Mission StatementAt Rialto Fire Soccer Club we strive to inspire all of our players to push themselves beyond the limits they ever thought possible.  Whether that be on the field, in the classroom, at home, or within the community.  We are a smaller club with between 15 to 20 teams.  We look at this as a good thing... IntroductionWelcome to Rialto Fire Soccer Club.The Rialto Fire Soccer Club provides a fun, safe and healthy game for all its members. Our goals is to compete at the highest level possible, at an affordable cost. Our ambition is to develop highly competitive teams for players that might have their sights set on a college soccer scholarship or playing for the US Olympic or National teams, and simultaneously developing exceptional young men and women that can contribute to their community.

What is the Rialto Fire Soccer Club? We are a dynamic body of over tirelessvolunteers and administrators donating time, energy and money to make the game better for the kids. Rialto Fire Soccer Club has dedicated coaches and players between the ages of eight and nineteen. RYSL is a nonprofit and educationalorganization whose mission is to foster the physical, mental and emotional growth anddevelopment of Rialto’s youth through the sport of soccer. Our job is to make it fun and instill in young players a lifelong passion for the sport.

How does it all work? From our humble beginnings in 1989, with just over 200 registered players, to our current registration of over 1,200, RYSL and the Rialto Fire Soccer Club have quickly become the largest youth organization in the city of Rialto.The organizations have always been recognized as a leader in Rialto youth sports. The Rialto Fire Soccer Club has an aggressive Risk Management program to help ensure the safety and well-being of all its members. As the Rialto Fire Soccer Clubcontinues to grow and mature, we are able to hold down player costs with the generous help ofcommunity sponsorships and various league fundraisers. Through a democratic structure, the membership of the Rialto Fire Soccer Club is able to provide uniform rules and guidelines. These guidelines facilitate inter-city, inter-state, and even international play. The Board of Directors conducts the administration of the Club. The members of the Club elect each of these board members into office. All participants should adopt a positive attitude and encourage both the players and the volunteer workers. Be patient and have fun!

This handbook has been developed in response to repeated questions over the years and some questions will still be left unanswered. It is hoped that this booklet and the information contained within will assist both parents and coaches as they participate in The competitive world of Club Soccer.

All members of the Club are invited and encouraged to attend Board meetings held regularly each month at the Ayala Fire Station located across from Jerry Eaves Park. Please contact a board member if you would like to address the Board.All parents of participating players are also encouraged and asked to help in some capacity each season. There are many ways to volunteer, such as

coach, assistant coach, referee, assistant referee, team coordinator, field setup, concession stand and fund raisers. We need individuals who are willing to be referees each year. Most volunteer jobs are easy, fun and very rewarding. Get involved, you’ll love it!!

Codes of ConductThe United States Youth Soccer Association (USYSA) and the Rialto Fire Soccer Club are both veryinterested in having responsible and competent coaches that are willing to assist parents and other interested persons to become better qualified.

The USYSA and The Rialto Fire Soccer Club subscribe to the principle of teaching by example and both insist that administrators and coaches conduct themselves in such a manner as to set an example that if followed would enable every player to be a credit to the game.

The USYSA and Rialto Fire Soccer Club place the game ahead of any desire to win, be it on League, District, State or National level. If any administrator or coach, no matter how capable, fails to control themselves, the team, or has players or parents who consistently contravene the laws of the game, the USYSA and the Board for the Club will act immediately to remedy the situation. Appropriate disciplinary action can include any one or more actions, including suspension or expulsion of the coach, parent, player or the team.

It is held to be self evident that a team whose players are frequently incurring penalties may be judged to have a coach not capable of teaching the players to conduct themselves in a manner creditable to the game. The Rialto Fire Soccer Club and the California Youth Soccer Association-South (CYSA-S), however, place themselves in the same position as their coaches. Discipline comes only when absolutely necessary and only after all other avenues for remedial action have been exhausted.

A good coach is many things. He/she is a parent, educator, friend, mentor and role model to all players. When the coach accepts the responsibility to coach a team, he/she accepts a responsibility to the team, all players, all parents. the Associations we belong to and the sport of soccer. The coach should accept sport as part of human activity and recognize its contribution to the enrichment of life and the growth of our youth.

COACH’S CODE - Coaches should remember:• Children have more need of example than criticism.• Soccer is a game for fun and happiness.• The laws of soccer should be regarded as mutual agreements, the spirit or letter of which no one should try to evade or break.• Visiting teams and spectators are honored guests.• No advantage except those of superior skill should be sought or used.• Officials’ decisions should be accepted without looking angry no matter how unfair they may seem. You are an example!• The GAME is the greatest teacher.• Winning is desirable, but winning at any cost defeats the purpose of the game.• Losing can be a triumph when the team has given its best.• Treat others as you would have them treat you.

PARENT’S CODE - Parents should remember to:• Make athletic participation for your child and others a positive experience.• Attempt to relieve the pressure of competition, not increase it. A child is easily affected by outside influences.• Be kind to your child’s coach and to officials. The coach gives personal time and money to provide a competitive activity for your child. The coach is providing a valuable community service, often without reward other than the personal satisfaction of having served the community.• The opponents are necessary friends. Without them, your child could not participate.• Applaud good plays by your team and efforts made by members of the opposing team.• Do not openly question the judgment of the referee and never their honesty. The attitude shown by parents at games towards their child, the opposing team, the officials and the coach influence the child’s values and behavior in sports. Criticism, disrespect for officials and opponents by over-anxious or over protective parents bent on immediate success rather than long range benefits undermines the purpose of sport and brings into the game stresses beyond those of competition.

Frequently Asked QuestionsThe following are questions that have been asked time and time again! Hopefully, the adjoining answers will clarify basic information and allow an enjoyable season for all. The handbook has been made available, so as to communicate expectations, rules and procedures followed by the Club.

What is the Rialto Fire Soccer ClubThe Rialto Fire Soccer Club is a year round competitive soccer club, which is part of the Coast Soccer League (CSL) and CYSA that administrates over 93,000 youths in Southern California. Our players are generally from the Rialto community but may also be from surrounding communities.

How are the Teams Organized?Players are divided into age groups according to State Bylaws, with team members starting as young as U8 and going through age U19 in both Boys and Girls teams. Ages are based on the age matrix provided by Cal South and Coast Soccer League for the current registration year.

What are Club Teams?The club teams play in a gaming league under The Rialto Fire Soccer Club Constitution and By-Laws and travel all over the Southern California Area playing teams of the same skill and age level. Club teams are chosen prior to recreational team selection by open tryouts and are made up of skilled players who must be willing to travel and play on Saturday and Sunday. There are expenses incurred for club team with regards to equipment, fields, referees and tour fees that parents may not see in recreational soccer. Club teams must start their first season in the Bronze Division of their age group. Finishing First in your league guarantees promotion to the next level. CSL will determine if additional promotion slots are available on a year by year basis. The Divisions are broken down as follows; Bronze, Silver, Silver Elite, Gold, and Premier (starting at age 14).

What are The League Cup, Cal Cup, State Cup (Governors) and State Cup (Presidents) and National Cup Tournaments?These are post season tournaments where teams and individuals in club soccer have an opportunity to participate against teams from other League’s and Divisions.

The League Cup Tournament is a free tournament offered each year by CSL for all its members. Teams still have to sign up at the time of registration if they want to participate in this event. Teams are slotted in the tournament based on their level and league position at a predetermined point in the season. The first round is usually played during the regular season.

The State Cup (Governors and Presidents) and National Cup are end of the season tournaments where club teams for different Club Organizations (SCDL and CSL) can play against one another. The State Cup (Governors) is available only to Bronze level teams. The State Cup (Presidents) is available to teams from all levels. Teams will begin in group play at a predetermined location, usually Bakersfield, Lancaster or San Bernardino. National Cup is an end of the season tournament that is available to teams of any level. Teams will play teams from other States, Leagues and Divisions. National Cup begins against regional teams and if successful the team can eventually travel to play teams from all over the Country. Teams can only play in one of these tournament fields.

Cal Cup is an end of the season tournament Run by Cal South. Cal Cup is available to teams of any level. Teams will play teams from other leagues (SCDL and CSL) and Divisions. Teams can play in both State Cup and Cal Cup, but the tournament dates can overlap.

What does the Player Registration Fee cover?Player and team registration fees for Club soccer cover , registration for Coast Soccer League, Insurance and Field Maintenance, The player fees do not cover all the hidden costs of the season of play. Donations and fundraisers cover the bulk of the costs and expenses like: training and coaching fees, field use fees, maintenance of equipment, new equipment, practice lights, referee costs, tournament fees, and printing. Teams may charge a monthly fee to help cover these costs.

How do we get uniforms?All teams must wear the approved Rialto Fire Soccer Club uniform (jersey top, shorts and socks) for games. Uniforms must be ordered through the Rialto Fire BOD. Uniforms styles usually last 3-5 years, when the current uniform style ends, the Rialto Fire BOD will select a new style and existing teams may transition for one additional season to the new style.

Uniforms cannot be altered in any manner nor can substitutions be worn.For example:No names on uniformsThe complete uniform as issued must be worn for every regular League game. No substitutions ofbrand, color, etc. are allowed.

Where do we practice?All practice times and places are scheduled by the designated person selected with Board approval. Head coaches will notify players and parents when and where teams will practice. No exceptions to Board approved practice times and places. Requested exceptions must be made in writing and sent to the attention of the President of The Club for Board consideration.

How much playing time will each player have?In Club Soccer league play, there is no guarantee of playing time for the player. All playing time is decided by the coaching staff. If a player misses practices or games, there are CYSA-S rules that allow the Rialto Fire Soccer Club Disciplinary Board to take action against the player.

