Commerce and communication are now conducted online more than ever. Dispute resolution, in particular mediation, will likewise have to evolve, and SMC is increasingly moving to facilitate online mediations. In the face of this new reality, mediators will have to develop new skills and change some perspectives in order to thrive. In response to this, SMC is launching a new 4-part interactive online workshop, entitled “Mediation in an Online World”. This course looks at the issues of efficiency, practicality, and enforcement that counsel and mediators should consider when using various technology-enhanced platforms for mediation. It provides the training needed to refine and adapt existing mediation skills to be compatible with the increasing incorporeal digital forums around us. During the course, participants will have the opportunity to interact closely with trainers, as well as access to online dispute resolution coaches reviewing their performance during the roleplays and training exercises.

3 June This module will cover the relationship between OnlineDispute Resolution and online mediation. You will learn toidentify the advantages and disadvantages of onlinemediation and to know when it is appropriate forresolving disputes. You will also gain an understanding ofthe different online mediation platforms and the servicesthey provide.

10 June You will learn to recognise the ethical standards and coreskills required for online mediation. There will be a reviewof general mediation skills taught in Singapore MediationCentre's courses and also the adaption of offlinemediation techniques to the online environment.

17 June This module will guide you to prepare for online mediationand to manage its process. You will learn to develop timemanagement in asynchronous online conversations and tomanage mediation with largely synchronousconversations. Post-online mediation will also be covered.This is an interactive module with demonstrations.

Part 4- Communication Skills for Online Mediators

24 June You will learn to develop rapport and discourse in theonline environment and to build awareness of partypsychology and common online behavior. The module willalso cover strategies on the appropriate procedures andtechniques for communication in an online environmentand the pitfalls when communicating online.

Eunice is the Chief Executive Officer (CEO) of the Financial Industry Disputes Resolution Centre and has morethan 12 years of experience in mediating, managing and adjudicating disputes during a multi-faceted legal career.She is qualified as an Advocate and Solicitor of the Singapore Supreme Court and an Associate Mediator of theSingapore Mediation Centre (SMC). A First-Class Honours law graduate from the National University ofSingapore, Eunice served as a Justices’ Law Clerk in the Singapore Supreme Court and later obtained a Mastersof Law from Harvard. Eunice is also an Assistant Professor at the Singapore Management University and she hasconducted mediation training both locally and internationally and continues to coach students for mediationcompetitions. Her articles on mediation, evidence, and procedure appear in leading publications and academicjournals in her field.

Dorcas is an Assistant Professor in the Singapore Management University’s School of Law. She graduated fromthe National University of Singapore in 2003 with LL.B and obtained her LL.M from Harvard University Schoolof Law. She has been District Judge in the State Courts for almost seven years, where she conductedmediation and neutral evaluation for civil claims and minor criminal offences, as well as contributed to theoverall development of court ADR. Dorcas has also written and spoken extensively on ADR. Dorcas is acertified mediator with International Mediation Institute and Singapore International Mediation Institute. She isalso a mediator with Singapore International Mediation Centre and Singapore Mediation Centre. Dorcas hastaught negotiation and mediation courses in SMU, SMC and SIMC. She is a Fellow of the National Center forTechnology and Dispute Resolution (www.odr.info) and has also published articles on Online DisputeResolution.

Chern Yang is a banking and commercial matters litigator and also has extensive experience as a mediator. Hewas one of the youngest to be appointed as a Principal Mediator of the SMC and International Mediator ofSIMC. Chern Yang has attended advanced mediation training by the Straus Institute for Dispute Resolution,Pepperdine University School of Law and the Harvard Negotiation Institute, Harvard Law School and is Vice-Chairperson of the Society of Mediation Professionals (Singapore). He regularly teaches mediation for SMC andhas done so for the Judiciary in Brunei, Thailand, Myanmar, and Government Officials in Fiji. In 2015, ChernYang was awarded the Outstanding Court Volunteer (Advocate and Solicitor) by the State Courts of Singaporein recognition of his mediation work. The Legal 500 Asia-Pacific 2019 has praised Chern Yang as a “strategicthinker” and “a good team player”.

Professor Tania Sourdin is the Dean of the University of Newcastle Law School and was previously theFoundation Chair and Director of the Australian Centre for Justice Innovation (ACJI) at Monash University inAustralia. In the past two decades, she has conducted qualitative and quantitative research projects intoaspects of the dispute resolution and justice system systems in 12 Courts and Tribunals and six externaldispute resolution schemes within Australia. Other research has focused on justice innovation, technology,delay and systemic reforms. Professor Sourdin is the author of a number of more than 110 books, articles andpapers, that are focused on justice reform issues. She has won awards for her research work on behaviouralchange in the justice sector. She has also retained a part time practice focus and has worked for more than 30years as a lawyer, 25 years in various senior part time tribunal positions and as a mediator and has since 2014been the NBN industry dispute resolution advisor within Australia.

Colin Rule is Vice President for Online Dispute Resolution at Tyler Technologies. Tyler acquired Modria.com,an ODR provider Colin co-founded, in 2017. From 2003 to 2011, Colin was Director of Online DisputeResolution for eBay and PayPal. He has worked in the dispute resolution field for more than 25 years as amediator, trainer, and consultant. He is currently Co-Chair of the Advisory Board of the National Center forTechnology and Dispute Resolution at UMass-Amherst and a Non-Resident Fellow at the Gould Center forConflict Resolution at Stanford Law School. Colin has presented and trained throughout Europe and NorthAmerica for organizations including the Federal Mediation and Conciliation Service, the Department of State,the International Chamber of Commerce, and the CPR Institute for Dispute Resolution. He has also lecturedand taught at UMass-Amherst, Harvard, Yale, Stanford, Pepperdine, Southern Methodist University, and SantaClara University.
