  • INTRODUCTION.

    The Kegister of Burgesses and Guild-Brethren of the City of

    Edinbm-gh is contained in a number of MS. vokimes, carefully

    preserved in the Town Clerk's fire-proof safe in the City

    Chambers.

    After 30th May 1666 the entries of apprentices are contained

    in the scroW volumes, along with those of burgesses and guild-

    brethren. The roll of these is being issued separately.

    Of these volumes Nos. 1 to 8 have been used in compiling the

    roll which follows, beginning at 17th May 1487, and ending in

    Vol. 8 at 31st December 1700.

    The very early entries are taken from the minutes or records

    of the Town Council. The scroll volumes, whose contents have

    not been entered in the official volumes, or have been lost with

    them, are very badly and hastily written, and in many cases the

    names, christian and, more particularly, family, are very difficult

    to decipher, the rather that no rule of spelling has been observed,

    and the attempts at a phonetic rendering are bewildering.The

    Celtic names are really dreadful.

    The earhest entries, being in ancient script, and also in

    Latin abounding in contractions, offered obstacles which would,

    it is to be feared, have wrecked the undertaking, but for the help,

    so graciously given, chiefly by Mr. John Jarvis, Session-Clerk

    of the City Churches, by Mr. Henry M. Baton of H.M. Kegister

    House, and by Miss Marguerite Wood, Keeper of the Burgh

    Records, to all of whom I tender my very grateful thanks.

    10 July 1550.The Council passed an act, that no one be made freemanor burgess, except by bailies sitting in judgement : their names to be put inthe "lokkit buke"2in presence of the Dean of Guild. The duty to be paidfor burgesship to be v.li. (^5) and for guildry .\.li. (^10), the dean to pay to theprovost, bathes and clerks for the time v.li. for each of their burgesships, andthey to make no burgesses by themselves. The rights of burgesses, sons anddaughters to be observed.

    25 Sept. 1555.In reply to a question put by Mr. John Preston, treasurer,the provost, baillies and counsale declare the treasurer to have no duty of

    burgesship yearly {i.e. the right of admitting a burgess in virtue of his office).

    gude and thankful service done be Maister John Spens the year bygane in theoffice of baillierie in the absence of Edward Litill, electit baillie for this presentyeir, he being in the parttis of France, ordains Johnne Charteris dene of gyldto gyf the said Maister Jhonn Spens the dewtie (entrance fee) of ane burges-schip and the samyn salbe allowit to him, etc."

    15 March 1560-1."The samyn day the baillies and counsale ordains allactis creatiouns and privelegis of burgesses to be writtin in this buk fra thisfurth be writtin and extractit in our awn maternale toung for satefeing of thecommoun pepill quha hes murmurrit the Ignorance of the style usit in this bukof before." \^But the five entries which follow, up to 2^ March, are in Latinas of old. ^

    3 Feb. 1562-3. (C.)Wm. Robertsoun, flesher, dwelling in Sanct Marye

    Wynd, warned under threat of tynsale of freedom, to dwell within the town andno longer gather hides, tallow and skins in great number and despatch thesame within night to Leith, contrary to acts and statutes.

    23 .(4/rz7 1563.John Paterson, deacon of the masons, makes petition for

    free gildry, for good service rendered on the New Tolbuith. The councilanswers that it is not in use to grant this privilege to unmarried men, butwhen he shall happen to have a lawful wife, his desire shall be considered andbe satisfied.

    23 Feb. 1566-7. (C.)Wm. Byrny, B. and G., renders his freedom of B. and

    G. to the provost and council, and is commanded in time comingto pay his

    custom, etc., and to be held as an unfreeman, making claim to no liberty

    by said freedom.

