpermission toworkand thegrantingofpermission toworkunder
paragraph one and paragraph two shall be pursuant to the criteria, procedures and conditions
prescribedintheMinisterialRegulation,whichmayspecifytheuseofelectronicsmeans.Thework
permitvalidityperiodshallbeasrequestedbytheapplicantbutnotexceedingtwoyearsfromthe
dateoftheworkpermitissuance.
Under paragraph three of theMinisterial Regulation, a specific period from receiving
theapplicationtothedayoftheworkpermitissuanceshallnotexceedfifteenworkingdays.Inthe
casethattheRegistrarisnotabletoissuetheworkpermitwithinthespecificperiod,theMinisteror
Director-Generalshalltakeappropriateactionontheofficialsinvolved.Inthecaseofnotissuingthe
workpermitwithoutreasonablecauseshallbeconsideredasadisciplinaryoffenseandadisciplinary
actionshallbeconducted.
Under the execution of law, the permitted person to work under paragraph one has the
rights to engage in all types of work that are not prohibited for foreign workers in pursuant to
Section7paragraphone.
Section60 AforeignworkerwhoresidesoutsidetheKingdomthatdesirestoapplyfor
aworkpermitintheKingdommaysubmittheapplicationandmakepaymentforthefeesthrough
electronicssystem.
Any employerwho desires to employ a foreignworker to engage in their business in the
KingdommaysubmitaworkpermitapplicationonbehalfoftheforeignworkertotheRegistrarand
maypayforthefeesonbehalfoftheforeignworker.
The application for permission to work and the granting of permission to work under
paragraph one and paragraph two shall be pursuant to the criteria, procedures and conditions
prescribedintheMinisterialRegulation.
Section61 A foreign worker who enters the Kingdom temporarily under the
immigrationlawtoengageintheworkthatconsistofnecessaryorurgentcharacteristicsoradhoc
workforaperiodofnotexceedingfifteendays,thatforeignworkermayengageinthatworkafter
givingwrittennotificationtotheRegistrar.
Theworkthatconsistofnecessaryorurgentcharacteristicsoradhocworkunderparagraph
oneshallbeshallbeasprescribedbytheDirector-General.
Theforeignworkerwhoworks inaccordancetoparagraphone, ifsuchworkexceedsthe
periodprovided,may request for an extensionof not exceeding fifteendays, and shall notify the
Registrarbeforetheperioddeadline.
Thenotificationunderparagraphoneandparagraphthree,andtheissuanceofnotification
receiptshallbepursuanttothecriteriaandproceduresprescribedintheMinisterialRegulation.
Section62 When a foreignworker is permitted towork in the Kingdomunder the
lawoninvestmentpromotion,petroleumorotherlaws,theauthoritywhograntspermissionunder
suchlawshallnotifytheRegistrarwithoutdelay.
TheRegistrarshall,afterreceivingthenotificationunderparagraphone,issuethework
permittothat foreignworkerwithinsevendaysas fromthedateofreceivingofsuchnotification.
Whilewaiting for theworkpermitunderparagraph two, that foreignworkermayengage inwork
withoutregardtoSection68
The work permit issuance under paragraph two shall be pursuant to the criteria,
procedures and conditions prescribed in the Ministerial Regulation without being under the
executionofSection7,andtheworkpermitvalidityperiodshallbeaspermittedtoentertowork
undersuchlaw.
Inthecasethatthepermittedpersontoworkhasbeengrantedanextensionperiodto
work under such laws, the responsible agency regarding those laws shall notify such extension
periodtotheRegistrarimmediatelyinpursuanttotheformprescribedbytheDirector-General,and
theRegistrarshallwritedownsuchextensionperiodontheworkpermit.
Section63 TheforeignworkerwiththefollowinggroundsmayapplytotheRegistrar
for theworkpermit toengage in thework asnotified in theGovernmentGazetteby theCabinet
according to the recommendation of the Committee with due regard to national security, social
impactandhumanity:
(1) beingdeportedunderthelawondeportation,butisallowedtoworkatanyplace
inlieuofdeportationorwhilewaitingfordeportation;
(2) having immigrated into or stayed in the Kingdomwithout permission under the
immigration law, but is allowed to stay in the Kingdom temporarilywhilewaiting for deportation
undertheimmigrationlaw,whichisnotthecaseofSection63/2;
Theapplication forpermission toworkand thegrantingofpermission toworkunder
paragraph one shall be pursuant to the criteria, procedures and conditions prescribed in the
MinisterialRegulation,andtheworkpermitvalidityperiodisasoftheperiodallowedbutshallnot
exceedoneyearfromthedateoftheworkpermitissuance,andmaybeextendedasmanytimeas
seeappropriatebutshallnotexceedoneyearperextension.
WhentheRegistrar issuesaworkpermit tothe foreignworker,anotificationshallbe
madetotheCompetentOfficialundertheimmigrationlaw.
WithintheendofJanuaryofeveryyear,theCompetentOfficialundertheimmigration
lawshallnotifytheRegistrarregardingtheresultofdeportationorrepatriation.Inthecasethatthe
Registrar is notified that there is no deportation or repatriation, or has not been notified by the
CompetentOfficialundertheimmigrationlaw,theRegistrarisauthorizedtoextendtheworkpermit
under paragraph one as requested by the foreignworker and shall notify the Competent Official
undertheimmigrationlawwhentheextensionhasbeengranted.
Section63/1TheforeignworkerwiththefollowinggroundsmayapplytotheRegistrar
towork:
(1) being lost of nationality by theprovisionsof theAnnouncementof theNational
ExecutiveCouncilNo. 337,dated13thDecemberB.E. 2515(1972)orbyotherlaws;(2) bornintheKingdombutnotentitlingtoThainationalitybytheprovisionsofthe
AnnouncementoftheNationalExecutiveCouncilNo. 337,dated13thDecemberB.E. 2515(1972)orbyothernationalitylaws;
(3) being a foreign worker who has been granted legal entry status under the
announcementoftheMinistryofInteriorinaccordancetotheimmigrationlaw;
(4) being a foreign worker who is a person without registration status and has
receivedan identificationcard inaccordancewiththeCentralRegistrationOfficeRegulationunder
thecivilregistrationlaw.