How soon do the players have to report prior to a game?All players should be at the field of play as directed by the coach. This allows a coach the time needed tocheck in and warm up the team prior to play. Before the game, players will be checked for properuniform, cleats, shin guards, fingernails and to make sure that no jewelry is worn.

Are there any rules that players and parents should be aware of?Rubber cleats are the only ones that are legal (no metal cleats are allowed). Shoes may not have a toe cleat on the very point of the shoe. No jewelry may be worn, including pierced earrings, exposed pierced items or hard hair accessories.

SHIN GUARDS ARE MANDATORY FOR ALL GAMES NO EXCEPTIONS.

The Club recommends that eyeglasses be strapped on. No player wearing an orthopedic cast, hard brace, temporary cast or splint shall be permitted to play in any CYSA-S or Rialto Fire sanctioned practice or game. No player shall be allowed to play in any game with an injury that can be aggravated by playing.

REFEREES HAVE ABSOLUTE AUTHORITY ON THE FIELD AND THAT AUTHORITY MUST NOT BE CHALLENGED. Protests may be filed with CSL Protests and Appeals Board only on misapplication of ‘THE LAWS OF THE GAME’. There is a $50.00 protest fee that must accompany the protest and is refunded if the Board upholds the protest. No Protests may be filed on referee judgment!

Spectator Behavior!The coach and all parents have a definite responsibility in proper spectator behavior at all times. Althoughthe coach and the parents may not agree on all calls by the referee, they must be accepted. Trying to change a call by screaming at the referee or assistant referee will not change the outcome and will not be tolerated.

Spectators are to stay behind the orange spectator line at all times during game play and should direct nocomments to referees. Although referees can and occasionally will make incorrect calls, unlike some other sports, soccer calls are almost never changed and the referee’s judgment will always be upheld andunchallenged. There is no excuse for badgering an official and IT WILL NOT BE TOLERATED. Thecoach will be held responsible for any spectator on their sideline who misbehaves.

PARENTS AND COACHES ARE ENCOURAGED TO GIVE POSITIVE ENCOURAGEMENT THAT IS SOIMPORTANT TO CHILDREN. Be sure that as a coach or parent you show good sportsmanship at alltimes.

What happens in case of rain?In case of inclement weather, the coach is responsible for communicating with league officials for gamestatus. Games are generally not called off unless there is danger to the players or potential damage to thefields. If a coach cannot get through to either CSL Director of Referees or their designate, THE TEAMMUST REPORT TO THE ASSIGNED FIELD WITH THE MINIMUM REQUIRED PLAYERS READYTO PLAY OR RISK GAME FORFEITURE. The decision to cancel or suspend any game will bedetermined by the designated CSL officials or referee

Who sets up and takes down the Fields at Home Games?The first two teams on the field each day will each set up one half of the field. The teams that have the last game of the day on the field will each be responsible for taking down and properly storing the gear from the field. The coach or team parent will request volunteers. League rules state, that it is your responsibility to know and that if your team does not comply, THE PENALTY FOR NONCOMPLIANCE WILL BE LOSS OF $50 FROM BOND FOR FIRST OFFENSE AND $150 FROM BOND FOR EACH SUBSEQUENT OFFENSE. THIRD OFFENSE WILL RESULT IN SUSPENSION OR DISMISSAL.

Hints for Coaches, Parents and ManagersCoaches:1.) Be Organized! If help is needed on a project whether it is a fund-raiser, scheduling, snacks, practice, etc. ask for help. Do not try to do it all by yourself.

2.) Develop a Coaching Philosophy. The beginning or returning soccer coach should prepare to:

a.) Exhibit exemplary conduct at both practice and games. Team discipline reflects the coach’s

attitude 100%.b.) Coach clean, skillful, honest and sportsmanlike soccer.c.) Work at team morale as hard as soccer skills and tactics.d.) Maximize praise and minimize criticism in all dealings with team members.e.) Make corrections slowly and calmly, in a manner tailored to the individual.f.) Be a skills teacher. Stress individual skill development and team tactics. Minimize

lectures andmaximize demonstrations.g). Minimize coaching from the sidelines during the games

h). Welcome feedback from players and parents alike concerning potential problems and ways to

improve.

3.) Try to have a few “get-togethers” with your parents during the season. Explain your coaching philosophy and style!

Managers:1.) As soon as game schedules are available, take the list of parents and make schedules for field set up, concession etc. Make copies of the schedule and pass them out ASAP. Each Saturday checkwith next week’s parents and remind them of their assignment.

2.) Always make sure you have the game form and player cards before the game for player check in. Also have a stamped envelope for the referee before every home game.

3.) Confirm League Cup Sign Up as well as State Cup sign up dates if you are interested in playing these events.

Everyone:1.) REMEMBER, above all, WE ARE HERE FOR THE BENEFIT OF THE CHILDREN. You are an example for them, so please leave your tempers at home. If you have a problem with your coach or player, tell them in private, children pick up attitudes displayed, likes and dislikes.

2.) Each team has a variety of fundraisers each year. The League may also have some fundraisers. These fundraisers help the teams and league control the costs of registration and provide vital funds for the operations of the both . Please do your part to support the league in these endeavors.

CONSTITUTIONARTICLE I: NameThe name of this organization shall be "Rialto Fire Soccer Club". It shall also be referred to as "The Club" or "Rialto Fire SC".

The purpose for which the Rialto Fire Soccer Club is organized is to provide non-profit educational soccer competition for youths ages, Under 9 to Under nineteen (19) years of age.

ARTICLE III: AffiliationThis organization shall be an affiliated branch of and comply with the authority of the United States Soccer Federation (USSF) and the California Youth Soccer Association – South (CYSA - S).

ARTICLE IV: Administration1.) The Rialto Fire Soccer Club shall be governed by a Board of Directors. The business of the Rialto Fire Soccer Club shall be transacted by this Board of Directors.

2.) The Board of Directors shall consist of a Club Commissioner, President, Secretary, Director of Coaches and Registrar/Treasurer. The Board of Directors may also have at the discretion of the Board of Directors, other such officers as may be appointed in accordance with the BY-LAWS of this organization.

3.) The Board of Directors shall meet in general session once each quarter at the call of the President and in special sessions from time to time as may be required to conduct the business of the league. In order to conduct business at a board meeting, there must be present a fifty-one percent (51%) quorum of the elected directors. Each individual has one (1) vote.

5.) The Annual General Meeting will be held in January, in conjunction with the end of the regular season and League Cup. The date will be determined and published by the Board of Directors with a minimum of thirty (30) day public notice.

ARTICLE VI: Rules of PlayThe Rialto Fire Soccer Club Board of Directors shall promulgate and implement Rules and Regulations (Ground Rules) pursuant to which the purpose of the Rialto Fire Soccer Club League will be accomplished.

ARTICLE VII: ColorsThe representative colors of the Rialto Fire Soccer Club shall be Red and White; and the logo of the RialtoFire Soccer Club shall be attached

ARTICLE VIII: AmendmentsThe Rialto Fire Soccer Club Board of Directors or its member teams shall proposeamendments to this Constitution, which shall be valid for all intents and purposes, as part of this Constitution, when ratified by two-thirds (2/3) of the voting membership of the Rialto Fire Soccer Club at the Annual General Meeting. All such proposals shall be sent to the voting membership at least thirty (30) days prior to the Annual General Meeting.

ARTICLE IX: RatificationThe ratification and signature of two thirds members of the 2012 Rialto Fire Soccer Club Board of Directors shall be sufficient for the establishment of the Constitution.

BY-LAWSARTICLE I: Membership

SECTION 1 - Classification of MembersThere shall be three classes of members in the Rialto Fire Soccer Club. These classes shall be voting, nonvoting and contributing.

Voting members shall be the persons who are elected directors and all appointed officers.

Nonvoting members shall be registered coaches, assistant coaches, lines persons, team parents, referees, parents and legal guardians of registered players of Rialto Fire Soccer Club and registered players of the Rialto Fire Soccer Club.

Contributing members shall be individuals, organizations and companies who financially support or donate time to the Rialto Fire Soccer Club. Death, or removal of any elected member of the Board of Directors (BOD) will automatically end their membership as a voting member of this organization. The election of a successor as provided by these BY-LAWS shall operate to elect that person to voting membership in this organization.Any person who actively participates in the activities of the Rialto Fire Soccer Clubshall be a nonvoting member of this organization unless they are or become a votingmember.

SECTION 2 - Voting Rights of MembersEach voting member shall be entitled to one (1) vote. Nonvoting and contributing members shall not have a vote.

B.) President’s Vote: The Rialto Fire SC President will cast a vote in accordance with Roberts Rules of Order (most current edition).

1.) The President will remain impartial when overseeing/presiding over Rialto Fire Soccer Club meetings at which motions and voting of business is conducted by the BOD or general membership.

2.) May cast a vote when voting is done by ballot.

3.) May cast a vote (if not by ballot) whenever his/her vote will affect the result of suchVote

a.) The President may vote to either break or to cause a tie.b.) Where a two-thirds vote is required, the President may vote to cause or to block the attainment of the necessary two-thirds.

SECTION 3 - Removal of Nonvoting MemberShould the Board of Directors find the conduct of any member (whether player, parent,coach, assistant coach, official or officer) detrimental to the best interests of this league or soccer, the Rialto Fire SC Board of Directors may take such action as they deem reasonable, applicable and appropriate including but not limited to suspension or removal from this league. Such action shall require a majority vote from the Board of Directors currently in office.

