RESUME OF BUSINESS TRANSACTED DURING THE FOURTHSESSION OF TWELFTH KERALA LEGISLATIVE ASSEMBLY
The summons dated 20th February 2007 for the Fourth Session of TwelfthKerala Legislative Assembly was issued to Members on 20th February 2007. TheSession commenced at 9.00 a. m. on Friday, March 2, 2007 and adjournedsine-die at 4.15 p.m. on Thursday, March 29, 2007. The House met on thefollowing days viz. March 2, 5, 6, 7, 8, 9, 12, 13, 14, 15, 16, 19, 20, 21, 22, 23,26,27, 28, 29 (20 days of sittings). The House transacted business for 121hours and 40 minutes.
Governor’s Address :
The Governor Shri R. L. Bhatia addressed the Members of the LegislativeAssembly at 9.00 a.m. on 2nd March 2007. The discussion on the Motion ofThanks to the Governor’s address commenced on March 5, 2007 withShri P. Jayarajan moving the following motion:—

The discussion on the Motion of Thanks lasted for 3 days, viz. March 5,6and 7, 2007. The motion was adopted on 7th March 2007. The House devoted15 hours and 18 minutes for the discussion on the Motion of Thanks and 53Members including Ministers participated in the discussion.
The Governor’s reply to the Motion of Thanks was reported to the Houseon 15th March 2007.

Reference Regarding the Boat Tragedy :
On March 5, 2007 the Speaker made a reference regarding the BoatTragedy which happened at Thattekad in Bhoothathankettu Dam reservoir onFebruary 20, 2007.
As a mark of respect to those who died in the tragedy, the Membersstood in silence for a while.582/2007.

Statements Under Rule 300 :
1. On March 15, 2007 Shri V. S Achuthanandan, Chief Minister made astatement under rule 300 informing the formation of the Agricultural DebtCommission in the State.

2. On March 23, 2007 Shri Kodiyeri Balakrishnan, Minister for Homeand Tourism made a statement under rule 300 about the attack of police stationin Kottakkal in Malappuram District by the N.D.F activists.
Half-an-Hour Discussion (Rule 49):
On 26th March, 2007 Shri K. M. Mani raised a discussion on a matter ofpublic importance arising out of the answer to starred question No. 29 dated 5thMarch 2007 on A D B Loan Agreement and spoke . Seven members took part inthe discussion.
Minister for Local Self Government and Rural development replied to thepoints raised in the discussion.

Obituary Reference:
On 28th March 2007 the Speaker made reference regarding the demise ofN.Sundaran Nadar, former Minister and Deputy Speaker M. K. Joseph,N. Subramonya Shenoy, K. P. Aravindakshan, A. V. Aryan, former Members ofthe Kerala Legislative Assembly and A. Sunnasahib, Former M. P. Lok Sabha.As a mark of respect to the deceased, the Members stood in silence for a while.
Question of Breach of Privilege :
1. On 29th March 2007 Speaker informed the House that the consent waswithheld for the following notices :

(i) Notice given by Shri T. N. Prathapan against the Minister forEducation and Culture, alleging that the reply given to thesubmission raised by Shri K. C.Venugopal on 26-6-2006 regarding theconferring of Minority status to six Professional Colleges wascontrary to the facts and misleading the House.
(ii) Notice given by Shri Thiruvanchoor Radhakrishnan against theMinister for Agriculture alleging that he had misled the House whilereplying to the Starred Question on 20-6-2006, that no person diedin Kasaragod due to the spraying of Endosulphan.
2. On 29th March 2007, Speaker informed the House that the noticegiven by Shri Simon Britto Rodrigues against Fr. A. J. Saviyans, the Principal,Sacred Heart College, Thevera who had informed that he would not participatethe inaugural meeting of the College Union by the M.L.A, was referred to theCommittee of Privileges and Ethics.
3. The Speaker also informed that following notices of Question ofBreach of Privileges were under consideration of the Chair :
(i) Notice given by Shri Joseph M. Puthussery against the ChiefMinister alleging that the reply given to the Unstarred QuestionNo. 6 on 18-9-2006 regarding the renovation of Ministerial residencewas untrue and misleading the House.