The foreign worker under paragraph one shall not be under the execution of
announcement under Section 7 and Section 11 but the Cabinet may prohibit the types of work,
whichcouldbe fullyprohibitedorprohibitedunderconditions,as thecasemaybewith regard to
thenationalsecurity,socialimpactandhumanity.
Theapplication forpermission toworkand thegrantingofpermission toworkunder
paragraph one shall be pursuant to the criteria, procedures and conditions prescribed in the
MinisterialRegulation,andtheworkpermitvalidityperiodisfiveyearseachtime.Thepersonunder
(1),(3)and(4)areexemptedfromtheworkpermitfeeortheworkpermitextensionfee.Theperson
under (2) may be or may not be exempted from the fee shall be pursuant to the Ministerial
RegulationunderSection6.
Section63/2 In the case that the Minister under the immigration law permits any
foreignworkerorothergroupofpersontoentertheKingdominaccordancetotheimmigrationlaw,
orexemptanyforeignworkerorothergroupofpersonnottocomplytothe immigration law,the
Cabinet may specify such foreign worker or other group of person, who is not a foreign worker
underSection63/1,toapplytowork,theCabinetshallspecifythetypesofworktheforeignworker
mayengageinforthebenefitsofeconomicandsocialdevelopment.
The application for permission under paragraph one shall be pursuant to the criteria
andproceduresprescribedintheMinisterialRegulationandsuchMinisterialRegulationshallspecify
the criteria for the Director-General to have the authority to specify the conditions on the work
permit. Theworkpermit validityperiod is as requestedby theapplicantbut shallnotexceed two
yearsfromthedateoftheworkpermitissuance.
Section64 The foreignworker being of nationality of the country having common
boundarywith Thailandwhoenters into theKingdomwithborderpassorotherdocument in the
samewaywhichareprescribedbytheDirector-General,maybepermittedbytheRegistrartowork
in the Kingdom temporarily through the specified period or season within the area which is
specified.
Localities, nationalities of foreigners and types or natures of work to which the
provisions of paragraph one shall apply and the conditions for application thereto shall be as
prescribedintheNotificationoftheCouncilofMinistersbypublicationintheGovernmentGazette.
Theapplicationforworkpermissionandtheissuanceofaworkpermitunderparagraph
oneshallbe inaccordancewith the rules,proceduresandconditionsprescribed in theMinisterial
Regulation
Paragraph4Repealed.
Section 64/1 A foreign worker who desires to apply for a work permit shall have
qualifications andwithout any disqualification ground as prescribed by theMinisterial Regulation
andhavenotbeensentencedtopunishmentunderSection101,exceptbeingacquittedforatleast
twoyearsbeforeapplyingforaworkpermitorbeingaforeignworkerunderSection63inwhichthe
Registrargrantsapermissiontoworkasaspecialcase.
Inthecaseofwherethere isaneedtocheckthehealthoftheforeignworkerbefore
issuing a work permit, the foreign worker or the employer of the foreign worker shall bring the
foreignworkertoasanatoriumthatobtainsalicensetooperateasanatoriumforahealthcheck.
Theprovisionsinparagraphoneshallnotbeenforcedonthe foreignworkerunderSection63/1.
Section64/2 The permitted worker has a duty to notify the Registrar regarding the
employer, the employer’s workplace and they type of work within fifteen days from the date of
engaginginthework,andshallnotifytheRegistrareverytimewhenthereisachangeofemployer.

Section 67. The person granted permission for working who intends to continue
workingshallsubmitanapplicationforrenewaloftheworkpermittotheRegistrarbeforethework
permitexpires.
Uponsubmissionoftheapplicationunderparagraphone,theapplicantforrenewalof
suchworkpermitmaywork for the timebeinguntil theRegistrargivesanorder refusing togrant
renewaloftheworkpermit.
UndertheexecutionofSection63andSection63/1,theextensionperiodofthework
permitshallbeasrequestedbytheapplicantbutnotexceedingtwoyearsperextensionandonlyas
necessary.
The application for renewal of a work permit and the renewal thereof shall be in
accordancewiththerules,proceduresandconditionsprescribedintheMinisterialRegulation.
Section68 Thepermittedworker shall always be able to show thework permit to
theCompetentOfficialortheRegistrarwithinareasonabletime.
Section 69. If a work permit is lost, destroyed or substantially damaged, the person
granted permission for working shall submit an application for a work permit substitute within
fifteendaysasfromthedateoftheknowledgeofsuchloss,destructionordamage.
The application for the substitution of the work permit and the issuance for the
substitutionoftheworkpermitpursuanttothecriteriaandproceduresprescribedbytheDirector-General.

CHAPTERV
FOREIGNERS’WORKINGMANAGEMENTFUND

Section 75. There shall be establishedwithin the Department of Employment a fund
called the “Foreigners’ Working Management Fund” as a revolving fund to be expended on the
foreigners’workingmanagement.
Section76.TheFundshallconsistofthemoneyandpropertyasfollows:
(1) the money and property transferred from the Fund for the Repatriation of
ForeignersfromtheKingdomundersection140;
(2)surchargeunderparagraphfiveofSection11andparagraphtwoofSection47,and
theadministrativefinechargedunderthisRoyalOrdinance;
(3)themoneyorpropertydonated;
(4)feescollectibleunderthisRoyalOrdinance,inrespectofwhichapprovalisgivenby
theMinistry of Finance for their being expendedwithout being required to be submitted to the
TreasuryastheStaterevenue;
(5)fruitsofthemoneyorpropertyoftheFund;
(6)subsidiesallocatedbytheGovernmentasarenecessary;
(7)anyothermoneyorpropertyreceivedbytheFundinanycasewhatsoever.
Themoneyandpropertyunderparagraphone shall be remitted to theFundwithout
beingrequiredtoberemittedtotheTreasuryastheStaterevenue.
Section77.ThemoneyoftheFundshallbeexpendedforthefollowingobjects:
(1)assistingforeignerswhohaveanentryforworkingunderthisRoyalOrdinanceand
whosufferviolationofrightsunderlabourlaw;
(2)repatriatingforeignersfromtheKingdom;
(3) assisting and subsidising State agencies or non-governmental organisations which
haveproposedprojectsorworkplans inconnectionwithworkingmanagement,welfareprovision,
education,publichealthandlabourprotectionforforeigners;
(4)providingmonetaryreturnstoforeignerswhohavecontributedmoneytotheFund
for theRepatriationofForeigners fromtheKingdomundertheForeigners’WorkingAct,B.E.2551
(2008)andfundingexpensesinconnectionwithsuchproceeding;
(5)managingtheFund;
(6) managing the foreigners’ working under this Royal Ordinance. The pursuit of
activities under (1), (2), (3), (4), (5) and (6) shall be in accordancewith the rules, procedures and
conditionsprescribedbytheFundCommittee.
