IMMIGRATION ACT 2014

The Immigration Act 2014 established the requirement for private landlords (or

their appointed agents) to verify the identity and right to rent of all occupants aged

18 or over in the UK. Landlords must obtain, verify and store evidence that these

checks have been completed.

Under the Act, landlords must see original documents that satisfy the Home Office

requirements from a list of 2 document groups. Landlords must also inspect the

documents to ensure that they are genuine and have not been tampered with,

many of these document types will have never been seen by most landlords. The

landlord must also make reasonable inquiries to establish that only the occupants

listed will live at the property. All documentation must be securely stored in a

tamper free format for 12 months after the tenancy ends.

WHAT DO WE THINK?

In our opinion this new legislation will place an overbearing burden on landlords.

It's difficult to implement and is administratively challenging because of the lack of

knowledge of genuine or forged document types. We believe this could prove a

significant business risk.

National rollout commences in 2015

£3000 fine for non-compliance

Right to rent of all occupants (not just tenants) over 18 must be verified

You must inspect documents and make sure they are valid and tamper free

You must ensure you determine the total number of people living at the

property

Original documents must be seen in person or by live video feed

Document copies must be kept for 12 months after the tenancy ends

All documents must be produced on request by the Home Office