SECTION 4 - Removal of Voting MembersAny participating member may be removed from office for any of the following conditions:

1.) For failure to execute the duties of their office2.) For failure to promote the best purpose of Rialto Fire Soccer Club as stated in the constitution3.) For misappropriation of Rialto Fire Soccer Club funds or equipment4.) For the conviction of any felony or misdemeanor crime involving

crime againstchildren5.) For failure to attend two (2) consecutive Board of Directors meetings without proper notification

A.) Any participating member of the Rialto Fire Soccer Club may petition the Board of

Directors, calling for the removal of any Board of Directors member. The petition shallbe in writing, state the reasons for the removal and be signed by the complainant. ThePetition must be presented to the Board of Directors at the next board meeting. A hearing on the petition shall be held in a closed session. If determined that the complaint is verifiable, the matter will be transferred to the RYSL Board of Directors for disciplinary action.

B.) The Board of Directors shall examine the petition to decide if the alleged charge falls within its sphere of interest. The matter may be transferred to the Rialto Fire SC Disciplinary committee. A majority vote of the Rialto Fire SC Board of Directors, excluding the party under petition, shall be sufficient for a determination of charges. The person filing the petition is ineligible to vote.

C.) Upon finding that the charges alleged come under the Rialto Fire SC Board of Directors sphere, the Board of Directors shall prepare a letter informing the party of the charges. The President shall serve a copy to the party either personally or by registered mail. Upon receipt of the letter, the party involved will forego their duties.

D.) Actions or recommendations of the committee that may be imposed by the Rialto Fire SC Board of Directors are as follows:

1.) Find the charges are false and clear the party's name

2.) Find the party is in violation and imposes any of the following:a.) The party shall be removed from officeb.) The party shall be admonished and be allowed to remain in their positionc.) The party may be given a period of probation

E.) If the President is the member under petition, the Rialto Fire SC Commissioner shall take control of Rialto Fire Soccer Club until the petition is resolved. The control will follow thechain of command.

SECTION 5 -Suspension of Rialto Fire Soccer Club Members - Detrimental ActionShould any member of the Rialto Fire Soccer Club engage in any physical violence or consume any alcoholic beverage at any Rialto Fire Soccer Club function or a function in which the Rialto Fire Soccer Club is participating, that member will be immediately suspended from any Rialto Fire Soccer Club

function. This suspension will remain in effect until the Rialto Fire SC Disciplinary Board can convene to take such action as they deem reasonable, applicable and appropriate including but not limited to further suspension or removal from this league.

SECTION 6 - Suspension of Rialto Fire Soccer Club Members - TheftShould any member of the Rialto Fire Soccer Club be suspected of stealing funds or property at any Rialto Fire Soccer Club function or a function in which the Rialto FireSoccer Club is participating or going to participate in, that member will be immediatelysuspended from any Rialto Fire Soccer Club function. This suspension will remain ineffect until the Disciplinary Board can convene to take such action as they deem reasonable, applicable and appropriate including but not limited to further suspension or removal from this league. In addition to the decision of the Rialto Fire SC Disciplinary Board, a report will be made to the local law enforcement authority for prosecution to the fullest extent of the law, and/or forwarded to the local court jurisdiction.

ARTICLE II: Meetings

SECTION 1 - Annual General MeetingThe annual general meeting of the members of this league shall be held according to Article V of the Constitution.

SECTION 2 - Board of Directors MeetingsRegular meetings of the Board of Directors shall be held within the boundaries of this league and at a place designated for that purpose. There shall be a meeting once a quarter with at least six (6) meetings of the Board of Directors each seasonal year. The dates of these meetings shall be set at an organizational meeting that is to be held immediately following the annual general meeting. These dates shall be promulgated to the voting membership within ten (10) days after the annual general meeting. All closed session meetings will be held in accordance with Robert Rules of Order.

SECTION 3 - Special MeetingsSpecial meetings for the Board of Directors shall be held for any purpose any time by call of the President or if the President is absent or refuses to act, by any two (2) elected Board of Directors members. The league Secretary shall deliver personally, by written notice or phone call, the time and place of the

special meeting. Such notice shall be sent to each Board of Directors member to assure that it reaches each director at least twenty-four (24) hours before the time of holding such meeting.

ARTICLE III: League Management

SECTION 1 - Directors PowersSubject to the limitations of the articles of the Rialto Fire Soccer Club Constitution and these BY-LAWS, all organizational powers shall be executed by or under the authority of the Board of Directors.

SECTION 2 - Directors and ResponsibilitiesPresident: The President will administer the league according to its Constitution and BY-LAWS, rules and regulations. The President shall preside over all regular andspecial meetings of the Board of Directors. The President shall represent theRialto Fire Soccer Club in district and state meeting of California YouthSoccer Association, Coast Soccer League, or on city levels, if necessary. The President shall help all members of the Board of Directors in the performance of their duties. ThePresident will be responsible for the coordination to interface with the City of Rialto and the School District for field permits. The President shall prepare and provide a written agenda before the commencement of each Board of Directors meeting. The President shall see that any decisions by the BOD has been fulfilled or completed prior to the end of his/her term.

Commissioner: The Commissioner shall carry out the duties of the President, if the President cannot be present. The Commissioner shall also represent the clubs interest on the Rialto Youth Soccer League (RYSL) Board. The Commissioner will be Chairman of the Disciplinary Board and Chairman of the Nomination Committee.

President: The President has numerous responsibilites amd will be responsible for the coordination to interface with the City of Rialto and the School District for field permits. Co-ordination of Club functions with CSL and must run the day to day operations of the club, a timeline of duties is being developed to include the following:

January - Schedule Club Tryouts for Spring season, including setting up of a coaches committee that will develop drills and system for rating players. There should be three (3) to 5 coaches committed to attending so that the player recommendation to a potential coach is adequate. Voting for any

open Board Position should be done this month. The Club President should also be contacting Adidas to determine uniform issues that may arise in the next season.

February - Club President should be developing a list of returning teams, coaches, and potential new teams for the upcoming season. New Board Members should be installed by the 15th of the Month to insure continuity of the Club.March - Club President should be notifying teams of upcoming May CSL Application Deadline. Tryouts for Spring should be held sometime in this month, TBD by coaches committee.

April - Club President should receive and pass on the Jerry Eaves Field closure schedule if available and begin process of scheduling teams on their alternative field.

May - Club President will work with the Club Treasurer to receive all League Team Fees. Fees will then be consolidated into one check and delivered to CSL. Each team must have their application, fees and bracket justification turned in on time.

June – Club President shall assist coaches and managers with any bracket appeals before the early July deadline.

July – Club President works with League Registrar to pick day and time for team player registration. Schedule meeting one/two weeks prior to go over the required items needed at registration to help process. President should also work with field coordinator to assign fields at Jerry Eaves once field is re-opened. Club President should work with field coordinator to assign field painting schedule for the upcoming season. August –

Secretary: The Secretary shall be responsible for the keeping of the minutes of all regular and special meetings of the Board of Directors. The Secretary will also retain

all correspondence between the Rialto Fire Soccer Club, Rialto Youth Soccer League and any individual, company or other organization that pertains to the running of theleague. The Secretary shall provide copies of the minutes of the prior meetingto the Board of Directors. The Secretary shall make copies available of thecurrent BY-LAWS and Ground Rules for the Board of Directors and to theDirector of Coaches for distribution to all Club coaches. The Secretary shall see that all dates vital to the running of the league are published in the newspaper or other public notices, such as general elections and registration. The Secretary shall be responsible for standings and game descriptions being given to the press during the season. The Secretary will also be responsible for the Club Social Media content including Facebook, Twitter, and any Club Website.

Treasurer/Registrar: The Treasurer shall be responsible for all funds of the Rialto Fire SoccerClub. The Treasurer shall make all deposits and along with the President and Commissioner, pay the bills incurred by the league. The Treasurer shall keep a detailed record of such transactions and prepare a report of said transactions to the Board of Directors each month. The Treasurer shall present their records at any time should there be a request for audit. TheTreasurer shall prepare a written report of said transactions. The Treasurer shall pay all Board of Directors approved expenditures incurred by the league. The Treasurer shall prepare a written End-of-Year financial report. The Treasurer will file the Leagues Tax Return with the Internal Revenue Service in a timely manner the year that is served as Treasurer.

Past President: The Past President shall be an advisor to the President and all other Directors in the dispensing of their duties. Past President has no voting privilege at theBoard of Directors meeting.

Coaches: All Coaches must be California Youth Soccer Associationcertified with a minimum of an "E" license to run, hold and execute the duties of Coaching. All coaches and trainers should also be run through risk management with RYSL

Director Of Coaches: The Director of Coaches shall be the first point of contact for all Rialto Fire Soccer Coaches. The Director of Coaches will work with the RYSL Field Manager to assign practice fields, set up the field painting schedules and also set up all goal set up and take down schedules. The Director of Coaches shall recruit and see to the licensing of all Rialto Fire

Soccer Club coaches. The Director of Coaches will be responsible for answering questions and disburse information to coaches. TheDirector of Coaches shall see that the Board of Directors and each coachreceives a list containing the names and phone numbers of all coaches...

SECTION 3 - VacanciesThe President shall have the power to appoint a temporary director in case of a vacancy in a director position. The Board of Directors may fill vacancies by vote of the remainingdirectors, though less than a quorum, or by a sole remaining director, and each director so elected shall hold office until his successor is elected at the annual general meeting of the league. A vacancy shall be deemed to exist in case of death, resignation, removal or disqualification of any director.

SECTION 4 - Order of Business at Regular MeetingsThe order of Business that shall be normally conducted during each regular league meeting shall be as follows:

Procedures and debate shall be in accordance with the Rules of Parliamentary Law known as "Roberts Rules of Order" (current edition).

SECTION 5 - Quorum1.) A majority of the number of elected directors as stated in Article IV Item 3 ofthe Constitution and By-Laws shall be necessary to constitute a quorum for thetransaction of business. The action of the majority of the directors present at anymeeting at which there is a quorum, when duly assembled, is valid. If aminority of the directors, without a quorum, may assemble from time to time,but may not transact any business.

2.) Any expenditure made prior to a Board of Directors or Executive decision willnot be reimbursed.

