    Meeting Minutes All Residents Meeting

    21 September 2013 10am

    1 Welcome and Purpose of Meeting

    Martin (MB) welcomed those in attendance, thanked them for coming and called themeeting to order.

    MB explained that the Residents of Rowan Park Residents Association (RORP) hadbeen brought about by a group of residents who wanted to unite the community todeal with issues on the development, largely as a result of ongoing problems with theservice provided by the developer.

    RORP is not currently a legal entity of any sort, and it has been brought aboutthrough the efforts of a small group of residents on the estate. He stressed that thisinitial meeting was crucial to establishing RORP as a legitimate body whichrepresents the views and interests of all residents, and makes Rowan Park a betterplace to live.

    MB explained that the purpose of the meeting was also to gather the views ofresidents before the Chamonix Estates meeting on 3 October 2013.

    2 Legal Entity, Constitution and Officers

    Simon Bozzoli (SB) spoke briefly about the proposed structure of the association. It isproposed that RORP becomes a Community Interest Company (CIC).

    CICs are companies limited by guarantee which are formed for the express purposeof advancing the interests of a defined community. In the case of RORP, thecommunity would be all residents living within the boundaries of the Rowan ParkEstate. Residents include homeowners and private and housing association tenants.

    SB stated that Merton Council do not have a formal process for recognising

    community groups, and that as such there is no formal requirement for a minimummembership level. It was generally agreed that the association would need to have agood level of membership across the estate if it was to be legitimate.

    SB explained that work had been done on development of a constitution for theassociation. The constitution will contain the guiding principles of the association aswell as an operational guide for the running of it. Residents are therefore encouragedto become involved and comment on the draft. A first draft will be published asap.

    The association, as a minimum, must have a secretary, a treasurer and achairperson. These three officers will be responsible for the running of theassociation. They will also head up a committee of residents which is made up of arepresentative from each block or terrace. Attendees were asked to consider whether

    or not they would have time to be involved in the committee in this way.

    Officers and representatives will be elected at the next all residents meeting dateTBC.

    3 Common Issues with the Developer

    Drainage and Sewers:

    There was unanimous agreement from all present that a comprehensive solution tothe issues to do with the sewer blockages was provided by the developer. Therewere rumours that the sewage installation had not been done to the correctspecification, and all residents present requested that Crest Nicholson provide acomprehensive update on the problem, and their proposed solution.

    Damp Floor Issues:MB raised the issue of flooring in some properties becoming a problem and askedthose present if there had been similar issues in other homes. There were 8households who had been affected by a similar problem. Of the approximately 30households present at the meeting, 8 households is a significant percentage. Therewas agreement that the association should seek resolution of the issue from Crest.

    Solar Array Installations:There was some discussion around the solar array installations on houses, and thepromises that were made to residents regarding income generated by the arrays atthe time of purchase. The promises made ranged from 100 per year to 500 peryear. There was further discussion about the evidence required to sign up for FITs.Crest has taken an incredibly long time to provide this. RORP to chase for all homes. RORP

    4 Waste Management and Bins

    MB discussed the issue of rubbish and fly tipping around the estate. These issues arecaused by the lack of bins available to residents. It was unanimously agreed that:

    - All rubbish and recycling should be kept in your back garden until the night

    before bin collection day.- All residents would try to police fly tipping, and speak to someone from the

    association if a perpetrator was discovered.

    It was pointed out that the lease agreement and contract for each property statesclearly that rubbish should not be kept in front of the front elevation of a home until ashort time before collection.

    It was further agreed unanimously that the association would make a request to CrestNicholson to provide wheelie bins for all households with no access to communalwaste facilities.

    5 Damaged Planting, Watering, Maintenance

    All agreed that the current situation in terms of maintenance of gardens and plantingacross the estate is ineffective. There are numerous plants and beds which are dyingas a result of the warm summer, and these need to be replaced.

    All present also agreed that the planting that has been done along the front of theestate on Rowan Rd (where the current sales office is) is much more attractive thanthe planting further back in the development. The residents would like Crest tostandardise the planting throughout the estate.