Section 78. There shall be a committee called the “Committee of the Foreigners’
Working Management Fund” consisting of the Permanent Secretary for Labour as Chairperson,
Director-General of the Department of Employment as Vice Chairperson, a representative of the
Ministry of Foreign Affairs, a representative of the Comptroller-General’s Department, a
representative of the Bureau of the Budget and a representative of the Office of the Attorney
GeneralasexofficiomembersandnotmorethanfivequalifiedpersonsappointedbytheMinister
from persons possessing expertise in labour, finance, economics, administration or law, provided
thatonepersonshallbefromeachfield,asmembers.
The Director of the Foreign Workers Administration Bureau, Department of
Employment,shallbeamemberandsecretary.
The Fund Committee may appoint not more than two Government officials of the
DepartmentofEmploymentasassistantsecretaries.
Section79.Aqualifiedmemberof theFundCommitteeshallholdoffice fora termof
fouryears.AqualifiedmemberoftheFundCommitteewhovacatesofficeupontheexpirationofthe
termmaybere-appointedbutmaynotserveformorethantwoconsecutiveterms.
Section 80. In addition to the vacation of office upon the expiration of the term, a
qualifiedmemberoftheFundCommitteevacatesofficeupon:
(1)death;
(2)resignation;
(3)beingabankrupt;
(4)beinganincompetentoraquasi-incompetentperson;
(5)beingremovedbytheMinisteronthegroundofneglectofduties,misbehaviouror
lackofcompetence;
(6)beingsentencedbyafinaljudgmenttoatermofimprisonment.
Section81.TheFundCommitteeshallhavethepowersanddutiesasfollows:
(1)to laydownpolicies,supervisethemanagementandmonitoroperationstoensure
conformitywiththeobjectsoftheFund;
(2)toprescriberules,proceduresandconditionsforthedisbursementofmoneyofthe
FundinaccordancewiththeobjectsoftheFund;
(3)toconsiderandapprovetheannualactionplan;
(4)toconsidertheallocationofthemoneyoftheFundforexpenditure inaccordance
withtheobjectsoftheFund;
(5)toissueRulesinconnectionwiththereceiptofmoney,thedisbursementofmoney,
the retentionofmoney, the exploitation and internal audit of the Fund,with the approval of the
MinistryofFinance;
(6)toissueRulesinconnectionwithrulesandproceduresforthepaymentofmoneyof
theFund for themanagementof foreigners’workingandthedisbursementofadvancemoney for
suchoperation.
Section82.TheFundCommitteehasthepowertoappointasub-committeeoftheFundfor
consideringorperforminganyparticularactivityasentrustedbytheFundCommittee.
Section 83. The Department of Employment shall prepare accounts of the Fund in
conformity with correct accounting systems by reference to generally recognised accounting
principlesandsubmit thesametotheauditorwithinsixtydaysas fromtheendof theaccounting
year.
Section84.TheOfficeoftheAuditor-Generalortheindependentauditorasapprovedbythe
OfficeoftheAuditor-GeneralshallbetheauditoroftheFund.
Section85.Theauditorshall reportauditresultstotheFundCommitteeforsubmissionto
theCouncilofMinisterswithinonehundredtwentydaysasfromtheendoftheaccountingyearand
the Department of Employment shall disseminate financial statements certified by the auditor
withinfifteendaysasfromthedateonwhichtheCouncilofMinistershastheknowledgethereof.
CHAPTERVI
ADMINISTRATIVEMEASURES

PARTISUSPENSIONOFPERMITSFORBRINGINGFOREIGNERSFORWORKING,REVOCATION
OFPERMITSFORBRINGINGFOREIGNERSFORWORKINGANDREVOCATIONOFWORKPERMITS

Section 86. In the case where the person granted permission for bringing foreigners for
workinglacksanyqualificationorisunderanyprohibitionundersection27orfailstocomplywithor
incorrectly complieswith this RoyalOrdinanceor aMinisterial Regulationor aNotification issued
under thisRoyalOrdinance, theDirector-Generalshallordersuspensionof thepermit forbringing
foreigners forworking foraperiodnotexceedingonehundred twentydaysandorder theperson
granted permission for bringing foreigners for working to undertake correct compliance or take
remedialactionwithinthespecifiedperiodoftime.
Section 87. In the case where the person granted permission for bringing foreigners for
working commits an offence under this Royal Ordinance and is under legal proceedings, the
Director-General shallorder suspensionof thepermit forbringing foreigners forworkinguntil the
casebecomesfinal.
Section88.TheDirector-General shallorder revocationofapermit forbringing foreigners
forworkinguponoccurrenceofthefollowingevents:
(1)thepersongrantedpermissionforbringingforeignersforworkingfailstocomplywithor
takeremedialactionrequiredbytheorderoftheDirector-Generalundersection86;
(2)thepersongrantedpermissionforbringingforeignersforworkinghashadthepermitfor
bringingforeigners forworkingsuspended,withtheperiodofoneyearnothavingelapsed,orhas
had thepermit forbringing foreigners forworkingsuspendedon twooccasionsandthereexistsa
groundfororderinganothersuspensionthereof;
(3) thepersongrantedpermission forbringing foreigners forworkinghas failed tocomply
withorincorrectlycompliedwiththelawofthecountryoforiginorbecomeinvolvedwithoraided
and abetted such failure of compliance or incorrect compliance in the bringing of foreigners for
working with employers in the country and the Director-General has given a written warning
demandingcorrectcompliancewiththelawofthecountryoforiginorprohibitinginvolvementwith
such hitherto indicated incidences but the person granted permission for bringing foreigners for
workingfailstocomplywiththewrittenwarningoftheDirector-Generalwithinfifteendaysasfrom
thedateofreceiptthereof;
(4) the person granted permission for bringing foreigners for working violates section 89
paragraphtwo;
(5) the Director-General considers that the failure, by the person granted permission for
bringingforeignersforworking,tocomplywithorincorrectcompliancewiththisRoyalOrdinanceor
aMinisterialRegulationorNotificationissuedunderthisRoyalOrdinanceisaseriouscase;
(6) the Director-General considers that the person granted permission for bringing
foreignersforworkingisunabletocomplywiththisRoyalOrdinanceoraMinisterialRegulationor
NotificationissuedunderthisRoyalOrdinance.