3.) Any decision that is not covered by the Constitution, By-Laws, or Rules &Regulations of the Rialto Fire Soccer Club must be presented to the Board of Directors or the Executive Board for decision and approval.

SECTION 6 - Team FundraisingTeams may hold their own fundraisers but are not permitted to hold fundraisers on the fields without BOD approval.

ARTICLE IV: Playing Rules

SECTION 1 – All teams will be required to play their league games according to the rules set forth by Coast Soccer League, http://coastsoccer.com/rules.php .SECTION 2 – UpdatesThe Rialto Fire Soccer Club Administrators shall maintain adequate and correctaccounts, books and records of its business and properties. All of the accounts, books and records shall be kept at its principle place of business within the boundaries of the league as fixed by the Board of Directors from time to time.

SECTION 3 - Inspection of RecordsAll records provided for in SECTION 1 above shall be open for inspection for the directors and members of this league upon reasonable notice.

SECTION 4 - Checks, Drafts, Notes, Indebtedness ChecksDrafts or other orders for payments of money, notes or other evidence of indebtedness, issued in the name of, or payable to, the Rialto Fire Soccer Club shall be signed or endorsed by such person or persons and in such manner as provided for in these BY-LAWS or as from time to time shall be decided by the Board of Directors.

SECTION 5 - AuditAn audit of the Rialto Fire Soccer Club financial books by a CPA tax Specialist shall be completed each year. This audit shall include all financial transactions through the month of December for the year-end.

ARTICLE VI: Amendment to the BY-LAWSSECTION 1 - Amendment by MembersThese BY-LAWS may be amended at the annual general meeting or at any other meeting of the members called for that particular purpose, whenever two-thirds (2/3) of the voting members of this league as provided in the BY-LAWS deem it necessary. Such proposed amendments shall be valid for all intents and purpose when as part of the BY-LAWS; they are ratified by a majority of the voting members present at the meeting.

SECTION 2 - Amendment by the Board of Directors.The Board of Directors may not amend these BY-LAWS.

SECTION 3 - NotificationEach voting member of this club shall be given thirty (30) days notice of any meetingcalled to propose changes to these BY-LAWS. Such notification may include a copy of any proposed amendments.ARTICLE VII: RatificationWe the undersigned, being voting members of this club and acting in the capacity of a director or a representative, hereby assent to the foregoing BY-LAWS, and adopt the same as the BY-LAWS of the Rialto Fire Soccer Club. RULES AND REGULATIONSI. GENERALA.) The Rules of Play shall be the Laws of the Game as published by FIFA and set by Coast Soccer League as defined on their website at http://coastsoccer.com/rules.php

B.) All games played shall be under the Rules and Regulations of CYSA-S and the Coast Soccer League, except that where a conflict exists, the more restrictive rule applies.

II. CLAIMS OF IGNORANCEA Claim of ignorance to these rules and regulations shall not be satisfactory grounds for violation, protest or appeal.

III. REGISTRATIONA.) Registration will be open to all eligible participants.

B.) All participants available shall be registered before the season begins. A player is considered registered from the moment the player or player agent signs the registration form and pays the appropriate registration fee.

C.) Recruiting of players from RYSL or any other club team will not be permitted during the roster freeze period and in the case of RYSL players, until the players season is over, including All Star commitments.

D.) Recruitment among the club teams will not be permitted. If active recruitment of an existing player is found the coach faces the possibility of suspension or removal. If a parent initiates the contact, the coach is required to go to the Director of Coaches or another Board Member before any active recruiting can take place. If there is a problem with the coach and players or parents we will do the best we can to facilitate any change necessary. The goal is to improve the club by player development and recruitment of players OUTSIDE of the club not by recruiting players within our own club.

E). The Rialto Fire Soccer Club Board of Directors, in conjunction with the Rialto Youth Soccer League Board of Directors shall set the registration fees prior to the beginning of registration.

F.) All players must supply proof of age at the time of registration. Acceptable proof of age is defined as an originalcertified birth certificate, passport or immigration papers. (You will need to supply the original and one copy of the document. The original will be returned once verified.)

IV. TEAMS – Club TeamsEach team can hold try-outs when they want with no restrictions except during roster freezes. The Club may decide to hold try-outs for all ages, but teams are not requires to attend.

There may be no more than three teams for each age and gender per Coast Soccer League Rules. If more than one team exists in an age group the longest tenured team can maintain the Rialto Fire Name, the second team will be Named Rialto Fire Red and the third Team will be Rialto Fire White.

Each team has the ability to procure Sponsors for their team. 100% of the sponsorship moneyis to be used for the benefit of the team. If the sponsorship money is being used to purchase sweats, jackets or warm-up’s for each member of the team, the coach, assistant and team parent can be included. Sponsorships are to be received in check format only and must be turned over to the Rialto Fire Soccer Club Treasurer. Claims may be made against your banked sponsorship money by providing valid receipts along with the Rialto Fire Soccer Club reimbursement request to the Club Treasurer (Receipts must be from current seasonal year). Reimbursements will be sent out within two weeks of the request. Any monies not claimed by December 31st of the season year will become part of the Rialto Fire Soccer Club General Fund unless an extension is approved by the Board of Directors.

V. PLAYER SAFETYA.) No player shall be allowed to play in any regularly scheduled game with an injury, illness or recent medical condition that playing can aggravate or which constitutes a danger to others without a medical release.

B.) No jewelry may be worn including pierced earrings, other exposed pierced items or hard hair accessories.

C.) SHIN GUARDS ARE MANDATORY FOR ALL GAMES - NO EXCEPTIONS.

D.) The Club recommends that eyeglasses be strapped on.

E.) No player wearing an orthopedic cast, temporary cast or splint shall be permitted to play in any CYSA-S or Rialto Fire Soccer Club sanctioned practice or game.

F.) No player will be allowed to compete with blood visible or on his or her uniform.

G.) No metal or toe cleats will be allowed.VI. PROPER DRESSA.) To be properly dressed is defined as Club approved shirt, with approved number style, shorts, socks and league approved shin guards. Sweats may only be worn under the regulation uniform and must be of the same color as the shorts. Shirts must be tucked in at all times. Cleats must conform to CYSA-S rules that allow for rubber cleats on shoes with no front toe cleat. No pads may be worn except by the goalie.

B.) Shin guards are mandatory at all games. No player will be allowed to participate without shin guards.

C.) Goal Keepers will be allowed to wear black soft-brimmed hats to shade from the sun. If the Goal Keeper is substituted and then plays on the field in another position, all goalie clothing must be removed and they must be dressed fully in the league provided uniform (socks, shorts, jersey) for their team..VII. Soccer Club regulations. All practice attire and equipment must by BOD approved. (Practice attire and equipment includes but is not limited to: Backpacks, practice jersey, warm-ups, etc.).VIII. DUTIES AND RESPONSIBILITY OF COACHES & MEMBERS

A.) A coach’s primary responsibility is to all players and the game.

B.) Coaches and their assistants shall not direct negative, derogatory or personal remarks towards the referees, assistant referees, players, spectators or any other league members. Failure to comply may result in ejection and further disciplinary action by the Rialto Fire SC Disciplinary Board.

C.) Coaches shall be responsible to control their sideline. Every effort shall be made to calm the atmosphere by explaining the situation or informing an individual that such behavior is not in keeping with the spirit of the game or good sportsmanship. The coach should use good judgment in the situation, realizing that negativism, derogatory comments and harassment of players or referees is detrimental to the game.

D.) Only credentialed Administrator/Coaches with USYSA passes issued for said team or from any other team from that team’s league of registration for the current seasonal year and, in addition, Cal South RiskManagement cards, may be within the technical area (team bench) provided that all such administrators/Coaches are identified on the patch report (roster) (CYSA-S Rule 2.1.3).

E.) All coaches shall diligently strive to attend the clinics arranged by the Director of Coaches.

F.) No coach, assistant coach, member or anyone representing a coach, assistant coach or member shalldirectly or indirectly approach a registered player regarding playing on any other team, league or club until after the end of the current season, defined as the end of the Tournament of Champions play. This rule does not apply to CYSA-S sanctioned tournament play that allows for loaned players. In addition, no recruitment within the club will be permitted. If a player or parent approaches a coach about moving teams, the coach must immediately inform the Director of Coaches or another club Board Member before they can move forward with recruitment.

G.) Coaches shall provide phone numbers of coaches, assistant coaches and team parent to each member of their team

H.) All coaches will ensure that a responsible adult is at all practices from inception to its conclusion and that all children present at practice have a ride home with either their parent, legal guardian or their designate. No coach may leave the practice area while children from their team are present. Children are to remain with the coach until picked up by their parent, legal guardian or their designate. Children not picked up in a timely manner should be reported to the Director of Coaches or another Club Board Member.

I.) An adult female must be in attendance at all practices and games when a female is registered to the team. An adult female must be in attendance on the field if a female is injured.

J.) The teams with the first game of the day are responsible for each setting up the entire field. This includes goals, nets and corner flags. The teams with the last scheduled game that day on that field are responsible for the taking down and proper storage of the entire field. It is the responsibility of the coach to verify the field schedule to see if they are playing the last game of the day on their field of play. (The Director of Coaches may provide this schedule information for the current week games as well as for the next week games.)

K.) Any serious injury to a participant shall be reported immediately by the team coach to the Club President or available Board Member if the President is unavailable.

L.) Any ejections of players, coaches, or parents must be reported the same day to the Director of Coaches.

M.) All team members shall be responsible for the general appearance of the playing fields, practice fields and post game clean up.

N.) Original player forms MUST be present at any and all Club functions, including but not limited to practice, games, tournaments and team parties. Original player cards will be present at defined Rialto Fire Soccer Club functions.