Reference of Bills to Subject Committees
Six Bills were referred to Subject Committee and Subject CommitteeReports on those Bills were presented to the House. Subject Committee Reportson two Bills, which were referred to Subject Committee during the third session,

Financial Business
1. Budget for the year 2007-2008
The Budget for the year 2007-2008 was presented on 9th March 2007.
2. Final Supplementary Demands for Grants for the year 2006-2007
On 5th March 2007, the Minister for Finance laid before the House FinalSupplementary Demands for Grants for the year 2006-2007.
Discussion and voting on the Final Supplementary Demands for Grants2006-2007 took place on 8th March 2007 and the House devoted 4 hours and 48minutes for the transaction of the Business.
The Kerala Appropriation Bill, 2007, in respect of the Final SupplementaryDemands for Grants for the year 2006-2007 was introduced in the Assembly on15th March, 2007. The Bill was taken into consideration and passed on the sameday.
3. Vote on Account
The Vote on Account for a period for four months (April to July 2007)was presented on 9th March 2007. The Minister for Finance moved the motionregarding Demands for Grants on Account towards defraying charges for themonths April to July 2007 on 19th March, 2007. Discussion and voting on theVote on Account were held on the same day. The House devoted 5 Hours and27 Minutes for this business. Ninteen (19) Members (including Minister forFinance) participated in this discussion.
The Kerala Appropriation (Vote on Account) Bill, 2007, in respect of theDemands for Grants on Account was introduced, considered and passed on 20thMarch 2007.

Private Members Bills and Resolution :
According to the calendar of sittings of the Fourth session of the TwelfthKerala Legislative Assembly, two days were set apart for private members’business. Of these March 16 was set apart for transacting private members’ billsand March 23 was set apart for transacting private members’ resolution. Duringthe session, the House devoted one hour and forty minutes intoto for privatemembers’ business.
Private Members’ Bill
During the session motions for leave to introduce 19 Bills and continuationof discussion of three Bills have came up before the House during the session.Among these only 8 Bills were discussed on March 16, 2007. The concernedMinisters opposed these bills. Discussions were inconclusive. Details regardingthe name of Members who moved the motions for leave to introduce bills andthe results thereof are given in Appendix X.
Private Members’ Resolution
During the day set apart for Private Members’ Resolution, i.e. March 23,2007, three resolutions came up before the House. The discussion on theresolution given notice of by Shri. M. Hamsa which was moved on 23rd March,2007 was concluded. Shri K. C. Joseph, Babu Paul and P. K. Abdu Rabbparticipated in the discussion. After the reply by the Minister for law,Parliamentary Affairs, Sports, Youth affairs and Ports, the resolution wasamended and adopted unanimously by the House.
The second resolution given notice of by Shri V. S. Sunilkumar was movedin the House and the discussion was not concluded.
The third resolution given notice of by Shri Thiruvanchoor Radhakrishnanwas not moved in the House.

THE SALIENT FEATURES OF THE BILLS PASSED
1. THE KERALA APPROPRIATION BILL, 2007
The Bill is introduced in pursuance of clause (1) of Article 204 of theConstitution of Inida read with article 205 therof, to authorise payment andappropriation of certain sums from and out of the Consolidated Fund of theState of Kerala required to meet the supplementary expenditure charged on theConsolidated Fund of the State of Kerala and the grants made by the LegislativeAssembly for the expenditure of the Government of Kerala for the financial year2006-07.
2. THE KERALA APPROPRIATION (VOTE ON ACCOUNT) BILL, 2007
The Bill is introduced in pursuance of Article 204 (1) of the Constitution ofIndia, read with Article 206 therof, to provide for the appropriation out of theConsolidated Fund of the State of Kerala of the moneys required to meet theexpenditure charged on the Consolidated Fund of the State and the grants madein advance by the Legislative Assembly in respect of the estimated expenditureof the Government of Kerala for a part of the Financial Year 2007-08.
3. THE KERALA HANDLOOM WORKERS’ WELFARE CESS BILL, 2007
The Hon’ble High Court of Kerala in its common judgment in O. P. No.6397/l996 (1) dated the 22nd February, 2002 has declared invalid section 4(2) ofthe Kerala Handloom Workers’ Welfare Fund Act, 1989 which provides forcontribution by the textile dealers. This has led to a considerable decrease inthe income of the Kerala Handloom Workers’ Welfare Fund, as the major sourceof the Fund was the contribution of textile dealers under section 4 (2) of thesaid Act.
2. In order to augment the resource of the Fund for attending variouswelfare activities to the beneficiaries, the Government have decided to enact alegislation to impose cess on the sales turnover of textiles effected within theState of Kerala.
3. Since the Legislative Assembly of the State of Kerala was not insession and circumstances existed for making urgent legislation to implement theabove decision, the Governor of Kerala had promulgated the Kerala HandloomWorkers’ Welfare Cess Ordinance, 2006 as Ordinance No. 4 of 2006 and was