    9 May 1567. (C.)(i^/a^^/David & James Fairlie's bairns.)Councildeclairs that they will not "deleit the name of David Fairlie furth of the gildbuke nor may not do the samyn be the law and fynds that his bairns aucht to

    possess the privilege of thesaid act and as to James Fairlie bairns they of

    right can grant them na privilege without his name be found in the buke butin respect he was an honest man and that gif his name be not in the buke itwas be negligence of him that soucht not the samyn and in respect his faderwas bayth burgess and gyld (br.) thai promis to be gude to the said Jan)es

    iZ June 1567. (P.R.)Act of council that no outlandish men be made

    burgesses till they be married and have"stob and staik" within the burgh,

    and no craftsmen save such as have completed their apprenticeship in the

    said burgh.

    8 Aug. 1567. (C.)Hercules Meth.ven, baxter, having been imprisoned for

    fifteen days as accused of deforcing a town's officer, binds himself never to dothe like again, under pain of tynsell of freedom and banishment.

    25 Aug. 1567. (C.)Hercules Methven, baxter, has his freedom restored.

    15 Nov. 1567. (C.) Charles Studeman, cook, is made G. by act of C. of20 Nov. 1567, "and hes satefeitt the dene of i;yld for dewtie and bynds andobleisses him that fra this day furth he sail nochtt be sene upon the calsay alsthe remanentt commoun kukis with meitt to sell in commoun housses, but sailcauss his servands pas with the samyn and that he sail hold his taverne onthe hie gaitt fra Witsonday furth nixtt and behaiff himselfe honestlie in all

    2 April 1568. (C.)"The caus quhy thir sowmes ar delivered to AdamFullertoun and he to be chargit therewith is that Alexr. Park (former) dene of gildbeing unable to repair the warks of the kirk, the said Adam takes the burdingthereof upoun his consent and at the counsales command in special of thirpersonis quha hes lang occupeit the liberty, having na freedome, and foundfurth (found out) be him."

    26 Jan 1568-9. (C.)--The baillies and counsell "considering the greattynsell of Jhoii Weir fermorer of the pittie customs the yeir past be resson ofthe pest, ordains Jhone Harwood, dene of gild, to gif to him the dewtie of aneburgesship.''

    26 Sept. 1570."The whilk day the provest, baillies and counsall under-standmg the greit hurt that cumes to the hale merchant estait of this realme bethe solistatioun of lordis, greit men and courteors quhais servands and kvnsmenar maid burgesses and fiemen of burgh without paying of any dewtie thairforto the greit hurt of the commoun weill of all burrois And becaus sic requeistescannocht commounlie be refusit for eschewing of the displesour of the said greitmen and courteours.     25 Oct. 15/0. (C.)John Palmer, nit., is ordained to ask forgiveness of

    Adam FuUertoun, dean of gild, in presence of the whole council, upon hisknees, for injurious words spoken unto him, and to deliver the keys of his booth

    to the baiilies to remain with them till he be made gildbrother or find cautionto desist from using of gild merchandice. On 15 Nov. he is made gildbrother,and acts himself to pay x.H. betwix and Martinmas next.

    12 Sept. 1572.Gawane Pery is made burgess gratis for good service done

    by him to the good town in working at the new wester bulwark.

    19 Dec. 1572."The quhilk day the baiilies and counsall haveing respect of

    the gudewill borne towartes the gude toun and nychtboures thereof be CapetaneThomas Craufurd and that he is presentlie lyen in our Soverane Lordis serviceat the sege of the Castell of Edinburgh and hes to his quarter ane gret part of

    the landis lyand abone the butter trone upoun the south syde of the hie street

    Quhairby the said landis will be uteriie wrackit Incaiss he tak nocht gret heid

    and cure thairto Thairfor and for gude pleasoure to be done in tymes cuming to

    the gude toun Hes at his requeist maid Mr. Robert Purwe?s burgess and gild-brother of this burgh frie gratis without payment of any dewete therefor Quhagave his ayth according to the ordnance Proveiding alvvayss the said Mr.