Section89.Anorder forsuspensionofapermit forbringingforeigners forworkingandan
orderforrevocationofapermitforbringingforeignersforworkingshallbeinwritingandnotifiedto
the person granted permission for bringing foreigners forworking. In the casewhere the person
grantedpermissionforbringingforeignersforworkingisnotfoundorthepersongrantedpermission
for bringing foreigners forworking refuses to receive the order, such order shall be posted at an
openandconspicuousplaceat theofficeand it isdeemedthatthepersongrantedpermissionfor
bringing foreigners forworking has the knowledge of such order as from the date onwhich it is
posted.
During suspension of the permit for bringing foreigners for working, the person granted
permission for bringing foreigners for working shall not carry out any act in connectionwith the
bringingofforeignersforworkingwithemployersinthecountryunlessitistheacttobecarriedout
infurtheranceofthebringingof foreignersforworkingwithemployers inthecountrypriortothe
dateofthesuspensionofthepermitforbringingforeignersforworking.
Thepersongrantedpermissionforbringingforeignersforworkingwhosepermitforbringing
foreignersforworkinghasbeenrevokedmustberesponsiblefortherepatriationofforeignerswho
remainunderhisresponsibilitytocountriesoforiginuntiltheliabilityunderthisRoyalOrdinanceis
discharged and shall give the Director-General a report on foreigners who remain under his
responsibility.
Section 90. In the casewhere it appears that the person granted permission for working
violates this Royal Ordinance or fails to complywith the conditions fixed for the permission, the
Registrarshallhavethepowertoorderrevocationoftheworkpermit.
Section 91. The Director-General may publish a list of employers or persons granted
permissionforbringingforeignersforworkinguponwhompunishmenthasbeeninflictedbyreason
oftheviolationoforfailuretocomplywiththisRoyalOrdinance.
PARTII
APPEALSAGAINSTADMINISTRATIVEORDERS

Section92 In the casewhere theDirector-General refuses to grant permission under
Section 26, refuses to grant permission to extend the license to bring in foreign workers under
Section 30 or has deducted the guarantee or demand for additional guarantee under this Royal
Ordinance,thepermissionapplicantorthelicenseewhoispermittedtobringinforeignworkershas
therighttoappealtotheMinisterwithinthirtydaysfromthedateofreceivingtheorder.
ThedecisionoftheMinistershallbefinal.
Section93 In the case that the Director-General has deducted the guarantee ordemandforadditionalguaranteeunderthisRoyalOrdinance,theemployerhastherighttoappeal
totheMinisterwithinthirtydaysfromthedateofreceivingtheorder.
ThedecisionoftheMinistershallbefinal
Section94.Thepersongrantedpermissionforbringingforeignersforworkingwhosepermit
forbringingforeignersforworkinghasbeensuspendedorwhosepermitforbringingforeignersfor
workinghasbeenrevokedhastherighttoappealtotheMinisterwithinthirtydaysasfromthedate
ofreceiptofthenotificationoftheorderinquestion.AdecisionoftheMinistershallbefinal.
Section95 InthecasethattheRegistrarrefusestograntpermissionunderSection59,
Section60,Section63,Section63/1orSection64orrefusestograntpermissiontoextendthework
permit under Section 67, or revokes the work permit under Section 90, the foreign worker who
applied for permission, the person applied for permission on behalf of the foreignworker or the
permittedworker,asthecasemaybe,hastherighttoappealtotheMinisterwithinthirtydaysfrom
thedateofreceivingtheorder.
ThedecisionoftheMinistershallbefinal.
Section96.TheMinister,uponreceiptoftheappealundersection92,section93,section94
or section95, shall consider the appeal andnotify the appellantwithout delaybut not later than
thirty days as from the date of receipt thereof. If a necessary cause prevents completion of the
consideration within such period of time, the appellant shall be given the notification thereof in
writing before the expiration of such time. In this regard, the period for the consideration of the
appealmaybeextendedforaperiodnotexceedingthirtydaysas fromthedateof theexpiration
thereof.
In the case where the period of time specified in paragraph one has elapsed, it shall be
deemedthattheMinisterhasconsideredtheappealandaffirmedtheoriginalorder.
Section97.Theappealundersection92,section93,section94orsection95shallnothave
theeffectofstayingtheexecutionoftheorderexceptthecaseoftheappealofanorderrefusingto
grantrenewalofaworkpermitundersection67.
CHAPTERVII
COMPETENTOFFICIALS

Section98. IntheperformanceofdutiesunderthisRoyalOrdinance,theRegistrarandthecompetentofficialhavethepowersasfollows:
(1)tosummonsororder,inwriting,anypersonconcernedtogiveexplanationsandfurnishdocumentsoranyotherevidenceforassistingtheconsideration;
(2) toenter theplaceofbusinessofbringing foreigners forworking in the countryduringworkinghoursforconductinganinspectionintheexecutionofthisRoyalOrdinance;
(3)toentertheenterprisesthatacceptaforeignworkerduringworkinghourstoinspecttheoperationsunderthisRoyalOrdinance;
(4) to conduct a search in the case where there is a reasonable cause to suspect that aforeignerhasbeenbrought forworking in thecountryora foreignerhasworkedunlawfullyor toconductasearchforfindingandassistingaforeignerwhohasbecomeaninjuredpersonfromanyactinviolationofthisRoyalOrdinance;
(5) to seize or attach documents or evidence pertinent to theworking or the bringing offoreignersforworkinginthecountry,inthecasewherethereisareasonablecausetobelievethatanoffenceunderthisRoyalOrdinancehasbeencommitted.
A search under (4) requires awarrant of search except that, in the casewhere there is areasonable cause to believe that a delay in securing awarrant of search is likely to result in theforeigner being attacked, moved or concealed or relevant evidence being moved, concealed,transformedordestroyed,asearchmaybeconductedwithoutwarrantofsearch,providedthattheprovisionsoftheCriminalProcedureCodeonsearchingshallbecompliedwith.