O.) No alcoholic beverages are allowed at any and all Rialto Fire Soccer Club functions including team parties. Smoking shall be prohibited during any Rialto Fire Soccer Club event. Club Function is defined as any gathering where official league business is being handled, such as BOD meetings, disciplinary hearings, etc., as well as anytime players are present including but not limited to practices, games, and team parties.

O.) Administrators or trainers will have risk management badge visible during all practices and games or provide current year Cal South ID card.

P.) Anyone found in violation of these general behavior guidelines and the preceding Code of Conduct may be subject to disciplinary action.

IX. REFEREES/OFFICIATINGA.) Rialto Fire Soccer Club will recognize the suspensions and rulings of organizations that are affiliated with CYSA-S. Said organizations may initiate suspensions of any official, manager, coach, player or spectators/members of any club team for a stipulated period of time.

B.) Referees are NOT OBLIGATED to answer questions about calls made.

C.) The following offenses shall subject members to suspension:A.) Any official, manager, coach, player or spectator/member of a team charged with verbal abuse of a player, referee, or game official shall be automatically suspended without appeal for a minimum of three (3) games and may be subject to additional disciplinary action by the Rialto Fire SC Disciplinary Board. Failure to comply after being notified by phone and/or mail will result in the forfeiture of all games with the suspended official, manager, coach, player or spectator/member in attendance.

B.)Any member charged and verified by Club officials with the verbal abuse of anyone on or near the field of play shall be automatically suspended for one (1) game and may be subject toadditional disciplinary action by the Rialto Fire SC Disciplinary Board. Incidents of severe referee abuse shall be referred to the CYSA-S Protest, Appeals and Disciplinary Board for review.C.) When it shall be alleged that any player, coach, administrator, or member has committed an assault upon any other player, or coach, or administrator, or member, or upon a spectator at any game, Rialto Fire Soccer Club shall immediately notify Cal South (Cal South shall be defined as either the District Commissioner, the Cal South Board, or the Cal South Protest, Appeals, and Disciplinary Board). The information will be sent to the Cal South Corporate Office within 72 hours of the alleged offense. Cal South will determine which level will adjudicate the alleged offense. Should the Rialto Fire SC fail to report such an incident, a referee report or other written complaint shall be grounds for Cal South to act on the allegation of misconduct.D.) Upon receipt of a written allegation that a player, coach, administrator, or member, has committed an assault upon another player, coach, administrator or member, or upon a spectator at any game, the adjudicating authority shall immediately suspend the accused individual(s). Such suspension will be communicated by a method described in the Rialto Fire Soccer Club or Cal South Manual of Operations, Protest and Appeals and Discipline. Cal South will have full authority to assess penalties such as, but not limited to, suspension, revocation/probation.E.) “Assault” includes, but is not limited to the following act/acts committed upon an affiliated player coach, administrator, member, or spectator at an affiliated game: the act of kicking, punching, choking, spitting at or on, grabbing or bodily running into, the act of kicking or throwing any object at another player, coach, administrator, or spectator that could inflict injury or damage to said person or his/her personal property, i.e., car, equipment, etc.

. F.) Any player, coach, administrator or member, who shall be adjudged to have committed an assault upon a player, coach, administrator or member, or upon a spectator at any game, shall have the right of appeal. The appeal of a Rialto Fire SC decision shall be directed to the District Commissioner in whose District the incident occurred within forty-eight (48) hours of the receipt of the Rialto Fire SC decision. Subsequent appeal shall follow normal appellant Levels according to the Rialto Fire SC or Cal South Protest and Appeals and Discipline Manual.G.) Disciplinary sanction or suspension imposed as the result of an assault shall remain in full force and effect unless it is overturned on appeal or review, regardless of the level at which it was imposed.

XI. COACHES, PARENTS AND SPECTATOR SIDELINE RULESA.) Coaches will remain in marked coach’s boxes during the game. Coaching by each team is allowed on the sideline for their team only. A team may not have coaches on both sidelines of the field. Once a warning is given, the head coach may be ejected from the game for noncompliance.

B.) NO ONE but coaches, assistant coaches, players and substitutes will be allowed in the coach’s box.

C.) ALL SPECTATORS must remain behind the orange spectator’s line, or in the absence of an orange

spectator’s line, two (2) yards from the side (touch) line. Spectators must also remain within fifteen (15)yards each way from the center line. No one will be allowed near the penalty box or at the end of the fieldand spectators must remain on their own side of the field. Failure to comply may result in the game beingsuspended until the offending spectator or spectators leave the sight and sound of the field. This mayrequire the offending party to leave the park of play.

D.) Spectators and coaches will direct only POSITIVE COMMENTS from the sidelines.

E.) Spectators and coaches shall refrain from any verbal harassment of referees, assistant referees, coaches or players.

F.) NO ONE, including coaches and parents will be allowed on the field during a game until invited onto the field by the referee. If a player is injured, the referee will stop play as they see fit and invite the coach to help any injured player. An adult female must be in attendance for a female player. DO NOT MOVE OR CARRY FROM THE FIELD A CHILD THAT IS INJURED. Any child needing carriage from the field ofplay should have it done so by trained Emergency Medical Technicians or by parent or guardian - ONLY..

G.) Referees are NOT OBLIGATED to answer questions about calls made.

H.) Teams and their spectators are responsible for and will pick up sideline trash after their games. There will be trash cans at all fields.

I.) Any Coach or spectator that is ejected from the field of play by the Referee of the match is compelled to leave “the sight and sound of the field” immediately. This may require the offending party to leave the park of play. The referee of the match may hold up play until such time that a coach and/or parent comply with the order to leave. Additionally, the Referee of the match may suspend play if their order for acoach/spectator to leave the field is not complied with.

J.) DO NOT park in red zones, loading zones, driveways, on sidewalks or curbs or any other areas in andaround the park not designated or marked for parking. Your car may be towed and impounded at yourexpense and the City of Rialto Police will assess a fine.

XII. AMENDMENTSThe Rialto Fire Soccer Club Board of Directors reserves the right to amend any of the preceding rules and regulations as necessary.

PROTEST, APPEAL & DISCIPLINARY HEARING PROCEDURES

No hearing or other administrative action shall result from circumstances of charges which are only communicated verbally.Proper documentation of all Protest, Appeal, and Disciplinary (PAD) Hearingmatters must be maintained. All actions taken must be in accordance with thefollowing procedures and time frames. Please read this manual thoroughly. A.) GENERAL GRIEVANCES are complaints of a general nature which are not based upon specific ruleviolations and/or specific administrative decisions (or lack of decisions). Such "grievances" are handleddifferently from protests, appeals, or disciplinary hearings. Grievances must be filed with the immediatenext higher authority (grievance with a league filed with District Commissioner, etc.) or as determined bythe Cal South Board of Directors or their designate and may be heard on an informal basis by theappropriate authority. All parties shall be given an opportunity to present arguments either in person or inwriting to the adjudicating authority. Cal South will make the determination if the grievance will be heardin an “open” or a “closed” format. There is only one adjudication level for a grievance, and the decisionproduced is final with no further appeal allowed.

B.) DISCIPLINARY HEARINGS are administrative actions that result from written allegations ofmisconduct. Such misconduct must be prohibited by a published rule, regulation, or procedure. Adisciplinary committee shall only hear allegations of misconduct against individuals or entities within thejurisdiction of the convening authority. Charges may only be brought by the elected and/or appointedofficials of duly constituted clubs, leagues, tournament committees, or Cal South State Administrators.Referees are recognized as officials of such organizations in matters regarding game misconduct. Theoriginal disciplinary hearing on any matter shall be an Open Hearing. A member who is charged may notsend a “representative” or “proxy” to attend in their place. Minors must be accompanied by a parent orlegal guardian.

C.) An OPEN HEARING is a type of hearing (grievance, protest, disciplinary or appeal) in which theprinciple parties and witnesses for both sides are directed to appear and all necessary evidence shall bepresented before the members of the hearing committee. Testimony shall consist of witness statements and their answers to questions from the committee. Verified written or pictorial evidence may be submitted. The original hearing of any disciplinary matter must be an Open Hearing. Subsequent appeal(s) may be heard in open or closed hearings. An “open” hearing does not necessarily mean it is open to anyone who wants to attend or watch. The Board may exclude spectators or limit them as deemed prudent. They may also reasonably limit the number of “advisors” assisting the member facing charges.

D.) A CLOSED HEARING is a type of hearing (grievance, protest or appeal) that requires all testimony and evidence to be submitted in writing by a specified time and date. Parties may be given the opportunity to file written rebuttals to the arguments of the other party. Testimony and evidence may be considered by the Board or Committee meeting together or by its members on an individual basis with a decision reached by mail or by phone. The

original hearing of any disciplinary matter may not use the “closed” format and must be an open hearing. Subsequent appeal(s) may be heard in open or closed hearings.

E.) BAD FINANCIAL STANDING is a period where specific membership benefits are removed due to themember’s refusal to meet financial obligations to the affiliated authority. Bad Financial Standing may existalong with Probation or Suspension. Bad Financial Standing requires a hearing by the convening authority.It may be imposed by the appropriate authority (as determined by the Rialto Fire Soccer Club Board of Directors) with cause and written notification issued to the offending party. Such a hearing shall be held using the format for hearings as required by this Manual. Only the imposing authority or a higher jurisdiction may modify or remove Bad Financial Standing.

F.) PROBATION is an official period of warning wherein any further violations of Rialto Fire Soccer Club, CYSA-S, USYSA, or USSF Rules and Regulations or By-Laws may result in a hearing without regard to stated time limits in this manual. Conditions of Probation may be placed on the offender by the adjudicating authority. A period of Probation itself is not considered adverse action and cannot be appealed; however, specific conditions of probation that remove or limit benefits of Rialto Fire Soccer Club or CYSA-S membership may be appealed. (examples may include denying ability to coach or be a team administrator, enter or travel to tournaments, etc.) Violation of Probation in itself shall not be a cause of action for a hearing unless proper appeal rights have been given to the offending party when the Probation is imposed. There must be additional underlying violation of the rules for charges of violating Probation or the offending party has not completed conditions of probation.