    Roberts bairnis gottin or to be gottin broke (enjoy) na prevelege be vertew of his

    rycht bot allanerlie himself according to the ordnance prescryvet anent the

    personis that obteins their fredome and libertie gratis.

    II Feb. 1572-3.''The samyn day the baiilies and counsall haveing respectof the gude behavioure of Walter Mackesoun and that he is not of mynde touse the tred of marchandice but allanerlie to keep and hald ane comoun ostelarhous within this burgh Quhilk salbe ane gret releve to the n\ chlboures of this

    burgh and that oure soverane Lordis Liegis may the mair better be esit andservit within the samyn thrby Hes admittet the said Walter to be their

    burgess and gildbrother for payment of the dewete of twentie pound allanerlie

    Notwithstanding of the act maid in the contrair that nane sould be ressavit but

    payment of three scoir pound Qlk act the said baiilies & counsall be thirpresents dispensis with for and in respect of the premises."

    13 Feb. 1572-3."The quhilk day the baiilies and counsall being convenit

    comperit Johne Neill skynnar sone and apperand air of Rychart Neill

    skynnar burgess of this brugh and presentet his said fatheris ticket of burges-

    ship and in respect thereof desyred to be admittet their burgess be vertew of

    his said fatheris prevelege for payment of the Dewete usit and wonat Qlk

    prevelege the saids baiilies and counsall wald not consent that he should

    broke In respect that the said Ry[char]t wes within this brugh the tyme of

    the Detention thereof agains our Soverane Lord and that there wes ane ordinancemaid that sik persones that remanet within the samyn suld tyne thair liberteisand fredome And yet thai having consideratioun that the said Johne Neill wasactuallie in Leyth and watet thair on the Kingis Maiesteis service Hes admittethim to be thair burgess for payment of threttene shillings allanerlie to theDene of gilde."

    I Oct. 1574." Robert Abercromby, saidler, being dischairgit of his fredome

    of burgesshipe and gildrye for making bargane with ane unfreman in Leyth and

    cuUoring (colouring; of his gudes under cullor of his awn, hes payit to the dene

    of gyld for his libertie to be frie again, xv.li."

    9 Nov. 1576. (C.)"The provest, baiilies & counsall ordains that all sic asues bene burgesses befoir the act of the commissioners of burrowes beand wonet

    I Jan. 1577-8."The provest, baillies and counsale remembering the

    monyfald benifitts resavet be them for their commounweillbe the moyane of

    Robert Campbell, ane of the scribis of our soueranelordis sessioun, and

    houpping the samyn gude will to continew with him, Thay grants gavis and

    disponis to him and his airis lawfuil gottin or to be gottin the fredome of ane

    privelege of fre-burgesses and gyld-broder and they did resave his aith accordingto their consuetude in sick caiss."

    8 Oct. 1578."The provest, bailleis and counsel! understanding that Lucas

    Willsoun, dene of gild, has oversein himself in making of Thomas Bell burgesand gildbrother for the soume of threttie punds allanerlie, it being statuit thatnane sail pass the said dignitie under the soum of fourtie pund at lest Quhair-foir thay ordane the said Thomas Bell to deliver to the said dene of gild ten

    pund in compleit payment of fourtie pund and that nane heireficr be maid

    burges nor gildbrother except thay be admittit in presens of the provest, bailleis

    and counsell or at the lest the maist part thereof.''

    I Jan. 1579-80. (C.)"The same day the council ordains Lucas Wilson,

    dene of gild, to bring with him the lokkit buke on Wednisday nixt to the effectthat John Setoun, littistar, efter his admission and aith taiken, may be insertas burges & gild[brother] of this burgh be rycht of Mrt. Nisbett his wyfe, dochtcrto umqll. Adam Nesbett therein."

    6 Jan. 1579-80. (C.)Act of C. that burgesses and gildbrothers shall beadmitted only at four times in the year, viz. at the four head courts ; and that thelocked gild book be put up in the charter house, not to be removed till two daysbefore the said head courts, that the rights of fathers of applicants may beexamined.