Intheperformanceofthedutiesunder(2),(3),(4)and(5),personsconcernedshallrenderreasonableassistance.
Theuseofpowerunder(1), (2)or(3)shallnotbeexecutedin immoderatewaysthatstoptheforeignworkerfromworking,orcausestheemployer’senterprisetostoporengageduringthenightunnecessarily.
Section 99. The Registrar and the competent official must have an identification card inaccordancewiththeformprescribedbytheMinisterbypublicationintheGovernmentGazette.IntheperformanceofdutiesunderthisRoyalOrdinance,theRegistrarandthecompetentofficialmustshowtheidentificationcardtopersonsconcerned.
Section100.IntheperformanceofdutiesunderthisRoyalOrdinance,theRegistrarandthecompetentofficialshallbeofficialsunderthePenalCode.
For the purpose of arresting and suppressing offenders under this Royal Ordinance, theRegistrar or the competent official shall have the same powers and duties as those of anadministrativeorpoliceofficialundertheCriminalProcedureCode.
In the case that the Competent Official finds a foreign worker who is working withoutobtaining a work permit or works differently to what is specified in the work permit which is inviolationofthisRoyalOrdinanceandtheCompetentOfficialorderssuchforeignworkertoreporttothe police with the Competent Official but the foreign worker refuses to comply or escape, theCompetentOfficialshallhavethepowertoarrestsuchforeignworkerwithoutawarrantofarrestandshalltakethearrestedpersontotheofficeoftheinquiryofficialatonce.
CHAPTERVIII
PENALTIES

Section100/1TheDirector-General,theRegistrarortheCompetentOfficialwhofailtoreplytothenotificationwithintheperiodspecifiedunderSection5/1paragraphtwowithoutreasonablecauseshallbeliabletoafineofnotexceedingtwentythousandBaht.
Section101AnyforeignworkerwhoviolatesSection8shallbeliabletoafinebetweenfive
thousandtofiftythousandBaht.Afterthefineispaid,arepatriationoftheforeignworkershallbe
arrangedimmediately,exceptfortheforeignworkerunderSection63orSection63/1.
Theprovisions inparagraphoneshallnotbeenforcedontheforeignworkerswhoarethe
victims or witnesses under trafficking in persons offenses in pursuant to the anti-trafficking in
personslaws.
In the case where the accused under paragraph one will fully departs the Kingdom, the
inquiry official may fine the case in pursuant to the criteria, procedures and conditions together
prescribedbytheCommitteeandshallnotifytheDepartmentofEmployment,andwhentheforeign
workerdepartstheKingdom,thecaseissettledaccordingtothecriminalprocedurecode.
TheCommitteeunder paragraph three consists of the representative ofOffice of the
AttorneyGeneral as Chairperson, the representative of the Royal Thai Police asmember and the
representativeoftheDepartmentofEmploymentasmemberandsecretary.
Thecriteria,proceduresandconditionsofthefinethataretogetherprescribedbythe
Committee under paragraph three shall take into consideration regarding the severity of the
offense,therepetitionoftheviolationandthepreventionofoffenserepetitionoftheoffenderand
shallbepublicatedintheGovernmentGazette.
Section102 Whoeveracceptsa foreignworker thatviolatesSection9shallbe liable to
finebetweententhousandBahttoonehundredthousandBathperoneforeignworker.
If the violator under paragraph one repeats the violation, such violator shall be liable toimprisonmentforatermofnotexceedingoneyearortoafinebetweenfiftythousandBahttotwo
hundredthousandBahtperoneforeignworker,ortoboth.Suchpersonshallbeprohibitedtoemployanotherforeignworkerforthreeyearsfromthedateofthecourtfinaljudgmentforpenalty.
It shall not be considered that the family member living with the person who accepts a
foreign worker to work under paragraph one to be guilty of being a principal, an instigator or a
supporter.
Section103 Whoever fails to complywith Section 13 shall be liable to a fineof not
exceedingtwentythousandBaht.
Section104.Anypersonwhoviolatessection25shallbeliabletoimprisonmentforaterm
notexceedingsixmonthsortoafinenotexceedingonehundredthousandBahtortoboth.
Section 105. Any person who violates section 26 paragraph one shall be liable toimprisonment for a term of one year to three years or to a fine of two hundred thousand to sixhundredthousandBahtortoboth.
Section106 Any Competent Official who fails to perform duty under Section 30
paragraph twoshallbe liable to imprisonment fora termnotexceedingoneyearor toa finenot
exceedingtenthousandBaht,ortoboth.
Section107 Anylicensee whoispermittedtobringinforeignworkerswhodoesnotcomplytoSection31paragraphone,Section32,Section33,Section34,Section35paragraphone,Section41paragraphtwo,Section43orSection44shallbeliabletoafineofnotexceedingtwentythousandBaht.
Section108Repealed.
Section 109 Any manager authorized to act on behalf of juristic person or registered
employeeunderSection35whodoesnotcomply toSection35paragraphtwoshallbe liable toa
fineofnotexceedingfivethousandBaht.
Section110 Anyone who is not an employee that has the responsibility in bringing foreignworkerstoworkunderSection35buthasoperatedinbringingforeignworkerstoworkwiththeemployersintheKingdomshallbeliabletoimprisonmentforatermnotexceedingthreeyearsortoafinenotexceedingsixhundredthousandBaht,ortoboth.
Section 110/1 Any licensee who is permitted to bring in foreign workers delivers the
foreign worker to be an employee of a workers subcontract or wages subcontract employer, or
engagestheforeignworkertoworkbybeingtheworkerssubcontractorwagessubcontracthimself
or herself shall be liable to imprisonment for a term not exceeding one year or to a fine not
exceedingtwohundredthousandBaht,ortoboth.
Any licenseewho ispermitted tobring in foreignworkersdelivers the foreignworker tothe employer without notifying the Registrar under Section 41 paragraph three shall be liable toimprisonmentforatermnotexceedingsixmonthsortoafinenotexceedingonehundredthousandBaht,ortoboth.
Section111Any licenseewho ispermitted tobring in foreignworkersoremployeewho
perform duties relating to bringing foreign workers to work violates Section 42 shall be liable to
imprisonmentforatermofnotexceedingoneyearandfine twofoldofthemoneyorotherproperty
receivedfromtheemployerorforeignworkerorcostdemandedexceedingfromtherateprescribed
bytheDirector-Generalandthecourtshallordersuchlicenseewhoispermittedtobringinforeign
workersoremployeewhocommittedtheoffensetoreturnthemoneyorotherpropertydemanded
illegallytotheemployerorforeignworker,asthecasemaybe.