published in the Kerala Gazette Extraordinary No.34 dated the 6th day ofJanuary, 2006.
4. A Bill to replace the said Ordinance by an Act of the Legislature couldnot be introduced in, and passed by, the Legislative Assembly of the State ofKerala during its session which commenced on the 3rd day of February, 2006and ended on the 21st day of February, 2006 and the session commenced onthe 14th day of March, 2006 and ended on the 15th day of March, 2006, and inorder to keep alive the provisions of the said ordinance, the Kerala HandloomWorkers’ Welfare Cess Ordinance, 2006 (24 of 2006) was promulgated by theGovernor of Kerala on the 17th day of March, 2006, and was published in theKerala Gazette Extraordinary No. 600 dated 17th day of March, 2006.
5. A Bill to replace the said Ordinance by an Act of the State Legislaturecould not be introduced in, and passed by, the Legislative Assembly of theState of Kerala during its session which commenced on the 24th day of May,2006 and ended on the 30th day of June, 2006 and in order to keep alive theprovisions of the said Ordinance, the Kerala Handloom Workers’ Welfare CessOrdinance, 2006 (29 of 2006) was promulgated by the Governor on the 5th dayof July, 2006 and was published in the Kerala Gazette Extraordinary No. 1123dated the 5th July, 2006.
6. A Bill to replace the said Ordinance by an Act of the State Legislaturecould not be introduced in, and passed by, the Legislative Assembly of theState of Kerala during its session which commenced on the 18th day ofSeptember, 2006 and ended on the 26th day of October, 2006 and in order tokeep alive the provisions of the said Ordinance the Kerala Handloom Workers’Welfare Cess Ordinance 2006 (46 of 2006) was promulgated by the Governor ofKerala on the 30th day of October 2006 and published in the Kerala GazetteExtraordinary No. 1710 dated the 30th day of October, 2006.
7. A Bill to replace the said Ordinance by an Act of the State Legislaturecould not be introduced in, and passed by the Legislative Assembly during itssession commenced on the 27th day of December, 2006 and ended on the 29thday of December, 2006, and in order to keep alive the provisions of the saidOrdinance, the Kerala Handloom Workers’ Welfare Cess Ordinance, 2007(7 of 2007) was promulgated by the Governor of Kerala on the 5th day ofFebruary, 2007 and published in the Kerala Gazette Extraordinary No. 206 datedthe 5th day of February 2007.
8. The Bill seeks to replace the Ordinance No. 7 of 2007 by an Act of theState Legislature.

4. THE KERALA PUBLIC ACCOUNTANTS (AMENDMENT ) BILL, 2007
At present there is no provision in the existing Acts or Rules for thespeedy realization of loss caused to Government by the Government LawOfficers during the period they hold office as such. The provisions contained inthe Kerala Public Accountants Act, 1963, are not adequate to proceed againstsuch persons for recovering the loss caused by them to Government. Forrecovering such loss, the only remedy is to file suits before competent courts.Government have, therefore, decided to include provisions in the Kerala PublicAccountants Act, 1963, to make the said Act applicable to persons who are orhave been Government Law Officers.
Though a Bill for the above purpose was published as Bill No. 228 of theEleventh Kerala Legislative Assembly, but the same could not be introduced in,and passed by the Eleventh Kerala Legislative Assembly. As the LegislativeAssembly was not in session and the above proposals had to be given effect toimmediately, it was decided to promulgate the same as an Ordinance.Accordingly, the Kerala Public Accountants (Amendment) Ordinance, 2005 (17 of2005) was promulgated by the Governor on the 18th day of October, 2005 andwas published in the Kerala Gazette Extraordinary No. 2255 dated the 19thOctober, 2005.
A Bill to replace the Ordinance No. 17 of 2005 by an Act of the StateLegislature could not be introduced in, and passed by the Kerala LegislativeAssembly during its session held on the 21st day of November 2005. Therefore,the Kerala Public Accountants (Amendment) Ordinance, 2006 (1 of 2006) waspromulgated by the Governor on the 2nd day of January, 2006 and published inthe Kerala Gazette Extraordinary No. 6 dated 2nd day of January, 2006.
A Bill to replace the Ordinance No. 1 of 2006 by an Act of the StateLegislature could not be introduced in, and passed by the Kerala LegislativeAssembly during its session which commenced on the 3rd day of February, 2006and ended on 21st day of February, 2006 and commenced on 14th March, 2006and ended on 15th March, 2006. Therefore, the Kerala Public Accountants(Amendment) Ordinance, 2006 (21 of 2006) was promulgated by the Governor onthe 17th day of March, 2006 and published in the Kerala Gazette ExtraordinaryNo. 597 dated 17th March, 2006.
A Bill to replace the Ordinance No. 21 of 2006 was published as Bill No. 3of Twelfth Kerala Legislative Assembly, but the same could not be introduced in,and passed by the Legislative Assembly of the State of Kerala during itssession which commenced on 24th May, 2006 and ended on the 30th June,2006. Therefore, the Kerala Public Accountants (Amendment) Ordinance, 2006(34 of 2006) was promulgated by the Governor on the 5th day of July, 2006 andpublished in the Kerala Gazette Extraordinary No. 1128 dated 5th July, 2006.