    20 Jan. 1579-80. F"our hat makers, mts., made B.3 Feb. 1584-5.

    A new form of burgess oath was introduced.3 Nor/. 1 591.

    A new form of oath was ordained in respect so manyburgesses take little or no regard to the keeping of their burgess oath, especiallyin legard to extents, watching, etc. This oath ran as follows (7 Dec. 1591) :

    The Aithe of ane Gildbrother."

Swa helpme God."The prayer of invocation used at the meeting of the Guild Council:"O

    most gratious God and loveing father we most humblie beseik thy majestic forthy Chryst's saik to be present in meting with us, in giveing ane b'lissing to owraiTaires and seing thow art only wyse be thow owr wisdome in all owr adoesAnd grant (all partiahtie and all corrupt affections set assyd) we may deall inall maters presentit to us with upryght hearts and single eyes as in thy presence,sua that the issuit of our travells by thy speciall grace may alwayes tend to theglorie of thy name the weillfair of this our native toun and the comfort ofeveriefaithfull member of the same through Jesus Christ our Lord and onlvSaviour. Sobeit. Amen."

    15 Apr. 1600. -Mr. Wm. Watson, born 1558. Minister in St. Giles. Put inward Jan. 15S6 for speaking boldly before the King. An intimate friend ofJames Melville, who gave him shelter at Kilrennie when order was given forhis apprehension as being concerned in the tumult of 17 Dec. 1596. He wasreleased from the horn and restored in July 1597, but owing to his refusal

    to accept the King's story of the Gowiie conspiracy, he was banished fora time in 1600. He was one of the eight ministers summoned in 1606 toappear before the King at Greenwich, and was warded with Dr. Vaughan,Bishop of London. In 1607 he returned to his parish of Burntisland, whencehe was translated in 1615 to Markinch, where he died in 1619.

    In 1617 James VI. paid his first and only visit to Scotland after hissuccession to the English crown. The nobles, gentlemen and household whoattended the banquet given on the 26th June were made burgesses and gild-brethren gratis.

    16 Nov. 1636."The same day in pns of the provest, baillies, deyne of gild,thesaurer and ane pairt of the gild counsell being conveynit, William, Lord

    Alexander, Sir Arthur Alexander (his brother), mr. of wark to his majestic,Henrye Alexander, sone to the ryt honll. Williame, Erie of Striveling, andsecretarie to the Kyng's maist excellent majestic for Scotland and ane of his

    majestie's privie counsell for both kingdoms, and Mr. James Gordoune, keeperof his majestie's signet, compeirand ar maid burgesses and gildbrethren of this

    burgh of Edinburgh, and gave their aith iti cotnmuni forma conforme to aneact of counsell of the daitt the sext of September 1637," whereby this is ratifiedand promise given to grant burgess-ship to Malcolme Alexander.     7 March i66o. Sir James Stanfield of New Milns, in East Lothian, and hisson Philip. Sir James, a Yorkshire man by birth, is said to have been acolonel on the Parliamentary side in the Civil War. He came to Scotland,after the battle of Dunbar, 1650, and having acquired certain lands on the southbank of the Tyne, a mile east of Haddington, he set up a cloth manufactory,named New Milns. Later he was knighted by Charles IL, and his clothindustry was encouraged in 1681 by James, Duke of Albany and York, later

    James VH.He also acquired property in Edinburgh, both in Blackfriars Wynd, and in

    what is now called World's End Close, where Sir Wm. Bruce of Baicaskie dis-poned part of his property to him, whence the close at one time bore the nameof Stanfield's CI. He also owned the ground in Leith whereon the glass workwas built later.

    He was made a burgess and guild-brother of Edinburgh 7th March 1660,being then secretary to General Major Thomas Morgan, gratis, and ;^5 votedto him, for his good service done to the town.