Inthecasethatthelicenseewhoispermittedtobringinforeignworkersrefusestoreturnthemoneyorotherpropertyinpursuanttothecourtorderwithinthirtydays,whentheemployerorforeignworkermakearequest,theDirector-Generalmaydeducttheguaranteeundertakenbysuchlicenseewhoispermittedtobringinforeignworkerstocomplywiththecourtorder.
Section112.Anypersonwhoviolatessection45shallbeliabletoafineoftwentythousandBahtandtoanotherfinenotexceedingfivethousandBahtadaythroughouttheperiodinwhichtheviolationoccurs.
Section113 Any employer who brings in a foreign worker to work with himself or
herself in theKingdombybeing theworkerssubcontractorwagessubcontractshallbe liable toa
finenotexceedingtwohundredthousandBaht.
Any employer under Section 46 paragraph one brings in a foreign worker to work with
himselforherself in theKingdomwithoutnotifyingunderSection46paragraphoneorparagraph
twoshallbeliabletoafineofnotexceedingonehundredthousandBaht.
Any employer who fails to show an employment contract when the Competent OfficialrequeststoinspectitunderSection46paragraphthreeshallbeliabletoafineofnotexceedingfivethousandBaht.
Section113/1AnemployerwhofailtonotifytheRegistrarorthelicenseewhoispermittedto bring in foreign workers when a foreign worker no longer works with them in accordance toSection46paragraphthree,orwhenacaseunderSection50paragraphoneoccurs,asthecasemaybe,shallbeliabletoafineofnotexceedingfivethousandBaht.
Section114 Anyemployerwhoviolatessection49shallbeliabletoimprisonmentfor
atermofnotexceedingsixmonthsandfine twofoldofthemoneyorotherpropertyreceivedfrom
the foreignworkerorhasdeductedexceeding the rateprescribed, and the court shallorder such
employertoreturnthemoneyorotherpropertydemandedillegallytotheforeignworker.
Inthecasethattheemployerrefusestoreturnthemoneyorotherpropertyinpursuanttothe courtorderwithin thirtydays,when the foreignworkermakea request, theDirector-Generalmaydeducttheguaranteeundertakenbysuchemployertocomplywiththecourtorder.

Section128.Anypersonwhomakesanydeceitful representation toanotherperson thathecanbringforeignersforworkingwithemployersinthecountryorcanprocureforeignworkersforemployers and, through such deceit, obtains money or property or any other benefit from thedeceivedpersonshallbe liableto imprisonmentforatermofthreetotenyearsortoafineofsixhundredthousandtoonemillionBahtforeachforeignerortoboth.I
anoffenceunderparagraphone is jointlycommittedby threepersonsupwardsorbyanorganisedcriminalunder the lawonanti-humantrafficking, theoffendershallbe liable toheavierpenaltythanthatprovidedbylawbyonehalf.
Section129.Anypersonwhoaidsandabetsthecommissionofanoffenceundersection128, whether the principal commits the offence outside the Kingdom or not, shall be liable toimprisonmentforatermofonetothreeyearsortoafineoftwohundredthousandtosixhundredthousandBahtortoboth.
Section 130. In claiming the property or value lost on account of the commissionof theoffenceundersection128orsection129onbehalfoftheinjuredperson,thePublicProsecutormaymakea claim togetherwith the institutionof a criminal actionormay subsequently file amotionwhensuchcriminalactionisundertrialbytheCourtofFirstInstance,withoutprecludingtheinjuredperson’s right to fileamotion formakinganadditional claim for lostpropertyorvalueunder theCriminalProcedureCodebeforetheCourtrendersjudgment.
Inthecasewherenoapplicationismadeforcompensationforlostpropertyorvalueunderparagraphone,iftheCourtrendersjudgmentspunishingtheaccused,theCourtmay,inthecriminaljudgment,ordertheaccusedtocompensatetheinjuredpersonforthelostpropertyorvalueastheCourtdeemsappropriate.Suchorderdoesnotprejudicetheinjuredperson’srighttoinstituteacivilactionagainsttheaccusedforclaimingadeficientamountinrelationtothelostpropertyorvalue.
Section 131Anyone seizes theworkpermit or other important documentof the foreign
worker shall be liable to imprisonment not exceeding six months or to a of fine between ten
thousandBahttoonehundredthousandBaht,ortoboth.
In thecasethat the foreignworkergivesconsent foranyonetokeeptheworkpermitor
otherdocumentsunderparagraphone,suchpersonshallallowandfacilitatetheforeignworkerto
accesssuchdocumentatalltimesasrequestedbytheforeignworker,anyonewhoviolatesshallbe
liabletothepunishmentinaccordancetoparagraphone.
Section132. In thecasewhere theoffender isa juristicperson, if thecommissionof the
offencebysuchjuristicpersonhasresultedfromtheinstructionoranactionofanypersonorfailure
togiveaninstructionorfailuretotakeactionrequiredtobedoneasadutyofadirector,amanager
oranypersonresponsiblefortheoperationofsuchjuristicperson,suchpersonshallalsobeliableto
thepenaltyasprovidedforsuchoffence.
Section133TheoffensesunderthisRoyalOrdinancewhicharepunishablebyafinealone,exceptfromtheoffensesunderSection101,theDirector-GeneralortheGovernorshallhavepowertosettlethecaseasfollows:
(1) theDirector-GeneralfortheoffensescarriedoutinBangkok.
(2) theGovernorfortheoffenses carriedoutinaparticularprovince.
In the case where there is an inquiry, if the inquiry official finds that any person has
committed an offence under this Royal Ordinance carrying the penalty in respect of which
settlement ispermissibleand suchpersonagrees to the settlement, the inquiryofficial shall refer
themattertotheDirector-GeneralorChangwatGovernor,asthecasemaybe,withinsevendaysas
fromthedateofsuchperson’sagreementtothesettlement.
Uponpaymentofafinebytheoffender,inanamountrequiredforthesettlement,within
thespecified timenotexceeding thirtydays, thecase shallbedeemed tohavebeenextinguished
undertheCriminalProcedureCode.