F.) SUSPENSION shall be defined as the complete cessation of any and all affiliated activities. All benefits of membership are removed. Suspension from one (League, State, Regional, or National) is suspension from all. All affiliated members and organizations are required to observe the suspension of any member or disciplinary action may result. Additional conditions of suspension may be imposed during the suspension period. When suspended, a member may not play for or practice with any team; may not coach or in any way assist in the instruction, training or management of a team or any of its players; may not hold any official position of responsibility within any affiliated organization (team, club, league, or stateassociation).

G.) BAN a disciplinary action that restricts participation within specific and/or limited types of sanctionedactivities within the Association only.

II. LINE OF JURISDICTIONA.) The line of jurisdiction, in ascending order, follows.Level 1: District Commissioners, Leagues, Tournament Authorities, State and State Cup Committee(s)Level 2: Cal South Protest, Appeals, and Disciplinary Committee(s) (PAD), Cal South Board ofDirectorsLevel 3: Cal South PAD Review Panel (Cal South Vice President and PAD Chairman), (as needed)Level 4: United States Soccer Federation (USSF) Appeals Committee

B.) Level 1: District Commissioners, Leagues, Tournament Authorities, State and State Cup Committee(s)

1.) These bodies may be the first level of adjudication. They may hear original protests, appeals, and allegations of misconduct arising from events within their jurisdiction. These matters shall beMATCH RELATED COMPLAINTS ONLY or complaints referred to them by Level 2. Level

1authorities SHALL NOT HEAR referee or non referee assaults, severe referee abuse, overage player violations, or falsification of document cases unless Level 2 (Cal S) assigns a matter to a Level 1 authority 2.) Rialto Fire Soccer Club shall establish its own protest, appeal and disciplinary hearing procedures. Such procedures must be published and available to all members in writing and include notification of the right to appeal and the procedures for doing so. These procedures and practices shall be in accordance with this Manual, and the CYSA-S and USSF requirements and procedures.3.) If Level 1 fails to or chooses not to act on a protest, appeal or allegation of misconduct it shall be remanded to Level 2 for action.4.) There shall be only one level of adjudication at Level 1.5.) Appeals of Level 1 decisions shall be directed to Level 2.6.) Appeals of Level 2 decisions shall be directed to Level 4 (USSF)

C.) Level 2: CYSA-S1.) "Cal South" may consist of the Cal South Board of Directors, Cal South Executive Committee, or Cal South Protest and Appeals Committees. The Cal South PAD Committee may be divided into sections (based on geographic areas) as approved by the Board of Directors. Each section will have a chairman and committees from each geographical area as defined by Cal South.

a.) The Cal South Board of Directors shall establish policy to determine which "Cal South" body shall be assigned to adjudicate cases.

2.) "Cal South" may hear appeals from Level 1, hold original hearings on all matters forwarded without action from Level 1, or cases assigned from Level 1, hold original disciplinary hearings including but not limited to the following: Referee assault/abuse (referee abuse may be assigned by "Cal South" to a lower Level); Non Referee Assault; Falsification of Documents; Overage player complaints. Cal South, at its discretion, may elevate any matter involving violation of Cal South, USYS, or USSF Rules directly to Level 2.3.) In cases involving referee abuse and/or assault, "Cal South" may hear related rule violations of other members associated with the incident or may assign them to an appropriate level.4.) Appeals of Level 2 decisions shall be directed to Level 4.

D.) Level 3: CYSA-S PAD Review Committee1.) The PAD Review Committee shall review cases for merit as needed.

E.) Level 4: United States Soccer Federation (USSF) Appeals Committee1.) The appeal of “CYSA-S” decisions shall be made in accordance with the provisions of USSF Rules. See the CYSA-S PAD manual Appendix for the procedures and forms for submittal of appeals to USSF.

III. MANDATORY CONDITIONSA.) No person may sit on a hearing committee when any conflict of interest exists. If a Level 1 or Level 2

authority has an institutional conflict of interest with the issue being adjudicated, then the matter shall bereferred to another PAD Section/Committee or to the Cal South Board of Directors for consideration.Decisions on the level of adjudication will be decided by the Board of Director’s designate or the PADChairman.

B.) (All Committees, Leagues and Tournaments Please Note) No Level 1 authority shall hear or adjudicate an allegation of Referee Assault. An allegation of an assault on a referee or assistant referee shall be immediately submitted to Level 2.

C.) No Level 1 authority, unless directed by (CYSA-S) shall hear or adjudicate an allegation on Non-Referee Assault when an injury has occurred.

D.) The hearing and adjudication of any protest or allegation of misconduct should be completed within thirty (30) days of the filing of the cause of action. If a decision is not reached within the thirty (30) day period, the matter may be submitted to the next higher Level without determination and any fee submitted applied at the next Level.

E.) At all Levels of the appeal process, if a decision is not reached within thirty (30) days of receipt of thewritten appeal, the party filing the appeal may submit the appeal to the next higher Level withoutdetermination with the appeal fee submitted applied to that Level.

F.) The decisions and/or disciplinary sanctions imposed as the result of a hearing shall be binding on all Levels and shall be recognized by all affiliated organizations (Leagues, Tournaments, etc.). The filing of an appeal shall not “stay” the execution of such decisions and/or disciplinary sanctions.

G.) All original copies of evidence submitted shall be retained by the hearing committee at which the evidence was first submitted. The official hearing packet submitted to a higher- level appeal committee in the appeal process shall be a true and exact copy of all original evidence submitted and accepted at the lower-level hearing. The packet shall be numbered, indexed and signed as verified by the original hearing chairman and forwarded by certified mail. In special circumstances, a higher-level appeal committee may require the original copy (s) of a specific document (s).

H.) It is the intention that there shall be no more than two (2) hearing levels on any matter within CYSA-S.Appeal committees may direct a re-hearing and thus exceed the two (2) hearing limit.

I.) In accordance with USSF Bylaw 701 – in all hearings conducted by any hearing body of Rialto Fire SC, thefollowing will be accorded:

1.) Notice of specific charges or alleged violations in writing and the possible consequences if the charges are found to be true.2.) Reasonable time between receipt of the notice of charges and the hearing to allow defense preparation (7 – 21 days advance notice is current Cal South policy).3.) The right to have the hearing conducted at a time and place so as to make it practical for the person to attend.4). The right to a hearing before an impartial body of fact finders.

5.) The right to be assisted in the presentation of one’s case at the hearing (Cal South policy only allows assistance in an advisory capacity – See H. above).6.) The right to call witnesses and present oral and written evidence and argument.7.) The right to confront witnesses, including the right to be provided the identity of

witnesses.8.) The right to have a record made of the hearing if desired.9.) Notice of any substantive and material action of the hearing panel in the course of the proceedings.10.) Equality concerning communications, and no ex-parte communication except for

proceduralexplanation.11.) The right to notification of the decision in a prompt manner.

IV. FILING PROCEDURES & FEESA.) A protest, appeal or allegation of misconduct shall be filed in writing and include

1.) The appropriate filing fee (if required). Game and League officials are not required to post this fee when conducting league business.

2.) The nature and specifics of the complaint.

3.) A listing of rules or procedures that have been violated.

4.) A statement of the desired result.

5.) All supporting documentation (For appeals, the evidence packet if available)

6.) Shall be submitted within 15 days of the incident (allegations of referee assault, non referee assault, referee abuse). All other complaints/allegations of misconduct must be reported within thirty (30) days of the incident or discovery of the misconduct.

a.) Note: Referees’ game reports shall be accepted as an official allegation of misconduct regardless of their format and without regard to the requirements of this section.b.) Note: A copy of the "Cal South Notice of Appeal" is included in the CYSA-S PAD manual. Use of this form is necessary so that information on an appeal is presented in the proper manner.c.) Note: Appeals to USSF shall include the USSF Notice of Appeal, and Appeal Document Directory (CYSA-S PAD manual Appendix).

B.) Filing shall be as follows1.) The original document of the protest, appeal or allegation of misconduct, along with all supporting documents shall be forwarded by Registered or Certified U.S. Mail - return receipt requested or Priority or Express Mail – with Delivery/Signature Confirmation.2.) In the case of an appeal, the appeal must be placed in the mail and postmarked within ten (10) days of the receipt by the appellant of the decision being appealed (Sundays & Holidays excluded), unless the rules of the competition state otherwise.

3.) In the appeal of a lower-level decision, one (1) complete copy of the appeal shall be sent to the chairman of the lower-level hearing board by the appellant. This shall

serve notice of the appeal and offer the lower-level authority the opportunity to respond in writing to the appeal board if such a response is felt necessary.

a.) Upon receipt of the appeal the lower-level Board shall submit a copy of the official document directory, all evidence and any additional documents reviewed to the higher-level appeal board.

b.) This submittal shall normally be by Registered/Certified U.S. Mail, Priority or Express Mail with Delivery/Signature Confirmation and be mailed within ten (10) days of receipt of the notice of appeal.

C.) Filing Fees and Number of Copies Required1. The schedule of Filing Fees and number of copies required are as

follows:LEVEL 1: Filing fee $50.00. Two (2) copies to the Rialto Fire Soccer Club President LEVEL 2: Filing Fee $200 (fee for appeal filing only). Five (5) copies to PAD or Board of Directors.LEVEL 3: No Filing Fee. Three (3) copies to PAD Review Board.LEVEL 4: Filing Fee as established by USSF.

a.) One (1) copy to USSFb.) One (1) copy to Cal South State Office.c.) One (1) copy to PAD Chairman

C.) The CYSA-S Board of Directors will determine responsibility for any inordinate costs incurred at anylevel within the hearing / appeal process and may assess the responsible party in addition to the filingfee.