    On 2 July 1679 Mr. Philip Stanfield, fiar of New Milne, was made burgessand guild-brother of the burgh, gratis. He must have been Sir James' elderand most unsatisfactory son, who was married, and lived in his fatlier's house.

    On the 28 November the body of Sir James was found among the ice ina pool in the river. It was secretly buried by his son, as that of a suicide.

    But the Lord Advocate, hearing of the case, gave orders for the exhumationand examination of the corpse. This was carried out, and the surgeons per-formed the autopsy, in the course of which they made an incision in the neckof the deceased. When Philip, at the request of the surgeons, lifted the headof his dead father, to help in replacing the body in the coffin, the blood suddenlyshowed on the linen swathing, and Philip, horror-struck, dropped his burden,and fell back in a faint. In due course he was arrested, and tried before theHigh Court of Justiciary in February 1688, and found guilty. Sir GeorgeMackenzie assisting the Lord Advocate in the prosecution. He was hanged atthe Market Cross, and his body was hanged in chains at the Gallow Lee, betweenEdinburgh and Leith, and finally disappeared.

    The New Milns property was sold, on the winding up of the cloth company,to the notorious Colonel Francis Charteris, who changed its name to Amisfield,after that of his family seat in Nithsdale. {^See "Twelve Scots Trials," by Wm.Roughead, W.S., and "Sir Richard" in Sir Walter Scott's " Minstrelsy of theScottish Borders.")

    In the early admissions of burgesses payments of duty were sometimes "bycomposition." In some cases spices and wine, a banquet in fact, were

    furnished, and accepted.Burgesses were often admitted by the provost, or a bailie, or the treasurer,

    apart from the Dean of (iuild Court.When thus admitted by a bailie, it was by him as a bailie

    "et ea ratione."

    This was corrected later.

    A master often is admitted burgess in order to be able to take an apprentice.The date, between brackets, in the entry of admission of a craftsman as

    B. or G. by right of his apprenticehip, is that of his entering his master'sservice.

    When a letter is given in brackets in a name, as in "Caldwell(s)," it indicatesthat both forms (" Caldwell" and "Cald wells") are found.

    A good many entries appear twice, under different dates.

    If "gratis" be not mentioned, the burgess paid for his burgesship.

    Dates. It must be remembered that under the Old Style the year ended24 March.

    Thus I Jan. \'-^oo {p.'^.') succeeds 31 Dec. 1500, and should be written i Jan.1 300- 1.

    The New Style was adopted ist Jan. 1600.

    There are very few addresses or residences given, e.g. "John Adamsone for-nent the crose." 12 Jan. 1 570-1

    Residence.^\Nhtn a man was made a burgess of Edinburgh it was necessaryfor him to reside within the burgh. Instances occur frequently of indwellers inLeith, who, on being made burgesses, are required to remove and find residencein Edinburgh, under the paine of tinsell (loss) of their freedome, eg. FrancisAird and Rob. Dowglas, 27 Oct. 1669. Patrick Crightoun, mt. was forced toleave tlie Canongate and reside in Edinburgh 17 March 1648.

    An applicant for burgesship could choose one qualification therefor, ratlierthan anotherprobably preferring the cheaper. Thus a man eligible as'prenteis to an employer, or as guidson to a burgess, would choose the latter

    qualification.Not infrequently a group of one trade entered as burgesses at one time a

    bunch of tailors, hatmakers. or fieshers, while on special occasions, such asbanquets, or the honouring of a special family, as many as a hundred might beadmitted burgesses and gild-brethren, gratis. Such burgesses, however, as arule, enjoyed the privilege personally, without the riglit to transmit it to theirbairns.

    Moses Mosias, a Jew, was allowed to trade in the town, with a promise, forhis encouragement, that if he become a Christian, he shall be admitted burgess,gratis (M.T.C. 14 Dec. 1698.)