A Bill to replace the Ordinance No. 34 of 2006 was published as Bill No.25 of Twelfth Kerala Legislative Assembly, but the same could not be introducedin, and passed by the Legislative Assembly of the Sate of Kerala during itssession which commenced on 18th September, 2006 and ended on the 26thOctober, 2006. Therefore, the Kerala Public Accountants (Amendment)Ordinance, 2006 (53 of 2006) was promulgated by the Governor on the 30th dayof October, 2006 and published in the Kerala Gazette Extraordinary No. 1717dated 30th day of October, 2006.
A Bill to replace the Ordinance No. 53 of 2006 could not be introduced in,and passed by the Legislative Assembly of the State of Kerala during itssession which commenced on 27th December, 2006 and ended on the 29thDecember, 2006. Therefore, the Kerala Public Accountants (Amendment)Ordinance, 2007 (8 of 2007) was promulgated by the Governor on the 4th day ofFebruary, 2007 and same was published Kerala Gazette Extraordinary No. 214dated 5th February, 2007.
The Bill seeks to replace the Ordinance No. 8 of 2007 by an Act of theState Legislature.
5. THE TRAVANCORE-COCHIN HINDU RELIGIOUSINSTITUTIONS (AMENDMENT) BILL, 2007
The Travancore-Cochin Devaswom Boards are managed under theprovisions of Travancore-Cochin Hindu Religious Institutions Act, 1950. PresentTravancore-Cochin Hindu Religious Institutions Act, 1950 does not seem toensure social justice, as it does not envisage specific provisions for therepresentation of women and members belonging to Scheduled Castes/ScheduledTribes in the Devaswom Boards. Also the appointments in Travancore andCochin Devaswom Boards are entrusted with the Boards themselves which havealways called for much public criticism raising allegations of rampant corruption.Hence it was felt necessary to bring in transparency by entrusting theappointments of the Boards to Public Service Commission. There is no provisionin the Act to enquire into and report on the allegations of irregularities ofcorruption, maladministration or misappropriation of funds if any, by the Board.Hence provisions empowering the Government to appoint a Commission toinquire into the affairs of Devaswoms as and when required, especially, wheneverthere are instances of misappropriation or mismanagement on the affairs ofDevaswom is necessary.
For the smooth administration of the Board, Standing Committeesassigning specific functions have to be constituted from among the members ofthe Board. To ensure participation of devotees and local people, temple advisory