    Crest / Chamonix should be asked for a schedule of maintenance of the gardenswithout delay. This will allow us to establish whether or not it is sufficient, and also to

    enforce it.

    Oliver Wright (OW) mentioned that Chamonix have already produced a contractmaintenance summary of frequency (see appendix 2). However as the only areashanded over to Chamonix are the flats. CN should be keeping to this schedule andnot having done so has caused many plants to die.

    6 Weeding, Watering and Gardening Schedules

    There is a problem across the development where weeds are coming up through thepaved walkways and streets. This needs to be properly maintained to ensure thatstreets and walkways are not damaged, and to preserve the aesthetics of the estate.

    All agreed that Crest / Chamonix should provide a clear schedule of when watering,

    weeding and general gardening (hedge cutting, tree trimming, mowing) will be carriedout. This can then be enforced and altered.

    It was also suggested that a commitment to altered schedules should be securednow to ensure the management company will alter the schedule to preserve ourgardens in the event of another hot summer.

    7 Parking Arrangements and Visitor Spaces

    SB raised the issue of parking generally on the estate and asked for residentsthoughts and views.

    One resident had brought with him his TP1, and quoted from Schedule 1 of Panel 12point 9: The right (in common with owners of the properties and of other dwellings onthe Estate and for visitors to both the Property and other properties on the Estate) totemporary use of the Non-Allocated Parking Spaces for the purpose of parking asingle fully taxed and licenced private motor car or motor cycle in a roadworthycondition capable of being parked wholly within the boundaries of the Non- AllocatedParking Spaces subject to availability on a first come first served basis..

    By Definition the non-allocated parking spaces means the casual parking spaces on

    the Estate tinted green and marked V on the Plan or such greater or lesser parkingspaces as may from time to time be allocated by the Transferor.

    It was agreed generally that an urgent resolution be sought to this matter, as failure toresolve the issue might result in the introduction of parking fines / charges by themanagement company a situation that none of the residents would be happy with.

    It was generally agreed that with immediate effect:

    Allocated parking spaces are for the exclusive use of their owners.

    Residents would cease parking on pavements immediately.

    All residents would try to enforce and stick to the speed limit 10mph.

    Visitors spaces may be used respectfully until a resolution is finalised.

    It was suggested that there are some issues with being able to see the demarcations

    between street and pavement. While these are clearly different colours, one residentthought it may be an idea to plant trees on some of these boundaries to furtherdelineate the difference.

    All agreed that this was a sensible idea, that would also contribute to the aesthetics ofthe estate, and that Crest / Chamonix should be request to do this work. RORP

    8 Street Care, Rumble Strips, Disabled Access

    There are numerous places in which the private roads on the estate are cracked,crumbling or falling apart. Manhole covers are coming loose, and bricks / paving iscracked and broken.

    The bill for maintaining these issues will eventually fall to the Resident of the estatevia the management company, as the road are private roads, and it is thereforeimperative that Crest Nicholson leaves behind a robust and lasting infrastructure.

    A subcommittee has already been formed regarding these issues and a list is beingprepared to be sent to the developer for action.

    9 Lanscaping of Park and Common Areas

    All agreed that the current state of the park is not acceptable. It is the responsibility ofCrest Nicholson to ensure that the park is handed over to the council in a satisfactory

    state.

    The residents are not happy that the park has had lawn seed sewn over it there arerocks, broken glass, stones and numerous weeds in the soil where the seed hasbeen sewn, and this means that the grass is not suitable for children to play on, or forgeneral enjoyment. The residents all agreed that the park should be turfed.

    Other issues include the pond (how is the water level going to be maintained, shouldit be lined) and the other overflow / drainage ditch (there are serious concerns thatthis will be smelly and unsightly if not properly set up.

    The residents would like a clear plan from the developer and to approve this plan indiscussion with the develop prior to the parkland being finalised.

    It was suggested that Residents of Rowan Park should not only be used as amouthpiece to raise issues with Crest Nicholson.

    All agreed that the association should also be responsible for arranging events andgenerally making Rowan Park a better place to live.