Section134.WhiletheNotificationundersection7hasnotbeenissued,theRegistrarmaygrantforeignerspermissionforengaginginanyworkexcepttheworkprescribedintheRoyalDecreeissuedundersection6oftheForeigners’WorkingAct,B.E.2521(1978).
Section135.Anyforeignerwhohasbeengrantedaworkpermitorhasbeengranted,asamatterofrelaxation,permissionforworkingundertheForeigners’WorkingAct,B.E.2551(2008)onthedatepriortothedateonwhichthisRoyalOrdinancecomesintoforceshallbedeemedtohavebeengrantedaworkpermitorgranted,asamatterofrelaxation,permissionforworkingunderthisRoyalOrdinance.
Work permits issued under the Notification of the National Executive Council No. 322,dated13thDecember,B.E.2515(1972)shallcontinuetobevaliduntiltheexpirythereof.
Section 136. Any employerwho has been granted permission for bringing foreigners forworking with him in the country under the Royal Ordinance on the Bringing of Foreigners forWorkingwithEmployers in theCountry,B.E.2559(2016)maycontinuethebringof foreigners forworkingwithhiminthecountry.
Section137.AnypersonwhohasbeengrantedapermitforbringingforeignersforworkingwithemployersinthecountryundertheRoyalOrdinanceontheBringingofForeignersforWorkingwith Employers in the Country, B.E. 2559 (2016) prior to the date onwhich this RoyalOrdinancecomesintoforceshallbedeemedtohavebeengrantedapermitforbringingforeignersforworkingunderthisRoyalOrdinance.
In the casewhere thepersonwhohasbeengrantedapermit forbringing foreigners forworkingwithemployersinthecountryunderparagraphoneintendstobringforeignersforworkingwithemployersinthecountryafterthedateonwhichthisRoyalOrdinancecomesintoforce,suchperson must comply with this Royal Ordinance before bringing foreigners for working withemployersinthecountry.
Section138.AllapplicationssubmittedundertheForeigners’WorkingAct,B.E.2551(2008)andtheRoyalOrdinanceontheBringingofForeignersforWorkingwithEmployersintheCountry,B.E.2559(2016)priortothedateonwhichthisRoyalOrdinancecomesintoforceshallbedeemedto be the applications submitted under this Royal Ordinance and the Director-General shallcompletelyrequiresupportingdocumentsorevidenceprovidedunderthisRoyalOrdinance.
Section139.AllappealssubmittedundertheForeigners’WorkingAct,B.E.2551(2008)andtheRoyalOrdinanceontheBringingofForeignersforWorkingwithEmployersintheCountry,B.E.2559(2016)priortothedateonwhichthisRoyalOrdinancecomesintoforceshallbedeemedtobetheappealssubmittedunderthisRoyalOrdinance.
Section 140. All affairs,money, rights, liabilities, property and debts of the Fund for theRepatriationof Foreigners from theKingdomunder theForeigners’WorkingAct,B.E.2551 (2008)shallbetransferredtotheForeigners’WorkingManagementFundunderthisRoyalOrdinance.
Section141.Intheinitialperiod,theForeigners’WorkingManagementPolicyCommissionshall consist of ex officio members under section 17 for performing duties under this RoyalOrdinancepro temporeuntil theappointmentofmembers representingemployees’organisationsandqualifiedmembersismadeunderthisRoyalOrdinance,providedthatthisshallnotbelaterthanonehundredtwentydaysasfromthedateonwhichthisRoyalOrdinancecomesintoforce.
Section142.Intheinitialperiod,theCommitteeoftheForeigners’WorkingManagementFund shall consist of ex officiomembers under section 78 for performing duties under this RoyalOrdinance pro tempore until the appointment of qualified members is made under this RoyalOrdinance,providedthatthisshallnotbelaterthanonehundredtwentydaysasfromthedateonwhichthisRoyalOrdinancecomesintoforce.
Section143.Anemployeewhosewageshavebeendeductedandremitted intotheFundfor theRepatriationofForeigners fromtheKingdomundertheForeigners’WorkingAct,B.E.2551(2008) prior to the date on which this Royal Ordinance comes into force and who has left theKingdomathisownexpensesshallbeentitledtoareturnofthedeductedmoneywithintwoyearsasfromthedateofleavingtheKingdom.Intheabsenceofarequestforareturnthereofwithinthespecifiedtime,suchmoneyshallvestintheFund.
Section144.AlloffencesundertheForeigners’WorkingAct,B.E.2551(2008)whichhaveoccurredpriortothedateonwhichthisRoyalOrdinancecomesintoforceandwhicharecapableofsettlementmaybesettledbytheSettlementCommitteeappointedbytheMinisterofLabourundersection56of the Foreigners’WorkingAct, B.E. 2551 (2008) prior to thedateonwhich thisRoyalOrdinancecomesintoforce.
All offences under the Royal Ordinance on the Bringing of Foreigners forWorking withEmployers in the Country, B.E. 2559 (2016) which have occurred prior to the date onwhich thisRoyal Ordinance comes into force and which are capable of settlement may be settled by theDirector-General of the Department of Employment or Changwat Governor as provided undersection61oftheRoyalOrdinanceontheBringingofForeignersforWorkingwithEmployersintheCountry,B.E.2559(2016).
Section 145. All by-laws or orders issued or given by virtue of the provisions of theForeigners’WorkingAct, B.E. 2521 (1978), the Foreigners’WorkingAct, B.E. 2551 (2008) and theRoyalOrdinanceontheBringingofForeignersforWorkingwithEmployersintheCountry,B.E.2559(2016) as in force on the date prior to the date onwhich this Emergency comes into force shallremaininforceinsofarastheyarenotcontrarytoorinconsistentwiththisRoyalOrdinanceuntilby-lawsorordersissuedunderthisRoyalOrdinancecomeintoforce.

In issuing Ministerial Regulations prescribing fees, different fees may be prescribed byreferencetooccupationallinesoroccupationallinestogetherwithworklocationsofforeigners.