committees for particular temples are required to be constituted by includingnecessary provisions. The Board of Revenue being defunct, it necessitated thereplacement of the Board of Revenue by including a provision for theappointment of Principal Secretary to Government as Chief Commissioner. Theexisting Act does not contain provisions entrusting duties and functions of theBoard. Hence such a provision has to be inserted. The Honorarium of themembers of the Travancore-Cochin Devaswom Board have been prescribed wayback in 1990. Enhancement in the honorarium is required at this distance of time.Also the term of the Board will be two years instead of four years.
In view of the above, Government felt it necessary to bring about theamendments for the proper administration of Travancore-Cochin DevaswomBoards. As the Legislative Assembly was not in session and the proposals hadto be given effect to immediately, the Travancore-Cochin Hindu ReligiousInstitutions Amendment Ordinance, 2007 was promulgated by the Governor onthe 4th day of February, 2007 and the same was published as Ordinance No. 5of 2007 in the Kerala Gazette Extraordinary No. 204 dated 5th February, 2007.
The Bill seeks to replace Ordinance No. 5 of 2007 by an Act of the StateLegislature.
6. THE KERALA PANCHAYAT RAJ (AMENDMENT) BILL, 2007
As per sub-section (1) of Section 159 of the Kerala Panchayat Raj Act,1994, a Panchayat member have to submit within three months from the date ofassuming his office, a statement of assets and liabilities of himself and othermembers of his family, in the prescribed form before the competent authority asmay be authorised by the Government by notification in this behalf. But certainPanchayat Members in the State have not duly submitted the statement ofassets and liabilities before the concerned competent authority.
2. As per clause (q) of Section 35 of the Kerala Panchayat Raj Act, 1994,it is provided that, the Panchayat Members, who failed to submit the declarationregarding assets and liabilities as per the said Act, shall be disqualified tocontinue as a Panchayat Member.
3. As disqualifying of these persons may cause administrative difficultiesin the functioning of certain Local Self Government Institutions, the Governmenthave decided to amend the Kerala Panchayat Raj (Amendment) Act, 1994,suitably by incorporating provisions for protecting the Members of Panchayatsfrom the disqualification of not having submitted the statement of assets andliabilities, within the time-limit prescribed, for one time only.
4. The Bill seeks to achieve the said purpose.

7. THE KERALA MUNICIPALITY (SECOND AMENDMENT) BILL, 2007
As per sub-section (1) of Section 143 A of Kerala Municipality Act, 1994, aCouncillor have to submit within three months from the date of assuming hisoffice, a statement of assets and liabilities of himself and of other members ofhis family in the prescribed form before the competent authority as may beauthorised by the Government by notification in this behalf. But certaincouncillors of Municipalities/ Corporations in the State have not duly submittedthe statement of assets and liabilities before the competent authority.
2. As per clause (p) of Section 91 of the Kerala Municipality Act, 1994 itis provided that the Councillors who failed to submit the declaration of assetsliabilities as per the said Act shall be disqualified to continue as a Councillor.
3. As disqualifying of these person may cause administrative difficultiesin the functioning of certain Local Self Government Institutions, the Governmenthave decided to amend the Kerala Municipality Act, 1994 suitably byincorporating provision for protecting the Councillors of Municipalities from thedisqualification of not having submitted the statement of assets and liabilitieswithin the time-limit prescribed, for one time only.
4. The Bill seeks to achieve the above object.
8. THE KERALA DAIRY FARMERS’ WELFARE FUND BILL, 2007
In Kerala, about 14 lakhs of the families have adopted the cattle rearing asan occupation. But out of this about two lakhs of the dairy farmers alone havebecame members in the Primary Dairy Co-operative Societies. In Kerala out ofthe total milk production 17% is used for domestic purpose, 4% for manufactureof milk products and the remaining 79% is given for marketing. The proposal,“Dairy Farmers’ Welfare Fund” is intended to ensure the social security of thepoor Dairy Farmers who are engaged in the occupation of cattle rearing. TheGovernment have examined the matter in detail and have decided to enact alegislation for the above purposes. As the Legislative Assembly of the State ofKerala was not in session, and the above said proposal had to be given effectto immediately the Governor of Kerala had promulgated the Kerala Dairy Farmers’Welfare Fund Ordinance, 2005 as Ordinance No. 14 of 2005 on the 24th day ofAugust, 2005 and the same was published in the Kerala Gazette ExtraordinaryNo. 1959 dated the 24th August 2005. A Bill to replace the said Ordinance couldnot be introduced in and passed by the Legislative Assembly during its sessionwhich commenced on the 21st day of November, 2005 for want of time. Asdifficulties will arise if the provisions of the said Ordinance was not kept alive,hence in order to keep alive the provisions of the said Ordinance the Governorhad promulgated the Kerala Dairy Farmers’ Welfare Fund Ordinance, 2005 as

