Notice Claiming the Right to Buy
This notice is or use by certain secure tenants o local authorities, and o
certain housing associations and other bodies, who wish to claim the right to
buy their homes.
Beore lling in each part o this notice please read the notes relating to thatpart and the inormation pack which should have been provided by your
landlord.
You may also nd it helpul to read the Government booklet Your Right to
Buy Your Home. You can get a copy rom your landlord or a Citizens Advice
Bureau or by writing to Communities and Local Government Publications,
PO Box No 236, Wetherby, West Yorkshire, LS3 7NB.
I you need urther advice you can get help rom a Citizens Advice Bureau or
you can consult a solicitor. Help with the cost o advice rom a solicitor may
be available under the Legal Aid Scheme.
When you have flled in this notice, take it or send it by recorded delivery
to your landlord. I you take it by hand, ask or a receipt. Keep a copy o
the completed notice yoursel.

Part D: Qualifcation and discount
Please read these notes beore flling in the table(s) on pages 5–9.
1. I you were a public sector tenant beore 18 January 2005, you must have been a tenant or a qualiying
period o at least two complete years to be eligible to buy your home. You are then also eligible or a
discount. Yourdiscountcannotbegreaterthanthemaximumdiscountfortheareainwhichyoulive;see
the booklet Your Right to Buy Your Home. However, subject to that limit, your discount is 32 per cent i youare a tenant o a house, and 44 per cent i you are a tenant o a fat, plus any extra discount or additional
complete years as a public sector tenant. I you are buying a house, you are eligible or one per cent more
discount or each additional complete year, up to a maximum limit o 60 per cent. I you are buying a fat,
you are eligible or two per cent more discount or each additional complete year, up to a maximum limit
o 70 per cent.
2. I you became a public sector tenant or the frst time on or ater 18 January 2005 , you must have
been a tenant or a qualiying period o at least ve years to be eligible to buy your home. You are then
also eligible or discount. Your discount cannot be greater than the maximum discount or the area in
whichyoulive;seethebookletYour Right to Buy your Home. However, subject to that limit, your discountis thirty ve per cent i you are a tenant o a house, and ty per cent i you are a tenant o a fat, plus
any extra discount or additional complete years as a public sector tenant. I you are buying a house, you
are eligible or one per cent more discount or each additional complete year, up to a maximum limit o
sixty per cent. I you are buying a fat, you are eligible or two per cent more discount or each additional
complete year, up to a maximum limit o seventy per cent.
3. You need not have spent the ull qualiying period in your present home or with your present landlord,
and in some circumstances periods which another person (such as your husband, wie or civil partner) has
spent as a public sector tenant or armed orces occupier can count towards your qualiying period.
A public sector tenant is a tenant o one o the public sector landlords listed at the end o this orm
who occupies the property as their only or principal home. This may include an employee living in
accommodation provided in connection with their job.
An armed orces occupier is a person who occupies accommodation provided or them as a member
o the regular armed orces o the Crown.

What happens next?
Public sector landlords (see Parts D and E)
Your landlord must reply to your claim by either
admitting or denying the right to buy. I the right to
buy is denied, reasons must be given. Your landlord
has our weeks to reply unless the period on which
you rely to qualiy or the right to buy includes a
period spent as a tenant o another landlord. In thatcase your landlord must reply within eight weeks.
Ater admitting your right to buy, your landlord must
notiy you o the proposed terms o sale, including
the purchase price. At that stage you must decide
whether to go ahead with the right to buy or to
withdraw your application.
This notice does not commit you to buying the
property. You may withdraw at any time beore
completion by notiying your landlord in writing.