D.) At Level 2 (Cal S), the filing fee shall be NON-REFUNDABLE.

E.) At all Levels of the appeal process, if a decision is not reached within thirty (30) days of receipt of thewritten appeal, the party filing the appeal may submit the appeal to the next higher Level without determination with the appeal fee submitted applied to that Level.

V. PRE-HEARING PROCEDURESA.) Validation and Review of Protests, Appeals and Allegations of Misconduct

1. Upon the filing of a protest, appeal or allegation of misconduct, the receiving authority shall conduct the following “Validation / Review” to determine the appropriate response or action to the filing.

a.) Identify the principle parties involved.

b.) Determine that they are in good standing (Not on suspension and have standing to file a complaint). If not, the filing is void.

c.) In the case of a protest, determine the protester’s standing to lodge a protest. (See Definitions Protests)

d.) For an appeal, determine if the appeal is directly related and germane to the lower authority’s decision. If not the appeal is rejected and returned to the filing party.

e.) In the case of an allegation of misconduct, determine that specific charges are made, that rules allegedly violated are cited (or sufficiently described) and a desired result is stated (a request for disciplinary action is a desired result). Note: A Referee’s Game Report and/or Misconduct Report are deemed to fulfill these requirements.

f.) Determine if the matter has been filed with the proper authority. (i.e. Referee Abuse / Assault goes directly to Level 3).

g.) Determine if the information necessary to adjudicate the matter is included. Vital information includes names, addresses, phone numbers, previous hearing minutes, applicable rules, referee’s game reports, witness statements, etc.

h.) Determine if the complaint has been filed within thirty (30) days of the incident.

i). If sufficient information to adjudicate the matter is available, the principle parties are to be notified of receipt of the complaint and the date, time and place of the hearing.

j.) Personal problems between individuals will not be heard.Note: Five (5) calendar days in considered sufficient time to conduct the “Validation / Review” process unless documentary evidence is delayed or circumstances prevent obtaining pertinent information or documents. However if the accused individual is suspended, a hearing must be scheduled within thirty (30) days. If a hearing cannot be completed within thirty (30) days, the suspended individual will be temporarily reinstated until the hearing process can be completed This determination will be made by the Rialto Soccer Club BOD, or Cal South Vice President or Cal South PAD Chairman depending on the reason for suspension.

B.) Notification of Hearing1.) If notification of the receipt of a complaint and the notification of the hearing date, time and place cannot be made at the same time, then two (2) separate notifications shall be required. Extreme hardships resulting in the inability to appear at a hearing should be honored and the hearingdate or time should be adjusted as practical to be fair to the accused. Extreme hardship is illness, death, or other emergency reasons. Game attendance instead of appearing will not be considered as extreme hardship or emergency. However, if this section is abused by the accused, it shall be noted and the hearing shall proceed as scheduled.

2.) Notification of all hearings shall require receipt of hearing notice seven (7) to twenty- one (21) days prior to a hearing unless the accused gives written waiver of rights to the notice requirement in order to expedite the procedure or because of late notification.

3.) Notification shall be communicated to the principle parties at the same time and method and shall be accomplished by one (1) of the following (in order of preference):

a.) By both Certified (or Registered) U.S. Mail - Return Receipt Requested and by First Class U.S. Mail.b.) By both Two-day or Overnight Priority mail with proof of mailing and by First Class U.S. Mail.c.) By Express/Overnight Mail with Delivery Confirmation and by First Class

MailNote: Refusal to accept Certified / Registered / Priority / Express mail shall not be grounds to claim lack of proper notification. USSF has held that the honest attempt to deliver a certified notice is an acceptable attempt to notify.

Note: Notification Methods “a.”, “b.”, and “c.” are much preferred over “d.” and “e.” d. Mailgram / Telegram / Fax with signed confirming copy.

e.) Personally delivered (Courier or other) with signed receipt for delivery.Note: The requirement of a signed confirmation of receipt establishes the date of delivery of the Notification Letter to the address of record of the parties involved.

4.) Notification shall contain the following:a.) A condensed statement of the cause of action.b.) A copy of the rules or procedures allegedly violated.c.) The possible consequences if the charges are found to be true.d.) The date, time, place, and type of hearing (Open or Closed) (Note: All original disciplinary hearings must be Open)e.) Limits or restrictions:

i.) Three (3) eyewitnessesii.) No character witnessesiii.) Testimony will be no longer than five (5) minutes and must be relevant to case being heard)

f.) Closed hearing:i.) Written testimony must be received five (5) days prior to hearingg.) Special requirements. Note - include special reminders. For example:

i.) "Minors must be accompanied-by a parent-or-legal guardianii.) "Written testimony submitted by persons not present at the hearing must be notarized and signed under penalty of perjury.”

Such statements can only be accepted if the author can either be present/available by telephone and can be questioned/cross examined. Written testimony alone shall be accepted only in the case of a closed hearing or appeal. These written statements shall not exceed the number of witnesses allowed for the hearing.

5.) One (1) complete copy of all documentation received by the hearing authority shall accompany the Notification Letter. Striking addresses, phone numbers and (in some cases) names from statement copies are acceptable (Keep originals intact).

6. One (1) complete copy of this Manual should accompany the Hearing Notification in an original

hearing. If copies are not on hand, do not delay Notification, but deliver the Manual with reasonably sufficient time for review prior to the hearing.

VI. HEARING COMMITTEESA.) Committee Composition

1.) Level 1:a.) Rialto Fire SC President (Chairman)b.) Rialto Fire SC Director of Coachesc.) Rialto Fire SC Secretaryd.) Two (2) Rialto Fire SC members selected by the Rialto Fire SC President that are not currently serving on the Rialto Fire SC Board of Directors.

2.) Level 2: The Cal South Board of Directors/Executive Committee shall constitute a Committee or any of the Cal South PAD Section Committees can act as directed by the Cal South Board of Directors designate, the Cal South Board of Directors, or the PAD Chairman. All Level 2 hearings shall follow the procedures in this Manual.

a.) If heard by the Executive Board, at least three (3) members of the Executive Board must be present.b.) If heard by the Cal South Board of Directors, all elected Board members

who have notparticipated in any hearing of the matter at a lower level may sit. A quorum as defined in the Cal South By-laws is required.c.) The Cal South Protest, Appeals, and Disciplinary Committees shall be

composed of:i.) Board of Directors Designate (liaison to the BOD)ii.) PAD Chairmaniii.) Four (4) to Six (6) Section Committees (each Section Committee shall consist of a Chairman and a pool of trained members)

3.) Level 3: The Cal South PAD Review Committee (made up of a Board of Directors designate and the Cal South PAD Chairman/Section Chairmen) may review any case for merit from a lower level. After review, a case may be remanded back to the hearing committee to be re-heard, passed to a new PAD committee, or defended on appeal.

4.) Contact USSF for more information.

B.) Conflicts of Interest

1.) Committees hearing protest, appeals and allegations of misconduct shall be composed of persons having no conflict of interest or direct association with the principle parties in the matter. Exceptions to this may be the District Commissioners or Members of the Rialto Fire SC Board of Directors who are exercising the normal duties of their office.

2.) No person shall hear a matter at more than one (1) level of jurisdiction.

3.) No person shall testify as a witness and sit on the hearing committee.

C.) Record of Proceedings

1.) The Chairman shall appoint a person to record the proceedings of any open hearing. It is not necessary that this person be a member of the committee.

VII. EVIDENCE AND TESTIMONYA.) Documentary Evidence (Written, Printed, Photographic, etc.)

1.) At the original hearing on any issue, all documentary evidence such as ID cards, team rosters, referee's game reports, letters, proof of age documents, photographs and other sources of written or printed information shall be original or official only. No photocopies or other reproductions shall be acceptable. Note: Appeal hearings may use copies of the original evidence packet unless the originals are required in order to assure a fair and accurate assessment of the case.2.) A Referee's game report is considered the official report of the game. The referee and/or assistant referee(s) shall be present at the hearing to give testimony or answer questions. If the referee is not available to testify, the hearing body may dismiss the charges, reschedule the hearing, or use other evidence and testimony available from other witnesses to render a decision.

3.) Written documents submitted where the author will not be present at the hearing shall contain an affirmation that the document is a true statement of the facts to the best of their knowledge and shall be notarized verifying the signature.

4.) Proof of age documents shall conform to the rules of the competition and CYSA-S Rules and

Regulations. Should further documentary proof be required, sufficient notice shall be communicated to the accused and ample time allowed to acquire additional proof even if a hearing on the matter must be delayed.

B.) Verbal Testimony & Witnesses

1.) Testimony shall be limited to the principle parties, eyewitnesses and recognized authorities on the subject (such as a registrar on registration matters). Character witnesses and other third-party witnesses shall not be allowed.

2.) All accused individuals have the right to confront their accusers. Written testimony shall not be

accepted in lieu of oral testimony for the accuser or the accused.

3.) Minors under the age of eighteen (18) must be accompanied by a parent or legal guardian.

4.) Testimony and the number of witnesses may be restricted with respect to time as stipulated in the Notification of Hearing sent to the principle parties.

5.) It shall be assumed that verbal testimony given before a duly authorized hearing committee shall be affirmed as true to the best knowledge of the witness.

1.) A Document Directory shall be established and maintained at each hearing level. All documentary evidence received and accepted shall be listed. The Minutes of the proceedings and a copy of the Decision Notification Letter shall be listed as the final documents for each hearing.

VIII. HEARING PROCEDURESA.) General Rules of Conduct

1.) Minors, whether they are witnesses or principles to the action, who have not attained the age of eighteen (18), must be accompanied by a parent or legal guardian.