Ordinance No. 28 of 2005 on the 29th day of December, 2005 and the same waspublished in the Kerala Gazette Extraordinary No. 2808 on the 29th day ofDecember, 2005.
Though a Bill containing the same provisions was published as Bill No. 358of the Eleventh Kerala Legislative Assembly, the same could not be introducedin and passed by the Legislative Assembly during its session which commencedon the 3rd day of February, 2006 and ended on the 21st day of February, 2006and the session commenced on the 14th day of March, 2006 and ended on the15th day of March, 2006 for want of time. As the said proposals should begiven effect to immediately the Governor had promulgated the Kerala DairyFarmers’ Welfare fund Ordinance 2006 on the 17th day of March, 2006 asOrdinance No. 18 of 2006 and the same was published in Kerala GazetteExtraordinary No. 594 on the 17th day of March, 2006.
A Bill to replace the said Ordinance by an Act of Legislature could notbe introduced in and passed by the Twelfth Kerala Legislative Assemblyduring its session which commenced on the 24th day of May 2006 and endedon the 30th day of June, 2006, the Governor had promulgated the Kerala DairyFarmers’ Welfare Fund Ordinance, 2006 (36 of 2006) and the same waspublished in the Kerala Gazette Extraordinary No. 1130 dated the 5th day ofJuly, 2006.
A Bill to replace the said Ordinance by an Act of Legislature could not beintroduced in and passed by the Legislative Assembly of the State of Keraladuring its session which commenced on the 18th day of September, 2006 andended on the 26th day of October, 2006, the Governor had promulgated theKerala Dairy Farmers’ Welfare Fund Ordinance, 2006 (56 of 2006) and publishedthe same in the Kerala Gazette Extraordinary No. 1720 dated the 30th day ofOctober, 2006.
A Bill to replace the said Ordinance by an Act of the Legislature couldnot be introduced in and passed by the Kerala Legislative Assembly during itssession which commenced on the 27th day of December, 2006, and ended on the29th day of December, 2006, the Governor had promulgated the Kerala DairyFarmers’ Welfare Fund Ordinance, 2007 (20 of 2007) on the 4th day of February,2007 and published the same in the Kerala Gazette Extraordinary No.218 on the5th day of February, 2007.
The Bill seeks to replace the above said Ordinance by an Act of the StateLegislature.

9. THE KERALA ROAD SAFETY AUTHORITY BILL, 2006
Comparing the rate of road accidents in other States in India the rate ofroad accidents in Kerala is very high. Several measures have been adopted toreduce the rate of road accidents in the State by the various departmentsindividually and collectively. But these activities have not brought in theanticipated results so far. Contrary to the past, the increase in the number ofvehicles, the bad condition of the public roads, negligent driving of vehicles,driving after consumption of liquor, violation of traffic rules, unawareness of thetraffic rules to the pedestrians etc. are the main reasons for the road accidents.The absence of liaison of the various Departments, the inadequacy of funds andthe absence of a Centralised Authority for the effective implementation of theprogrammes of road safety are the major impediments. For reducing roadaccidents in Kerala and to find out a total wayout and to extend the consolationand relief activities including trauma-care to the persons involved in the roadaccidents, immediately, the Government are of the view that a Road SafetyAuthority and a Road Safety Fund shall be constituted. In order to implementthe said proposal and to frame a valid scheme for the purpose a suitablelegislation is necessitated.
2. Though a Bill containing the above proposals was published as BillNo. 227 of the Eleventh Kerala Legislative Assembly, the same could not beenacted for want of time.
3. As the Legislative Assembly of the State was not in session and theabove proposals has to be given effect to immediately, the Kerala Road SafetyAuthority Ordinance, 2006 was promulgated by the Governor on the 7th day ofJanuary, 2006 and the same was published as Ordinance No.7 of 2006 in theKerala Gazette Extraordinary No. 45 dated the 7th day of January, 2006.
4. As a Bill to replace the said Ordinance by an Act of the Legislaturecould not be introduced in, and passed by, the Legislative Assembly of theState of Kerala during its session which commenced on the 3rd day of February,2006 and ended on the 21st day of February, 2006 and in the sessioncommenced on the 14th day of March, 2006 and ended on the 15th day ofMarch, 2006. Therefore the Kerala Road Safety Authority Ordinance, 2006 (27 of2006) was promulgated by the Governor on the 17th day of March, 2006 andwas published in the Kerala Gazette Extraordinary No. 603 dated the 17th March,2006.
5. A Bill to replace Ordinance No. 27 of 2006 by an Act of the StateLegislature could not be introduced in, and passed by, the Twelfth KeralaLegislative Assembly during its session which commenced on the 24th May,2006 and ended on the 30th June, 2006.