Remarks: - thereasonstoenactthis legislationarethatwhiletheRoyalOrdinanceConcerningthe
ManagementofForeignWorkers'EmploymentB.E.2560(2017)specifiestheresponsibilitiesunder
law to the licensee who is permitted to bring in foreign workers, the employer and the foreign
worker, there are unnecessary complicated procedures and permission system, which are not in
accordance with the provisions of the Constitution of the Kingdom of Thailand. Moreover,
specifications concerning the violations and penalty provisions are as severe as the violations
regardingtraffickinginpersons.Eventhoughtheuseofforeignworkersthatviolatetheprovisionsin
thisRoyalOrdinancearenottheactsthathavethecharacteristicsoftraffickinginpersons,itcreates
panicand impact towards theemployerswithinhouseholds,agriculturesector, smallandmedium
enterprisessector,andthebusinessandindustrysector,whichhaveimpacttheeconomyandsocial
of the country. An amendment of such Royal Ordinance shall be made by using only necessary
permissionsystemandspecifyeasierandmorefacilitatedprocedures incontrollingand inspecting
foreignworkerswhocomeintowork,theworkoftheforeignworkers,therecruitmentofforeign
workerstopromotethepartnershipwiththerelevantsectorsthatarerelatedinthemanagementof
foreignworkersemployment system.Aswell as revising thepenaltyprovisions tobeappropriate.
Moreover,bypursuingthemeasurestotemporaryexemptthepenaltyprovisionsenforcedonthe
employersandforeignworkers,toprovidetimetocomplytosuchRoyalOrdinanceinaccordanceto
the Order of the Head of the National Council for Peace and Order No. 33/2560 concerning the
Temporary Measures to Rectify the Problems in Management of Foreign Workers' Employment
dated4JulyB.E.2560(2017)endedon31DecemberB.E.2560(2017),theproblemsreappearafter
theendoftheexemption.Therefore,thesituationsareemergent,urgentandunavoidable,inorder
toprotectthecountry’seconomicsecurity,thisRoyalOrdinanceshallbelegislated.
RoyalOrdinanceConcerningtheManagementofForeignWorkers'Employment(No.2)B.E. 2561(2018)
Section2 ThisRoyalOrdinanceshallcomeintoforceasfromthedayfollowing thedateofitspublicationintheGovernmentGazette.
Section67 Anyonewhoemploysaforeignworkerpriortotheenforcementofthis
RoyalOrdinanceandsuchforeignworkerobtainsalegalworkpermit,anotificationshallbemadeto
the Registrar under Section 13 of the Royal Ordinance Concerning the Management of Foreign
Workers'EmploymentB.E.2560(2017)
which is amendedunder thisRoyalOrdinance, suchnotification shall bemadewithin
sixty days from the date this Royal Ordinance is enforced. The Director-General shall specify the
proceduresregardingthenotificationthroughanelectronicmeanorothermeanthatwillfacilitate
theemployer.
TheProvisionsinparagraphoneshallnotbeenforcedonthetypesofforeignworkers
prescribedbytheDirector-General.
The foreign worker in which the employer has already submitted an application to
employ a foreignworker and has received a certificate to receive a nationality verification in the
KingdomoracertificateofleavingtheKingdomundertheannouncementoftheMinistryofLabour
concerning the Criteria, Procedures and Conditions inWork Permit Application and Permission to
WorkundertheRoyalOrdinanceConcerningtheManagementofForeignWorkers'EmploymentB.E.
2560(2017)priortotheenforcementofthisRoyalOrdinance,maystayintheKingdomandworkfor
thecurrentemployeruntiltheRegistrarhasanordernottoissueaworkpermit.
In necessary cases, the Minister shall specify the period the Registrar and the
CompetentOfficialhavetocarryoutanationalityverificationorotheroperationsthatareneededin
ordertopermitaforeignworkertowork.InthecasethattheRegistrarorCompetentOfficialfailto
completesuchoperationwithintheperiodspecified,theMinistershallconductadisciplinaryaction
towardstheRegistrarandCompetentOfficialimmediately.
Section68 The Minister’s announcement under Section 7 and the Cabinet’s
specificationunderSection63orSection63/1oftheRoyalOrdinanceConcerningtheManagement
ofForeignWorkers'EmploymentB.E.2560(2017)whichisamendedbythisRoyalOrdinancethatis
developedafterthisRoyalOrdinanceisenforcedshallnothaveimpactontheforeignworkersthat
havealreadybeenpermittedtoworkpriortothedaythisRoyalOrdinanceisenforced,suchforeign
workermay continue towork until thework permit expires, and if there is a desire for thework
permitextensionthenarrangementshallbemadeincompliancetotheRoyalOrdinanceConcerning
theManagementofForeignWorkers'EmploymentB.E.2560(2017)whichisamendedbythisRoyal
Ordinance.
Section69 The foreign workers under Section 63/1 of the Royal Ordinance
ConcerningtheManagementofForeignWorkers'EmploymentB.E.2560(2017)whichareamended
by this Royal Ordinance who have not yet been granted permission to workmay work until the
enforcementoftheMinisterialRegulation,tobedevelopedunderSection63/1paragraphthreeof
the Royal Ordinance Concerning the Management of Foreign Workers' Employment B.E. 2560
(2017),whichisamendedbythisRoyalOrdinance.WhentheMinisterialRegulationisenforced,such
foreign worker shall apply for a work permit within sixty days from the date the Ministerial
Regulationisenforced,andwhensuchapplicationissubmitted,theforeignworkershallbeableto
continuetoworkuntiltheRegistrarrefusestoissuetheworkpermit.
Regarding the sixty days period under paragraph one, theMinistermay prescribe an
extensionwheyconsiderednecessary.
Section70 The provisions of Section 30 paragraph one, paragraph five and
paragraphsixoftheRoyalOrdinanceConcerningtheManagementofForeignWorkers'Employment
B.E.2560(2017)whichareamendedbythisRoyalOrdinanceshallnotbeenforcedonthelicensees
who are permitted to bring in foreign workers under the Royal Ordinance Concerning the
ManagementofForeignWorkers'EmploymentB.E.2560(2017)priortothedateofenforcementof
thisRoyalOrdinance,andthe licenseewho ispermitted tobring in foreignworkersshall continue
the operate of business in bringing foreign workers to work until the license to bring in foreign
workersexpire.
Section71 TheprovisionsofSection101,Section102andSection119of theRoyal
OrdinanceConcerningtheManagementofForeignWorkers'EmploymentB.E.2560(2017)andthe
amendmentbythisRoyalOrdinanceshallnotbeenforceduntil1JulyB.E.2561(2018).
Section72 TheMinisterofLabourshallhavechargeandcontroloftheexecutionof
thisRoyalOrdinance.