2.) In the event of the defendant's inability, failure or refusal to attend after being properly notified, the hearing authority may either reschedule the hearing or proceed with the hearing using the evidence on hand to produce a decision.

3.) Plaintiffs and Defendants are allowed to remain in the hearing room throughout the testimony phase of the hearing. They must be allowed to examine any and all documentary evidence presented and accepted at the hearing.

4.) Copies of all written evidence (evidence packet) will be given to the hearing committee, defendant and plaintiff.

5.) All written evidence must be received by the Rialto Fire SC Director of Coaches no later than five (5) days prior to the hearing, unless the Chairman grants an exception of less than five (5) days. In the event that written evidence is submitted less than five (5) days prior to any hearing, a minimum of five (5) exact copies plus the original must be provided by the submitting party. The hearing committee will vote on its acceptance as proper evidence prior to deliberations (criteria to include pertinence as eyewitness accounts and requirements for documentary evidence - Section VII.). The defendant shall be given copies of all documentary evidence used in the hearing. (Witness addresses and phone numbers should be stricken from the copies). If unable to provide copies at the hearing, the defendant must be allowed to examine all evidence presented and receive any copies due him with the Decision Notification Letter.

6.) All questions/ statements from involved parties shall be addressed to the chairman who will ask the appropriate individual for an answer/rebuttal if the chairman deems the question pertinent.

7.) Witnesses may be recalled after initial testimony for further questioning and/or clarification of earlier testimony.

8.) An attorney or other advisor may counsel either party at a hearing; however, this advisor may not participate directly in the proceedings and will restrict their comments and advice to the party he is advising. An advisor may not question the witnesses, present oral arguments, interrupt or object to the conduct of the proceedings. A disciplinary hearing is an administrative hearing and not a court of law.

The chairman may order advisors out of the hearing room if they fail to properly conduct themselves according to this paragraph.

B.) Procedure for Conducting an Open Hearing1.) All parties, including witnesses, are brought into the hearing room. All parties and committee sign an attendance sheet and introduce themselves.

2.) Chair describes the case to be heard, including:a.) Names of parties involved including teams, league, etc.b.) Event involved (game, tournament, etc.)c.) Date of the incident.d.) Rule numbers and description of rules allegedly violated.

3.) Witnesses are excused to an outer room (unless the accused is a minor, even if the witness is his/her parent). Minors must have a parent or legal guardian with them at all times.

4.) If the Chairman grants an exception to the five (5) day written evidence submission requirement,he/she asks all parties for any additional written evidence they wish to submit. Adequate copies must be provided with the original and distributed to the committee and principle parties. The hearing body may rule on the acceptability of each document as evidence at this time. When all accepted written documentation is finalized, the Chairman shall number the evidence packet items (all written documentation accepted by the committee as evidence in the hearing) for future reference.5.) Testimony - Order of Presentation

Note: Testimony shall consist of an opening statement followed by questioning by the committee.

a.) Plaintiff presents caseb.) Witnesses for plaintiff called individuallyc.) Defendant presents cased.) Witnesses for defendant called individuallye.) Recall any witnesses as necessaryf.) Plaintiff closing statementg.) Defendant closing statement

6.) Open Hearing adjourned. Parties excused. Committee deliberates.

7.) Chairman should ensure that the evidence packet including decision letters and related documents are retained for at least one (1) year.

IX. DECISIONSA.) The members of a hearing committee shall decide each issue arising from the hearing. The Chairman may participate in the discussion of the evidence but shall vote only when necessary to break a tie vote on any issue.

B.) The decision of the committee and any disciplinary sanctions imposed shall respond only to the specific issues and allegations contained in the complaint.

C.) Any other issue and/or rule violation, which may become known during the course of the hearing, shall be referred to the convening authority. This referral may be accompanied with a recommendation for

appropriate action. Notice of the referral shall be included in the decision rendered to the principlesinvolved.

D.) Decisions shall be reduced to written form and should be forwarded to the principle parties within five (5) days of the conclusions of deliberations (Sundays and holidays excepted). If a suspension is imposed on a player or administrator (or if a suspension is over- turned on appeal), a copy of the decision shall be sent to the Cal South Office for inclusion on the Cal South Disciplinary List.

E.) Notification of the decision shall be communicated to the principle parties at the same time and by the same method. The methods sanctioned in Section V shall be used with consideration given to ensure adequate notice to the parties involved.Note: Special circumstances (especially time sensitive cases) may require the decision to be communicated by methods other than those in Section V. Nevertheless, in all cases an official written decision must be finally produced and forwarded to both parties per Section V.

F.) Notification of the decision shall include a statement of the procedure for appeal. This statement shallclearly indicate the appropriate level of jurisdiction, including the identity and address of the person and/oroffice to which the appeal must be directed in accord with the following:

Level 1: Appeals to Level 2, Cal South Appeals CommitteeLevel 2: Appeals to Level 4, USSF Appeals Committee

X. PENALTIES AND FINESA.) Penalties – Guidelines For Sentencing

1.) Penalties shall be in accordance with the following guidelines. These guidelines are intended to give maximum and minimum punishments.

a.) Referee Assault against an adult referee or adult assistant referee or any other adult reasonably construed to be a game official.

i.) Minimum mandatory one (1) year suspension unless there is serious injury which requires a five (5) year minimum suspension or more if warranted.

b.) Referee Assault against a youth referee who is under the age of eighteen (18) by an adult.

i.) Minimum mandatory three (3) year suspension or a five year (5) minimum suspension if there is injury or more if warranted.

c.) Referee Abuse against any referee or anyone reasonably construed to be a game Official.

i.) Minimum mandatory three (3) game suspension unless the abuse is deemed to be terrorist threats or gestures; remarks or actions are gender or racially demeaning. Maximum can be up to seven (7) years.

d.) Non-Referee Assault is physical assault by anyone, of anyone other than a referee.

i.) Minimum thirty (30) day suspension – Maximum seven (7) year suspension if there is serious physical injury.

e.) Falsification of Documents can be in any manner or matteri. Minimum ninety (90) day suspension. Maximum can be up to seven

(7) years.

f.) Lesser offense penalties should be decided based on committee judgment.

B.) Alternative Penalties – can and should be assigned in addition to other penalties or a combination ofseveral penalties except where there is a minimum, mandatory penalty as in assaults.

1.) Referee Certification – proof of completion to the hearing panel chairman and Rialto Fire Soccer Club BOD.

2.) Assignment to referee games (through any league or association) with proof of completion of assigned games to hearing panel chairman and Rialto Fire SC.

3.) Counseling – Anger Management; Gender Sensitivity, Racial Sensitivity with proof of completion of required number of hours to hearing panel chairman and Rialto Fire SC.

C.) Monetary Fines1.) Shall be assessed at the discretion of the hearing authority.

2.) Any individual assessed a fine shall be given a minimum of thirty (30) days to pay.

3.) Payment shall be payable to Rialto Fire SC by cashier’s check or money order.4.) Payments will be addressed and sent to Rialto Fire SC and clearly labeled as a

fine.

5.) Fine amounts:a.) Minimum amount shall be $50.b.) Maximum amount shall be $500.

6.) Any fine not paid by an individual within the time frames allowed by Rialto Fire SC may place that individual in Bad Financial Standing.

XI. APPEAL HEARINGSA.) Filing of Appeals

1.) Appeal rights are limited to only those parties to the original action that are adversely impacted by a lower-level decision (original hearing or previous appeal). No appeal shall be considered if filed by any other party. Exception: Parents or legal guardians may file on behalf of a minor child.

2.) Appeals must be filed in writing in accordance with Section IV.

3.) The filing of an appeal does not "stay" the decision or sanctions imposed.

B.) Scope and Authority of Appeal Committees/Hearings1.) Appeal hearings may be open or closed at the discretion of the appeal authority.

2.) An appeal hearing is not a retrial. The appeal committee shall limit itself to a review of the written evidence and testimony of the previous hearing. The procedures used at the lower level, its decision and sanctions imposed. Both parties involved may submit arguments in support of their positions.

3.) The appeal committee chairman shall review all appeals submitted and determine the legal standing of the appellant to appeal, that the appeal is filed with the proper authority, that the necessary copies are included, that the fee is paid and that the appellant states a factual basis for the appeal and the outcome desired.

4.) If an appeal meets the criteria of "3" above, the chairman shall notify both parties of the basis of the appeal, the format and date of the hearing and any other information deemed necessary to the proper conduct of the hearing. If not, the appeal shall be rejected and returned with the rationale for rejection.

5.) The committee shall use five (5) review standards to determine the reasonableness and fairness of the process accorded the appellant at the lower-level hearing.

a.) Some Credible Evidence:i.) Don't re-try the case or re-weigh the evidence. It is not relevant how the appeals committee would have voted on the evidence.ii.) Review must show "some credible evidence" which despite contrary evidence could lead a reasonable person to the same conclusion. "Some credible evidence" does not mean a preponderance of evidence. One witness or piece of evidence may outweigh the cumulative impact of all others.iii.) All evidence considered must be part of the original hearing record.

b.) Followed Established Rules and Procedures:i.) Followed rules and procedures of the League, State, USYSA, and

USSF.ii.) Followed customary disciplinary or appeals procedures.iii.) Adjusted to special situations, gave defendant reasonable procedural breaks to assure a fair process.Note: Minor procedural errors may be present. The committee must determine if the errors materially/significantly affected the appellant's right to fair process.

c.) Fair Process:i.) Notified in advance of all charges against them or proven reasonable attempts to notify them per this manual.ii.) Names, dates, places.iii.) Reasonable specificityiv.) Fair hearing, including chance to present the accused’ side of the

story.(a) Time limitations.(b) Witness limitations.(c) Scheduling of hearing.

v.) Notification of decision and appeal rights.