6. Hence the Kerala Road Safety Authority Ordinance, 2006 (35 of 2006)was promulgated by the Governor on the 5th day of July, 2006 and waspublished in the Kerala Gazette Extraordinary No. 1129 dated the 5th July, 2006.
7. As a Bill to replace the said Ordinance by an Act of the Legislaturecould not be introduced in, and passed by, the Legislative Assembly of theState of Kerala during its session which commenced on the 18th day ofSeptember, 2006 and ended on the 26th day of October, 2006 and the KeralaRoad Safety Authority Ordinance, 2006 (55 of 2006) was promulgated by theGovernor on the 30th day of October, 2006 and was published in the KeralaGazette Extraordinary No. 1719 dated the 30th day of October, 2006.

10. THE KERALA FISHERMENS’ AND ALLIED WORKERS’WELFARE CESS BILL, 2006
As per sub-section (2) of section 4 of the Kerala Fishermen’s Welfare FundAct, 1985 (30 of 1985), a dealer shall contribute every year to the KeralaFishermen’s Welfare Fund one per cent of his sale proceeds in the year. AConstitution Bench of the Hon’ble Supreme Court in its judgment in Civil AppealNo.12788 of 1996 declared that the said section is unconstitutional on the groundof lack of legislative competency of the State Legislature. The Court has statedthat the nexus between the fishermen and the purchaser/exporters are notsufficient to burden a purchaser/exporter with the in post or levy of thecontribution under the said section as there is no relationship of employer andemployee between the contributor and the beneficiary. As a result of thejudgment in the said case, the Kerala Fishermen’s Welfare Fund Board is not ina position to levy the contribution from the purchasers/exporters of fish andhence it has lost its financial stability.
2. The Government have examined the matter and consider it necessary tomake a law to levy and collect cess from the dealers on the sale proceeds offish and fish products with a view to augment the resources of the KeralaFishermen’s Welfare Fund.
3. Though the Bill containing the above proposal was published as BillNo. 287 of the Eleventh Kerala Legislative Assembly, the same could not beintroduced in and passed by the Assembly for want of time.

4. As the Legislative Assembly of the State of Kerala was not in sessionand the said proposal has to be given effect immediately. The Kerala Fishermenand Allied Workers’ Welfare Cess Ordinance, 2006 was promulgated by theGovernor on the 7th day of January, 2006 and was published as the OrdinanceNo. 8 in the Kerala Gazette Extraordinary No. 46 dated the 7th day of January,2006.
5. A Bill to replace the said Ordinance by an Act of the State Legislaturecould not be introduced in and passed by the Legislative Assembly of the Stateof Kerala during its session commenced on the 3rd day of February, 2006 andended on 21st day of February, 2006 and the session commenced on the 14thday of March, 2006 and ended on the 15th day of March, 2006. Therefore theKerala Fishermen and Allied Workers Welfare Cess Ordinance, 2006(28 of 2006) was promulgated by the Governor on the 17th day of March, 2006and the same was published in the Kerala Gazette Extraordinary No. 604 datedthe 17th March, 2006.
6. A Bill to replace the said Ordinance by an Act could not be introducedand passed by the Twelfth Kerala Legislative Assembly during its session whichcommenced on the 24th May, 2006 and ended on the 30th June, 2006 andtherefore The Kerala Fishermen and Allied Workers Welfare Cess Ordinance,2006 (37 of 2006) was promulgated by the Governor and the same was publishedin the Kerala Gazette Extraordinary No. 1131 dated the 5th July, 2006.
7. A Bill to replace the said Ordinance by an Act of the State Legislaturecould not be introduced in and passed by the Legislative Assembly of the Stateof Kerala during its sessions commenced on the 18th day of September, 2006and ended on the 26th day of October, 2006 therefore The Kerala Fishermenand Allied Workers Welfare Cess Ordinance, 2006 (57 of 2006) was promulgatedby the Governor on the 30th day of October, 2006 and the same was publishedin the Kerala Gazette Extraordinary No. 1721 dated the 30th October, 2006.
8. The Bill seeks to replace the said Ordinance by an Act of the StateLegislature.
